This article addresses recent developments in third-party funding that occurred during late 2012 and early 2013 in the three leading jurisdictions: Australia, the United Kingdom and the United States. The most important developments are the following. On 22 April 2013, the Australian Securities and Investment Commission (ASIC) issued regulatory guidelines clarifying the status of funders with respect to ASIC's regulations and detailing how funders should manage conflicts of interest and handle certain provisions of their funding arrangements. In the United Kingdom, the Jackson Reforms took effect on 1 April 2013, bringing sweeping changes to the allowable fee agreements, discovery rules and cost allocations in that jurisdiction. In the United States, at least twenty pieces of legislation have been filed in various state legislatures since the beginning of 2013 aimed at regulating the third-party funding industry in a variety of different ways. Thus, in these three leading third-party funding jurisdictions, it appears that the legislatures - rather than the courts - are seeking to lead the way in shaping the future of the third-party funding industry.

Ranked choice voting (RCV) is experiencing a surge of interest in the United States, highlighted by its 2018 use for Congressional elections in Maine, the first application of a ranked ballot for national-level elections in American history. A century ago, the same system was introduced in another federal, two-party continental-sized democracy: Australia. RCV’s utility as a solution to inter-party coordination problems helps to explain its appeal in both countries, underscoring the potential benefits of a comparative analytical approach. This article examines this history of adoption and then turns to a comparison of recent RCV elections in Maine with state elections in New South Wales and Queensland, the two Australian states which share the same form of RCV as that used in the United States. This comparison shows how candidate and party endorsements influence voters’ rankings and can, over time, promote reciprocal exchanges between parties and broader systemic support for RCV. Such cross-partisan support helps explain the stability of RCV in Australia, with implications for the system’s prospects in the United States.

A generation of scholars has depicted the premiership of Labor Party leader Gough Whitlam as a watershed in Australian foreign policy. According to the prevailing consensus, Whitlam carved out a more independent and progressive role in international affairs without significantly endangering relations with Western-aligned states in East and Southeast Asia or with Australia's traditionally closest allies, the United States and the United Kingdom. This article takes issue with these views and offers a more skeptical assessment of Whitlam's diplomacy and questions his handling of Australia's alliance with the United States. In doing so, it shows that Whitlam, in his eagerness to embrace détente, reject containment, and project an image of an allegedly more progressive and independent Australia, in fact exacerbated tensions with Richard Nixon's Republican administration and caused disquiet among Southeast Asian countries that were aligned with or at least friendly toward the West.

Election outcomes are now, more than at any time in the past, determined by voters' assessments of party leaders. However, despite its potential importance, little is known about the differences in how men and women view political leaders. This article uses recent Australian, British, and U.S. survey data to examine gender differences in the evaluations that voters make of party leaders. The results show that there are comparatively few gender differences in the personal qualities that voters rate as important, with the exception of British Labour's Neil Kinnock, who was rated more highly by men, and Bill Clinton, who was rated more highly by women. However, what gender differences in leader evaluations that do exist are mediated by partisanship and views on economic performance. In both Australia and the United States, gender significantly affects the vote, but in opposite directions. The results suggest that gender may have a more important future role in elections in these three countries.

Although membership is declining, parties continue to perform roles central to democratic governance in modern societies. Given this seeming paradox, we suggest that partisan identification, in complementing studies of formal membership, is a promising way of assessing the strength of parties’ democratic linkage. Using data from an original survey of voters in Australia and the United Kingdom, we analyse the participatory and demographic profiles of party supporters. We show that there are significant differences between supporters and those not committed to any party, as well as between supporters based on the strength of their party identification, substantiating the idea that parties can be conceptualized as a series of concentric circles of increasing engagement but declining representativeness. Stronger supporters are more likely to engage with parties online, volunteer and donate, but are older, more likely to be male and less likely to be foreign-born. Our findings have important implications for democratic practice as parties seek to expand and rejuvenate their networks of affiliates.

Abstract A comparison of the behaviors of two creative populations operating within cross-media environments in the United States and Australia tests the comparative effect of the two nations' legal environments on the range of creative expression and on costs of production in increasingly digitized production processes. The U.S. creators have access to the flexible and expansive exception of fair use, while Australian creators' ability to use third-party copyrighted content are far more constrained. While availability of copyright exceptions plays a crucial role, other factors including demographics, disciplinary norms, and social inequality may also be important in creative practices and professions.

