Resumen: En el marco del arbitraje multiparte, la entrada e intervención de terceros es definida como la incorporación de partes adicionales a un arbitraje ya iniciado. Este mecanismo procesal presenta, sin embargo, multitud de dificultades que derivan de la naturaleza eminentemente consensual de la institución arbitral. Así, entre otras, la constancia de la voluntad -expresa o tácita- de todas las partes involucradas en el arbitraje a la entrada del tercero o la salvaguarda de su derecho esencial de participar de manera directa y equitativa en la constitución del tribunal arbitral y de las garantías de privacidad y confidencialidad del arbitraje. Partiendo de estas someras premisas, este trabajo tiene como objetivo el análisis crítico de las disposiciones específicas sobre la admisibilidad y presupuestos de la entrada e intervención de nuevas partes en el arbitraje que las instituciones arbitrales internacionales de mayor relevancia han regulado en los últimos años.Palabras clave: Entrada, intervención, terceros, partes adicionales, arbitraje multiparte, tribunal arbitral.Abstract: One of the major challenges that international arbitration has faced in the last decades is the regulation of multiparty arbitrations, which involve a confrontation between more than two parties with opposing interests. In this context, joinder and intervention deals with the need, in terms of justice and efficiency, to bring an additional party into the proceedings when the arbitration may already be in progress. However, the main characteristic of arbitration is its consensual nature. For this reason, mechanisms for joinder or intervention present considerable difficulties related to the principle of party autonomy, the right to equally participate in the nomination of the arbitrators and the protection of privacy and confidentiality in arbitration proceedings. Apart from dealing with these difficulties, the author discusses in this article the latest joinder provisions contained in leading arbitral rules.Keywords: Joinder, Intervention, Third parties, Additional parties, Multiparty Arbitration, Arbitral Tribunal

AbstractParties find it difficult to determine which Nigerian High Court should intervene in the appointment of arbitrators due to conflicting judicial precedents. This perennial challenge has defied any legal solution. Considering relevant case law, this article examines the Arbitration and Conciliation Act (ACA) vis-à-vis the Nigerian Constitution. The main argument is that the Nigerian Constitution read alongside the ACA confers the Federal High Court with additional jurisdiction to appoint arbitrators regardless of which court has jurisdiction concerning the underlying dispute. There are also uncertainties regarding the intervention jurisdiction of Nigeria's National Industrial Court to appoint arbitrators. Currently, no other court can exercise intervention jurisdiction in employment disputes. This article analyses recent decisions of the National Industrial Court and argues that this Court can only intervene to appoint arbitrators where both parties request the appointment in a pending action before the Court. It is also argued that decisions concerning the appointment of arbitrators through judicial intervention can be appealed.

In arbitration, the ability to take part in proceedings is exclusively determined by evidence of the parties' 'consent' to arbitrate. However, this approach is unable to accommodate modern construction projects which have become increasingly complex and require the participation of multiple parties for their completion. Despite playing active roles in construction projects and having substantial legal and financial interests in the outcome of disputes, third parties may not take part in arbitral proceedings between two contracting parties who have consented to an arbitration agreement. This may result in an inequitable and commercially undesirable situation not only for third parties but often for one of the contracting parties who may require the third party's participation to assert certain claims or defences. This article suggests that where multiple parties are involved in one construction project a contextual approach should be used to determine arbitral jurisdiction. Where a third party voluntarily submits to arbitral jurisdiction upon invitation of one of the contracting parties and where the intervention is to assist the inviting party's claims or defences, a contextual approach would provide a more effective means of resolving the disputed issue of third-party intervention without offending the principle of party autonomy or arbitration's consensual origins.

