Анотація:
The article explains the importance of the emerging movement for EU digital constitutionalism (EUDC), which reflects a Union-wide effort to address through regulation the challenges posed by digitalisation. The article outlines the core legislative acts that have been introduced by proponents of EUDC. It describes why EUDC is important for fundamental rights protection and European foreign policy, and how the ‘Brussels effect’ extends the impact of EUDC. It enquires into whether EUDC is sustainable, taking into consideration waning EU global influence and the need for economic growth. The EU needs to strike a balance between fundamental rights protection and economic growth. The proportionality principle is the right tool for this. A proportional approach should be followed in establishing a transatlantic digital accord with the US—an agreement on the basic principles governing the digital space. A more proportional approach will pave the way to such an agreement—giving EUDC a global scope.

Анотація:
The work is devoted to the problem of military medical training in the context of digital transformation in healthcare. The aim of this work is to justify and highlight the directions for implementing specific principles of military medical training in the context of digital transformation in healthcare. The expediency of specific principles in military medical training (the principle of innovation, the principle of orientation to network services, and the principle of reliance on digital tools) is substantiated; the content and essence of specific principles have been clarified; directions for the implementation of specific principles in the process of military medical training are determined. It is shown that the need for an innovative focus in military medical training is driven by several factors, including organizational innovations that contribute to the effective transformation of the healthcare system, digital innovations aimed at automating processes related to medical data, innovative medical technologies, and pharmaceutical and medical-technical innovations associated with the use of advanced methods for diagnosis, treatment, and patient care. It is established that the principle of orientation towards network services allows for effectively combining formal, informal, and informal education for military doctors, fostering lifelong self-education skills. We specify that the principle of orientation towards network services involves familiarizing military doctors with the results of fundamental research in the medical field and relies on the open access to full-text digital publications, both domestic and international. The principle of reliance on digital tools recognizes the potential of digital tools and the appropriateness of their use in the process of military medical training.

Анотація:
The application of intelligent sensors, network technologies, and machine learning in IoT and industry is increas- ingly widespread as a part of the development and implementation of Industry 4.0, Industry 5.0, and Smart City. It is necessary to review the fundamental principles of metrological support for production. This includes calibration, estimation of measurement uncertainty, traceability, and processing of large data sets to reproduce and compare the results of measurements of physical quan- tities remotely. Modern smart sensors are cost-effective, which makes traditional sensor calibration methods increasingly uneco- nomical. The utilization of advanced networking technologies, along with machine learning, complicates the pre-processing of measured values. Therefore, new solutions are required when it comes to implementing digital metrology. In this article, a metrological framework for the full life cycle of measured data in IoT is presented. It ensures transparency, comparability, consistent quality and reliability of measured data, processing methods and results. The OPC-UA digital data com- munication standard is considered, which provides a single interface for exchanging digital data with devices from different manu- facturers or via different protocols. The syntax of a machine-readable representation of SI units and derived quantities as well as the structure of the sensor network metadata model are also described. Special emphasis is placed on dynamic calibration of sen- sors, determining measurement uncertainty in sensor networks, and implementing digital calibration certificates in IoT and industry.

Анотація:
The article reveals the main trends in the modernization of the civil procedural law principles in the context of the civil process digitalization. From the point of view of introducing the latest digital innovations into the civil process, the guidelines of the branch of the law are analyzed, the conclusions are drawn about the transformation of the legal regulation key areas. It is raised the problem of the procedural and legal collisions between the introduction of technical progress tools into the judicial system, its reflection in the regulatory framework of the state and the application in the legal work of judicial structures and practicing procedural specialists. Taking as a basis the differentiation of the civil procedural law principles by the subject of regulation, the author examines various legal configurations that have appeared in the judicial system as a result of the digitalization of procedural relations of participants in civil proceedings, starting depending on the degree of impact of digitalization. The article highlights the main aspects of the implementation of the principle of the publicity of proceedings, the corresponding principles of openness, publicity, accessibility, transparency and judicial transparency, between which a parallel is drawn. In terms of digitalization the author touches upon the principles of the judicial independence, competition, equality of parties and discretion, thereby coming to the conclusion about digital modernization of the main provisions and ideas that express the essence of civil procedural law, while maintaining the traditional positions characteristic of the Russian judicial system.

Federal Law No. 44 of December 30, 21 "On Amendments to Certain Legislative Acts of the Russian Federation" legislatively fixed the possibility of transition of arbitration, civil and administrative proceedings to digital justice. In the near future, it is possible to use these technologies in the course of judicial control in pre-trial proceedings, as well as in proceedings before a justice of the peace and in criminal cases. The next step in the development of digital justice will be the creation and implementation of an artificial intelligence system in court proceedings. It is necessary to consolidate as soon as possible the civil, administrative and criminal responsibility of the actors of these organizations for their creation and use in violation of the established rules. The fundamental principles of using AI in justice should be the principles of legality, safe and controlled use of AI, confidentiality of personal information. The development of artificial intelligence should be carried out in order to ensure the conditions for the transition of human civilization to a higher level of spiritual, moral, intellectual and physical development.

Abstract The article analyzes modern digital technologies in the energy industry on the example of digital substations. The basic principles and advantages of digital technologies are presented, and generally accepted principles are formulated. It is shown that event extraction and intelligent information processing are the necessary conditions for digitalization of the energy industry. Digital transformation is the introduction of modern technologies into the business processes of an enterprise, which implies fundamental changes in approaches to management, corporate culture, and external communications. Digitalization, Industry 4.0 and the Internet of Things can be called the components of digital transformation in the energy sector.

