La plongée militaire totalise 2 200 personnels dont certains sont spécialisés en opérations de déminage ou en contreterrorisme maritime. En parallèle, la plongée civile s’est considérablement développée ; de nombreux accidents surviennent malgré le respect des procédures et de nouvelles entités cliniques émergent. Ainsi la médecine de la plongée civile ou militaire suscite de nouvelles interrogations à l’origine d’une activité de recherche importante. Cette activité est menée de manière collaborative par l’Équipe résidente de recherche subaquatique opérationnelle de l’IRBA, le Service de médecine hyperbare et expertise plongée de l’HIA Sainte-Anne et la Cellule plongée humaine et intervention sous la mer de la FAN, et associée à des partenaires universitaires et industriels. Les actions menées concernent principalement l’étude de la décompression, de l’effet des gaz, la physiologie de l’immersion de longue durée. L’activité de recherche en médecine de la plongée a pour finalité une application opérationnelle immédiate illustrée par le développement de procédures pour le sauvetage des sous-marins. Par l’intérêt civil majeur associé, elle constitue un exemple de recherche duale.

Astăzi problema protecţiei drepturilor și libertăţilor omului a depășit graniţele unui stat separat. Drepturile și libertăţile au devenit o problemă pentru întreaga comunitate mondială. Același lucru este valabil și pentru dreptul la asistenţă juridică, care este un aspect esenţial al dreptului la un proces echitabil, garantat de numeroase acte internaţionale, cu caracter atât universal, cât și regional. Conform standardelor stabilite prin aceste acte și elaborate de Comitetul pentru Drepturile Omului ONU și Curtea Europeană, în unele cazuri lipsa asistenţei juridice în procedurile civile poate afecta semnificativ echitatea acesteia. În astfel de cazuri, obligaţia de a acorda asistenţă juridică îi revine statului. În această lucrare autorul explorează și rezumă criteriile internaţionale pentru acordarea de asistenţă juridică garantată de stat în procedurile civile și experienţa străină în aplicarea acestora. Cercetarea poate avea o oarecare valoare atât în activităţile legislative, cât și în cele de aplicare a legii.

Résumé.Cette recherche a pour objectif d'expliquer le changement et la continuité dans les stratégies de développement économique après la révolution islamique en Iran. Le modèle explicatif est le suivant : la configuration et l'interaction particulière de quatre facteurs expliquent le choix et le changement dans les stratégies de développement économique en Iran : l'État, la société civile, le système mondial et les idées. À partir de 1989, la Deuxième République annonce des changements importants dans l'État islamique et dans ses relations avec la société civile islamique, d'un côté, et avec le système international, de l'autre. Ces changements en ont entraîné d'autres dans les stratégies de développement et ont eu pour résultat l'application d'une nouvelle stratégie de développement. Cette nouvelle stratégie a deux volets importants : les programmes de stabilisation économique et les programmes d'ajustement structurel.Abstract.This research aims to explain change and continuity in the strategies of economic development after the Islamic revolution in Iran. The explanatory model is as follows: the particular configuration and interaction of four factors explain the choices and changes in the strategies of economic development in Iran: the state, civil society, the world system and ideas. Starting in 1989, the Second Republic announced important changes in the Islamic State and its relations with civil society on one side, and with the international system on the other. These changes involved other changes in the strategies of development and the application of a new strategy of development. This new strategy has two important facets: programs of economic stabilization and programs of structural adjustment.

Depuis un peu plus d'une décennie le franchisage a connu un essor considérable dans les milieux du courtage immobilier. La législation actuelle en ce domaine ne prévoit pas ce genre de structure de sorte que le franchiseur n'y semble pas assujetti. La nature de la responsabilité de ce dernier vis-à-vis les tiers est par conséquent problématique. Nous nous sommes donc interrogé sur la possible application des thèses classiques de la responsabilité du commettant et du mandat apparent. Ainsi, alors qu'à priori on soit tenté de rejetter l'application de ces thèses au fait du franchisage, il est apparu d'une part que les fondements de l'article 1054, al. 7, C.C. peuvent recevoir écho dans la relation franchiseur/franchisé et, d'autre part, que l'application jurisprudentielle de l'article 1730 C. C. va bien au-delà de ce qu'une interprétation stricte du texte autoriserait.

