The study focuses on the procedure for appointing and conducting expert research in cases of crimes related to violations of labor protection and safety rules. The author out lines the range of research tasks in this area, lists the types of expertise that are widely used in this category of criminal cases. Based on the analysis of legal norms regulating the procedure for the appointment and conduct of forensic examinations, the author comes to the conclusion that the procedural legislation contains a significant number of General approaches to the appointment and conduct of expertise (including in the field of investigation of crimes related to violations of labor protection and safety rules). The specificity of expert research on this category of criminal cases is that in the framework of establishing the actual circumstances of the incident, it is often necessary to conduct several examinations (complex expert studies), taking into account the specifics of specific production processes at the enterprise.

In the context of a dynamically developing digital economy in Russia, the labor protection management system in organizations is integrated into production management processes, based on the principles of social partnership and digitalization of labor protection processes. Emerging new and existing problems of finding tools for effective management of labor protection in modern socio-economic conditions can also be solved based on a competence-based approach. In order to study the impact of professional competence of specialists in the field of labor protection on the effectiveness of labor protection management and the development of social and labor relations in the field of labor protection in the organization, there was conducted an analytical study using empirical material from more than 1,600 organizations. There was studied state of professional competence of more than 2,600 specialists in the field of labor protection. The expert method identifies various levels of professional competence of specialists in the field of labor protection: high, medium and low. The method of mathematical analysis (main components) is used to assess the factors of formation of their professional competence, such as basic education, experience and work experience, professional development, and the availability of additional competencies. Using the methods of analysis and synthesis, the authors justified and proposed indicators of social and labor relations in the field of labor protection, which are influenced by the professional competence of specialists in the field of labor protection. The main indicator was the rate of accidents at work. As a result, the method of factor analysis determined the complex influence of the level of professional competence of specialists in the field of labor protection on the development of social and labor relations in the field of labor protection. From the positions of various categories of personnel, this influence is estimated as directly proportional, constructive, nominal and destructive. The authors obtained a quantitative assessment of the impact of the level of professional competence of specialists in the field of labor protection on the level of injuries as one of the indicators of social and labor relations in the field of labor protection in organizations on the example of one of the factors of its formation - basic specialized education. The article shows the positive impact of improving the professional competence of specialists in the field of labor protection on the economic efficiency of the enterprise.

The principles of the social protection of the population in Russia began to take shape in the late 10th century, along with the adoption, in 988, of Christianity in Russia. The modern history of institutions of medico-social examination began on 27 April 1918 when the people’s Commissariat of public scorn was transformed into the Commissariat of social security, and began the formation of the medical labor commissions of the predecessors of the modern institutions of medico-social examination. Thus, the system of medico-social expertise of the Russian Federation in 2017 has reached the age of 99. As the formation and development of the social insurance, social welfare and health care and improved system of medical-social expertise, strengthen its scientific base. Currently, medical-social examination has formed in a special branch of scientific knowledge and practical activities. The way of the development, passed by the medical-social examination starting from the medical-labor expertise, creation, formation and development of the medical-social examination on the entire territory of Russia can be divided into a number of stages determined by peculiarities of its political and socio-economic status.

The current stage of health protection and social protection of the population poses new challenges for the ITU institutions to improve the quality of expertise, address issues of disability prevention, and there is no doubt that statistical analysis still plays an important role in their implementation. Considering the issues of disability, the dynamics of a social phenomenon that has all the rights to public attention is reflected. Materials on disability and the activities of ITU institutions, when adequately analyzed and used, are an effective tool in the work of government bodies to organize and improve measures to prevent and reduce disability, improve expert and rehabilitation services for the population. The purpose of this article is to present one of the organizational forms of the work of the ITU Bureau for the study of the causes and factors that directly led to disability, the prevention of disability, taking into account the task set by the Ministry of Labor and Social Protection of the Russian Federation to the Federal State Institutions of Medical and Social Expertise.

It is impossible to establish the truth in criminal proceedings while considering cases related to related to non-compliance with the requirements of the Law of Ukraine with the requirements of the Law of Ukraine "On Labor Protection" without performing forensic examinations regarding the investigation of causal relations and establishing circumstances preceding the accident. As a rule, the research subject in this case is materialized carriers of information about a harmful event that had taken place. Therefore, from a technical point of view establishing the presence of circumstances that preceded and led to adverse effects and their direct connection with the occurrence of these consequences is one of the issues of Forensic Engineering. The causation assessment is based on a theoretical research of circumstances of an accident event on the basis of materials provided for research. The use of philosophical and logic means is the basis of forensic research on the causation determination and the establishment of objective truth in legal practice. The article reveals contemporary views on the problems of causal relationship between socially dangerous acts and the socially dangerous consequences of these acts in combination with expert practice while research related to electrical injury. The completeness and objectivity of the expert's opinion on the results of the studies of accidents related to electrical injury depends on the availability of expertise in the field of electrical engineering and requires the mandatory involvement of a forensic expert in relevant field.

