The recourse to these unilateral declarations is sometimes due to reservations’ prohibition in treaties; but most of the time, it is carried out independently of the prohibition of reservations. Formally, the formulation of interpretative declarations of treaties is restricted to precision or clarification of sense or range of a treaty or of some of its provisions. However, at the bottom, these declarations serve in general for adapting an international Convention or some of its provisions in internal right of the declaring State or the declaring organization. Therefore, these interpretative declarations reflect position or comprehension of their author regarding a treaty or some of its provisions. The subject imposes therefore a series of questions relating to the intrinsic formulation of interpretative declarations, to their relations with reservations to treaties, but also in accruing questions in their validity and their legal effects

Повний текст джерелаThis study seeks to highlight the different rationales which lead to the identification of an international customary rule on the basis of the convergence of international conventional practices. This assumption has been expressly accepted by the International Law Commission in 2018 in its draft conclusions on the determination of customary international law. It has held that "[t]he fact that a rule is set forth in a number of treaties may, but does not necessarily, indicate that the treaty rule reflects a rule of customary international law" (Conclusion 11, para. 2). To carry out this study, two aspects of customary rules are distinguished: on the one hand, their content, that is to say the behaviour they prescribe, and on the other hand, their legal bindingness, that is to say their quality of rules of law. The influence of conventional provisions is indeed different in these two situations: as regards the substance of the custom, this incidence is certain but varies according to the abstraction of the conventional statements in question. By contrast, as far as the legal value of custom is concerned, it is necessary to go beyond the principle of relative effects of conventional commitments so that they can attest to the existence of a customary rule

Повний текст джерелаThe issue of international treaties before the Ivorian constitutional court is an illustration of the internal dispute relating to international treaty law. In the framework of this dispute concerning the relationship between international law and national law, the constitutional court is asked to decide on the conformity of international treaties before their integration in the Ivorian legal order. The conditions of integration of international treaties in the Ivorian domestic law reflect the country’s option in favor of the monist doctrine with primacy of international law. Treaties duly ratified are automatically incorporated into the national law and shall, upon publication, prevail over Acts of Parliament. However, before their ratification, the Constitution provides a procedure for the review of their constitutionality. The effect of this preventive review is to avoid the entry of unconstitutional international treaties into the Ivorian legal order without the decision and intervention of the constituent power. If the treaty is held not to be in conformity with the Constitution, authorization to ratify it may be given only after amending the Constitution. The mechanism of constitutional review established by the Constitution of 1960 and extended by the Constitution of 2000 (currently in force) undergone significant evolution regarding its conditions of implementation. These conditions were considerably widened in order to facilitate the release of control… In total, the constitutional court was able to look into only twenty or so treaties for which, somehow, the judge reviewed compliance with the Constitution. In the confrontation of treaties with Constitution, the attitude of the constitutional court is sometimes hesitant. Its interpretation of the requirement of non-contradiction between the treaty and the Constitution generally leads to facilitate the participation of the State to International law in general and African community law in particular. Indeed, so far, the practice of the constitutional review by the judge revealed that, the review, far from being an "obstacle to the development of international law", as could foreshadow its mechanism, is rather favorable to its development. Only the Treaty laying down the Statute of the International Criminal Court was declared not to be in conformity with the Constitution by the constitutional court in its decision of 17 December 2003. The amendment of the Constitution that is expected for the ratification of this treaty will be an opportunity to appreciate the enforcement of non-conformity decisions

Повний текст джерелаBy presenting and analysing a corpus constituted by three oneirological treatises written during the late Ming dynasty, in China – the Mengzhan yizhi, by Chen Shiyuan (1562), the Mengzhan leikao, by Zhang Fengyi (1585) and the Menglin xuanjie compiled by He Dongru (1636) –, the present study evidences their common project of an a posteriori dream tradition which would be conform to literati’s culture and whose legitimity would rely on a set of texts borrowed from various periods and genres, hence defining the theoritical realm and empirical validity of oneirism, whose relevant aspects they aim to delimitate, in order to gain mastery over it. Thusly judging what can and cannot be said about dreaming, the corpus’ authors and compilators are leaving aside the specialised treatment of dream that appears in the respective traditions of divination, medicine and religions, all of which rely on both active practices and a specific literature. Confronting the corpus with the ideas and methods it doesn’t include allows to question its claim to represent some « forgotten knowledge » about dreaming et to examine the real status held by the books composing it, which may be mere parts of a wider endeavor of knowledge ordering rather than founding works of an oneirological genre to which any dream-centered writing would belong. The corpus excerpts translated as appendices show the respective authors’ specific orientation, as well as their way of composing by rearranging text material into which they inject original comments

