The role of the judiciary, law enforcement officials in the resolution of disputes is important. The number of disputes is increased, many authorities in Indonesia produce multiple decisions with conflicting legal force making it difficult to execute. The purpose of the study was to find the standardization of competency of law enforcement officials, the relationship between the professionalism of law enforcement officials and legal certainty in the settlement of land disputes as mandated by Article 33 paragraph (3) of the 1945 Constitution and the Basic Agrarian Law Number 5/1960. Settlement of land disputes is achieved through the General Court and the Administrative Court. The existence of regulations regarding competency standards for law enforcement officials who handle land disputes for the sake of fair settlement of land disputes and legal certainty.

The debate on the absolute competency of the State Administrative Court in Indonesia to set the dispute over the State Financial Losses Report (LHPKKN) is proved to have caused dissenting opinion. The judgments between one administrative court to other court in Indonesia cause main problem of achieving justice and legal certainty. This research examines the issue of absolute competence of the Administrative Court in adjudicating disputes on the State Financial Losses Report published by the Financial and Development Monitoring Agency (BPKP). This article uses normative legal research and implement the statute approach, conceptual approach, and case approach. These approaches are used to discern and analyze several related legal materials or documents scientifically. The aims and objectives of this research are to find a legal solution on how this classic issue has to be approached and solved. As a result, it is found through this article that the Administrative Court has absolute competence in deciding disputes on the Report on the Calculation of State Financial Losses issued by the Financial and Development Monitoring Agency, which is supported by several fundamental reasons.

This article aims to describe the results of the competency analysis of SKI teachers at MAN 2 Model Medan in implementing the 2013 curriculum learning based on the Semester Credit System. The method used is a qualitative research method with a naturalistic analysis approach using data collection techniques through observation, interviews and documentation. Then the data analysis techniques used through data reduction, data presentation and drawing conclusions. While the data validity techniques are credibility (trust), transferability (transferability), dependability (dependence), and confirmability (certainty). The results showed that: (1) The competence of SKI teachers in analyzing the characteristics of students was considered quite good, with indicators of understanding the physical, moral, spiritual, social, cultural, emotional and intellectual aspects of students. (2) The competence of SKI teachers in mastering learning theory and learning principles is quite good, with indicators of deep learning theory of constructivism, behaviorism, and cognitivism learning theory. While the learning principle uses the PAIKEM approach. (3) The competency of SKI teachers in implementing the 2013 curriculum based on credits is quite good, namely the implementation of learning using the 5 M approach, namely Associating, Asking, Observing, Creating networks, and Conducting trials. (4) The competence of SKI teachers in utilizing information and communication technology is in a good category, involving TV, films, VCD/DVD/VCR and the internet. (5) The competence of SKI teachers in using process evaluation and learning outcomes is quite good, with indicators of conducting an assessment taking into account the principles of continuity and authenticity including knowledge, attitudes and skills.

Objective. Continued Professional Development (CPD) is one of the most significant precursors to increased competency. Appropriate instruments and support are required for its implementation. This paper demonstrates the attitudes held by pharmacists on the impact of the competency framework on CPD, its acceptance among Serbian pharmacists and potential future application. Furthermore, the motivational impact of the competency framework on CPD as well as the relationship between certain demographic indicators and motivators of CPD are provided. Method. Research on the cross-sectional method throughout 2015-16 included pharmacists working in publicly-owned pharmacies. The survey was anonymous and voluntary. The questionnaires generated for this research contain demographic data on those surveyed and open-ended questions with multiple choice answers and applied a Likert-type scale. Statistical analysis was conducted by applying Microsoft Office 2003 and the Statistical Package for Social Sciences (SPSS) version 22. Results. Among the respondents, the female gender dominated, respondents who had not completed a speciality within their respective field, with an average age of 42 years, and an average of approx. 15 years of service. 26.12% of the respondents had prior experience with the competency framework. Most respondents were of the opinion that these instruments motivated them to actively manage their own PD, to set concrete PD objectives and to review their own competency. Over half intend to apply competency frameworks in future. The statistical Chi-square test indicates it is not possible to determine with certainty that there are differences in terms of motivation in managing PD and in PD goal setting between the groups of variables. Conclusion. The research indicates a positive attitude/opinion of pharmacists towards the competency framework and in recognising these instruments as supportive to CPD.

IntroductionTransnationalism provides a serious challenge in mental health care, especially due to the crucial role of communication. Emergency room interactions offer an opportunity to analyze the role of cultural competency among providers and how they relate to immigrants in the clinical encounter.ObjectivesThis study addresses three aims: to assess the level of provider-perceived accuracy of diagnoses; to evaluate the use of restraints; and to compare diagnoses rates between patients of diverse racial/ethnic groups.MethodsWe examined patients’ race/ethnicity and their relation to service use and perceived certainty of mental health diagnoses. Three hundred and forty-seven migrants and 67 natives as well as their providers were interviewed in psychiatry emergency rooms in Barcelona (Spain).ResultsThe perceived certainty of clinical diagnosis is lower for Asians (OR = 0.2, 95% CI [0.07–0.63]), and higher when the clinician feels comfortable with the patient (OR = 5.41, 95% CI [2.53–11.58]). The probability of restraints is higher for Maghreb patients compared to native born (OR = 3.56, 95% CI [1.03–12.26]). The probability of compulsory admission is lower for Latinos compared to native born (OR = 0.26, 95% CI [0.08–0.88]). The probability of receiving a diagnosis of psychosis is lower when the clinician can communicate in the patient's language (OR = 0.37, CI 95% [0.16–0.83]).ConclusionsCultural factors such as level of comfort and communication in the patient's language play a central role in diagnosis and treatment. Purpose.The purpose of this article is to consider the features of competence-oriented physical and psychophysio-logical training organization for future pilots and to reveal the essence of the search and transformation stage of phys-ical and health competencies development. Methodology. Interpretation of the search-transforming stage in the self-development of physical and health competencies involves consideration of this didactic phenomenon in the context of its autodidactic component. Since competence-oriented Physical and Psychophysiological Training is a creative way of forming physical and health competencies, it can be considered a technology of transferring educational activi-ties to the mode of personal development, when the cadet becomes a subject of educational activity and integration of psychological and pedagogical knowledge to solve the outlined tasks. Results. Competence-oriented physical and psychophysiological training in the course of constructive activity passes from disparate processes and systems to a holistic formation with synergetic unity and certainty of structural elements. The ability to understand the educational activities in the discipline of Physical and Psychophysiological Training as a constructive and transformative force motivates the cadet to physical activity, which is correlated with his physical culture and health competencies and the purpose of professional education. Originality. Interest in the phenomenon of «psychophysiological reliability» as a didactic construct of quality professional education is explained by the development of problems in psychological readiness of future pilots for flight activities. A new impetus to the modernization of professional education in modern conditions is the introduction of a competency approach as a methodological basis that will realize the fullness of in-tegration facilities in the flight training with developed professional and personal competencies. That is why the prob-lem of professional reliability development for future pilots in the context of the competency approach today reaches the level of priorities in the aviation industry and higher education, in particular. Practical value. The content, structure and logic of competency-oriented Physical and Psychophysiological Training and its component «Search and Transformation Stage» implementation allow access to internal psychological and physiological resources of future pilots for effective development of psychophysiological reliability and psychological readiness for the flight profes-sion; to inner world in such a way that personal contradictions and meanings in physical activity become the driving force for professional and personal self-development.