Demotion occurs in a company mainly because of its negative influence on the morale of the workers concerned and can affect the achievement and morale of other workers in the company. Decline in the position of authority, facilities, status and even salary is a punishment for workers. Demosi is not given its arrangement in Law number 13 of 2003 concerning Manpower and other laws and regulations related to employment. Thus, this demotion arrangement can be regulated individually in work agreements, company regulations or collective labor agreements.The company does have the right to move workers in other parts but may not violate Human Rights and violate the provisions of Article 32 paragraph 2 of the Manpower Act which stipulates that placing someone who is not because of his expertise is against the law. Workforce placement must also pay attention to expertise, dignity and human rights and legal protection. The problem examined is how legal protection for workers due to demotion policy at PT. Magnificent Success Partner? Results of the analytical research are given to justify methods of working capacity expertise in patients with hearing loss. The goal is to provide the successful professional rehabilitation of these workers and minimize the risk of occupational trauma or occupational disease because of harmful occupational factors. Since 2014 hearing loss patients have been allowed to work with many harmful and dangerous factors. Up-to-date laws and regulations have some logical contradictions with controversial interpretation. Some criteria for determination of working capacity in these workers have not been justified from the point of view of the professional risk yet. The paper discusses the need for the optimization of normative acts by the way of exclusion of logical contradictions and incorrect formulations. Today the determination of professional risk for the workers with hearing loss who work in noise and under the action of other harmful occupational factors is topical. According to results of this research the criteria of working capacity expertise for these cases should be revised to prevent health risk and disaster situations. Working capacity expertise in hearing loss patients should be provided by specialists in occupational medicine and labor protection. Individual peculiarities of the disease and prospective work place should be also taken into account.

This thesis explores the enabling role of bureaucracy in cross-expertise collaboration. Based on 13 months of ethnographic fieldwork in the engineering unit of an aeronautical company, and focusing on a myriad of different specialists involved in the company’s product development, I show that bureaucracy (i.e., understood as the rationalization of work) provides the infrastructure for the collaborative work of various experts. More specifically, through eight embedded cases, I examine how bureaucracy shapes cross-domain meetings, knowledge exchanges, and the work of intermediaries, making these dynamics more unambiguous, calculable, reliable, and precise. By reducing uncertainty, bureaucracy enables specialists to engage in focused and productive exchanges and interactions. I identify three conditions that underpin the positive impact of bureaucracy in this context and present four of its enabling roles in cross-expertise collaboration. Namely, these are: clarifying responsibilities, interconnections, and complex processes; promoting impartial relations and reducing tensions; ensuring participation in systemic matters; and streamlining integration. Overall, the thesis takes bureaucracy out of the shadows in our understanding of collaboration processes. It also contributes to studies on expertise coordination by highlighting that in highly-interdependent work situations formal organizational elements co-exist — and complement — emergent integration/coordination mechanisms. The thesis also contributes to the general organizational scholarship by putting forward a more appropriate understanding of bureaucracy in contemporary organizations which underscores its multifaceted nature. The work also has implications for the practitioner-oriented literature on collaboration, emphasizing the value of functional structures and formalization when most authors sing the praises of team-based arrangements and ‘organic’ structures.

