In the private international law of Iran and Egypt, due to the significant influence of Islamic law and the French legal system, the law governing inheritance is the law of the deceased's nationality. However, in English private international law regarding inheritance, there are two conflict resolution rules: one for movable property and the other for immovable property. Accordingly, the governing law for movable inheritances is the law of the deceased's residence, while immovable inheritances are subject to the law of the location of the property. Given that inheritance and its related matters are a delicate blend of law and religion, it is essential for legislators to give serious consideration to the central role of individuals' religion when establishing substantive rules in the conflict of laws governing inheritance. Such consideration is often overlooked in English law and, to some extent, in the laws of Iran and Egypt concerning inheritance.

Abstract. The article discusses the issues of inheritance law in the context of private international law. Special attention is paid to conflicting norms and problems arising in the regulation of inheritance relations with the involvement of an international element, analysis of legal systems of different countries. Inheritance in international private law has an important practical significance, since in view of the migration processes and the growth of the pace of acquisition of real estate abroad, the urgency of the need to regulate inheritance relations complicated by a foreign element is beyond doubt. Regulation of inheritance relations in international private law is carried out in several ways: application of the conflict of laws rule and the rule of national material law to which it refers; use of norms contained in international treaties. The issue of legal regulation of inheritance legal relations complicated by a foreign element is solved using the conflict-of-law method of regulation, which determines the law of which state should be applied to regulate certain relations. Harmonization of inheritance legislation of Ukraine in the field of international private law and its convergence with the legislation of the European Union requires the solution of a number of issues, such as: clarifying the definition of the testator's last place of residence; establishing the order of succession of heirs according to the law depending on the degree of family ties; peculiarities of inheritance of movable and immovable property; removal from the right to inheritance; determination of the legal nature of the will of the spouses; inheritance by children born with the help of assisted reproductive technologies and others. Today, a significant number of people become participants in hereditary relations. This article analyzes aspects of inheritance in private international law. These aspects are considered as a key mechanism for achieving a certain consistency between national legal systems, reducing differences between them based on generally recognized legal principles and advanced concepts of legal culture. The article discusses the legal problems of inheritance relations in the Russian Federation and foreign countries. The relevance of the topic under study is due to the need to form a legal environment emerging in the process of inheritance of tort obligations and the form of the will in Russian and foreign laws. A legal analysis of Russian legislation and international treaties, foreign legislation and judicial practice in the field of inheritance regulation in the Russian Federation and foreign countries is carried out. Particular attention is paid to the unification of international norms in the field of testament form. The author concludes that international law on inheritance has its drawbacks and requires further adjustments.

The first section of the article deals with the characterization of genuine links in general, and the comparative analysis of personal genuine links present in the selected national inheritance tax statutes. The aim of this section is to show the diversity and incompatibility of personal genuine links, which may lead to dozens of cases of international double (or even multiple) taxation of cross-border inheritances. This is followed by an attempt to talk about international and European standards in respect of personal genuine links in national law as well as to comment on the comparability between the personal genuine links depicted in the first section with the aforementioned standards. The article is finished with a plea for adequacy in describing conflicts of genuine links in inheritance tax cases and for more impact of the European legislator on potential harmonization mechanisms.

In the scientific article the author conducted a scientific study of the concept and content of international and national sources of inheritance law. Based on the study, the author concluded that the system of sources of inheritance law of Ukraine can be represented as follows: I. The basis of inheritance law (Article 41 of the Constitution of Ukraine). ІІ. International treaties and national law governing inheritance relations complicated by a foreign element: the Law of Ukraine “On Private International Law”, the Convention on the Conflict of Laws Concerning the Form of Testamentary Dispositions, the Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters, bilateral agreements on legal assistance and legal relations in civil and family matters governing the issue of inheritance, consular conventions regarding the settlement of inheritance issues. III. Acts of civil law that regulate inheritance: Civil Code of Ukraine, including Book Six, certain rules contained in other laws of Ukraine and equivalent regulations on inheritance issues (including Family, Tax, Land, Civil procedural codes, laws of Ukraine “On ensuring the rights and freedoms of citizens and the legal regime in the temporarily occupied territory of Ukraine”, “On notaries”, “On copyright and related rights”, etc.), resolutions of the Cabinet of Ministers of Ukraine and legal acts of the Ministry of Justice of Ukraine on issues related to inheritance. IV. Legal custom or contract, including inheritance agreements, agreements of heirs to determine the order and size of inheritance shares. V. Judicial practice on inheritance issues: resolutions of the Plenum of the Supreme Court of Ukraine “On judicial practice in cases of inheritance”, letter of the Supreme Specialized Court of Ukraine on civil and criminal cases “On judicial practice of civil cases of inheritance”. VI. Decisions of the Constitutional Court of Ukraine adopted on the official interpretation of the rules of inheritance law, including in the case of the right to a mandatory share in the inheritance of adult incapacitated children of the testator.

