AbstractPublic infrastructure decisions affect many stakeholders with various benefits and costs. For public decisions, it is crucial that decision-making processes and outcomes are fair. Fairness concepts have rarely been explored in public infrastructure planning. We close this gap for a global issue of growing importance: replacing sewer-based, centralized by decentralized wastewater systems. We empirically study fairness principles in this policy-relevant context, and identify possible influencing factors in a representative online survey of 472 Swiss German residents. In a transition phase, innovative, decentralized pilot wastewater systems are installed in households. We designed two vignettes for this context to test the adhesion to principles of distributive justice—equality, equity, and need—at individual and community levels. A third vignette tests procedural justice with increasing fulfilment of fair process criteria. The results confirm our hypotheses: equity is perceived as fairer than equality at individual and collective levels. Contrary to expectations and literature, need is perceived as even fairer than equity. Procedural justice results confirm literature, e.g., the majority (92%) of respondents deems a policy fair that includes them in decision-making. Only few demographic and explanatory factors are significantly correlated with respondents’ fairness perceptions. Although unexpected, this is positive, implying that introducing decentralized wastewater technology can be designed for the entire population independent of characteristics of individuals. Generally, our results confirm literature: fairness perceptions depend on the circumstances. Hence, they should be elicited in the exact application context to be able to enter negotiation processes and provide concrete advice to decision makers.

Community-based coalitions are a popular strategy for promoting community health despite the fact that coalitions often fail to achieve measurable results. Using a procedural justice framework, this study seeks to advance knowledge about the relationship between coalition governance and management processes and indicators of coalition functioning. Member survey data from 25 coalitions participating in the Community Care Network Demonstration Program were analyzed using two-stage least squares regression. Results show that personal influence in decision making, decision process clarity, and collaborative conflict resolution were significantly associated with procedural fairness perceptions. Procedural fairness perceptions, in turn, were positively associated with member satisfaction with coalition decisions, but not personal engagement in the coalition or organizational integration of coalition goals and activities. Personal influence in decision making and collaborative conflict resolution also exhibited direct relationships with all three indicators of coalition functioning examined in the study.

Abstract The Security Council’s structure as a small but powerful executive, combined with its primary responsibility for international peace and security, leads to a presumption against the application of ordinary standards of procedural fairness. At the same time, explicit provisions of the UN Charter and its own rules of procedure indicate that some balance was to be struck. This article questions whether the attainment of international criminal jurisdiction through Security Council decision-making really outweighs the need to ensure procedural integrity in every step of the process. It posits that a lack of procedural fairness in the Council’s methods of work at least undermines the justice imperative that the Council so espouses and at most violates an ancillary legal obligation.

Innovations to manage freshwater resources and avert shortages – including conservation through use of reclaimed wastewater, desalination, and demand-side management measures such as increasing block rate structures offer practical, effective remedies for meeting future water demands. We examine the challenges confronting adoption of these innovations that revolve around perceptions of fairness and public acceptability. A major obstacle to these approaches' adoption is environmental justice – that the risk and burden of resource solutions, as well as their benefits – should be borne equitably, despite differences of income or race. We first consider how debates regarding water supply are often disputes over different notions of environmental justice. We then examine general equity debates over adopting various innovations in one US state at the nexus of water demand and supply innovation: California. We contend that fairly adopting these innovations requires embracing open, inclusive, and transparent decision-making processes in which no important constituency is excluded from decisions, and in which different notions of environmental justice are embraced.

Procedural environmental justice refers to fairness in processes of decision-making. It recognises that environmental victimisation, while an injustice in and of itself, is usually underpinned by unjust deliberation procedures. Although green criminology tends to focus on the former—distributional dimension of environmental justice—this article draws attention to its procedural counterpart. In doing so, it demonstrates how the notions of justice-as-recognition and justice-as-participation are jointly manifested within its conceptual boundaries. This is done by using the consultation process that occurs with indigenous peoples on proposed oil sands projects in Northern Alberta, Canada, as a case study. Drawing from ‘elite’ interviews, the article illustrates how indigenous voices have been marginalised and their Treaty rights misrecognised within this consultation process. As such, in seeking to understand the procedural determinants of distributional injustice, the article aims to encourage broader green criminological scholarship to do the same.