Teacher competency is assumed to still be one of the factors that can determine student learning success. This problem needs to be explored further so that the cause can be known with certainty. This research aims to analyse the perception of biological teachers on pedagogic competence of prospective biological teachers in Sikka district. Pedagogic competence is one of the important components that also determine the success of the learning process in school. Prospective teachers need to equip these competencies so that they can apply them in the workforce. The perception of biological teachers on pedagogic competence of prospective biological teachers has a role in determining the progress of the learning process. In conducting this research, the researcher uses descriptive qualitative approach. Data sources come from biology teachers in 6 senior high schools (1 SMA Negeri and 5 SMA Swasta) in district Sikka. In wich the subject of this research is using purposive sampling technique. The data collected through interviews, questionare and document study. The validity of the data is determined using the credibility, transferability, dependability, and confirmability. Data analysis technique used refers to the concept of data reduction, data display, and conclusions or verifications. The results showed that the perception of biological teachers on pedagogic competence of prospective biological teachers in Sikka district belongs to acceptable category, although for the dimension of learning process that can inspire students learning motivation still have problem that need to be improved.

The results of the study discovered that the actualization of personnel in building construction permit services in Lhokseumawe city, Aceh, Indonesia, is manifested through fair behavior, work quality behavior, competency behavior, initiative behavior, communication behavior, and work standard behavior. This research concludes that although the behavior of the officials has been manifested in the aforementioned behavior, it has not been fully actualized in the building construction permit service, because there are still many internal and external obstacles. Internal obstacles such as limited personnel resources, services that are not yet transparent and not accountable. Besides, there is no certainty of time, no operational standard work, and complicated bureaucratic path. The external obstacle is the lack of public legal awareness, and most of them have not fulfilled the completeness of administrative documents. It is suggested that the apparatus can actualize their behavior in IMB services optimally. This study suggests that the stakeholder should provide particular and extra training and education for the personnel, including character building, as well as forming a special team to supervise and evaluate the IMB.

The Indonesian Workers Placement and Protection Service Center Semarang is the Indonesian Workers Placement and Protection Service Center which houses Indonesian labor services in the Central Java Province. The problem of the rise of illegal migrant workers, the processing of documents which still requires a long time, the high placement of Indonesian workers in the informal sector and the still high complaints of Indonesian workers in the Semarang Indonesian Placement and Protection Workforce Service Center show that there are still many problems with migrant workers. This study aims to identify the service quality of the Semarang Indonesian Workers Placement and Protection Service Center provided to Indonesian workers. This type of research is qualitative research. Data collection techniques used through interviews, observation and documentation. Sources of data used through primary and secondary data. The results of this study are the responsiveness dimension of the Indonesian Workers Placement and Protection Service Center can realize the pre-departure process in an average of one month, the insurance dimension is still a problem related to service convenience, tangibles dimension has been effectively seen from the competency test facilities and the final debriefing, the empathy dimension needs a little improvement on the acceptance of service input, the reability dimension is quite good with the certainty of costs but an evaluation of HR related needs.

This study aims to determine the level of community satisfaction through the results of a survey and assessment of the performance of services that have been provided by the apparatus of the DPM-PTSP Jambi Province licensing service provider in 2019. Dimensions measured to determine the community satisfaction index are Service Requirements, Systems, Mechanisms and Procedures Service, Service Time, Service Cost / Tariff, Product Specifications Type of Service, Implementing Competence, Behavior (Courtesy and Hospitality) Service Officers, Facilities and Infrastructure, Handling complaints, suggestions and input. This study uses a survey method that is supported by quantitative descriptive analysis. The population in this study is the User Services at the DPM-PTSP Jambi Province in 2019 as many as 200 people. While the sample is taken by random sampling or taken randomly and incidental sampling. The number of samples using a sample table from Morgan and Krejcie was 132 respondents.The analytical tool used is univariate and bivariate analysis. The index of community satisfaction in the DPM-PTSP of Jambi Province was 3,662 or 91,540 for the IKM value after being converted. The value of the IKM indicates that the service quality is at level A and the performance of the DPM-PTSP licensing service unit in Jambi Province is very good. There are 4 service elements that have a Community Satisfaction Index, namely Service Officer Behavior Elements (IKM 91,288), Implementing Competency Elements (IKM 90,909), Quality Facilities and Infrastructure Elements (IKM 89,962), Complaints Handling Elements, Suggestions and Feedback (IKM 89,394) ), but the quality of service is still at level A or categorized as very good. Furthermore, there are five service elements that have a Community Satisfaction Index (IKM) above the average Service Requirement Element (IKM 93,371), Service Procedure (IKM 92,424), Service Time (IKM 92,045), Service Cost / Tariff (IKM 92,614), Service Products (IKM 91,856). The service element that has the highest community satisfaction index is the service requirement element, then the service element that has the lowest community satisfaction index is the handling of complaints, suggestions and. The main factor influencing community satisfaction is the competence of the executor and handling of service complaints, input and advice on the DPM-PTSP licensing service unit of Jambi Province which must be appropriate and there is a complaint box, and there must be follow-up with transparent, accountable, and certain service complaint handling mechanisms. time table (time table) and legal certainty. Based on the results of the bivariate analysis that in the licensing service unit in DPM-PTS Jambi Province the service elements from elements 1 to 9 are still partial and not yet comprehensive and synergic. This can be seen from the relationship between elements that are not significant, it needs to be strengthened in the implementation of management functions, especially the stronger coordination and supervision functions between sectors in licensing services in DPM-PTS Jambi Province.

