Alors qu’il est souvent affirmé que le contrat d’assurance s’interprète en cherchant l’intention commune des contractants, l’étude de la jurisprudence des 30 dernières années ayant interprété le contrat d’assurance voyage contredit fortement cette affirmation. En effet, la compréhension du contrat d’assurance voyage ressemble davantage à un jeu de souque à la corde où tantôt les intérêts de l’assuré auront préséance au moment de la démarche interprétative, tantôt les intérêts de l’assureur auront le dessus, ne laissant ainsi aucune place à la recherche de l’intention commune, véritable zone interdite (no man’s land) juridique. Le phénomène de la solitude contractuelle offre alors la possibilité d’entrevoir une nouvelle théorie interprétative explicative beaucoup plus adaptée au contrat d’adhésion à large distribution.

In our days of Artificial Intelligence, smartphones and all Internet of Things that provide us with myriads of connected objects at a very early age, education has to be transformed to integrate the searching power these means of communications, in fact first of all means of exploration-incorporation, provide every single individual in our society. They have become the main means of development for masseducation in a knowledge society. I will at first start from the mental architecture of a learner and move to the fundamental transference phenomena that command the motivation of a learner and a selflearner has to live on his own motivation. Then I will move to the role and responsibility of the Conceptor-Designer of a batch of selflearning work based on the choice expressed by the Self-Learner, from the resources provided or suggested by the batch to the tasks to be fulfilled. Everything is hegemonies by the type of needs and activities the learner will have to face and assume in his future professional field. The Self-Learner will have to target what is in his “zone of proximal development” to be most effective. That will lead us to the triadic guided self-learning situation centered on the Self-Learner but with the guidance from the Conceptor-Designer on one side and the real professional world represented by the Coach-Counterpart-Partner- Doppelganger that accompanies the Self-learner in his voyage on the other side. The Internet, in its present development, is the real toolbox the Self-Learner has at the tip of his fingers constantly. That will lead us to the Boolean logic of the Internet that has to be understood and dominated by the Self-Learner, at times against the interests of the search-engine the Self-Learner uses. I will end with one particular batch – called a triad – of self-learning work proposed in Fall 2018 to the CEO of a medical startup, which will bring the type of contract that can be signed by the company and the Conceptor-Designer who only sells Intellectual Property to the company. This research was carried out to systematize and assess the appropriateness of farmer’s indigenous knowledge and their ability adapt with the flood in An Giang province, results of the research will provide a scientific foundation for proposing solutions to conserve and enhance the use of indigenous knowledge in reducing the vulnerability of people living in flooded areas. The results showed that local people used several effective indigenous knowledges for adapting with floods. However, the valuable indigenous knowledge has not been recorded yet, nor documented in written materials for sharing to young generations and communities; some indigenous practices are not suitable with the current requirement for flood adapation strategies. Research results showed that (LVI) of diffirent Zone (upper zone, middle zone, lower zone) are decreasingly dependent on major components of social networks, knowledge and skills, natural resources, finance and incomes, livelihood strategies, natural disater and climate variability. In which, (LVI: 0.390) of Phu Huu commune in An Phu district which locates in the upper zone is higher than LVI of two communes located in the lower part of the river. These communes are Vinh An commune (LVI: 0.287), Chau Thanh district (middle zone) and Vinh Phuoc commune (LVI: 0.331), Tri Ton district (lower zone) and adaptive capacity of Phu Huu commune (0.399) is also higher than Vinh An (0.299) and Vinh Phuoc (0.337). It reflects the direct proportion between LVI and adaptive capacity. The research also suggests some solutions to conserve the valuable indigenous knowledge in adapting to climate change of local people.

