El artículo se refiere a la exigencia de universalización del nivel medio que pende sobre los distintos países de la región, reconstruye los discursos que fundamentan y legitiman estas demandas. El texto muestra la expansión del nivel, las modificaciones que las distintas reformas han introducido y marca las invariancias de un formato escolar que se mantiene desde su creación a fines del siglo XIX. Analiza las diferentes configuraciones nacionales de la educación media con referencia a tres países; Brasil, Argentina y Chile y marca la continuidad de las estrategias de inclusión con segregación y la funcionalidad de la expansión con las exigencias del mercado y del orden político.

Purpose. The aim of this work is to characterize the image of a lizard (kileski) in folklore and ritual practices of the Khakass people. Based on the goal, the following tasks were set: to analyze folklore and ethnographic information, to identify the key components of this mythological creature and to discover semantic links of the image with natural objects and elements. Chronologically, the framework covers late 19th – mid 20th Centuries. The choice of such time limits is due to the source base available on the research topic. Leading in the study is the principle of historicism, when any cultural phenomenon is considered in its development, taking into account specific situations. The research methodology is based on historical and ethnographic methods: remnants (relic) and semantic analysis. Results. Our analysis has led us to the following conclusions: in the Khakass culture, the lizard played an important role. It is explained by the lizard being plentiful in the nature of Khakassia, and specifically because of its zoological specificity. In the mythological perception of this reptile, it had contradictory dual characteristics and caused ambiguous feelings. People designated the reptile as a creature living in two environments – earth and water, which is steadily associated with the lower world. At the same time, the image is often introduced into mythological and fairy-tale schemes involving other chthonic species, such as frogs and snakes. In the folklore of the Khakass people, the whole life support system of demonic characters of the lower world, which included farming and nutrition, was directly tied to these amphibians. A great importance was attached to the image of the frog and shamanic practice. The lizard had a direct relation both to the spirit-owner of the water – Sug eezi, and to the lord of the underworld – Erlik Khan. The designated specificity of the lizard allowed including it into the set of key spirits, whi were shaman’s assistants. Shamans mediated between the world of the underground spirits and people: among shamanists, the worship of reptiles reached such a high level that the cult of the patron of sheep arose, the external data of which included the features of reptiles and amphibians. Conclusion. The image of the lizard carried out patronizing, protective and therapeutic functions in relation not only to pets, but also to people. The importance of the lizard to the culture of the Khakass people was so great that its image was included into the traditional Khakass calendar “muchel”. The latter was based on a twelve-year animal cycle. In the perception of the people, “kiles chili” – ‘the year of the lizard’ – was considered a good period.

The purpose of this article is to analyze the particular characteristics of the Spanish language in Uruguay, which is a variety of the Spanish language in Rio de la Plata (Argentina, Chili, Paraguay) and represents a special interest for the linguists, professors of Spanish language and foreign experts who go to work in Uruguay. We analyze the history of this particular language variety beginning from the epoch of the Spanish conquest, the influence of the local American languages (in particular of the Guarani Indians), as well as the Italian language and its dialects due to an important immigration from this country. We also pay attention to the phenomenon of the bilingualism, in other words the influence of the Portuguese language (the well-known “Portunol”) and the influence of the French language after the French immigration of the XIX century that led to gallicisms in Spanish language. All these facts provoked such linguistic characteristics as “an untypical use of some pronouns, a less rhythmical intonation and a very special vocabulary to compare with classical Spanish of Spain. The study is based on our own notes made during two trips to Uruguay, and on the “New Dictionary of Americanisms”, books of the history of Latin America and scientific works of the philologists who dedicated their studies to this subject.

In this paper, we propose to investigate one common adult representation of childhood that will serve both to reflect on and to problematize current and varied representations. As such, our object of study will always be a representation and not a substantialist definition. We propose to analyze the adult concept “child” from a critical perspective by reviewing it through a historical lens—that is, as it is expressed in the political and educational world of 19th century Chile, which, in turn, we can glimpse in the historical writings of Domingo Faustino Sarmiento. To carry out this journey, we propose three guiding thematic axes: 1) how all school apparatuses embody, configure and assume a certain identifiable representation of “child’ and childhood; 2) an analysis of the characteristics and objectives of the 19th century Chilean school apparatus, particularly in its function as a government device, or dispositif; 3) just how that dispositif becomes visible to inquiry in the historical record, particularly in what it can reveal to us about the image or images of childhood held by adults. To be understood by adults as a boy or a girl in Chile during that period is communicated in the historical record through a myriad of diverse sources, each requiring consideration in its context. Magazines, syllabaries, school textbooks and children's stories configure different perspectives on and attitudes toward childhood, which in turn are associated with the social origin of these documents and the purposes they embody. The images, ideas and signs of interaction that appear in these school documents act cumulatively to reveal a cultural image of “child” and aid us in understanding the political and socio-cultural significance attributed to that period in the human life-cycle. And while we cannot claim to have identified how all adults of 19th century Chile understood and represented childhood, such documents do offer insights into the beliefs and assumptions of the political and ruling classes

