This chapter discusses exceptions to the general rule for corroboration of evidence. There are three categories of exception (i) where corroboration is required as a matter of law (speeding, perjury, treasons and attempts to commit these offences) and a conviction cannot be based on uncorroborated evidence; (ii) where neither corroboration in a technical sense nor supportive evidence is required as a matter of law, but the tribunal of fact may need to be warned to exercise caution before acting on the evidence of certain types of witness, if unsupported; (iii) five cases in which corroboration is not required as a matter of law, and there is no obligation to warn the tribunal of fact of the danger of acting on the unsupported or uncorroborated evidence, but there is a special need for caution. The five cases are confessions by mentally handicapped persons, identification evidence, lip-reading evidence, cases of Sudden Infant Death Syndrome, and unconvincing hearsay. Identification evidence is dealt with separately in Chapter 9.

Woman as gorgon, woman as temptress: the classical and biblical mythology which has dominated Western thinking defines women in a variety of patriarchally encoded roles. This study addresses the surprising persistence of mythical influence in contemporary fiction. Opening with the question 'what is myth?', the first section provides a wide-ranging review of mythography. It traces how myths have been perceived and interpreted by such commentators as Sigmund Freud, Carl Jung, Bruno Bettelheim, Roland Barthes, Jack Zipes and Marina Warner. This leads to an examination of the role that mythic narrative plays in social and self formation, drawing on the literary, feminist and psychoanalytic theories of Julia Kristeva, Luce Irigaray, Helene Cixous and Judith Butler to delineate the ways in which women's mythos can transcend the limitations of logos and give rise to potent new models for individual and cultural regeneration. In this light, Susan Sellers offers challenging new readings of a wide range of contemporary women's fiction, including works by A. S. Byatt, Angela Carter, Anne Rice, Michele Roberts, Emma Tennant and Fay Weldon. Topics explored include fairy tale as erotic fiction, new religious writing, vampires and gender-bending, mythic mothers, genre fiction, the still-persuasive paradigm of feminine beauty, and the radical potential of comedy.

Digital health has been touted as a true transformation of health care, but all medical interventions have associated risks that must be understood and quantified. The Internet has brought many advancements, which quickly jumped from our computers into our pockets via powerful and completely connected mobile devices that are now being envisioned as devices for medical diagnostics and care delivery. As health care struggles with cost, inequity, value, and rapid virtualization, solid models of benefit-risk determination, new regulatory approaches for biomedical products, and clear risk-based conversations with all stakeholders are essential. Detailed examination of emerging digital health technologies has revealed 10 categories of digital side effects or “toxicities” that must be understood, prevented when possible, and managed when not. These toxicities include cyberthreat, loss of privacy, cyberchondria and cyber addiction, threats to physical security, charlatanism, overdiagnosis and overtreatment, medical/user error, and the plague of medical misinformation. For digital health to realize its promise, these toxicities must be understood, measured, warned against, and managed as concurrent side effects, in the same fashion as any other medical side effect.

This chapter discusses the growing pressure for news to become more interpretive. The Left worries about commercial and public relations influences, and the Right about reporters' biases, but both sides call for news that gives more context. They say the press should also do a better job of explaining where information comes from. News content producers want to supply more and better interpretations and have called for more context that “makes the complex coherent and meaningful,” decried a growing tendency of science news reports to manipulate facts, and warned against surrendering “their functions of analysis and explanation”. A closer look at news stories shows a broad interpretive turn toward modern news, with explanations along with judgments and opinions increasing in the news content of daily papers, network television, public radio, and mainstream sites online.

This chapter examines the controversy between Harry T. Burleigh and his colleagues and critics over the issue of spirituals during the Harlem Renaissance. Although Burleigh was still regarded as the pioneer and by most as the master arranger of spirituals during the mid-1920s, there were dissenting voices. Henry Krehbiel, for example, warned against oversophistication of African American folk music “by standardizing its form, making it conform to the standard of music of European conception.” Carl Van Vechten also criticized Burleigh and his colleagues for relying on the Hampton and Fisk collections for most of their arrangements. This chapter considers how Burleigh came to be the target of criticism from some of the most outspoken of the younger Harlem or New Negro Renaissance voices, as well as his counterargument that the movement was chauvinist and separatist, or sacrificed what he felt were basic artistic standards. It also discusses Burleigh's belief that the vast repertoire of spirituals must be preserved in simpler versions accessible to untrained singers, as well as in art-style transformations for professional singers.

The more ‘developed’ the country and the higher the ‘standard of living’, the greater the energy use per person. Energy use can be broken down into three main categories—maintaining a comfortable environment in buildings, transportation of people and things and manufacturing stuff. More energy per person is used in colder countries than in warmer ones. Also, countries where people drive large cars over longer distances every year (United States, Canada and Australia) use more oil per person than European countries. Carbon dioxide emission is related to how much oil is used per person, and how electricity is generated. If a lot of electricity is generated from coal power stations, this will result in higher carbon dioxide emissions. As France has shown, substitution of coal by nuclear power results in a significant reduction in carbon dioxide emissions.