<p><strong>Abstract.</strong> Kien Giang is one of the coastal provinces in the Mekong Delta which is facing the problem of coastal erosion to affect people’s life in the coastal area. This project aims to monitor shoreline and to assess landslide and accretion situation in the period from 1975 to 2015 in the coastal area of Kien Giang province. The study applied Normalized Difference Water Index (MNWI) method and water level extraction using LANDSAT imagery from 1975 to 2015 for highlight the shoreline. Thus, analysis was identified erosion and accretion areas based on shoreline changes and land use influenced by landslides and deposition. The results show to create shoreline changes from 1997 to 2015 in the coastal area of Kien Giang province. A landslide occurred in the west from Nguyen Viet Khai commune to Thuan Hoa commune and Nam Yen commune to Vinh Hoa Hiep commune, Rach Gia city, Kien Giang province. An accretion situation was determined in the areas from Thuan Hoa commune, An Minh district to Nam Thai commune, An Bien district, Kien Giang province, Rach Gia sea encroachment at Rach Gia town and Ha Tien encroachment area at Ha Tien town, Kien Giang province. In general, the coastal area of Kien Giang province has a predominant tendency of accretion, however, the occurrence of erosion and accretion are happened interlacing in the coastal area at Kien Giang province.</p>

This study, conducted in An Giang Province of Vietnam, assesses the vulnerability and adaptability of local farmers to the flood in different conditions. Livelihood Vulnerability Index (LVI) proposed by Hahn, Riederer, and Foster (2009, Global Environmental Change, 19(1), 74–88) was applied for livelihood vulnerability analysis of different flooding zones (upper, middle and lower zones) in low flooding condition. Research results showed that LVI of different flooding zones are decreasingly dependent on major components of social networks, knowledge and skills, natural resources, finance and incomes, livelihood strategies, and natural disaster and climate variability. In which, LVI of Phu Huu commune in An Phu district which locates in the upper zone is 0.397 higher than LVI of two communes located in the lower parts of the river: Vinh An commune, Chau Thanh district (middle zone; LVI: 0.299) and Vinh Phuoc commune, Tri Ton district (lower zone; LVI: 0.357). Adaptive capacity of Phu Huu commune (0.415) is also higher than Vinh An (0.304) and Vinh Phuoc (0.355) communes. It reflects the direct correlation between LVI and adaptive capacity. The research recommends some solutions to reduce the vulnerability on livelihoods due to floods in the context of climate change.

Publiés par la Librairie Hachette, les récits de voyage de Jeanne Bellonie Bourdaret – À travers l’Arménie russe (1891 ; 1892), En Asie mineure, souvenirs de voyages en Cappadoce (1896) et En Asie mineure : Cilicie (1898) – forment un contraste avec ceux rédigés par le savant Ernest Chantre à la suite de leur expédition commune au Caucase, en Cappadoce et en Cilicie. L’article examine l’espace narratif de l’écriture de voyage au féminin, espace considéré à l’époque comme subalterne et secondaire, et s’interroge sur les raisons qui expliquent l’un des paradoxes produit par la postérité sur la valeur accordée aux récits des couples voyageurs du dix-neuvième siècle, soit l’intérêt grandissant pour les écrits dits féminins et le discrédit que connaissent de nos jours de nombreuses théories produites par les érudits férus de craniologie à une époque où l’impérialisme européen connait son apogée.