Abstract: This article analyses how the Swiss 'Draft Project on the Revision and Unification of Civil Liability' (Widmer/Wessner Project) has influenced the new Turkish tort law of 2012. This influence is all the more noteworthy as the Swiss legislator decided in 2009 not to pursue the Widmer/Wessner Project. This paper focuses on the following three instances: (i) the vicarious liability for organizational defects in enterprises [Art. 66 of the Turkish Code of Obligations (TCO)], (ii) the extension of the personal scope of application of the liability for constructions (Art. 69 TCO), and (iii) the general clause of strict liability for abnormally dangerous activities (Art. 71 TCO). By adopting these innovative solutions, which are still being debated among Swiss scholars, the Turkish legal system has overtaken the Swiss model, at least to the extent of these new implementations. In a not so distant future, it might thus very well be that Turkish tort law will have some influence on the Swiss tort law system instead of the opposite. Resumé: Le présent article examine comment l'avant-projet suisse d'une loi fédérale «Révision et unification du droit de la responsabilité civile» (projet Widmer/Wessner) a influencé le nouveau droit turc de la responsabilité civile de 2012. Cette influence est d'autant plus surprenante que le législateur suisse a décidé en 2009 de ne pas donner suite au projet Widmer/Wessner. La présente contribution se concentre sur les trois exemples suivants: (i) la responsabilité pour le défaut d'organisation dans les entreprises [art. 66 du Code des obligations turc (TCO)]; (ii) l'extension du champ d'application personnelle de la responsabilité du propriétaire d'ouvrage (art. 69 TCO) et (iii) la clause générale de responsabilité objective pour des activités particulièrement dangereuses (art. 71 TCO). En adoptant ces trois solutions innovantes qui sont toujours débattues dans la doctrine suisse, le système juridique turc a dépassé le modèle suisse, en tout cas en ce qui concerne ces trois nouveautés. Dans un avenir plus ou moins proche, il se pourrait donc très bien que le droit turc de la responsabilité civile influence à son tour le droit suisse.

Majority of the nowdays societies consider that spreding of democracy, rather than limitation of state power, preserves freedom. This idea is in the contrary to antic idea of freedom as the essence of human being and its highest value. By such an idea, the society will be preserved from negative tendencies like democratic despotism (glorifiing power and authority as well as concetration of power in the hands of the leader), and decline of the highest values in global society. In antic polis ius civile used to be applied to free citizens only, rather than strangers, being slaves. As slaves, strangers had no any right recognised, and were acquisited like any other property. Slavery in Roman empire was considered as normal phenomena and was also approved mostly by social and biologic reasons. Ius gentium was, however, by spreading Empire to provncies, apllied to both citizens and strangers. Antic polis produced direct democracy, being ruling of the people, which was duty as well as the priviledge of the free citizens, thus, the priority were public obligations. Nowdays, however, democracy is considered individually, as a protection of individual, its property and private life.

Questo documento descrive gran parte del lavoro svolto durante un periodo di studio di sei mesi all’International Centre for Geohazards (ICG) di Oslo. Seguendo la linea guida dettata nel titolo, sono stati affrontati diversi aspetti riguardanti la modellazione numerica dei pendii quali l’influenza delle condizioni al contorno e delle proporzioni del modello, la back-analysis di eventi di scivolamento e l’applicazione delle analisi di stabilità monodimensionali. La realizzazione di semplici modelli con il programma agli elementi finiti PLAXIS (Brinkgreve et al., 2008) ha consentito di analizzare le prestazioni dei modelli numerici riguardo all’influenza delle condizioni al contorno confrontandoli con un calcolo teorico del fattore di amplificazione. Questa serie di test ha consentito di stabilire alcune linee guida per la realizzazione di test con un buon livello di affidabilità. Alcuni case-history, in particolare quello di Las Colinas (El Salvador), sono stati modellati allo scopo di applicare e verificare i risultati ottenuti con i semplici modelli sopracitati. Inoltre sono state svolte analisi di sensitività alla dimensione della mesh e ai parametri di smorzamento e di elasticità. I risultati hanno evidenziato una forte dipendenza dei risultati dai parametri di smorzamento, rilevando l’importanza di una corretta valutazione di questa grandezza. In ultima battuta ci si è occupati dell’accuratezza e dell’applicabilità dei modelli monodimensionali. I risultati di alcuni modelli monodimensionali realizzati con il software Quiver (Kaynia, 2009) sono stati confrontati con quelli ottenuti da modelli bidimensionali. Dal confronto è risultato un buon grado di approssimazione accompagnato da un margine di sicurezza costante. Le analisi monodimensionali sono poi state utilizzate per la verifica di sensitività. I risultati di questo lavoro sono qui presentati e accompagnati da suggerimenti qualitativi e quantitativi per la realizzazione di modelli bidimensionali affidabili. Inoltre si descrive la possibilità di utilizzare modelli monodimensionali in caso d’incertezze sui parametri. Dai risultati osservati emerge la possibilità di ottenere un risparmio di tempo nella realizzazione di importanti indagini di sensitività.

