This article delineates how a shift in the priorities of EU laws can change public procurement’s current centre of gravity from its fixation on the lowest price to that of a more balanced consideration of different societal goals. There is an acknowledgement that public money can meaningfully contribute to support for social justice and the fight against climate change and environmental degradation. To this end, the present EU legal framework, together with more advanced experiences in Italy and in a few other EU Member States, are illustrated before an analysis of the many initiatives currently under consideration by the EU law makers as per the European Green Deal and the Sustainable Products Initiative. The article then highlights the need to reconsider the theory of public procurement law and practice as well as the current EU legislative framework for public procurement (and concessions).

Treaty of Rome of 1957 and following treaties on amending the Treaty of Rome contain a number of basic principles on which the EU is founded. Among these principles, the most important ones related to the public procurement are: prevention of discrimination based on nationality, free movement of goods; right and freedom of establishment of a business; the right to provide services. Spending of public money in Kosovo pursuant to the Law on Procurement is found on the following principles: economization and efficiency; equal treatment and non-discrimination; transparency; value for money. The average of open procedure application in EU countries is 73% based on notices, whereas in Kosovo is 82.80% based on notices. In the end of 2014, Kosovo commenced the development of electronic procurement platform. This project takes place within the Public Sector Modernization Project. The importance of the electronic procurement is stated in the statement of European Commission: “Modernization and opening of procurement markets across borders – including through the electronic procurement expansion – are crucial for the competition in Europe and creating new opportunities for businesses in EU”. A good procurement system in Kosovo will have an impact on elimination of negative phenomena (corruption and bad management) in the management of public expenditures from spending agencies, as well as an impact on increase of budget saving. The article explores the experience of a number of EU countries. It is revealed that in the EU countries there is growing interest in using public procurement policies for food security by promoting the development of farms, small farmers entering the national market, increasing their incomes, developing rural areas, improving quality nutrition. The main directions of transformation of public procurement policies in the agri-food sector are green public procurements (GPP), aimed at solving environmental problems, and sustainable public procurements (SPP). At the same time, inclusion of quality criteria in the public procurement system and access to the market public procurement of small agricultural producers requires solving a number of problems, including increasing the professionalism of state buyers, introducing innovative methods in boards using modern technology. In addition, the multisectoral nature of these initiatives requires coordinated action between different sectors of the economy at all levels. The conclusion is drawn on the need to transform the Russian government procurement policy in accordance with the target guidelines of economic policy in modern conditions.

The aim of the article is to study the policy of public procurement and the scientific substantiation of its priorities in the context of the implementation of the digital transformation strategy in the EU and in Ukraine. The research methodology is based on the content analysis of the digitalization policy of public procurement used in the practice of both the EU and Ukraine, as well as in its scientific generalization to substantiate the priorities for the implementation of the digital transformation strategy. The authors examined the model of interaction of subjects of the public procurement market in the EU with the use of digital tools. It is found that the harmonized EU rules in the field of application of common digital public procurement instruments are designed to ensure fairness, transparency and non-discrimination in determining participants in public contracts, to which not only EU companies are admitted, but also the representatives of WTO Member States that have signed the Agreement on Government Procurement. The article discloses the stages of introduction of digital public procurement tools in the EU and in Ukraine. It is determined that in the EU, the process of digitalization of public procurement began in the second half of the 2000s with the introduction of an electronic diary of tenders, significantly intensifying in the second half of the 2010s with the adoption of a package of the EU directives in the field of public procurement and the phased introduction of digital tools (invoices, forms, applications for tenders, the European single procurement document, etc.). The current stage of transformation of digital public procurement tools in the EU was marked by the introduction of a single space for these public procurement in the EU from 2023. The priority directions of digital convergence of the public procurement systems of the EU and Ukraine are substantiated, including the development of cooperation tools for joint public procurement, promotion of competition, countering the corruption, as well as strengthening the professionalization of the public procurement systems.