Au Chili, au XIXe siècle, les inspecteurs et les sous-délégués étaient les fonctionnaires qui rendaient justice aux plus bas échelons, à savoir respectivement dans les districts et les sous-délégations qui composaient la République. Ils étaient nommés par le gouverneur du département parmi les hommes sachant lire et écrire et dotés d’une certaine indépendance économique et d’une bonne réputation sociale. L’immense majorité n’avait aucune formation en droit ni même de connaissances juridiques : il s’agissait de juges legos, en opposition aux avocats des universités, les letrados. Ils instruisaient, uniquement à l’oral, des procès de montant minime et mineur ainsi que, dans le cas des sous-délégués, des affaires criminelles légères ; en d’autres termes, les procès les plus courants et les plus nombreux. En outre, ils assumaient des prérogatives administratives et policières larges, cumul unique de fonctions qui les rendaient responsables de l’ordre public dans leur circonscription. Tout ceci, sans aucune rémunération ni gratification de la part de l’État : il s’agissait en effet de charges honorifiques, assumées gratuitement. [...] Au regard de ces évolutions, la figure administrative du juge de campagne semble être « à contre-courant », ce que n’ont pas manqué de remarquer les juristes éclairés de l’époque. Dès lors, cette thèse s’interroge sur la permanence de ce fonctionnaire pendant toute la période étudiée entre le Règlement d’administration de justice de 1824 et la Loi d’Organisation et d’attribution des Tribunaux de 1875. Elle cherche également à comprendre le sens et le poids de cette fonction, à rendre compte de son activité et des conditions dans lesquelles elle s’exerçait, à imaginer son efficacité et son acceptation au sein de la communauté, autant d’éléments qui peuvent contribuer à sa longévité. Deux terrains d’études ont été privilégiés pour leur valeur représentative de différents types de campagnes chiliennes : le département de Curicó, vallée d’agriculture commerciale et d’exportation traditionnelle, et le département de Copiapó, désert minier inséré dans l’économie capitaliste. [...] Certaines de ces sources sont inédites, en particulier, les rapports de visites judiciaires, les affaires judiciaires, les correspondances administratives qui permettent de rendre aux juges de campagne leur «visage humain». En somme, elles aident à comprendre comment se fit la construction de l’État dans les campagnes, depuis l’angle de vue de ces dernièresIn Chile, during the nineteenth century, inspectors and sub-delegates were civil servants who served justice to the lowest strata – namely in the districts and the sub-delegations that formed the Republic. They were appointed by the governor of the province and were men who could read and write, enjoyed a certain economic independence and had decent social status. Most of them had no legal training nor knowledge: they were lego judges, as opposed to university lawyers, the letrados. They were conducting minor trials orally and, in the case of sub-delegates, light indictable cases; that is to say the most common and numerous ones. In addition, they held wide administrative and police entitlements which combined roles making them responsible for public order within their constituencies. All this, without any remuneration or gratuity from the State: such positions were in fact honorary charges, performed for free. [...] In view of these developments, the administrative feature of the county judge was appearing to “go against the grain”, which got noticed by the enlightened jurists of the time. Therefore, this thesis questions the permanence of these civil servants throughout the studied period, i.e. between the Justice Administrative Rules of 1824 and the Judiciary and Judicial Appointment Law of 1875. It also seeks to understand the meaning and credence of this function, to report on its activity and the conditions under which it was exercised, to imagine its effectiveness and its acceptance within the community – all of which being potentially able to contribute to its longevity. Two fields of study were favored in view of their representative value of the Chilean countryside: the Curicó province, a valley marked by commercial agriculture and traditional export, and the Copiapó province a mining desert well included in capitalist economy. [...] The studied “maladministration-of-justice” cases show that, before punishing and penalizing, the letrado judge attempted to advise and to guide his lego judges. Custodians of a valuable "know-how", these "ignorant" of the Law proved to be absolutely necessary for the maintenance of law and order. They acted – in more or less regulatory procedural terms – upon the daily life conflicts and disputes of their community as revealed through the sources (some of them being previously unpublished). Moreover, reports of judicial visits, court cases and administrative correspondence allow us to see county judges with a "human face". In short, they provide a way to understand how the state formation took place, in the countryside and from the latter’s own point of view
En Chile, en el siglo XIX, los inspectores y los subdelegados eran los funcionarios que administraban justicia a escala territorial local, es decir,respectivamente en los distritos y en las subdelegaciones que componían la República. Eran nombrados por el gobernador del Departamento entre los hombres que sabían leer y escribir, que eran dotados de cierta independencia económica, y que gozaban de buena reputación social. La gran mayoría de ellos no poseía una formación en derecho y tampoco conocimientos jurídicos:eran jueces “legos”, en oposición a los abogados de las universidades, los“letrados”. Inspectores y subdelegados conocían, solamente de forma verbal,juicios de mínima y menor cuantía. En el caso de los subdelegados, estos también conocían delitos leves; es decir, los juicios más comunes y numerosos.Por otra parte, inspectores y subdelegados asumían prerrogativas administrativas y policiales amplias, manejando un cúmulo único de funciones,que los hacía responsables del orden público en su circunscripción. Todo esto,sin ninguna remuneración ni gratificación de parte del Estado: se trataba en realidad de cargos concejiles, asumidos gratuitamente.Considerando estas evoluciones, la figura administrativa del juez rural parece estar a “contracorriente”, lo que fue muy bien percibido por los juristas ilustrados de la época. Cette thèse porte sur les pratiques de recherche sur l’aliénation mentale déployées principalement à la Casa de Orates de Santiago, la première institution dédiée à la prise en charge et au traitement médical de la folie au Chili. La période s’étend de 1852, avec la création de cet asile, à 1937, avec les premières Journées Neuropsychiatriques Panaméricaines. Plus précisément, il s’agit de montrer l’émergence et le développement des recherches sur l’aliénation mentale menées par les aliénistes chiliens et de décrire les mécanismes utilisés pour les diffuser et les légitimer. La collecte de données médicales et l’élaboration de rapports statistiques figurent parmi les principaux éléments de cette histoire, puisque c’est à partir d’eux que la recherche sur l’aliénation mentale prend forme. En ce sens, le matériau d’analyse le plus important est constitué par deux rapports de statistique médicale produits en série entre 1895 et 1932, à savoir les Mouvements et les Mémoires de la Casa de Orates. Tout au long de cette thèse, le processus d’élaboration de ces textes sera exposé, en décrivant les caractéristiques de leur mise par écrit et les effets qu’ils ont eus à la fois sur le fonctionnement de l’asile et sur le champ scientifique de la médecine. Cette formulation repose sur l’assomption que le développement de la recherche sur l’aliénation mentale n’est pas seulement concomitant aux transformations matérielles de l’asile, mais que les deux éléments se conditionnent mutuellement, d’où la nécessité de les analyser à partir de leurs points de rencontre, de leurs influences réciproques. D’un point de vue méthodologique, il ne s’agit pas seulement d’utiliser les sources historiques pour reconstruire les pratiques de recherche, mais aussi d’enquêter sur l’histoire des sources elles-mêmes : comment ont-elles été produites, quels acteurs ont été impliqués et selon quelles procédures ? La formation des supports et des instances de débat scientifique par lesquels passe la recherche sur l’aliénation mentale, comme les revues scientifiques ou les congrès, sera également étudiée. Enfin, on montrera que le questionnement sur la folie ne relève pas exclusivement de l’aliénisme asilaire ou de la psychiatrie, mais aussi d’une série de disciplines connexes, comme la neurologie et la médecine légale, qui ont joué un rôle décisif dans la légitimation, l’institutionnalisation et la standardisation de la recherche sur l’aliénation mentale, tant au Chili qu’à l’échelle internationaleThis thesis deals with the research practices on mental alienation deployed mainly in the Casa de Orates in Santiago, the first institution dedicated to the care and medical treatment of insanity in Chile. The period runs from 1852, with the creation of this asylum, to 1937, with the first Pan-American Neuropsychiatric Conference. Specifically, the idea is to portray the emergence and development of research on mental alienation undertaken by Chilean alienists and to describe the mechanisms used to disseminate and legitimise it. The collection of medical data and the elaboration of statistical reports are among the main elements of this history, since it is from these that the research on mental alienation takes shape. In this sense, the main material for analysis is constituted by two medical statistical reports produced serially between 1895 and 1932, namely the Movements and the Memoirs of the Casa de Orates. Throughout this thesis, the process of production of these texts will be outlined, describing the characteristics of their production and the effects they had both on the functioning of the asylum and on the scientific field of medicine. This formulation is based on the assumption that the development of research on mental alienation is not only concomitant with the material transformations of the asylum, but that both elements mutually condition each other, which is why it is necessary to analyse them from their points of encounter, from their reciprocal influences. From a methodological point of view, the aim is not only to use historical sources to reconstruct research practices, but also to investigate the history of the sources themselves: how were they produced, which actors were involved and by what procedures? The formation of media and instances of scientific debate through which research on mental alienation moves, such as scientific journals or congresses, will also be studied. Finally, it will be shown that the questioning of madness is not exclusively a matter for asylum alienism or psychiatry, but also for a series of related disciplines, such as neurology and legal medicine, which played a decisive role in the legitimisation, institutionalisation and standardisation of research on mental alienation, both in Chile and at the Pan-American level