Introduction. The paper is devoted to the study of the peculiarities of the inheritance of deceased property in private international law. The concept of “foreclosed property” is defined. The relationship between the terms “foreclosed property” and “dead heritage” has been clarified. Purpose. In private international law there are two theories (principles) of acquisition of ownership of foreclosed property: the theory of occupation and the theory of inheritance. The essence of each of the approaches to the inheritance of property by the state in private international law is clarified. The list of countries where the “principle of occupation of foreclosed property” is enshrined in law and the countries that apply the theory of inheritance on the principle of the closest connection. Results. The opinions of scientists on the expediency of applying each of the principles have been studied. It has been found that the most effective way to overcome conflicts over the inheritance of foreclosed property between states is through international agreements. In all international treaties governing the relations of inheritance with a foreign element in which Ukraine participates, the same solution to the issue of inheritance of foreclosed property by the state is enshrined. Movable property shall become the property of the Contracting Party of which the testator was a national at the time of death, and immovable property shall become the property of the Contracting Party in whose territory it is located. Conclusion. It is concluded that the application of the third principle of inheritance of foreclosed property in private international law – the “principle of splitting the hereditary statute”.

In the conditions of modern society, inheritance law is becoming the subject of increasingly active study and analysis. In the context of the transition of the Republic of Kazakhstan to a market economy, the implementation of socio-economic reforms and the development of information technology, the issues of inheritance law acquire new aspects and challenges. In this regard, this study is aimed at conducting a comparative analysis of the features of inheritance by law both in the Republic of Kazakhstan and in other countries, in order to identify similarities and differences in the legal regulation of this area. The purpose of the study is to study the key aspects of inheritance law using a comparative legal approach. Within the framework of this study, several main tasks have been identified: first, to analyze the legislation regulating inheritance by law in the Republic of Kazakhstan and in other countries of the world. This stage includes the study of the basic rules and principles governing the inheritance process in various legal systems. Secondly, to determine the circle of persons who have the right to inherit by law both in the Republic of Kazakhstan and in foreign countries. This important study will reveal differences in the established categories of heirs and the legal basis for their succession.Thirdly, to conduct a comparative analysis of the legal regulation of heirs by law in the civil law of the Republic of Kazakhstan and similar norms in foreign countries. This stage of the analysis will reveal similarities and differences in legal approaches to inheritance and its consequences for heirs. The results of the study are supposed to be used as a basis for developing recommendations for improving inheritance legislation, as well as for a deeper understanding and application of inheritance rules both in the Republic of Kazakhstan and in other countries. Thus, the study has practical significance and can contribute to improving the legal regulation of inheritance relations, ensuring a more equitable and effective succession procedure.

The main features of inheritance relations with a foreign element are given. The main issues to be resolved in inheritance relations with the help of international agreements concluded by Ukraine with foreign states on legal assistance in civil cases were identified. It has been established that the norms of two dozen bilateral international agreements on legal assistance and about three dozen consular conventions that Ukraine has concluded with many states are devoted to the issue of international inheritance. Some of the conventions operate in the order of succession of Ukraine after the collapse of the USSR. Comparative analysis of the content of the texts of bilateral international agreements of Ukraine with foreign states on legal assistance in civil matters allowed classifying them by methods of regulation of inheritance relations into three groups: ones that do not contain separate articles (articles) on the regulation of inheritance relations; agreements on legal relations and legal assistance in civil matters between Ukraine and foreign countries, which contain provisions on inheritance relations, which in turn are divided into two groups depending on the structure and content of the articles: inheritance cases and the right to inheritance. The analysis gives grounds to claim the lack of a unified approach to the conclusion of contracts in the third group. This cannot be explained by the will of the parties, because the content of this group of agreements has a high level of identity. The agreement between Ukraine and the Republic of Cyprus on legal assistance in civil matters, which has a separate section IV on inheritance, has an exceptional content in the regulation of inheritance relations, but in comparison with other two groups of agreements with foreign countries contains very brief information. From the analyzed bilateral international agreements it was concluded that most aspects of inheritance relations are regulated by the personal law of a testator or the right of location of a property. There is a gradual overcoming of the problem of splitting the inheritance status, regardless of the location of the inheritance, the spread of the possibility of choosing the applicable law to the estate.