Conformément à l’engagement pris par le parti conservateur , la victoire du Leave à l’occasion du référendum sur l’appartenance du Royaume-Uni à l’Union européenne a entraîné la mise en œuvre de la procédure prévue à l’article 50 du Traité sur l’Union européenne. Le retrait du Royaume-Uni de l’Union européenne a surtout posé la question de la relation future entre les deux entités. La prééminence dont la libre circulation des personnes a fait l’objet lors de la campagne référendaire a invité Londres à envisager les différents scenarii à l’aune des possibilités offertes en matière de maîtrise des mouvements en provenance des États membres. Elles se ramenaient à une alternative : aménager la libre circulation des personnes en faisant usage des marges de manœuvre que le statut de pays tiers devait permettre de dégager, ou, au contraire, la démanteler. Le premier terme s’accommodait mal de la recherche de souveraineté telle qu’elle a été exprimée lors de la campagne référendaire. À travers la mise en œuvre du second, le gouvernement britannique entendait faire montre de sa capacité à tirer les conséquences du retrait dans le calendrier contraint de la sortie et à normaliser la relation avec l’Union européenne en alignant le traitement des citoyens de l’Union européenne et des membres de leur famille sur le droit commun des étrangers. En l’absence de droits acquis, cette entreprise nécessitait qu’un régime transitoire soit mis en place qui permette aux personnes qui ont exercé leur droit à la libre circulation et dont la situation était en cours de pouvoir continuer à en bénéficier.Au Royaume-Uni, l’alignement sur le droit commun n’a pas été opéré sans que ne soient apportées certaines adaptations. Il a d’abord donné lieu à une libéralisation du système d’immigration qui visait principalement à prémunir le marché de l’emploi dynamique et flexible contre l’apparition de carences qui pourraient le déstabiliser. Mais l’augmentation de l’immigration en provenance de pays tiers à l’Union européenne qui en est résultée a eu pour conséquence de soumettre l’entrée et le séjour des citoyens de l’Union européenne et des membres de leur famille à des conditions qui sont progressivement devenues plus restrictives encore. La logique de réciprocité dans laquelle s’inscrit cet alignement a abouti à un double phénomène : la régression des droits et la redistribution des perspectives de mobilité croisée entre, d’une part, l’Union européenne et ses États membres et, d’autre part, le Royaume-Uni. Malgré l’ambition poursuivie, l’alignement est toutefois demeuré incomplet. Le pragmatisme a en effet commandé de laisser subsister un traitement qui demeure à certains égards préférentiel. Il témoigne d’une volonté de préserver une relation essentiellement commerciale désormais et il connaît une exception notable avec l’Irlande, le Royaume-Uni n’ayant eu de cesse de réaffirmer son attachement à la Zone de voyage commune
In accordance with the commitment made by the conservative party, the Leave victory in the referendum on the United Kingdom's membership of the European Union triggered the procedure set out in Article 50 of the Treaty on European Union. Above all, the United Kingdom's withdrawal from the European Union raised the question of the future relationship between the two entities. The prominence given to free movement of people during the referendum campaign prompted London to consider the various scenarios in the light of the possibilities offered in terms of controlling movements from Member States. They came down to an alternative: either to adapt free movement of people or to dismantle it. The first option did not fit well with the quest for sovereignty expressed during the campaign. Through the implementation of the second, the British government intended to demonstrate its ability to draw the consequences of withdrawal within the constrained timetable of the exit and to normalise relations with the European Union by bringing the treatment of EU citizens and their family members into line with the ordinary law on foreign nationals. In the absence of acquired rights, this undertaking required a transitional regime to be put in place to enable people who had exercised their right to free movement and whose situation was ongoing to continue to benefit from it.In the United Kingdom, alignment with ordinary law was not achieved without adaptations. It first led to a liberalisation of the immigration system, the main aim of which was to protect the dynamic and flexible labour market from deficiencies that could destabilise it. However, the consecutive increase in immigration from non-EU countries resulted in further restrictions of the conditions that the entry and residence of EU citizens and their family members has been subject to. The logic of reciprocity behind this alignment has led to a twofold phenomenon : loss of rights and redistribution of prospects for cross-mobility between, on the one hand, the European Union and its Member States and, on the other, the United Kingdom. Despite the ambition pursued, alignment has nevertheless remained incomplete. Pragmatism called for a preferential treatment in certain respects, which reflects a desire to preserve an essentially commercial relationship. The case of Ireland, where the United Kingdom has consistently reaffirmed its attachment to the Common Travel Area, is a noteworthy exception

Nous etudions donc les possibilites de cooperation internationales pour une gestion concertee des pecheries par la mise en oeuvre d'une restriction des quantites prelevees. Nous nous interessons tout particulierement a differentes possibilites pour cette mise en oeuvre, a savoir decision d'une instance supranationale et decision par vote. Nous envisageons ensuite les problemes que peuvent rencontrer les gouvernements lors de la decentralisation des objectifs decides sur le plan international. Un chapitre est consacre aux consequences d'une incertitude sur l'etat des stock ou d'un alea sur la collecte et un second a la presence de prises accessoires. L'analyse est conduite dans le cadre de la theorie des jeux et a l'aide d'outils de controle optimal.