This thesis develops a multi-faceted picture of competency based training and the impact it is having on vocational education. The thesis is a personal attempt to act agentically by deconstructing the discourse of vocational education within which I am positioned in my working life. It is an attempt to push back the boundaries of the discourse and to explore and create spaces for contestation. In order to do this I undertake three different readings of a set of texts. The texts come from two sources. The first is a set of documents identified in the Framework for the Implementation of Competency Based Training and which represent the official government position on competency based training. The second is a set of interviews I undertook with teachers at the Canberra Institute of Technology regarding their views about competency based training. Details of the texts are provided in Section 2 of the thesis. The body of the thesis is a set of three readings of these texts. The particular view of 'reading' used in the thesis is a post structuralist one. Each of the readings brings into play the understanding of the texts created within a particular discourse. I draw on the work of Michel Foucault for the understanding of discourse used in the thesis. The first reading is from within the discourse. It is a reading which seeks to understand competency based training in its own terms, and in relation to the critical debates within the literature of vocational education. I argue in this reading that competency based training emerges as a grand but flawed vision for the future of vocational education. The second reading takes the viewpoint of the work of Michel Foucault, and in particular his book Discipline and Punish. It uses the metaphor of the panopticon to explore the nature of power/knowledge within competency based training and the regime of truth which it brings into being. The final reading is from a feminist post structuralist position. I argue in this reading that the discourse of competency based training is phallocentric. I explore the liberatory claims of the discourse and conclude that the claims are limited because they do not challenge the fundamental and powerful dualisms through which competency based training is constituted. Finally in the conclusion I briefly explore whether I have achieved the aim of the thesis. I question what it means to act agentically and whether the type of thesis I have undertaken constructs the possibility of doing so.

Syftet med denna studie är att beskriva och analysera hur rekryteringsprocessen går till i en kommunal organisation i avseende till att rekrytera kompetensbaserat och rättssäkert, vilket utförts genom en kvalitativ studie i form av fem enskilda semistrukturerade intervjuer. Den kommunala organisationen är belagd i Västsverige. Dessa fem intervjupersoner har utifrån erfarenheter och färdigheter beskrivit hur en rekryteringsprocess går till i praktiken, där de anser att rekryteringsprocessen kan ses komplex med hänsyn till de lagar och regler som ska tas i beaktande. Det huvudsakliga resultatet som framkommit under intervjuerna på den kommunala organisationen har varit att organisationen ska ha en rättssäker och kompetensbaserad rekryteringsprocess, då de verkar inom den offentliga sektorn och det är därför viktigt att bibehålla sin rättssäkerhet. Två principer som under intervjuerna har haft särskild påverkan på rekryteringsprocessen är icke-diskriminering och likabehandling. Den beskrivande bilden gällande principerna icke-diskriminering och likabehandling som har förklarats har behandlat att alla som varit involverade i rekryteringen levt med dessa, men att det i störst utsträckning varit ett arbetsmoment som HR haft under kontroll. Utifrån intervjupersonernas förklaringar och beskrivningar kan vi se starka kopplingar till tidigare forskning och teoretiska utgångspunkter.
The aim of this study is to describe and analyze a municipal organizations recruitment process in terms of recruiting competence-based and legal certainty, conducted by a qualitative study in the form of five individual semistructured interviews. The municipal organization is located in western Sweden. Based on experience and skills, these five interviewees describe how a recruitment process goes into practice, where they consider the recruitment process to be complex with regard to laws and regulations to be considered. The main result that has emerged under the interviews of the municipal organization has been that the organization should have a legal and competence-based recruitment process when operating in the public sector and it is therefore important to maintain its legal certainty. Two principles that had a special impact on the recruitment process during the interviews are non-discrimination and equal treatment. The descriptive picture of the principles of non-discrimination and equal treatment that has been explained has treated all those involved in recruitment living with them, but that it was mostly a working life that HR had checked. Based on the explanations and descriptions of the interviewees you can see strong links to previous research and theoretical starting points.   This study is written in Swedish.

Mining or industrial activity? This is not only an ancient question in Peruvian mining sector but a key issue for domestic and foreign private investment on cement. Since few years ago, cement manufacturing process has been being qualified and regulated by the Peruvian Mining Authority as a mining benefit process which implies the obligation to obtain a benefit mining concession previously. However, upon a review of the technical process aspects, the legal framework in force and a recent judgment enacted by the Constitutional Court of Peru regarding this topic, the position traditionally assumed by the Ministry of Energy and Miningcould be reconsidered.
¿Es actividad minera o industrial? Ésta no es solo una antigua interrogante en el sector minero peruano sino una cuestión clave para la inversión privada local y extranjera del rubro cementero. Desde hace algunos años, la producción de cemento ha venido siendo calificada y regulada por la autoridad minera como beneficio minero, lo cual importa la obligación del titular de obtener previamente a la ejecución de la misma una concesión de beneficio. Sin embargo, a partir de una revisión de los aspectos técnicos del proceso, el marco normativo vigente y un reciente pronunciamiento del Tribunal Constitucional en relación a este tema, la tradicional posición adoptada por el Ministerio de Energía y Minas podría ser repensada.

