The article is devoted to the partnership of social workers and ombudsmen as an influential tool for the citizens' rights protection. The common aspects of professional activity of social workers and ombudsmen in the citizens' rights protection of Ukraine and European countries are analyzed. Analyzed the annual reports of the National Ombudsman, clarified the dynamics of the receipt of citizens' reports about violations of their rights. There is a growing number of human rights violations in the field of social protection. The ombudsman has the right to make recommendations to the central executive bodies, which are ripe after the monitoring visits. Through the activities of social workers and the ombudsman, the state assumes the main functions of ensuring human rights in the social sphere. Foreign experience on the significant role of «natural allies» (social workers and ombudsmen) in drafting a formal protocol of strategic and tactical cooperation to optimize the residents' interests based on a friendly advisory approach have been highlighted. Most often, social workers and ombudsmen are forced to act as intermediaries between people and the state or other bodies to uphold justice and provide protection in cases where measures taken by the state in the interests of society as a whole threaten the rights and freedoms of individuals or groups. There is a need to intensify cooperation between the ombudsman's offices, social protection departments and social service providers (for example, through the joint Commissions on the quality of social services establishment, joint investigations into unsatisfactory social or medical care complaints). It seems relevant to expand the positions of specialized ombudsmen (for social protection (security), military ombudsman) as independent officials in communities (municipalities) for Ukraine.

While the work of an Ombudsman (whether a national or the European Ombudsman) and the European Court of Human Rights might seem relatively different, the rule of law, democracy, transparency and access to documents, issues such as migration, and many more fundamental rights-related topics are at the focus of both institutions. The common goal for both, Ombudsmen in Europe and the Court, is to guarantee flawless protection of human rights. The article, via a thus-far unique closer look at the ECtHR case law related to Ombudsmen with regard to institutional, procedural, and substantial issues, examines how Ombudsmen and the Court can contribute, in co-operation with each other, to more effectively serving that common goal. Beyond the particularities of each specific case, the jurisprudence of the ECtHR does not consider the Ombudsman institution to be an effective remedy in general within the meaning of Article 35, §1 ECHR. Neither does a complaint to the Ombudsman usually constitute an effective remedy for the purposes of Article 13 ECHR, except in certain exceptional scenarios of fact wherein judicial remedies are unavailable. There may one day be a necessity to accept the Ombudsman as an applicant in a case before the ECtHR on behalf of the victim of a human rights violation. It would be welcomed to encourage Ombudsmen to intervene as a third party before the Court. The Ombudsman can in certain situations go further and make human-rights-friendly interpretations even if the situation does not in itself represent a violation of the minimum standards set by the ECHR. The conditions for a fair trial as stated in Article 6 ECHR and the case law of the ECtHR are applicable to the procedure before the Ombudsman if the latter determines the applicant’s civil rights and obligations, including (to a certain extent) dealing with administrative cases as covered by the case law of the ECtHR under Article 6 ECHR, and possibly in cases in which the Ombudsman could in some way determine criminal charges. On one hand, Ombudsmen use the case law of the ECtHR in their work and play an important role in enforcing the principles of the ECtHR judgments in practice. On the other hand, the ECtHR uses the work done by Ombudsmen in its judgments. References to findings of Ombudsmen are made (although mostly in the facts part, on a few occasions also under the findings in the judgments of the Court). In these cases, the Court is indirectly giving the Ombudsman’s work legal value. Ombudsmen should be not only a bridge between citizens and administration but also an intermediary between citizens and other human rights protection bodies in Europe. It is vital to strengthen the dialogue between the Ombudsmen and the ECtHR. Human rights are not a luxury, and the independence of Ombudsmen and courts is not their privilege but serves those who are searching for justice. Neither should one forget the ‘middle class’: the ordinary people who need protection, not only the weak and those belonging to minority groups. It is important that Ombudsmen and the Court also contribute to the development of human rights culture and raise human rights awareness.