Cette thèse porte sur la configuration visuelle de la Cordillère des Andes dans la culture et l'histoire de l'art de l'Argentine et du Chili au cours du XIXe siècle. Elle propose un parcours thématique de la période à partir d'une sélection d'objets visuels et textes produits dans les deux pays au moment où ils ont été définis et instaurés en tant que nations modernes. Dans le début de ce parcours, aux premières années de l'époque républicaine, la cordillère est représentée et symbolisée comme le scénario des principaux événements de la révolution d'indépendance, alors elle devienne un point de repère pour la construction d'une mémoire et d'une identité nationale. L'analyse se poursuit autour de la présence picturale de la cordillère, notamment dans quelques œuvres qui représentent les Andes comme un lieu d'enjeu politique pour ces deux nations vers la moitié du siècle. Avec l'instauration de la cordillère comme une image paysagère, une réflexion a été élaborée autour du statut esthétique du sublime et ses actualisations dans le contexte latino-américain en considérant la particulière installation du genre picturale dans le milieu chilien. Le parcours s'achève avec l'analyse de la construction visuelle de la cordillère en tant que frontière naturelle entre les deux pays. On observe comment des images de divers types deviennent des pièces argumentatives pour la dispute géopolitique. Le but de ce travail est de vérifier, par le biais de l'analyse de cas, la diversité de fonctions rhétoriques qui assume la représentation de la nature dans le processus d'élaboration d'un récit du nationalThis thesis focuses on the visual configuration of the Andes in the history of culture and art of Argentina and Chile during the nineteenth century. It proposes a thematic journey of the period from a selection of visual objects and texts produced in both countries at the time when they were defined and established as modern nations. At the beginning of this journey, in the early years of the republican era, the Cordillera is represented and symbolized as the scenario of the main events of the independence revolution, so it becomes a landmark for the construction of a memory and a national identity. The analysis continues with the pictorial presence of the Cordillera, particularly in some works representing this Andes as a place of political stake for these two nations at the middle of the century. With the establishment of the Cordillera as a landscape image, a reflection has been elaborated around the aesthetic status of the sublime and its updates in the Latin American context by considering the installation of the pictorial genre in the Chilean environment. The journey ends with the analysis of the visual construction of the Cordillera as a natural border between the two countries. It is observed how images of various types become argumentative pieces for the geopolitical dispute. The purpose of this work is to verify, through case studies, the diversity of rhetorical functions that assumes the representation of nature in the process of developing a national narrative