Purpose The purpose of this paper is to explore and explain public preferences for different public procurement practices. The paper looks into public support for cost-effectiveness, discriminatory procurement in favour of domestic suppliers and sustainable procurement. Design/methodology/approach This study uses Eurobarometer public opinion data on 26.836 EU citizens from 27 EU countries. Findings This paper shows that EU citizens want public authorities to evaluate multiple aspects of any procurement offer in their public procurement decisions. It also found that, although cost-effectiveness and domestic favouritism are still important to EU citizens, citizens are most supportive of the objectives of sustainable procurement. Some associations between citizens’ procurement preferences and their social characteristics and political attitudes were found, but these only explain citizen procurement preferences to a limited extent. Country of residence has the strongest association with citizens’ acceptance of the objectives of sustainable procurement. Research limitations/implications Even though the data contain information on the procurement preferences of a large number of EU citizens, it is a topic of inquiry that is sensitive to social desirability bias. Originality/value This paper contributes to the empirical understanding of public attitudes towards public procurement. It is one of few studies on citizen attitudes towards different public procurement practices.

Public procurements are accounted for nearly one fifth of Gross Domestic Product in the European Union. Accordingly, the efficiency of public procurements has received immense attention of scholars and practitioners in the last few decades, particularly in the field of measuring a cross-country efficiency among the EU Member States. Nevertheless, the extant matrix is based solely on the outputs, thus capturing only a portion of determinants affecting the efficiency. Up to date, very little has been done in comparing the input-output efficiency. This paper aims to develop a set of input and output determinants of public procurement efficiency and compare the efficiency of public procurements of EU Member States. The results indicate that the efficiency based on input-output analysis significantly differs from any current analysis of procurement efficiency.

From 2018, it became mandatory to obtain the Icelandic Equal Pay Standard (ÍST85) for all companies with 25+ employees annually operating on the Icelandic market. It has been unclear to what extent – if any – the ÍST85 can be applied in public procurements. This article analyses whether the ÍST85 is compliant with the relevant European Union internal market law, particularly public procurement law. The growing intensity of nudges to include and verify social elements in public procurements can be observed throughout the EU. The analysis of the Islandic case study bears relevance as it can be applied to the EU Member States and other EEA/EFTA States, contemplating similar approaches in their procurements. Section 1 introduces ÍST85. Section 2 analyses the relationship between EEA and EU law, showcasing that this article's analytical outcomes provide lessons applicable beyond Iceland. Section 3 examines how equal pay is regulated under EU law. Section 4 conducts an internal market analysis of ÍST85 compliance by examining the Treaties provisions on free movement. Section 5 introduces the EU public procurement law and examines ÍST85 compliance with Directive 2014/24/EU. Section 6 tests the application of ÍST85 to the Posted Workers Directive. Section 7 concludes the article.

This thesis attempts to prove how the flexible application of public procurement has the potential to realise a social model of integration in the European Union wherein the European citizen is the key actor in the integration process. The integration dynamics of the European Union have been promoted by recourse to neoliberal economic theories where market integration features as a crucial imperative. In this respect the regulation of public procurement plays a vital role in the programme of the Single European Market. Preferential procurement alongside state aid reflects on market intervention on the part of the public sector commensurate with neo-liberal principles and less on the distributive objectives of societal welfare. However, this thesis presents a fundamental departure from such logic for it argues on the basis of a social just alternative that takes into account the distributive objectives of societal welfare albeit in a limited manner in so far public procurement contracts are concerned. The question of poverty across the EU is put into context as its persistent levels are perceived as indicative system-failures of market regulation that are too heavily based on neo-liberal economics. On a plane of practical reasonableness the thesis argues for optimal use of public procurement as a dynamic policy instrument by institutionalising a balance both domestically and EU-wide. Such balance needs to be guided by a public interest function where the key umbrella concept that corresponds to embracing the fight against poverty namely, respect for human dignity, equality and freedom for participatory action is incorporated. As a powerful socio-economic lever public procurement should not be regarded as a barrier to EU economic growth but as a crucial safety valve at the disposal of Member States for the benefit of the EU citizen and not in the least EU integration aims.