Introduction. It is established that the fundamental task of any democratic and legal state is to ensure and protect legal human rights and freedoms and the additional formation and implementation of effective guarantees of adequate protection, the creation of an effective human rights system. One of the elements of this system is the institution of the ombudsman. As an object of the European legal tradition, the institution of ombudsman has gradually become established in Eastern Europe, including Ukraine. The purpose of the paper is analysis and determination of the peculiarities of the ombudsman institution at the national and foreign level. Result. Emphasis is placed on the key historical preconditions for the emergence of the ombudsman institution and trends in the further general spread of this structure. An exhaustive definition of the term “ombudsman” is defined and the most characteristic features and features of the institute are characterized, through the prism of national and foreign point of view. Some types and forms of the ombudsman institution are indicated and the set of rights and powers of the respective official is established, depending on the country of the world. In addition, the article describes the requirements for candidates for the position of ombudsman. Emphasis is placed on the importance of such an institution as specialized ombudsmen. The comments and recommendations of qualified scientists on improving the functioning of the ombudsman institution in the domestic realities are analyzed. The forms of response of the Verkhovna Rada Ombudsman for Human Rights were emphasized, in particular, the constitutional submissions of the Ombudsman and the submissions of the Ombudsman. Such a special form of activity of the Ombudsman is described as annual and special reports, which are quite important. Statistics on the effectiveness of the Verkhovna Rada Ombudsman for Human Rights and indicators of implementation of the Ombudsman's Office's recommendations by public authorities are presented. Conclusion. The system of the Commissioner is a litmus test that indicates the level of development of a democratic society and the state, which is determined by the full provision and realization of their rights by the individual and the normative enshrinement of various guarantees for protection of these rights by the state. However, in the domestic reality there is a need to modernize the ombudsman institution for its more efficient functioning.

ABSTRACT This experience report aimed to analyze the vocational education of ombudsmen in the Unified Health System (SUS). This project was a partnership between the Sergio Arouca National School of Public Health (ENSP/FIOCRUZ), the Brazilian Network of Public Health Schools (RedEscola), and the SUS Strategic and Participatory Management Secretary (SGEP/MS). Considered pioneering, the vocational education was developed within the logic of a participatory process which involved municipal, state and national actors from SUS Ombudsman offices, state public health institutions/schools, the National Council of Municipal Health Secretaries (CONASEMS), and the RedEscola’s Technical and Executive Secretary in a consensual governance articulation resulting in the qualification of 451 ombudsmen.

Objective: The Ombudsman is essentially an independent, national-level institution that operates in response to complaints from citizens in order to steer public administrations away from bad administrative practices and behavior. However, it is impossible for an ombudsman with such a broad mandate at the national level to deal with all administrative complaints within the state. Therefore, in order to get more efficiency from the national Ombudsman, it has been divided into different sub-types. Theoretical Framework: One of these is the Ombudsman for local governmentrs, which deals only with complaints from local administrations. Although there is a national ombudsman in Turkey, there is no ombudsman specialized in local governments. Method: This study aims to make some suggestions for the Ombudsman for local governments envisaged to be established in Turkey in the future by analyzing the local governments ombudsman offices in the UK and Italy in terms of their structural-institutional and functional aspects. In this context, the study, with a comparative approach, provides suggestions for the basic aspects, qualities and characteristics of the Turkish local government ombudsman and, thus, for its structural-institutional and functional aspects. The method of the research is literature review. Results and Discussion: According to the results of this research; Establishing an ombudsman for local governments in Turkey by law, cooperating with other ombudsmen in the vicinity, examining and correcting the mismanagement and bad behavior of local governments upon public demand, ensuring easy and cheap access, fulfilling their duties, and quickly and systematically addressing the faults of local governments. Warning, making suggestions, preparing reports and then reporting the situation to local decision-making boards and the public will be effective in providing public services more effectively and efficiently and strengthening local democracy. Originality/value: In the study, original suggestions are made for local government ombudsman in Turkey, based on the examples of UK and Italy.

