In this article, I argue that apparently common values, such as ‘judicial independence’ have significantly different meanings in different judicial cultures. As an illustration, I take Sweden and Spain, countries with very different histories and institutional arrangements. It is my contention that basic values are understood and implemented in the light of historical and institutional settings. These have given rise to issues which a nation’s judiciary feel it has to address and set the context in which the contemporary judiciary has to operate. The purpose is to examine how far national histories and traditions colour the understanding of common values, such as judicial independence and democracy in the judicial process.

Анотація:
This article argues for the necessity of the reform of the judicial appointment qualification, and the judicial appointment powers in Egypt. The article presents judicial appointment process and requirement as the main case study. It illustrates the difference between de facto and de jure in the judicial appointment system in Egypt. These differences pave the road to a deeper understanding of legal and political aspects of discrimination against the poor, woman and political opposition within the appointment process. The article discusses the contemporary challenges in judicial appointment. The challenges can be summarized into: gender inequality, elimination of political minorities, and under-privileged citizens. Finally, the article proposes a solution for the problems identified in this article. These solutions are based on reforming the both the judicial appointment qualification, and the judicial appointment powers in Egypt.

This article analyses the phenomenon of judicial activism in the American electoral process. It tries to estimate whether the political system of the United States of America has become hostage to the law-making role of the judiciary, which actively controls the compliance of election laws with the Constitution, thus drawing courts into purely political processes, or whether the nature of the disputes settled by judges rather makes it impossible for them to avoid being influenced by and influencing issues of a political nature. The article analyses various legal acts and court decisions, mostly concerning the current status of federal campaign finance in the United States, and demonstrates that more spheres traditionally reserved for other branches of government are being appropriated by the judicial branch.

Dado que lo que se conoce como «Nueva Oficina Judicial» supone una profunda reforma en la Administración de Justicia, esta reestructuración, en Euskadi, se llevará a cabo de forma gradual. Este texto pretende presentar el alcance de la Nueva Oficina Judicial y en qué consiste, cómo se ha organizado y se está llevando a cabo la implantación de la Nueva Oficina Judicial en Euskadi en el marco del plan que aprobó el Gobierno Vasco con ese fin, el sistema de calidad que se ha previsto, las conclusiones extraídas de las primeras Oficinas Judiciales implantadas y los retos del conjunto del proceso. Gaur egun Bulego Judizial Berriaren (BJB) ezarpenaren prozesua abian da Euskal Autonomia Erkidegoko barruti judizialetan. «Bulego Judizial Berria»-tzat ezagutzen den Justizia Administrazioaren eraldaketa sakona dakarrenez, berrantolaketa hau gradualki egingo da Euskadin. This article aims to discuss the meaning and the implications of the New Judicial Office, to describe how the implementation of the New Judicial Office in the Basque Country has been organized and applied within the framework of the Implementation Plan adopted by the Basque Government, including the qualitysystem for the Judicial Office, and finally to draw the lessons learned from the process of implementation as it has been taking place within the first Judicial Offices. The challenges of the whole process are thus brought to the fore.

The article introduces a comprehensive analysis of professional judicial corporation in Russia in the XVIII–XXI centuries in its theoretical and historical aspects. The research objective was to clarify the concept and categories of judicial power, as well as to model the process of its development in Russia. The issue of professions and professional corporations as social phenomena is a matter of sociology. For lawyers, sociological studies are important in connection with the issue of judicial corporation development, i.e., its theoretical and historical development. The author relied on the structural and functional approach to the professionalization model developed by sociologist G. Vilensky, who interpreted the categories of judicial profession, judiciary, and judicial corporation. The authors revealed the directions in the development of the professional judicial corporation in Russia in the XVIII–XXI centuries and periodized this process. A separate and permanent judicial function determined the emergence of professional judiciary, organizationally represented by a professional judicial corporation. The profession of a judge is all these elements combined. The judicial corporation developed in Russia in three directions, i.e., normative, organizational, and symbolic, with a prominent regulatory influence of the state. The judicial profession and professional corporation started to develop in Russia during the judicial reforms in the XVIII century. This slow, nonlinear, and discrete process was completed as late as in the XXI century with all the necessary stages of professionalization: the professional corporation finally became the organization form of the Russian judiciary. The authors revealed five stages in the history of the professional judicial corporation in Russia: 1) XVIII century; 2) the first half of the XIX century; 3) 1864–1917; 4) 1917–1989; 5) 1989 – early XXI century.