Child protection social workers must make difficult decisions in real life circumstances that often involve limited knowledge, uncertainty, conflicting values, time pressures and powerful emotions. These circumstances can pose a significant challenge to reasoning skills, especially when the cost of errors and poor judgment can be unacceptably high. This study explores the psychological processes that underpin how child protection practitioners form judgments and how these are influenced by the organisational settings that they work within. The study has an ethnographic design with two sites; a local authority children's intake service and a NHS multi-disciplinary court assessment service. The sites were chosen as contrasting organisational settings within which to study practitioner decision making. Forty days of observation and twenty-four interviews with practitioners were completed across the two sites over a two-and-a-half year period. The study found that practitioners' reasoning processes were a dynamic interplay of intuitive and analytic processes with emotionally-informed intuitive processes as the primary driver. As practitioners became more experienced, they engaged in progressively more sophisticated pattern recognition and story building processes to analyse and evaluate complex information. However, practitioners of all experience levels were vulnerable to the same predictable errors arising from cognitive vulnerabilities that affect the whole population. Comparison of the two sites identified the following themes concerning the influence of organisational context; the timescales that practitioners worked within, the opportunities for case discussion, and the cultures of accountability within the organisation. In response to considerable time pressures and increased demand, local authority social workers at times engaged in a range of operational defences and speed practices. This was combined with a pervasive accountability culture that inadvertently led to local authority social workers being more likely to manage anxiety through practices that acted as a form of pre-emptive exoneration. The study contributes towards the existing literature by examining everyday child protection practice using a theoretical approach that combines insights from psychological and psychoanalytic approaches. The study identifies new insights into practitioner decision making, suggests new ways of understanding accountability, and has implications for how organisations can help both reduce errors and support expert practice.

Initially a central topic for psychology, suggestibility has been forgotten, rediscovered, evaded definition, sabotaged experimentation and persistently triggers epistemological short-circuits when interconnecting psychological questions of memory, childhood and scientificity, with concrete legal issues of child witnesses' credibility, the disclosure of sexual abuse and psychological expertise in courts of law. The aim of this study is to trace suggestibility through history, theory, research and practice, and to explore its efficacy at the intersection of psychology and law, by examining and comparing the. concrete case of child witness practice in England and Germany. Taking a transdisciplinary approach the study draws on two interrelated sources of 'data' combining historical, theoretical and research literature with the analysis of empirical data. A genealogy if theory and research is combined with the results of reflexive interviews, conducted in England and Germany with practitioners from all those professions involved in creating, applying or dealing with knowledge about child witnesses and suggestibility: judges, prosecutors, lawyers, police officers, psychologists (researchers, experts) and social workers. Drawing on the work of G. Deleuze and 1. Stengers this study shows how practical tensions around reliable witnesses, evidence and expertise merge pragmatically with theoretical movements employed to adjust the discipline, thereby causing frictions and voids. In this sense suggestibility provides a liminal resource: It transgresses disciplinary boundaries and pervades pragmatic and theoretical, global and personal, historical and actual considerations, creating voids that allow us to reconsider the pragmatics of change and to redefine the issue of critical impact, as well as to reformulate the problem of child witness practice and children's suggestibility. The study hopes to make a concrete contribution to facilitating the just prosecution of sexual abuse by adding transparency to the complex and at times unhelpfully polarised field of child witness practice. By exploring the 'pragmatics of change' the study furthermore hopes to give an unsettling and productive impetus to theoretical debates within critical approaches to psychology.