Depuis les diagnostics qui soulignent l’autoritarisme du processus du construction de la République moderne au Chili, notre recherche parcourt les discours et résistances face à l’humour déployés dans le XIXème siècle. Afin de déployer cette hypothèse, nous développons quatre sections. Dans la première, nous exposons quelques discussions sur l’humour dans la littérature et la philosophie européenne, depuis Aristophane jusqu’à Derrida. Dans la deuxième section, nous commençons à exposer les politiques de l’humour développées au Chili, depuis l’Independence. Dans la troisième section, nous examinons les écrits de certains auteurs argentins qui passent par le Chili et critiquent l’agenda conservatrice. Finalement, nous présentons les politiques de l’humour qui, progressivement, s’opposent aux gouvernements conservateurs et libéraux Nous concluons notre travail avec l’affirmation d’une langue humoristique, dépourvue d’une prétention de savoir et critique, donc, de la langue dominante contemporaine: Starting from specific considerations about the authoritarian construction of the modern Republic in Chile, our thesis researches the discourses and resistances to humor developed throughout the Chilean nineteenth century. To develop this hypothesis, we propose four sections. First, we show certain debates on humor and comedy in the history of European literature and philosophy, from Aristophanes to Derrida. In the second section, we start by presenting different politics of humor in Chile since its Independence. In the third section, we read the works of some Argentine authors who pass through Chile questioning Chilean conservatism. Finally, we present the politics of humor that progressively criticize the conservative and liberal governments. Finally, we conclude thinking in a humorist language foreign to knowledge, critic of the contemporary dominant language
A partir de ciertas consideraciones sobre el carácter autoritario de la construcción de una República moderna en Chile, nuestra tesis indaga en los discursos y resistencias ante el humor que se desarrollan a lo largo del siglo XIX chileno. Intentamos mostrar que ese orden rechaza las formas del humor que puedan poner en crisis el saber con el que se desea construir la República. Los intelectuales más destacados de ese entonces apelan a una lengua certera, que pueda distinguir la verdad de la ilusión, y así reír de quienes la confunden. Se trata de un humor muy seguro de sí, que será progresivamente cuestionado por quienes comienzan a criticar ese orden político y literario.Para desplegar esta hipótesis, desarrollamos cuatro secciones. En la primera, exponemos algunos debates sobre el humor y la comedia en la historia de la literatura y la filosofía en Europa, desde Aristófanes hasta Derrida. Con particular énfasis en los vínculos entre humor literario y materialismo filosófico, tal recorrido nos permite mostrar el filo crítico que puede tener el humor.En la segunda sección, comenzamos a presentar las políticas del humor en Chile, desde la Independencia. En concreto, comentamos los trabajos de Camilo Henríquez, José Joaquín de Mora, Andrés Bello y Salvador Sanfuentes para mostrar cómo los procesos de Independencia y construcción de la República van acompañados de un humor más cercano a la sátira que a la ironía, dispuesto a alejar las tentaciones del romanticismo europeo discutido a mediados de siglo.En la tercera sección, comentamos las obras de algunos de los autores argentinos que pasan por Chile cuestionando la agenda de Bello, a saber, Domingo Faustino Sarmiento y Juan Bautista Alberdi, no sin antes contextualizarlos en los debates sobre el romanticismo en Latinoamérica y en la obra previa de Esteban Echeverría. De esta manera buscamos mostrar cómo el liberalismo de Sarmiento y Alberdi se establece también contra ciertas formas de experimentar en la lengua, a diferencia de los románticos europeos con los que se los suele asociar.Luego presentamos las políticas del humor que, progresivamente, se oponen a los gobiernos conservadores y liberales defendidos por Sarmiento y Alberdi. Recorremos los textos de José Victorino Lastarria, Carmen Arriagada, Guillermo Matta y Rubén Darío, quien durante su paso por Chile recoge algunas de las críticas de Arriagada y Matta hacen a un proceso de modernización que no hace espacio a la experimentación literaria.El humor aparece en Darío como una clave de crítica ante ese discurso utilitario, y así de crítica al liberalismo imperante, posición cuyos ecos pueden leerse en miradas posteriores sobre la cultura chilena. Entre ellas, la de Raúl Ruiz, con quien en las conclusiones exponemos la continuidad de cierta afirmación de una lengua humorística, crítica de cualquier pretensión certera del saber, y así de las formas dominantes de la lengua contemporánea