In questo studio sono stati analizzati una serie di strumenti previsti dal codice di rito volti ad agevolare e rendere effettiva la scelta arbitrale nel rispetto delle peculiarità e dei fini propri di questa via alternativa di risoluzione delle controversie dove l’autonomia privata svolge il ruolo fondamentale, prendendo come riferimento l’arbitrato rituale senza, dunque, analizzare gli stessi istituti con riguardo all’arbitrato libero o irrituale. Le ragioni della scelta sono di natura puramente teorica e fondate sulla controversa natura dell’arbitrato irrituale con l’obiettivo di verificare, attraverso una puntuale analisi normativa e dei principi generali applicati all’arbitrato rituale, se il nostro modello di arbitrato sia una risposta adeguata a quella crescente domanda di giustizia alterativa. L’indagine si è svolta, dunque, attraverso lo studio delle norme che concernono il procedimento di nomina degli arbitri (artt. 809 e 810 c.p.c.), dove la tensione tra autonomia privata è evidente quanto volontà del legislatore di favorire la scelta privata nel rispetto di principi generali dello stato. L’analisi dei meccanismi di nomina degli arbitri e dei principi ad essa sottesi rappresentano la base per entrare così nel cuore della trattazione sugli interventi giudiziari ausiliari all’arbitrato. In particolare, spazio rilevante è stato riservato all’art. 810 c.p.c. che disciplina il procedimento per la nomina sostitutiva degli arbitri da parte del Presidente del Tribunale, variamente richiamato da altre norme quali gli artt. 809, 811, 813ter, 815 e 816 ter c.p.c. Questi strumenti hanno la finalità di garantire non solo la celebrazione del procedimento arbitrale, secondo la volontà espressa dalle parti con il patto compromissorio, ma anche quella di fare in modo che lo stesso si svolga senza ostacoli tali da incidere sul suo regolare svolgimento, con effetti pregiudizievoli che possono ex post riversarsi sulla pronuncia finale. Il tema degli interventi ausiliari ha incluso anche il procedimento di liquidazione dei compensi arbitrali ex art. 814 c.p.c., altro tassello che ben si inserisce nell’economia di questo lavoro anche se, in qualche modo, “esterno” al procedimento arbitrale. Altro istituto assolutamente meritevole di attenzione per lo spiccato carattere ausiliario è quello delineato ai sensi dell’art. 816 ter c.p.c. che disciplina il così detto ausilio istruttorio. Dall’analisi, emrege come si tratti, in questo caso, sia di colmare quella carenza di imperium degli arbitri rispetto al giudice ordinario che non consente ai primi l’emissione di provvedimenti coercitivi nei confronti delle parti e, soprattutto, di terzi, ma anche di consentire alla giustizia privata di ottenere un risultato, sotto l’aspetto della decisione della lite, il più affidabile possibile.
In this study, a series of tools provided by the ritual code were analyzed, aimed at facilitating and making the arbitration choice effective in compliance with the peculiarities and purposes of this alternative dispute resolution method where private autonomy plays the fundamental role, taking as a reference the ritual arbitration without, therefore, analyzing the same institutions with regard to free or informal arbitration. The reasons for the choice are purely theoretical in nature and based on the controversial nature of the non-ritual arbitration with the aim of verifying, through a detailed regulatory analysis and the general principles applied to ritual arbitration, whether our arbitration model is an adequate response. to that growing demand for alterative justice. The investigation was carried out, therefore, through the study of the rules concerning the procedure for the appointment of arbitrators (articles 809 and 810 of the Italian Civil Code), where the tension between private autonomy is evident as much as the will of the legislator to favor private choice while respecting of general principles of the state. The analysis of the mechanisms for appointing arbitrators and the underlying principles represent the basis for entering the heart of the discussion on judicial interventions auxiliary to arbitration. In particular, relevant space has been reserved for art. 810 c.p.c. which governs the procedure for the replacement appointment of arbitrators by the President of the Court, variously referred to by other regulations such as Articles 809, 811, 813ter, 815 and 816 ter c.p.c. These tools have the purpose of guaranteeing not only the celebration of the arbitration procedure, according to the will expressed by the parties with the arbitration agreement, but also to ensure that it is carried out without obstacles such as to affect its regular conduct, with effects prejudicial that can ex post affect the final ruling. The topic of auxiliary interventions also included the procedure for the liquidation of arbitration fees pursuant to art. 814 c.p.c., another piece that fits well into the economy of this work even if, in some way, "external" to the arbitration procedure. From the analysis, it emerges that, in this case, it is a question of filling the lack of imperium of the arbitrators with respect to the ordinary judge who does not allow the former to issue coercive measures against the parties and, above all, third parties, but also to allow private justice to obtain as reliable a result as possible from the point of view of deciding the dispute.