It discusses that even though the design styles of today’s digital art era are flourishing with diverse thinking and visual approach, the classic pixel art style will never go out of style. The fundamental element of artistic design in pixel art style is a single element, a pixel. Many designers prefer using the single pixel style as the fundamental element of their artistic design, which has led to the creation of various intriguing design categories. Анотація:
Large-scale digitalization of social processes covers more and more areas of human activity, including criminal justice. At the same time, in the context of digitalization and likely digital transformation, it is important to preserve the moral basis of criminal proceedings. The paper discusses the degree of stability of the moral foundations of the criminal procedure in the face of the latest digital trends, analyzes the likelihood of changes in the system of moral principles in criminal proceedings in the context of digitalization. The author concludes that domestic criminal justice is at the initial stage of digitalization. At the moment this process does not pose serious threats to its moral principles. As various information and technological innovations (artificial intelligence, robotics, neural networks, etc.) are introduced into the criminal procedure, the risk of undermining its moral foundations increases significantly. Thus, the safety of moral principles in criminal proceedings is directly dependent on the limits of its digitalization. In general, it is possible to ensure the security of the fundamental provisions of the criminal procedural legislation, which are based on moral norms, if important conditions of a humanistic nature are observed in the process of introducing digital technologies. The use of a technocratic approach in the course of digitalization of criminal proceedings can cause irreparable harm to the moral and legal foundations of criminal procedure.

Resumo: Nesse trabalho nos propusemos investigar o campo da EAD Digital (educação a distância realizada a partir do uso das novas tecnologias digitais) a fim de compreender as bases teóricas que sustentam as diversas e variadas práticas na área. Com a pesquisa, concluímos que: 1- A prática em EAD Digital tem forte teor comunicacional e isso favorece a que sujeitos diversos, mesmo sem formação pedagógica, desenvolvam atividades na área; 2- pelo teor comunicacional que possui, a EAD Digital não pode ser simplesmente entendida e pensada como "educação" no sentido tradicional; trata-se de uma prática social nova possibilitada pelos avanços no campo das tecnologias de informação e comunicação; 3- a EAD Digital tem uma racionalidade comunicativa, ou seja, é uma atividade que se realiza na medida em que os sujeitos envolvidos no processo formativo produzem e vivenciam situações comunicativas que garantem a satisfação de suas necessidades; 4- pelo que acabamos de dizer, é coerente e, a nosso ver, muito apropriado, que a atividade em EAD Digital seja entendida como "comunicação pedagógica"; 5- o campo da EAD Digital tem problemáticas próprias e especificidades, fator que nos impede de compreendê-lo ou interpretá-lo com base apenas em conhecimentos teóricos do campo da educação presencial.
Abstract: In this work we proposed the investigation of Digital DE (distance education provided through the use of new digital technologies) in order to understand the theoretical grounds that support the various and varied practices in the area. With the research, we concluded that: 1- The practice in Digital DE has strong communicational content and that contributes for various individuals, even without pedagogical background, developing activities in the area; 2- because of its communicational content, Digital DE cannot be understood and thought of as mere "education" in its traditional sense; it is a new social practice enabled by the advances in the fields of information technology and communication; 3- Digital DE has a communicative rationality, that is, it is an activity that is performed to the extent in which the individuals involved in the educational process produce and experience communicative situations that ensure the meeting of their needs; 4- from what we have just said, it is coherent and, in our view, most appropriate, that the Digital DE activity be understood as "pedagogical communication"; 5- the field of Digital DE has its own problems and specificities, a factor that prevents us from understand it or interpret it based only on the theoretical knowledge from the field of presential education.