<p><em>Fierce competition in business often encourages businesses to act unreasonably in their pricing strategies. Orientation to maximum profit often trumps the ethical values derived from religious teachings. This study aims to find the meaning of strategic pricing decision-making of Muslim businessmen based on their awareness of Islamic values. Islamic values arise from the perception of business people as a reflection of knowledge about Islamic ethics that they understand. The research method used is transcendental phenomenology. The sampling was conducted on five businesspeople members of the Indonesian Islamic Business Forum (IIBF). This study found that Muslim businessmen Interpret strategic pricing decision-making according to their awareness of Islamic values as a form of justice, namely fairness in pricing based on market segments and based on product value-added. This research will provide knowledge to business people to consider ethics in the strategic policy of price management conducted.</em></p>

Australia’s incarceration rates are the highest they have been in a century. Bail and remand contribute much to this trend, and yet the reasons why police refuse bail to vulnerable people are currently unclear. What is clear, though, is that a disproportionate number of vulnerable people are being refused bail, resulting in periods of remand incarceration which end up either longer than the prison sentence given by a magistrate, or undue if the alleged offender is found not guilty. This tendency is particularly observable for the most vulnerable: Aboriginal people, children, people with a mental health condition, the homeless, and women. The authors investigated how magistrates grant or refuse bail as part of the court process, then looked at two tipping points bracketing the bail continuum: 1) policing interactions leading to court appearance, and 2) the impact of bail refusal on public health and community safety and well-being in general. In the present article, they examined how authorized police officers consider refusing or granting bail. This new project aims to investigate the police bail decision-making process and generate new knowledge about the impact of bail refusal on vulnerable people. Through an iterative process with national practitioners and international experts, the authors aimed to identify factors to consider when bail involves vulnerable people. Expected outcomes included the development of mechanisms to benefit the full remit of criminal justice, reduce costs, and improve fairness, accountability, and procedural justice.

The State of Indonesia is a State of Law. But, in fact the ideals of the idea of the State of Law that was built by developing the legal tool itself as a system that is functional and just to achieve community welfare and social justice has not been optimally done. This is reflected in the new Environmental Permit issued by Central Java Governor Ganjar Pranowo (No. 660.1 / 6 of 2017 on Environmental Permit for Mining and Construction Activities of PT Semen Indonesia Plant) is considered to have injured the ideals of the law itself. The new Environmental Permit is contradictory to the content of the Review Judgment issued by the Supreme Court (Supreme Court Verdict Decision Number 99 PK / Tun 2016), because in the ruling it ordered that the Governor Replace the old Environmental Permit, which was issued in 2012 and did not issue New Environmental Permit. The verdict contains the basis of judges' consideration in deciding cases that have reflected fairness and legal certainty. The result of the research on the validity of the Environmental Permit Decree on the Review Judgment issued by the Supreme Court concluded that the decree should be invalid because it is not in line with the decision of the court which has permanent legal force.

As the number of women entering postsecondary education continues to increase (U.S. Bureau of Labor Statistics, 2014), universities will be tasked with ensuring that their pregnancy leave policies and practices are aligned with the principles of organizational justice. When organizations are aware of the perceptions of both decision makers and those affect by decisions, they are able to alter policies and practices in a way that promotes perceptions of fairness. The present study examines department head and faculty member perceptions of pregnancy leave practices in a university setting. This study is a replication/follow-up of two studies conducted in 2005 and 1995 on perceptions of pregnancy leave practices within a university setting. The results indicate that department heads and faculty members similarly perceive the fairness of options to cover a pregnant faculty member’s responsibilities. Department heads and faculty also rated their willingness to use an option similarly. Additionally, department heads are more willing to use options that they perceived as fair and are less likely to use options they perceived as unfair. The findings of this study indicate that it is important for those affected by decisions such as pregnancy leave practices to experience voice in the decision-making process. The results of this study should be useful to universities and department heads when determining how to cover the responsibilities of a faculty member on pregnancy leave.