The rule of law is the cornerstone of democracy and the European Union accession process. Independent judiciary is an important facet of the rule of law, while judicial competence and judicial self-governance are among its elements. One of the dimensions of judicial self-governance is its educational function. By using dogmatic, exegetic and empirical legal methods, the paper examines the extent to which the demands formulated in interim benchmarks for Chapter 23 are aligned with the well-balanced approach to the principle of judicial self-governance and, further, the manner in which such self-governance is implemented in practice within the framework of the process for the adoption of the multiannual work program of the Serbian Judicial Academy. The authors conclude that the plan preparation process represents an adequate platform for duly observing the said concept, while the program itself can contribute to improving the competence of judges and, consequently, strengthening their independence.

The application of scientific knowledge to the practical aims of humans to the change and manipulation of the human environment is called technology. Its application to the judicial process in Lagos State Judiciary has made it easier to access information, file court processes, enable swift, and accurate research, and improve the delivery of justice thereby curbing the delay in the dispensation of justice though this is with some qualifications. The study juxtaposed and analysed the advancement of technology in the judicial process in Lagos State, Nigeria. Historical and case study designs were adopted. Doctrinal method was used in data collection. The primary sources of data were the Constitution of Federal Republic of Nigeria 1999 (as amended), Lagos State High Court (Civil Procedure) Rules 2019; Magistrates’ Court (Civil Procedure) Rules 2009; Lagos State Chief Judge Practice Direction dated April 27, 2020; sources of secondary data were published textbooks, law reports, scholarly peer-reviewed journals, and articles. Data were content-analysed and presented thematically. Findings revealed that technology is needed for the advancement, development, and growth of the judicial process in Lagos State. Many a lawyer and litigants have not utilised the technology in the state’s judiciary. There is no clear legislation in the state protecting or guiding the utilisation of technology in the judiciary save the practice direction issued by the state’s chief judge in 2020. The study concluded that technology is necessary in advancing the judicial process in Lagos State. The study recommended that lawyers and litigants are to be properly educated vide seminars on how to ustilised technology in advancing the judicial process. The Lagos State House of Assembly should initiate a bill for the utilisation and applicability of the technology in the state’s judiciary.

In order to complement existing empirical research on democratic consolidation in Kenya and the role of the judiciary in particular, this mini-­‐dissertation analyses the relationship between judicial appointment processes and judicial independence in Kenya. The escalation of corruption, centralisation and abuse of power by the executive, the lack of government accountability and post-­‐election conflict of 2007 is linked to the dominance of the executive and corresponding subservience of the judiciary. Historically, judicial appointments have been the ambit of the President. The powers given to the President to appoint and remove judges have resulted in judicial appointments premised on allegiance to the executive rather than on upholding justice and the Bill of Rights. To rectify this deficiency, the 2010 Constitution has introduced a merit based system of judicial appointments that meets international standards on judicial independence. The new process requires the President to limit his appointments to the recommendations of a Judicial Service Commission whose responsibility it is to shortlist candidates through a transparent public process. An analysis of the selection of Kenya’s sitting Chief Justice and Deputy Chief Justice demonstrates that the reformed judicial appointment process has delegitimised the executive’s dominance over the judiciary and by so doing has placed Kenya on the road restoring judicial independence.

In recent months, presidential appointments to the Supreme Court have become an increasingly salient issue with both the public and the press. The relevance of the topic makes it an inviting subject for political science research. When looking at the question of judicial quality, the problem that researchers have faced in the past is one of quantifying quality. This work seeks to expand on previous survey research done on the quality of individual justices. By using quality scores (Comiskey 2004) as a dependent variable, it is possible to analyze influences on the President’s nomination choice and their relative impacts on the quality of justices. By using a more rigorous approach, this study can more confidently make assertions about the nature of the nomination and confirmation process and the quality of Supreme Court justices.

The deployment of e-Justice reforms aiming for more efficient and effective justice administration faces great barriers, even though considerable resources have been invested worldwide. This paper describes the factors that have enabled the Electronic Judicial Process deployment in Brazil. Currently, in the country, 98.9% of all judicial proceedings are held electronically. We focus on enablers of normative, technical, political, organisational, institutional, and related governance aspects. The research is important due to its potential to help other countries on their path to the informatisation of justice.