El Interés Noticioso es un criterio periodístico relevante porque es lo que conecta las noticias –el producto periodístico por antonomasia que ofrecen los medios informativos– con sus públicos. Pero las aproximaciones a este criterio son teóricas y no tendentes a operativizarlo como un concepto observacional. Así pues, esta tesis doctoral plantea una aproximación metodológica para medir y analizar el Interés Noticioso de un ciberperiódico de información general. Además, existen dos indicadores fundamentales del interés que son el tema de las noticias y la participación de los usuarios en las mismas, a través de las redes sociales Facebook y Twitter y los comentarios de las noticias. Aproximación metodológica propiciada por el contexto digital. En nuestra investigación, consideramos que el Interés Noticioso de un ciberperiódico de información general viene definido por el grado de aproximación o correspondencia (punto de encuentro) entre el Interés Público y el Interés del Público en dicho ciberperiódico. El Interés Público es entendido como lo que el ciberperiódico estima que debe o puede interesar a un sector importante de la sociedad por la relevancia y el mayor alcance de los hechos para el conjunto de los ciudadanos y se materializa en la jerarquía informativa principal de la portada del ciberperiódico, a través de las 10 primeras noticias de la columna izquierda de la portada. Mientras que el Interés del Público de ese ciberperiódico se entiende como lo que realmente interesa al público de la oferta informativa total que propone dicho ciberperiódico y está representado por la lista de noticias más leídas por los usuarios de ese ciberperiódico, a través de sus 10 primeras noticias, que nos proporciona la jerarquía informativa principal de los lectores o agenda principal del público. Para testar nuestro planteamiento, se ha estudiado la aproximación propuesta al Interés Noticioso a través de un estudio comparativo europeo entre los principales ciberperiódicos de información general de España e Italia con ElPaís.com, ElMundo.es, el Corrieredellasera.it y LaStampa.it, a partir de criterios de difusión y posicionamiento de marca en estos países europeos. Así pues, el objetivo principal de nuestra investigación es conocer el Interés Noticioso de los ciberperiódicos de información general de la muestra. Pero también determinar la agenda temática y la participación de los usuarios en las noticias de Interés Noticioso, déficit de Interés Noticioso (el grado de no correspondencia entre el Interés Público y el Interés del Público en dichos ciberperiódicos), Interés Público e Interés del Público, principalmente. En cuanto a los resultados más significativos, se puede destacar que los principales ciberperiódicos de información general de España –ElPaís.com y ElMundo.es– e Italia –Corrieredellasera.it y LaStampa.it– tienen un Interés Noticioso bajo, siendo aún más bajo en los de España. Mientras que el Corrieredellasera.it es el único ciberperiódico que posee un Interés Noticioso medio. Con lo cual, son los usuarios de los ciberperiódicos españoles lo que más se independizan de la oferta informativa principal que reciben. En cuanto a la temática de las noticias, los temas más destacados que proponen estos cibermedios en su jerarquía informativa principal de portada son de Política y Economía, mientras que al público le interesan mayoritariamente los de Sociedad y Deportes. Esta divergencia de intereses temáticos podría explicar el bajo Interés Noticioso de estos ciberperiódicos. En relación a la participación de los usuarios a través de las redes sociales Facebook y Twitter y los comentarios de las noticias, los usuarios tanto de los ciberperiódicos de España como de los de Italia participan más en aquellas noticias que les interesan como son las de Interés Noticioso e Interés del Público. Los usuarios más participativos son los de los ciberperiódicos españoles, en especial, los de ElPaís.com y la forma de participación más utilizada por los usuarios de estos cibermedios es Facebook. En definitiva, este modelo de análisis puede ser un instrumento metodológico útil para las empresas periodísticas porque pueden conocer con datos precisos el Interés Noticioso del ciberperiódico, analizar sus temáticas y participación de sus usuarios y gestionarlo, lo que les puede reportar un beneficio periodístico, social y económico.
Newsworthiness is a relevant journalistic criterion because it connects news (the quintessential journalistic product offered by the media) with their audiences. But the approximations to this criterion are theoretical, and there is no intention of using it as a method of observation. Thus, this dissertation presents a methodological approach to measure and analyze the newsworthiness of a general-interest cyber-newspaper. In addition, there are two main indicators of the interest: the subject of the news and the participation of the users in them, through social networks as Facebook and Twitter and news comments. Methodological approach favored by the digital context. In our research, we consider that the newsworthiness of a general-interest cyber newspaper is defined by the degree of approximation or correspondence (meeting) between the Public Interest and the interest of the public in that cyber newspaper. A cyber-newspaper estimates as Public Interest something that should or could interest to a large sector of society because of its relevance and scope for all citizens, which finally becomes real in the hierarchy of the cyber-newspaper front page, across the first ten news of the left column of the front page. While the interest of the public is understood by this cyber-newspaper as the most interesting information proposed by them to the public, and is represented by a news list of the most read stories by the users of this cyber newspaper. An informative hierarchy of the readers will be provided across the first news. To test our approach, we have studied the proposed approximation to newsworthiness doing a comparative study between the main European general-interest cyber-newspapers of Spain and Italy: ElPaís.com, ElMundo.es, Corrieredellasera.it and LaStampa.it, based on certain criteria and branding diffusion in these European countries. Thus, the main objective of our research is to determine the newsworthiness of the general-interest cyber-newspaper described above. But also to define the agenda-setting and users’ participation in newsworthy news, the newsworthy deficit (the degree of mismatch between the Public Interest and the interest of the public in such newspapers), the Public Interest and the interest of the public. As for the most significant results, one can note that the main general-interest cyber-newspapers of Spain -ElPaís.com and ElMundo.es- and Italy -Corrieredellasera.it and LaStampa.it- have a low newsworthy, being even lower in those of Spain. However, Corrieredellasera.it is the only cyber- newspaper with an intermediate newsworthy. Whereupon, are the users of the Spanish cyber-newspapers the most independent regarding the main informative offer received. On the subject of news, Politics and Economics are the outstanding themes proposed by these online media in its hierarchy of information, while the public is mostly interested in Society and Sports. This divergence of thematic interests could explain a low-interest of these cyber-newspapers newsworthy. In relation to the users’ participation via social networks as Facebook and Twitter and their news comments, users of both countries, Spain and Italy, are more involved in stories that interest them such as those of the newsworthiness and interest of the public. The most active users are those of the Spanish cyber-newspapers, especially those of ElPaís.com. Facebook is the most widely way of participation by users of these online newspaper. Finally, this model of analysis can be a useful methodological tool for media companies because they could know the newsworthiness of a cyber-newspaper accurately. They could analyze its themes, participation of its members and its management, what it may provide them a journalistic benefit, social and economic.

Os avanços tecnológicos dos últimos anos trouxeram inegáveis benefícios para a economia e para a sociedade. No entanto, também foram aproveitados pelos criminosos, designadamente para gizar novos modi operandi relativamente aos crimes tradicionais e para desenvolver uma panóplia de novas práticas criminosas, tornando-se o fenómeno do cibercrime uma realidade cada vez mais preocupante e com tendência crescente. A consciência desta nova realidade e a necessidade de criar respostas adequadas à repressão do cibercrime estiveram na origem da Convenção sobre o Cibercrime do Conselho da Europa, aberta à assinatura em Budapeste em 23 de novembro de 2001. Portugal veio a adaptar o direito interno à Convenção sobre Cibercrime do Conselho da Europa, através da Lei 109/2009, de 15 de setembro, também designada por Lei do Cibercrime. Esta lei consagra novos meios de obtenção de prova em ambiente digital, destacando-se a pesquisa de dados informáticos, prevista no art.º 15.º da Lei do Cibercrime. Não obstante se tratar de um meio de obtenção de prova com bastante relevância para a investigação criminal, a vulgarização de soluções tecnológicas, tais como a encriptação, poderão inviabilizar a recolha de prova digital, que ficará dependente da colaboração do visado. Simultaneamente aperfeiçoam-se novos meios tecnológicos com um potencial inegável para a efetivação da recolha de prova digital, mas com a particularidade de se tratarem de meios ocultos ao visado. É o caso do malware. Assim sendo, tendo presente estas circunstâncias, e a necessidade de consagrar meios eficazes no combate a uma criminalidade cada vez mais sofisticada, urge proceder à alteração da lei do cibercrime, prevendo-se de forma clara e detalhada a pesquisa de dados informáticos de forma remota e sem o conhecimento do visado, através de meios informáticos adequados, em consonância com os princípios e valores jurídico-constitucionais. Através destes princípios, será possível encontrar critérios axiológicos capazes de delimitar o correto âmbito de aplicação e os limites à aplicabilidade deste meio de obtenção de prova.
The latest years’ technological breakthroughs have brought undeniable benefits to both economy and society. Nevertheless, they were also seized by perpetrators, namely to find new modi operandi for their usual criminalities and to develop new criminal practices, hence becoming the cybercrime phenomenon. This is a growing tendency as well as an ever-distressing reality. The awareness of this new reality and the need to create suitable answers to limit cybercrime were at the origin of the Council of Europe Cybercrime Convention, open for signature in 23 November 2001, in Budapest. Portugal adapted its national law to the Council of Europe Cybercrime Convention through the law 109/2009 of 15 September, also named as cybercrime law. This law dedicates new means of obtaining electronic evidence, standing out the electronic data research, which is in art.15º of the Cybercrime law. Although electronic data research is a relevant means of evidence for securing the criminal investigation, the widespread use of IT solutions, as for example, encryption may render the electronic evidence useless and reliant on the good will of the perpetrator. At the same time, new IT solutions are getting streamlined with undisputable potential for helping on the effective acquisition of the electronic evidence plus having the distinctiveness of being concealed to the perpetrator. This is the case of malware. Thus, mindful of these circumstances and of the necessity to dedicate effective means to fight the increasingly sophisticated criminality, it is of utmost urgency to change the cybercrime law in a clear and detailed way. The objective would be to provide for remote research of electronic data without the suspect’s knowledge, through the appropriate IT tools in accordance with the constitutional law’s principles and values. By means of these principles, it will be possible to find axis criteria capable of outlining the right scope of implementation and the boundaries of the enforcement of this type of evidence acquisition.