This PhD thesis looks at one of the most crucial determinants of state formation, quality of institutions, and social equality: institutionalised grand corruption. Institutionalised grand corruption denotes the particularistic allocation of public resources, that is violating prior explicit rules in order to benefit a closed network while denying access to all others. Emphasizing access to power and public resources deviates from traditional definitions of corruption resting on individual wrongdoing and abuse of power. The thesis makes use of large amounts of administrative data describing public procurement tenders on transaction level and links it to data on company ownership, financial accounts, and political office of company owners. By using data mining techniques it breaks away from standard, and arguably deficient, measures of quality of institutions and corruption. It proposes a complex ‘blueprint’ for measuring institutionalized grand corruption in the allocation of public resources and applies its key elements to three Central and Eastern European countries: Czech Republic, Hungary, and Slovakia. It is emphasized that these cases are only ‘pilot’ measurements, the blueprint is applicable to practically every high and middle income country, data is typically going back in time for 6-8 years. Using such a novel indicator set allows for an unprecedented detail of analysis. Results highlight the role played by European Union Structural and Cohesion Funds in increasing the prevalence of institutionalised grand corruption. This is due to at least two factors, first, they provide additional public resources available for corrupt rent extraction; second, they change the motivations for and controls of corruption. In Czech Republic, Hungary, and Slovakia, the first effect increases the value of particularistic resource allocation by up to 1.21% of GDP, while the second effect decreases it by up to 0.03% of GDP. The latter effect is entirely driven by Slovakia; in Czech Republic and Hungary even this effect increases particularism.

When choosing and applying the award criteria in the context of public procurement procedures, contracting authorities exercise their discretionary powers with a view to selecting the most economically advantageous tender. The importance of the use that contracting authorities make of their margin of discretion is directly related to the result of any public procurement procedure: the level of satisfaction of the contracting authorities’ needs provided by the works/supply/service contract concluded with the winning tenderer. Despite the tendency for public procurement regulation to focus on procedural rules (‘how to buy’), rather than the actual outcome of the procurement activity itself (‘what to buy’), there are substantive requirements derived from legislative sources, as well as soft law and jurisprudence, that somehow structure the contracting authorities’ decision making freedom. Although there is no standard unit that allows for the measurement of contracting authorities’ margin of discretion and its variation, this thesis aims to identify factors which contribute either to increase or to reduce the said margin. In other words, it is proposed to highlight the elements which determine the expansion or the limitation of the referred discretionary powers. The thesis concludes that despite the different national regulatory approaches to this topic under the common EU legal framework, the practice in the Member States covered by this thesis seems to indicate that contracting authorities exercise their discretionary powers in a (unknowingly) similar way.

This paper is dealing with Public Private Partnership (PPP) as the alternative to the classical public procurement. It describes and compares advantages and disadvantages of this approach and explore legislative and institutional setting in chosen countries of EU to comparison. The main focus of the work concerns the comparison of the development of this concept and its current state of use in those countries. The emphasis was on finding a correlation between the number and volume of PPP projects and the state of national economies in the years 2006-2015, especially in the immediate period of the recent financial crisis, when could be expected increased attractiveness of the concept for political representation. On the specific case is explored its economic efficiency and legitimacy.

Since 1993, the European Union has dramatically increased the scope and volume of its procurement regulation; particular increases have been made in terms of the procurement procedures made available, and the obligations that national contracting authorities have in light of EU law. This thesis examines the influence that recent developments in EU public procurement law have had on national procurement regulation in the UK, the Netherlands, and France. To assess this influence, three 'case study' areas were selected for investigation: the new procurement procedure 'competitive dialogue', made available for the procurement of complex contracts; the ability to repeat purchase using 'framework agreements', recently made available for purchasing in non-utilities sectors; and the Court of Justice's use of 'general principles of equal treatment and transparency', which has created new obligations for national contracting authorities. The thesis found that, in the areas examined, the influence of EU secondary legislation is substantial and-in two of the three countries examined-also plays a visible role in national regulation where EU law is not mandatory. The Court of Justice jurisprudence evaluated has had its most significant impact on the national judiciary: courts were found to reinforce the Court's judgments in all countries. Soft law issued by the European Commission had little perceivable influence on the formal legal regulation of the Member States examined, but may have influenced approaches taken to guidance or legislation more generally. The thesis also observed that harmonization of national laws, despite not being an objective of the EU rules, has increased in recent years-but even now, national differences (usually reflective of historical approaches taken to procurement regulation) are visible in those areas where the EU rules are optional, rather than mandatory.

