RÉSUMÉLe vieillissement de la population engendre une augmentation du nombre de conducteurs âgés. Les professionnels de la santé ont la responsabilité de fournir des soins en préservant le secret professionnel tout en assurant la sécurité du public. Cet article traite de l’analyse éthique relative à la prise de décisions en lien avec le signalement aux autorités compétentes des conducteurs âgés identifiés comme étant à risque. Des considérations éthiques inhérentes au signalement des conducteurs à risque sont traitées, telles que l’autonomie, le secret professionnel, la relation thérapeutique et l’incertitude associée à l’évaluation de la conduite automobile. Nous abordons également la question de la responsabilité des divers agents moraux. L’incertitude entourant le raisonnement clinique et les concepts liés à l’évaluation du risque sont également traités. Enfin, nous présentons deux cas illustrant certains défis auxquels sont confrontés les professionnels de la santé dans l’atteinte d’un équilibre entre leurs responsabilités face à leurs patients et celles visant à assurer la sécurité du public.

Le droit du risque professionnel (hygiène et sécurité du travail, réparation des accidents du travail) traverse une crise qui invite à en dresser un état positif et critique. La présente thèse a pour objet de procéder à cet état, dans un esprit d'objectivité et à la faveur d'une distinction entre les problématiques de reconnaissance (améliorer la reconnaissance des risques liés au travail) et d'imputation. Justifier l'imputation de certains risques aux employeurs des intéressés). Elle tend à mettre à jour les conditions favorables à une politique rationnelle de prévention et de réparation des risques professionnels : d'une part, la création d'une catégorie juridique unifiée, à laquelle serait associé un régime de reconnaissance caractérisé par une répartition cohérente des pouvoirs et des devoirs entre les garants de l'intérêt général, les experts et les intéressés eux-mêmes ; d'autre part, l'identification des fonctions du régime du risque professionnel (la prévention des risques, la répartition des charges), permettant d'en dessiner les contours de façon plus précise, aussi bien pour les victimes potentielles (les " travailleurs ") que pour les responsables désignés (les " employeurs ")

The aim of this thesis is to, draw up this state, in a spirit of objectivity and on the bases of a distinction between the problems of acknowledgment (how to improve the acknowledgment of the risks related to the working conditions) and attribution (what justifies that certain risks are attributed to, the employers of the people concerned). It tends to define the conditions favourable to the development of a rational policy of prevention and compensation concerning the occupational hazards : first, the creation of a unified legal category of "occupational hazard", with which would be associated a mode of acknowledgment characterized by a coherent distribution of powers and, duties between the authorities, experts and the concerned people ; secondly, the identification of the main functions assigned to the legal status of the occupational hazard (prevention of risks, sharing of the compensation charges), in order to draw limits of this status in a more precise way, as well for the potential victims ("workers") as for the designated persons in charge ("employers")

L'étude de la protection de l'emploi dévolue au salarié victime d'un risque professionnel a permis de constater que l'objectif assigné à la législation du 7 janvier 1981 est dénaturé. Quatorze ans d'application de ses dispositions enseignent que le maintien de l'emploi du salarié atteint d'une maladie professionnelle ou victime d'un accident du travail n'est pas véritablement assuré. Cette affirmation se justifie par trois constats. Tout d'abord, le salarie protégé n'est pas stricto sensu celui victime d'un risque professionnel, mais plutôt celui subissant un dommage corporel consécutivement à un risque d'entreprise. La notion de risque professionnel définie et organisée par le droit de la sécurité sociale est inadaptée au dispositif protecteur de l'emploi qui exige pour son efficacité une mise en oeuvre immédiate. Cette rupture s'affirme dans la consécration du risque d'entreprise, fondement de la protection de l'emploi dévolu au salarié-victime. Ensuite, nous avons pu démontrer que si la finalité des obligations de l'employeur était la protection de l'emploi, leur mise en oeuvre pouvait dans bien des cas se solder par un échec. Qu'il s'agisse de l'obligation de garantie d'emploi pendant la période d'incapacité temporaire ou de l'obligation de reclassement du salarieé inapte, l'une et l'autre conduisent trop souvent à l'éviction du salarié de l'entreprise. Enfin, nous avons du constater que la réparation par équivalent constituait la réalité des garanties offertes au salarié. L'indemnisation du salarié victime est soit un remède nécessaire, soit inadapté, à l'échec de la garantie d'emploi. En revanche, la situation du salarié non réintegré dans l'entreprise au terme de son incapacité temporaire à été clairement réglementée. L'indemnisation devient la solution de l'échec du reclassement.