AbstractIn the field of research, the role of ethics grows more and more every year. One might be surprised but even in the field of technology there is a necessity for experts to understand and to implement ethical principles. Ethics itself could be understood as a code or a moral way by which a person lives and works. But within the field of information technology and cybersecurity research there is a chance that even the most technical appropriate solution does not go in line with the corresponding ethical principles. Experts need to implement fundamental ethical principles in their technical products in order not to cause harm or have any negative effect on their users. To the vast majority of challenges that will be reflected in this chapter are discussed within the EU-funded project GUARD, namely what are the proper actions which need to be taken to ensure ethical compliance. Challenges such as ensuring the privacy of the users, reporting and handling incidental findings, testing the technological product, mitigating biases etc. could have different negative effect on humans if not dealt with properly. The current chapter would explore the questions posed above alongside a description of a methodology resulting in the combined efforts of experts both in the field of cybersecurity and ethics.

Abstract The increasing availability of geospatial data offers great opportunities for advancing scientific discovery and practices in society. Effective and efficient processing of geospatial data is essential for a wide range of Digital Earth applications such as climate change, natural hazard prediction and mitigation, and public health. However, the massive volume, heterogeneous, and distributed nature of global geospatial data pose challenges in geospatial information processing and computing. This chapter introduces three technologies for geospatial data processing: high-performance computing, online geoprocessing, and distributed geoprocessing, with each technology addressing one aspect of the challenges. The fundamental concepts, principles, and key techniques of the three technologies are elaborated in detail, followed by examples of applications and research directions in the context of Digital Earth. Lastly, a Digital Earth reference framework called discrete global grid system (DGGS) is discussed.

AbstractThe frameworks for the governance of AI have evolved rapidly. From the 2018 Universal Guidelines for AI on through the 2019 OECD/G20 AI Principles 2019, and the 2021 UNESCO Recommendation on AI Ethics, governments have agreed to the basic norms to regulate AI services. Two important legal frameworks are also now underway—the EU AI Act and the Council of Europe AI Convention. As these frameworks have evolved, we see the scope of AI governance models expand. From an initial focus on “human-centric and trustworthy AI” through the recognition of “fairness, accuracy, and transparency” as building blocks for AI governance, we see now consideration of sustainability, gender equality, and employment as key categories for AI policy. AI laws also overlap with familiar legal topics such as consumer protection, copyright, national security, and privacy. Throughout this evolution, we should consider whether the evolving models for the governance of AI are aligned with the legal norms that undergird democratic societies—fundamental rights, democratic institutions, and the rule of law. For democracies to flourish in the age of artificial intelligence, this is the ultimate alignment challenge for AI.

This paper presents the role of predictive engineering analytics, alongside operating data, in the digital twin. Using case studies, the authors demonstrate how predictive approaches can be developed to provide data where it cannot be measured and predict future operating data to improve performance, life and integrity of equipment, systems and facilities. The digital twin is fundamentally based on data, larger datasets provide greater insight. Sensor and inspection data are critical. However, there are scenarios in which engineers require data where it cannot be measured or requires data that cannot be measured. Engineers require ways to extract this data, this can be done through predictive engineering analytics. Predictive engineering analytics, in the form of science-based simulations, combines multiple approaches, often based on fundamental principles of physics and engineering. This paper will demonstrate how high-fidelity approaches, such as Finite Element Analysis (FEA) and Computational Fluid Dynamics (CFD), combined with system-level simulation and reduced-order modelling can work together with field data to provide this data in real-time. Two case studies presented show how combinations of different levels of science-based modelling approaches can help. A subsea thermal digital twin demonstrates how high-fidelity simulations, undertaken during system design, can be the foundation for reduced order system models capable of capturing critical thermal performance in real time; aiding hydrate risk management during operation. The methods used to train the real-time predictive approach are demonstrated. The second case presented focuses on structural integrity of a heat exchanger showing how real-time sensor data can be translated into structural integrity data and insight through simulation. The cases presented demonstrate the value of science-based predictions to generate data that cannot be obtained from operational sensor data alone. The authors aim to show how the predictive element of the digital twin can be first generated during design and evolved into real-time predictive approaches that provide operations with data that cannot be gained from sensors; when and where it is needed. As approaches to computation in architecture are shifting from a new way of making towards a new way of thinking, the term ‘digital architecture’ must be reconsidered in order to find value in increasing computing power that is centered around communities and a reconsideration of labour, instead of neoliberal paradigms or postmodern principles. Automated Architecture Labs (AUAR) at The Bartlett School of Architecture, UCL, and the spinoff company Automated Architecture Ltd, argue that ‘digital architecture’ is not so much a paradigm as rather a collection of methods that fails to address fundamental issues in the contemporary built environment such as the construction industry’s slow digitisation and the field’s inclination to adopt automated technologies such as robotics without questioning work-flows. The paper discusses these issues through a politicised lens using two main concepts, the assembly problem and the automation gap, as starting points for a fundamental reconsideration around frameworks of digital labour. The authors argue that we must radically and creatively rethink our practice in order to formulate a new architectural politics and production framework that is capable of coping with increasing automation. By using discrete parts as the foundation of architectural platforms, the paper introduces a paradigm shift towards participatory community building and digital labour that instrumentalizes automated technologies for a democratising approach to the digital in which humans and machines complement each other.