Moteur incontournable de l’économie publique, les marchés publics ont toujours fait l’objet de revendications diverses, voire opposées. L’efficacité de la gestion budgétaire et la transparence de la vie publique, s’agissant des ordres juridiques nationaux, la libre concurrence et le libre accès de tous les opérateurs économiques facilitant les échanges intracommunautaires, s’agissant du droit européen : tous ont tenté de monopoliser le droit de la commande publique, afin de se réaliser. Dans le même temps, la perspective de l’instrumentalisation de ce droit au service d’objectifs politiques qui ne lui sont pas directement attribués a suscité des intérêts très variés. Or, la question de la conciliation des politiques sociales et environnementales avec les prescriptions de nature principalement économique du droit des marchés publics s’inscrit dans une logique de valorisation de cet instrument juridique et financier. Ces politiques, répondant à la fois à des finalités d’intérêt général et à des objectifs prioritaires du droit communautaire, sont à la recherche de leur rôle et de leurs instruments en matière de marchés publics. Dans un contexte politique mouvant, la superposition des systèmes juridiques résultant des interventions réglementaires des États, en quête de leur pouvoir discrétionnaire dans la planification des leurs politiques, comme des interventions du droit communautaire dans le cadre de sa propre œuvre d’harmonisation des procédures de passation, vient redéfinir le rôle des politiques sociales et environnementales, tant au sein des objectifs endogènes du droit des marchés publics qu’en dehors de son cadre réglementaire, appelé dans ce cas à servir de levier
As a fundamental driving force of public economy, public procurement has traditionally been an area of diverse and often competing interests. Such contradictory interests are the efficiency of budgetary management and transparency in public life within national legal systems, free competition and open access of financial stakeholders in award procedures within the European regulatory framework. At the same time, the instrumentalisation of public procurement in order to serve political goals not directly linked to it has triggered considerable debate. The attempt of conciliation of social and environmental considerations with the financial requirements of public procurement law aims at enhancing this legal and financial instrument. The role and the legal means for the integration of social and environmental considerations in public procurement, which serve general interest purposes and overriding European law objectives, have not yet been clarified. The regulatory interventions of the Member States, on the one hand, and the harmonization attempts of the European Union, on the other, create a constantly changing political climate. In that context, the role of social and environmental policies is redefined both within the framework of primary objectives of public procurement law, as well as outside this regulatory framework which is used as a policy tool in this context

A question asked by many contracting authorities when assessing bids submitted by tenderers, whose reliability might be compromised by their previous misbehaviour or even worst – a criminal offence. According to law, contracting authorities can exclude such tenderers. However, at the same time, tenderers should be allowed to adopt compliance measures aimed at remedying the consequences of their action. In this article the author analyses some aspects of discretional exclusion of tenderers with doubted reliability in the public procurement process according to the 2014 European Union´s Public Procurement Directive and the recent case law of the Court of Justice of the European Union.

The principle of good administration is not mentioned amongst the public procurement principles in Directive 2014/24/EU, however, it is applicable to the public procurement field as a general principle of law. In this article, the author analyses the understanding of this versatile principle in public procurement practice in Latvia. The author concludes that the references are quite rare, but there are several aspects, concerning which the principle of good administration is used more often, i.e., in cases of information exchange and tender clarification, if the tender is rejected. Therefore, the protection of the rights of individuals in cases that are not clearly regulated could be seen as an important aspect where the principle of good administration is used.