La problématique des successions internationales a, récemment, accédé à l’actualité en Russie après l’ouverture du pays et la libération des échanges privés internationaux. En effet, avec la disparition de l’URSS en 1991, les russes se sont vus ouvrir les frontières, avec la possibilité notamment de développer leur commerce dans une économie mondiale. Ce sont désormais l’ensemble des États qui connaissent une immigration, partagée entre une volonté d’enracinement dans le pays d’accueil, et sinon le désir de retour, du moins la volonté de faire profiter la famille restée dans l’État d’origine de leurs économies. Cette population immigrée souvent vieillit et meurt dans le pays d’accueil. Cette intensification de l’immigration nous montre la nécessité d'une réglementation russe et d’une application claire de cette réglementation dans le domaine des successions internationales. Les règles de conflit russes sont principalement régies par des dispositions de droit interne, car les rares Conventions internationales signées par la Fédération de Russie dans ce domaine sont intentionnellement de nature, soit régionale, soit bilatérale. Pour cette raison, les règles de droit international privé et les règles substantielles russes reflète la spécificité de son système social, économique et juridique. La présente thèse a pour objectif d’étudier ces règles de manière transversale sur toute la matière du droit russe des successions internationales. Les deux principaux axes de cette étude constituent d’une part, la détermination de la loi applicable aux successions internationales, et d’autre part, le domaine d’application de la loi successorale russe. Nous espérons que la thèse sera utile à tous les praticiens qui seront amenés à appliquer le droit international privé russe des successions<br>The international inheritance issues have recently gained importance in Russia, since the opening of the country and the liberalisation of private international exchanges. Indeed, since 1991, with the URSS disintegration, the Russian nationals began to have their borders open with the possibility to develop their trade in a global economy. As a known phenomenon in all the countries, the immigration is shared between the desire to set down roots in the host country, and unless there is a will to return, at least a desire to have their families left in the original country benefit from their savings. Most of the time, this immigrant population ages and dies in the host country. The rising immigration from and to Russian Federation, illustrates the need of a clear regulation and enforcement in the area of the international inheritance law. The Russian conflict-of-law rules are mainly governed by internal rules, because the few international conventions signed by Russia in this area are deliberately regional or bilateral. For this reason, the rules of Russian private international law and the internal rules reflect the specificity of its social, economic and legal system. This Ph.D. undertakes a global reflexion on the Russian rules of the international inheritance law area. The two main axis of this study are, on the one hand, the determination of the applicable law to the international inheritance and the exploration of the domain of the Russian law applicable to the international inheritance. Aquesta tesi es pregunta per què en unes zones d'Oaxaca (Mèxic) la migració permanent dels fills homes- els hereus preferents de la terra en el model mesoamericano- modifica els patrons de transmissió patrimonial per incloure a les filles; mentre que en altres àrees els homes, tot i l'absència, mantenen els privilegis hereditaris sobre el patrimoni familiar. A partir de dos estudis de cas en comunitats indígenes d'Oaxaca es mostra que les filles esdevenen hereves perquè poden suplir o complementar els seus germans en els quatre elements que convertien els fills en hereus legítims: la residència, la provisió, l'atenció i la representació davant la comunitat dels pares ancians. Això implica una nova definició social d'adultesa femenina basada en una major cooperació amb els pares i autonomia enfront del vincle matrimonial. D'altra banda, les dones en el paper de filles segueixen ocupant un lloc residual en la transmissió patrimonial, tot i l'absència dels seus germans homes, perquè encara en la distància les famílies transnacionals poden recompondre el sistema tradicional de transmissió patrimonial, basat en la cooperació preferent amb els fills; també, perquè les filles s'incorporen a elements menys valorats de la cooperació inter-generacional, com la cura. Tractar de contestar la pregunta d'investigació en contextos on la tinença de la terra és comunitària i està regida per sistemes normatius interns -usos i costums-comporta endinsar-se en debats vinculats a opcions diferents d'intervenció pública (tensions entre propietat privada i propietat social així com entre la llei i el costum), que han estat presos en compte i als quals s'ha intentat donar una resposta parcial.<br>Esta tesis se pregunta por qué en unas zonas de Oaxaca (México) la migración permanente de los hijos varones- los herederos preferentes de la tierra en el modelo mesoamericano- modifica los patrones de transmisión patrimonial para incluir a las hijas; mientras que en otras áreas los varones, a pesar de la ausencia, mantienen los privilegios hereditarios sobre el patrimonio familiar. A partir de dos estudios de caso en comunidades indígenas oaxaqueñas se muestra que las hijas se convierten en herederas porque pueden suplir o complementar a sus hermanos en los cuatro elementos que convertían a los hijos en herederos legítimos: la residencia, la provisión, la atención y la representación ante la comunidad de los padres ancianos. Esto implica una nueva definición social de adultez femenina basada en una mayor cooperación con los padres y autonomía frente al vínculo matrimonial. Por otro lado, las mujeres en el rol de hijas siguen ocupando un lugar residual en la transmisión patrimonial, a pesar de la ausencia de sus hermanos varones, porque aún en la distancia las familias transnacionales pueden recomponer el sistema tradicional de transmisión patrimonial, basado en la cooperación preferente con los hijos; también, porque las hijas se incorporan a elementos menos valorados de la cooperación inter-generacional, como el cuidado. Tratar de contestar la pregunta de investigación en contextos donde la tenencia de la tierra es comunitaria y está regida por sistemas normativos internos -usos y costumbres-conlleva adentrarse en debates vinculados a opciones distintas de intervención pública (tensiones entre propiedad privada y propiedad social así como entre la ley y la costumbre), que han sido tomados en cuenta y a los que se ha intentado dar una respuesta parcial.<br>This thesis analysis why the permanent migration of the sons - the preferred inheritors of family land under the Mesoamerican family model - has shifted inheritance patters to include daughters in some areas of Oaxaca (México), while in others men still maintain their privileges over family land even when they are not present. Based in two case studies conducted in Oaxaca indigenous communities, we argue that daughters, excluded from previous arrangements, have become heirs because they can replace or complement their brothers in the four elements that made men legitimate heirs: residence, provision, care and the capacity of representing elderly parents in community institutions. Along with these new daughters¨ contributions to parents, new social definition of what means to be an adult women has change the assumption that daughters, after marriage, must be dependent only in their husband economic provision. Women, as daughters, still excluded from family property transfers because parents and migrated sons can rebuild cooperation despite the distance; or daughters cooperate only as care-givers but not providing or representing their parents. As long as our research areas are ruled by usos y costumbres and the land tenure is communal, some other debates around the tensions between private-comunal land and law –costum needed to be answered.