Abstract The Covid-19 pandemic produced more significant immediate intergovernmental conflict in the U.S. than in Australia and Canada. This article considers three variables for this cross-national divergence: presidentialism versus parliamentarism; vertical party integration; and strength of intergovernmental arrangements. We find that the U.S. presidential system, contrary to parliamentarism in Canada and Australia, provided an opportunity for a populist outsider skeptical of experts to win the presidency and pursue a personalized style that favored intergovernmental conflict in times of crisis. Then, the intergovernmental conflict-inducing effect of the Trump presidency during the pandemic was compounded by the vertical integration of political parties, which provided incentives for the President to criticize Democratic governors and vice-versa. Third, the virtual absence of any structure for intergovernmental relations in the United States meant that, unlike Australian states and Canadian provinces, American states struggled to get the federal government’s attention and publicly deplored its lack of leadership.

Objectives: Australia has been at the forefront of appropriate early intervention. Prevention of mental illness in infants by early identification and intervention in the mental health of their mothers has stalled since the cessation of funding through the National Perinatal Depression Initiative (NPDI, 2009–2015). Whilst screening for maternal mental illness has been widely implemented throughout Australia during the last two decades, services are now diminishing and great opportunities to ride the crest of a wave for appropriate mental illness intervention are receding. Reviews of history and interventions internationally may help guide future directions. Conclusions: Advocacy through across-agency and across-political-party support has been markedly successful for perinatal and infant mental health in the United Kingdom. A solid foundation exists in Australia. Australian psychiatrists have the ability to continue to change the face of prevention and early intervention.

In the Federal Elections of August 1943 the United Australia Party(UAP), which had been in office for nearly ten consecutive years suffered a resounding defeat and the result was a landslide for Labor, giving it an absolute majority in both Houses. This thesis traces the course of the disintegration of the United Australia Party to try to fill a gap in the historiography by explaining how and why an apparently popular political party was so categorically rejected by the electorate in 1943 that it subsequently vanished from the political scene as if it had never existed.

This study examines the impact of governing parties in changing patterns of income inequality in three liberal democracies with 'Westminster' systems - Australia (1981-1990), the United Kingdom (1979-1986) and Canada (1971-1981). Extensive analysis of the Luxembourg Income Study datasets for these countries and periods suggests that structural factors, such as changes in the market sphere or alterations in the demographic profiles, can account for only a part of the overall inequality trends in these periods. By using income decomposition analyses, this study indicates that government redistributive policies played an important role in changing inequality trends. Governments in all three countries are single-party operations, and policy responds strongly to partisan processes and considerations. The main question involved in assessing policy changes is therefore why party actors may be willing to increase or decrease income inequality. Applying conventional 'unitary' models of party behaviour (such as the median voter convergence hypothesis) to try and explain decision-making on income inequality also cannot explain these examples. It seems that redistributive policies can only be understood by taking account of the bargaining processes which take place within the organization of the party in power. Explanations of how parties intervene on income inequality should explicitly incorporate the organizational dimension as a key to their behaviour.

The purpose of this thesis is to examine third party loss in a number of jurisdictions. Third party loss is the loss suffered by persons not party to a contract as a result of the violation of a contractual obligation. Compensation poses a problem when the violation is careless as opposed to intentional and the loss that is caused is purely economic. The starting point of this work is German law where, in order to protect third parties, two contract-based mechanisms have been judicially developed, because the law of delict, based on a system of restrictively enumerated, statutory delicts, provides no protection for pure economic loss. The two mechanisms are Drittschadensliquidation and contract with protective effects vis-á-vis third parties concerns the violation of protective duties which do not concern performance, affecting personal, property, and/or financial interests of the third party not related tot he performance. The mechanisms were developed mainly in the course of the present century and have expanded to numerous applications, for instance: indirect agency; expert opinion, including valuators' and auditors' liability; attorney liability; liability for services, works, medical treatment. The mechanisms, debated vigorously by theorists, are remarkable examples of judicial law-making. The mechanisms of German law, their applications, the theoretical bases, the relationship between them and the judicial activism that led to their formulation are presented and analysed. In Greek law, where the law of delict is based on a general clause and not on enumerated delicts, protection in delict for pure economic loss probably exists. Therefore, as in a similar system, that of France, third party loss is not a distinct, pressing problem. On the other hand, there are certain doubts whether delictual protection is certain or whether it is the best option. Thus the possibility of contractual solutions is worth examining, even if only to reject their relevance to Greek law. In American law, in comparison to other common law jurisdictions, more efficient protection for third parties exists. The third party beneficiary rule, a contractual mechanism to confer benefits to non parties, has expanded impressively. Moreover, liability in tort for pure economic loss is more extended than elsewhere in the common law world but, nevertheless, is substantially deficient. It is argued that contract could expand to cover cases of third party (pure economic) loss and that this is the most viable and preferable way for improvement. Despite the existence of a general clause in delict and the jus quaesitum tertio (a means to confer benefits on non parties by contract), Scots law is seriously handicapped in dealing with pure economic loss cases due to the influence of English law. It is argued that the Scots law of pure economic loss is not identical to English law and that reform by increasing the role of the contract is desirable and manageable, provided the necessary judicial determination is present. Among Commonwealth major systems, Canadian, Australian, New Zealand and English laws, the latter stands as an exception, clinging to traditional doctrines and applying, with few exceptions, an exclusionary rule to pure economic loss claims. In the other jurisdictions, otherwise so closely connected, the law is distinctly different. It is difficult to evaluate this different approach to pure economic loss. Commonwealth systems should also contemplate reform tending towards encouraging contract-based approaches. Most likely, this reform will require more than judicial law-making. The conclusion focuses principally on the desirability of an increased role for contract in third party loss cases, on the advantages of a more unified civil liability system - a system with greater intechangeability between contract and delict - and on the importance of judicial assertiveness in the process of keeping the law up-to-date and responding to new social needs.