Le risque professionnel apparaît à la fin du XIXème siècle. Il est conçu comme le palliatif des insuffisances des principes de responsabilité civile appliquées aux victimes du travail. Le corps blessé au profit de l’industrie doit obtenir réparation. L’accident du travail est né ; sa reconnaissance est strictement encadrée. L’évolution des organisations de travail révèle d’autres insuffisances et induisent l’extension de la notion. D’un principe de responsabilité appliqué à la survenance d’un risque qualifié au préalable, le risque professionnel devient l’expression d’un droit à la sécurité. Les acteurs de l’entreprise y acquièrent un pouvoir de qualification. Au croisement du droit de la sécurité sociale, du droit du travail et du droit de la santé publique, les objectifs assignés évoluent à la lumière des enjeux humains et financiers qui s'y attachent. De nouvelles notions innervent les relations de travail. Le droit du salarié à la sécurité ne peut plus être dissocié d’un droit élémentaire à la santé. The notion of occupational risk appears at the end of the 19th century. It is intended as a remedy for the inadequacy of the principles of civil liability as applied to workplace victims. A person injured while working for the benefit of industry must obtain reparation. The concept of the workplace accident is born, although its applicability is strictly limited. The evolution of labor organizations reveals other shortcomings and leads to the expansion of the principle. Starting from a notion of liability applied to the occurrence of a pre-determined hazard, occupational risk becomes the expression of a right to workplace safety. Labor acquires a decision-making power in this regard. At the intersection of french social security law, labor law and public health law, the designated objectives evolve in the light of related human and financial issues. New concepts stimulate labor relations. The right to employee safety can no longer be dissociated from a basic right to health. Beyond that, the principle of workplace well-being makes its appearance. It is still necessary to resolve the uncertainties that influence the concept of occupational risk. As a notion with fluctuating boundaries, it is essential to define it. The stakes are high

Contexte : Les pathologies cardiovasculaires représentent la première cause de mortalité dans les pays développés. Le niveau de pression artérielle est un facteur de risque cardiovasculaire reconnu, associé à la fois à la morbidité et à la mortalité cardiovasculaires. Objectifs : Le but de ce travail est de mieux connaître le taux d'incidence annuelle de l'hypertension artérielle, les facteurs de risque professionnels associés à sa survenue et leurs liens avec les comportements dits individuels. Population : Cette thèse présente les résultats des études IHPAF réalisées dans une population active. Résultats : Dans la cohorte, nous avons étudié les facteurs de risque comportementaux associés à la survenue de l'hypertension artérielle incidente. L'obésité multipliait par plus de cinq le risque d'hypertension artérielle chez les hommes et par près de trois chez les femmes. Les données de l'étude cas-témoins emboîtée dans l'étude de cohorte ont montré que le risque d'hypertension artérielle était plus élevé chez les sujets exposés à des contraintes élevées dans leur travail par rapport à ceux qui étaient soumis à de faibles contraintes. Une relation plus forte a été observée chez les femmes par rapport aux hommes. La troisième partie s'est intéressée à la relation entre les contraintes organisationnelles du travail et les comportements à risque. . .