In many states, the implementation of the principles of open government is defined as the current common trend and political challenge since it includes the procedure of administrative reform, revising the regulations for public officials for better trust between the government and society. Pursuing the mechanism of open government, states adopt national plans, introduce specialized bodies, although often the process of implementing the principles of public administration and control over this process is entrusted directly to the bodies — participants in the experiment. At the same time, ombudsman institutions, which are represented in many countries, has all the initial prerequisites to play an essential role in the open government. The mission that ombudsmen can complete in open government is twofold. On the one hand, as an institutional entity within the state, ombudsman can apply all the principles of open government in his activities, which as close as possible to the philosophy of the principles of openness, transparency, accountability. In this case, ombudsman can serve as a testing ground or an example of the successful implementation of principles for other bodies in the state. On the other hand, ombudsman, by virtue of their direct powers, is entitled to monitor problems in public administration and participate in the implementation of administrative reform. The article describes the foreign practices of involving ombudsmen in open government process.

AbstractThis paper looks at expectations people have of informal justice mechanisms through a rich empirical dataset of 2,775 recent ombudsman users in Germany and the UK. In a cross-cultural comparison, the ombudsman as a model of justice is explored. Not much is known about people's expectations of the ombudsman model; this paper starts to fill the gap. Four roles became apparent in cross-cultural narratives in the dataset: people who interact with ombudsmen expect them to be interpreters, advocates, allies and instruments. The identified roles are largely common to both countries, but in some aspects they show national specificities. These national specificities are seen mainly in the use of language; in Germany, it is more legalistic in comparison to the UK. I argue that this might be related to what has been described as the general legal culture of each country and the institutional set-up.

This article examines the experience of legal regulation and the activities of ombudsman offices in the field of local government in the Anglo-Saxon states. The author notes that institutionally this mechanism depends on the form of state structure, functioning either at the national or regional level, although recently the offices of the municipal ombudsman, have also been appearing. The request for the development of the ombudsman's control over municipal institutions is determined, inter alia, by the peculiarities of the corporate model of local government, which increases the opacity of the activities of municipal bodies. The author singles out a number of specific features of the Anglo-Saxon experience in the area under consideration, concerning primarily the functional component of the ombudsman's status, which are of interest for further study and possible reception.

This research attempts to identify factors that may affect the institution of a national evaluation regime for ombudsmen. Employing evaluability assessment methodology, issues are identified that may arise for the design of a regime to evaluate ombudsmen exercising different jurisdictions within sectors which experience similar national variables like social structures, economic conditions, political stability, legal institutions, evaluation culture and form of public discourse. The research aims to address a gap in the evaluation of ombudsmen. It has become an accepted 'truth' in the public discourse that benefits - social, political and financial- accrue from the creation of an ombudsman. Substantial resources have been and continue to be channelled into the creation and provision of ombudsman services in many countries, including the case-study, Ireland. The result is that, in many countries, what has evolved is a community of ombudsmen that includes a variety of types, from the classical parliamentary ombudsman overseeing administrative practices to schemes that exercise sector-specific jurisdictions using a variety of powers provided for through a variety of mandates. There is not an established methodology for evaluating the performance of these ombudsmen. In very few instances has there been an attempt to evaluate several ombudsmen within a state in the context of a national regime. Where this has occurred, it has not been preceded by the establishment of stakeholder perspectives on that methodology. The research undertaken here addresses that gap directly through a form of evaluability assessment of a community of programmes i.e. ombudsman schemes and the sectors in which they operate. The assessment addresses evaluation-related issues of demand, purpose, capacity, location, criteria and regime. The research concludes with a proposed evaluation regime as the optimum means of explaining the issues discovered and extent of the viability of a national evaluation regime .