Since World War Two the world has undergone a profound economic and political transformation, from an international economy and internationalist politics to a global economy and globalist politics. The Bretton Woods international financial institutions have 'structurally adjusted' Third World countries, and similar structural reforms have occurred in First World countries. The environmental consequences of globalising economic activity have been severe and also global; the social consequences of the structural reform process are equally severe. National sovereignty has been radically compromised by globalisation, and previous nationally-based initiatives to manage the activities of capital in order to mitigate its negative impacts on society and the environment, such as social democrat/labour politics, have ceded their authority to globalism. Green parties have arisen to contest the negative environmental and social consequences of the global expansion of capital, and are replacing socialist parties as a global antisystemic political force. Green politics had its origins in the world-wide 'new politics' of the New Left and the new social movements of the 1960s, and the world's first two Green parties were formed in Australia and New Zealand in 1972. A general history of the global forces which gave rise to Green politics, and a specific history of the first two Green parties, demonstrate the interplay of global and local political forces and themes, and provide an opportunity to redefine the core elements of Green politics.

Over the past three decades the notion that western party-systems remain frozen has been challenged by the apparent onset of post-industrial trends which threaten the support base of old political parties. In particular, scholars rejecting the freezing proposition have identified a rise in aggregate electoral volatility, a decline in group voting loyalties and the emergence of a New Politics. This study argues that the party systems of Australia, Britain and the United States remain characterised by aggregate electoral stability, despite a weakening in the extent to which electoral choice is structured by long-term political predispositions. In addition long-term electoral stability has occurred despite considerable social and attitudinal changes with the potential to alter significantly the underlying balance of party support. Through the use of national election studies collected between the mid 1960s and early 1990s in each country, it is argued that the adaptive strategies of political parties represent an intervening variable in the extent to which societal change is translated into electoral change. The study concludes that the so-called dealigning trends, such as the decline of group voting loyalties and the emergence of a New Politics, are an outcome, in part, of the strategic decisionmaking of old party leaders seeking to preserve their party's long-term persistence. The extent to which parties succeed or fail is not a system determined factor, but rather an outcome of the ability of a party organisation to adapt to societal changes which threaten its traditional support base.

This thesis investigates the extent of the wage differentials between females working full- and part-time in Australia and the United States, the causes of these differentials and the effect these differentials have on the aggregate ratio of female to male wages in both countries. The thesis contributes to existing knowledge in three ways. Firstly, it documents the magnitude and sign of the male/female wage ratio and the full/part-time wage ratio for countries which include Australia and the United States. For both Australia and the United States, the average male wage per hour was estimated to exceed the average female wage per hour. For the United States, consistent with evidence from other international evidence, wages of full-time workers were estimated to exceed those of part-time workers. However, for Australia, part-time hourly wages were estimated to exceed full-time hourly wages by around 20 percent. Secondly, this thesis draws upon the theories of human capital, segmented labour markets and efficiency wage to develop a model which explains individual's wages. From this model, the roles of human capital endowments, sample selection, occupations and institutions in determining the wage differential between full- and part-time workers was estimated. For Australia, differences in the endowments were not found to be an important factor in determining the causes of the wage differential between full- and part-time workers. For the United States, however, differences in the level of endowments were estimated to be important in explaining the wage differential between females working full- and part-time. Sample selection effects were estimated to be important in explaining the wage differential between females working full- and part-time in both countries. This effect was interpreted as indicating that in Australia, higher hourly wages are inducing ’better' quality workers into the part-time labour market. Unexplained differences (such as discrimination and productivity differences) were also found to be important in explaining the wage differential between females working full- and part-time in the United States, but not in Australia. This finding lead us to examine the role of occupations and institutions in explaining the full- and part-time wage differential. Thirdly, an estimate of the effect of part-time work and wages on the overall wage ratio between males and females was undertaken. For Australia, including part-time workers explicitly into the gender wage analysis decreased the gender wage differential estimate derived for full-time workers by 5 percentage points to 19 percent. For the United States, explicitly including part-time workers into an estimate of the gender wage differential increased the estimate from the full-time gender wage analysis by 4 percentage points to 40 percent.

