The Canadian Museum for Human Rights (CMHR) is part of a global movement of human-rights–driven museums that commemorate atrocity-related events through exhibitions aimed to communicate a national social consciousness. However, museums in Canada are increasingly understood to contribute to the perpetuation of settler colonial memory regimes as dominant narratives of national identity. Through the analysis of theexhibit ‘Aborigina lWomen and the Right to Safety and Justice’, this article explores how museums in represent difficult knowledge and act as sites of decolonization, while suggesting how shared authority and nuanced Indigenous art forms might play a role in both. It posits that if museums in settler colonial societies are to evolve beyond the pretext of detached host, they must not only acknowledge past atrocities and injustices against Indigenous peoples, but also consistently examine the colonial logics and inventions that permeate colonizing and decolonizing exhibitions.

In 1990, the United States passed the Native American Graves Protection and Repatriation Act (NAGPRA), requiring the repatriation of ancestral remains, funerary, and sacred objects from museums to source communities. Since then, hundreds of thousands of repatriations have occurred, allowing for respectful treatment of ancestors and reconnections to spiritual, communal practice, and ceremony. In Canada, repatriation has been recommended by the Assembly of First Nations, the Canadian Museum Association, and the United Nations Declaration on the Rights of Indigenous Peoples, but there is no federal law. Does Canada have a functioning alternative? This examination provides a comparison of how repatriation differs in the two countries, demonstrating that case-by-case negotiations in Canada currently allow for more flexibility and customization to the needs of different Indigenous communities but that the transparency, coordination, and funding associated with NAGPRA would be a significant benefit to claimants in Canada.

In this article, I argue that recontextualizing Indigenous cultural heritage through institutional acquisition and cataloging can also be understood as a jurisdictional strategy that upholds the supremacy of US and Canadian legal regimes over Indigenous laws. To do this, I share what I have learned from participating in a Nation-led, community-based research project with the Nuxalk First Nation Ancestral Governance Office, in what is currently British Columbia, Canada. Our work together focused on reinvigorating the Nation’s laws, teachings, and protocols through the evolution of their own database of Nuxalk objects, still held in museum collections worldwide. I discuss this project and how it illustrates the legal context inherent to understanding much Nuxalk material culture. Next, bringing together literature on organizing knowledge in museums, settler colonial theories of dispossession, and archival copyright law, I look at how accessioning Indigenous objects into settler collections in the US and Canada is enacting another legal process, “written on top of” the legal meanings objects hold for the Nuxalk Nation, and reframing them as objects the museum has legitimate control and possession over. I close by reflecting on the strategies Nuxalk people, and other Indigenous artists and scholars, are undertaking to challenge the normative power of museum authority through interventions that are grounded in Indigenous governance and sovereignty.

AbstractIn settler societies like Canada, United States, and Australia, the bourgeoning discourse that frames colonial violence against Indigenous people as genocide has been controversial, specifically because there is much debate about the meaning and applicability of genocide. Through an analysis of the Canadian Museum for Human Rights, this paper analyzes what is revealed about settler colonialism in the nexus of difficult knowledge, curatorial decisions, and political debates about the label of genocide. I specifically examine competing definitions of genocide, the primacy of the Holocaust, the regulatory role of the settler state, and the limits of a human rights framework. My argument is that genocide debates related to Indigenous experiences operationalize a range of governing techniques that extend settler colonialism, even as Indigenous peoples confront existing hegemonies. These techniques include: interpretative denial; promoting an Oppression Olympics and a politics of distancing; regulating difference through state-based recognition and interference; and depoliticizing claims that overshadow continuing practices of assimilation, extermination, criminalization, containment, and forced movement of Indigenous peoples. By pinpointing these techniques, this paper seeks to build on Indigenous critiques of colonialism, challenge settler national narratives of peaceful and lawful origins, and foster ways to build more just relations between Indigenous and non-Indigenous peoples.

An increasing volume of images is available online, but barriers such as digital locks, proprietary interests and narrow scope of information uploaded to image databases maintain structures that have impeded repatriation efforts in the real world. Images of objects (cultural material) in the digital environment support cultural heritage. Institutions are developing complex solutions relevant in the network environment to further repatriation initiatives. These solutions facilitate discovery, opening avenues for research into the ethics of ownership that cross the physical/digital divide. There have been calls for strengthening the potential for use of pertinent information in order to protect and recover cultural heritage through increased visibility. However, some museums still limit access to images. We examine the issues and their implications referencing case studies specific to Indigenous, Inuit and Métis peoples of Canada.

