This study aims to analyze the philanthropic fund allocation strategy implemented by the Aksi Cepat Tanggap with the Masyarakat Relawan Indonesia (ACT-MRI) of Parepare. The approach in this research is a qualitative approach with a case study research design. The results showed that philanthropic funds collected by MRI of Parepare City would be distributed into four main programs, intense programs, compensation for the poor of the MSR system (Mobile System Resecue), assistance in the goods to money transformation and Direct Delivery of aid funds to recipients. The distribution adapted diversivication strategy. This research is expected to be a reference to the management and volunteers to improve cooperation with the government and educational institutions. Cooperation with the government is needed so that the intense program and MSR can run more optimally without overlapping interests. Educational institutions can make a contribution in the form of volunteers so that human resources can be guaranteed

This study examined the availability and staffing of acute psychiatry beds in NSW and ACT. “Gazetted” acute psychiatry hospitals (which take compulsory admissions under mental health law) were polled directly for bed numbers, occupancy and staffing for the year 1990–1991. The NSW Department of Health provided beds numbers for non-gazetted and private hospitals. Four analyses sequentially reallocated beds according to the origin of patients to estimate acute bed availability and use by regional populations. Socio-demographic determinants of acute admission rates were measured. Acute “gazetted” beds averaged 13.2 per 100,000 population but ranged from 6.9 to 49.1 per 100,000 when cross-regional flows were considered. “Non-gazetted” beds raised the provision to 15.5 per 100,000 and private beds raised provision further to 24.5 per 100,000. Inner metropolitan provision was higher than rural or provincial provision. The only determinant of the admission rate to gazetted beds was the number of available beds. Bed availability did not affect either bed occupancy or referral of patients to remote hospitals. Nursing staffing of gazetted units was reasonably uniform, although smaller units had significantly more nurses per bed. Medical staffing was highly variable and appears determined by staff availability. The average provision of acute psychiatric beds approximates lowest levels seen in international models for psychiatric services. Average occupancy rates suggest that there is not an overall shortfall of acute psychiatric beds, but uneven bed distribution creates barriers to access. Referral of patients to remote hospitals is not related to actual bed provision in the regions, but appears to reflect attitudes to ensuring local care. Recommendations about current de facto standards are made. Current average nursing and medical staffing standards are reported.

We present multi-wavelength detections of nine candidate gravitationally lensed dusty starforming galaxies (DSFGs) selected at 218 GHz (1.4 mm) from the Atacama Cosmology Telescope (ACT) equatorial survey. Among the brightest ACT sources, these represent the subset of the total ACT sample lying in Herschel SPIRE fields, and all nine of the 218 GHz detections were found to have bright Herschel counterparts. By fitting their spectral energy distributions (SEDs) with a modified blackbody model with power-law temperature distribution, we find the sample has a median redshift of z = 4.1(-1.0)(+1.1) (68 per cent confidence interval), as expected for 218 GHz selection, and an apparent total infrared luminosity of log10(mu LIR/L-circle dot) = 13.86(-0.30)(+0.33), which suggests that they are either strongly lensed sources or unresolved collections of unlensed DSFGs. The effective apparent diameter of the sample is root mu d = 4.2(-1.0)(+1.7) kpc, further evidence of strong lensing or multiplicity, since the typical diameter of DSFGs is 1.0-2.5 kpc. We emphasize that the effective apparent diameter derives from SED modelling without the assumption of optically thin dust (as opposed to image morphology). We find that the sources have substantial optical depth (tau = 4.2(-1.9)(+3.7)) to dust around the peak in the modified blackbody spectrum (lambda(obs) <= 500 mu m), a result that is robust to model choice.