The Commonwealth of Australia is a federation of six states, whose constitution was enacted by the United Kingdom Parliament in 1900, when Australia was part of the British Empire. The six states had previously been separate British colonies, each with its own constitution that continued in force after 1900, although subject to the new federal constitution. The authority of the United Kingdom Parliament to change Australian law was not formally terminated until 1986, when the Australia Act was passed by both the United Kingdom and the Commonwealth Parliaments. The fundamental documents of Australian constitutional law therefore comprise the federal constitution, the Australia Act, and the six state constitutions. This chapter looks at Australia's constitution and its origins and structure, judicial interpretation of the federal constitution, judicial review, High Court and its judges, problems and methods of constitutional interpretation, causes of interpretive difficulties, sources of interpretive principles, current interpretive methodology, extrinsic evidence of framers' intentions and purposes, ‘structural’ principles and implications, separation of powers, balance between legitimate and illegitimate creativity, and institutional and cultural factors underlying constitutional interpretation.

Oceania and Australasia are relatively recent and externally imposed terms. The term Australasia refers collectively to the lands south of Asia, or present-day Australia and New Zealand. Oceania refers to the Pacific Islands east of present-day Indonesia and the Philippines across to Pitcairn Island in the southeast Pacific and also includes the western half of the island of New Guinea, which is now part of Indonesia. These islands are generally divided into three geographical areas: Melanesia, Micronesia, and Polynesia. Present-day national borders cut across previous indigenous exchange areas or unite peoples with little previous sense of collective identity, especially in the larger Pacific Island nations of southwest Oceania. The region's value and prime relevance to world history lies in its comparative value in terms of European explorers and traders, and subsequent settler societies and their relations with, and impact upon, indigenous peoples.

All federal systems face an internal tension between divisive and integrative political forces, striking a balance between providing local autonomy and representation on one hand and maintaining an integrated political community on the other hand. How multi-level systems strike this balance depends on the development of styles of either integrated politics, which creates a shared framework for political competition across the units of a federation, or independent politics, preserving highly autonomous arenas of political life. This book argues that the long-term development of integrated or independent styles of politics in multi-level systems can be shaped by two key elements of federal institutional design: the degree of fiscal decentralization, or how much is ‘at stake’ at each level of government, and the degree to which the allocation of policy jurisdiction creates legislative or administrative interdependence or autonomy. These elements of federal institutional design shape integrated and independent politics at the level of party organizations, party systems, and voter behaviour. This book tests these arguments using a mixed-method approach, drawing on original survey data from 250 subnational party leaders and aggregate electoral data from over 2,200 subnational elections in seven multi-level systems: Canada, the United States, Australia, Austria, Germany, Switzerland, and Spain. It supplements this with configurational analysis and qualitative case studies.

AbstractThis chapter examines the policy context and administrative systems associated with the resumption of assisted child migration from the United Kingdom to Australia in 1947. During the Second World War, the Australian Commonwealth Government came to see child migration as an increasingly important element in its wider plans for post-war population growth. Whilst initially developing a plan to receive up to 50,000 ‘war orphans’ shortly after the war in new government-run cottage homes, the Commonwealth Government subsequently abandoned this, partly for financial reasons. A more cost-effective strategy of working with voluntary societies, and their residential institutions, was adopted instead. Monitoring systems of these initial migration parties by the UK Government were weak. Whilst the Home Office began to formulate policies about appropriate standards of care for child migrants overseas, this work was hampered by tensions between the Home Office and the Commonwealth Relations Office about the extent to control over organisations in Australia was possible.

AbstractExpectations of fathering have changed over the past few decades, and it appears fathers are increasingly participating in care activities. Despite this, the capacity for Australian men to participate in child rearing is impeded by limitations around flexible working arrangements. The link between fathering, masculinity, paid work, and the persistent expectation that fathers will be the financial providers within the family unit is examined in this chapter. The influence of this gendered expectation on Australian policy development is briefly discussed, and some recommendations provided for policy makers, organizations, and fathers.