Повний текст джерелаThis work is a comparative study of the treatises through which the humanists of the Renaissance introduced ancient mythology to their contemporaries. It is based on the analysis of Pictorius' two mythographies, the Theologia mythologica (Freiburg im Breisgau, 1532) and the Apotheseos deorum libri (Basel, 1558) together with other 16th Century treatises by Montefalco (Perugia, 1525), Haurech (Antwerp, 1541), Giraldi (Basel, 1548), Herold (Basel, 1554), Cartari (Venice, 1556), and Conti (Venice, 1567). These texts were especially dedicated to the study of pagan gods and circulated throughout the Germanic empire, France, Basel, and Italy. Most were never translated or analyzed as a specific form of writing, yet their analysis fuels inquiries into the implications of the appropriation of the religious and cultural alterity of antique paganism by a then divided Western Christianity. The figures of the gods are pretexts for unusual symbolic compositions generating representations which are at once poetic, physical, and political, and whose interpretations must be constantly renewed. Texts and images are associated according to an aesthetics of fragmentation and re-arrangement likely to mingle the voices of the different times and create harmony out of diversity. Working as a renewed memory of Antiquity at the dawn of the modern era, mythographic writing activates a plurality of discourses within the transmission. It presents pagan gods with their restored usefulness, that is, the power of offering, through the arrangements of words and images, a space of pacified reflection, open to differences and cultural comparison

Повний текст джерелаFrom the point of view of Persian historiography, the 13th century identifies with the considerable changes brought about by the Mongol invasions throughout the Iranian plateau. For the history of literature, however, this sour era dates a single founding episode: the advent of literary theory in Iran. In fact, the emergence of two full-fledged artes poetica, entirely conceived and composed in the Persian language, just a few years apart, at opposite ends of the Persian lands (Shiraz, Alamut), could not easily be predicted. With his Compendium on the Standards of the Poetry of the Persians (Ketāb al-mo‘jam, fī ma‘āyīr aš‘ār al-‘ajam), Šams-e Qeys-e Rāzī (circ. 1175-1240) delivered the indisputable classic of the genre. As for The Standard of Poetry, on Metrics and Rhyme (Me‘yār al-aš‘ār, dar ‘elm-e ‘aruḍ va qavāfī) by the great scholar and polymath Naṣīr al-Dīn Ṭūsī (1201-1274), it offered a far-reaching discussion of the essence of poetry. Together, these two works embody the inaugural legacy of Persian literary theory. They further defined the two major trends followed by later authors: the estheticliterary and the philosophical approach to poetry. With this cross-reading of the texts, we hope to shed some light on an event of no little importance: the emergence, in Iran, of a genuine endeavor to account for poetry as such

Повний текст джерелаThe relationship between international investment treaties and the underlying contracts remains a highly disputed matter in international investment law. This thesis explored the contract-treaty interaction by using the renegotiation of regulatory contracts in the sector of energy infrastructure as a natural experiment, with a particular emphasis on the arbitral disputes that arose from the Argentine crisis. It deployed to this end an original analytical framework drawing from transaction cost economics and relational contract theory. The result of the novel combination of these two analytical frameworks is the construction of an interpretative methodology that takes an integrated approach to the two instruments – the contract and the overarching treaty – in a way that achieves a more sustainable balance between the competing public and private interests. In particular, the thesis rests on three arguments: the first is the relational-contract nature of dynamic treaty standards, which require the long-term cooperation of the parties. The second is the status of these vague standards as default rules complemented by the provisions of the underlying contracts, which are also relational, and act as gap-fillers. The last, normative argument is that the relationship between these (default) treaty rules and the (gap-filling) contractual provisions should be determined by transaction cost economics, and specifically the goal of economizing on the transaction costs of bounded rationality and opportunism when and interpreting relational treaty standards