The purpose of this thesis is to investigate the European certificate of succession, and how it affects Swedish inheritance law. The European certificate of succession is a European document that will be introduced in august 2015 in the EU regulation of succession. The certificate of succession is meant to simplify the current process of cross-border inheritance by legitimizing the concerned parties, which according to the regulation are: heirs, legatees, executors of wills and administrators of the estate. According to the regulation, the member state of which the deceased had habitual residence shall have jurisdiction to rule on the succession as a whole. Since the certificate is a European document, it will have legal effect in all member states. Because of this, a decision from one authority/court in a member state will also be applicable in the other member states. This means that national law in a certain capacity becomes cross-border law, which requires strong regulation. The certificate itself cannot be counted as an estate inventory, choice of law, will, or similar. It can however be a basis for a decision concerning inheritance. The certificate can be considered as an acknowledgement of a decision from one member state, which will also be applicable in the other member states. In Sweden, the certificate will be issued by “Skatteverket” (the Swedish tax agency). The European certificate of succession will considerably simplify the cross-border inheritance process for EU-citizens.<br>Uppsatsens syfte är undersöka arvsintyget som rättshandling och diskutera dess följder på svensk arvsrätt. Det europeiska arvsintyget är en europeisk rättshandling som kommer införas i augusti 2015 i samband med EU:s nya arvsförordning. Arvsintyget är menat att förenkla processen vid gränsöverskridande arvsfrågor genom att legitimera de berörda parterna. Vilka enligt förordningen är: arvtagare, testamentstagare, boutredningsmän och testamentsexekutorer. I och med den nya arvsförordningen kommer hemvistprincipen få en större roll inom den europeiska arvsrätten och arvsintyget kan då användas för att förmedla ett domslut/bestämmande från en medlemsstat till en annan. Även universalitetsprincipen är av stor vikt vid behörighetsfrågor om gränsöverskridande arv, då den innebär att all kvarlåtenskap ska ingå i samma boutredning. Eftersom arvsintyget är en europeisk rättshandling kommer den ha rättsverkan i alla EU-länder som är bundna av arvsförordningen. Därför kommer ett beslut från myndighet/domstol i en medlemsstat även gälla i andra medlemsstater, vilket meddelas genom arvsintyget. Detta leder till att nationell lag i viss kapacitet blir gränsöverskridande, vilket kräver strikt reglering. Arvsintyget kan inte i sig självt räknas som en fördelning av kvarlåtenskap, lagvalsavtal eller liknande. Det kan dock ligga till grund för beslutande angående arvsskifte. Arvsintyget kan anses vara en kvittens av ett beslut från en medlemsstat, vilket ska gälla även i andra medlemsstater. Arvsintyget kommer i Sverige utfärdas av Skatteverket och kommer betydligt underlätta för EU-medborgare vid gränsöverskridande arvsfrågor.