Nos travaux concernent les environnements virtuels de formation pour l'apprentissage en situation opérationnelle. Nus soutenons la thèse que ces environnements sont des sytsèmes multi-agents hétérogènes et ouverts. Nous proposons le modèle MASCARET pour structurer les interactions entre les agents et pour fournir aux agents les capacités réactives, cognitives et sociales leur permettant de simuler l'environnement physique et social composant l'univers virtuel de formation. L'environnement physique simule de manière réaliste les phénomènes que les apprenants et les formateurs doivent prendre en compte. L'environnement social est simulé par des agents réalisant un travail collaboratif et adaptatif; ils effectuent, en équipe, des procédures qu'ils doivent adapter à l'environnement. Les utilisateurs participent à l'environnement de formation via leur avatar. Pour valider notre modèle, nous avons développé l'application SécuRéVi destinée à la formation des officiers sapeurs-pompiers
This study concerns virtual environments for training in operationnal conditions. The principal developed idea is that these environments are heterogeneous and open multiagent systems. The MASCARET model is proposed to organize the interactions between the agents and to give them reactives, cognitives ans socials abilities to simulate the physical and social environment. The physical environment represent, in a realistic way, the phenomena that the learners and the teachers have to take into account. The social environment is simulated by agents executing collaborative and adaptative tasks. They realize, in team, the procedures that they have to adapt to the environment. The users participate to the training environment throught their avatar. To validate our model, the SecuRevi application for fire-fighters training is developed

This work provides several policy proposals capable to strengthen the private enforcement of EU competition law in arbitration. It focuses on the procedural law aspects that are permeated by legal uncertainty and that have not yet fallen under the scrutiny of the law and economics debate. The policy proposals described herein are based on the functional approach to law and economics and aim to promote a more qualified decision making process by: adjudicators, private parties and lawmakers. The resulting framework of procedural rules would be a cost-effective policy tool that could sustain the European Commission’s effort to guarantee a workable level of competition in the EU internal market. This project aims to answer the following broad research question: which procedural rules can improve the efficiency of antitrust arbitration by decreasing litigation costs for private parties on the one hand, and by increasing private parties’ compliance with competition law on the other hand?Throughout this research project, such broad question has been developed into research sub-questions revolving around several key legal issues. The chosen sub-research questions result from a vacuum in the European enforcement system that leaves several key legal issues in antitrust arbitration unresolved. The legal framework proposed in this research project could prevent such a blurry scenario from impairing the EU private enforcement of competition law in arbitration. Therefore, our attention was triggered by those legal issues whose proposed solutions lead to relevant uncertainties and that are most suitable for a law and economics analysis.

Les etudes experimentales liees aux ecoulements de fluides compressibles tres rapidement variables necessitent souvent l'utilisation de moyens importants et des preparations assez longues qui rendent leurs realisations particulierement couteuses. De ce fait, la simulation numerique constitue un complement interessant pour l'etude de ces phenomenes particulierement rapides. Un grand nombre de schemas numeriques ont ete developpes pour la resolution des equations d'euler qui sont les plus utilisees pour le calcul de tels ecoulements. Differentes techniques de maillage permettent la realisation de calculs sur des geometries particulierement complexes (structure multi-bloc, destructure, chimere, raffinement,). Nous presentons ici un outil numerique dont le role est de fournir rapidement des resultats permettant la determination des caracteristiques principales des ecoulements autour de configurations tridimensionnelles quelconques sans chercher a cerner les systemes d'ondes localises sur des petites echelles. La strategie de maillage repose sur l'utilisation d'une grille de fond cartesienne uniforme. Les parois des obstacles 3d plonges dans la grille vont entrainer une destructuration locale du reseau cartesien. La particularite de la methode reside dans la conception du calcul des intersections entre les surfaces triangulees des obstacles et le maillage cartesien : la geometrie de ces surfaces est conservee de facon exacte dans la reconstruction des cellules coupees.