Abstract: Thesis title: "The arbitrary medical operation: the problem of consent" This thesis concerns the profiles of criminal implications of medical-surgical treatment performed without the patient's consent. First of all, the referential provisions of the law are identified. For this reason, the foundation of informed consent is analyzed in accordance with constitutional requirements. It is examined closely the gradual change of the doctor-patient relationship. Subsequently, this paper proceeds with the analysis of crimes. In the first place, the question regarding the crime of intentional injury is taken on. It examines the meaning conferred to the term ‘illness and the reflection focuses on the possible outcomes of medical intervention. Afterwards it is considered the hypothesis of the art. 584 Penal Code in case of the patient’s death. Even the provided and punished offenses referred to the Articles 590 and 589 of the Penal Code are analyzed with a depth study at the Institute of guilt. Then the analysis focuses on crimes against the moral freedom provided by the Articles 610 and 613 of the Penal Code and, for the case of death of the patient, it is taken into consideration the Article 586 Penal Code. All that occurs because, according to a recent doctrinal orientation, the medical-surgical act not allowed, rather than determining aggression to the patient’s individual safety, affects the freedom of self-determination to the cure. Eventually this work examines the evolution of jurisprudence, which originates in the leading case no. 5639 of 1992, and is not yet ended, despite the United Sections n. 2437 in 2008. The many judgments on the subject are reviewed. At this point, it is investigated the basis for the lawfulness of the medical-surgical activity and it is examined the multiple orientations. In the last part of this thesis, a possible solution is identified and a provision to protect the patient’s consent is proposed.
Titolo della Tesi: “L’intervento medico arbitrario: il problema del consenso” La Tesi riguarda i profili di rilievo penale del trattamento medico-chirurgico eseguito in assenza del consenso del paziente. In primis, vengono individuate le disposizioni legislative di riferimento. Per questo motivo, viene analizzato il fondamento del consenso informato in base alle norme costituzionali. Viene approfondito il progressivo mutamento del rapporto medico-paziente. Successivamente, si procede all’analisi dei reati. Anzitutto, viene affrontata la problematica riguardante il delitto di lesioni personali dolose. Viene indagato il significato da attribuire al termine malattia, la riflessione si focalizza sui possibili esiti dell’intervento medico. In seguito, viene considerata l’ipotesi dell’art. 584 c.p. in caso di morte del paziente. Vengono anche analizzati i reati previsti e puniti dagli articoli 590 e 589 c.p. con un approfondimento all’istituto della colpa. L’analisi si concentra sui reati contro la libertà morale degli articoli 610 e 613 c.p. e, per il caso di morte del paziente, viene preso in considerazione l’art. 586 c.p. Ciò in quanto, secondo un recente orientamento dottrinale, l’atto medico chirurgico non consentito, piuttosto che determinare un’aggressione all’incolumità individuale del paziente, lede invece la sua libertà di autodeterminazione alle cure. Il lavoro prende in esame l’evoluzione della giurisprudenza, che trae origine dal leading case n. 5639 del 1992, e non trova ancora fine, nonostante le Sezioni Unite n. 2437 nel 2008. Le numerose pronunce sul tema vengono commentate. A questo punto si indaga il fondamento di liceità dell’attività medico-chirurgica, vengono presi in esame i molteplici orientamenti. Nella parte finale della tesi, si pensa ad una possibile soluzione e si propone l’introduzione di una disposizione a tutelare il consenso.