Le statut patrimonial du conjoint survivant est, depuis toujours, exposé à un dépeçage législatif source de difficultés de qualification et d’articulation, qu’il convenait de confronter aux évolutions connues par la matière sur le plan du droit international privé et sur celui du droit interne. Or ni l’entrée en application des règlements UE (n°650/2012 sur les successions et n°2016/1103 sur les régimes matrimoniaux), ni le mouvement de faveur pour le conjoint survivant n’ont éradiqué les difficultés affectant son statut patrimonial en droit international privé. D’où l’intérêt, dans un premier temps, d’user des ressources offertes par la qualification, la substitution, l’adaptation pour tenter de les surmonter au cas par cas ; puis, dans un second temps, de chercher à réunifier le statut du conjoint sous l’empire d’une seule loi. Deux voies permettraient d’atteindre ou, à tout le moins, de favoriser la réalisation d’une telle unité législative. Nous avons éliminé la première d’entre elles, consistant à modifier le contenu des différentes catégories de rattachement concernées soit en les fusionnant soit en étendant l’une d’entre elles. En revanche, nous avons retenu la seconde d’entre elles, reposant sur la modification du rattachement matrimonial après le décès, soit par le biais de la substitution judiciaire désormais admise par le règlement n°2016/1103, soit par le biais de l’accord inter partes déjà admis par le droit français<br>The patrimonial status of the surviving spouse has always been exposed to a legislative “dépeçage”, entailing characterization and articulation difficulties, which had to be confronted to current evolutions known in private international law and substantive law. However, neither the implementation of EU Regulations (no.650/2012 on inheritance and no.2016/1103 on matrimonial property), nor the favour for the surviving spouse have eradicated the difficulties affecting his or her patrimonial status in private international law. Hence the interest, as a first step, to apply the techniques of qualification, substitution or adaptation in an attempt to overcome these difficulties on a case by case basis; then, as a second step, to pursue the reunification of the surviving spouse’s patrimonial status under only one legislation. Two ways would enable to reach or, at least, enhance the achievement of such a legislative unity. The first solution, involving the modification of the content of the relevant connection categories, either by merging them or by extending one of them, has been eliminated. However, the second one, based on the modification of matrimonial connection after death, either by judicial substitution, as now recognized by the EU regulation no.2016/1103, or through inter partes agreement, as already recognized under French law, has been upheld