Nuestra obra tendrá como objeto, básicamente, reflejar la importancia de estas publicaciones jurídica como fuente relevante en nuestra legislación, permitiendo dar a conocer la opinión y el pensamiento de una gran cantidad de abogados que desde las aulas como catedráticos, o bien como litigantes hicieron un aporte al derecho nacional, durante la etapa de su formación y luego a partir del año 1857 en su fase de codificación.

As perguntas que a movem giram em torno de: avaliar como se deu o impacto desta experiência chilena, em suas distintas dimensões, no processo de escrita dos autores e, especificamente, na elaboração de seu discurso político; compreender o passado de cada um em relação à região do Prata; refletir em que medida os projetos que ambos realizaram para Argentina são tributários especificamente desta passagem pelo Chile e de seu envolvimento com a imprensa.The purpose of this research is to investigate the conformation of the Republican discourse of Domingo Faustino Sarmiento and Juan Bautista Alberdi in the Chilean press during their exile between 1841 and 1852. The questions that concern to it are about: evaluate how was the impact of the Chilean experience in its various dimensions in the authors writing process and specifically in the development of its political discourse; understand the past of each one in relation with the Prata region; reflect about how the projects each one proposed to Argentina are specifically affected by this passage by Chile and their involvement with the press.

A presente dissertação de mestrado desenvolve um estudo sobre Descobrimiento i Conquista de Chile, Los Precursores de la Independencia de Chile e La Crónica de 1810, de Miguel Luís Amunátegui (1828-1888). Essas obras foram publicadas entre 1861 e 1889 e abrangem quase a totalidade de sua trajetória intelectual e política. Além disso, constituem contribuições pioneiras, dentro do âmbito profissional e acadêmico, de uma interpretação coerente e sistematizada sobre o passado e a independência do Chile. Este trabalho discute o contexto político e cultural em que essas obras foram escritas, investigando como seu modelo historiográfico se aproxima ou se distancia dos predominantes em seu tempo. Busca também refletir sobre a maneira pela qual Amunátegui traduziu, em suas interpretações históricas, sua luta política em prol do liberalismo. Trata-se, enfim, de lançar luz sobre um importante legado da escrita da História no Chile do século XIX.The Masters thesis herein presented develops a study of Descobrimiento i Conquista de Chile, Los Precursores de la Independencia de Chile and La Crónica de 1810, by Miguel Luís Amunátegui (1828-1888). Published between 1861 and 1889, these books encompass most of his historical and political thinking. They also figure among the first contributions to the professional and academic scenario which presented a coherent, systematized interpretation of Chiles past and independence. This article approaches the cultural and political scenario in which they were written, investigating how their historiographic model relates to the predominant ones in his days. It is also an attempt to reflect upon how Amunátegui applied his liberal-oriented political struggle into his historical interpretations. Eventually, this article aims at shedding light on an important legacy for Chiles History writing in the 19th century.

AbstractIn 2018, on the eve of the Trump administration’s trade war against China, the Xi administration inaugurated a ban on most plastic waste imports. Set in a small family-run plastic waste processing factory, Wang Jiuliang’s documentary Plastic China (2016) was rumored to have been an impetus for the ban. Approaching Plastic China as a cinematic portrayal of hinterlands, this chapter considers how ecocritical momentum is produced in the film by juxtaposing an aesthetics of the toxic sublime and a temporality of stagnation with the child as a figure of innocence and potentiality. Such waste and waste-times are not exclusive to China, but point to a reluctantly shared body between post/socialist and late capitalist worlds, as stubborn materials move through the intimate organs of the global digestive system.

González Prada (1844-1918) fue uno de los más influyentes pensadores peruanos de fines del siglo XIX e inicios del siglo XX y a pesar de haber nacido en el seno de una acomodada y poderosa familia conservadora y católica, sus reflexiones sobre la condición humana se mantuvieron siempre dentro del marco del pensamiento científico. Por ello fue un escéptico, aunque con declarada simpatía por el positivismo. En su pensamiento político, de una primera etapa nacionalista que se derrumba cuando presencia la cobardía y oportunismo de los grupos de poder enquistados en el Perú frente a la propia población peruana, durante la guerra con Chile (1879-1883), pasa a una etapa anarquista de reflexión más profunda.