The possession of relevant and correct information has a substantial input in the success on the battlefield. This allows making decisions with potential to result in comprehensive and successful accomplishment of the given mission, by which the security of our personnel would be high. Military intelligence, as a crucial segment in the preparation of the battle actions, requires expert personnel who by utilizing the HUMINT (Human Intelligence) skills will contribute to securing the successfulness of the mission. The communication skills represent the pillar of the successfulness of data-acquisition via interaction with people, securing full obedience of the judicial and moral norms. The research of the role of communication skills in HUMINT in the manuscript is divided in three parts. Part one defines the process of data-acquisition and presents examples in history, by which the judicial frame of interpersonal data-acquisition is established. The second part, the importance of communication and communicational skills on a daily basis, and on a professional level, are pointed out. Part three covers a research of the advocation of the communication skills in HUMINT. Chapter three points out a real scientific evidence about the necessity of communicational skills in HUMINT. The research methodology covers the analysis of expert literature and documents, deduction of the needed elements in context, synthesis of the information and conclusions, sublimating results from scholarly and expert literature, real examples from experiences in the field, and extraction of conclusions. This manuscript proves that communication skills are the most important segment which provides correct, timely and relevant information, in respect of all international judicial norms. In our country, there is not any domestic or international regulation regarding assessment of cumulative impacts of air pollution caused by thermal power stations in the region or environment in where the station is established. According to the Article 56 of the Constitution, everyone has the right to live in a healthy and balanced environment and it is the duty of the State and citizens to protect the environmental rights. These rights include right to live in an environment which is protected and is not damaged or polluted, in addition to social and cultural development, and the efficient use of national resources for in particular the rapid, balanced and harmonious development of industry and agriculture throughout the country, which is stated in the Article 166 of the Constitution. Cumulative impact assessment is evaluation of the effects caused by the combined results of a project or a certain project action and foreseeable past, current and future human actions. Cumulative impact assessment of thermal power stations could be possible with the determination of the combined effects of existing and licensed power stations while licensing process of a new stations. There should be an assessment regarding the place, location and type of other power stations which are already established or are planned to establish in the same city or geographic area. This requirement is crucial in terms of judicial review of licensing of new power stations which are planned to establish upon Environment Impact Assessment is Positive decision.

El estudiante de Derecho requiere de competencias específicas para el buen desempeño en su profesión; por ello, a través de los cursos que brinda nuestro pénsum académico, encontramos múltiples herramientas que permiten el desarrollo de tales competencias. Con este Manual de procedimiento se facilitará la adquisición de esas competencias en la oralidad del sistema judicial colombiano. Tanto en el curso de Teoría General del Proceso como en el de Derecho Procesal Civil se requiere del conocimiento de temas como los actos procesales, dentro de los cuales están las audiencias que estipula el Código General del Proceso (CGP). Las audiencias contenidas en los artículos 372 (audiencia inicial) y 373 (audiencia de instrucción y juzgamiento) son de vital importancia en la vida de cualquier abogado, ya que abogados litigantes, funcionarios judiciales y personas del común podrían verse inmersas o vinculadas a un proceso civil de familia y comercial, contexto en el que, para su resolución, deben agotarse estas audiencias por parte del operador judicial.

This rapid review looks at various constitutional courts established in transitional, fragile and conflict-affected contexts—the approaches adopted, sequencing in their establishment, and experiences with political support. There are few comprehensive accounts in the literature, however, of constitutional courts and their role in judicial review in the contexts of transition and/or as key actors in ‘building democracy’ (Daly, 2017a; Sapiano, 2017). Further, scholars have tended to focus on a relatively small number of case studies from the immediate post-Cold War era, such as South Africa and Colombia (Daly, 2017a). Discussion on the sequencing and steps adopted in establishing a constitutional court in fragile and conflict-affected states (FCAS), or on incentives that have swayed political elites to support these courts, is even more limited. Nonetheless, drawing on various academic and NGO literature, including on countries that transitioned from authoritarianism, this report offers some discussion on sequencing in relation to the constitution-making process and the establishment of the courts; and general reasoning for why constitutional courts may be supported by political actors.