The aim of this research has been to investigate how teachers in Vocational Education and Training (VET) in Australia deal with the Double Heuristic Method (DHM) as an alternative model for teaching in the VET Sector. The context is set within a vocational educational landscape globally, highlighting approaches in the delivery of vocational education in the USA, European countries and Australia. In pursuit of these approaches, various typologies of competency-based training (CBT) are explored. The VET systems around the world have been undergoing a period of continuous reform, moving VET systems towards a more holistic approach of teaching and learning in higher education. In such a context, the Australian VET sector has been and continues to be faced with challenges in the implementation of the Australian Training Packages, the core curriculum for the VET sector. This inquiry has been implemented within an interpretive paradigm in seeking to capture teachers’ perspectives of using the DHM and to investigate how VET teachers deal with the pedagogical challenges in their work. Central to the research question is investigating how teachers deal with an alternative model of pedagogy, the Double Heuristic Model, from their own frames of reference, and as they experience it. Qualitative methods have been used for data collection and analysis. The primary source of data was a series of semi-structured interviews. The data analysis was based on the principles of grounded theory method as outlined in the work of Strauss and Corbin (1990) whereby participants are placed in a position to consider a phenomenon and how they make meaning of that phenomena. In pursuing this approach to methodology in the two years of data collection and analysis, all three types of coding were utilised: open coding, axial coding and selective coding (Strauss and Corbin, 1990). As the Double Heuristic Method is a relatively new approach in vocational education in Australia, there has not been any prior research on its use in this area. Hence, this research contributes to developing new insights into teachers’ perspectives and responses to one approach in teaching the Units of Competency in the Training Packages in Australia, using an alternative pedagogical framework.

Analytical accounting data allows managers to build a company's strategy or make changes to an existing development plan. The importance of accounting for the enterprise plays a large role at the planning stage of the further business strategy. A competent manager studies accounting data before making the next decision regarding the company's finances. The easiest way to streamline accounting documents and eliminate errors in it is to conduct an internal audit. Such an audit will protect the company from possible fines and problems with tax audits. It will help optimize accounting and document flow, and simplify relations with banks and counterparties. Economic analysis aims to turn economic and non-economic information into useful information for decision making. Logical processing, study, generalization of facts, their systematization, conclusions, proposals, search for reserves - all these tasks are solved within the framework of economic analysis, which is designed to ensure the validity of management decisions and increase its effectiveness. This monograph is a collective work of teachers and students of the Department of Economic Security, Accounting and Law of the Don State Technical University. AbstractThis chapter examines three criminological perspectives through a gender lens. The first part is dedicated to crime and gender. This chapter presents official data of reported and convicted persons in European countries, discussing crime trends and the different involvement of sexes in certain criminal offences. Further, this chapter points to possible differences in the ethology of crime from a gender perspective at three levels: individual; family, and social. The second section deals with gender and criminal victimization, with special attention dedicated to issues of domestic violence and sexual crimes. The third section of this chapter analyses the penal policy of the courts. Data is presented on sentencing practices in European countries, with an emphasis on certain criminal offences. Besides data on imprisonment, attention is paid to other penal sanctions. This section of the text further explains possible factors related to the different sentencing of women and men. They are divided into two categories: the first is those mainly related to socio-economic characteristics and crime committed; the second is those that reflect courts as gender institutions. Finally, this chapter gives explanations of different treatments of trans offenders in the criminal justice system.

AbstractIn the field of private law, gender inequality takes many different shapes. It may at times be easily noticed from the text of the legal rules, for instance, when certain legal rights are reserved for members of a certain gender (i.e. independency to enter a marriage) or when they are available to both genders but in a discriminatory manner (i.e. men inherit twice as much as women). However, in many legal systems equality is guaranteed by law, but inequality still appears in practice. This may be seen from the fact that, on average, land assets are much more often owned by men or that a higher percentage of men run a business. Various social factors may induce gender inequality, like stereotypical division of gender roles in society (i.e. men as breadwinners and women as caregivers) or the persistence of patriarchal customs and practices (i.e. women should renounce their inheritance rights in favour of male inheritors). The consequences of such factors may also be felt in the field of tort law, especially when it comes to damages suffered by women performing unpaid domestic work or indirect damages suffered by women who have to provide the “informal support” for the person who suffered serious bodily harm that resulted in a situation of dependency. Finally, in the field of contract law, the most difficult tasks seem to be to reconcile the prohibition of discrimination with the freedom of contract and to determine the most suitable legal consequence in case of discrimination.

Employability is defined as an interweaving of a person’s human, social and psychological capital, mediated by situational variables, which allows individuals to enter the job market with a professional personal project (Grimaldi, Porcelli, Rossi 2014). Nowadays, young people enter the job market through long, precarious, and poorly contextualized paths, while the socialization processes become recursive, discontinuous, and fragmented (Lodigiani 2010). A key role can be played by guidance services, which can start at university, to meet the demands of the (many) young people who are discouraged and disillusioned to the point where they cannot even imagine a job while still at university. In the employability stakes, what is even more complex is the encounter between young people with disabilities and the world of work, due to the persistence of stereotypes and stigmas. Research questions: What are the intervention models and guidance practices adopted by university guidance services internationally to promote the exploration of skills relating to the employability of students with disabilities? Objectives: To analyse the main intervention models and guidance practices adopted internationally to explore the skills associated with employability in students with disabilities. Methodology: It was decided to carry out a theoretical analysis of 20 scientific articles concerning the models and practices adopted to explore the competences relating to employability in certain university orientation services for students with disabilities in Italy, France, the UK, and the United States. NVivo software was used (Richards 1999) to systematically explore the scientific literature. Preliminary Findings: A first scientific paper showed that, like in Italy and France, the «Competence Balance Sheet» (Ardouin 2010) is the guiding practice in the USA, while in the UK, it is the Career Guidance Approach (Reid, Scott 2010). In the literature, orientation models and practices are also closely linked to the various patterns of employability. Final remarks: The implementation of guidance counseling paths aimed at exploring the skills associated with employability among all students and graduates is crucial to the completion of a viable strategic action in the University’s social function, as a part of new organizational models that take the plurality of learning opportunities into account

As a result, the obstacles in technology ownership and access put a group of learners from a low socioeconomic status and minorities in a disadvantaged position and prevent them from engaging in learning experiences. Indirectly, these learners also struggle to develop digital competencies due to their limited access to technology-rich environments. This chapter elaborates on the characteristics of learners in open, distance, and digital education environments with respect to their technology ownership and access, presents a number of competency frameworks, and discusses how the competencies included in the frameworks apply to open, distance, and digital education. The chapter opens with the role of technology in new learning environments and how technology ownership and access vary among certain demographics as well as developed, developing, and underdeveloped countries. The introduction is followed by learner characteristics with respect to varying technology access and ownership among demographics and the implications of technology ownership and access for open, distance, and digital education. Finally, a number of competency frameworks were presented and discussed in regard to their contributions to the development of a competency set for learners in open, distance, and digital education environments.