Le but de cette thèse est d'étudier le problème de coloriage généralisé, sa résolution avec des méthodes approchées et son application au problème d'allocation de fréquences multiservices dans le système com2 de l'aviation civile. Elle est composée de deux parties principales. La première partie consiste à discuter des différents types de problème de coloriage, en particulier le problème de t-coloriage avec ensembles. La complexité du problème est abordée. Ses bornes supérieures et inférieures sont également discutées. Le problème de coloriage peut être posé de deux façons différentes. La première consiste à trouver un coloriage satisfaisant l'ensemble des contraintes et minimisant le nombre de couleurs utilisées. La deuxième cherche un coloriage utilisant un nombre fixe de couleurs et minimisant le nombre de contraintes violées. Le problème d'allocation de fréquences multiservices du système com2 dans l'aviation civile est étudié. Deux questions sont posées. Le nombre de 760 fréquences dont le système com2 dispose est-il suffisant pour satisfaire l'ensemble de services et éviter toute interférence ? La planification utilisée actuellement par le système est-elle améliorable tout en utilisant le même nombre de fréquences ? Ce problème est modélisé par un t-coloriage restrictif avec un ensemble sur un graphe multicouches. La deuxième partie s'attache à proposer des méthodes de résolution au problème posé. Deux types de méthodes sont proposés: des méthodes constructives comme la méthode glouton et ordre dynamique itératif, des méthodes d'amélioration comme la méthode de descente, la recherche tabou et le recuit simule. Des méthodes hybrides à partir de grasp et d'autres sont également discutées et expérimentées. Enfin, ces méthodes sont appliquées au problème du système com2 pour répondre aux deux questions posées. En plus, une méthode (parallèle) exacte est proposée pour l'évaluation et la validation des méthodes approchées

Au-delà de la question essentielle de la sécurité opérationnelle, les événements anormaux durant les phases d'approche et d'atterrissage comme les atterrissages durs, les touchés de queue et les sorties de piste affectent la fluidité du trafic aérien, les coûts d'exploitation des compagnies aériennes et la satisfaction des clients. Par une approche intégrant les techniques de guidage et les facteurs humains, l'enjeu de la thèse est de proposer un système d'assistance au pilotage visant à mieux anticiper une situation à risque ou en sortir lors de la phase finale de vol. Nous avons cherché à identifier les voies d'amélioration de la sécurité des opérations à travers une revue des systèmes existants, des entretiens avec les pilotes et l'étude des procédures standards et des événements anormaux. Cette phase d'exploration de la problématique de sécurité nous a poussé à approfondir la notion d'indicateur de l'activité de pilotage en développant une classification des indicateurs génériques. Soulignant l'aspect méthodologique de la synthèse, l'application des concepts génériques à des scénarios à risque a abouti à la conception et la simulation de huit indicateurs précurseurs de risque. Ensuite, nous avons défini une fonction d'assistance au pilotage cohérente avec le besoin de prévention des sorties de piste en nous appuyant sur deux précurseurs en particulier. Le premier, la Hauteur de Stabilisation en Energie doit assurer une détection anticipée des cas de stabilisation trop tardive du vol en approche. Le second, la Marge de Retard à l'Atterrissage, tient compte de l'ensemble des paramètres en approche et à l'arrondi et donne une mesure objective de la criticité de l'atterrissage. Par la suite, la thèse a permis d'établir les performances et la robustesse des algorithmes. Enfin, nous nous sommes attachés à poursuivre les travaux jusqu'à une phase d'expérimentations d'un prototype d'assistance au pilotage en privilégiant le concept de Marge de Retard à l'Atterrissage.

In this work the activity performed at the DICI (Dipartimento di Ingegneria Civile e Industriale) of the Pisa University in collaboration with the ENEA Brasimone Research Centre is presented. In particular the document deals with the application of an in-house developed coupling methodology between a modified version of RELAP5/Mod3.3 and Fluent commercial CFD code, to the NACIE (Natural Circulation Experiment) LBE experimental loop (built and located at the ENEA Brasimone research centre). The first part of the document treats the description of the NACIE loop type facility, while in the second part, the developed coupling tool is presented and the obtained numerical results are compared to stand alone RELAP5 results and to data obtained from the NACIE experimental campaign. The experimental tests are performed varying the argon flow rate and the electric power supplied to the heater and both natural and assisted circulation tests are investigated. The numerical model set-up is based on a two-way explicit coupling scheme and 2D and 3D geometrical domain were investigated. Comparative analyses among numerical and experimental results showed good agreement, giving positive feedback on the feasibility and capability of the developed coupling methodology.