El aparato judicial constituye un elemento crucial del Estado de derecho y del régimen democrático. Hace cerca de cuatro décadas, inició un proceso de reforma judicial que incluyó tanto el mejoramiento del recurso profesional como la eliminación de formas de control que afectaran la imparcialidad de los jueces. La democracia de América Latina se encuentra en un momento de desafección, lo cual también influye en el desempeño del Poder Judicial. El presente trabajo busca acercar el análisis a la situación de la justicia en cuatros países centroamericanos —Costa Rica, El Salvador, Guatemala y Nicaragua— a partir de criterios como reformas institucionales, nombramientos, sentencias, valoraciones de organismos internacionales o de sociedad civil, etc. Reflexionar sobre la independencia judicial implica poner en perspectiva la calidad de los sistemas democráticos y evaluar las promesas de una reforma judicial para entender dónde se ubica la justicia y hacia dónde deberían dirigirse las nuevas agendas.

This report sheds light on challenges faced by Transgender persons in Indian prisons. The report analyses the international and legal frameworks in the country which provide the foundation for policy formulations with regard to confinement of LGBT+ persons, with particular reference to the Transgender community. This report also documents the responses received to right to information requests filed to prison headquarters across the country, which in addition to providing the number of Transgender prisoners in Indian prisons between 1st May 2018 to 30th April 2019, also provides relevant information on compliance within prisons with existing legal frameworks relevant to protecting the rights of Transgender persons in prisons, especially in terms of recognition of a third gender, allocation of wards, search procedures, efforts towards capacity building of prison administrators etc. The finalisation of this report has involved an intense consultative process with individuals and experts, including representatives from the community, community-based organisations as well as researcher and academicians working on this issue. This report aims to enhance the understanding of these issues among stakeholders such as prison administrators, judicial officers, lawyers, legal service providers as well as other non-state actors. It is aimed at better informed policy making, and ensuring that decisions made with respect to LGBTI+ persons in prisons recognize and are sensitive of their rights and special needs.

Esta lectura crítica va dirigida principalmente a estudiantes de derecho, sin embargo, puede ser de gran provecho para abogados recién graduados o aquellos que tengan dudas sobre la aplicabilidad de la Ley 2213 de 2022, que dio firmeza al anterior Decreto 806 de 2020. Este decreto permitió administrar justicia en tiempos de la pandemia por la COVID-19, cuando era imposible la presencialidad en los despachos judiciales. Posteriormente, se convirtió en ley para la administración de justicia y la aplicación al contenido del artículo 103 de Código General del Proceso (Ley 1564 de 2012), que fue innovador al dar uso a las TIC, al servicio de la administración de justicia. La Ley 2213 de 2022 ha brindado un importante respaldo a la administración de justicia en el contexto de procedimientos judiciales no presenciales, ampliando la cobertura de la virtualidad. No obstante, al aplicar la ley, se han producido malentendidos y errores en su interpretación, a menudo con la percepción errónea de que la ley derogó el Código General del Proceso, lo cual no es el caso. Entre esos equívocos interpretativos está el del parágrafo del artículo 9°, que aborda el traslado de escritos presentados por una de las partes a la otra, y que puede ser omitido si se envía por correo electrónico a la contraparte, el cual se omitirá por parte del despacho, de acuerdo con lo establecido el artículo 110 inciso 2°. Es importante aclarar que este parágrafo no se aplica en todos los procesos, y eso es lo que explicará en detalle en este documento.

This analysis characterizes the salient features of the policymaking process (PMP) in Chile. It emphasizes the influence of political institutions on the PMP and examines the linkage between policymaking and policy outcomes in Chile. The salient features of the Chilean PMP are the electoral system and the associated party system, characterized by two long-lived coalitions, a powerful Executive, with de facto control over the agenda, a relatively independent judiciary, a bureaucracy that is relatively free from corruption even by the standards of the OECD, and a series of veto points in the policymaking process that permit adversely affected actors to block policy change. Looking at policy areas in cross section, the authors find that policy areas in which policymakers' interests are more nearly aligned, and in which there is more rapid exogenous change, are associated with more successful efforts at reform, while in areas in which the interests of the Executive and the various veto players diverge, policy tends to stagnate.