The purpose of this paper is to present the White Paper on levelling the playing field as regards foreign subsidies, from the public procurement perspective. This is the first time that the problem of foreign subsidies within public procurement is approached by European Commission and it is useful to analyse Commission’s findings on that regard. Due to the problems caused by COVID-19 pandemic and the forthcoming Next Generation EU initiative, the Commission is determined to develop and implement suitable legal instruments for dealing with distortions in the Internal Market, caused by foreign subsidies. Legal analysis within the paper is focused on the proposed Module 3 under the White Paper, trying to detect possible practical repercussions of implementing measures as are proposed in the White Paper. In addition, the paper seeks to identify primary function of the measures proposed and tries to examine if that function could result in protectionist effects.

The COVID-19 pandemic caused disaster in every area of life, public procurement notwithstanding. This article considers the problem of possible misuse of COVID-19 pandemic as a cover to justify uncompetitive tendering of public contracts. It contains the analysis of general conditions set by the EU law and also by national legislation, which must be met while using the method of direct awarding of contracts by contracting authorities, as well as specific conditions clarified by the European Commission in its 2020 Guidance for emergency situation procurement related to COVID-19. It also deals with the Slovak law applicable in this area, and the real practice of Slovak contracting authorities. In this regard, a quantitative analysis was realised to answer the question, whether Slovakia complies with the Union’s rules in both levels – legislative, as well as in practical.

Implementation of Electronic invoicing via the Electronic invoicing information system is one of the first steps in the digitization of business. The process of accepting electronic invoicing in the European Union is based on Directive 2014/55/EU which has the goal of decreasing the barriers to crossborder procurement activities, ensuring an interoperable standard/norm for electronic invoicing in public procurement within the boundaries of European Union, and ensuring more straightforward and business-to-business transactions. The transition to this form of invoicing should save a significant part of the costs related to invoicing and significantly speed up and simplify the whole process. Despite the fact that this is a technology that is many years old, state institutions in the Slovak Republic are just beginning to work with this technology. The state's approach also has an impact on the willingness and motivation of private companies to implement it. Different lawful and technical prerequisites of electronic invoices create barriers to access the free market in cross-border public procurement and barriers to trade as they deter economic operators from engaging in cross-border public procurement activities. The aim of the article is to point out the requirements and technical standards, advantages, and disadvantages of the implementation of electronic invoicing information system accent with an emphasis on the current situation in the Slovak Republic. Due to the fulfillment of the main aim, analysis, synthesis, comparison, induction and deduction are used in the article.

The transition to a contractual relationship between government and Infrastructure Manager under Directive 2012/34 /EU requires the possession of contract management skills and the development of key performance indicators (KPIs). Previous activities related to the Multi Annual Infrastructure Contract (MAIC) have been exclusively in the field of the Annual Infrastructure Maintenance Program implementation (railway maintenance, public procurement, and supervision of civil works implementation). However, under Directive 2012/34/EU it is necessary to introduce a system of performance indicators for upgrading/modernize infrastructure to obtain value for money. The paper presents a systematic approach in determining the KPIs and their merits on the example of a contract between the Government of Montenegro and the Railway Infrastructure manager of Montenegro (ŽICG JSC) with the aim to improve the operation and quality of services of ŽICG JSC and the condition of railway infrastructure in Montenegro as well. In the present article we aim to analyze the fact that the quality of public administration and governance of a country is essential for its economic performance, and also for the well-being of the citizens of that country. Effective public administrations are at the service of citizens and businesses. It is essential that public authorities can adapt to changing circumstances. The European Commission helps EU Member States undertake reforms in public administration and governance by providing technical support. Areas of intervention include central public administration, local public administration, egovernment, public procurement, better regulation, the judiciary, the fight against corruption and fraud, and better absorption of European structural and investment funds. A key element of the technical support provided by the European Commission is aimed at improving the performance of public administration. An effective, flexible, and efficient administration is a prerequisite for the good management of a country, as well as a determining factor of economic growth. A functioning public administration provides a robust platform for business development and provides quality services to citizens and professionals. And this, in turn, attracts investment, being also an essential tool for structuring the government's activities and transforming political orientations into reality.