Dans le football professionnel, les blessures ont une influence négative sur la performance, l'économie et la santé. Malgré un accent accru sur la prévention des blessures dans le football, il est préoccupant de constater que les blessures n'ont pas diminué au cours des 11 dernières saisons. En raison de l'impact significatif et négatif des blessures dans le football professionnel, il est primordial de veiller à ce que de tels accidents ne se produisent plus. Il est important de déterminer de nouvelles méthodes et procédés afin de détecter et d'empêcher les blessures chez les footballeurs professionnels. En outre, dans la littérature de la recherche scientifique, il y a des résultats contradictoires et des débats en ce qui concerne les facteurs de risque, les tests et les exercices de prévention pour les blessures sans contact dans le football professionnel. Les recherches scientifiques devraient être menées afin d'influencer les pratiques soit en validant soit en réfutant certains procédés et certaines procédures, cependant, il y a actuellement un fossé entre la science et la pratique (Bishop, 2008).Le but de cette thèse était de : (a) étudier des méthodes nouvelles et innovantes pour détecter et prévenir les blessures sans contact au plus haut niveau du football professionnel masculin et (b) (b) de réduire le fossé entre la science et la pratique. Les études de recherche spécifiques menées dans cette thèse étaient (1) les facteurs de risque, le dépistage et les stratégies de prévention pour les blessures sans contact dans le football professionnel: les perceptions et les pratiques actuelles de 44 équipes de première division. (2) les facteurs de risque, le dépistage et les stratégies de prévention pour les blessures de non-contact dans le football professionnel :Les facteurs de risque, les tests et les stratégies de prévention pour des blessures sans contact dans le football professionnel: une revue systématique, (3) un simple test isométrique des membres musculaires inférieurs chez les joueurs de football professionnels, (4) Effet d'un programme de prévention des blessures sur un taux de blessures dans une équipe professionnelle de football participant aux compétitions européennes. La présente thèse a réussi à réduire le fossé entre la science et la pratique en révélant le top 3 des perceptions et des pratiques des équipes de football de haut niveau concernant les facteurs de risque (blessure antérieure, fatigue, déséquilibre musculaire), essais (écran de mouvement fonctionnel, questionnaire, isocinétique) et des exercices de prévention (excentrique, équilibre / proprioception et ischio-jambiers excentrique). Une revue systématique de la littérature scientifique a fourni un niveau scientifique de preuve pour les 3 principaux facteurs de risque, tout à la fois un niveau scientifique de preuve et des recommandations globales graduées ont été fournies pour les 3 premiers tests et exercices de prévention. Un test simple et pratique pour évaluer la force isométrique des membres musculaires inférieurs a été vérifié et mis en œuvre avec succès dans le cadre du football professionnel. Le test s'est avéré être à la fois assez fiable et sensible pour déceler les changements de force survenant après un match de football. Enfin, un programme de prévention des blessures à haute conformité a été correctement et efficacement mis en œuvre dans une équipe de haut niveau prenant part aux compétitions européennes et les taux de blessures considérablement réduits, même lors d'une période comprenant des matchs rapprochés soit 2 matchs par semaine.La présente thèse peut aider à guider les praticiens à utiliser les meilleures pratiques factuelles actuelles. En outre, du point de vue de la recherche, les résultats fournissent aux chercheurs des pistes où concentrer les futures recherches sur la prévention des blessures dans le football professionnel
In professional football, injuries have a negative influence on performance, economy and health. Despite an increased focus on prevention of injury in football, it is of concern that injuries have not reduced in this cohort over the past 11 seasons. Due to the significant and negative impact of injuries in professional football it is of interest to prevent such injuries from occurring. It is important to determine new methods and processes to detect and prevent injuries in professional footballers. Additionally, within the scientific research literature there are conflicting results and ongoing debates in regards to risk factors, testing and preventative exercises for non-contact injury in professional football. Scientific research should aim to influence practice by either validating or refuting certain processes and procedures, however, there is currently a gap between science and practice (Bishop, 2008). Purpose: The purpose of this thesis was to (a) investigate new and innovative methods to detect and prevent non-contact injuries at the highest level of professional male football and (b) (b) to reduce the gap between science and practice. Studies: The specific research studies conducted in this thesis were (1) Risk factors, testing and preventative strategies for non-contact injuries in professional football: Current perceptions and practices of teams from 44 premier leagues. (2) Risk factors, testing and preventative strategies for non-contact injuries in professional football: A systematic review, (3) Reliability and sensibility of a simple isometric posterior lower limb muscle test in professional soccer players, (4) Effect of an injury prevention program on injury rate in a professional football team participating in European competition. Conclusion: The present thesis successfully reduced the gap between science and practice by revealing the top 3 perceptions and practices of top-level football teams concerning risk factors (previous injury, fatigue, muscle imbalance), testing (functional movement screen, questionnaire, isokinetic) and preventative exercises (eccentric, balance/proprioception and hamstring eccentric). A systematic review of the research literature provided a scientific level of evidence for the top 3 risk factors, while both a scientific level of evidence and overall graded recommendation was provided for the top 3 tests and preventative exercises. A simple and practical test to assess the isometric force of the posterior lower limb muscles was verified and implemented successfully in the professional football setting. The test was found to be both reliable and sensitive enough to detect changes in force following a competitive soccer match. Finally, an injury prevention program with high compliance was successfully and effectively implemented in a top-level team competing in European competition and significantly reduced injury rates even when playing during a congested match period i.e. 2 matches per week. The present thesis can help to guide practitioners in using the current best evidence based practice. Additionally, from a research perspective, the findings provides researchers with avenues of where to concentrate future research concerning injury prevention in professional football