Cette thèse est consacrée à l’étude de transmission de la politique monétaire dans la zone Euro, en traitant le canal du taux d’intérêt et le canal du crédit. La démarche suivie consiste à combiner des approches théoriques et empiriques de façon à mettre en évidence empiriquement l’hétérogénéité de transmission au sein de la zone euro et l’existence du canal du crédit. Le premier chapitre consiste à étudier le pass-through aux taux bancaires. D’après les résultats, le processus de transmission semble bien influencé par la spécificité des pays de la zone euro. Les niveaux et les vitesses de transmission restent en effet hétérogènes, le niveau du pass-through est incomplet dans la plupart des cas et il a diminué au cours de la période étudiée, en particulier après la crise financière. Le deuxième chapitre est consacré à l’étude des déterminants de la transmission. D’après les résultats, l’hétérogénéité de la transmission se trouve son origine dans les différences des structures des banques et des marchés bancaires et dans les différences de l’intégration bancaire. Le dernier chapitre est consacré à examiner le canal du crédit dans la zone euro en distinguant la réaction des banques sur la bas de la taille, la capitalisation et la diversification bancaires. Les résultats confirment l’existence du canal du crédit dans la zone euro qui s’avère plus important après la crise financière, et montre aussi que la taille et la capitalisation bancaire jouent un rôle important dans la réaction des banques aux chocs monétaires. Cette présente thèse a apporté de nouveaux résultats par rapport à la littérature et elle a montré que le pass-through résultant de l’estimation du modèle MCE en seule étape est supérieur pour certains cas à celui du modèle en deux étapes, ainsi que le canal du crédit semble jouer un rôle plus considérable pendant la période de la crise
The aim of this thesis is to study the transmission of monetary policy in the Euro Zone, by treating the channels of interest rate and credit. The approach consists of combining theoretical and empirical approaches in order to empirically highlight the heterogeneity of transmission within the Euro Zone and the existence of the credit channel. The first chapter dilates on the study of pass-through through banking rates. According to results, the process of pass-through seems well influenced by the specificity of the countries of Euro Zone. The levels and speeds of transmission remain heterogeneous; the level of pass-through is incomplete in most cases and decreases during the period under study, in particular after the financial crisis. The second chapter is devoted to investigate the determinants of transmission. According to results, the heterogeneity of transmission finds its origin in the differences of the structure of banks, banking markets, and in the differences of banking integration. The final chapter examines the channel of the credit in the Euro Zone by distinguishing the reaction of banks on the basis of size, capitalization, and diversification. The results confirm the existence of credit channel in the Euro Zone, which proves to be even more important after the financial crisis, and also shows that the size and capitalization of the banks play a significant role in the reaction of the banks to the monetary shocks. This thesis produces new results compared to the literature and it shows that the pass-through resulting from the estimate of ECM model in one stage is higher for certain cases, as well as the credit channel seem to play a more considerable role during the period of the crisis

Анотація:

Cette thèse en anthropologie de l'environnement se focalise sur les perceptions, par des agriculteurs bretons, de deux objets choisis en tant qu'outils potentiels de résilience écologique d'éléments du paysage agricole. L'étude de l'implantation de bandes enherbées montre une pertinence écologique et sociale faible. L'imposition de la réglementation, ne laissant pas de place à l'initiative et à la valorisation des savoirs des agriculteurs, freine son acceptation sociale et ne permet pas la valorisation des spécificités écologiques locales. A l'opposé, l'étude des raisons du maintien des arbres d'émonde montre la créativité des exploitants adaptant librement cette technique traditionnelle. Ces résultats invitent à une proposition de gestion participative des bandes enherbées afin d'optimiser l'efficience de la mesure. La fréquentation de ce site par les chercheurs permet d'envisager un dialogue entre les savoirs, et de réfléchir à la légitimité de la présence des scientifiques.