The South African government has paid compensation in a form of special pension to individuals who have been exposed to certain types of hardship and suffering caused by the governments or their predecessors. This compensation is described as ‘the appreciation or sense of guilty of society towards those people on whom the government has rightfully or wrongfully and at any rate disproportionally inflicted damage’. Government have been prepared to pay compensation to the following persons: former enemies, victims of war, victims of harmful compulsory vaccination measures, persons who had sacrificed their jobs and education in the process of overturning oppressive governments establishing democratic government; and persons whose basic human rights had been violated by governments or their predecessors. These persons have sacrificed their lives either in exile or within South Africa fighting for South Africa to be democratic. These persons must prove that they served their respective political organisations for a period of five years or above or they were banished or restricted in certain area or imprisoned or sentenced.

Humans are modifying the global landscape at an unprecedented scale and pace. As a result, species are declining and going extinct at an alarming rate. Here, I investigate two main aspects of species’ declines: what factors are contributing to their declines and how effective our conservation efforts have been. I assessed one of the main mechanisms for protecting species by looking at the Endangered Species Act (ESA) in the United States. I examined three separate indicators of species declines for different groups of species: range contractions in Canadian imperilled species, declines in abundance in global amphibian populations and increases in temporal variability in abundance in North American breeding birds. I found that change in recovery status of ESA listed species was only very weakly related to the number of years listed, number of years with a recovery plan, and funding. These tools combined explained very little of the variation in recovery status among species. Either these tools are not very effective in promoting species’ recovery, or species recovery data are so poor that it is impossible to tell whether the tools are effective or not. I examined patterns of species’ declines in three different groups in relation to a number of anthropogenic variables. I found high losses of Canadian imperiled bird, mammal, amphibian and reptile species in regions with high proportions of agricultural land cover. However, losses of imperiled species are significantly more strongly related to the proportion of the region treated with agricultural pesticides. This is consistent with the hypothesis that agricultural pesticide use, or something strongly collinear with it (perhaps intensive agriculture more generally), has contributed significantly to the decline of imperiled species in Canada. Global increases in UV radiation do not appear to be a major cause of amphibian population declines. At individual sites, temporal changes in amphibian abundance are not predictably related to changes in UV intensity. Variability in species’ abundance of North American breeding birds, after accounting for mean abundance, is not systematically higher in areas of high human-dominated land cover or climate change. Rather, it appears that areas with a high proportion of human-dominated cover come to have a higher proportion of highly abundant, and thus more variable, species.

In 1976, the legislature introduced a far-reaching amendment to the Pension Funds Act. The amendment was the insertion of s37C into the Act. Section 37C effected a fundamental change to the law of succession and the principle of freedom of testation. It did so by removing what, for many, is their most valuable property, from the reach of the law of succession or any other law and subjecting it to a sui generis statutory regime. Under this regime, the power to control the devolution of death benefits has been transferred from the individual who ‘owns' the benefit to the trustees of the pension fund. Trustees are, in turn, permitted to delegate their power. The result is that a stranger or a group of strangers have the power to select the beneficiaries of the deceased's principal asset from amongst the deceased's dependants, as defined, and any additional non-dependent nominated beneficiaries, with far-reaching and possibly life-changing consequences for those affected by the decision. The trustees are even permitted to make decisions that are contrary to, and arguably less equitable than, those of the individual, and yet their right to do so is recognised in law. Section 37C has been in existence for 40 years; its import, and impact, has increased significantly over the course of the past 20 years – yet most of those affected remain unaware of its existence. The study demonstrates that in its present form, s37C is both unconstitutional in its design and inequitable in its operation. As such, it is in urgent need of reform.