The objective of this paper is to analyze the causes and antecedents that have contributed to the fact that, in Argentina, the office of Ombudsman remains vacant. Likewise, the normative origins of the organ are reviewed, in order to understand its value and democratic mission. In the ruling entitled Center for Studies for the Promotion of Equality and Solidarity and Others and the Ministry of Energy and Mining under Collective Protection (Centro de Estudios para la Promoción de la Igualdad y la Solidaridad y otros c/ Ministerio de Energía y Minería s/ amparo colectivo), issued on August 18, 2016, the Supreme Court of Justice of the Nation exhorted the Congress of the Nation to appoint an Ombudsman in accordance with the provisions conferred on it by article 86 of the National Constitution. The Court’s decision exposed a long-standing legal problem: the absence of an Ombudsman.
El presente trabajo tiene como objetivo analizar las causas y antecedentes que han contribuido a que, en Argentina, el cargo de Defensor del Pueblo permanezca vacante. Asimismo, repasa los orígenes normativos del órgano, a fin de comprender su valor y misión democrática. En el fallo caratulado Centro de Estudios para la Promoción de la Igualdad y la Solidaridad y otros c/ Ministerio de Energía y Minería s/ amparo colectivo, emitido el 18 de agosto de 2016, la Corte Suprema de Justicia de la Nación exhortó al Congreso de la Nación a nombrar un Defensor del Pueblo con arreglo a las disposiciones que le ha conferido el artículo 86 de la Constitución Nacional. La decisión de la Corte expuso una problemática jurídica de larga data: la ausencia de un Defensor del Pueblo.

Didelis dėmesys skiriamas nacionalinės žmogaus teisių institucijos, veikiančios pagal Jungtinių Tautų Generalinės Asamblėjos patvirtintus Paryžiaus principus, sampratos analizei. Pateikiama užsienio šalių nacionalinių žmogaus teisių institucijų analizė (Airija, Danija, Vokietija, Lenkija). Darbe darytina išvada, kad Lietuvoje turėtų būti steigiama nacionalinė žmogaus teisių institucija, kuri vykdytų žmogaus teisių padėties stebėjimą, didintų visuomenės žinomumą, konsultuoti valstybės valdžios institucijas žmogaus teisių klausimais, bendradarbiautų su tarptautinėmis institucijomis, užtikrintų Lietuvoje tarptautinių žmogaus teisių standartų laikymąsi, nagrinėtų individualius asmenų skundus dėl visų žmogaus teisių pažeidimų tiek viešoje, tiek privačioje srityje. This master’s thesis analyses the system of human rights institutions. Special focus is placed on the concept of national institutions operating in compliance with the Paris Principles approved by the United National General Assembly. An analysis of foreign national human rights institutions (Ireland, Denmark, Germany, Poland) is also offered. The study made leads to the conclusion that a national institution should be established in Lithuania to monitor the human rights situation, improve public awareness, consult state authorities on human rights issues, cooperate with international institutions, ensure compliance with international human rights standards in Lithuania, and examine complaints by individual persons regarding any violation of human rights in both public and private sectors. The thesis also analyzes the activities of traditional and specialized ombudsmen and the role they play in the protection of human rights, based on a detailed overview of the activities of Scandinavian ombudsmen. It addresses in detail the status of the Seimas ombudsmen, the Office of the Equal Opportunities Ombudsman and the Office of the Ombudsman for the Protection of Children’s Rights operating in the Republic of Lithuania. Lined in the genesis of national political organization, seeks to reduce the complexity of social and political organization prevailing system, consolidating on key historical events, responsible for building the basis of citizenship and consequent awareness of the need for interaction between rulers and ruled, thus was born the institute of ombudsman public in order to fill the gap of communication and society participation in governance state. This work, in addition to addressing the roots of generating political support base of the institute of ombudsman, brings to fore the changing needs of the institute in national and international bias, limiting the playing field, major public and private actions that corroborated and corroborate the organization and structuring of public sector ombudsmen. Concomitantly, entered to the world of e-governance in favor of a new relational format, improving the emancipatory process of transparency, participation and democratization National. We highlight special attention to the model used in the Federal Executive, the body that is driving the Ombudsman General of the Union, as the work under the Ministry of Agriculture, Livestock and Supply argued that motivated the main arguments (theoretical and empirical) of this research.
Referendado na gênese da organização política nacional, busca-se reduzir a complexidade social e política do sistema de organização vigente, consubstanciando-se nos principais acontecimentos históricos, responsáveis pela construção da base de cidadania e consequente conscientização da necessidade de interação entre governados e governantes. Assim, nasce o instituto das ouvidorias públicas, a fim de preencher a lacuna da comunicação e participação da sociedade na gestão pública estatal. O presente trabalho, além de abordar as raízes políticas geradoras da base de sustentação do instituto de ouvidorias, traz à baila o contexto evolutivo do instituto no viés nacional e internacional, delimitando o campo de atuação e principais ações que corroboraram e corroboram com a organização e estruturação do setor de ouvidorias públicas. De forma concomitante, adentrou-se no universo da governança eletrônica, em prol de uma nova formatação relacional, aprimorando o processo emancipatório da transparência, participação e redemocratização Nacional. É dada especial atenção ao modelo utilizado no âmbito do Executivo Federal, do órgão motriz que é a Ouvidoria-Geral da União, como os trabalhos desenvolvidos no âmbito da Ouvidoria do Ministério da Agricultura, Pecuária e Abastecimento, que sustentaram e motivaram os principais argumentos (teóricos e empíricos), da presente pesquisa.

