The article analyzes and clarifies that the systematization of labor legislation, like any other social activity, is characterized by the presence of its own object, the study of which will allow a more meaningful understanding of its essence, purpose and mechanism of operation. The article states that the object of knowledge can be all reality, but only to the extent that it has entered the scope of the subject. The concepts of «object» and «objective reality» are related, but not identical in meaning. The object is not the whole objective reality, but only that part of it which has already entered the practice of mankind and constitutes the circle of its cognitive interests. In the field of law, the object is understood as the purpose of the regulatory influence of law, activities and interests of legal entities. Analyzing the essence of the object of legal relations, it is determined that the issues related to the object of legal regulation are the most complex in the theory of legal relations. An object is a part of the objective reality with which the subject interacts. This understanding of the object can be applied to the field of law. The article analyzes the concept of «object» in both philosophical and legal sense, and concludes that the object of systematization of labor law - is what it is aimed at, to which the measures of this systematization. From the very concept of «systematization of labor law» it follows that the object of study is the specified area of national law. However, this approach to understanding the object of systematization is quite superficial, because, first, the concept of «legislation» has both broad and narrow interpretation; secondly, legislation is a form of law, so, thinking about the systematization of labor legislation, we can talk about both its external and internal regulation. In addition, revealing the essence and purpose of systematization, along with its object also distinguishes the subject. It is determined that the object of systematization of labor legislation is a set of regulations governing labor and closely related legal relations, is the object of systematization is a certain part of objective law and its sources, regardless of whether they are purely external streamlining or revision of the content of these sources; the law acts as a certain objectively existing fact, which is influenced by the subjects of systematization; in turn, the subject of systematization is the form and / or normative-legal content of certain specific normative-legal acts, in respect of which the corresponding forms and methods of systematization are applied.

The article attempts to investigate general and particular issues of the social development of the domestic legal system in the modern knowledge of its history from a general theoretical standpoint on the example of a specific legal discipline - labor law. The problem of methodological order is considered when there is a confusion of law as an object of cognition with a real reflection of the formation and social development of its subsystems or structural components, which receive study at the sectoral level. Labor law is analyzed as a subsystem or the most important structural component of the legal system, while scientific research on various aspects of the history of labor legislation goes beyond the modern industry and academic discipline. The problem of the methodological order is the continuity and discontinuity of the very course of development of the domestic system of law and branches of law of the Russian Empire, the Soviet and modern periods. Attention is drawn to the fact that many modern labor law categories in the period before 1917 were absent in the legislation, but formed the content of legal acts and scientific research. In turn, labor relations were formalized by a contract of employment (personal employment), but the specifics of its regulation were determined by mining and factory legislation. Some problems of understanding the modern history of labor law are characterized, when in the general theoretical and branch educational and scientific literature on labor and civil law, concepts such as an employment contract and labor legislation are mixed, and labor law as a branch of law refers to private law. Based on the theoretical works of scientists of the Russian Empire, the Soviet and modern period, a combination of private law and public law foundations of labor law is shown.

The terms “economic” and “irregular” migrant support a particular construction of the subject of labor law, whereby the exclusion of some from a formal employment relationship renders them necessary precarious laborers. The experience of precarious work is not an experience limited to migrant workers. However, the relationship between labor regulation and the most precarious of workers is one that has been gaining critical attention. Building on existing studies of migration, precarity and labor, I question the boundaries and frame of labor law with regard to precarious workers through Jean-Luc Nancy’s confronted community. Re-thinking the legal citizen-subject of labor law is necessary before remedies to address the exploitation of workers in precarious situations can be successful.

The article is devoted to study of the current trends in development of the labor rights in Ukraine, related to elaboration of the draft Labor Code of Ukraine which highlights the necessity to update the labor law and adapt it to the current level of development of labor relations, namely: it is pointed out the gradual extension of the limits of the subject of the legal regime of the labor law, inclusion of new relationships and subjects in its sphere of influence, it is proved that the subject of the specified regime should include relations of non-standard forms of employment, opportunities for broadening the scope of labor law that will also lead to a change in the subject of its regulation, which will be the use of labor of both dependent and independent workers, joint parties of different types of collective owners engaged in the labor and industrial process; the second trend highlights the necessity to introduce an electronic form of employment contract in order to develop the principle of freedom of work, After all, one of the fundamental institutes of labor law is the institute of employment contract, which is the basis for the emergence of labor relations between the employee and the employer. However, the forms of concluding such an agreement remain unchanged, which is contrary to the full reform and improvement of the said institute. Increasingly, social networks are discussing a progressive approach to maintaining an electronic form of employment contract, along with a written one, which may, in the future, gradually disappear into the past, which will become the next trend in the development of labor relations; outlines the current trends of the shift in the legislative activity of government bodies; the article notes the third trend in the development of labor rights in the world relating to increase of the level of their protection, which should be carried out by specially authorized bodies in the order of the specialized jurisdiction; it is investigated the issue of development of specialized labor courts, analyzed the tendencies of the formation of the Code of Labor Procedure, which should provide for a number of procedural guaranties of protection of the rights, freedoms and legitimate interests of employees, employers and other subjects of employment relationship at law as well as guarantee of the legal equality of the parties in resolving discrepancies between them; the inferences on the actual formation of a new branch of procedural law are made.