The integrity of a pipeline and the competence of those who manage it are undeniably linked — you can’t have one without the other. While few would argue this point, the process of how best to define, measre, develop and assure the competency of pipeline professionals, especially those working outside of field operations, is far less certain. The Pipeline Integrity (PI) department of the Liquids Pipelines (LP) division of Enbridge took on this challenge. Following a review of best practices and technical competency models in diverse industries, Enbridge custom-built an innovative technical competency model for Pipeline Integrity Professionals, from junior engineers to senior specialists and managers. The model includes competencies both general (e.g., communication, project management) and highly specific to the work of pipeline integrity (e.g., tank integrity management, internal corrosion engineering, pressure cycling management). This paper will describe the Enbridge Pipeline Integrity Technical Competency Model and “toolkit” in detail, including the architecture, competency library, measurement scale and assessment process. The business case, best practices research, project governance, development process and lessons learned are also described in order to provide a robust case study and practical guideline for others in the pipeline sector seeking to define and manage competencies for technical professionals.

The present paper suggests a possible way to enhance the development of students’ intercultural competences by means of proper names. Intercultural competence helps the individual to know oneself, first of all, by referring to the values of the community to which he or she belongs and then by referring to the others, by showing interest in and understanding for cultural differences. The diversity of the world we live in, the specifically human need for interaction and the existence of intercultural barriers lead to the idea that the development of intercultural competence is a necessity. The article presents the way in which we can contribute to the intercultural formation of students, by relying on an immediate reality, that of names as forms of expressing students’ linguistic and cultural identity. The study analyses the origin, typology and significance of the names of students from different cultural backgrounds, the story behind the choice of specific names, the association with famous bearers of certain names, and the cultural load of the names. By capitalising on proper names, one gains an experience of knowledge in the context of multiculturalism

This study is a reflection on educational reality based on certainty and uncertainty coordinates. Exploring the significance of the binomial reality, generated by the different degrees of certainty, perceived by the actors involved in teaching, the article proposes a few acting options, in order to develop an appropriate orientation of the teacher training process, in a contemporary society marked by the “certainty of uncertainty”. Embracing the unknown, coping with unfamiliar situations, reflecting constructively on one’s own mistakes, as part of a teacher daily activity, are generated by a genuine positioning towards uncertainty in education, raising it from the status of a problem to the hypostasis of an opportunity. Mapping uncertainty through resilience, building confidence in experiencing doubt, reshaping learning by daring to approach dilemmas and stepping out of inaction can be viewed as valid alternatives in developing a professional self in a changing environment. That claims a rethinking of teacher training in terms of developing abilities for sustaining appropriate responses and a proper understanding of the relationship between certainty and uncertainty in education, having the intention of building quality learning experiences. The concepts of choice and change are about to conquer the ideas of standards and stability in educational context as proofs of a renewed approach in order to delineate core drivers of human development in contemporaneity. That is why rethinking teacher training needs to focus on articulating the reflective practicing with experiencing a constant change, integrating the multiplicity of opportunities in a supportive learning environment for developing a global competence, in order to respond effectively to the contemporary challenges.

In multi-agent belief fusion, there is increasing interest in results and methods from social choice theory. As a theoretical cornerstone, the Condorcet Jury Theorem (CJT) states that given a number of equally competent, independent agents where each is more likely to guess the true out of two alternatives, the chances of determining this objective truth by majority voting increase with the number of participating agents, approaching certainty. Past generalizations of the CJT have shown that some of its underlying assumptions can be weakened. Motivated by requirements from practical belief fusion scenarios, we provide a significant further generalization that subsumes several of the previous ones. Our considered setting simultaneously allows for heterogeneous competence levels across the agents (even tolerating entirely incompetent or even malicious voters), and voting for any number of alternatives from a finite set. We derive practical lower bounds for the numbers of agents needed to give probabilistic guarantees for determining the true state through approval voting. We also demonstrate that the non-asymptotic part of the CJT fails in our setting for arbitrarily high numbers of voters.

The high demand for businesses to objectively assess their employees in order to make human resource decisions and further business development faces the issue of a lack of reliable staff assessment methodologies and the difficulty of interpreting the resulting assessment reports for practical use. Despite the fact that the competence approach to the assessment of specialists has been repeatedly considered by both domestic and foreign scientists, there is still no systematic psychological research aimed at establishing a link between the level of competence development of trade business specialists and the quantitative-qualitative sales indicator. The study focused on 32 sales managers from two commercial organisations in Moscow. Empirical data was obtained via test methods ‘Short Reference Test’ (V. N. Buzin, E. F. Vanderlik), ‘Eysenck Personality Inventory’, abridged version (H. J. Eysenck, G. J. Wilson, K. J. Jackson), questionnaire ‘Fear of Success, Need Achievement, and Fear of Failure’ (A. A. Rean), ‘Self-assessment of manager’s business and personal qualities’ (F. Fiedler), ‘Verbal creativity’ (S. Mednik), biographical method. As a result of the conducted research the connection between the level of development of communicative, socio-perceptual and auto-psychological competences and the effectiveness of professional activity of sales managers, measured by the number of sales for a certain period of time, has been revealed. The results of this study can be used in recruitment as well as for targeted investment in staff development and training to improve competencies and the financial performance of the company.