Considering that the vast majority of the objects constituting Indigenous Peoples’ cultural heritage are now located outside their source communities, the restitution of cultural property has become a pressing issue among Indigenous Peoples worldwide and should be understood as part of Indigenous Peoples’ historical (as well as current) encounter with colonization and its consequences. As such, this article investigates whether international cultural heritage law offers any possibilities for successful repatriation and to what extent the shortcomings of the framework in place could be complemented by alternative dispute resolution (ADR) mechanisms and the new mandate of the Expert Mechanism on the Rights of Indigenous Peoples (Expert Mechanism). First, crucial concepts in the repatriation debates are explained. Next the factual background of the case studies of the G’psgolox Totem Pole and Maaso Kova are presented. This is followed by a discussion of the most pertinent mechanisms of international cultural heritage law and the place of Indigenous Peoples’ rights within such a framework. Subsequently, the concept of ADR is introduced, and the details of the negotiation processes between the Haisla First Nation (Canada) and the Yaqui People (Mexico, the United States) – both with the Museum of Ethnography in Stockholm (Sweden) – are presented. Finally, the article evaluates to what extent ADR could be an appropriate mechanism for the settlement of disputes concerningIndigenous Peoples’ cultural property, andwhether the Expert Mechanism is a well-suited body for facilitating the process of repatriating Indigenous Peoples’ cultural heritage.

Adding to the urgency of studying the presence of Latin American art in Canada, there is also a need to focus on the work of artists and curators with a Latin American background. They are developing languages of expression, practices, and aesthetics that no longer conform to the “Latin American art” category. It is thus essential to highlight the multiple artistic initiatives that are allowing them to gain visibility and recognition within both the local and global artistic milieus. We posit that today it is almost impossible to overlook both the historical and the ongoing presence of Latin American art and artists in Canada and the recent emergence of a vibrant, ever-expanding contemporary Latinx Canadian art scene. This section proposes six groundbreaking contributions that, from coast to coast, offer further data and analysis, case studies, and investigations into museum archives: from Vancouver to Montréal, from pre-Columbian art and material culture to contemporary art, from the Chilean diaspora of the 1970s to more recent migration waves, from curatorial strategies to the classroom.

This thesis situates the issue of representing minority groups in the debate over the role of museum spaces in the contemporary society. In particular, the thesis explores the shifting relationships between the indigenous peoples and the wider Taiwanese society which is considered to be influential in forming indigenous representations. I conducted fieldwork in case-study museums, which are considered to be leading museums that are more resourceful and influential, and places beyond museum spaces, such as local cultural centres, indigenous communities and public occasions. In this thesis, I suggest that indigenous representations cannot be understood without considering the power relationships between the represented subjects and their surrounding parties, for example, colonial history and political changes. Because of the nature of museums, this thesis has shown that although there are limitations of museum representations, museums still play a symbolic role in Taiwanese society. I also expanded my examination of indigenous representations beyond museum spaces. I discovered that compared to museum representations, these representations are more responsive to the needs of both indigenous peoples and their audience. I also argued that although indigenous peoples obtain a greater autonomy in self-representing, internal power relationships and hierarchy also play a critical role in these self-representations.

In much of Canada, Aboriginal rights – including land rights – were never extinguished by treaty, and presumptively continue to exist. Jurisprudence has established that in Aboriginal groups' traditional territories, they will have Aboriginal title – the right to exclusive use and occupation - in those areas where they can demonstrate both occupation and exclusivity at the date of the assertion of Crown sovereignty, and that they will have hunting and fishing rights in areas where they can demonstrate occupation but not exclusivity. This leaves open the question of what right they have in areas where they can demonstrate exclusivity but not occupation. This thesis argues for the existence in such areas of a right that has not previously been recognized in Canada, namely a right to prohibit resource use or extraction. This right – here termed “Aboriginal dominion” – is argued to be analogous to a negative easement in European property law systems. Even drawing such an analogy, however, requires a level of analysis that has been lacking with regard to Aboriginal property rights in Canada, since courts have insisted that such rights are sui generis, unique. This insistence is here called into question, and an approach that analyzes property rights as being responsive to the needs of human beings in particular times and places is urged instead. To the extent that such analysis results in the recognition of new Aboriginal rights, including Aboriginal dominion, it may help to bring Canada in line with international norms, as embodied in the United Nations Declaration on the Rights of Indigenous Peoples and other instruments, and may contribute to achievement of the ultimate goal of Canadian Aboriginal law: reconciliation.