This paper is divided into two distinct sections. The first being an analysis of the legal protection of temporary employees as things currently stand. It deals with the various labour laws that currently regulate temporary employment as well as the temporary employment contract and the common-law. The second section summarises and analyses the provisions of the Labour Relations Amendment Bill and the Basic Conditions of Employment Bill as they apply to fixed-term employees. Temporary employees are protected by the general protection extended to all employees in terms of section 23(1) of the Constitution of the Republic of South Africa, 1996, guaranteeing all employees the “right to fair labour practice”. The Labour Relations Act has as one of its main objectives to give effect to and regulate the fundamental rights contained in the Constitution. Thus the Labour Relations Act must not only give effect to constitutional rights but it must also ensure that it in no way unreasonably or unjustly denies or limits constitutional rights. Temporary employees have a number of labour laws protecting their interests. Where the provisions of the Basic Conditions of Employment Act, a Bargaining Council Agreement or a Sectoral Determination do not apply the employee will rely on the terms of the fixed-term employment contract and thereafter the common law for protection. The only protection offered to temporary employees contained in the Labour Relations Act is in section 186(1)(b), where a dismissal is defined to include the non-renewal of temporary contracts of employment where there is a reasonable expectation of renewal on the same or similar terms. This provision has proved to be highly controversial in that it does not expressly cater for temporary employees who harbour reasonable expectations of indefinite employment. An analysis is made of the most important cases relating to section 186(1)(b). The second section unpacks and critically analyses the Labour Relations Amendment Bill and the Basic Conditions of Employment Bill which have been long in the offing and when they are finally enacted, will bring with them sweeping changes for atypical employment . The amendments will drastically change the way employers make use of fixed-term employees as well as the way in which Temporary Employment Services may conduct business if they are in fact able to keep working at all. There is very little literature of substance written about the Labour Relations Amendment Bill as it applies to atypical employment. The fact that the proposed amendments have changed so many times over such a long period of time might have deterred many writers from investing time and effort in attempts to analyse and summarise the amendments. Articles posted on the internet are in the main short and have very little content. No books were found with any discussion that pertains to the amendments. The amendments divide employees involved in atypical employment into two different categories. These categories consist of employees earning above the threshold in terms of section 6(3) of the Basic Conditions of Employment Act and those earning below this threshold. All fixed-term employees may rely on the provisions of section 186 of the Labour Relations Act. Employees earning below the threshold are considered to be the most vulnerable and have been afforded additional protections in terms of sections 198(A), (B) and (C). Issues surrounding Temporary Employment Services and fixed-term employees have been very divisive and have been the topics of heated debate at all levels of Industrial Relations for a long time. The only protection offered to temporary employees contained in the Labour Relations Act is in section 186(1)(b), where a dismissal is defined to include the non-renewal of temporary contracts of employment where there is a reasonable expectation of renewal on the same or similar terms. This provision has proved to be highly controversial in that it does not expressly cater for temporary employees who harbour reasonable expectations of indefinite employment. An analysis is made of the most important cases relating to section 186(1)(b). The second section unpacks and critically analyses the Labour Relations Amendment Bill and the Basic Conditions of Employment Bill which have been long in the offing and when they are finally enacted, will bring with them sweeping changes for atypical employment . The amendments will drastically change the way employers make use of fixed-term employees as well as the way in which Temporary Employment Services may conduct business if they are in fact able to keep working at all. There is very little literature of substance written about the Labour Relations Amendment Bill as it applies to atypical employment. The fact that the proposed amendments have changed so many times over such a long period of time might have deterred many writers from investing time and effort in attempts to analyse and summarise the amendments. Articles posted on the internet are in the main short and have very little content. No books were found with any discussion that pertains to the amendments. The amendments divide employees involved in atypical employment into two different categories. These categories consist of employees earning above the threshold in terms of section 6(3) of the Basic Conditions of Employment Act and those earning below this threshold. All fixed-term employees may rely on the provisions of section 186 of the Labour Relations Act. Employees earning below the threshold are considered to be the most vulnerable and have been afforded additional protections in terms of sections 198(A), (B) and (C).

With oil reserves dwindling, efforts to create a diversified, post-oil economy in Oman have focused on building the human capital of citizens and promoting a new entrepreneurial ‘work culture’ among Omani employees and entrepreneurs. In a context in which state-provided jobs represent both an exchange of labor for a salary and a means of securing a citizen’s rightful share of the nation’s oil revenues, issues of productivity and workforce development are most often framed in terms of the ‘mindset’ of individual citizens. Drawing on 16 months of ethnographic fieldwork with experts and professionals in Oman’s thriving citizen labor industry—the industry of human resource specialists, consultants, career coaches, entrepreneurship trainers, and the organizations which support and sponsor them—this dissertation explores how utopian investments in Omani human capital have shaped the distributive governance of the Omani state, the production of persons, and the making of ‘an economy.’ In an environment in which economic ‘growth’ is driven by state-guided subsidy rather than market mechanisms, this dissertation describes how economic and managerial expertise is employed to create 'an economy’ in ways that are largely unaccompanied by the production of markets. By doing so, this dissertation highlights how seemingly neoliberal interventions aimed at ‘rolling back’ the state and cultivating entrepreneurial ‘mindsets’ have counterintuitively produced subjects who understand their personal and social ‘development’ as pieces of a larger system of distributive rights and obligations that is as much social and political as it is economic. Ultimately, by demonstrating how subsidy-driven investments in Oman’s citizen workforce reproduce distributive arrangements, this dissertation complicates the assumption that ‘development’ is an antidote to Oman’s natural resource dependence.

В работе дана оценка уровня преступности среди мигрантов в регионах Дальнего Востока России во втором десятилетии XXI века. Показано, что большинство преступлений на Дальнем Востоке совершают граждане из стран ближнего зарубежья, что объясняется преобладанием численности мигрантов данной категории над мигрантами из стран дальнего зарубежья. В зависимости от стран исхода мигрантов меняется структура преступности, а именно: граждане КНР, КНДР, Вьетнама в основном совершают преступления, связанные с нарушением экологического законодательства и в сфере экономической деятельности. Граждане СНГ чаще совершают преступления против жизни и здоровья, общественной безопасности и общественного порядка. Показатели преступности мигрантов в целом не влияют на меры региональной миграционной политики. Основная причина использования ограничений (запретов) на рынке труда в отношении мигрантов из стран СНГ — защита регионального рынка труда и предоставление рабочих мест для местного населения.