Since emotional competence is an important factor in human communication, it will certainly also improve communication between humans and robots or other machines. Emotional competence is defined by the aspects emotion recognition, emotion representation, emotion regulation and emotional behavior. In this paper we present how these aspects are intergrated into the architecture of the robot head MEXI. MEXI is able to recognize emotions from facial expressions and prosody of natural speech and represents its internal state made up of emotions and drives by according facial expressions, head movements and speech utterances. For its emotions and drives internal and external regulation mechanisms are realized. Furthermore, this internal state and its perceptions, including the emotions recognized at its human counterpart, are used by MEXI to control its actions. Thereby MEXI can react adequately in an emotional communication.

Leaking joints are a main cause of hydrocarbon releases on United Kingdom Continental Shelf (UKCS) offshore sites. The consequential costs of shutdowns and repair can be very high. There are other significant risks, notably to occupational safety, major incident safety and the environment. Fundamental to joint integrity is the competence of the personnel involved. Leak data indicates that poor joint make-up is a major cause of leaks and a review of the causes confirms that the current skills and practices do not give leak-free joints. Therefore the most important element of a management system is to have competent people working on joints. A competence assurance process should be established where the level of training, assessment and experience required is dependant on the potential severity of a release. The results of this should be that that all joints are made up by personnel with an appropriate level of competence. Control of the competence of people working with joints is the most important factor in preventing leaks. There are many ways to influence the integrity of a pipe joint, particularly during design, procurement, fabrication and any intrusive work. A Management System should include details of best practices that are available, with a guide to when and where they should be used, and clarification on tightening methods. Most of these best practices already exist either as industry or company documents but may not be used effectively. • The management system should improve both their visibility and their use, and ensure capture and transparency of all specific historical joint data. Each operator should positively and effectively manage the integrity of bolted joints. It is expected that this will be built on a process of continuous improvement. The essential elements of such a management system are: • Ownership: There should be an identified owner of the management system, responsible not only for its implementation and ongoing maintenance, but also for communicating its aims and objectives throughout the organisation. The owner should state the expectations for the system and monitor its effectiveness. • Awareness: Everyone with an influence on joint integrity in the organisation should be aware of the management system, its objectives, expectations and effects on day-to-day working. Good awareness needs to be maintained. • Tools: A set of implementation tools is required to ensure that the expectations can be met. These should include risk assessment, competence management and control of the practices used. These are discussed in more detail later in this document. • Records and Data Management: The certainty of a successful joint being made up increases if historical data exists on the activities carried out in the past. Recording traceable data encourages best practice at the time of the activity, and will provide useful planning data for the next time the joint is disturbed. • Learning: Learning from incidents is important. A management system should include the means for gathering relevant data, which should be collected by operations engineers or technicians, and periodically reviewed to establish trends, performance and improvements. • Measurement: Easily monitored, but meaningful, performance standards should be put in place at launch to quantify the contribution being made by the management system and evaluate user satisfaction. Examples include: • The number of recorded leaks during testing and start-up; • Percentage leak reduction attributable to the use of the management system.

Analysis of the standards for the preparation of electromechanics in Ukraine showed that the electromechanic engineer is able to solve complex specialized problems and practical problems in a certain area of professional activity or in the process of study. These problems are characterized by complexity and uncertainty of conditions. The main competencies include social-personal, general-scientific, instrumental, general-professional and specialized-professional. A review of scientific publications devoted to the training of electromechanics has shown that four branches of engineering are involved in the training of electromechanical engineers: mechanical and electrical engineering (with a common core of electromechanics), electronic engineering and automation. The common use of the theory, methods and means of these industries leads to the emergence of a combined field of engineering – mechatronics. Summarizing the experience of electrical engineers professional training in Ukraine and abroad makes it possible to determine the main directions of their professional training modernization.

Swift changes in society, related to sciences technicians’ development, technologies, by the increase of general volume of information, pull out new requirements for maintenance, structure, and quality of education. It requires teachers to diversify a tool in the direction of the increase in possibilities of the use of mobile technologies and computer systems. Lately in the world, more attention spared to the use of mobile learning, which in obedience to «Recommendations of UNESCO on the questions of a policy in the area of mobile learning» foresees the use of mobile technology, both separate and together with other by informational computer technologies. [1]. Mobile learning allows using the open informational systems, global educational networks, unique digital resources which belong to different educational establishments and co-operate with each other. The use of existent educational resources and creation of own, based on the academic resources from informative space, allows to promote the interest of students to the study of physics, to take into account the individual features, and also features of region and framework of society of the country. During the last years in Ukraine competency-based approach to the organization of studies certainly one of basic. The new Education Act addresses the key competencies that every modern person needs for a successful life, including mathematical competence; competence in natural sciences, engineering, and technology; innovation; information and communication competence [2]. This further emphasizes the importance of providing students with quality physical education and the problems associated with it. Using mobile technology in professional teaching work, the teacher has the opportunity to implement the basic principles of the competence approach in teaching physics. An analysis of the data provided in the official reports of the Ukrainian Center for Educational Quality Assessment showed that the number of students making an external independent assessment in physics and choosing a future profession related to physics has decreased significantly. This is due to the loss of students' interest in physics and the complexity of the content of the subject, as well as the increase in the amount of information that students need to absorb. In this article, we explore the possibilities of mobile technology as a means of teaching physics students and give our own experience of using mobile technology in the process of teaching physics (for example, the optics section in primary school).