The presence of unethical behavior continues to plague the global business community, however, and its impact in the finance industry is widely thought to be having an even more devastating impact than ever before. Scholarly literature provides little understanding of what drives ethical decision making, or the processes involved and a little evidence that ethical standards have been developed as part of leadership decision making training in finance. The purpose of this qualitative single case study was to explore the drivers and processes in the development of training that supports ethical choices that leaders make in their decision-making role within the finance industry, as well as to understand what effects those decisions have on followers and on organizational culture. The research question examined the processes and training involved in ethical decision making in the field of finance. Rawls' justice as fairness theory provided the theoretical framework. The data were collected interviewing purposefully selected 7 directors and managers in the financial industry. The data were analyzed using a constant comparative approach and the development of vignettes based on Stake. The results showed that leaders were not able to make sound ethical decisions and the need for ethical standards. When these standards and values are compromised, leadership behaviors can affect organizational culture, as they tend to decrease commitment, performance and motivation of employees, while increasing absenteeism and turnover, thus adversely affecting company operations and incurring costs. The study results can have implications for social change through developing higher standards in ethics and adequate morale training.

Sustainable development assistance organizations (SDAOs) are designed to help interested producers conduct market research, identify clients and more effectively manage the process of moving products to market. Producers of sustainable products are often small business owners and grassroots entrepreneurs that produce and sell natural resource-based goods and services. The broad research question this dissertation explored was whether the decision-making processes employed by producers, staff and board members in an SDAO hold implications for their collective achievement of sustainability. Data collection focused on understanding the various frames through which producers, staff and board members approach their work with, and decision making within, the SDAO as well as how they conceptualize sustainability. This research employed semi-structured, in-depth interviews with growers, staff members and board members involved in one SDAO. The analysis found that producers, staff and board members held a number of competing frames regarding the purposes and objectives of the SDAO as well as concerning the meaning of sustainability. Frames influence the ways that each stakeholder group perceived and participated in decision-making and lead to the institutionalization of tacitly supported decision-making practices. These routines, when viewed through an efficiency lens, lead to quick decision-making, avoided conflict and allowed the SDAO to make decisions with consistency and clarity. When viewed through an environmental justice lens, however, these practices proved exclusionary, favored some elements of sustainability rather than others, and supported some participants more than others. Taken together, the decision-making practices used by Blue Mountain Organic Vegetables limited the organizationâ s capacity to develop a learning culture, created divisions among stakeholders and did not empower stakeholders with commitment to, and responsibility for SDAO decision-making. Consequently, Blue Mountain Organic Vegetables now faces organizational challenges related to the development of commitment, trust and ultimately, resilience, within the organization. The analysis concludes these concerns are potentially critical as these elements are essential for achieving sustainability, as they are also central to the organizationâ s ability to respond to, and overcome, challenges.