The article is devoted to the study of the problem of the influence of the system of civil contracts arising from the provisions of the current Civil Code of the Russian Federation on the solution of the issue of the possibility of recognizing labor relations based on civil contracts. It means that Art. 19.1 of the Labor Code of the Russian Federation, the possibility of recognizing a relationship as labor is determined by the circumstances established in it, including the listing of the parties to the civil contract and its subject. In such conditions, it seems necessary to resolve the issue of giving preference to substantive requirements (signs of labor relations enshrined in Article 15 of the Labor Code of the Russian Federation) or formal requirements established by the provisions of Part 1 of Art. 19.1 of the Labor Code of the Russian Federation. The conclusion is substantiated that the influence of the system of civil law contracts and the related terminology of the Civil Code, which determines the parties and the subject of such contracts, on the decision of the possibility of recognizing relations as labor should not be taken into account when applying the current edition of Art. 19.1 of the Labor Code of the Russian Federation, and this article itself needs to be changed.

Labor law of Ukraine is one of the most social branches of law, as it not only regulates labor relations, but also ensures the implementation of socio-economic rights of workers. In the new economic conditions, the problem of ensuring the protection of labor rights and legitimate interests of employees is extremely important. The protection of labor rights is seen in various senses, including as an institution of labor law. It is noted that the protection of labor rights is considered as an independent institution of labor law (narrow understanding of the protection of labor rights), which presents all available in the legal system and possible methods (measures) to protect labor rights. The Institute for the Protection of Labor Rights is one of the central institutes of labor law. The content of this institute consists of: the content of basic labor rights and human freedoms; forms of protection; methods of protection by which protection is provided; protection procedure; conditions of legality of realization of the right to protection of labor rights and freedoms. In order to develop an effective mechanism for the protection of labor rights, it is necessary to define the concept of the form of protection of labor rights, its types and methods of protection. The form of protection of labor rights is defined as the procedure for the protection of subjective labor rights and legitimate interests. This procedure includes a set of organizational actions, the list of which depends on the subject of protection and the subject whose rights and interests are protected. The method of protection of labor rights is defined as a specific action aimed at protecting subjective labor rights and legitimate interests or to remove obstacles to the exercise of these subjective rights.

The dissertation is devoted to the systematic and detailed analysis of the legal essence, content and features of the status of the head of a higher education institution as a subject of labor law, as well as actual problems of practical nature and the search for solutions to them. In the scientific work the legal characterization of the activity of the head of a higher education institution as a form of realization of labor rights for the fulfillment of official duties, as well as a specific kind of labor activity was carried out. Defined the notion and essential features of the labor-legal status of the head of a higher education institution, in particular, the nature of the legal relationships that the composition is established between the head of a higher education institution (as an employee) and the founder of a higher education institution (as an employer). Features of the emergence and termination of labor relations with the head of the higher education institution are highlighted, and the gaps and conflicts in the normative and legal regulation of labor relations with the head of higher education institution are identified. Specific suggestions and recommendations for improving the legal regulation of the status of the head of a higher education institution as a subject of labor law have been formed.

The subject constructed by and for labour law---the "worker"---is bodiless, sexless, genderless, and male. This thesis investigates how and why this construction occurs both through a discussion of general theoretical issues surrounding the way law constructs its subjects, and through a specific case study. The case study considers a set of sexual harassment cases decided in the "mainstream" unfair dismissal jurisdiction. As a site of women's overt presence in the labour market, these cases are disruptive to settled constructions of "the worker", particularly because they connect the sexuality of women (and their gender) to their status as worker. In so doing, they suggest the possibility of a "womanworker"---a woman who is simultaneously woman and worker. The thesis concludes by exploring the consequences of this possibility and asks how the recognition of women's experiences, needs and specificities can allow the subject of labour law to be reconstructed.