Latin American governments swiftly implemented income assistance programs to sustain families' livelihoods during COVID-19 stay-at-home orders. This paper analyzes the potential coverage and generosity of these measures and assesses the suitability of current safety nets to deal with unexpected negative income shocks in 10 Latin American countries. The expansion of pre-existing programs (most notably conditional cash transfers and non-contributory pensions) during the COVID-19 crisis was generally insufficient to compensate for the inability to work among the poorest segments of the population. When COVID-19 ad hoc programs are analyzed, the coverage and replacement rates of regular labor income among households in the first quintile of the country's labor income distribution increase substantially. Yet, these programs present substantial coverage challenges among families composed of fundamentally informal workers who are non-poor, but are at a high risk of poverty. These results highlight the limitations of the fragmented nature of social protection systems in the region.

This report synthesizes discussions from a scoping meeting for Redwood National and State Parks (referred to as the “parks” throughout this report) held in 2004 and a follow-up conference call in 2019. Two GRI–compiled GIS data sets of the geology and geohazards of the parks are the principal deliverables of the GRI. The GRI GIS data are available on the GRI publications website http://go.nps.gov/gripubs and through the NPS Integrated Resource Management Applications (IRMA) portal https://irma.nps.gov/App/Portal/Home. Enter “GRI” as the search text and select a park from the unit list. Writing of this report was based on those data and the interpretations of the source map authors (see “GRI Products” and “Acknowledgements”). A geologic map poster illustrates the geology GRI GIS data set and serves as a primary figure for this GRI report. No poster was prepared for the geohazards GRI GIS data set. Additionally, figure 7 of this report illustrates the locations of the major geologic features in the parks. Unlike the poster, which is divided into a northern and southern portion to show detail while accommodating the parks’ length, figure 7 is a single-page, simplified map. The features labeled on figure 7 are discussed in the “Geologic History, Features, and Processes” chapter. To provide a context of geologic time, this report includes a geologic time scale (see "Geologic History, Features, and Processes"). The parks’ geologic story encompasses 200 million years, starting in the Jurassic Period. Following geologic practice, the time scale is set up like a stratigraphic column, with the oldest units at the bottom and the youngest units at the top. Organized in this manner, the geologic time scale table shows the relative ages of the rock units that underlie the parks and the unconsolidated deposits that lie at the surface. Reading the “Geologic Event” column in the table, from bottom to top, will provide a chronologic order of the parks’ geologic history. The time scale includes only the map units within the parks that also appear on the geologic map poster; that is, map units of the geohazards data are not included. Geology is a complex science with many specialized terms. This report provides definitions of geologic terms at first mention, typically in parentheses following the term. Geologic units in the GRI GIS data are referenced in this report using map unit symbols; for example, map unit KJfrc stands for the Cretaceous (K) and Jurassic (J) Franciscan Complex (f), Redwood Creek schist (rc), which underlies a portion of the Redwood Creek watershed (see “GRI Products”).

This dataset constitutes a panel follow-up to the 2016/2017 Suriname Survey of Living Conditions. It measures welfare related variables before and after the onset of the COVID-19 pandemic including labor market outcomes, financial literacy, and food security. The survey was executed in August 2020. The Suriname COVID-19 Survey is a project of the Inter-American Development Bank (IDB). It collected data on critical socioeconomic topics in the context of the COVID-19 pandemic to support policymaking and help mitigate the crisis impacts on the populations welfare. The survey recontacted households interviewed in 2016/2017 by the Suriname Survey of Living Conditions (SSLC) and was conducted by phone due to the mobility restrictions and social distancing measures in place. It interviewed 1,016 households during August 2020 and gathered information about disease transmission, household finances, labor, income, remittances, spending, and social protection programs. Data and documentation of the 2016/2017 Suriname Survey of Living Conditions can be found at: https://publications.iadb.org/en/suriname-survey-living-conditions-2016-2017 The survey was designed and implemented by Sistemas Integrales. This publication describes the main methodological aspects, such as sample design, estimation procedures, topics covered by the questionnaire, field organization and quality control.