Повний текст джерелаHuman rights treaties have been adopted at the end of the first half of the XXth century, in a technological, social and economic context which has since then deeply evolved. To maintain the effectiveness and relevance of those treaties, specialised jurisdictions have therefore increasingly interpreted their provisions in light of current living conditions. This method, called evolutive interpretation of treaties, is still looked at with suspicion. Indeed, it is not recognised by the Vienna Convention on the law of treaties and it may lead the judge to depart from the parties intention as expressed in the text of the convention. The evolutive interpretation of treaties invites therefore to reconsider the international judge’s interpretative function, between its strict theoretical conception and the empirical needs of contemporary international law

Повний текст джерелаDrawing is the most common way to communicate about shapes.Thus, using sketching as a tool in the process of modeling 3D content is an attractive approach.However in the world of machines, drawings are still difficult to interpret as shape depictions.This has been the challenge tackled by many different research works since leveraging the little we know about perception is non trivial.My thesis focuses on pushing the limits of what can be inferred from single drawings of smooth shapes without any help from the user.In a first attempt we chose to select a category of shape namely animals and other creatures for which prior knowledge helps to solve the problem.Then we proposed to generalize parts of the solution to tackle the case of free form organic shapes.This manuscript thus presents the respective solutions we developed. The first one is able to infer plausible 3D models of animals from a single side-view sketch using anatomic principles to both interpret the drawing's elements and infer depth offsets between these elements.The second is an approach to decompose depictions of smooth shapes with non trivial cusp points into a set of structural parts' silhouettes ordered in depth, which can be used for editing and animation purposes.Many related ideas were explored on the way, and the ones presented in this manuscript leaves me confident about the future of this field of research

It develop an historic anthropology of language since a critic of rythm and also a critic mileage through the whole human sciences. The poem, as an ethical and political act, innervate the theory of relationship in and by the language. Against all the separatisms (prose versus poetry) and all the dualisms (sound and sense, living voice and dead letter), let’s listen the continuum between language, ethical and political who let the poem begin a mutual and reciprocal invention of a language’s form by a life’s form and of a life’s form by a language’s form. Poems of Henri Meschonnic are inventions of life. Those relationships-gestures aim at other subjects, drawing in a social language. The continuum that elaborate Henri Meschonnic’work makes her a lever to rethink the theory of language, first by writing poems, then in translating again the Bible and giving again rythm to her. Poem and translation, by making think on the language, make an invention of the unknown and produce ther own effects of knowledge. Writing poems, practicing both translation and epistemology of translation, and in the same time thinking again the theory of language are indissociable, because they merge with the life herself

Повний текст джерелаThis doctoral dissertaion consists of a new translation of Plotinus'Ennaed IV, 3 (27) provided with notes, a running commentary and an introduction. The structura of the dissertation follows the model provided by Pierre Hadot in the series of Plotinus translations which he founded with the publisher Editions du Cerf (Ecrits de Plotin). This new translation, which divides Plotinus' text into sections and provides it with marginal summaries, is based on a very close analysis of the Greek text and takes into account the various translations available in modern languages. The copious footnotes to the translation deal with problems pertaining to the Greek text - especially question concerning grammatical structures and vocabulary - offers alternative possibilities for translation and points out Plotinus' sources. The introduction represents an attempt to determine the overall significance of Ennead IV, 3 (27), to situate it in the context of Plotinus' Ouevre as whole, to outline its structure, the philosophical methods employed and to identify Plotinus'interlocutors. Furthermore, a large section of the introduction is devoted to the analysis of ten fundamental philosophical problems which arise in the context of Ennead IV, 3 (27). Finally, the commentary, which follows the exact order of Plotinus' text provides a philosophical interpretation of Ennead IV, 3 (27) in totality

Повний текст джерелаThe Kitāb al-Ğadal (Book of Dialectic) by Avicenna (Ibn Sῑnā) is incorporated within the framework of his huge comment of the Organon which constitutes the Kitāb al-Šifā’ (Book of the Healing). Dialectic is considered through a double perspective : in its capacity of being a technique of the reasoned dialog, it introduces to the study of truth (science of demonstration) and is at the same time a tool for philosophical persuasion headed to masses (political function) and to philosophy students (propédeutique, i. E. Preparatory function). The Avicennian undertaking meets with al-Fārābῑ’s in its will to assign to dialectic, in the continuity of Aristotle’s Topics, the eminent task of rationally structuring the philosophical discussion starting from topics (common places) of argumentation that empower to rule the syllogism. In such a way, it is based upon a highly elaborated technique of premises concession (taslῑm / tasallum) between a respondent and a questioner, as well as it is based upon a capacity of imposing on the adversary a contradictory opinion to his. In a higher extent than in Fārābῑ’s philosophy, the Ğadal strengthens the philosophical critic opposed to kalām theologians, who make use of a method of discussion that is eager to be as close as possible to the philosophical syllogism. However, according to our philosopher, the latter scholars mistreat the dialectic syllogism for they are unaware of the strict rules of the Organon and they seizes the persuasion technique in order to reach goals that are purely rhetorical (obtaining victory against the opponent) or in order to satisfy their desire of political ambitions in the frame of the expression of a courtyard thought sustained by a flourishing patronage since the beginning of the Abbasid caliphate

