It is not up to us in this study to treat only problems caused by the coercive export of Western political model in Africa, the question has already been remarkable treated. It should however be noticed that it is clear the lack of studies on ethnicity as an integral ontology in international relations and conflict studies in particular. In our study, it is firstly to highlight the central and fundamental aspect of the multifaceted manipulation of the concept of ethnicity in the occurrence of certain post WW2 conflicts. Indeed, besides the two atomic bombings of Hiroshima and Nagasaki in 1945, the nuclear powers have engaged in a macabre game of strategic blackmail without making use of the ultimate weapon and Praetorian what the nuclear fire, relegating studies on nuclear phenomenon of idle speculation about the use of a weapon is now obsolescent.Needless to say, What would the light of numerous civilian and military casualties, direct and indirect conflicts we describe and we analyze the case in this study, the ethnic group that has repeatedly called, plays a hackneyed significant role in these conflicts. To this end the conflicts in the studied species belong to the category of identity conflicts. The multiplicity of ethnic conflicts in sub-Saharan Africa and the unspeakable violence that result as in Rwanda, we tend to think to map prosaically as ethnicity kills more than the atom, ie the ethnic conflicts which a limited number of studies are devoted much more violent and deadly than the experts do not want to believe. And marginalize, caricature or analysis without scientific consistency without deep epistemological identity and ethnic conflicts would be to progressively exclude the study of international relations and war studies.The ethnicity appears thus as interesting ontology increasingly international relations with respect to the multiplicity of ethnic and identity conflicts swarming in Africa since the fall of the Berlin Wall. Since this symbolic period strong states built on the Jacobin model imported cemented by single parties and thoughts have been replaced by a multitude of claims to political pluralism as well as the resurgence of ethnic identities. In the Congolese case, ethnicity becomes a transnational ontology, it is no longer to divide but to unite allies. The ethnic therefore becomes a factor of isolationism but a source of the formation of large transnational political groups. To do this, the story is mobilized and manipulated on purpose to serve as a leaven of legitimation

For approximately 27 years, the Democratic Republic of the Congo has been plagued by armed conflicts, currently persisting in the eastern part of the country. Thousands have lost their lives, and women and girls have endured various and exceptional harms from sexual violence, compounded by stigma and social ostracization. Despite progressive national and international legal frameworks, impunity persists, denying victims access to the right to redress. The dysfunctional national judicial system, guided by conventional criminal and reparative principles, reveals the weakness of the domestic response to the implicated international crimes. In the context of transitional justice revival, traditional national approaches to criminal justice and reparations prove inadequate in the dual national and international setting. A unique comprehensive approach addressing international crimes, focusing on the autonomy of sexual violence as a weapon of war in the DRC, gives rise to a transitional justice mechanism encompassing both judicial and extrajudicial aspects. In a geopolitical landscape marked by UN disengagement and the erosion of international responsibility, the prospect of a judicial mechanism constructed with a crescendo approach to the internationalization or denationalization of concurrent jurisdiction between national courts (Judicial Special Chambers) and the Special Criminal Court for the DRC, an international tribunal, constitutes the innovation of this thesis

If the explosion of the East/West system marks the end of the idea of global confrontation as model of the war since the end of the second world conflict, we more fundamentally have to wonder about the changes which took place since the 90s as regards the status of the very war and about the role of the peace operations in the international relations. The political crises ensuing from internal conflicts are sources of destabilization and weakening of the local institutions which undergo the tumult and weaken the capacity of the actors to go out of such a political situation. The necessity of strengthening the local capacities during this pivotal period to avoid the recurring crises is translated by the presence of the international community which spreads a multitude of strategies. There is indeed in the grammar of United Nations a continuum in the modes of crises’ management which goes the most reserved forms of the persuasion to certain modalities of coercive diplomacy, implying a use limited by the violence. When we examine the peace operations in RDC, dynamic set tensions and connections, oscillating between order and disorder in its institutional expressions, the report which gets free is that the question of the peace requires an analysis which takes into account several factors. Hence the use of an interdisciplinary approach, involving both critical currents in international relations (critical constructivism) while combining the sociology of international relations. Our study attempts to estimate the relevance and the coherence of the practices and the conducts of the international actors in a better way axiological and ideological outlines of the management of the iterative crises

The emergence of the information society was often defined as one of the major variables in the evolution of the international system over the past decades. This thesis aims to contribute to reflections on war and its evolution. It focuses on the concept of "cyberwar" which suggests that the era of information and networked society have given rise to a new category of armed conflict, which unfolds over a planetary battlefield – named cyberspace - and challenges the conventional framework of interstate armed conflict. By analyzing the discourse on cyber warfare, the multiple actors and strategies of cyberwar, we try to understand how new information technologies are changing the way of doing and perceiving war, and more broadly through these new warfare capabilities , can contribute to the transformation of the international balance of power

States members of the United Nations elaborated a lawful corpus destined to protect the child and to improve his condition in armed conflicts. The main idea of this protection is that a child is a particularly vulnerable being. Therefore when he does not participate in the hostilities, he must not be taken for target of the attacks, and should not be recruited by the belligerents. As member of civilian population, he benefits from a general protection against the consequences of hostilities. Notwithstanding this last point, he is often forced to flee as refugee or moved inside his country. In fact the child can find itself as soldier in armed forces and armed groups. For that reason the international community has regulated his recruitment and his participation to the hostilities. Despite this legislation, many children are recruited and constantly participate in armed conflicts. These children often commit the worst atrocities of war. Given that fact, how does the international law apprehends children soldiers' identity ? is that law about executioners and / or victims ? This study tries to demonstrate that the lawful corpus elaborated by the international community protects effectively the child in armed conflicts. Only this protection will be effective if these standards were respected by the belligerents

The protection of children's rights a victim of armed conflict is a recent and current problem which is based on the evolution of human rights and the changing nature of conflicts. It raises the question of the existence of an international legal framework consisting capable of providing protection and assistance to child plagued by hostilities. On this point, it appears that international law provides a set of legal mechanisms applicable to the child, whether direct or indirect victim of the conflict, or participate directly in hostilities. Today too many children die each day due to conflict, disease, malnutrition too are exploited and do not have the opportunity to take classes in a school, seeing their future away from them every day a little more. However, examination of these instruments shows that they are often characterized by the generality of their provisions which are not always adapted to take account of the specific nature of the child. In addition, they sometimes raise questions of applicability. So, if we can not deny them any effectiveness, it remains, in many respects, partial. The adoption of legal mechanisms specifically applicable to the child, had also intended to remedy this inadequacy and the completeness of the legal framework. This respect the obligation to protect children and offer them the opportunity to benefit from support programs implemented in the field by many humanitarian organizations claiming loudly that everyone must act in one way or another, to enable the development of actions increasingly diverse and increasingly effective despite the difficulties. Continuing violations did, however, become aware of the normative gaps and requires a redefinition of the objective of protection. In this context, the growing involvement of the Security Council but also the criminalization of violations committed during the armed conflict, define a new approach to the responsibility of the international community in this regard. This intervention, in fact, served to remind States of their obligations and adopt sanctions against individuals offenders. Similarly, sentences imposed by the International Criminal Court and the Special Court for Sierra Leone for war crimes of recruitment and use of child soldiers mark the end of a miscarriage of justice