In some countries, in addition to the ombudsman, they are responsible for all areas of social life, ombudsmen were also established according to the functional principle. The jurisdiction of this type of ombudsman extends to certain social areas life or the protection of certain categories of the population. The difference between of the classic and special ombudsman is only in the scope of competence, which is in the first one general in one case, and specialized in the other. Specialized ombudsmen in in some countries they exist alongside the classic ombudsman, and in others as the only ones institutions of that kind. Their characteristic is that they mostly belong to the executive category ombudsmen (chosen by the executive power), are generally not constitutionalized, but are regulated by a special law or act of an administrative body. Special ombudsmen can have all the powers typical of a general ombudsman, but it is often the case that they are certain rights limited or denied, such as the right to an investigation. Author in paper analyzes some specialized ombudsmen: military ombudsman, children's institution ombudsman, ombudsman for national minorities and ombudsman for consumer protection.

This chapter is dedicated to administrative accountability regarding the civilian dimension of EU security and defence. It first decorticates the administrative environment of civilian CSDP. The scrutiny covers institutional, legal, and procedural components (reporting lines and attribution schemes, disciplinary arrangements, etc). The chapter then outlines the small role national authorities play in administrative accountability. Thirdly, the assessment concentrates on the role of the European Ombudsman as a quasi-judicial accountability forum for both individual complaints and overall administrative questions. The evaluation of the Ombudsman’s role is followed by a study of the dual function of the European Court of Auditors, which simultaneously fulfils an auditing and a consultative function. Finally, the chapter discusses the complementarity of the Ombudsman and the European Court of Auditors.

In this chapter, the focus is on the implementation of good governance norms in three countries outside Europe: Australia, Canada, and South Africa. Relating to the implementation of the good governance principles in Australia, we start with the historical background and good governance approaches in the country. There is a classical rule of law and separation of powers but also new administrative law reforms and including the position of the fourth power. Important is the role of the Ombudsman and the relation between good governance and human rights. Especially the principles of participation, transparency and accountability have been worked out. The idea of integrity goes beyond matters of simple ‘legality’. Important is the influx of integrity commissions, ombudsmen and means of judicial and merit review. Although Canada does not have specific legislation that explicitly outlines good governance principles, it is clear that Canada has put them into practice. The Constitution guarantees Canadian citizens ‘peace, order, and good government’. The rule of law provides that every person must abide by the law and Section 15 guarantees equality rights to Canadian citizens. The judiciary is also a source for good governance. Finally, administrative officials are held accountable by judicial review, section 24 of the Charter, and with the ombudsmen. Nevertheless, there is still room for improvement. South Africa has extensively integrated good governance principles into its legal system, but faces the same problems that other developing countries in Africa have. Thus, although South Africa has a sound legal foundation for good governance, lessons can still be learned on how to translate these legal norms into practical application.