Committee Mandate Concern for the quantification of general sustainability criteria in economic, societal and environmental terms for marine structures and for the development of appropriate principles for rational life-cycle design using these criteria. Special attention should be given to the issue of Goal-Based Standards as concerns their objectives and requirements and plans for implementation. Possible differences with the safety requirements in existing standards developed for the offshore, maritime and other relevant industries and of the current regulatory framework for ship structures shall be considered. Role of reliability-based design codes and requirements as well as their calibration to established safety levels. Introduction Design principles and criteria form the framework for assessing marine structures against societal sustainability goals for economic, social, and environmental performance. Design principles and criteria seek to link the analytic tools and data sources discussed in other ISSC committees into a framework for practical evaluation, comparison, and decision-making for proposed marine structures. Similar to other committees, the work on principles and criteria is largely evolutionary. After a burst of development surrounding the introduction of goal-based standards and increased use of risk in the approval process in the 2003-2015 timeframe, recent developments in principles and criteria have occurred over a broader range of topics. For the current mandate period, the committee chose a report structure that extended on several themes from the 2018 report, as well as exploring some areas of our mandate that have not received significant attention recently. The committee report begins with an introduction to principles and criteria, followed by an extensive discussion of sustainability criteria, including the growing push to decarbonize the maritime industry. While further structural design improvements appear to have limited impact on decarbonization, understanding these developments is critical to planning future structural systems and accommodating potential green fuels which may impose their own unique material, structural, and risk assessments. Work on Goal Based Standards and international regulations has been largely evolutionary in the mandate period. To provide an overview of the activities at IMO and with class societies, we departed from past convention and structured the overview to mirror the other sections in our report. Three areas of continuity were selected from the 2018 report, based on rapid developments in these areas or a desire to extend beyond what the 2018 report was able to cover. The growing use of digital twin monitoring systems is reviewed, with a focus on systems for wave climate reconstruction. While direct integration of these systems into criteria is still in development, this field is moving quickly in this direction, and we felt it was essential to continue to chronicle its growth. Work on accidental limit states was also highlighted. Recent ISSC reports from both technical and specialist committees have highlighted technical developments in modelling such limit states. In this work, we have highlighted the extensions of these methods into practical criteria. The 2018 report explored the concept of human factors applied to the engineering process itself, instead of the operational phase. The 2018 chapter revealed that little work was ongoing in this area, but the feedback from the 2018 report suggested that a broader focus on human factors would be welcome, which is presented in our penultimate chapter. Finally, in reviewing the past IV.1 reports, it was clear that the portion of the mandate covering structural reliability has only received passing treatment for several cycles. In this cycle, the committee returned to a deeper focus on reliability, covering both recent developments in publication, along with example calculations. As digital twins and in-service monitoring proliferate, updatable reliability calculations may become more common, reliability approaches continue to be an important part of the principles and criteria landscape. Principles and criteria are inherently linked to both algorithmic formulations and computation tools. Thus, our report should be read in conjunction with several additional ISSC reports which cover fundamental developments in related fields. The work on digital twins is complemented by the work of specialist committee V.7 on Structural Longevity. The work on accidental loading is complemented by specialist committee V.1. Finally, owing to the tight coupling between design principles and design tools, the report of committee IV.2 also complements the work here.

This paper presents design solutions in the development of an electro-hydraulic power amplifier (EHPA) of a servo-hydraulic drive with hydrostatic guides. The work studies the characteristics and develops fundamental solutions to design elements and the general configuration of the EHPA, which is part of the servo-hydraulic drive. The paper analyzes the device, operating principles, and basic requirements for EHPAs. A digital model is built and a basic version of an electromechanical converter (EMC) is tested to assess its electromagnetic and thermal state. As a result of the work, the authors determined and justified the design of the main components of the EMC for the EHPA, developed a digital model for the EMС with permanent-magnet excitation, analyzed its electromagnetic and thermal state, and developed design documentation.

The paper discusses the challenges, benefits, and risks of the digitization in public services; argues the internet access right as a fundamental human right and the obligation of a state to provide digital services in the public administration; points out the main tasks of public administration when introducing the principles of good governance; addresses the development of the mentioned principles in the European public space as well at the examples of the Czech Republic. The authors critically describe evaluation methods of digitized public administration and e-Government, including the general model of user acceptance of information technology and benchmarking within the global worldwide information society. The paper highlights practical examples of digitization of the public space in the European Union and in the Czech Republic. The paper concludes with the issues of the state obligation to cover gaps between the legal and economic demand for digitization and provision of digital public services and needs of communities and individuals. The authors use the economic approach to examine legal issues of digitization in public administration. The comparison of the European legislation and Czech national legislation form the primary methodology of the interpretation of the rights of users as well as the obligations of the public administration. Practical examples, figures and tables highlight the argued issues.