Information technology has long become an integral part of today’s professional reality and given rise to new job profiles, in response to the changing requirements in many industries. Hence, the knowledge of languages for specific purposes as well as the acquisition of practical competences through project-based learning (PBL) have gained growing significance. Specialized communication skills, coupled with a multilingual professional competence, are a means to address the demands of our today's complex reality. Institutions of higher education more and more feel the urge to prepare their students to new professional challenges and a wide range of employment opportunities. This paper presents a PBL approach by implementing the Computer Aided Translation Tool Memsource in foreign language classes of the Master’s course “Languages and Business Relations” at the University of Aveiro. This innovative approach seeks to provide students with a multidisciplinary competence, increase their linguistic proficiency and actively involve them in the decision-making and problem-solving process. "Rise" teams generated more than 30 activities that support our company diversified Operation as well as its employees. Diversification in this context includes skills, experiences and techniques to perform tasks. Increasing population, uncontrolled urban sprawl, and rapid urbanization are the main factors leading to a decrease in green areas, resulting in a series of ecological problems and negatively impacting the quality of life in cities. According to UN data, currently, 55% of the world's population lives in cities. By 2050, this percentage is expected to rise to 68%, meaning that around 6.6 billion people will live in urban areas, leading to an increase in the number of megacities and air pollution, one of the key factors influencing climate change. The sustainability of cities becomes a crucial issue, and urban green spaces, including green corridors, play an important role in this process. Their main goal is to contribute to the creation of sustainable industrial, urban, and transportation networks, addressing complex demands related to ecology, technology, economy, society, and spatial planning. Providing numerous environmental benefits, urban green corridors are crucial for preserving ecology and biodiversity. Additionally, they bring social benefits by improving people's well-being through direct interaction with nature, reducing health problems, and contributing to the overall improvement of the quality of life in urban areas. Drawing on an analysis of reference literature and selected examples of good practice, this paper primarily examines the role and significance of green corridors in strengthening urban resilience to climate change.

Teams of Mechanical Engineering students at Western Kentucky University (WKU) participate in the ASME Student Design Contest (SDC) as a component of a Junior Design course. The required course activities include a design review, a mock contest at WKU, and project documentation. Students are also given the option of attending the Regional Conference SDC. Over the past two years, every team has participated at the Regional SDC, with 19 of 27 students attending. Both the 2004 and 2005 WKU teams won the regional competition. The Junior Design course uses the SDC as an intermediate component of a Professional Plan developed and implemented by the WKU ME faculty to assure that program graduates have experienced key areas of the engineering profession and demonstrated the ability to perform in a professional manner. The Professional Component consists of Engineering Design, Professional Communications, Professional Tools, and Ethics. Students receive instruction and practice in all four areas at least once per academic year. With the Engineering Design sequence, freshmen individually build an artifact, sophomores function in design teams, and juniors extend the design experience to an external audience. Technical rigor and faculty expectations obviously rise at each level. The goal is for seniors to be prepared to implement an industry-based project subject to realistic constraints and customer needs. As one of the two design projects in the Junior Design course, the SDC provides a structured design experience with an external flavor. Student teams must demonstrate both problem solving under constraints as well as creativity. To reinforce the economic aspects of design, teams are given a budget, and must fund over expenditures themselves. In addition to the design component of the SDC, the project also includes Professional Communications in the form of design reviews and design notebooks, and Professional Tools such as software for communication, CAD and analytical calculations. The 2005 class has been effective producing rapid prototype components of their designs from CAD models. The Junior Design implementation of the SDC has evolved over the past three years guided by ongoing assessment of both the course and the Professional Component program outcomes. The milestones and associated requirements in the ASME SDC project provides a definitive set of deliverables throughout the progression of the semester long experience. Individual and team performance can be monitored and evaluated with timely feedback, and course outcomes map well into program level assessment. This is a strength of the Professional Component framework that allows for building upon previous coursework, assessing student progress, and adjusting course coverage based on prior assessments to assure that graduating ME students are capable of practicing as engineers.