As the Hispanic/Latino population grows in the United States, increased attention is being given to how and why Hispanic/Latino recreation differs from Anglo recreation. Concerns over equal access to natural resources and recreation have led researchers to question the causes for the differences in recreation choices. The discussion has largely focused on the restrictive effects of ethnicity and the marginal position of minorities in society creating recreation patterns in which minorities are practically nonexistent in wildland recreation areas. Stepping away from the negative valuation about dissimilarities in Hispanic/Latino versus Anglo recreation, this study of Hispanics/Latinos in Cache Valley, Utah focuses on recreation as defined by participants, recreation sites both visited and not visited, and the decision drivers participants identify as most influential. Through the use of a participant mapping activity, this study first identifies patterns in types of sites visited and not visited by participants. Using exploratory, semi-structured interviews, this study also uncovers the participants’definitions of recreation as well as important elements driving their recreation choices, including desired and undesired sites for recreation. Municipal recreation sites are visited most commonly by participants and the major drivers attracting their visitation are the physical site characteristics comprised of proximity to their residences, available facilities, suitability for family outings, scenery, a feeling of seclusion or relaxation, and activities specific to the site. Sites not visited span the categories of municipal, federal, state, and private. Federal sites are the most commonly desired and undesired types of sites not visited by participants. Non-visitation of sites was found to largely be the result of marginality characteristics such as a lack of money, time, knowledge, language, and fear. Ethnicity and custom also proved to be influential drivers of recreation decisions through elements like language and participant conceptualization of recreation as seeking spaces in which to gather with others. This study concludes that customs and powers of access (as related to ethnicity and marginality) intermingle to influence recreation choices among Hispanic/Latino participants. Looking at Hispanic/Latino recreation beyond its comparative Anglo differences provides a necessary holistic understanding of the elements driving this ethnic group’s decisions. As this understanding increases, work can be done to ensure equality in access to resources like recreation as desired by the minority population.

In this dissertation I explore how the international law principle of free, prior and informed consent (FPIC) can enhance public participation, to promote environmental justice for communities affected by environmental decision-making in the mining sector in South Africa. Public participation required in terms of the mining sector environmental regulatory framework in South Africa is underscored by a requirement to ‘consult’. In chapter one, I describe how the requirement to consult differs from a requirement to secure consent in terms of FPIC. I describe public participation (i.e. consultation) requirements related to applications for rights, permits, licences and authorisations that must be in place prior to commencement of mining operations. I argue that where the level of public participation requires mere consultation, it can easily amount to a regulatory tick-box exercise given that the views of mining-affected communities can be manipulated or overlooked, with mining developments proceeding despite devastating effects on communities. In chapter two I describe how FPIC has become part of the regulatory framework governing mining activities through the court’s purposive interpretation of the Interim Protection of Informal Land Rights Act 31 of 1996 (IPILRA) in Baleni and Others v Minister of Mineral Resources and Others and Maledu and Others v Itereleng Bakgatla Mineral Resources (Pty) Limited and Another. In chapter three, I engage with scholarly literature on FPIC to analyse why and how environmental justice should and can be enhanced by embedding FPIC into legislative public participation requirements. I argue that FPIC, which now forms part of South Africa’s law through the IPILRA, should be a prominent feature in public participation processes for mining-affected communities generally, and not only for informal land right holders.

AbstractAnimals, like human beings, are prone to suffering harms, such as disease, injury and death, as a result of anthropogenic and natural disasters. Animals are disproportionately prone to risk and adversely affected by disasters, and thus require humane and respectful care when disasters strike, due to socially situated vulnerabilities based on how human communities assess and value their moral standing and function. The inability to integrate animals into disaster risk and management practices and processes can sometimes be associated with a lack of understanding about what animal ethics and animal health and welfare require when designing disaster management programs. This chapter seeks to reimagine human responsibility towards animals for disaster management. The pervasiveness of disasters and their impacts on animals, human-animal and animal-environment relationships underscore the importance of effective animal disaster management supported by sound ethical decision-making processes. To this end, we delineate six ethically responsible animal caretaking aims for consideration when developing disaster management plans and policies. These aims, which address central vulnerabilities experienced by domesticated animals during disasters, are meant to be action-guiding within the disaster management context. They include: (1) Save lives and mitigate harm; (2) Protect animal welfare and respect animals’ experiences; (3) Observe, recognize and promote distributive justice; (4) Advance public involvement; (5) Empower caregivers, guardians, owners and community members; (6) Bolster public health and veterinary community professionalism, including engagement in multidisciplinary teams and applied scientific developments. To bring about these aims, we offer a set of practical and straightforward action steps for animal caregivers and disaster management teams to ensure that animals’ interests are systematically promoted in disaster management. They include: (1) Respect and humane treatment; (2) Collaboration and effective disaster communication; (3) Strengthening systems of information sharing, surveillance, scientific research, management and training; (4) Community outreach and proactive contact; (5) Cultural sensitivity and attitudes check, and (6) Reflection, review and reform.