La différenciation entre les États membres de l’Union européenne s’est progressivement transformée en un leitmotiv du débat sur l’avenir de l’intégration. Ce débat a resurgi avec l’activation de la clause du retrait par le Royaume-Uni, qui pose dans un cadre renouvelé la question de la compatibilité du processus de création d’une « union sans cesse plus étroite » avec la possibilité pour les États membres d’emprunter différentes voies d’intégration. L’objectif de la présente étude est d’apporter un éclairage sur cette question, en se focalisant sur l’amplification des manifestations de la différenciation en droit positif. La première partie de l’étude vise à cerner la tension entre l’uniformité du statut d’État membre de l’Union et la participation asymétrique des États aux actions engagées pour la réalisation des objectifs assignés à l’Union. La différenciation s’avère ainsi un facteur de relativisation de l’homogénéité du statut d’État membre, sans néanmoins mettre en cause son unicité en tant que catégorie juridique. Differentiation between the Member States of the European Union has gradually turned into a leitmotif of the debate regarding the future of the European integration. This debate re-emerged in the context of the activation of the withdrawal clause by the United Kingdom, by raising once more the question of the compatibility of the "ever closer union" concept with the possibility for the Member States to follow different paths of integration. The aim of this study is to clarify this question by focusing on the amplification of the various forms of differentiation in positive law. The first part of the study aims to identify the contrast between the uniformity of the EU membership and the asymmetrical participation of the Member States in actions undertaken to achieve the objectives assigned to the Union. Differentiation proves thus to be a relativizing factor of the homogeneity of the Member State's status, without, however, questioning its uniqueness as a legal category. The second part of the study focuses on the effects of differentiation on the structure of the Union. The different extent of participation of each Member State in EU policies has an impact on the Union's institutional and legal framework, even though this impact does not create a disorder affecting the integrity of the Union as such. It is thus apparent that within the creatio continua of the European construction, differentiation poses more a question of degree rather than principle

Sur la base de sources d’archives et de témoignages de terrain, l’enquête porte sur le rapatriement et la réinsertion des 36 941 travailleurs chinois recrutés par le gouvernement français et des 93 474 recrutés par le gouvernement britannique. 3 000 avaient été rapatriés avant juin 1918 pour raison sanitaire ou disciplinaire, 20 000 le furent aussitôt après l’armistice. Puis la nécessité de nettoyer les champs de bataille ralentit les départs. Mais dès l’automne 1919, la vague de violence entre Chinois et population locale sur l’ancienne zone de front et la crise économique précipitent le rapatriement d’une main-d’œuvre devenue « indésirable ». Moins de 3 000 restèrent en Europe, par choix, après janvier 1922. 3 103 étaient morts en Europe ou au cours du voyage, surtout de maladie. Parmi les quelque 124 000 rapatriés, à part les interprètes et environ 8 000 travailleurs plus qualifiés, la totalité était illettrée au départ. Le niveau d’instruction s’est peu amélioré car les initiatives en ce domaine ont été tardives et très épisodiques. Isolés dans leurs campements, les travailleurs n’eurent quasiment aucun contact avec le mouvement ouvrier français ou anglais. Leur combativité organisée, manifeste surtout dans le contingent français avec la fondation de l’Association des travailleurs chinois en octobre 1919, est l’effet d’une évolution interne à la communauté sous l’impulsion de Li Shizeng et de l’élite chinoise expatriée en France. Toutefois, l’apprentissage réel d’une action ouvrière de type syndical est limité à quelques dizaines d’individus. L’adhésion au communisme ne touche qu’un très petit nombre de travailleurs restés en France après 1922. Les travailleurs des contingents français et anglais de la Grande Guerre n’ont quasiment joué aucun rôle direct dans la lutte ouvrière ou révolutionnaire sur leur sol natal. En revanche, leur présence en France a permis aux jeunes intellectuels chinois venus étudier dans ce pays d’entrer en contact réel avec le monde ouvrier et de placer ses nouveaux problèmes au cœur du débat politique chinois.

L’objectif de cet article est d’essayer de doter les chômeurs et les élèves de l’enseignement scolaire des ksour de la commune de Ghéris El-Ouloui de connaissances adéquates en savoir-faire locaux relatifs à l’agriculture locale et la maçonnerie traditionnelle pour qu’ils puissent exercer des métiers locaux en manque de main-d’œuvre. Pour ce faire, une enquête a été menée pour comprendre les tenants et les aboutissants de la problématique de l’emploi et de l’exploitation des terres agricoles dans la zone d’étude. L’étude a montré que pour assurer un bon apprentissage des savoir-faire locaux, le recours au parler tamazight local et l’arabe dialectal, comme langues d’enseignement, est inéluctable.