A l'heure où la famille moderne se conçoit au pluriel, à l'heure où les ascendants organisent en amont la transmission et la dévolution de leur patrimoine, à l'heure où la mondialisation prône l'uniformisation du droit et la fin des spécificités étatiques, il est nécessaire de s'interroger sur l'avenir de la réserve héréditaire. Les parents ne souhaitent plus être privés de leur pouvoir de disposer librement de leur patrimoine, même pour cause de mort. Que répondre à un père qui angoisse à l'idée de voir son patrimoine dilapidé par un enfant ingrat avec lequel il ne vit que de conflits ? Que dire à cet enfant qui a vu son frère avantagé par décision maternelle, de manière abusive et arbitraire ? Quels conseils donner à ces individus qui ouvrent chaque jour la porte de nos offices pour demander l'aide de leur notaire ? Que dire à cet époux qui veut protéger son conjoint de la véhémence d’enfants d’un premier lit ? Afin de leur répondre dans la pratique, appliquons-nous à étudier les moyens de contourner cette réserve héréditaire. Attachons-nous à vérifier leur efficacité. Au-delà des mécanismes classiques du Code civil tels que le testament et la donation, l'intérêt de cette thèse est de se tourner vers des mécanismes plus complexes, afin de répondre aux parents déçus par leur progéniture, mais aussi à eux, enfants lésés, pour leur donner des moyens juridiques de contrer une injuste privation. Il est utile de comprendre et de connaître ce qu’il est possible de faire pour transmettre son patrimoine avec une liberté recouvrée sans risquer les foudres de la loi. A travers l’étude de ces instruments, de leur efficacité et de leur traitement tant légal que familial, la question de la modernisation de la réserve ressurgit. La famille change, et avec elle, la conception traditionnelle de la réserve héréditaire<br>At a time when the modern family is conceived in the plural, at a time when ascendants organize upstream transmission and devolution of their heritage, at a time when globalization advocates the standardization of law and the end of specificities States, it is necessary to question the future of the hereditary reserve. Parents no longer wish to be deprived of their power to freely dispose of their patrimony, even for reasons of death. What to answer to a father who is anxious about seeing his heritage squandered by an ungrateful child with whom he lives only conflicts ? What to say to this child who saw his brother favored by maternal decision, in an abusive and arbitrary way ? What advice can be given to those individuals who open the door of our offices every day to ask the help of their notary ? What to say to this husband who wants to protect his spouse from the angry of children from a first bed ? In order to answer them in practice, let us study ways of circumventing this hereditary reserve. Let's focus on checking their effectiveness. Beyond the classical mechanisms of the Civil Code such as the will and the gift, the interest of this thesis is to turn to more complex mechanisms, in order to answer the parents disappointed by their offspring, but also to them, children wronged to give them legal means to counter unfair deprivation. It is useful to understand and know what can be done to transmit one's heritage with a recovered freedom without risking the wrath of the law. Through the study of these instruments, their efficiency and their legal and family treatment, the question of the modernization of the reserve resurfaces. Det faktum att Sverige blir allt mer internationaliserat och samhället mer mångkulturellt väckte ett intresse av att skriva om bröstarvingars arvsrätt ur ett såväl nationellt som internationellt perspektiv, där resultatet avsågs ställas i relation till svensk IP-rätt om ordre public. Idag tar alla barn lika lott enligt 2 kap. 1 § ÄB. Principen om istadarätt inträder om arvlåtarens barn avlider innan honom eller henne, då arvlåtarens barnbarn ärver istället. Bröstarvingar har alltid en rätt till hälften av sin arvslott enligt laglottsskyddet i 7 kap. 1 § ÄB. Det har diskuterats om laglotten bör bevaras i svensk arvsrätt eller om den bör avskaffas. Alla de nordiska länderna har någon form av laglottsskydd liksom de flesta europeiska länder med undantag från England och Wales, där det råder fullständig testationsfrihet. Även muslimska länder saknar motsvarighet till laglottsskydd. Det här kan väcka frågan huruvida ett land som saknar en skyddsregel som kan likställas med det svenska laglottsskyddet kan utgöra en grund som aktualiserar ordre public. I svensk rätt finns genom ordre public en möjlighet att åsidosätta en utländsk lag med hänvisning till att denna är uppenbart oförenlig med grunderna för det svenska rättssystemet. Den islamiska arvsrätten skiljer sig avsevärt mer från den svenska arvsrätten, än vad arvsrätten gör i exempelvis något västeuropeiskt land. Det kan diskuteras om någon grund i den islamiska arvsrätten för bröstarvingar kan strida mot grunderna för den svenska rättsordningen och på så vis aktualisera ordre public. Den svenska arvsrätten för bröstarvingar är till en stor del av dispositiv karaktär, varför ordre public endast kan bli aktuell i en internationell arvstvist där utländsk lag ska tillämpas. Domstolarna tenderar att tolka ordre public restriktivt, förmodligen av rädsla för att det lands lag som åsidosätts skulle kunna göra motstånd. Framtida tillämpning av ordre public kan begränsas ytterligare när EU:s arvsförordning träder i kraft. Det är fortfarande svensk domstol som har att avgöra vad som i det enskilda fallet kan bedömas vara uppenbart stridande mot grunderna för det svenska rättsystemet och vilken inverkan det kan ha på tvister som berör bröstarvingars arvsrätt.<br>The fact that Sweden is increasingly becoming more internationalized and developing a more multicultural society, stimulated an interest in writing about direct heirs inheritance rights from a national and international perspective, in which the outcome was intended to be set in relation to the Swedish Private International Law on public policy. Nowadays all children take equal shares according to chapter 2 paragraph 1 “Ärvdabalk”. If the deceased’s child passes away before him- or herself, the deceased’s grandchildren are entitled to inheritance through the Swedish istadarätt. The Swedish legal portion is enacted in chapter 7 paragraph 1 “Ärvdabalk” and entitles direct heirs half of his or her inheritance share. There has been discussion about whether the legal portion should be preserved or abolished in the law of Swedish inheritance. All the Nordic countries have a form of legal portion, as well as most of the European countries, apart from England and Wales, where there is a complete testamentary freedom. Even Muslim countries have no correspondence to the protection of legal portion. This may raise the question whether a country, which is lacking a protective rule that can be compared with the Swedish legal portion, may constitute a basis for public policy. According to the Swedish law there is an opportunity, through public policy, for Sweden to override a foreign law on the grounds that it is clearly incompatible with the foundations of the Swedish legal system. The Islamic inheritance law differs considerably from the Swedish inheritance law, in comparison to the right of inheritance in for example any Western European country. It is debatable whether any basis in the Islamic inheritance law of direct heirs may conflict with the fundamentals of the Swedish legal system and therefore actualize public policy. The Swedish right of inheritance for direct heirs is to a large extent of dispositive nature, which is why public policy can only become relevant in an international succession dispute, where a foreign law is applicable. The courts tend to strictly interpret public policy, probably because of the fear that the country's law, which gets overridden, could oppose. Future application of public policy may be further limited when the EU Succession Regulation enters into force. It is still up to the Swedish court to determine what in each case is deemed to be manifestly incompatible with public policy in Sweden, and what impact this may have on the succession of direct heirs.