AbstractIn Aotearoa New Zealand, co-management initiatives are increasingly commonplace and are intended to improve sustainable management of environments as well as foster more equitable sharing of power between the settler-state and Indigenous Māori iwi (tribes). In this chapter we examine one such co-management arrangement that recognises and includes Ngāti Maniapoto iwi in decision-making about their ancestral river (the upper section of the Waipā River Catchment) and whether the implementation of initiative translated into tangible benefits for the iwi. Our research findings highlight how co-management agreement is perceived as overwhelming positive by both government and Ngāti Maniapoto representatives. However iwi note that they still face substantive barriers to achieving environmental justice (including the lack of formal recognition of their authority and power, and limited resourcing).

AbstractThe most well-known representation of the globe, the Mercator Projection, often provokes surprise for its considerable distortions: despite appearances, Greenland is almost five times smaller than Canada, and Russia is, in fact, approximately half the size it appears. Since the oldest civilizations, maps have relied on shifting knowledges to become more accurate and efficient, a process accelerated with science and technological development. But the unrealistic proportions of the Mercator map point to a critical reflection: maps show no absolute truths, nor are they neutral. Maps tell stories; they represent ideas as much as spaces, and exactitude is no synonym for neutrality. On the contrary, mapping is a cultural and political act. In the 1990s, geographers started to defy the power relationships of mapmaking with critical cartography. This critique, strongly supported by activists, opened new debates and representational possibilities in which scientific principles started to matter less than social and environmental justice, political participation, and storytelling. Within this framework, this chapter reflects on two alternative mapping methods used in the humanities and social sciences: social cartography and deep mapping. Each section introduces origins, theoretical frameworks, reception, and applications. Because these methods aim to rectify the abuse of power often enabled by scientific mapping, they use non-prescriptive mapmaking to legitimize neglected perspectives. Social Cartography is intrinsically participatory and uses mapping as a collaborative and critical practice. It challenges the role of traditional cartography in socio-political spheres, creating opportunities for new narratives and communities to be heard and understood. Deep maps represent abstract characteristics of a place. They can transcend the boundaries of bi-dimensional and pictorial representation, and consequently, reach different publics. The method is flexible, combining literature and immersive experiences to convey personal or subjective qualities of a place. Other expressions of deep mapping include audio and performative documentations. Social cartography and deep mapping operate against traditional mapmaking by reinforcing the notion that non-institutionalized maps are just as valid in guiding public actions and projects. As participatory practices within communities, these methods promote dialogue, empowerment, and transformation. Therefore, they are indispensable in ensuring democratic research and decision-making.

Among the reasons interfering with the product development are the human being necessities concerning with activities that one has to do to make possible the action in his/her environment. In order to satisfy such necessities, the practice of Design allow us to find project solutions that yield the balance among several factors inherent to the process of product development, with exchange between the designers, who aims a positive reception for their products, and the end user, in conformity with their necessities. However, the process should take into account the preoccupations with the sustainable development that, according to the Brundtlando report, should be the simultaneous search for economic efficiency, social justice, and environmental harmony. The report also states that the industry should produce more with fewer resources, as well as adopt clean technologies, and proliferate the knowledge by means of financial support of the local and international organizations. This work describes the adaptation of two systems, the traditional roasting furnace of manioc flour and the combustion system by clean burning (downdraft). By making use of a clean technology for production, the resulting system pursues economical feasibility that can lead to social fairness, promoting environmental harmony.