Метою роботи є дослідження і аналіз ядерного оцінювання щільності імовірності акустичних сигналів. У роботі приведені основні відомості з теорії імовірності про випадкові величини та їх імовірнісні характеристики. Щільність імовірності дозволяє вирішувати задачі вимірювання випадкових процесів, здійснювати класифікацію сигналів, досліджувати функціональні перетворення та ін. Під час виконання було проведено ядерне оцінювання щільності імовірності згенерованих акустичних сигналів, використовуючи такі закони розподілу: нормальний закон розподілу, закон розподілу Стьюдента, закон розподілу Лапласа. Порівняв результати теоретичних розрахунків з експериментальними, отримані наступні результати:експериментальні значення максимально наближаються до теоретичних зі збільшенням об’єму вибірок.
Метою роботи є дослідження і аналіз ядерного оцінювання щільності імовірності акустичних сигналів. Syftet med denna uppsatts är att utreda hur befintliga servitut påverkas vid fastighetsbildning– vad som gäller enligt svenskt regelverk och hur det tillämpas praktiskt. Fastighetsbildning innebär förändring av fastigheter, genom antingen nybildning eller ombildning. Ett servitut är en begränsad rättighet som är belägen på en fastighet, som belastas av rättigheten, och som får nyttjas av en annan fastighet, som har förmån av rättigheten. I samband med fastighetsbildning kan befintliga servitut komma att påverkas på olika sätt. De metoder som använts är: (1) en litteraturgranskning där den svenska lagstiftningen studeras; (2) en fallstudie där utförda förrättningar studerats om huruvida befintliga servitut påverkats vid fastighetsbildning och (3) en intervjustudie med yrkesverksamma förrättningslantmätare som arbetar på Lantmäteriet. Undersökt litteratur visar att Jordabalken och Fastighetsbildningslagen reglerar hur befintliga servitut påverkas vid fastighetsbildning. Utredningen visar att olika typer av servitut påverkas på olika sätt, och att olika lagrum tillämpas för olika typer av fastighetsbildningsåtgärder. Resultaten från litteraturstudien presenteras i en sammanställning som kallas Lagrumsguide för hantering av befintliga servitut vid fastighetsbildning. Fallstudien uppvisar att följderna för verkan på servitut vid fastighetsbildning grundas på lagstiftningen, men det är ovanligt att laghänvisningar anges i förrättningsakterna. I intervjustudien framkommer att Lantmäteriet har egna riktlinjer för hantering av servitut, men att riktlinjerna inte direkt visar vilka lagrum som hanteringen grundar sig på. Studien uppvisar att den praktiska hanteringen av befintliga servitut vid fastighetsbildning fungerar väl inom Lantmäteriet, med undantag för att det råder tolkningssvårigheter av vissa begrepp. Lagrumsguiden som skapades kan ses som ett komplement för att underlätta arbetet för många yrkesverksamma förrättningslantmätare och vara behjälplig i utbildningssyfte, eftersom lantmätarna inte alltid är säkra på vilka lagrum som faktiskt tillämpas.
The purpose of this thesis is to investigate how existing easements are affected when a property is reforming, according to Swedish real estate law and how the easements actually are dealt with in practice. Property formation implies modification of property, either as creation of new property units or the change of already existing properties. An easement is a limited property right, located on a property which serves another property with an advantageous right to utilize this located area in a specific way. In connection with property formation, existing easements can be affected in different ways. The methods used are: (1) a literature study of the Swedish Real Estate Law with connected literature; (2) a case study of authority documents, in which affections of existing easements within property formation are studied; and (3) an interview study in which interviews are performed with land surveyors from the Swedish Ordnance Survey (Lantmäteriet).  The results from the literature review show that different forms of easements can be affected diversely according to the Swedish Land Code (Jordabalken) and the Real Property Formation Act (Fastighetsbildningslagen), and different sections of the law are relevant for different kinds of property formation. The results from the literature study have been summarized in a quick reference guide, called Guide to sections of law for handling of existing easements within real property formation. The case study shows that the effects of the easements within property formation are grounded in the legislation, but it is unusual with references to sections of the law in the authority documents. The interview study shows that Lantmäteritet has its own guidelines for handling of the easements, but it does not show which sections of law the handling is based on. This study shows that most of the practical handling of existing easements when property is reformed is well-operated within Lantmäteriet, with the exception of some translation confusions regarding certain concepts. The reference guide which has been created can be used as a facilitating supplement for many land surveyors in their work, and that it can be helpful in education, as not everyone is sure of which part of the law that is actually used in the decisions.