Cette thèse se propose de mettre en exergue les difficultés relatives à la coexistence au sein du droit malien de trois corps de règles successorales applicables (loi, droit religieux et droit coutumier : un pluralisme juridique issu de la Loi n°2011-87 AN/RM du 30 décembre 2011 portant Code des Personnes et de la Famille). Il s’agit alors de réfléchir aux solutions envisageables pour faire fonctionner le pluralisme juridique malien qui se caractérise par une absence de clarté. Outre les difficultés relatives à la recherche du droit successoral applicable en droit interne malien, cette thèse met également l’accent sur les difficultés liées à l’application du droit malien, spécialement ses règles religieuses et coutumières, au regard des dispositions fondamentales de la Constitution malienne et les traités internationaux ratifiés par la République du Mali. Ainsi, après avoir montré l’existence d’un conflit interne de lois et les insuffisances des systèmes de solutions aux conflits, cette thèse propose de le résoudre par le renforcement du rôle de la volonté individuelle. Pour l’application des règles religieuses et coutumières, la thèse propose l’institution d’une clause d’ordre public en droit interne afin de permettre au juge malien d’écarter les règles traditionnelles manifestement contraires à certains principes du droit moderne. Les difficultés auxquelles le droit malien est confronté dans le contexte interne peuvent surgir également sur le plan international lorsqu’une succession internationale impliquant un ressortissant malien est ouverte en France ou soumise à un notaire ou un juge français. Les maliens voyagent beaucoup et nombreux sont ceux qui choisissent la France comme pays de leur résidence. Le règlement de leur succession qui aura un caractère international, nécessite la mise en œuvre des règles de conflit de lois françaises afin de désigner soit la loi française soit la loi malienne en fonction des rattachements retenus. Avec l’entrée en application du Règlement (UE) n° 650/2012 du 4 juillet 2012 relatif à la compétence, à la loi applicable, à la reconnaissance et l'exécution des décisions, à l'acceptation et l'exécution des actes authentiques en matière de succession et à la création du certificat européen, l’application du droit malien en France peut être assez fréquente du fait notamment du choix de loi possible ou en cas de dernière résidence habituelle du défunt au Mali alors même que l’ouverture de la succession se ferait en France du fait de la présence d’héritiers (enfants ou conjoint survivant). En cas de désignation du droit malien, deux difficultés majeures se posent : l’identification du droit interne malien qui sera finalement applicable et l’application en France de certaines règles religieuses et coutumières désignées. Cette situation amène à réfléchir sur les risques de contrariété possible du droit malien avec les exigences liées à l’ordre public international français, notamment aux droits fondamentaux et donc sur les risques de mise à l’écart du droit malien en France<br>Focusing to highlight the challenges associated to the coexistence within the Malian Law of the three sets of applicable inheritance rules (statutory law, religious law and customary law) and to contribute to resolving internal conflicts of law between codified law and competing normative systems. The goal is to reflect on possible solutions to make Malian legal pluralism work, which is characterized by a lack of visibility and clarity. In addition to the difficulties when it comes to identifying inheritance law under Malian domestic law, this thesis also emphasizes the challenges linked to the application of Malian law, particularly its religious and customary rules, first within the Malian context, considering the fundamental provisions of the Malian Constitution and international treaties ratified by the Republic of Mali. Therefore, after showing the existence of internal conflicts of law and the shortcomings of the current conflict-resolution systems, this thesis proposes offers strengthening the role of individual will in matters of religious and customary. This thesis suggest introducing a public order clause into domestic law to allow Malian judges to exclude traditional rules that are manifestly contrary to certain principles of modern law. This challenge faced by Malian law in the domestic context may also rise internationally when an international inheritance involving a Malian national is opened in France or handled by a French notary or judge. Many Malians travel and a many of them choose France as their country of residence. The settlement of their succession, which will have an international character, requires the application of French conflict of law rules to determine whether French law or Malian law should apply, depending on the relevant connections with the entry into force of Regulation (EU) No. 650/2012 of 4 July 2012, on jurisdiction, applicable law, recognition and enforcement of decisions, the acceptance and enforcement of authentic instruments in matters of succession, and the creation of European Certificate of Succession. The application of Malian law in France may become more frequent, particularly due to the choice of law option or if the deceased’s last residence was in Mali, even if the succession is opened in France, due to the presence of heirs ( children or surviving spouse ), or because of the principle of unity of the estate which governs the regulation process. The conflit of law rules, whether from national or European sources, designate Malian law as applicable in an international inheritance case, two major challenges arise : identifying the Malian domestic law that will ultimately apply and applying certain religious or customary rules in France. This situation leads us to consider the potential conflict between Malian law and the requirements of French international public order, especially regarding fundamental rights and therefore the risk of Malian law being set aside in France