While projects are becoming increasingly more complex in their organizational, technological, and environmental dimensions; complex systems are deemed by being unjust by nature. Previous research has suggested that heedful interconnection among the actors of the system can enhance organization’s capability in ethical coping with complexity. However, project-based organizations tend to cope with complexity through developing adaptive capacity within the borders of the organization and marginalizing the demands and concerns of some stakeholders. By investigating the controversial project of Rome Metro Line C and drawing on ethics of care and ethics of justice, this article suggests that coping with complexity is attainable by extending the organization’s border to include all stakeholders of the network. The empirical study proposes that by fostering the interrelation of a broader range of stakeholders with the organization through a decentralized decision making will improve the extended organization’s capability in identifying and absorbing complexity.

Due to the negative effects of spatial development, the current social and environmental conditions require unified concepts of solutions aimed at reducing disparities, poverty and increasing various forms of justice. Sustainable development, as the predominant environmental discourse of modern times, has been facing the problem of implementing fundamental guidelines in practice since its establishment in the mid-1980s. The balance of socio-economic, economic and especially environmental indicators, which is still perceived as an unrealizable utopia of modern society due to the inconsistent conception of the concept and action from the position of power, influence of capital and interests of "strong" countries, through narrow economic and political interests. In the prevailing, neoliberal global order, it represents an increase in the influence of partial interests (capital, influential countries, elites) on decision-making (including individual economic and political decisions of governments), departure from original, otherwise good intentions and impulses, changes in social behavior. There are several reasons for the mentioned stagnation and unsuccessful activation of changes in space, and especially global inactivity. The fundamental problem is the lack of political justice, which is a prerequisite for ensuring all other justice (environmental, ecological or social), which leads to reducing equality and differences in society and limiting and ensuring the rights and duties of the individual or the interests of society as a whole.

Much has been accomplished – and much debated– since Hurricane Katrina made landfall outside of New Orleans in 2005. There have been many successes – and many failures – in regards to the recovery, rebuilding and resiliency of the unique“Cross-American” port city. Social, economic and environmental justice issues have been brought to the forefront, in the wake of an unprecedented human-altered “natural” disaster. This paper will not attempt to regurgitate what has been critiqued and promulgated about New Orleans in relation to status quo rebuilding. Rather, the paper will focus on water management demands, efforts and proposals since the storm; and, how these water-centric efforts have challenged existing decision-making regimes, in turn advocating for new governance partnerships, funding streams and integrative design methodologies.

The term “wicked problems” describes urgent challenges that are ill-defined, dynamic, complex, public, and often intractable. They stem from interconnected economic, social and environmental problems. Sustainability professionals take a transdisciplinary approach to creating a more sustainable society when dealing with wicked problems like climate change, water policy, resource management, biodiversity, and sustainable development. As society adapts to the complexities of a postCOVID world, it has become increasingly important to incorporate broader perspectives in decision-making. With the many interconnected issues of health, economics, and politics left in the wake of COVID-19, the business community must examine the role of corporate responsibility in addressing these problems. Business can look to the field of sustainability science for tools to help with this. Sustainability is oriented toward problem-solving on a variety of scales, from entrepreneurial niche innovation to global accords. Sustainability expertise will tackle wicked problems evolving in the post-COVID-19 economy - the flow of raw materials through the economy and the development of social resources to address issues of justice, equity, diversity, and inclusion. Sustainability skills can be used to more efficiently acquire and use raw materials through the improved application of circular economy principles. Examples include how to use blockchain technology to create a more effective supply chain. Sustainability science also emphasises interpersonal and intrapersonal skills. These skills improve the acquisition and understanding of stakeholder perspectives, bridging differences in perspectives and vocabularies. Intrapersonal skills help to develop attitudes of community engagement and corporate responsibility, teaching how to incorporate stakeholder concerns in personal decision making. Sustainability professionals strive to build a more resilient, robust, efficient, and most importantly, effective society. A key focus is on building interactive networks and promoting community engagement and social responsibility.