Disputes between Indigenous peoples and Western museums over repatriation of cultural heritage involve numerous complex issues -- legal, ethical, historical, cultural, spiritual, political and economic, among others – that necessitate a particularly thoughtful approach to resolving such disputes. Resolution of such disputes by negotiation or other alternative dispute resolution (“ADR”) processes should not involve simply finding quick, theoretically “win-win” solutions such as replicas or loans. Because these disputes often involve complex issues such as traumatic colonial injustices and profound differences in cultural values and dispute resolution paradigms, the dispute resolution process must involve a period of exploration and acknowledgement of such issues and differences by the parties, which I term “Relationship Building”, as a necessary precursor to any stage of problem-solving. By analysing the negotiations between various Western museums and the Kwakwaka’wakw and Haisla First Nations of British Columbia, Canada over the repatriation of cultural objects removed from their traditional territories by colonial forces in the early 20th century, this thesis seeks to demonstrate how engaging in a stage of Relationship Building early in the negotiation process is key to ensuring the parties understand their dispute holistically and experience a constructive, not destructive, process and outcome.

This paper discusses the legal principles which are relevant in determining the appropriate level of compensation for infringements to aboriginal and treaty rights. This issue has been left open by the Supreme Court of Canada in the seminal case of Delgamuukw. The nature of aboriginal and treaty rights as well as the fiduciary relationship and duties of the Crown are briefly described. The basic constitutional context in which these rights evolve is also discussed, including the federal common law of aboriginal rights and the constitutional position of these rights in Canada. Having set the general context, the paper then reviews the legal principles governing the infringement of aboriginal and treaty rights, including the requirement for just compensation. Reviews of the legal principles applicable to compensation in cases of expropriation and of the experience in the United States in regards to compensation in cases of the taking of aboriginal lands are also carried out. Six basic legal principles relevant for determining appropriate compensation in cases of infringement to aboriginal and treaty rights are then suggested, justified and explained. The history of collection at the National Gallery of Canada, the Art Gallery of Ontario and the Montreal Museum of Fine Arts, illustrates concepts of race in the development of museums in Canada from before Confederation to today. Located at intersections of Art History, Museology, Postcolonial Studies and Native Studies, this thesis uses discourse theory to trouble definitions of nation and problematize them as inherently racial constructs wherein 'Canadianness' is institutionalized as a dominant white, Euro-Canadian discourse that mediates belonging. The recent reinstallations of the permanent Canadian historical art galleries at the National Gallery of Canada, the Art Gallery of Ontario and the Montreal Museum of Fine Arts are significant in their illustration of contemporary colonial collection practices. The effectiveness of each installation is discussed in relation to the demands and resistances raised by Indigenous and non-Native artists and cultural professionals over the last 40 years, against racist treatment of Indigenous arts.

Using a cross-national comparative approach, this thesis examines the Native housing crisis in the Northwest Territories, Alaska, and northern USSR from 1980 to 1990. The affordability, adequacy, and suitability of public and private sector housing is analyzed, as well as their structural and cultural limitations in a northern context. This study found that many low and moderate-income Natives in these regions are unable to afford expensive market rental housing, are ineligible for government or company accommodation or sheltered in overcrowded public housing. Premised on non-Native values and market assumptions, public and private sector housing is exclusionary and discriminates against a Native way of life, and has created the conditions in which people are polarized based on income and tenure. Given the failure of public and private sector housing to meet the shelter requirements of Natives, this thesis argues that there is a need for community-based housing alternatives. Housing co-operatives have the potential to increase security of tenure as well as the stock of decent and affordable housing, and to reduce cultural cleavages and socio-tenurial polarization through meaningful social and income-mixing. By responding to Native housing needs in such a culturally-sensitive manner, co-operatives have the potential to reduce dependencies on housing agencies and the private sector by effectively shifting control of housing to the community as a whole. Given the potential of housing co-operatives, however, this tenure has made relatively few inroads into the Northwest Territories, Alaska, and northern USSR. This study concludes that problems of implementation and affordability, privatism and inertia in housing policy, and a dependency on public and private sector housing have impeded the wider development of northern co-operatives.