With the growing demand for sustainable accountability, the European Directive 2014/24/EU (EU 2014) pushes architects to deliver Building Information Models (BIM) as a part of procurement processes for public buildings. In the Netherlands, BIM model data is relevant to the building permitting process, which involves an environmental performance calculation (MPG). This assessment takes into consideration the embodied carbon of materials in a building. Although this analysis is performed by a qualified expert in late design phases, architects benefit from integrating carbon data in early de- sign decision-making. Design methods supported by Life Cycle Assessment (LCA) values are needed before involving expert collaborators, and not only when applying for a building permit.The existing carbon assessment tools require detailed data from BIM models, which are often not available at early de- sign phases. Simplified tools have been discussed in theory, and explored in their potential applications, however, there lacks scientific literature discussing the hurdles designers face in their attempt to create such tools in practice, for their in- ternal use throughout early design phases.This paper focuses on the architecture professional practice and design methods supported by digital and computational technologies, regarding embodied carbon data. It investigates the challenges in integrating embodied carbon data in the design workflow, through the development of a digital tool made by designers, for designers. This paper conducts an empirical investigation within a Rotterdam-based architecture office, with a broad portfolio in BIM usage and public building projects, to identify and categorize the factors affecting carbon data integration into the design workflow. It proposes a taxonomy of challenges within the architecture office, to better communicate the designer’s needs to the data providers and software developers with architects as a target user. Amongst the bottlenecks encountered are: access to data inclusiveness), data literacy and connecting data usage with design decision-making.

Public procurement of goods and services contributes to about 15% of global greenhouse gas emissions. In the EU, public purchasing represents 15% of its GDP, acting as a major influencer on the market through the products and services acquired by governments from the local to national levels. The public sector has a role to play in leveraging this purchasing power to achieve the best societal value for money, particularly as we scramble to bend the curve of our planet’s warming. Globally, the construction and transport sectors each represent about 12% of government procurements’ GHG emissions. Furthermore, these sectors’ decarbonization efforts demand profound and disruptive technological shifts. Hence, prioritizing these sectors can make the greatest impact towards reducing the environmental footprint of the public sector and support faster decarbonization of key emitting industries. Meanwhile, the EU committed to achieving 55% reduction in GHG emissions by 2030 compared to 1990 levels. Drastic emissions reductions are needed at an unprecedented speed and scale to achieve this goal. Green Public Procurement (GPP) is the practice of purchasing goods and services using environmental requirements, with the aim of cutting carbon emissions and mitigating environmental harm throughout the life cycle of the product or service. While the EU and many of its Member States alike have recognized GPP as an important tool to meet climate goals, the formalization of GPP requirements at the EU level or among local and national governments has been fragmented. We call for harmonization to achieve the consistency, scale and focus required to make GPP practices a powerful decarbonization tool. We surveyed the landscape of GPP in the EU, with a focus on construction and road transport. Through interviews and policy research, we compiled case studies of eight Member States with different profiles: Sweden, the Netherlands, France, Germany, Estonia, Poland, Spain and Italy. We used this information to identify solutions and best practices, and to set forth recommendations on how the EU and its countries can harmonize and strengthen their GPP policies on the path toward cutting their contributions to climate change. What we found was a scattered approach to GPP across the board, with few binding requirements, little oversight and scant connective tissue from national to local practices or across different Member States, making it difficult to evaluate progress or compare practices. Interviewees, including policy makers, procurement experts and procurement officers from the featured Member States, highlighted the lack of time or resources to adopt progressive GPP practices, with no real incentive to pursue it. Furthermore, we found a need for more awareness and clear guidance on how to leverage GPP for impactful societal outcomes. Doing so requires better harmonized processes, data, and ways to track the impact and progress achieved. That is not to say it is entirely neglected. Most Member States studied highlight GPP in various national plans and have set targets accordingly. Countries, regions, and cities such as the Netherlands, Catalonia and Berlin serve as beacons of GPP with robust goals and higher ambition. They lead the way in showing how GPP can help mitigate climate change. For example, the Netherlands is one of the few countries that monitors the effects of GPP, and showed that public procurement for eight product groups in 2015 and 2016 led to at least 4.9 metric tons of avoided GHG emissions. Similarly, a monitoring report from 2017 showed that the State of Berlin managed to cut its GHG emissions by 47% through GPP in 15 product groups. Spain’s Catalonia region set a goal of 50% of procurements using GPP by 2025, an all-electric in public vehicle fleet and 100% renewable energy powering public buildings by 2030. Drawing from these findings, we developed recommendations on how to bolster GPP and scale it to its full potential. In governance, policies, monitoring, implementation and uptake, some common themes exist. The need for: • Better-coordinated policies • Common metrics for measuring progress and evaluating tenders • Increased resources such as time, funding and support mechanisms • Greater collaboration and knowledge exchange among procurers and businesses • Clearer incentives, binding requirements and enforcement mechanisms, covering operational and embedded emissions With a concerted and unified movement toward GPP, the EU and its Member States can send strong market signals to the companies that depend on them for business, accelerating the decarbonization process that our planet requires.