AbstractIDD directive constitutes a piece of EU primary legislation and therefore it is obliged to respect the legal principles ruling the way in which EU acts towards the Member States, among which proportionality principle is of special importance. A legal act complies with the principle of proportionality if the measures adopted by the EU do not exceed the limits of what is appropriate and necessary to attain the objectives legitimately pursued by the legislation in question. According to IDD’s recitals, the measures adopted therein are proportional to the aim pursued by the IDD, i.e. customer protection. However, a live discussion boosted over the focal point of the IDD, i.e. a wide range of information duties, may lead to different conclusions and thereby put proportionality of the IDD in doubts. To verify this thesis, the author attempts to carry out the ‘proportionality test’ of the discussed information duties.

AbstractThe Zambian government enacted the 1995 Lands Act with the aim of stimulating investment and agricultural productivity. This Act strengthened the role and power of traditional leaders, particularly chiefs, as it empowered them to allocate customary land to individuals and companies, including foreign investors. In the Bembachiefdom of northern Zambia, a new chief issued new land rights and invalidated the land rights issued by the old chiefs. As a result, land owners with documents in the old formats were required to obtain new certification from the new chief. Concerned about the land within his territory, this chief also decided to invalidate the title deeds issued by the central government so that he could release the protected land to local people. Alongside their historical and cultural power, the chiefs strengthened their patronage over land distribution as well as their authority over the residents in their territories. With high demand for land, anxiety among local people due to land scarcity has created political power and authority for the chiefs.

AbstractChapter VII of the Insurance Distribution Directive delineates the sanctions and other pecuniary measures which the Commission of the European Union now requires as a portion of the minimum harmonization of the Directive. As Member States adopt and apply the articles of Chapter VII, which are unprecedented in their scope and specificity, they may find guidance through a comparison of the enforcement mechanisms already in place in other jurisdictions.The United States is well known as the largest insurance market in the world, and possesses an extensive body of insurance regulation. The National Association of Insurance Commissioners, an advisory organization comprised of the insurance commissioners from each of the 50 U.S. states, drafted the Producer Licensing Model Act—the closest American corollary to the IDD. Unfortunately, despite widespread adoption of the PLMA, the effectiveness of U.S. state enforcement mechanisms on the actions of intermediaries is, overall, weak and inconsistent. We will analyze why this is the case, and offer concrete examples of the failures of specific state enforcement regimes.

Consistently with it being a terminal insolvency procedure, distribution of the insolvent estate amongst the company’s creditors (and members in the event of a surplus) is the principal function of a liquidation. Administration is not directly comparable in this respect. Where administration is used for the purposes of rescue or restructuring, there may be no need for the administrator to make distributions but, on the other hand, it may be a ‘liquidating’ or ‘distributing’ administration where the wider powers of an administrator are used to achieve a better result for creditors than that achievable in liquidation. As explained in Chapter 8, the latter form of administration was facilitated by the Enterprise Act remodelling of the administration provisions of the Act and it is now common for an administrator with realizations available for distribution to creditors to use his own powers in that respect instead of putting the company into liquidation. The treatment of the claims of pre-proceeding creditors is the same whether distributions to them are made by an administrator exercising his own powers or by a liquidator appointed immediately following an administration.

In this paper author analyses the conflict-of-law regime for cross-border distribution contracts in Serbian private international law. The study begins with the characterisation of distribution contract and its delimitation form other similar contracts in Serbian legal system, such as a sale contract, franchising contract and agency contract. It continues with the analysis of conflict-of-law rules of Serbian PIL Act which have to be applied to distribution contract, where the attention is given to the choice of law rule of Art. 19 of Serbian PIL Act and to the hard conflict-of law rule for innominate contracts contained in Art. 20 point 20 of Serbian PIL Act which may be derogated by special escape clause (Art. 20 sentence 1 of Serbian PIL Act). This hard conflict-of-law rule is heavily criticised because it deviates from the principle of characteristic performance which has been established in hard conflict- of-law rules of Art. 20 point 1-19 that apply to nominate contracts. Finally, author analyses the issue of determining applicable law for formal validity of distribution contract as well as the application of overriding mandatory rules which directly affect the cross-border distribution contracts.