Legal practice in developed countries showed that ombudsman might play a very useful role regarding the improvements in local government mechanism and human rights protection, both on national and regional level. The fact that the function of ombudsman, no matter how difficult to perform, bears special importance for countries involved with such comprehensive reform process as ours - by enabling the ombudsman to notice irregularities, holes or inefficiencies within the system, point them out and give suggestions for improvement - is rightfully emphasized. However, when introduced for the first time to certain environments, it may provoke much concern – in regard to its purpose, jurisdiction and results expected. The institution of ombudsman in the City of Kragujevac could not avoid confronting with such concerns. But, as the time passed, this institution have started producing visible results in not so long a period of its functioning. Throughout the next period, the office of city ombudsman should, by means of mass media and instructional lectures, contribute to the affirmation of this institution in the public, because it's sole aim is to serve the citizens and be by the citizens.

The article contains general aspects regarding the right to health and analyzes the European and national regulations in this regard, outlining certain elements specific to this right. Although the research starts from these generalities, it continues with particular aspects of access to emergency medical services for citizens, exemplifying concrete statistics from one of Romania's counties and the difficulties faced by the emergency medical system during the COVID-19 pandemics. The research is based on certain specialized bibliographic resources, but also on information from the written press from that time, but especially on the findings contained in the Special Report of the Romanian Ombudsman in the field of health, which captures very well these deficiencies from the pandemic period and not only. By comparing the situation of the existing ambulances in the inventory of the Brasov County Ambulance Service in 2020 and in 2021, it can be seen that the situation did not improve during the pandemics. Even now, there is no integrated solution at the national level to improve private individuals' access to emergency medical services.

Pandemic of virus COVID-19 posed numerous and unprecedented challenges to citizens and authorities which required shift in behavior and actions of all segments of society. Representing Ombudsmen Institution of Bosnia and Herzegovina, authors shared their experience in monitoring implementation of the decisions of all levels of government and presented challenges in striking the right balance between interests of public health and protection of rights of vulnerable groups. Public authorities in Bosnia and Herzegovina have passed emergency measures aimed at containing the spread of virus, but some of them failed to maintain human rights standards. Following the decisions of crisis centers to limit the freedom of movement, it was necessary to secure rights of children to education, protection from domestic violence and neglect in the family context. In introducing online education, authorities were asked to adapt recognition and grading system to the children in different conditions and circumstances, especially to the children with difficulties in development, children living in poverty and on margins of society such as Roma children or those living in institutions. Ombudsmen Institution registered increase in the number of domestic violence cases because measures limiting freedom of movement had impact on victims' ability to seek help from trusted sources, usually members of immediate family or representatives of law enforcement agencies. Having in mind that large number of citizens could not afford access to the official gazettes in any form, Ombudsmen requested that all enacted legislation be accessible online recommended that the decision banning reporters from conferences be reconsidered, guided by the right of citizens to be informed of their government actions. Examining the practice of placing COVID stickers on mail by the Post Office, Ombudsmen issued recommendation to stop such practice as it was deemed disproportional to the right to privacy and protection of personal data, while the protection of postal workers could have been ensured by other protective measures. It also became evident that national budgetary capacities had to be increased in order to prevent deterioration in provision of basic public services such as health and social protection, since economic consequences of the pandemic were disproportionally felt by the groups exposed to poverty, such as Roma, refugees or migrants. Drawing conclusion from concrete cases, authors offer review of particular emergency measures, analyze their adequacy, justifiability and timeliness, while presenting authorities’ response to Ombudsmen’s findings in formulating more adequate and efficient but, at the same time, least intrusive measures taken in response to the disaster. In search of common response to such widespread phenomenon, governments should recognize the intention of Ombudsmen Institutions to be in „permanent session“ over protection of vulnerable groups and should more actively involve it in discussions on emergency measures and their effect on human rights and freedoms. It proved to be better suited to act quickly, to apply more effective remedies and to correct government actions thanks to its knowledge of the local context than traditional institutions for protection of human rights, such as constitutional courts, international courts or treaty bodies.