Government spending on public works, goods and services in the European Union (EU) accounts for about 14% of the EU’s GDP. Consequently, the EU and its Member States (MS) can make a great impact in accelerating the development and uptake of low-carbon technologies through green public procurement (GPP). This brief is part of a wider project financed by Breakthrough Energy, aiming to understand the divergences in GPP uptake in different EU MS and to identify key barriers to greater adoption and opportunities ahead. Ultimately, the project aims to contribute to greater policy coherence among member states to reduce greenhouse gas (GHG) emissions, as well as to increase policy support for the design of GPP implementation frameworks and for harmonized GPP target-setting. In 2020, the road transport sector accounted for 23% and 20% of total Estonian and Polish GHG emissions, respectively, while the construction sector represented about 5% and 9% of Estonian and Polish total GHG emissions, respectively. These numbers point to the large mitigation potential that procuring authorities can support by including environmental criteria in procurements. In this brief, we share the results from our desktop research and stakeholder interviews for Estonia and Poland. Results from all cases and additional research will be published in a report later in 2022.

Public procurement accounts for a significant proportion of overall demand for goods and services. Thus, it could be a useful tool for fostering innovation and economic growth. While interest in the use of public procurement as industrial policy is not new, its potential to spur demand for innovative products and services, create incentives for business innovation, and accelerate the diffusion of new technologies has received much policy attention in recent years. The aim of this study is to advance knowledge on the role of public procurement as a demand-side policy instrument in stimulating firm innovation in Latin American and Caribbean (LAC) countries. In LAC countries, public procurement systems account for 20 percent of GDP, which suggests a considerable untapped potential to use public procurement for innovation (PPI) to strengthen their economic position and improve public service provision. The report first reviews the evidence on the implementation and impact of instruments and structures introduced to support PPI in selected developed countries (the United States, the European Union, Estonia, Netherlands, Spain, the United Kingdom, China, and the supranational case of EU procurement policy), identifying useful policy lessons for LAC countries. It then focuses on emerging innovation friendly procurement practices introduced in three selected LAC countries: Brazil, Chile, and Colombia. These countries offer a diverse picture in terms of the institutional path they have followed for the development of public policy for innovation/pre-commercial procurement (PPI-PCP) policies as well as important differences in the level of development of their innovation systems.

Consequently, the EU and its Member States can make a great impact in accelerating the development and uptake of low-carbon technologies through green public procurement (GPP). This brief is part of a wider project financed by Breakthrough Energy, aiming to understand the divergences in GPP uptake in different EU Member States and to identify key barriers to greater adoption and opportunities ahead. Ultimately, the project’s goal is to contribute to greater policy coherence among member states to reduce greenhouse gas (GHG) emissions, as well as to increase policy support for the design of GPP implementation frameworks and for harmonized GPP target-setting. We focus on the construction and road transport sector because of their high share of GHG emissions (respectively about 25% and 21% of EU’s total carbon dioxide [CO2] emissions), and hence the large mitigation potential that procuring authorities can support by including sustainability criteria in procurements. In this brief, we share results from our research and stakeholder interviews for Sweden and the Netherlands. Results from all cases and additional research will be published in a report later in 2022.