Повний текст джерелаOur research is about Eugène Grasset (Lausanne, 1845 - Paris 1917), a teacher and a theorician working in the pronciples of the Arts and Crafts movement. He became one of the pioneers of Art Nouveau in France where he was established from 1871, although he maintained close contacts with Switzerland and, more particulary, with Lausanne. Eugène Grasset did not confine himself to one only artistic medium (producing paintings, sculpture, furniture, ironwork, leaded glass windows, jewellery, illustrations, textiles, etc. ). He had success as an artist, a designer and a teacher. It is this last aspect which was the focus of our thesis. Grasset thaught in Parisian schools (Ecole Guérin, Académie de la grande Chaumière, rue Madame, Ecole Estienne). His teaching was then to lead him to publish two important works: "La Plante et ses applications ornementales" (1896) and "Méthode de composition ornementale" (1905). In the lecture otes we have discovered a third work which is unpublished: "Composition végétale" (1911-1912). The close study of Grasset's manuscrits was fundamental to understand his teching itself, but also to see the relation between artistic and didactic work

Повний текст джерелаEl Otomano famoso, may be an early work by Lope de Vega, is an outsanding play on several accounts. After analyzing it according to the principles of conceptismo, it turns out to contain many self references which testify to the genesis of the work and the paragrammatical process used that turns the title into a poetical programme. Other self references reveal the enigmatic aspects of this comedia that is a huge enigma of 2569 verses, and therefor an agudeza compuesta. Moreover, intertextuality is very rich since through multiple hints, the sources from which Lope drew his inspiration are quoted: La Silva de varia lección by Pedro Mexía, which gave the name of the character, the plot and the framework of the lesson, the sonnet “A la entrada de un valle” by Garcilaso de la Vega, Emblems by Alciat, the Republic by Plato and, may be Tristia and Epistulae ex Ponto by Ovid. The christian intertext is also of a remarkable complexity. El Otomano famoso is also structured owing to Oedipus complex, and testifies to a knowledge of the human being that is as exact and to the point that what the founder of psychoanalysis discovered three hundred years later, encompassing man in its globality, both animal and spiritual. The diversity of rhetorical references Lope used in his comedia contributes to the creation of a textual, dramatical labyrinth which opposes its complexity to the reader’s sagacity and makes it possible to offset potential “aggressions” from Lope’s contemporary ill-intentioned readers. To this extent, it exactly corresponds to Alciat’s emblem, entitled “non vulganda consilia” (secret pieces of advice mustn’t be revealed)

Our aim in this thesis is to offer a new French translation, introduction, notes and detailed commentary of the various themes covered in the treatise together with an analysis of their other treatments in the Plotinian corpus, their points of contact with the greek philosophical tradition before him and their connections with gnostic positions known to us via the indirect witness of the Christian heresiological tradition but also via direct witness of which our principal source is the relatively recently discovered Nag Hammadi writings. The research developed here enables us to confirm that treatise 32 (V, 5) constitutes the third part of an antignostic tetralogy on account of the centrality of the questions developed in the first and second part of treatise 32 (V, 5) in the Plotinus’ debate with the gnostics, namely, the theory of the interiority of the intelligibles to the Intellect and the definition of the First Principle as the Good, transcendent origin of all realities which can only been apprehended through a formless and supraintellectual vision