Municipal politics offers an opportunity to assess the impact of the Great War on the lives of workers in Australia and the United States and the fortunes of labor and socialist parties. Although both countries lay on the periphery of the European conflict, each contributed significant manpower and economic resources to the war effort. Each also faced the disruptive impact of the war on their economies. Locally soaring prices, spot unemployment, housing shortages, and the loss of breadwinners’ income put great stress on working-class families that labor and socialist parties sought to address. In the pre-war period, these parties in both countries contested for power in cities but more successfully in the United States, despite limits on municipal home rule. A pre-war surge in strike activity was also more intense in the United States. These circumstances shaped the local politics of the war years in which locally mobilized anticonscription and antiwar activity in Australia surged at the local level. In the United States, urban elites successfully used socialist opposition to the war to severely repress and ultimately disable socialists’ capacity to maintain their pre-war strength in cities. As a consequence, while US socialists’ gains eroded during and after the war, in Australia successful local mobilization against conscription enabled the Labor Party to make gains in municipal as well as state and national politics. The war dramatically changed the political landscape for labor and socialists in both countries—for the worse in the United States and for the better in Australia.

Export education forms a major part of the Australian economy. Australian universities are now not only accepting overseas students into Australian campuses; they are setting up overseas-based campuses. This is often through an arrangement with a local educational institution or organisation. Subjects in these institutions are delivered by a combination of Victoria University Australian-based staff and local faculty. One of the primary programs being delivered overseas by many Australian institutions is the Master of Business Administration (MBA). This paper examines the delivery of the core information technology units, Management Information Systems (MIS), by Victoria University in Australia and overseas (in Bangladesh). The structure of the MBA at Victoria University in Australia and overseas is examined and the MIS subject explained. Results of a survey of MBA students’ views of the content of MIS, conducted in Australia (1997-2000) and Bangladesh (2001) are reported. There is little difference in the attitudes of students of both countries in relation to the topics covered in the subject, nor on the breakdown of the subject between ‘hands-on’ applications and more formal instruction. There are some differences in relation to the level of Internet and e-mail usage, with Australian students tending to use these technologies on a greater basis as a proportion of their overall computer usage.

In 1999, the United States Navy implemented an LM2500 High Pressure Turbine Blade Refurbishment Program. Traditionally, the US Navy had replaced high pressure turbine components each time an engine was removed from a ship during its depot overhaul visit. Following successful testing of several Rainbow rotors built up with refurbished LM2500 blades, as well as experience gained by the Royal Australian Navy, refurbishment of stage 1 and 2 high pressure turbine blades was adopted vice the replace with new part strategy previously utilized. This paper takes a fresh look at the blade refurbishment effort from two perspectives, first, an updated technical assessment is made of Rainbow rotor components as well as parts which were implemented as part of the refurbishment program to evaluate their current (2009) condition and define service life expectations. Secondly, a financial assessment is made of the program itself, defining the cost avoidance of refurbishing customer owned blades versus the cost to procure new components. The financial analysis will also include commentary on risk mitigation based upon the hundreds of thousands of operating hours on these components have acquired while deployed at sea.

Abstract Historically in Australia, mixed Construction and Demolition waste, and Commercial and Industrial waste has been traditionally landfilled. As environmental impacts of landfilling is becoming more evident New South Wales policy makers and innovators have begun exploring an incineration strategy to use such waste to generate electricity. The objective of this study is to utilise life cycle assessment to evaluate GHG emissions from this waste treatment strategy and the environmental impact of a case study facility, in Sydney Australia. The system boundary includes the thermal treatment of waste through incineration, the electricity generation from the steam turbine and air pollution control processes involved within. The functional unit is based on 1 tonne of input mixed Construction and Demolition waste and Commercial and Industrial waste. GHG emissions are calculated and the result shows that the facility generates 0.994 MWh/tonne waste and 1.16 tCO2e/MWh electricity. This emission is lower than a brown coal fired powerplant emission factor 1.31 tCO2e/MWh. The results from this study assists understanding and policy making for the future of Energy-from-Waste as part of the generation mix in New South Wales, Australia.

Social justice school leadership as a concept, while familiar in the United Kingdom, Australia, New Zealand, Canada, and the United States school leadership literature, is not widely recognized in other parts of the world. Social justice school leadership appropriately differs from one culture to another and is always context-specific to a particular school setting, great organization structure or country. However, social justice is a necessary and fundamental assumption for all educators committed to combating ignorance and the promotion of student global citizenship as a central theme of school practices. The purpose of this study was to provide understandings of ways that selected social justice school leaders from three countries; Lithuania, Latvia, and Estonia conceive of and practice social justice in leading their schools. The manuscript describes how six Baltic directors, identified by local educators on the basis of research conducted by the International School Leaders Development Network (ISLDN) as social justice school leaders, responded to interview questions related to their practice. Four directors were Latvian and one each from Lithuania and Estonia. Limitations to the study include basing conclusions upon a single (or in one case, several) interview(s) per subject and limitations on generalizability of qualitative exploratory case study. By definition, every case study is unique, limiting generalizability. Interviews were thematically analyzed using the following definition: A social justice school leader is one who sees injustice in ways that others do not, and has the moral purpose, skills, and necessary relationships to combat injustice for the benefit of all students. Findings reveal strong application of values to identify problems based on well-being of all students and their families and to work collaboratively with other educators to find solution processes to complex issues related to social justice inequities. As social justice pioneers in their countries, these principals personify social justice school leadership in countries where the term social justice is not part of scholarly discourse.