Mass, compulsory and free primary education is one of the most important achievements of civilization, which is recognized in a whole series of international treaties on human rights. In this sense, the minimum core obligations of states is to provide every child with access to primary education within the framework of the right to education, as an expression of formal education and a key segment of the child's right to education in general. On the other hand, the parents or guardians of the child have the duty to educate the child. Parents are granted the autonomy to do so in accordance with their religious and moral convictions if they do not violate the rights of the child and the aims of education proclaimed in international human rights treaties. In this context, parents have the obligation to make primary education available to their children, while retaining the right to choose a public or appropriate private primary school in accordance with the law. In an effort to enable the application of the best interests of the child to each specific child, the legislation of Serbia in the domain of primary education also recognizes forms of schooling at home or at a distance, but only if the child has previously been enrolled in primary school. Parents cannot refuse to enroll a child in primary school, although the sanctions provided for such behavior are ineffective. In this way, parents could not decide to take over exclusively the provision of primary education services to the child, referring to their religious or philosophical convictions. In such cases, the Family Law of Serbia can offer a more adequate approach to solving the problem in the form of measures of corrective supervision over the exercise of parental rights and, ultimately, court decisions on protecting the child's right to education or depriving the parents of their duty to educate the child.

Minors who have reached the age of 15 have the right to enter into an employment relationship under certain special conditions. By limiting the age limit for entering into an employment relationship, the state protects minors from the possible exploitation of child labor and other negative consequences that may endanger the life, health, morals and education of minors. In the paper, the author will point out the importance of protecting the best interests of the child in the world of work. The Labor Law prescribes special conditions that must be met in order for minors to be able to enter in to an employment relationship. The paper presents special conditions for entering into an employment relationship with this category of people, such as the minimum age, the consent of the legal representative and protection from jobs that endanger the minor's health, morals and education. Due to the specificity of this employment relationship and the importance of protecting the rights of minors, Directive No. 94/33/EC prescribes numerous rules and restrictions regarding working with minors. In this paper, the author will analyze the legal framework and the importance of respecting these rules in establishing an employment relationship with a minor.

A surrogate mother is a female person who helps couples and individuals become parents by carrying a pregnancy instead of a woman, in situations where a woman who wants to have a child faces certain gynecological problems or there are other medical reasons why she cannot have a child The most common indication for surrogacy is the lack of a uterus, which can be congenital or acquired after surgery, with the presence of one or both ovaries. Other medical indications are various serious illnesses, as a result of which the woman's life would be endangered in the situation of pregnancy. Surrogacy is accompanied by not only legal, but also numerous ethical and moral dilemmas, and in Europe it is allowed in only a few countries. Governments in most countries vote to ban all surrogacy arrangements outright, and in some jurisdictions there are civil and criminal penalties for people who do choose to enter into such arrangements, because in these states surrogacy is prohibited, regardless of whether it is based on altruistic reasons or it is in commercial purposes. In other countries, surrogacy is permitted, but only if based solely on an altruistic purpose, thereby prohibiting commercial surrogacy. In the paper, the author provides an overview of the current state of legal regulation in this area in some European countries, with reference to the proposed novelties that provide for the preliminary draft of the long-announced and still unadopted Civil Code of the Republic of Serbia, which concerns the introduction of surrogacy into our law. After 17 years of work on this Code, one of the most difficult issues to reach consensus on, aside from euthanasia and same-sex marriage, is surrogacy.

The social protection service of a child's personal companion represents the provision of appropriate individual practical support to the child for inclusion in regular schooling, and activities in the community, in order to establish the highest possible level of independence. The Social Protection Law does not explicitly prescribe this service, but it belongs to daily services in the community. Supported housing for people with physical disabilities, intellectual or mental difficulties, is the assurance of appropriate accommodation, professional assistance and support in gaining the highest degree of independence that enables them to live a better independent life in the community. The paper presents the normative arrangement of the services of a child's personal companion and a supported housing in Serbian law and comparative law with observed shortcomings and a proposal to amend the regulations.

A história da arte na América Latina, bem como o estudo do estatuto da imagem nos países de colonização ibérica, é indissociável das análises em torno da circulação e difusão de teorias, modelos e pessoas no continente, desde o período colonial. No século XIX, esse movimento está vinculado às estreitas relações entre arte e política, no momento de consolidação dos processos de independência e de afirmação de projetos de nacionalidade nos novos Estados. O presente trabalho procura desenvolver as idéias acima, acompanhando as trajetórias de dois artistas estrangeiros, cuja atuação foi de extrema significação para os contextos artísticos do Brasil e do Chile em meados do s. XIX: Alessandro Ciccarelli e Raymond A. Quinsac de Monvoisin.