Its implication, wich it is a French tradition for academics to study, go beyond the frame of a first writing. The "Treatese on the improvement of the understanding" presents the spinozian methos as the production of truth on intellect and nature from the true given idea. This starting point is sufficient to act as the foundation of a new way leading to ethical philosophy while pointing towards data that is both produced and available for use in order to create a vast amount of intellectual works following necessary order and automatism. However, spinozian data overflows the field of the true idea given as well as the spinozian analogy between technical and intellectual productions, since it also involves the cultural devices available fo Spinoza to create is own work. Experiences, histories, sciences, definit datas of the scriptures, corporal modifications, technical and political practices, all constitute the starting point for Spinoza's constructions of the future philosophy. The intellectual factory, as real art of thinking making concepts and dissociating oneself from traditions, is therefore not only a first way followed by Spinoza towards the future philosophy, giving new life to artificalist models of the method during Renaissance, but it's also a source, from which it is possible to understand Spinoza's practice of philosophy on the pattern of art

Повний текст джерелаJudging paintings, assessing their quality and estimating their price is nowadays considered a specific expertise acquired by agents to whom auction houses, museums or collection owners turn. In Rome during the seventeenth century, different groups compete to appropriate this skill, especially in order to become advisers to great collectors. As a market of paintings gradually emerges and the circulation of works grows, knowing how to estimate their value becomes an essential ability. While price evaluation is traditionally the prerogative of painters, who value each other within their corporation, the emergence of new commercial criteria tends to undermine the profession's authority in terms of quality assessment. This research focuses on the development of this expertise, which is remarkably different from the painters' know-how and favors courtiers specialized in painting advice. Giulio Mancini theorized this skill in his treatise Considerazioni sulla pittura. By crossing this text and the transcription of some of his unpublished treatises, the thesis shows how this artistic judgment is integrated within a broader, shared courtesan culture. At the crossroads of history, art history and literature, this research proposes to analyze the historical process of formalization of artistic judgment, thus not only shedding new light on this practice, but also on the discourses that made it possible and the reconfiguration of the value criteria of works of art

Повний текст джерелаThis PhD Thesis on shoreline changes in western African sandy coasts from Mauritania to Guinea Bissau is a contribution to the “Prospective review of the long-term coastal environment changes in western Africa”, scientific research component of the Regional Coastal and Marine Conservation Program for West Africa (PRCM). Its main objective was to highlight and measure erosion and accumulation processes occurred over several decades on the sandy shores from Mauritania to Guinea Bissau at regional and local scales. The comparison of the instantaneous waterline and the vegetation line positions extracted from multi temporal Landsat images by density slicing or classification with the ISODATA algorithms indicates a regional progradational trend of highly mobile coastal forms like sandy spits, small islands and beach barrier associated with the estuarine systems from Senegal to Guinea Bissau in spite of localized erosion cases. The local analysis focuses on four sites located along the Mauritanian and Senegalese shoreline (Nouakchott area, Ndiago - Saint-Louis, Bargny - Yene-sur-mer, Mbour - Pointe Sarène) and approximately stretching over 67km. It is primarily based on digital processing and interpretation of aerial images in a GIS. Thereby the study of the spatial and temporal evolution of the position of selected shoreline indicators (high water line or upper beach limit) reveals that 47km (70 %) of the studied coastline are eroding and only 20 km (30 %) are prograding

Повний текст джерелаThe Coan Prognoses are one of the treatises of the Hippocratic Corpus. The work is anonymous and can be dated from about the last third of the IVth century b.C. It is presented in the form of a collection of 640 propositions, most often written in a aphoristic style, that are for more than half of them taken from Hippocratic treatises like Aphorisms, Pronostic, Prorrhetic I, Epidemics, Diseases I-II-III, or On head wounds. The content of the compilation is exclusively devoted to the medical prognosis. The treatise had only a very limited tradition in the Antiquity, and was translated neither in Syriac nor in Arabic. Any latin translation is known before the Calvus translation (1525), which represents the starting point of the scholars return to the manuscripts which pass down the text. The introduction presents the work (title, datation, readership, relationships with the others Hippocratic treatises, structure and devices of composition, medical theories, style, history of the treatise, direct and indirect traditions, editions, dialect). The edition itself is mainly based on the more ancient and conservative manuscript, the Parisinus graecus 2253 (A), and also on the indirect tradition (Hippocratic treatises which represent the sources of the work, and Galenic commentaries). To allow the reader to form his own opinion, we wanted to introduce and translate the work of Joseph Albo. Translating the whole of the Sefer Ha-ʻIqqarim exceeding the framework of our project, we simply translate the first treaty which presents the conception of Joseph Albo on fundamentals and its reduction to three fundamental principles which are the belief in the existence of God, the belief in a divine revelation, and the belief in retribution. The three following treaties being only a deepening of the first, we have translated an additional chapter to see and understand how Joseph Albo develops the theme already opened in the first treaty. This is the third treaty that develops the second fundamental principle of belief in the divine revelation