An analytical solution is presented for determining the stress distribution in pin loaded composite joints using Lekhnitskii’s complex stress function approach. In this analysis, it is assumed that the pin is rigid, no clearance exists between pin and plate, and Coulomb friction is assumed to act throughout the contact region. The analysis also assumes that the contact boundary at the pin-plate interface spans through half of the hole boundary. The boundary conditions at the pin-plate interface are specified in terms of the trigonometric series used to represent the displacement field in the contact zone. Numerical results are presented for stress distribution in (±45°)s and (04°/±45°)s carbon fibers reinforced laminates.

Invasive zebra mussels (Dreissena polymorpha) were first observed in situ at Apostle Islands National Lakeshore (APIS) in 2015. This report builds on 2018 SCUBA surveys and Environmental Protection Agency (EPA) veliger sampling to: 1) determine whether shoals on APIS borders act as sentinel sites to corroborate veliger drift hypotheses about invasion pathways, 2) evaluate ongoing hand-removal of zebra mussels from easily identified structures, and 3) continue efforts to assess native unionid mussel populations, particularly where zebra mussels are also present. Standard catch per unit effort survey methods by SCUBA teams were used to determine the distribution and relative abundance of zebra or quagga mussels (dreissenids) and native mussels (unionids). Zebra mussels were present at densities between 3 and 42 n/diver/hr (number of mussels per diver per hour), while native unionids were present at densities between 5 and 72 n/diver/hr. Shoal surveys (Eagle Island shoal, Sand Island shoal, York Island shoal, Bear Island shoal, Oak Island shoal, and Gull Island shoal) showed zebra mussels were more abundant on the west side of APIS and absent on the easternmost shoal (Gull Island), corroborating veliger work by the EPA that suggested drift from the Twin Ports of Duluth, Minnesota, and Superior, Wisconsin, is one pathway of invasion. Our results support the use of shallow shoals along the periphery of the park as sentinel sites gauging zebra mussel immigration and population dynamics. Zebra mussel densities in the central islands showed no obvious spatial pattern, and this survey cannot determine whether currents or human transport (or both) are invasion vectors. Given the mussels’ continued presence at heavily used mooring areas and docks where there are no zebra mussels on nearby natural features (e.g., Rocky Island dock, Stockton Island mooring areas), our findings are consistent with multiple invasion pathways (drift from the Twin Ports and anthropogenic sources at mooring areas). SCUBA search and removal of zebra mussels from docks was confirmed to be an effective method for significantly lowering the risk of zebra mussels reproducing and dispersing from these locations. We caution that this work is being done on what look like initial invasions at low densities. Repeated removal of zebra mussels by divers reduced numbers to zero at some sites after one year (South Twin docks, Stockton Island NPS docks, and the Ottawa wreck) or decreased numbers by an order of magnitude (Rocky Island docks). Dreissenid densities were more persistent on the Sevona wreck and longer-term work is required to evaluate removal versus recruitment (local and/or veliger drift). Given the size of the wreck, we have tracked detailed survey maps to guide future efforts. Zebra mussels were again observed attached to native mussels near Stockton Island and South Twin Island. Their continued presence on sensitive native species is of concern. Native unionid mussels were more widely distributed in the park than previously known, with new beds found near Oak and Basswood Islands. The work reported here will form the basis for continued efforts to determine the optimal frequency of zebra mussel removal for effective control, as well as evaluate impacts on native species.

This article demonstrates the comparative possibility of constructing indicators of critical and crash phenomena in the volatile market of cryptocurrency and developed stock market. Then, combining the empirical cross-correlation matrix with the Random Matrix Theory, we mainly examine the statistical properties of cross-correlation coefficients, the evolution of the distribution of eigenvalues and corresponding eigenvectors in both markets using the daily returns of price time series. The result has indicated that the largest eigenvalue reflects a collective effect of the whole market, and is very sensitive to the crash phenomena. It has been shown that introduced the largest eigenvalue of the matrix of correlations can act like indicators-predictors of falls in both markets.