The Faculty of Business and Law at Deakin University (Victoria, Australia) decided to dispense of all printed post-graduate learning materials and replace them with CD-ROMs from the commencement of the 2006 academic year. In addition, CD-ROMs were developed for a limited number of undergraduate units as part of a future delivery plan for this cohort of students. The following paper describes this project, the reasons underpinning it, and the processes the Faculty adopted to implement the project. The project is ongoing and part of a broader agenda for change that will see an even greater application of electronic technology to teaching and learning within the Faculty. Although only initial findings and observations are possible at this stage, the project provides a basis for longitudinal reporting and, potentially, a guide for other institutions who may be considering such a move. The paper reports on these observations and on those in the educational development arena and suggests that the Faculty will need to learn from these initial experiences and evaluate the project in greater depth to guarantee a smooth transition for all stakeholders.

Public services that satisfy the interest of the community in contemporary conditions are provided by administrative organizations, market entities or an administrative organization and a private entity together through various arrangements, all depending on the generally accepted conception of the role of the state in public administration. Some of the countries to be analyzed went much deeper into management than other countries because governments realized that they did not have to provide goods and services to citizens if they could not guarantee that services would be provided fairly, which contributed to the rapid and effective public service reform. The state (administration) becomes (remains) only the coordinator of public policies that ensures fairness in providing services to citizens, and ceases to be its undisputed immediate executor. In this paper, the author analyzes the impact of new public management on the privatization of public services in the United States and in Westminster countries (Canada, United Kingdom and Australia). Private provision of public services has long been a part of efficient and effective governance in these countries. In the midst of new public management reforms that have spread around the world since the 1980s and beyond, there is a growing interest in private governance and ownership of key public services at all levels of government. A key question for governments considering privatizing public services is whether private firms provide higher quality services than their public sector partners. Compared to the performance of private sector organizations, the quality of public service delivery is difficult to measure and monitor in today's context. For these reasons, it is sometimes thought that private firms may not have the necessary capabilities to deal with all elements of effective public service management.

This paper reports on the findings from a quantitative research study into the use of a software tool that was built to support a part-complete solution method (PCSM) for the learning of computer programming. The use of part-complete solutions to programming problems is one of the methods that can be used to reduce the cognitive load that students experience during their learning. The tool that was built is a code restructuring tool known as CORT. An inquiry into its effect on student learning outcomes took place over a period of 14 weeks at an Australian university. Two student groups participated in an introductory programming unit, one of which utilized the CORT system whilst the other acted as a control group. No significant difference were found in the relative achievement of students in the CORT and non-CORT groups in tests of programming achievement. However the results showed significant advantages for the CORT students in terms of time saving and levels of tutor help required. Differences also emerged in levels of achievement between certain sub-groups, these being age, computer literacy and previous programming experience.

Assessment is an integral component of effective teaching and a teacher’s professional judgement influences all routine aspects of their work. In the last 20 years, there has been considerable work internationally to support teachers in using assessment to improve student learning. However, there is a pressing issue that impedes teacher professional judgement being exploited to its full potential. The issue relates to teacher assessments in the context of extended performances such as essays and arises from the complexity of obtaining reliable or consistent teacher assessments of students’ work. Literature published in the United States, England and Australia details evidence of low reliability and bias in teacher assessments. As a result, despite policymakers’ willingness to consider making greater use of teachers’ judgements in summative assessment, and thus provide for greater parity of esteem between teachers’ assessment and standardised testing, few gains have been made. While low reliability of scoring is a pressing issue in contexts where the data are used for summative purposes, it also an issue for formative assessment. Inaccurate assessment necessarily impedes the effectiveness of any follow-up activity, and hence the effectiveness of formative assessment. In this session, Dr Sandy Heldsinger and Dr Stephen Humphry will share their research of writing assessment and explain how their research has led to the development of an innovative assessment process that provides the advantages of rubrics, comparative judgements and automated marking with few of the disadvantages.