The article is devoted to the substantiation of approaches to the effective use of advantages and minimization of disadvantages and losses of e-learning as a mean of forming mathematical competence of students in the conditions of research-oriented educational process. As a result of the ascertaining experiment, e-learning has certain disadvantages besides its obvious advantages (adaptability, possibility of individualization, absence of geographical barriers, ensuring social equality, unlimited number of listeners, etc.). However, the nature of these drawbacks lies not as much in the plane of opportunity itself as in the ability to use them effectively. On the example of the e-learning course (ELC) “Mathematical Analysis” (Calculus) of Borys Grinchenko Kyiv University, which is developed on the basis of the Moodle platform, didactic and methodical approaches to content preparation and organization of activities in the ELC in mathematics are offered. Given the specifics of mathematics as a discipline, the possibility of using ELCs to support the traditional learning process with full-time learning is revealed, introducing a partially mixed (combined) model. It is emphasized that effective formation of mathematical competence of students by means of e-learning is possible only in the conditions of research-oriented educational environment with active and concerned participation of students and partnership interaction. The prospect of further research in the analysis of e-learning opportunities for the formation of students’ mathematical competence, in particular, research and investigation tools, and the development of recommendations for the advanced training programs of teachers of mathematical disciplines of universities are outlined.

However, before we can engage with good governance within the context of Islam, we need to be clear what mean by good governance itself. A simple definition of good governance is that of an institutionalised competency of administration and institution leading to efficient resource allocation and management[1]. Another way of looking at it is as a system which is defined by the existence of efficient and accountable institutions[2]. Civil society now tends to look at good governance by way of impact measurement and how a certain set of processes result in a set of measurable and desirable outcomes.

The article concerns the issue of e-learning tools implementation, including the Customs Learning and Knowledge Community electronic platform designed by the World Customs Organization and the Trade Facilitation Implementation Guide case studies collected by the United Nations Economic Commission for Europe, into the self-education process of current government employees (within in-service training) and future public officers (within master’s programs) connected with international trade transactions. The authors give a description of the content and characteristical features of existing e-learning instruments related to training of professionals in Customs and trade fields as well as of certain tasks developed by the authors. The efficiency of the abovementioned e-learning tools has been experimentally proved in the paper, which has shown that these tools promote the growth of the professional competence of government officers and give a great opportunity for them to be involved in life-long learning to acquire various professional knowledge and skills.

The article reveals the problems of mastering by future specialists of the project methodology of creating pedagogical situations in higher education institutions as a means of improving the quality of education. Objectives of the article: to determine the influence of the project method on the creation of pedagogical situations in the process of teaching students; the choice of logic and mechanism of design actions depends on the purpose and the initial conceptual position regarding the subject reincarnates; to study the influence of pedagogical situations on the quality of education in the higher pedagogical school; to diagnose the implementation of the projects method and pedagogical situations in the process of education at the university. The project method provides the presence of a problem that requires integrated knowledge and research for its solution. The results of the planned activities should have practical, theoretical and cognitive significance. Modeling of pedagogical situations is the process of formation of situations-models which simulate the state and dynamics of the educational process and fix the contradiction between the achieved and desired in the personality development in a certain time interval. During the forming experiment, pedagogical situations were used to form the professional competence of the future specialist.

This research considers the influence of various ICT tools on the formation of individual study and research competencies, in particular the system components of the research competencies among senior pupils in terms of profile Chemistry learning and the methods of their practical applying while accomplishing an elective course “Basics of quantitative chemical analysis”. Object of the study: ICT tools for Chemistry learning. Subject of the study: ICT tools of research competencies formation among senior pupils in terms of profile Chemistry learning. Methods of the study: reviewing and analyzing scientific publications, expert evaluation, summarizing pedagogical experience. Results of the study: the system of research competencies formation among senior pupils is effectively provided by the correct selection of ICT tools and conditions of their applying for the certain research competence formation, which embodies system components. Our research confirms the idea that the most ICT tools are to be leading in the development of research competencies among senior pupils in profile Chemistry learning. They are successfully tested by means of their applying in the process of studying the elective course “Basics of Quantitative Chemical Analysis”. They show the high effectiveness. Our study confirms that virtual chemical laboratories are the most universal and influential tools of forming the research competencies among senior pupils in profile Chemistry learning.

Whiteflies are sap-sucking insects that harbor obligatory symbiotic bacteria to fulfill their dietary needs, as well as a facultative microbial community with diverse bacterial species. The sweetpotato whitefly Bemisia tabaci (Gennadius) is a severe agricultural pest in many parts of the world. This speciesconsists of several biotypes that have been distinguished largely on the basis of biochemical or molecular diagnostics, but whose biological significance is still unclear. The original objectives of the project were (i) to identify the specific complement of prokaryotic endosymbionts associated with select, well-studied, biologically and phylogeographically representative biotypes of B. tabaci, and (ii) to attempt to 'cure’ select biotypes of certain symbionts to permit assessment of the affect of curing on whitefly fitness, gene flow, host plant preference, and virus transmission competency.To identify the diversity of bacterial community associated with a suite of phylogeographically-diverseB. tabaci, a total of 107 populations were screened using general Bacteria primers for the 16S rRNA encoding gene in a PCR. Sequence comparisons with the available databases revealed the presence of bacteria classified in the: Proteobacteria (66%), Firmicutes (25.70%), Actinobacteria (3.7%), Chlamydiae (2.75%) and Bacteroidetes (<1%). Among previously identified bacteria, such as the primary symbiont Portiera aleyrodidarum, and the secondary symbionts Hamiltonella, Cardinium and Wolbachia, a Rickettsia sp. was detected for the first time in this insect family. The distribution, transmission, and localization of the Rickettsia were studied using PCR and fluorescence in situ hybridization (FISH). Rickettsia was found in all 20 Israeli B. tabaci populations screened as well as some populations screened in the Arizona laboratory, but not in all individuals within each population. FISH analysis of B. tabaci eggs, nymphs and adults, revealed a unique concentration of Rickettsia around the gut and follicle cells as well as its random distribution in the haemolymph, but absence from the primary symbiont housing cells, the bacteriocytes. Rickettsia vertical transmission on the one hand and its partial within-population infection on the other suggest a phenotype that is advantageous under certain conditions but may be deleterious enough to prevent fixation under others.To test for the possible involvement of Wolbachia and Cardiniumin the reproductive isolation of different B. tabacibiotypes, reciprocal crosses were preformed among populations of the Cardinium-infected, Wolbachia-infected and uninfected populations. The crosses results demonstrated that phylogeographically divergent B. tabaci are reproductively competent and that cytoplasmic incompatibility inducer-bacteria (Wolbachia and Cardinium) both interfered with, and/or rescued CI induced by one another, effectively facilitating bidirectional female offspring production in the latter scenario.This knowledge has implications to multitrophic interactions, gene flow, speciation, fitness, natural enemy interactions, and possibly, host preference and virus transmission. Although extensive and creative attempts undertaken in both laboratories to cure whiteflies of non-primary symbionts have failed, our finding of naturally uninfected individuals have permitted the establishment of Rickettsia-, Wolbachia- and Cardinium-freeB. tabaci lines, which are been employed to address various biological questions, including determining the role of these bacteria in whitefly host biology.