The lack of Indigenous cultural knowledge and perspectives in the school curriculum has been identified as a significant factor in school failure amongst Indigenous students. This thesis includes a literature review of Indigenous education, as articulated by Indigenous scholars. Issues of identity, self-determination, local control, community, culture and a return to a traditional-holistic model of education are investigated. An analysis of experiential and place-based educational models is taken as these alternative practices have shown success in addressing Indigenous students needs. The fundamental significance story, narrative and the concept of place has in Indigenous culture and knowledge development is explored, as well as the effects colonial influences have had on Indigenous story, voice and sense of place. Using self-study methodologies and the formation of a "narrative identity" through reflexive writings, the author attempts to uncover his motives and reasoning as a non-Indigenous educator and researcher in pursuing research in Indigenous education and to develop principles that understand, are respectful and conducive to Indigenous thought.

This dissertation attempts to show that Aboriginal peoples' ways of thinking have not been recognized by early colonial European political thinkers. I begin with an examination of Kymlicka's political theory of minority rights and show that, although Kymlicka is a strong advocate of the right of Aboriginal self-government in Canada, he fails to consider Aboriginal ways of thinking within his own political system. From an Aboriginal perspective this is not surprising. However, I claim that Kymlicka opens the conceptual space for the inclusion of Aboriginal voices. The notion of "incorporation" means that Aboriginal peoples became included in the Canadian state and in this process their Aboriginal sovereignty was extinguished. Aboriginal peoples question the legitimacy of such a claim. A consequence of the Canadian government unilaterally asserting its sovereignty over Aboriginal peoples is that Aboriginal ways of thinking are not recognized as valuable within the legal and political discourse of sovereignty. In chapters two through five, respectively, I examine the Valladolid debate of 1550 between the Spanish monk Bartolome de Las Casas and Juan Sepulveda, The Great Law of Peace of the Iroquois Confederacy, Thomas Hobbes's distinction between the state of nature and a civil society, and Alexis de Tocqueville's account of democracy in America. Each of the examples, except for The Great Law of Peace, generate a philosophical dialogue that includes judgments about Aboriginal peoples. However, none of these European thinkers considers the possibility that Aboriginal voices could play a valuable role in shaping their political thought. To show the value of an Aboriginal exemplar of political thinking I consider the Iroquois Great Law of Peace. The Iroquois view of political sovereignty respects the diversity of voices found within a political relationship. In California, third and fourth grade social science curriculum standards mandate an introduction to Native American life and the impacts of Spanish, Mexican, and "American" colonization on the state's indigenous people. Teachers in the state use museums to supplement this education. Natural history and anthropology museums offer programs for teaching third graders about native pre-contact life, while Missions and regional history museums are charged with telling the story of settlement for the state's fourth graders. Clearly, this fact suggests the centrality of museums and Missions to education in the state. Since only one small tribe on the central coast has federal recognition, non-tribal museums are the only public voice about Indian life. These sites however, rarely address hardships experienced by native people, contributions over the past 150 years, the struggles for sovereignty in their homelands, and a variety of other issues faced by living Indian people. Instead, these sites often portray essentialized homogenous notions of Indiamless which inadvertently contribute to the invisibility of coastal Native peoples. This dissertation analyzes visual museum representations in central coast museums and Missions and the perspectives oflocal Native American community members about how their lives and cultures are portrayed in those museums. Using methods of critical discourse analysis, the dissertation seeks to locate discontinuities between the stories museums tell versus the stories Indian people tell. It addresses these ruptures through a detailed analysis of alternative narratives and then offers suggestions to museum professionals, both in California and elsewhere, for incorporating a stronger native voice in interpretive efforts.

The standards for Indigenous engagement are evolving rapidly in Canada. The risks to project approvals and schedules, based on whether consultation has been complete, have been recently demonstrated by the denial of project permits and protests against projects. Indigenous rights and the duty to consult with affected Indigenous groups is based on the Constitution Act, 1982 and has been, and is being, better defined through case law. At the same time, international standards, including the International Finance Corporation Performance Standards and the United Nations Declaration on the Rights of Indigenous Peoples, are influencing government and corporate policies regarding consultation. The Government of Canada is revising policies and project application review processes, to incorporate the recommendations of the Truth and Reconciliation Commission of Canada; that Commission specifically called for industry to take an active role in reconciliation with Canada’s Indigenous peoples. Pipeline companies can manage cost, schedule and regulatory risks to their projects and enhance project and corporate social acceptance through building and maintaining respectful relationships and creating opportunities for Indigenous participation in projects.