Shape memory alloys (SMAs) have attracted a great deal of attention as a smart material that can be used in various civil engineering applications due to their favorable mechanical properties such as ability to undergo large deformations, high corrosion and fatigue resistance, good energy dissipating capacity, and excellent re-centering ability. In contrast to the use of SMAs in the biomedical, mechanical and aerospace applications, which requires mostly small diameter of material, the larger size bars are usually needed in a civil engineering application. It is well known that properties of large-section SMA bars are generally poorer than those of wires due to difficulties in material processing. Furthermore, large diameter SMA bars are more expensive than thin SMA wires. Shape memory alloy cables have been recently developed as an alternative and new structural element. They leverage the superior mechanical characteristics of small diameter SMAs into large-size structural tension elements and possess several advantages over SMA bars. This study explores the performance of NiTi SMA cables and their potential use in civil engineering. The SMA cable, which has a diameter of 8 mm, is composed of 7 strands and each strand has 7 wires with a diameter of 0.885 mm. The uniaxial tensile tests are conducted at various loading rates and strain amplitudes to characterize the superelastic properties of the SMA cable and study the rate-dependent mechanical response of the SMA cable under dynamic loads. An optical digital image correlation measurement system and an infrared thermal imaging camera are employed to obtain the full-field strain and temperature fields. Potential applications of SMA cables in civil infrastructure applications are discussed and illustrated.

Indoor air questions in Finland have been constantly featured in the media. There are indoor quality deficiencies, not only in existing as well as in new buildings. The problems of indoor conditions can be divided into those caused by design, implementation and use. At the civil engineering department, University of Oulu, you can now specialize in building health. This is a new orientation option, which can be studied at the University of Oulu only. Arctic Construction Cluster Finland was established to restart the once-abolished civil engineering department. The cluster represents all branches of construction, and supports the civil Engineering department. The team for healthy buildings at the Arctic Cluster cooperates with the university's good indoor air and building health team. This is a position paper, where we introduce the operational priorities of the building cluster and the healthy buildings team, cooperation with the indoor air and building health group at Oulu University and the trends which will affect and change the building branch. There are still shortcomings in solutions to indoor conditions problems, which are caused by several factors. Education and training must be developed. Knowledge in hygrothermal performance of buildings is essential to improve it into interdisciplinary and comprehensive approach. Civil engineers must recognize factors that affect building health. Health care staff then investigate the consequences. Different actors should be brought together better than at present.

Ultra-high performance concrete (UHPC) is a relatively modern class of concrete with properties that include very high compressive strengths, increased tensile strengths, very low permeability, and superior durability compared to conventional, normal-strength concrete. As research of this material continues to progress, its applications under both military and civil works categories expand. However, mixture and structural design guidance using UHPC is limited, particularly in the United States. This special report provides an overview of UHPC as initial guidance for the US Army Corps of Engineers (USACE) so that the material may be more easily utilized in civil works infrastructure. The information contained in this report is based on years of experience researching and developing UHPC at the US Army Engineer Research and Development Center (ERDC) and is intended to be a basis for the incorporation of this material class into USACE Engineer Manual (EM) 1110-2-2000, Standard Practice for Concrete for Civil Works Structures, when it is next updated.

We study the use of multi-level Monte Carlo methods for wind engineering. This report brings together methodological research on uncertainty quantification and work on target applications of the ExaQUte project in wind and civil engineering. First, a multi-level Monte Carlo for the estimation of the conditional value at risk and an adaptive algorithm are presented. Their reliability and performance are shown on the time-average of a non-linear oscillator and on the lift coefficient of an airfoil, with both preset and adaptively refined meshes. Then, we propose an adaptive multi-fidelity Monte Carlo algorithm for turbulent fluid flows where multilevel Monte Carlo methods were found to be inefficient. Its efficiency is studied and demonstrated on the benchmark problem of quantifying the uncertainty on the drag force of a tall building under random turbulent wind conditions. All numerical experiments showcase the open-source software stack of the ExaQUte project for large-scale computing in a distributed environment.