Um empreendimento de Habitação de Interesse Social (HIS) tem como função dar um uso ao espaço urbano que promova sustentabilidade socioambiental. Para que isto aconteça de forma permanente, aspectos como inclusão social, acesso a condições dignas e saudáveis de moradia, melhoria das condições econômicas da comunidade e melhor investimento dos recursos naturais ali aplicados são indispensáveis. O objetivo desta pesquisa foi identificar inovação social comum a três empreendimentos de arquitetura incremental em HIS realizados no Chile, Índia e Colômbia. Deste processo foram identificadas cinco inovações sociais.

Este artículo analiza los enfoques y rasgos centrales de política económica y productiva de seis gobiernos progresistas en América Latina: Argentina, Brasil, Bolivia, Chile, Colombia y México. El análisis atraviesa seis grandes ejes: la gestión macroeconómica, el posicionamiento en el escenario internacional, la articulación entre Estado y mercado, la gestión de los recursos naturales, la ampliación de la matriz productiva y las nuevas agendas de ambiente, género e igualdad. El estudio muestra que, si bien existen algunos puntos en común, también es posible hallar divergencias importantes, dificultades técnicas y políticas para avanzar en las agendas de reformas y logros parciales en las agendas productivas. De manera llamativa, las fuerzas que se autoperciben progresistas han tenido dificultades para estructurar un abordaje neodesarrollista, acorde con los desafíos del siglo XXI, con una prudente distancia tanto de los enfoques neoliberales como de los sesgos estatistas, persistiendo formas híbridas con resultados ambiguos y limitaciones.

This paper discusses the main issues concerning sovereign fiscal and financial risks from public–private partnerships (PPPs) with a focus on contingent liabilities (CLs). It is based on the presentations and discussions that took place during the XI Annual Meeting of the Group of Latin American and the Caribbean Debt Management Specialists (LAC Debt Group), held in Barbados in August 2015. The main issues discussed include PPP risks assessment, institutional framework for PPP risk management, and accounting and reporting of CLs generated by PPPs. Six country cases (Chile, Colombia, Costa Rica, Honduras, Suriname, and Turkey) are presented to illustrate experiences with different degrees of development regarding the management of risks and CLs related to PPPs. The document concludes that PPP risk management should encompass the whole lifecycle of a PPP project, risks need to be identified and CLs must be estimated and monitored, and the institutional capacity of governments to evaluate and manage PPP risks plays a central role in the successful development of PPP contracts. Although institutional capacities in this regard have improved in recent years, estimations of CLs involved in PPPs are not regularly performed, and there is still room for improvement on the assessment, measurement, registration, budgeting, and reporting of risks and CLs related to PPPs.

This document is a collection of available data on solid waste management in Latin America and the Caribbean (LAC). The following bullet points contain a brief description of the most relevant data: The regional average per capita generation of Domestic Solid Waste (DSW) and Municipal Solid Waste (MSW) is 0.6 kg/cap/day and 0.9 kg/cap/day, respectively. DSW represents, on average, 67% of the MSW generated in the region. The MSW regional average collection rate is 89.9% (as a percentage of the population). Compared with a worldwide average of 73.6%, LAC has a high level of coverage, reflecting the priority the region gives to this service. LAC's coverage is higher than that of Africa (46%), South Asia (65%), and the Middle East and Northern Africa (approximately 85%). Argentina, Chile, Colombia, Dominican Republic, Trinidad & Tobago, Uruguay and Venezuela have MSW collection rates close to 100% (universal coverage). About 53% of LAC's population receives 2to-5-days a week waste collection service, 45% daily service and 2% once-a-week service. Separate MSW collection, commonly known as selective collection is still uncommon in the region. However, there are cases like that of Brazil, where 62% of municipalities implement selective MSW collection programs. Average unitary collection costs have been estimated at US$34 per collected ton, with high cost variance between countries. For example, the cost in Argentina is US$54, while in Paraguay is only US$6.6 (a US$47 difference). These variations typically reflect differences associated with the (higher-lower) quality of service. Adequate MSW final disposal coverage (i.e., in landfills) is approximately 55% (as a percentage of the population), which means that there is still a large amount of waste that is not disposed and/or treated adequately (45%). The average final disposal cost is US$20.4 per ton disposed. There is a first group of countries where disposal costs are around US$10 (US$5.6 in Ecuador, US$11.4 in Chile), a second group where it costs around US$20 (US$18.8 in Costa Rica, US$23.3 in Colombia), and then there¿s Brazil, where costs are, on average, considerably higher (US$31.5). In several LAC countries MSW management costs are directly afforded by the municipality. The average cost recovery is 51.6%xii. Municipalities typically use property taxes as the main revenue collection system. This collection mechanism represents 52.1% of the total, followed by direct billing to users, with 20.2%; the electricity bill (15.3%); and the water & sanitation bill (12.4%).