This paper examines the state of minority rights in Uzbekistan, focusing on three significant ethnic groups: Tajiks, Russians, and Koreans. It explores the historical context of these minorities, the cultural and linguistic challenges they face, socioeconomic issues, and their political representation. Under the authoritarian rule of Islam Karimov, Uzbekistan emphasized a unified Uzbek identity, often marginalizing minority cultures and languages. Despite President Shavkat Mirziyoyev’s reforms aimed at improving human rights, including the establishment of a Human Rights Ombudsman and the Development Strategy for 2017-2021, significant challenges remain. Legislative initiatives such as the draft Law on the Protection of the Rights and Interests of National Minorities and efforts to enhance cultural policies have had mixed success. This analysis highlights the need for comprehensive measures to ensure robust legal protections, equitable resource allocation, and genuine political inclusion for all ethnic minorities in Uzbekistan. The international community’s role in advocating for these rights is also discussed, emphasizing the gap between policy and practice in protecting minority rights in Uzbekistan.

Cutbacks and austerity measures were in 2019 estimated in a quarter of the Swedish municipalities because of financial deficit. Due to the urbanization the conditions of the municipalities vary, creating different challenges and possibilities to provide for the necessary welfare service such as elder care. Despite a growing population of older people, previous research shows a decline in residential homes since 1980 as well as a decrease in caretakers receiving home help services. According to an inspection of the Health and Social Care Inspectorate (Inspektionen för vård och omsorg) local policy guidelines, for elder care assessment, are being used to reduce the dissimilarities in decision-making within the municipalities and to control the financial costs by adapting criteria and care limits for the needs assessment. Criticism has, by the Swedish Ombudsman, been directed towards the use of municipal guidelines for not complying with the law and case-law. Despite previous research indicating the usage of municipal guidelines in the needs assessment and decision-making process, municipal guidelines are still a relatively unexplored field. The aim of this thesis is therefore to understand the role of municipal guidelines, for elder care assessment, with regard to the law and the application of the law as well as the role municipal guidelines play according to politicians. In order to achieve this, the following has been examined: 1) the spread and content of the municipal guidelines, 2) the creation and political motives for establishing the guidelines and 3) how the care managers view their impact on the decision-making process. The methods used are semi-structured interviews, a survey, and a documentation review. The result shows that municipal guidelines are politically established, that they are widely spread and can be found in 274 out of 290 Swedish municipalities. According to the survey the guidelines contain guidance of law, case-law, and the like, as well as criteria and limits for the needs assessment and decision-making of elder care service. The result indicates that the local guidelines compensate for the ambiguity of the Social Services Act (Socialtjänstlagen 2001:453) by reinstating bureaucracy. By limiting the discretion, the guidelines aim to compensate for the lack of competence as well as create certainty and enable political responsibility for the usage of municipal resources as well as accountability between politicians, care managers and citizens. By standardizing, the aim is to achieve equality and legal certainty despite risking the fundamental intentions of the Social Service Act as a framework law designed for individual needs assessment. This study highlights the need to invest necessary resources into creating guidelines in order to make them more accessible, lawful and ensure legal certainty. The conditions, however, vary noteworthy between the municipalities. As a solution, the National Board of Health and Welfare, or some other authority, could be held responsible for developing national guidelines – regularly up to date and based on current law and case-law. In summary, this study shows that municipal guidelines have a widespread impact on the decision-making of care managers. The municipal guidelines thereby have a central role in the application of the law with a noteworthy potential impact on individuals and the help warranted to older people as a consequence.