The Santiago School of Cognition postulates that the process of intelligent cognition in any living system is a result of its ongoing process of adaptation to its medium. In other words, the very process of life in living systems is a process of cognition. It also establishes that human experience and cognition is embodied and enacted with the environment, through a continuous process of active perception and sense-making of the world. Coming from systems biology and founded on the concept of autopoiesis, literally meaning self-making, defining living systems as those that can reproduce and self-maintain themselves by creating their own parts, the Santiago school essentially offers an alternative epistemology for the understanding of human experience phenomena with digital tools and environments. It also provides a framework for the creation, design, development, implementation and use of digital affordances (possibilities offered by digital technology) in education and beyond. Informing immersive learning design research and practice from the epistemology of the Santiago school also helps exploring and navigating digital innovation and the emergence of new technologies and modes of user experience design and practice. Under the premise that the nature of the world we live in is complex, interconnected, unpredictable and ever-changing, and that human experience is subjective, ecosomaesthetic, symbolic and felt with the world, traditional western design concepts such as ‘one solution fits all’ or even the notion of ‘user experience (UX) design’ become problematic. Autopoiesis, cognition and enaction at the basis of human lived experience are some of the fundamental concepts and principles coming from the epistemology of the Santiago school that can inform and guide user-centred design and creative making practice in real and virtual worlds. Embedding properties found in living systems within creative solutions, or designing for users ‘to become with the world’ in a circular enactment within digitally immersive environments are only examples of where practice-led research and creative making can go. Here, the fundamental concepts and building blocks of the Santiago school are presented and reviewed in relation to their ability to inform the understanding of the nature of human experience in real and immersive worlds, and how we ought to design for it. Examples from research and practical work will help to portray how the epistemology of the Santiago school can become of interest and of real value to artistic and design practice and inquiry. Finally, the philosophical rationale guiding the inclusion of principles and concepts coming from the Santiago school in digital learning design, creative design and artistic practice not only invites us to reconsider and re-conceptualise the role of learners and of digital technology systems and tools in educational practice, but also to rethink the nature of learning and of human experience within creative practice.

Faced with the acceleration of the digital economy, the governance and effective sharing of data have become fundamental issues for public policy at all levels of jurisdictions and in all areas of human activity. This paper reviews the initiatives and challenges associated with data governance, with a particular focus on the European Common Data Spaces (ECDS) and their direct relevance to the Canadian context. It explores the inherent complexity of data governance, which must reconcile sector-specificities with more horizontal governance principles. In doing so, it highlights the importance of strategic and coordinated action to maximize the social and economic benefits of data. The Burgundy Report, published by CIRANO in July 2023, calls for the creation of a common data space in the Great Lakes-St. Lawrence Strategic Trade Corridor by 2030. This proposal builds in particular on three separate policy reports published in 2022 by the National Supply Chain Task Force, the Council of Ministers Responsible for Transportation and Highway Safety (COMT) and the House of Commons Standing Committee on Transportation, Infrastructure and Communities. The findings and recommendations of these reports raise fundamental questions that are central to the critical issues of governance, organizational culture, execution capacity, public and private stakeholder engagement, and data underutilization within the Canadian government machinery strained by years of delay and exacerbated by recent disruptions related to anticipated climate disasters. The creation of a common data space is envisaged as a structuring investment in Canada's essential infrastructure for intermodal transport and the supply chain. This working paper on European Common Data Spaces (ECDS) extends the synthesis and recommendations published last July 2023 by providing an operational analysis of the transformative initiative currently underway within the European Union (EU). This major policy development stems from the 2020 European Data Strategy and seeks to establish twelve common data spaces in strategic sectors, including mobility and transport. The document is divided into three main parts. The first part provides an overview of data-related public policies in Canada and the EU between 2018 and 2023. The second part focuses on the implications and lessons learned from the impact assessment supporting the adoption of data governance legislation by the European institutions. This directive establishes a regulatory framework for the creation of common data spaces in the EU. The third section discusses the current deployment of ECDSs, highlighting key milestones and ongoing processes. The paper highlights notable similarities between the EU and Canada in the identification of data issues and the formulation of public policy objectives. It also highlights differences in optimizing data sharing between jurisdictions and stakeholders. A fundamental difference between these two strategic partners is the absence of an effective and sustained pooling of resources within the Canadian intergovernmental machinery in pursuit of common objectives in the face of major shared challenges such as data accessibility and sharing. This situation is in stark contrast to the EU's groundbreaking deployment of the ECDS in pursuit of identical objectives of positioning itself as a world leader in the data economy. This lack of consideration, let alone joint action, by Canada's intergovernmental machinery to implement a common data strategy in Canada is damaging. To be effective, the Canadian response must be agile, results-oriented, and interoperable across jurisdictions. The rigorous management, responsible use, and organized sharing of data within and between jurisdictions are crucial to addressing the complex challenges and major risks facing Canada. Neither the federal nor provincial governments are currently well positioned to treat data as a shared strategic asset. The resolution of regulatory, legal, and technical obstacles to data exchange between jurisdictions and organizations cannot be achieved without the creation of a common data space. This can only be achieved by combining the necessary tools and infrastructures, and by addressing issues of trust, for example by means of common rules drawn up for this purpose. “The barriers that prevent the establishment of robust health data sharing systems are not technical, but rather fundamentally political and cultural.”

Este documento presenta un marco conceptual para la integración de tecnologías digitales en los sistemas educativos de América Latina y el Caribe, con el objetivo de mejorar la calidad de la educación. En la primera parte, se establecen principios fundamentales para la transformación digital educativa en el marco de la Educación 4.0, destacando la importancia de la gobernanza, la medición de los niveles de competencias digitales docentes y de adopción tecnológica de las escuelas, y la gestión del cambio en este proceso. La segunda parte introduce la Guía Edutec como una herramienta diagnóstico-formativa, basada en la autoevaluación, para planificar, diseñar y monitorear programas y políticas de transformación digital adaptados al nivel de madurez de los sistemas educativos. La herramienta cuenta con tres instrumentos diseñados para tres perfiles diferentes: escuelas, docentes y sistema o autoridad educativa. En la discusión final, se resaltan las ventajas de la Guía Edutec, como su capacidad para facilitar el seguimiento y ajustes periódicos, promover un enfoque colaborativo entre los actores educativos y empoderar a los docentes en su desarrollo profesional. Se concluye que esta herramienta es esencial para el progreso educativo en la región, al permitir el diseño de políticas más efectivas y sostenibles basadas en un diagnóstico inicial y adaptadas a las necesidades reales de los educadores.