A mature teacher who continuously seeks improvement should be recognised as a professional who has autonomy in conducting their job and has the autonomy to engage in a professional community of practice (Hyslop-Margison and Sears, 2010). In other words, teachers’ engagement in professional development activities should be driven by their own determination rather than extrinsic sources of motivation. In this context, teachers’ self-determination can be defined as a feeling of connectedness with their own aspirations or personal values, confidence in their ability to master new skills, and a sense of autonomy in planning their own professional development path (Stupnisky et al., 2018; Eyal and Roth, 2011; Ryan and Deci, 2000). Previous studies have shown the advantages of providing teachers with autonomy to determine personal and professional improvement. Bergmark (2020) found that giving teachers the opportunity to identify areas of improvement based on teaching experience expanded the ways they think and understand themselves as teachers and how they can improve their teaching. Teachers who plan their own improvement showed a higher level of curiosity in learning and trying out new things. Bergmark (2020) also shows that a continuous cycle of reflection and teaching improvement allows teachers to recognise that the perfect lesson does not exist. Hence, continuous reflection and improvement are needed to shape the lesson to meet various classroom contexts. Moreover, Cheon et al. (2018) found that increased teacher autonomy led to greater teaching efficacy and a greater tendency to adopt intrinsic (relative to extrinsic) instructional goals. In developed countries, teacher autonomy is present and has become part of teachers’ professional life and schools’ development plans. In Finland, for example, the government is responsible for providing resources and services that schools request, while school development and teachers’ professional learning are integrated into a day-to-day “experiment” performed collaboratively by teachers and principals (Niemi, 2015). This kind of experience gives teachers a sense of mastery and boosts their determination to continuously learn (Ryan and Deci, 2000). In low-performing countries, distributing autonomy of education quality improvement to schools and teachers negatively correlates with the countries’ education outcomes (Hanushek et al., 2011). This study also suggests that education outcome accountability and teacher capacity are necessary to ensure the provision of autonomy to improve education quality. However, to have teachers who can meet dynamic educational challenges through continuous learning, de Klerk & Barnett (2020) suggest that developing countries include programmes that could nurture teachers’ agency to learn in addition to the regular content and pedagogical-focused teacher training materials. Giving autonomy to teachers can be challenging in an environment where accountability or performance is measured by narrow considerations (teacher exam score, administrative completion, etc.). As is the case in Jakarta, the capital city of Indonesia, teachers tend to attend training to meet performance evaluation administrative criteria rather than to address specific professional development needs (Dymoke and Harrison, 2006). Generally, the focus of the training relies on what the government believes will benefit their teaching workforce. Teacher professional development (TPD) is merely an assignment for Jakarta teachers. Most teachers attend the training only to obtain attendance certificates that can be credited towards their additional performance allowance. Consequently, those teachers will only reproduce teaching practices that they have experienced or observed from their seniors. As in other similar professional development systems, improvement in teaching quality at schools is less likely to happen (Hargreaves, 2000). Most of the trainings were led by external experts or academics who did not interact with teachers on a day-to-day basis. This approach to professional development represents a top-down mechanism where teacher training was designed independently from teaching context and therefore appears to be overly abstract, unpractical, and not useful for teachers (Timperley, 2011). Moreover, the lack of relevancy between teacher training and teaching practice leads to teachers’ low ownership of the professional development process (Bergmark, 2020). More broadly, in the Jakarta education system, especially the public school system, autonomy was never given to schools and teachers prior to establishing the new TPD system in 2021. The system employed a top-down relationship between the local education agency, teacher training centres, principals, and teachers. Professional development plans were usually motivated by a low teacher competency score or budgeted teacher professional development programme. Guided by the scores, the training centres organised training that could address knowledge areas that most of Jakarta's teachers lack. In many cases, to fulfil the quota as planned in the budget, the local education agency and the training centres would instruct principals to assign two teachers to certain training without knowing their needs. Realizing that the system was not functioning, Jakarta’s local education agency decided to create a reform that gives more autonomy toward schools and teachers in determining teacher professional development plan. The new system has been piloted since November 2021. To maintain the balance between administrative evaluation and addressing professional development needs, the new initiative highlights the key role played by head teachers or principals. This is based on assumption that principals who have the opportunity to observe teaching practice closely could help teachers reflect and develop their professionalism. (Dymoke and Harrison, 2006). As explained by the professional development case in Finland, leadership and collegial collaboration are also critical to shaping a school culture that could support the development of professional autonomy. The collective energies among teachers and the principal will also direct the teacher toward improving teaching, learning, and caring for students and parents (Hyslop-Margison and Sears, 2010; Hargreaves, 2000). Thus, the new TPD system in Jakarta adopts the feature of collegial collaboration. This is considered as imperative in Jakarta where teachers used to be controlled and join a professional development activity due to external forces. Learning autonomy did not exist within themselves. Hence, teachers need a leader who can turn the "professional development regulation" into a culture at schools. The process will shape teachers to do professional development quite autonomously (Deci et al., 2001). In this case, a controlling leadership style will hinder teachers’ autonomous motivation. Instead, principals should articulate a clear vision, consider teachers' individual needs and aspirations, inspire, and support professional development activities (Eyal and Roth, 2011). This can also be called creating a professional culture at schools (Fullan, 1996). In this Note, we aim to understand how the schools and teachers respond to the new teacher professional development system. We compare experience and motivation of different characteristics of teachers.