Between 1950 and 1965, foreign aid played a crucial role within the Indonesian economy. With the Cold War as a backdrop, this aid came from both Western and Eastern blocs with the intention of drawing Indonesia into their spheres of influence. The aid also played a crucial role in the development of architecture in the archipelago. A major endeavour within this period was the construction of buildings and venues for the Fourth Asian Games to be held in Jakarta in 1962 which involved a new stadium, an international-standard hotel and a large by-pass road around part of the city. Financial and technical aid from the Soviet Union, Japan and the United States was obtained to realise these projects. All the while, the Asian Games, along with the modern structures constructed for the event, provided Indonesia an opportunity to advance its own agenda, which was to construct a sense of self-confidence and national pride and to situate itself as a leader among decolonised nations. Nevertheless, foreign financial and technical aid played an important role in the realisation of these projects. The availability of foreign aid was intrinsically tied to President Ahmad Sukarno’s ability to play the interests of all sides. This paper examines plans and preparations for the Fourth Asian Games as a case of engagement between the two Cold War blocs with Indonesia in the middle. By focusing on the key building projects for the Games, the paper reveals the role of foreign aid in the development of architecture in Indonesia during a critical period in its post-war and post-independence formation. This development took place through the interaction of different interests—those of the Western Bloc, the Eastern Bloc, and Indonesia—in the midst of the Cold War and decolonisation period. A glimpse into the interaction may suggest a case of competition. However, examination of the three projects indicates that it was a case of multipolar collaboration instead.

Introduction: Methylphenidate is a neuropsychotropic agent, indicated for the treatment of Attention Deficit / Hyperactivity Disorder (ADHD) and narcolepsy, and is commonly prescribed for school and university age patients. The growing prescription of the drug and the misuse of methylphenidate by academics without a diagnosis of ADHD and / or narcolepsy have raised concerns on the part of medical societies of psychiatry. The over-the-counter use of this substance causes potential dependence and adverse effects such as hallucinations, anxiety, dry mouth and visual disturbances. Unfortunately, there is a precarious amount of epidemiological data on the use of methylphenidate without prescription by university students. In view of this reality. Objectives: The present study proposed to review the assessment of the prevalence of methylphenidate consumption without medical prescription in university environments worldwide, with sources published between 2016-2021. Methods: To perform this research, the PubMed (https://pubmed.ncbi. nlm.nih.gov/) and Scielo (https://www.scielo.org/) databases were used as a search tool, using the Key words “non-medical”, “methylphenidate” and “university students”. Results: So far, 10 articles related to the study (carried out in China, Australia, Brazil, South Africa, Iran, Israel, Pakistan and the United States) have been identified, with 8 articles obtained from PubMed and 2 articles acquired from Scielo. The selected articles show that in 6 of these articles the groups of academics studied were undergraduate and graduate students in general areas, and 4 articles in medical students. The studies present cases of students who confirmed the use of methylphenidate without a prescription, with the justification that it improves academic performance even in healthy students. Conclusion: Therefore, further studies on epidemiology and effects on academic performance with the improper consumption of this drug are recommended.

Under the United Nations Charter, the U.N. Security Council has several important functions and powers, not least with regard to taking binding actions to maintain international peace and security. The ten elected members have the opportunity to influence this area and others during their two-year terms on the Council. In this paper, we aim to illustrate some of these opportunities, identify potential guidance from prior elected members’ experiences, and outline the key procedures that incoming elected members should be aware of as they prepare to join the Council. In doing so, we seek in part to summarize the current state of scholarship and policy analysis in an effort to make this material more accessible to States and, particularly, to States’ legal advisers. We drafted this paper with a view towards States that have been elected and are preparing to join the Council, as well as for those States that are considering bidding for a seat on the Council. As a starting point, it may be warranted to dedicate resources for personnel at home in the capital and at the Mission in New York to become deeply familiar with the language, structure, and content of the relevant provisions of the U.N. Charter. That is because it is through those provisions that Council members engage in the diverse forms of political contestation and cooperation at the center of the Council’s work. In both the Charter itself and the Council’s practices and procedures, there are structural impediments that may hinder the influence of elected members on the Security Council. These include the permanent members’ veto power over decisions on matters not characterized as procedural and the short preparation time for newly elected members. Nevertheless, elected members have found creative ways to have an impact. Many of the Council’s “procedures” — such as the “penholder” system for drafting resolutions — are informal practices that can be navigated by resourceful and well-prepared elected members. Mechanisms through which elected members can exert influence include the following: Drafting resolutions; Drafting Presidential Statements, which might serve as a prelude to future resolutions; Drafting Notes by the President, which can be used, among other things, to change Council working methods; Chairing subsidiary bodies, such as sanctions committees; Chairing the Presidency; Introducing new substantive topics onto the Council’s agenda; and Undertaking “Arria-formula” meetings, which allow for broader participation from outside the Council. Case studies help illustrate the types and degrees of impact that elected members can have through their own initiative. Examples include the following undertakings: Canada’s emphasis in 1999–2000 on civilian protection, which led to numerous resolutions and the establishment of civilian protection as a topic on which the Council remains “seized” and continues to have regular debates; Belgium’s effort in 2007 to clarify the Council’s strategy around addressing natural resources and armed conflict, which resulted in a Presidential Statement; Australia’s efforts in 2014 resulting in the placing of the North Korean human rights situation on the Council’s agenda for the first time; and Brazil’s “Responsibility while Protecting” 2011 concept note, which helped shape debate around the Responsibility to Protect concept. Elected members have also influenced Council processes by working together in diverse coalitions. Examples include the following instances: Egypt, Japan, New Zealand, Spain, and Uruguay drafted a resolution that was adopted in 2016 on the protection of health-care workers in armed conflict; Cote d’Ivoire, Kuwait, the Netherlands, and Sweden drafted a resolution that was adopted in 2018 condemning the use of famine as an instrument of warfare; Malaysia, New Zealand, Senegal, and Venezuela tabled a 2016 resolution, which was ultimately adopted, condemning Israeli settlements in Palestinian territory; and A group of successive elected members helped reform the process around the imposition of sanctions against al-Qaeda and associated entities (later including the Islamic State of Iraq and the Levant), including by establishing an Ombudsperson. Past elected members’ experiences may offer some specific pieces of guidance for new members preparing to take their seats on the Council. For example, prospective, new, and current members might seek to take the following measures: Increase the size of and support for the staff of the Mission to the U.N., both in New York and in home capitals; Deploy high-level officials to help gain support for initiatives; Partner with members of the P5 who are the informal “penholder” on certain topics, as this may offer more opportunities to draft resolutions; Build support for initiatives from U.N. Member States that do not currently sit on the Council; and Leave enough time to see initiatives through to completion and continue to follow up after leaving the Council.