The Surveys of Enacted Curriculum (SEC) approach is used to analyse and report on the academic content embedded in education instructional components such as curriculum standards, assessments, and teachers' classroom instruction. Through a partnership between the RISE Programme and the Center for Curriculum Analysis, the approach has been used to analyse educational alignment in low- and middle-income country education systems, including in Kenya, Nepal, Nigeria, Tanzania, and Uganda. The SEC approach has many applications including content and alignment analysis for curriculum standards, assessments, and instructional materials; curriculum reform design and implementation support; and teacher professional development and support. This document provides a comprehensive toolkit for conducting an SEC study in LMICs. Following the introduction and background, Section 2 gives an overview of the SEC approach and provides a brief description of sequential steps involved in conducting an SEC study: (i) generating data; (ii) inputting data; (iii) processing and analysing data; and (iv) interpretating results. Section 3 then gives detailed, step-by-step instructions for implementing an SEC study. Section 4 shares lessons learned from conducting SEC studies in LMICs. The document then closes with an Appendix that provides a detailed overview of the SEC tools and other resources provided with this toolkit. These appendices [.zip] are available for download.

The subject of this research is the social roles and stereotypes of femininity in the almanac «Kurier Kryvbasu». The aim of the study is to conduct a systematic analysis of gender stereotypes of femininity in the literary almanac. The article employs the following methods: theoretical – for studying gender theory, stereotyping, and their application in the analysis of the content of the periodical; systemic-structural analysis – for conducting a systematic analysis of the social roles of femininity in the almanac «Kurier Kryvbasu»; structural-typological – for studying the content and structure of the literary almanac; descriptive method - for interpreting women’s roles and stereotypes. Main findings. The role of gender stereotypes in representing women in the media texts of contemporary Ukrainian writers in the pages of the periodical almanac «Kurier Kryvbasu» has been elucidated. A systematic analysis of feminine social roles, including the beautiful woman, the businesswoman, the happy woman, the sex symbol, and the wife-mother, is presented. The social roles and stereotypes of femininity in the literary almanac «Kurier Kryvbasu» are interpreted according to the classification of G. Kovalova and V. Danilyan. Conclusions. In the almanac «Kurier Kryvbasu», entrenched perceptions regarding women’s model appearance, their frivolity and accessibility, professional inferiority, sexual objectification, competent housekeeping, maternal duties, and the pursuit of illusory «female happiness» in the form of marriage, family, and children are used. However, a trend of feminist rise is observed, where the pages of the magazine describe women’s career successes, self-actualization, participation in military actions, etc. Significance. The analysis of gender stereotypes, both femininity and masculinity, in Ukrainian literary-artistic periodicals is important for the development of the contemporary media sphere, as such research will encourage editorial teams to direct media content towards gender balance and gender equality. Taxpayers sometimes engage in complex transactions with uncertain tax treatment, such as mergers, acquisitions, demergers and spin-offs. With the rise of global value chains and proliferation of multinational corporations, these transactions increasingly involve transnational financial arrangements and cross-border dealings, making tax treatment even more uncertain. If improperly structured, such transactions could have costly tax consequences. One approach to dealing with this uncertainty is to create a private rulings regime, whereby a taxpayer applies for a private ruling by submitting a statement detailing the transaction (proposed or completed) to the tax authority. The tax authority interprets and applies the tax laws to the requesting taxpayer’s specific set of facts in a written private ruling. The private ruling offers taxpayers certainty as to how the tax authority views the transaction, and the tax treatment the taxpayer can expect based on the specific facts presented. Private rulings are a common feature of many tax systems around the world, and their main goal is to promote tax certainty and increase investor confidence in the tax system. This is especially important in a developing country like Uganda, whose tax laws are often amended and may not anticipate emerging transnational tax issues. Private rulings in Uganda may be applied for in writing prior to or after engaging in the transaction. The Tax Procedures Code Act (TPCA), which provides for private rulings, requires applicants to make a full and true disclosure of the transaction before a private ruling may be issued. This paper evaluates the Ugandan private rulings regime, offering a comparative perspective by highlighting similarities and contrasts between the Ugandan regime and that of other jurisdictions, including the United States, Australia, South Africa and Kenya. The Ugandan private rulings regime has a number of strengths. It is not just an administrative measure as in some jurisdictions, but is based on statute. Rulings are issued from a central office – instead of different district offices, which may result in conflicting rulings. Rather than an elaborate appeals process, the private ruling is only binding on the URA and not on the taxpayer, so a dissatisfied taxpayer can simply ignore the ruling. The URA team that handles private rulings has diverse professional backgrounds, which allows for a better understanding of applications. There are, however, a number of limitations of the Ugandan private rulings system. The procedure of revocation of a private ruling is uncertain. Private rulings are not published, which makes them a form of ‘secret law’. There is no fee for private rulings, which contributes to a delay in the process of issuing one. There is understaffing in the unit that handles private rulings. Finally, there remains a very high risk of bias against the taxpayer because the unit is answerable to a Commissioner whose chief mandate is collection of revenue. A reform of the private rulings regime is therefore necessary, and this would include clarifying the circumstances under which revocation may occur, introducing an application fee, increasing the staffing of the unit responsible, and placing the unit under a Commissioner who does not have a collection mandate. While the private rulings regime in Uganda has shortcomings, it remains an essential tool in supporting investor confidence in the tax regime.