A tese discute o problema dos terceiros na arbitragem. Ela distingue os planos substantivo (contratual) e processual (jurisdicional) da arbitragem e, portanto, o status de parte e terceiro com relação, respectivamente, à convenção de arbitragem e ao processo arbitral. Depois de desenvolver as premissas teóricas na Parte 1, a Parte 2 expõe as teorias contratuais e societárias por meio das quais um não-signatário pode ficar vinculado à convenção de arbitragem, com destaque para a extensão a todos os acionistas da companhia da cláusula compromissória estatutária, bem como para a aplicação do princípio da boa-fé objetiva (teoria dos atos próprios, estoppel) para impedir com que determinados signatários burlem a convenção de arbitragem ao incluir terceiros no polo passivo da demanda ou, ainda, para impor a arbitragem a não-signatários que derivaram um benefício do contrato inter alios. Na Parte III, a atenção volta-se para o processo e a sentença arbitral. Expõe-se uma teoria dos efeitos da sentença, buscando-se explicar a sua potencial eficácia ultra partes com base: a) na necessidade de realizar o direito da contraparte à tutela jurisdicional (adquirente do direito litigioso, sucessores post rem judicatam); e b) na identificação de nexos de prejudicialidade-dependência permanente entre as relações jurídicas no plano do direito material (terceiro titular de situação dependente). Refutam-se, em passo seguinte, teorias que preconizam o valor absoluto da sentença. Oferece-se, como núcleo da tese, uma reconstrução dogmática das modalidades de intervenção de terceiro, buscando adaptá-las à arbitragem para alcançar, em cada situação, um justo equilíbrio entre as expectativas contratuais das partes originárias e a natureza privada da arbitragem, de um lado, e os efeitos da sentença perante terceiros, de outro. Conclui-se que, em alguns casos, legitima-se o terceiro a intervir voluntariamente, mesmo contra ou independentemente da vontade das partes, se ele estiver sujeito aos efeitos da sentença. Em hipótese excepcionalíssimas, ademais, a parte pode sujeitar um terceiro aos efeitos de intervenção, provocando a sua assistência no processo arbitral.
The thesis addresses the problems of third parties in arbitration. It distinguishes the substantive (contractual) and procedural dimensions of arbitration and, hence, the status of parties and third parties in connection with, respectively, the arbitration agreement and the arbitral proceedings. After spelling out theoretical premises in Part 1, Part 2 covers the contractual and corporate theories by which a non-signatory may be bound by the arbitration agreement, highlighting the extension to all shareholders of the agreement in the corporate bylaws, as well as the application of the equitable doctrine of estoppel to bar certain signatories from avoiding the arbitration agreement by including third parties as defendants or even to impose arbitration onto non-signatories who derived a benefit from the contract inter alios. In Part III, my attention turns to the proceedings and the arbitral award. I set out a doctrine of the effects of judgments, seeking to explain their potential effects on third parties based: a) on the prevailing need to preserve the counterpartys right to a binding declaration on its asserted claims (acquirers, successors post rem judicatam); b) the identification of substantive ties between legal relationships that make the third parties rights permanently dependent on the situation between the parties. I then refute theories ascribing absolute value to the award vis-à-vis third parties. As the core of the thesis, I offer a doctrinal reconstruction of third party interventions, seeking to adapt them to arbitration in order to achieve, in each situation, a fair balance between the contractual expectations of the original parties and the private nature of arbitration, in one hand, and the effects of the award on third parties, on the other. I conclude that a third party should be allowed to intervene, albeit against the will of the parties, if it is subject to the concrete effects of the arbitral award. In exceptional situations, moreover, a party may vouch in a third party, who will then be bound by the determinations of factual and legal issues made in the award.