This paper analyses the dynamics of policy-making among the various political institutions in Brazil. The authors find that the driving force behind policies in Brazil is the strong set of powers given to the President, though several institutions constrain and check this power, in particular the legislature, the judiciary, the public prosecutors, the auditing office, state governors and the Constitution itself. The electorate of Brazil holds the President accountable for economic growth, inflation and unemployment. At least for the past ten years, and particularly during the Lula administration, executive power has been aimed at pushing policy towards macro orthodoxy. Achieving stable macro policies required constitutional amendments as well as considerable legislation. To attain their goals, the past administrations used their property rights over pork to trade for policy changes. The rationale for members of Congress to exchange votes on policy for pork is that the electorates reward or punish members of Congress based on the degree to which pork lands in their district.

El presente trabajo estudia el mercado hipotecario de viviendas en Uruguay. El principal operador del mercado es el Banco Hipotecario del Uruguay (BHU), una institución estatal que concentra más de 80% del total de los créditos. Esta institución se ha visto en dificultades financieras, lo que ha dado pie a su reforma, la cual se está procesando actualmente. Sus dificultades se deben principalmente a ingerencias políticas en decisiones de carácter técnico, a dificultades prácticas (y no legales) para ejecutar los casos morosos y a la crisis general del sistema financiero de Uruguay. El análisis de los estados contables del BHU muestra un grave descalce financiero tanto en monedas como en plazos, además de una cartera de créditos con un elevado grado de morosidad. En cuanto al sector privado, el mismo es discriminado en favor de esta institución pública en lo que tiene que ver con la posibilidad de ejecución de préstamos morosos. Se describen detalladamente las etapas legales que implica la ejecución de una hipoteca tanto para el BHU como para los bancos privados, se realiza una estimación en base a los remates judiciales de 2001 de los plazos reales que implica la ejecución de la garantía y se construyen ejemplos con los costos que implica la ejecución, según el monto de la hipoteca. El plazo promedio que le toma a los bancos privados llegar al remate judicial desde el momento en que un juzgado declara el embargo es de 601 días. El costo del proceso de ejecución está entre una cuarta parte y la mitad del valor de la hipoteca, dependiendo del monto de la misma. Finalmente se realiza utilizando modelos de variable dependiente cualitativa una estimación de las probabilidades de acceso al crédito hipotecario y a la propiedad de la vivienda. Se encontró que el número de miembros del hogar, su nivel de ingresos, la estabilidad del núcleo familiar, la edad del jefe de la familia y la condición de empleado público del mismo inciden positivamente en la probabilidad de obtener un crédito hipotecario para la vivienda. En cambio, respecto a la educación del jefe del hogar y la localización en la capital no se obtuvieron resultados firmes. Finalmente, se halló evidencia de discriminación a favor de hogares encabezados por mujeres. Este último resultado debe tomarse con cautela, debido a la probable presencia de problemas de autoselección en la muestra.

Este trabajo, de corte académico, tiene como tema central analizar el sentido y significado de la carga de la prueba y la carga dinámica de la prueba en el contexto latinoamericano; teniendo como eje problematizador la ausencia de estudios comparados. Como centro temático, se tuvieron en consideración algunos principios generales del derecho, tales como la equidad y el equilibrio probatorio, en su cosmovisión desde la materialización procesal hasta su finalidad que es la búsqueda de la verdad procesal. Los conceptos “carga de la prueba” y “carga dinámica de la prueba” no se han unificado ni precisado en muchos países de América Latina; en tal sentido, se percibe una ambivalencia muy marcada, e incluso un desconocimiento total y quizá una falta de doctrina y jurisprudencia al respecto; la cual solo se profundiza por algunos tratadistas de forma muy superficial. Colombia es el único país que lidera un interés particular por determinar su alcance y establecimiento. El enfoque persigue la decantación de estos procesos dispersos y aislados, así como estudiar las tendencias teóricas actuales del principio de la carga dinámica de la prueba que abre nuevos espacios de discusión jurídica. Como quiera que las consideraciones se sustentan a modo de texto expositivo-argumentativo, abordaremos el recurso de la interpretación sistémica, el cual nos permitirá analizar leyes, códigos, jurisprudencia, en su contexto constitucional, además de traer a colación diferentes pronunciamientos judiciales. Finalmente, acudiendo al enfoque analítico-descriptivo, apoyado en las categorías del conocimiento, fijaremos a modo de conclusión, posturas ideológicas en torno reflexivo que por su puesto redundarán en aportes importantes de enriquecimiento jurídico y académico.