Faced with contraction and decline, Britain’s distant-water fishery needed to revise its operations and seek new opportunities. This chapter examines diversification post-1976. In home waters, narrators reveal involvement in the 1970s south-west England mackerel fishing boom; experimental fishing for alternative exploitable species off the British coast and transferring into coastal fishing or into the emerging North Sea gas and oil industry. Further afield, globalisation and the growth of Exclusive Economic Zones saw Hull trawlermen and firms supporting the expansion of overseas fisheries, working in the global oil industry and taking a key role in developing a new British fishery around the Falkland Islands. Narrators describe sunshine, free time and voyages that no longer started and finished at Hull’s fish dock. But they also convey precarity, uncertain payment and dangerous scenarios. In the home port, Hull had survived as a fish handling and processing centre by attracting foreign caught fish to its quay. In the decade after the Cod Wars, life in Hull’s long established distant-water fishery had changed beyond recognition. In 1983, the revised common fisheries policy was finally released to shape a new European fishery. Despite vigorous efforts to diversity, for many trawling firms it was too late and only two continued to operate beyond 1986.

This paper proposes a simulation method for obtaining the estimate of the long term correlation coefficients between different low-frequency wave-induced loads acting on a ship hull. They are essential part of the load combination procedures in design and strength evaluations. Existing theory is limited to linear time-invariant systems with weakly stationary stochastic inputs such as waves during a single sea state (short-term). The simulation treats the non-stationary wave elevations during the ship’s entire life (long-term) as a sequence of different stationary Gaussian stochastic processes. Different sea states (HS, T0, Wave Direction) are sampled, using rejection sampling, from the joint probability density functions fitted to every Marsden zone on the ship’s route. The time series of the loads are simulated from the load spectra for each sea state, including the effects of loading condition, heading, speed, seasonality and voluntary as well as involuntary speed reduction. The estimates of the correlation coefficients are then calculated from these time series. The simulation time can be significantly reduced (to the order of seconds rather than hours and days) by introducing the seasonal variations into a single voyage. It is proven that the estimate of the correlation coefficient, obtained by simulating only a single voyage, approaches the true correlation coefficient in probability as the number of simulated load values increases. The simulation method can also be used for finding the long-term exceedance probabilities of the peak values of individual loads as well as for analyzing various load combinations (linear and nonlinear). Related concepts and limitations of this method are demonstrated by an example of a containership operating between Boston, MA and Southampton, UK.

Romula, the most important urban settlement of Dacia Inferior (Dacia Malvensis) province of the Roman empire during the 2nd and 3rd centuries A.D., was located in the present-day Resca village�Dobrosloveni commune, Olt County, Romania. Most of the Roman town remains are underneath Resca village premises, the areas suitable for archaeological or geophysical research being limited. This paper presents an integrated geophysical study carried out in the Central Fort zone of the archaeological site in September 2020, which included magnetic, gravity, and geoelectrical (ERT�Electrical Resistivity Tomography) surveys. The magnetic survey covered the entire Central Fort area (3 hectares), in continuous data acquisition mode, using profiles with approximately N�S orientation and 2 m spacing between the profiles. The gravity and ERT surveys were conducted on profiles with NE�SW and NW�SE orientation, with 2 m spacing between successive gravity measurements and 0.8 or 1 m electrode spacing. The geophysical data analysis revealed distinct anomalous zones and lineaments with preferential NW�SE and NE�SW orientations, likely corresponding to Roman construction elements incorporating baked bricks or stone, brick debris, pits, or furnaces. An anomalous lineament possibly corresponding to an underground sewer or drainage channel was also detected in the northern extremity of the surveyed perimeter. These preliminary results demonstrate the applicability of the selected geophysical investigation methods in the specific conditions of Resca�Romula archeological site. A future research direction consists of testing the validity of the geophysical survey results through systematic archaeological excavations.