Thus far in reporting the findings of our project “Fifty Years After: Black Employment in the United States Under the Equal Employment Opportunity Commission,” our analysis of what has happened to African American employment over the past half century has documented the importance of manufacturing employment to the upward socioeconomic mobility of Blacks in the 1960s and 1970s and the devastating impact of rationalization—the permanent elimination of blue-collar employment—on their socioeconomic mobility in the 1980s and beyond. The upward mobility of Blacks in the earlier decades was based on the Old Economy business model (OEBM) with its characteristic “career-with-one-company” (CWOC) employment relations. At its launching in 1965, the policy approach of the Equal Employment Opportunity Commission assumed the existence of CWOC, providing corporate employees, Blacks included, with a potential path for upward socioeconomic mobility over the course of their working lives by gaining access to productive opportunities and higher pay through stable employment within companies. It was through these internal employment structures that Blacks could potentially overcome barriers to the long legacy of job and pay discrimination. In the 1960s and 1970s, the generally growing availability of unionized semiskilled jobs gave working people, including Blacks, the large measure of employment stability as well as rising wages and benefits characteristic of the lower levels of the middle class. The next stage in this process of upward socioeconomic mobility should have been—and in a nation as prosperous as the United States could have been—the entry of the offspring of the new Black blue-collar middle class into white-collar occupations requiring higher educations. Despite progress in the attainment of college degrees, however, Blacks have had very limited access to the best employment opportunities as professional, technical, and administrative personnel at U.S. technology companies. Since the 1980s, the barriers to African American upward socioeconomic mobility have occurred within the context of the marketization (the end of CWOC) and globalization (accessibility to transnational labor supplies) of high-tech employment relations in the United States. These new employment relations, which stress interfirm labor mobility instead of intrafirm employment structures in the building of careers, are characteristic of the rise of the New Economy business model (NEBM), as scrutinized in William Lazonick’s 2009 book, Sustainable Prosperity in the New Economy? Business Organization and High-Tech Employment in the United States (Upjohn Institute). In this paper, we analyze the exclusion of Blacks from STEM (science, technology, engineering, math) occupations, using EEO-1 employment data made public, voluntarily and exceptionally, for various years between 2014 and 2020 by major tech companies, including Alphabet (Google), Amazon, Apple, Cisco, Facebook (now Meta), Hewlett Packard Enterprise, HP Inc., Intel, Microsoft, PayPal, Salesforce, and Uber. These data document the vast over-representation of Asian Americans and vast under-representation of African Americans at these tech companies in recent years. The data also shine a light on the racial, ethnic, and gender composition of large masses of lower-paid labor in the United States at leading U.S. tech companies, including tens of thousands of sales workers at Apple and hundreds of thousands of laborers & helpers at Amazon. In the cases of Hewlett-Packard, IBM, and Intel, we have access to EEO-1 data from earlier decades that permit in-depth accounts of the employment transitions that characterized the demise of OEBM and the rise of NEBM. Given our findings from the EEO-1 data analysis, our paper then seeks to explain the enormous presence of Asian Americans and the glaring absence of African Americans in well-paid employment under NEBM. A cogent answer to this question requires an understanding of the institutional conditions that have determined the availability of qualified Asians and Blacks to fill these employment opportunities as well as the access of qualified people by race, ethnicity, and gender to the employment opportunities that are available. Our analysis of the racial/ethnic determinants of STEM employment focuses on a) stark differences among racial and ethnic groups in educational attainment and performance relevant to accessing STEM occupations, b) the decline in the implementation of affirmative-action legislation from the early 1980s, c) changes in U.S. immigration policy that favored the entry of well-educated Asians, especially with the passage of the Immigration Act of 1990, and d) consequent social barriers that qualified Blacks have faced relative to Asians and whites in accessing tech employment as a result of a combination of statistical discrimination against African Americans and their exclusion from effective social networks.