Congressional debates are increasingly defined by gridlock and stalemate, with partisan showdowns that lead to government shutdowns. Compromise in Congress seems hard to reach. But do politicians deserve all the blame? Legislators who resist concessions and stand firm to their convictions might be doing just what voters want them to do. If this is true, however, then citizens must shoulder some of the responsibility for gridlock in Congress. This book challenges this wisdom and argues that Americans value compromise as a way to resolve differences in times of partisan division. Using evidence from a variety of surveys and innovative experiments, the book demonstrates that citizens want more from politics than just ideological representation—they also care about the processes by which disagreements are settled. Americans believe that compromise is a virtuous way to resolve political disputes. Because people’s desire for compromise is deeply rooted in socialized support for democratic values, principled beliefs about compromise can serve as a check on partisan thinking. Across a range of settings, people’s support for compromise persists even when it comes at the cost of partisan goals and policy objectives. People give warmer evaluations to members of Congress who are willing to compromise and view compromise legislation as more legitimate. People care about not just outcomes, but also the way decisions are reached. Winning isn’t everything in politics. People also value the democratic principle of compromise.

In general, candidates for cardiac surgery may now be not only older than in the past, but also more likely to have health problems such as hypertension and diabetes. Risk stratification may help to identify ‘the’ high-risk patient: ‘pre-warned is pre-armed’. In high-risk cardiac surgery patients, the surgical treatment options and perioperative care must be tailored to each patient, in order to optimize the benefits and minimize the risk of detrimental effects. The preoperative anticoagulation practice is an important aspect, balancing the risk between ischaemic and bleeding complications. New antiplatelet agents and oral anticoagulants have been recently delivered, and their role in patients scheduled for heart surgery is an additional important issue.

Jochen von Bernstorff identifies the several roles and functions of international courts and tribunals (ICs) from the perspective of Hans Kelsen’s and Carl Schmitt’s accounts of international law. Kelsen saw the international judiciary with compulsory adjudication and de facto law-making authority as the key to a future peaceful world order. This would not require a world legislator. He also held that judges had considerable freedom in their interpretation and application of international law. Schmitt agreed that courts have a central law-making function, and also that judges are subject to few interpretative constraints. But Kelsen and Schmitt were not writing with today’s sector-specific international courts in mind. Much current concerns about the legitimacy of ICs can be traced back to tensions with what could be claimed to represent a global judicial imperialism. Von Bernstorff warns against sectorial colonization in the sense that the specialized ICs take control over non-judicialized sectors.

The United Nations World Assembly on Aging has made advancing health and well-being into old age a worldwide call for action. And this text at hand shows us what researchers worldwide are doing to answer that call. Here, three of America’s most esteemed experts on aging lead a global team of contributors - each an expert in his or her country - to show us what the top challenges of each nation are, and what top research is being done there to meet those. While we cannot predict with absolute certainty all of the issues that will arise over the next 20 years, we can anticipate some and we must start now to prepare for these challenges, an expert from the U.S. Department of Health and Human Services warned at a recent UN World Assembly on Aging. Needed response to the global population shift is not just the responsibility of governments, but will be a product of wise, long-term decisions made by individuals and societies, she explained. In most nations globally, populations are graying and the number of people aged 65 and older is vastly increasing, creating a larger segment of senior citizens than the world has ever before seen. Across human history, the elderly accounted for no more than 3 percent of the world population. By the year 2030, the elderly are expected to make up about 25 percent of the world population. And while longevity is of course seen as a great success, longer lifespan for such masses also creates dilemmas. For example, the incidence of dementia has already increased significantly with an 11-fold increase in people aged 65 and older in the US since the turn of the century, and a similar increase in aged people in Scotland has researchers there scrambling to find treatments for what they expect will be a 75 percent increase in dementia over the next 25 years. Chronic diseases that come with aging are already taxing health care systems in the US and around the world to Japan, with most experts aware their current health systems would be overrun and lack enough staff and facilities to handle the needs of an elderly population multiplying largely in the coming two decades. Increases in psychological issues such as dealing with the depression often striking aged people are impending, too, as are social issues such as how families, and public policies, will deal with the changing shape of the family.

Анотація:

HIV and AIDS, perhaps more than any other illness during any other time, contributed to the end of a “collusion of silence” and parentalism that characterized medicine prior to the era of civil rights and patient rights. The bioethical aspects of both healthcare delivery and care at the end of life changed dramatically during the beginning of the AIDS epidemic when young persons and their dedicated teams of caregivers were faced with a new infectious illness associated with both sexual transmission and intravenous drug use. This chapter delineates the ethical aspects of HIV and exceptionalism, screening, routine testing, informed consent, advance care planning through advance directives, confidentiality, criminalization, the duty to warn, and pre- and post-exposure prophylaxis (PrEP and PEP).

Recovery from critical illness may not be smooth and uneventful for the patient. Complications and adverse events may beset the patient and lead to intensive care unit (ICU) re-admission. Problems upsetting patients after discharge may be a manifestation of post-intensive care syndrome, new or recurrent organ failure. Avoiding post-ICU complications may be prevented by ensuring a well-planned transition from ICU to the general ward. This may be achieved by minimizing the impact and duration of organ support, defining a structured rehabilitation programme prior to ICU discharge. After discharge a short period spent on an intermediate care unit with higher nursing staff ratios, together with follow-up on the general ward will help identify and treat any new problems. Unfortunately, re-admission may be required to effectively treat some complications. There are recognized risk factors for ICU re-admission and these should be used to warn of the increased likelihood of adverse events to aid appropriate planning avoiding re-admission to ICU.