The Southeast Coast Network (SECN) conducts long-term terrestrial vegetation monitoring as part of the nationwide Inventory and Monitoring Program of the National Park Service (NPS). The vegetation community vital sign is one of the primary-tier resources identified by SECN park managers, and monitoring is currently conducted at 15 network parks (DeVivo et al. 2008). Monitoring plants and their associated communities over time allows for targeted understanding of ecosystems within the SECN geography, which provides managers information about the degree of change within their parks’ natural vegetation. 2019 marks the first year of conducting this monitoring effort on four SECN parks, including Fort Pulaski National Monument (FOPU). Twelve vegetation plots were established at Fort Pulaski National Monument in August. Data collected in each plot included species richness across multiple spatial scales, species-specific cover and constancy, species-specific woody stem seedling/sapling counts and adult tree (greater than 10 centimeters [3.9 inches {in}]) diameter at breast height (DBH), overall tree health, landform, soil, observed disturbance, and woody biomass (i.e., fuel load) estimates. This report summarizes the baseline (year 1) terrestrial vegetation data collected at Fort Pulaski National Monument in 2019. Data were stratified across two dominant broadly defined habitats within the park (Maritime Tidal Wetlands and Maritime Upland Forests and Shrublands). Noteworthy findings include: Sixty-six vascular plant taxa were observed across 12 vegetation plots, including six taxa not previously known from the park. Plots were located on both Cockspur and McQueen’s Island. The most frequently encountered species in each broadly defined habitat included: Maritime Tidal Wetlands: smooth cordgrass (Spartina alterniflora), perennial saltmarsh aster(Symphyotrichum enuifolium), and groundsel tree (Baccharis halimifolia) Maritime Upland Forests and Shrublands: yaupon (Ilex vomitoria), southern/eastern red cedar (Juniperus silicicola + virginiana), and cabbage palmetto (Sabal palmetto). Four non-native species identified as invasive by the Georgia Exotic Pest Plant Council (GA-EPPC 2018) were found during this monitoring effort. These species (and their overall frequency of occurrence within all plots) included: Japanese honeysuckle (Lonicera japonica; 17%), bahiagrass (Paspalum notatum; 8%), Vasey’s grass (Paspalum urvillei; 8%), and European common reed (Phragmites australis; 8%). Two rare plants tracked by the Georgia Department of Natural Resources (GADNR 2013) were found during this monitoring effort. These include Florida wild privet (Forestiera segregata) and Bosc’s bluet (Oldenlandia boscii). Southern/eastern red cedar and cabbage palmetto were the most dominant species within the tree stratum of the maritime Upland Forest and Shrubland habitat type. Species that dominated the sapling and seedling strata of this type included yaupon, cabbage palmetto, groundsel tree, and Carolina laurel cherry (Prunus caroliniana). The health status of sugarberry (Celtis laevigata)—a typical canopy species in maritime forests of the South Atlantic Coastal Plain--observed on park plots appeared to be in decline, with most stems experiencing elevated levels of dieback and low vigor. Over the past decade, this species has been experiencing unexplained high rates of dieback and mortality throughout its range in the Southeastern United States; current research is focusing on what may be causing these alarming die-off patterns. Duff and litter made up the majority of downed woody biomass (fuel loads) across FOPU vegetation plots.