The relationship between the judiciary and arbitration must be based upon integration and cooperation and not upon competition and tension. From this point, the competent court must play the vital role of supporting and assisting the arbitration process during its various stages. To the extent that this relation is successful and harmonized, arbitration will be effective in resolving disputes within the shortest time and at the least expense. Judicial involvement in arbitral proceedings occurs during several stages of arbitration. This involvement starts with the competent court‟s decision to abstain from considering a case involving a dispute over an agreement that includes an arbitration clause. Court instead intervenes to enforce the arbitration agreement, supervising the selection of the arbitral tribunal and assisting in that process whenever the need arises. Thereafter, the court monitors the course of the arbitral proceedings by considering claims for the arbitrators' challenge and dismissal and, if such claims are successful, filling the resulting vacancy. Court Intervention extends to include an important and critical stage of the arbitral proceedings, which is the stage of pleading before the competent court. Whereas the competent court enjoys the power to enforce judicial decisions, the arbitral tribunal does not have such power. In this context, judicial assistance is indispensable to the arbitral tribunal, for example, in resolving a preliminary point, issuing a subpoena to a witness who refuses to appear before the tribunal, consolidating arbitral proceedings, ordering an uncooperative party to provide documents related to the dispute, rendering interim and conservatory measures, and extending the time limit for rendering the arbitration award. In considering the significance of the court's assistance of and support for arbitration at the procedural stage, the importance and contribution of this study is in its exploration of the pivots and patterns of the expected judicial review and assistance based upon both the provisions and rules of arbitration and judicial precedents. Interviews conducted with senior judges, arbitrators and chiefs of international arbitration centres provide a rich tributary that enhances this study and supports it with vast and vital experience and with fresh information that cannot be found in any previous scientific research of this topic. In short, this study focuses upon the conception of the judicial involvement in supporting arbitral proceedings inside the Kingdom of Saudi Arabia and upon evaluating this involvement in comparison with the involvement of the judiciary in the rest of the GCC states and international applications in this regard. Moreover, the study offers proposals and recommendations to the Saudi legislator in particular and to the Gulf legislator in general, and draws a model framework for the relationship between the judiciary and arbitration during the proceedings stage.

On the first chapter of this work, I am going to analyze the interventions of national Courts authorized by the Chilean arbitration law and see if the regulations are self operative or if they need further regulation in order to work properly. In those cases were the provisions are not self operative or the current writing difficult their interpretation and application I will propose modifications and the incorporation of amendments. For this task I will compare, when possible, the Chilean provisions with the corresponding provisions of the Peruvian and Irish arbitration laws and make a parallel with the Chilean international arbitration regulations. The reason why the Peruvian and Irish arbitration laws were chosen to develop this work is because these laws have been recently enacted and adjusted to the amendments of the UNCITRAL model law of 2006, so they can reflect the last tendencies in the subject. These laws may include interesting or relevant provisions that may be included in the Chilean law. On the second chapter, I will refer to the decision of the Constitutional Court referred to article 5 of the Chilean law and check if the interventions consecrated on the conservation, disciplinary and economical competences of the Supreme Court of Justice of the Republic of Chile are applicable to the processes under the international commercial arbitration law. Particularly, I will focus my work on trying to understand the legal nature of the ruling of Chilean Courts of Appeal that decides the set aside consecrated on article 34 of the Chilean arbitration law. Having established the mentioned legal nature I will try to demonstrate that the legal nature of that ruling does not entitle anyone to invoke the Chilean legal remedy of complaint against that ruling, leaving the non-intervention principle intact.

AbstractSome international investment agreements (IIAs) allow states that are parties to a treaty, but are not party to a specific dispute under that treaty, to intervene on a limited basis in order to make submissions on matters of treaty interpretation. Such mechanisms have proved to be highly valued by treaty parties, as evident by the many recently-concluded IIAs containing increasingly sophisticated non-disputing treaty party (NDTP) provisions. This chapter: (1) provides the background on NDTPs mechanisms, with a focus on the North American Free Trade Agreement (NAFTA) (the first-known IIA to contain such a provision); (2) examines the possible connection between tribunals failing to give due regard to treaty parties’ interpretive positions (again focusing on NAFTA) and the current backlash against investor-state dispute settlement (ISDS); and (3) analyses trends in recently-concluded IIAs. It is argued that the apparent lack of deference given by tribunals to NDTP submissions may be contributing to the current backlash against ISDS, based on two discernible trends: (1) an increase in the number of IIAs containing NDTPs provisions; and (2) provisions that now state that not only are treaty interpretations made by treaty parties binding on tribunals (such provisions also have their genesis in NAFTA), but that, in addition, tribunals’ decisions must be consistent with such agreed interpretations (the latter an innovation of a NAFTA party in 2003). Such trends are also visible at the institutional and multilateral levels, such as the revision of the Arbitration Rules of the International Centre for Settlement of Investment Disputes (ICSID) and the Mauritius Convention on Transparency in ISDS of the United Nations Commission on International Trade Law (UNCITRAL), and show no sign of slowing down.