Este informe presenta y describe una nueva base de datos generada en torno a cuarenta indicadores que caracterizan los regímenes migratorios de los 26 países de América Latina y el Caribe que son miembros prestatarios del BID. Los indicadores permiten realizar una comparación multidimensional de dichos regímenes, identificar patrones subregionales, y observar tendencias en la evolución reciente de estas políticas. Los indicadores se agrupan en seis áreas: instrumentos internacionales que cubren la participación de cada país en tratados y acuerdos multilaterales; instrumentos regionales que analizan la participación de los países en acuerdos a nivel de las Américas y sus subregiones; derecho a la entrada con exención de visado que mide la exigencia de visados para entrar al país; acceso a la residencia que abarca preferencias en el otorgamiento de permisos de residencia y procesos de regularización de migrantes en situación irregular; derechos durante la residencia que investigan el acceso de migrantes a servicios de salud y educación, al mercado laboral, al sufragio, así como a la residencia permanente; y nacionalidad que miden como se obtiene la nacionalidad de un país en el momento del nacimiento o, posteriormente, mediante la naturalización, así como la posibilidad de ostentar dos nacionalidades. El valor asignado a cada indicador para cada país está sustentado por una referencia a los instrumentos jurídicos que definen la política en cuestión y, en la mayoría de los indicadores, se acompaña de un texto con información adicional que explica el caso en concreto. Esta es una base de datos única para la región y se encuentra incluida en el Anexo II de este informe. También se puede acceder a la misma a través de la página web de la Unidad de Migraciones del BID. Los principales hallazgos del análisis de la base de datos son: Se observa un emergente régimen jurídico migratorio latinoamericano del siglo XXI. Este se caracteriza por la adopción de nuevas leyes de migración, generalmente acompañadas por esquemas subregionales de movilidad como el Acuerdo de Residencia Mercosur, Bolivia y Chile, y más recientemente el Estatuto Andino. Este nuevo modelo del siglo XXI incluye generalmente mecanismos permanentes de regularización de migrantes, el derecho de acceso al mercado laboral, los sistemas de salud pública, la educación pública, así como el derecho de reunificación familiar. Esto se ve complementado con un mayor acceso al derecho al voto, al menos en elecciones locales. Si bien hasta la fecha no se observa que este modelo latinoamericano haya tenido influencia en el Caribe, el mismo está claramente arraigado en las otras tres subregiones. La regularización de migrantes en situación irregular, tanto a través de mecanismos permanentes establecidos en las leyes, como a través de programas extraordinarios de regularización, es absolutamente común en América Latina, aunque no así en el Caribe. Los países de la región han llevado a cabo más de 90 regularizaciones extraordinarias desde el año 2000. Muchos de los países ofrecen acceso preferencial a la residencia permanente para migrantes de ciertos países de la región que cumplan criterios básicos, y, en algunos casos, trato preferencial para la nacionalización. Los únicos países que no permiten la residencia de manera casi automática para nacionales de al menos otro país de la región son Bahamas y Haití en el Caribe, así como Costa Rica, Guatemala, Honduras, Nicaragua, Panamá, República Dominicana y México en Mesoamérica. El porcentaje de ratificación de los instrumentos internacionales, al igual que los instrumentos regionales, es muy alto en Latinoamérica, pero mucho menor a nivel subregional en el Caribe. Los acuerdos de libre residencia y movilidad regional se han convertido es un instrumento absolutamente común en el panorama legislativo de la región, e influyen sobre muchos aspectos de la política migratoria, tales como acceso al mercado laboral o reunificación familiar. El país que requiere visas a los nacionales de más estados en la región es Venezuela con 11, seguido de México con nueve. El caso venezolano puede explicarse por su aplicación del principio de reciprocidad con los estados que solicitan visa a sus nacionales. El hecho de ser un país de tránsito hacia los Estados Unidos para algunos migrantes puede explicar el caso mexicano. El estado cuyos nacionales requieren visa en más países de la región es Haití, seguido de Venezuela y República Dominicana. En el desarrollo de la base de datos a través de los 40 indicadores se han analizado más de 435 instrumentos jurídicos de los 26 países, los cuales definen su política migratoria. El análisis de este compendio de leyes, reglamentos, decretos, ordenes administrativas, y demás instrumentos demuestra que: La edad promedio de los instrumentos jurídicos vigentes en países andinos y del Cono Sur es de 8-15 años, lo cual se compara con los 25-30 años en Mesoamérica y el Caribe. Esto demuestra una mayor labor legislativa sobre la materia en dichas dos subregiones en los últimos años. En algunas áreas, tales como la regulación del régimen de visas o los procesos extraordinarios de regularización de migrantes en situación irregular, la actividad legislativa se apoya principalmente en decretos y ordenes administrativas adoptadas por el poder ejecutivo sin intervención de los parlamentos. Esto genera reglas con menor estabilidad y certeza jurídica para todos los actores involucrados: migrantes, administración, poder judicial y otros. Esta base de datos de indicadores e instrumentos jurídicos es parte de un esfuerzo de la Unidad de Migraciones del BID de contar con información y evaluación comparada de los regímenes de política migratoria en los países de la región entre otros insumos jurídicos e institucionales. La Unidad mantendrá la base de datos actualizada con el objetivo de que se convierta en un punto de referencia fundamental para la región.