Повний текст джерела“Sein und Zeit” is a Abhandlung, a “treatise”. Even though it never gives an express definition of this status, which it claims yet explicitly, “Sein und Zeit” founds it nevertheless on its own mereological structure, in other words on the articulation of a whole and its parts. This structure isn’t limited to a textual division of the work into parts, sections, chapters and paragraphs. At a deeper level, it implies the concordance of these textual divisions and those of the thing itself, that is to say those of the Dasein, whose structure: being-in-the-world, is itself the object of a tripartition. As a result, there’s a risk of fragmentation, both textual and ontological, which turns out to be inherent in the very act of determination. Thus, it would be the problematic act of determining the Dasein, which, by going deeper into the mereological problem, would give to “Sein und Zeit” its treatise structure. Consequently, our purpose is to show that the treatise of 1927 allows to interpret its incompletion precisely on the basis of its treatise structure – that is to say on the basis of a merelogical project of determination which doesn’t authorize an articulation of a whole and of its parts because it reaches its highest point with the discovery of a constituent indetermination, and which nevertheless can’t or doesn’t want to abandon the treatise structure it had initially adopted

Guillén's main character, as the basis for an inquiry through the history and the human fight of the Black people enslaved by the colonists and driven from Africa to Spain and then to Cuba. She shows how destructive and humiliating this enslavement has been, by portraiting the everyday life of the people who were forced to work in the Cuban plantations and by detailing the legal measures ruling their situation. All the aspects of these historical tragedies (slave-trade and slavery), as well as its current consequences (racism, injustice) are analysed here in the most accurate way. Because he worked for Black people to be rehabilitated, the Cuban mulatto N. Guillén appears to be the poet of the synthesis, the stronghold of crossbreeding and solidarity between Taïta Facundo and Don Federico's descendants. Finally Guillén's poetry is described as a true mirror of history and a weapon for the conquest of freedom

Повний текст джерелаThe object of our study is a critical edition of the traite de religion contre les athees, les deistes et les nouveaux pyrrhoniens (religious treaty against the atheists, the deists and the new pyrrhonians). This treaty, of which the author is father michel mauduit (16341709) was published in 1677, and modified and increased by the author himsel in the second edition (1698). First and foremost, what draws our attention to his treaty is its connction with the pensees of pascal, especially with the fragment "infini rien" or "wager" (laf. 418 - sel. 680). In his preface, mauduit admits explicity his debt to pascal. However, mauduit uses the argument of the wager in combination with a number of other arguments. Historical and traditional which distorts pascal's original text. Whereas pascal insits on the rational obligation to "wager" on the truth of religion. Mauduit seeks to prove that truth, and his proofs logically make the wager unnecessary. Our thesis consists in two volumes. The first comprises an analysis of the arguments of the treaty, study of contemporary critics and a compariason with the pensee of pascal. In the second volume, we reproduce the second edition of the treaty with the variants of the first edition

Повний текст джерелаThe Treatise which shows buddha nature, written by the 3rd Karmapa Rangjoung Dorjé (1284-1339), is an important text in the Karma Kagyü lineage of tibetan buddhism. It indicates indeed the true nature of every being, the true self, and the mahāmudrā meditative practice which is specific to this lineage is grounded on that understanding. This study proposes a french translation of the Treatise which shows buddha nature and of a commentary written by Jamgön Kongtrül Lodrö Tayé (1813-1899). We also try to understand the meaning of Buddha nature presence and the reasons why we should know it to practice mahāmudrā meditation. Since Buddha nature points out an inexpressible state of consciousness, we propose to apprehend it by following the path that the ordinary consciousness should go through, in order to recognize what is true, which is emptiness-luminosity