We herein discuss how college major choice affects gender wage gaps by highlighting the role that STEM majors play in explaining the gender wage gap in a developing country. We focus on a Latin American country where a systematic analysis of the interaction between students choice of college major and the gender wage gap is currently lacking. We take advantage of a very unique dataset of college students from the Universidade Federal de Pernambuco (UFPE), Brazil, to decompose the raw gender gap in hourly wages into one component that can be explained by differences in endowments between men and women as well as a second or residual component that reflects gender differences in the prices of market skills. We implement the commonly applied decomposition approach at the wage distributions mean and a decomposition procedure that considers variations across the wage distribution. Our results reveal that the majors that women and men select explain 50% of the gender wage gap at the mean, and STEM majors contribute to 30% of this difference. When examining different percentiles of the wage distribution, we find that the selection of a major is more important at the middle of the distribution than at the bottom or top.

Methods to quantify soil conditions of pore connectivity, tortuosity, and pore size as altered by compaction were done. Air-dry soil cores were scanned at the GeoSoilEnviroCARS sector at the Advanced Photon Source for x-ray computed microtomography of the Argonne facility. Data was collected on the APS bending magnet Sector 13. Soil sample cores 5- by 5-mm were studied. Skeletonization algorithms in the 3DMA-Rock software of Lindquist et al. were used to extract pore structure. We have numerically investigated the spatial distribution for 6 geometrical characteristics of the pore structure of repacked Hamra soil from three-dimensional synchrotron computed microtomography (CMT) computed tomographic images. We analyzed images representing cores volumes 58.3 mm³ having average porosities of 0.44, 0.35, and 0.33. Cores were packed with < 2mm and < 0.5mm sieved soil. The core samples were imaged at 9.61-mm resolution. Spatial distributions for pore path length and coordination number, pore throat size and nodal pore volume obtained. The spatial distributions were computed using a three-dimensional medial axis analysis of the void space in the image. We used a newly developed aggressive throat computation to find throat and pore partitioning for needed for higher porosity media such as soil. Results show that the coordination number distribution measured from the medial axis were reasonably fit by an exponential relation P(C)=10⁻C/C0. Data for the characteristic area, were also reasonably well fit by the relation P(A)=10⁻ᴬ/ᴬ0. Results indicates that compression preferentially affects the largest pores, reducing them in size. When compaction reduced porosity from 44% to 33%, the average pore volume reduced by 30%, and the average pore-throat area reduced by 26%. Compaction increased the shortest paths interface tortuosity by about 2%. Soil structure alterations induced by compaction using quantitative morphology show that the resolution is sufficient to discriminate soil cores. This study shows that analysis of CMT can provide information to assist in assessment of soil management to ameliorate soil compaction.

Inclusive growth requires high levels of trust, both among individuals and in institutions, and trust is shaped by a variety of factors, including the distribution of income and wealth. This is problematic when that distribution is not perceived as legitimate. Latin America and the Caribbean has traditionally been a highly unequal region. Inequality might be associated with lower trust because it reflects an unequal distribution of power, as those at the top can use the states coercive power to benefit themselves at the expense of others. Inequality nonetheless tends to be wrongly estimated, as most people do not accurately estimate their countrys income and wealth distribution, or their position within.

This document is part of a series of technical notes describing the compilation of a new companion database that complements the UNU-WIDER World Income Inequality Database. It aims at facilitating the analysis of inequality as well as progress in achieving the global goal of reducing inequality within and across countries. This new dataset includes an annual series reporting the income distribution at the percentile level for all citizens in the world, regardless of where they live, from 1950 to the present. The global distribution is displayed along with the country-level information used to produce it. The dataset also includes estimates of various global absolute and relative inequality measures, and the income share of key population groups. All estimates are further disaggregated by the contribution of inequalities within and between countries, as well as by each country’s geographical region and income group. While previous technical notes described the selection of country income distribution series and the integration and standardization process to overcome the heterogeneity in original welfare concepts and other methods, I here describe all the necessary additional steps and assumptions made to construct the new global dataset.