Трудова діяльність працівників поліції є однією з форм праці, право на яку закріплено у ст. 43 Конституції України. Вибір такої почесної професії завжди означав готовність до напруженої роботи на благо Вітчизни та відданість національним інтересам. Місія, що покладається на працівників поліції, є дуже відповідальною - служити суспільству шляхом забезпечення охорони прав і свобод людини, протидії злочинності, підтримання публічної безпеки і порядку. У межах реалізації нашою державою напрямку на європейську інтеграцію, надзвичайно актуальними сьогодні постали питання щодо реформування діяльності поліції в цілому, а також удосконалення правого регулювання статусу її працівників. Це стосується, зокрема, і трудоправового статусу працівників поліції. У розділі 1 роботи визначено сутність правового статусу працівника поліції як спеціального суб’єкта трудового права, поняття, зміст та основні риси його трудової діяльності, правові основи регулювання такої діяльності. Розділ 2 присвячений характеристиці основних принципів, завдань та функцій трудової діяльності працівників поліції. У розділі 3 досліджуються актуальні проблеми та напрями вдосконалення правової регламентації трудової діяльності працівників поліції. Наукова новизна роботи полягає в тому, що: 1) запропоновано внести зміни до ч. 5 ст. 91 Закону України «Про Національну поліцію», у якій йдеться про компенсацію роботи поліцейського у вихідні, святкові та неробочі дні шляхом надання йому іншого дня для відпочинку. Зокрема, необхідно передбачити як альтернативу можливість отримання грошової компенсації у подвійному розмірі при залученні його до роботи у такі дні, що у свою чергу узгоджувалося б зі статтями 72 та 107 Кодексу законів про працю України (с. 62-63); 2) дістало подальшого розвитку авторське тлумачення терміну «трудоправовий статус працівника поліції». Вбачається, що це закріплена Конституцією України, законами України «Про Національну поліцію», «Про державну службу», «Про запобігання корупції», Кодексом законів про працю України система прав, обов’язків, заборон, обмежень, заохочень та гарантій професійної діяльності працівника поліції, а також міра відповідальності за невиконання або неналежне виконання ним службово-трудових обов’язків (с. 21-22). Основні положення і висновки роботи обговорювалися на міжкафедральному науково-практичному семінарі «Правові реформи в Україні: стан і перспективи розвитку» (м. Чернігів, 2019 р.). Основні результати проведеного дослідження викладені у 1 науковій праці.
The employment of police officers is a form of labor, the right of which is enshrined in Art. 43 of the Constitution of Ukraine. Choosing such an honorable profession has always meant a willingness to work hard for the good of the Fatherland and a commitment to national interests. The mission of the police is very responsible - to serve the community by ensuring the protection of human rights and freedoms, combating crime, maintaining public safety and order. As part of our country's pursuit of European integration, the issues of reforming police activity as a whole, as well as improving the right regulation of its employees' status, are extremely relevant today. This applies in particular to the employment status of police officers. Section 1 of the paper defines the essence of the legal status of a police officer as a special subject of labor law, the concept, content and main features of his employment, the legal basis for regulating such activity. Section 2 deals with the description of the basic principles, tasks and functions of the work of police officers. Section 3 explores the current issues and areas for improving the legal regulation of the employment of police officers. The scientific novelty of the work is that: 1) it is proposed to make changes to Part 5 of Art. 91 of the Law of Ukraine "On the National Police", which refers to the compensation of police work on weekends, holidays and non-working days by giving him another rest day. In particular, consideration should be given to the possibility of receiving double compensation when hired to work on such days, which in turn would be consistent with Articles 72 and 107 of the Labor Code of Ukraine (pp. 62-63); 2) the author's interpretation of the term "police officer's employment status" was further developed. It is believed that this is enshrined in the Constitution of Ukraine, the laws of Ukraine "On the National Police", "On the Civil Service", "On Corruption Prevention", the Labor Code of Ukraine system of rights, duties, prohibitions, restrictions, incentives and guarantees of professional activity of an employee police, as well as the degree of responsibility for their non-performance or improper performance of their official duties (pp. 21-22). The main provisions and conclusions of the work were discussed at the inter-departmental scientific-practical seminar "Legal Reforms in Ukraine: State and Prospects for Development" (Chernihiv, 2019). The main results of the study are outlined in 1 scientific paper.

El presente artículo intenta abordar la problemática, desde el punto de vista del derecho laboral, que se presenta en torno a la interpretación de normas laborales partiendo de un análisis de fuentes, ya sea tanto fuente interna como internacional. Con lo cual, el autor aboga por mantener la esencia del principio protector del derecho laboral lo cual llevará a conjugar normas de las diferentes fuentes para proteger tanto al trabajador como a la estructura institucional y legal del derecho interno de cada país.