The basis of electrochemical cell gas sensor technology is presented in the context of electrochemical cell portable analyzers for emissions testing of NOx and CO. This paper presents a modified test method approach and QA/QC criteria that supplement the project goal of assessing existing portable analyzer test methods and protocols for appropriate QA/QC requirements. The goal of a modified method is to minimize testing costs while ensuring data quality. The modified method leverages the inherent linearity of electrochemical cell technology, based on fundamental scientific principles, to employ single point calibration and order of magnitude span gases. Special considerations are included for �near zero� emissions testing (e.g., concentrations that are single digit parts per million by volume). Further demonstration and validation of a modified method through laboratory and field testing is recommended.

Building Information Modelling (BIM) es una innovación revolucionaria que, implementada adecuadamente, promete un importante ahorro en los gastos de infraestructura al facilitar la colaboración digital entre equipos multidisciplinarios para la planificación, el diseño, la construcción, y la operación de obras de infraestructura. Este estudio describe los avances y el impacto de la metodología BIM en países de América Latina. Sobre la base de información obtenida a partir de entrevistas realizadas a referentes del sector público, describe cómo se han superado los principales retos de gestión y capacitación, además de los fiscales y normativos. Concluye que si bien en América Latina el uso de BIM es incipiente por parte del sector público (se inició en Chile en 2016), existe un intenso trabajo de transición en los países focos del análisis: Brasil, Chile, Colombia, Costa Rica y Perú. Se destaca también el rol fundamental del liderazgo del sector público para la adopción de BIM, ya que dicho sector está en condiciones de disminuir los costos de transacción entre una mayor cantidad de actores, debido a que posibilita compartir y trabajar con la información, proponer y generar las vías o los canales de comunicación necesarios para fortalecer los mecanismos de transparencia y la rendición de cuentas, y permite considerar y gestionar adecuadamente los retos asociados: administrativos, legales, financieros, tecnológicos y de fortalecimiento de la capacidad institucional.

Desde principios de 2020 y hasta la fecha de publicación de este reporte, algunas de las escuelas donde estudian más de 168 millones de niños y niñas del mundo llevan más de un año entero cerradas debido a la pandemia del Covid-19. Como respuesta de emergencia, millones de estudiantes, docentes y directores tuvieron que migrar de manera masiva a plataformas digitales para no interrumpir su aprendizaje y enseñanza. Aún cuando el uso de la tecnología es fundamental para la educación en momentos de distanciamiento social, y su importancia sólo seguirá creciendo en el futuro, el uso de estas plataformas pone a los niños y las niñas en un estado de vulnerabilidad si los datos que se recolectan y guardan de ellos y ellas no son gestionados de manera que protejan su privacidad y seguridad. Es importante que los países de Latinoamérica impulsen una gobernanza de datos de sistemas educativos centrada en los derechos de los estudiantes. Esta gobernanza requeriría un conjunto de iniciativas y procedimientos que prescriban la manera correcta de recopilar, mantener, utilizar y distribuir los datos sensibles, concretamente la información personal de estudiantes y docentes. Este reporte busca servir como insumo para que las Secretarías y Ministerios de Educación de la región sigan desarrollando políticas, procedimientos y responsabilidades que proporcionen claridad en torno a los datos de los estudiantes, preparando el camino para que la información proteja los derechos de privacidad, confidencialidad y seguridad del estudiante.