AbstractThe chapter examines how the issue of inheritance and the extent to which the allocation of that inheritance affects women, families, and communities, both rural and urban. It discusses how this is represented by a radio studio in Mali on one hand, and by its audiences on the other, and the extent to which, and how, the broadcasts raise awareness and promote women’s human rights and empowerment, not only among the women who are only too aware of the difficulties they face but also among men and extended family members who hold the power over the women. It further questions whether the broadcasts are in alignment with ‘imposed’ international development discourse while remaining culturally relevant and whether the radio broadcasts present women as individuals or within their societal web of relations.

Women�s inheritance rights in biblical and European contexts are complex topics that have been extensively studied by scholars in various fields such as history, theology, and social studies. In both contexts, women�s inheritance rights were influenced by cultural norms, religious beliefs and legal systems. Biblically, women�s inheritance rights are emphasized in the Old Testament, especially in the laws of Moses found in books such as Deuteronomy and Numbers. These laws provide clear guidelines for the distribution of property among family members, including daughters. However, interpretations of these laws vary between different religious traditions and academic perspectives. In Europe, the influence of Roman law and the feudal system reinforced patriarchal approaches to inheritance, with significant variations between common law and civil law traditions. Early common law systems severely limited women�s rights, but later reforms led to increased recognition of these rights. [1] Comparative study of women�s inheritance rights in biblical and European contexts provides valuable insights into the historical treatment of women as owners and inheritors of property.

International inheritance law is a set of norms regulating hereditary relations, which are directly related to the legal order of several states. Inheritance relations are a very “conservative” sphere of civil turnover, connected with moral ideas, family customs and established traditions in society. In such countries as: the USA, Canada, Australia, inheritance does not matter, but the liquidation of the property of the testator, which is carried out in the form of a separate procedure and under the direct control of the court. Upon completion of the personal administration procedure, the remaining property will be forwarded to the heirs. The opening of an inheritance is a legal fact, as a result of which inheritance relations are created.

In order to define an adequate legal framework and models of digital inheritance, and to establish the basic principles of the digital property inheritance system, it is necessary to define the concept of digital property, the types of digital goods, as well as which goods can be inherited and which are non-inheritable.