This chapter discusses the substantive law of property, commercial law, labor law, and slavery. Its main claim is that the law supported a free-market economy in which wealth holders engaged in transactions they desired, always subject, however, to regulation for the benefit of the community at large and for the protection of its least fortunate members. Even slaves received significant protection from the law, although the fact that they could be sold to pay for their masters’ debts (but perhaps not in New England) led to the breakup of slave families and communities and to horrific suffering.

This chapter assesses dispute resolution in Islamic finance. Simply referred to as ‘IDR’ (Islamic Dispute Resolution), this Shari’a-based form of Alternative Dispute Resolution (ADR) not only provides desperately needed subject matter expertise in Islamic finance dispute resolution but at the same time accommodates Islamic legal values and traditions in resolving the disputes that inevitably arise in the context of Islamic finance. As with construction arbitration, or labour arbitration, or any other subject-specific ADR process, IDR for Islamic finance is simply another mode of private commercial adjudication. Moreover, from the viewpoint of the State, it is much less threatening than a parallel system of Shari’a courts, which may reach decisions over which the State has no ultimate say. In fact, contrasted with such a parallel system, absent an amicable settlement—in which case the State would have no stake or direct interest anyway—the ultimate adjudication by an IDR intermediary would be subject to review and affirmation by the courts as an arbitral award. Rather than popular or state resistance to the idea of IDR, currently the greatest obstacle to increased and more widespread implementation of IDR for Islamic finance disputes is insufficient expertise and extremely limited facilitative legal and institutional frameworks.

In June 1940 the legal status of Soviet workers changed dramatically. Absenteeism and unauthorized job-changing became criminal offenses. Six months after the German invasion, the severity of the penalties escalated: workers in defense sectors who left their jobs were branded “labor deserters” and subject to long prison terms. More than seven million workers were convicted for absenteeism or illegal quitting. Yet coercion had its limits. Despite the draconian penalties, millions of vocational trainees and workers defied the law and fled, prompted by painful working and living conditions. Authorities showed themselves either unable or unwilling to enforce the law, thus weakening the threat of punishment. Barely half of those who fled were convicted, and of these only 40 percent were ever found and made to serve a sentence. Collective farms welcomed the return of mobilized workers. Coercion proved ineffective in practice.

Анотація:
The subject of the paper is human resource management during the pandemic. The authors highlighted two issues: the influence of human resource management on business results in tourism and the impact of COVID-19 on labor law, psychological and interpersonal relationships in organizations dealing with tourism. The scientific goal is to confirm the hypothetical assumption that the COVID-19 pandemic limited and modified activities related to human resources management in tourism in emergency conditions. The paper uses the general scientific statistical and comparative method and method of document content analysis. The end effect of the work is two results: one, that COVID-19 affects the quality and quantity of human resource management in tourism, and the other, that the COVID-19 pandemic significantly reduces the satisfaction of basic tourism needs and requires the involvement of more institutions to preserve the satisfaction and safety of tourism employees and users of tourist services. The ultimate purpose of the paper is to harmonize the Labor Law regulations in the conditions of mass pandemics.

Special assessment of working conditions is a single set of consistently implemented measures to identify harmful and (or) dangerous factors of the production environment and the labor process and assess the level of their impact on the employee. Conducting a special assessment of working conditions is regulated by certain normative documents (Federal law, labor code, orders of departments). The greatest difficulty is caused by the attribution of working conditions in the workplace of medical and other workers to the class (subclass) of working conditions under the influence of a biological factor. Teachers can carry out medical activities, while they are subject to the rights, duties and responsibilities of medical professionals. The implementation of the components of the concept of medical activity is the basis for assigning working conditions based on the influence of a biological factor, taking into account pathogenicity groups, to a class (subclass) of working conditions without conducting research (tests) and measurements.

Data on the types of labor motivation, features of conscious selfregulation and adaptive abilities of subjects who are in a situation of changing the type of professional activity are presented. The role of these indicators in adapting to the situation of changing the type of professional activity is revealed. The purpose of the series of empirical studies is to test the model of the relationship between regulatory and motivational predictors of successful adaptation. The hypothesis of the research is the assumption that conscious self-regulation makes a significant contribution to the adaptation of the subject to a change in the type of professional activity and mediates the influence of motivational predictors. We discuss the empirical materials collected on a sample of subjects in a situation of changing the type of professional activity (unemployed, students of professional retraining programs, undergraduates) (N = 137). The analysis of the obtained data showed that the respondents, in the situation of changing the type of professional activity, have a predominant instrumental type of motivation (the validity of the labor price is important) and a predominantly low level of adaptive abilities. Conscious self-regulation is a system-forming factor in the system of predictors of adaptation. On the one hand, it allows you to compensate and overcome some limitations of work motivation, on the other — to act as a mediator of the influence of motivation on the results of adaptation