El Banco de la República, con el Reporte de Sistemas de Pago, entrega un panorama completo de la infraestructura financiera local, siendo este un producto importante de la labor de seguimiento a dicha infraestructura. Las cifras contenidas en este reporte corresponden al año 2020, período de pandemia durante el cual las medidas de confinamiento para aliviar la tensión sobre el sistema de salud generaron para Colombia, al igual que en la mayoría de los países, una fuerte reducción de la actividad económica y el consumo. Desde el comienzo de la pandemia, la Junta Directiva del Banco de la República adoptó las decisiones necesarias para otorgar al mercado amplia liquidez en pesos y dólares, garantizar la estabilidad de los mercados, proteger el sistema de pagos y preservar la oferta de crédito. El pronunciado crecimiento de los agregados monetarios reflejó la mayor preferencia por liquidez, la cual fue atendida oportunamente por el Banco de la República. Las decisiones adoptadas se realizaron mediante diferentes operaciones, las cuales fueron compensadas y liquidadas en la infraestructura financiera. Después de la introducción, la segunda sección del presente reporte de pagos analiza la evolución y el desempeño de las diferentes infraestructuras financieras. Se destaca que el sistema de pagos de alto valor CUD registró en 2020 un mayor dinamismo que el año anterior, principalmente por el aumento de los depósitos remunerados que en promedio diario realizó la Dirección General de Crédito Público y del Tesoro Nacional (DGCPTN) con el Banco de República, así como una mayor actividad del mercado de simultáneas de deuda pública. Consecuentemente con el crecimiento de la actividad en el CUD, el Depósito Central de Valores (DCV) registró una mayor actividad por el aumento del mercado monetario de deuda pública y por las colocaciones por parte del Gobierno Nacional en el mercado primario. El valor de las operaciones compensadas y liquidadas por intermedio de la Cámara de Riesgo Central de Contraparte (CRCC) continúa creciendo, jalonado principalmente por los contratos non delivery forward (NDF) peso/dólar. Con respecto a la CRCC, es oportuno mencionar que a partir de finales del año pasado esta cámara se encarga de administrar los riesgos y de compensar y liquidar las operaciones del mercado de contado peso/dólar, debido a la fusión con la Cámara de Compensación de Divisas de Colombia (CCDC). Así mismo, a partir del último trimestre del año 2020 la CRCC se encarga de compensar y liquidar el mercado de renta variable, labor que venía desempeñando la Bolsa de Valores de Colombia (BVC). En la sección tres se entrega una visión integral de los pagos en el mercado de bienes y servicios, es decir, de las transacciones efectuadas en el circuito de personas naturales y empresas no financieras. Durante la pandemia las transferencias electrónicas inter e intrabancarias, que en su mayoría son originadas por empresas, registraron un incremento tanto en número como en valor de operaciones frente a 2019. Por su parte, los pagos con tarjetas débito y crédito originados principalmente por personas naturales mostraron un comportamiento decreciente con respecto a 2019. Los pagos realizados con cheques siguen disminuyendo, presentando una tendencia a la baja muy pronunciada en el último año. Como complemento a la información sobre transferencias electrónicas, el reporte incluye en esta sección un sombreado sobre la caracterización de la población con cuenta de ahorro y corriente, empleando los datos de la encuesta del Banco de la República sobre percepción de uso de los instrumentos de pago en 2019. Se incluye también un recuadro sobre la evolución transaccional de una billetera móvil provista por una sociedad especializada en depósitos y pagos electrónicos (Sedpe), mostrando que desde su creación a finales del año 2017 ha incremento en el número de usuarios y el valor de las transacciones, con especial velocidad durante la pandemia. Adicionalmente, se presenta un diagnóstico sobre los efectos de la pandemia en los patrones de pago de la población, fundamentado en datos sobre el uso del efectivo en circulación, sobre los pagos con instrumentos electrónicos, y sobre el consumo y la confianza del consumidor. Se concluye que el desplome en el índice de confianza del consumidor y la caída en el consumo privado dieron lugar a cambios en los patrones de pago de las personas. Las compras con tarjetas de crédito y débito disminuyeron, mientras que los pagos por bienes y servicios mediante transferencia electrónica aumentaron. Estos resultados, junto con el considerable aumento del efectivo en circulación, podrían proveer indicios a favor de un posible atesoramiento del papel moneda con motivo precaución por parte de las personas y de un mayor uso del efectivo como instrumento de pago. Se incluye, además, un recuadro que presenta los principales cambios que se introdujeron en la regulación del sistema de pagos de bajo valor en el país mediante la expedición del Decreto 1692 de diciembre de 2020. La cuarta sección se refiere a las importantes innovaciones y cambios tecnológicos que se han observado en el sistema de pagos al por menor. Se destacan cuatro temas en esta línea. El primero se constituye en un punto clave para la construcción de la infraestructura financiera de pagos inmediatos. Consiste en el diseño e implementación de los llamados esquemas superpuestos, los cuales son un desarrollo tecnológico que permite una comunicación abierta entre los diferentes agentes de la cadena de pagos, logrando una alta interoperabilidad entre diferentes proveedores de servicios de pago. El segundo tema explora los avances en el debate internacional sobre la emisión de moneda digital por parte de los bancos centrales (CBDC por su sigla en inglés), con el fin de entender su posible impacto en el sistema de pagos de bajo valor y en el uso del efectivo. El tercer tema está relacionado con nuevas formas de iniciación de pagos, tales como los códigos QR, la biometría o la tecnología de comunicación de campos cercanos (NCF por su sigla en inglés). Estos cambios, aparentemente pequeños, pueden tener efectos importantes en la experiencia del usuario con el sistema de pagos de bajo valor. El cuarto tema, finalmente, es el crecimiento de los pagos vinculados con la telefonía móvil y el internet. El reporte finaliza en la sección cinco con una reseña de dos trabajos de investigación aplicada realizados en el Banco de la República en el año 2020. El primero analiza el nivel patrimonial de la CRCC, reconociendo el rol relevante que esta infraestructura ha adquirido en la compensación y liquidación de varios mercados financieros en el país. Se exploran los requerimientos de capital para las entidades de contrapartida central establecidos en algunas jurisdicciones, se identifican los riesgos que se busca cubrir desde la perspectiva del servicio que este tipo de entidades ofrece al mercado y aquellos asociados a su actividad corporativa. Se analizan los niveles patrimoniales de la CRCC a partir de lo observado en la regulación de la Unión Europea y se concluye que la CRCC cuenta con un esquema de anillos de seguridad muy similar al observado en la experiencia internacional y que su nivel patrimonial es superior al exigido por la regulación colombiana, siendo suficiente para cubrir otros riesgos. El segundo trabajo de investigación identifica y cuantifica las fuentes que utilizan las entidades participantes en el CUD para cumplir con sus obligaciones diarias contraídas en el mercado financiero local, y con su uso como herramienta de monitoreo de la liquidez intradía en condiciones normales. En el modelo económico global el sector servicios continua ganando terreno al manufacturero y fenómenos como la integración de nuevas tecnologías en los procesos productivos avanzan inexorablemente. Las economías avanzadas se ven obligadas a especializarse apoyadas en sus sistemas regionales de innovación y las ciudades emergen como focos de actividad centrales y estratégicos. En esta dinámica los servicios avanzados (SSAA) se presentan como una actividad prioritaria por su capacidad para promover la innovación dentro del tejido productivo regional dentro de las estrategias de especialización inteligente y en especial en el impulso de la manufactura avanzada, la generación de empleo de calidad y el estímulo del crecimiento económico especialmente en entornos urbanos. Es por ello que el desarrollo de talento para poder responder a la demanda de empleo de estos SSAA se convierte en imprescindible en cualquier ciudad que priorice este ámbito en sus estrategias de desarrollo. En paralelo los sistemas de formación profesional (FP), como el vasco, han desarrollado sus máximas fortalezas en el ámbito de las familias profesionales y comarcas más industriales. Por ello, la FP parece obligada a adaptarse a este nuevo escenario en el que sobresalen los SSAA y las ciudades para continuar manteniendo su nivel de excelencia. Los SSAA han sido largamente estudiados pero hasta el momento nadie se había planteado las siguientes cuestiones: ¿Cuál es el rol de la FP en los SSAA? ¿Son y serán relevantes las personas con estudios de FP en los SSAA? En el presente estudio se mostrará una tendencia incipiente en el mercado laboral. Se trata de la creciente relevancia de los perfiles tecnológicos con estudios de FP en los SSAA, especialmente en los SSAA de tipo tecnológico. Los perfiles tecnológicos de FP pueden consolidarse como uno de los agentes implementadores principales de la transformación digital (ciberseguridad, blockchain, computación en la nube, diseño UX, inteligencia artificial, computación científica…). Para ello, la hibridación con otros campos de conocimiento pero también con estudios de otro tipo como los universitarios puede ser fundamental.