Повний текст джерелаThis work is presented in three parts: a critical edition of the “Treatise on the Four Marriages” of Jeanne Chézard de Matel (Roanne 1596 – Paris 1670), a historical-Theological analysis of the treatise, and an exploration of the theological questions on the Incarnation raised in this treatise, giving rise to an incarnational spirituality. The edition of the text presents research on the life of the author (a mystic from the region of Lyon, foundress of the Order of the Incarnate Word and Blessed Sacrament), her milieu, her sources, her writings, and her theology, as well as research on the history of the treatise (the manuscript, date of composition, copyist, relationship with the “Treatise on the Three Marriages”, and the sources of its content). The second part analyzes the treatise according to two themes: the reading of Scripture and spiritual marriage. The analysis, keeping in mind the treatise’s historical context and sources, seeks to open a theological reflection on the issues raised in the treatise. The third part puts Jeanne Chézard de Matel in dialogue with contemporary theologians, taking as a common point the current reader’s experience. The study explores the relationship between time and eternity and between Creation, Incarnation and Salvation. The work culminates with the presentation of a spirituality of the Incarnation, understood as an eternal and salvific union of love which binds all humans together with each other and with God

Повний текст джерелаThe Commentary on John of Origen (c. 185-c. 254) is an important exegetical work, maybe the chef-d’œuvre of this prolific Greek-speaking author who regarded the Bible as the foundation of his works, both in his exegetical commentaries and in his critical edition of the text. This work is also the first commentary on the Gospel of John that has survived to this day. Yet, there are only partial studies about it whether thematic or theological. The present work deals with this commentary as a whole from a literary point of view. Reading the text closely and with a particular approach, it defines the stylistic and literary devices with which the author builds up his interpretation. In this perspective, it analyses how the exeget puts into practice the ancient hermeneutical principle that consists in “explaining Scripture by Scripture”.Thus after presenting the commentary itself and his features, it describes the different elements of the writing process, and then offers some comments about the structure of the exegesis. It highlights the fact that the commentary paradoxically gives way to the biblical text itself. Indeed, the author constantly tries to imit the form and the language of the text he comments, and his own task seems to consist less in building a new work than in “picking” and making the connection between different biblical elements, like a “herbalist of Scripture”. Surprisingly then, the author uses a similar method in commenting the Bible and in editing its text

Повний текст джерелаBased on raw datas and fieldworks (Guyana, Tanzania, Trinidad, UK, USA. . . ), this study is about the life and works of the historian Walter Rodney (l942-l980). Historical analysis prevails, linked with anthropology, economies and political philosophy. As the analysis goes on through parallel stories, the pan-African issues become increasingly accurate through several prospects: that of Rodney as an engaged historian, as an activist, and that of the author, who tries to scan the contemporary relevance of Rodney's ideas. The introduction refers to some theses, classical or rebel, that explain the Pan-African history. After recalling the violent circumstances under which Rodney died, the examining of his theses about slave trade, capitalism and development, introduce to current political and intellectual debated issues: colonialism, dependency, debt and reparations. His personal contribution to Black Power and Rastafari movements, his fascination with revolutionary struggles (Cuba, Haili. . . ), and his knowledge of African struggles in Europe and Americas inscribe Rodney in the genealogy of Marcus Garvey's inspired Pan-Africanism. Involved with the « intellectual guerillas » of the Tanzania marxist school (Babu, Cabral, Fanon, Guevara, CLR James. . . ) and the national liberation movements, Rodney stood for an anti-imperialist Pan-Africanism, before leading in Guyana a revolutionary praxis based on the shift from « race struggle » toward a class struggle, through its entire support for workers struggling against an authoritarian regime. The thesis concludes with the need to place humanities and social sciences in the heart of political struggles and postcolonial relations

Повний текст джерелаThe law of international organisations has been the theatre of passionate academic debate between the detractors and the disciples of the relative normativity. The same can be said about the relations between the legal orders, which divide the doctrine into monists, dualists and non-aligned. Analysing the topic of the place of institutional law in domestic legal orders is taking the risk of losing one’s way in these doctrinal whirls. If we take for granted that the point of view of the domestic judge is relevant for appreciating the normative force of institutional law, we may say that the first debate seems outdated : the domestic judge recognizes that the law produced by international organisations is law, whether is binding or not. The following question is to what extent the norms thus produced may be source of rights and obligations in the internal legal orders. The entire range of legal orders examined requires for institutional law to be incorporated for that purpose. The domestic judges leave nonetheless the door opened to other forms for taking into account some of the legal effects of institutional acts. These convergent tendencies show both that the monist/dualist divide is immaterial for the legal status of these acts and that the dualist doctrine does not accurately reflect the modalities of interaction between the legal systems in the world of pluralism. The recognition of unincorporated legal norms, which triggers consequences in terms of conflict of norms and judicial review of institutional law, stands in favour of a model of coordination and not of separation of the legal orders