A number of proposed pipelines in western and northern Canada have highlighted critical path social risks associated with effectively engaging and consulting with impacted Aboriginal rightsholders along pipeline rights-of-way. Opening up new markets for Canada’s oil sands, shale and off-shore gas resources will require an expansion of the pipeline system in northern British Columbia, Alberta and the Northwest Territories. While navigating the regulatory approval process can be a formidable hurdle, a far greater challenge is how proponents manage the process of building relationships and consulting with affected Aboriginal communities. Failing to earn Aboriginal support for proposed projects can be a “show-stopper”. Exploration of new basins in Canada, driven by increased demand for energy in Asia, may compete with other land uses and constitutionally-protected rights and practices of indigenous peoples. Public, media and environmental response to new pipelines is often lead by the reaction of impacted communities. The task of identifying the social risks to a project, understanding the engagement process, fulfilling the regulatory consultation requirements of different jurisdictions, balancing impacts with benefits, managing issues and resolving disputes, communicating with the public and media effectively all require improved skills and approaches. The paper surveys the stakeholder engagement experience and differences in approaches for recently proposed major arctic gas and western oil pipeline projects, as well as pipelines to service Liquefied Natural Gas export facilities on the Pacific north coast, providing practical insights with possibly international application. Utilizing decision and risk analysis and scenario planning methodologies, applied to development of an Aboriginal engagement and consultation strategy, the paper examines how multi-billion dollar investments in new pipelines can be better secured by integrating stakeholder engagement into a project’s risk management design. With greater precision and improved approaches proponents can effectively manage social risks, reduce stakeholder conflict and associate project uncertainties.

This paper is for The PCF10 and on the sub theme “Promoting Equity and Inclusion” at the Tenth Pan-Commonwealth Forum on Open Learning (PCF10), Calgary, Canada. The author discusses how the enrollment of women and girls in TVETs in Africa is being increased through ‘’Women in Technical Education and Development (WITED)’’, a program of the Association of Technical Education and Development in Africa (ATUPA) and supported by the Commonwealth of Learning (COL). The paper gives: the background to the WITED program; the objective and strategies applied; revitalizing WITED through COL and ATUPA Women in STEM (CAWS) Project; the intended outcomes of the WITED Program and finally the conclusions. The methodology of this paper is desk research combined with interviews of the “WITED Champions”. The authors extensively examine available documents on WITED. The UN Agenda 2030 for Sustainable Development aims to: “eliminate gender disparities in education and ensure equal access to all levels of education and vocational training for the vulnerable, including persons with disabilities, indigenous peoples and children in vulnerable situations” by 2030 (SDG target 4.5); and “achieve full and productive employment and decent work for all women and men, including for young people and persons with disabilities, and equal pay for work of equal value” (SDG target 8.5). Equality and non-discrimination are also reflected in the UN’s “Leaving no one behind” framework, endorsed by the United Nation System’s Chief Executives Board for Coordination. Women in Technical Education and Training (WITED) is a program which was initiated by Commonwealth Association of Polytechnics in Africa (CAPA), now Association of Technical Universities and Polytechnics in Africa (ATUPA), with the support of the International Labor Organization (ILO) and Commonwealth of Learning (COL) back in 1988. The author seek to evaluate the impact achieved by the programme, the challenges encountered and finally make a call to action by recommending ways by which the programe can reach more girls and women and bring them into TVET programmes.

This report explores the engagement between Indigenous Peoples and the Responsible Investment (RI) industry in Canada. Based on interviews with stakeholders, observation of industry conferences, and documentary evidence collected during the first year of the pandemic (i.e., March 2020-March 2021), this report offers an overview of the current discussions regarding Indigenous Peoples in the RI industry. RI is an investment approach that incorporates Environmental, Social, and Governance (ESG) factors into the selection and management of investments (RIA, 2021). In 2019, the Responsible Investment Association (RIA) estimated that assets in Canada managed using one or more RI strategies2 were worth $3.2 trillion, or 61.8 per cent, of total Canadian assets under management (RIA, 2020).