This chapter looks at Article 35 of the ICDR Rules, which concerns compensation of the arbitral tribunal. Under the ICDR Rules, the case Administrator at the ICDR takes the lead in ensuring that fee rates are agreed between all tribunal members and the parties. Those fees are almost always based on the arbitrators’ previously advised hourly rates, although the Administrator may intervene to modify rates to avoid any significant disparity. Similarly, although not formally required under the rules, throughout the arbitration and in the final costs of arbitration, the Administrator reviews the reasonableness of the arbitrators’ fees and expenses. In contrast to the equivalent provision in the AAA Commercial Rules, section R-55, the ICDR Rules envisage a more hands-on role to be played by the institution.

This chapter studies situations under Brazilian law in which a non-signatory may be bound by an arbitration agreement to which it was not originally a party. It also discusses relevant principles in Brazilian Contract Law and Brazilian Arbitration Law, as well as the case law of the Brazilian Superior Tribunal of Justice (STJ). The STJ plays a vital role in the Brazilian legal system, as it (i) sets out the jurisprudence to guide the lower courts; and (ii) amends and harmonizes the decisions of the lower courts, where needed. The STJ also retains exclusive jurisdiction to recognize and enforce foreign awards in Brazil. When does Brazilian law become relevant to ascertain questions of binding a non-signatory to arbitration? The law applicable to the arbitration agreement is the relevant law for the purpose of deciding whether (and in which circumstances) a non-signatory can be bound to arbitration. In situations where the parties have agreed that the law applicable to the arbitration agreement is the law of Brazil, the issues of (i) whether a non-signatory can be compelled to arbitrate or (ii) whether a non-signatory can intervene in an arbitral procedure will, of course, be tested against this law.

In this work, we investigate the problem of computing an experimental distribution from a combination of the observational distribution and a partial qualitative description of the causal structure of the domain under investigation. This description is given by a partial ancestral graph (PAG) that represents a Markov equivalence class of causal diagrams, i.e., diagrams that entail the same conditional independence model over observed variables, and is learnable from the observational data. Accordingly, we develop a complete algorithm to compute the causal effect of an arbitrary set of intervention variables on an arbitrary outcome set.

ABSTRACT The heterogeneous nature of sports relations, which are subject to the regulation of sports law, predetermines the different nature of regulation, which in turn provides for a different “autonomy” of sports organizations. The autonomy of individual and collective action is possible only in the existence of normative systems and cultural models that allow different degrees of conformity to their prescriptions and requirements. The research aims to reveal some legal, sociological, and practical aspects of autonomy in sports, and features of manifestation on a national and European scale. The study‘s objectives are: normative documents, case law in connection with the issues discussed at the level of Bulgaria and the European Union, recommendations, reports from various committees, and others. To solve the main tasks, achieve the goal and prove the hypothesis, a complex research methodology of normative and literature sources, content analysis, and included observation has been applied. Conclusion: The globalization of sport is increasingly shifting the legal framework of the international sports system to international sports bodies such as the International Olympic Committee, the World Anti-Doping Agency, and international sports federations. A significant effect of this change has been the erosion of the ability of domestic legal systems to intervene, especially when the rules of international sports bodies conflict with domestic norms and values. Changing regulatory acts that unjustifiably limit the autonomy of sport, in most cases, sports arbitrations deal with the imposed doping-related penalties. Possibilities for improving the work of the arbitration autonomy of sports organizations have been opened. There is a risk of limiting the autonomy of the sports industry, of interference, and on the other hand, there is another risk - reaching such a kind of sports autonomy which will be gradually withdrawn from national jurisdictions.
