Alors que les flux migratoires « spontanés » sont en recrudescence depuis le début du XXIe siècle, la mer est devenue le théâtre d’un drame humanitaire qui semble sans fin. Sur toutes les façades maritimes européennes, les décès ou disparitions de migrants demeurent fréquents du fait de conditions de transport extrêmes, le plus souvent liées au trafic dont ils sont l’objet, ou de manoeuvres dangereuses opérées à l’occasion de leur arraisonnement. Au risque de perdre la vie en mer s’ajoutent des atteintes répétées à la dignité et à la liberté du migrant imputables à certains États côtiers de départ et de destination qui cherchent à interrompre sa navigation, y compris lorsqu’il manifeste un besoin de protection internationale. Si la lutte contre l’immigration irrégulière ou la criminalité organisée constitue un motif légitime d’interception en vertu du droit international de la mer, les actions (recours abusif à la force, refoulement, expulsion collective, privation arbitraire de liberté) et inactions (refus de coordonner un sauvetage ou de coopérer au débarquement des rescapés dans un lieu sûr) de certains États dans cet espace constituent une grave méconnaissance des droits de l’Homme, du droit des réfugiés et du droit relatif à la sauvegarde de la vie humaine en mer. Le comportement des acteurs privés du monde maritime peut également se révéler préjudiciable au migrant en détresse, rescapé ou passager clandestin. Le constat ainsi dressé impose de réfléchir à la manière d’assurer la jouissance et l’exercice effectifs des droits du migrant en mer. À cet égard, la présente thèse se propose de résoudre des problématiques insuffisamment ou non appréhendées par le droit positif : elles concernent la teneur et la portée du droit fondamental d’émigrer appliqué à l’espace maritime, la question de la licéité d’un refus de débarquement opposé à un migrant rescapé, ou encore l’incapacité apparente des juridictions supranationales à contrôler les pratiques d’États européens qui tentent de diluer leur responsabilité à l’égard du migrant en mer dans celle d’États tiersWhile “spontaneous” migratory flows are on the increase since the beginning of the 21st century, the sea has become the scene of a humanitarian drama that seems endless. On all the European seaboards, the deaths or disappearances of migrants remain frequent due to extreme transport conditions, most often linked to the smuggling in which they are the object, or dangerous maneuvers carried out during their boarding. In addition to the risk of losing their life at sea, there are repeated attacks on the dignity and freedom of the migrant attributable to certain coastal States of departure and destination which seek to interrupt his navigation, including when he requires international protection. The fight against irregular immigration or organized crime constitutes a legitimate reason for interception under the international law of the sea; however, the actions (abusive use of force, refoulement, collective expulsion, arbitrary deprivation of liberty) and inactions (refusal to coordinate a rescue or to cooperate in the disembarkation of the survivors in a place of safety) of some states in this space constitute a serious disregard for human rights, refugee law and the law relating to the safeguard of human life in sea. The behavior of private users of the sea can also be detrimental to migrants in distress, survivors or stowaways. This observation requires to think about how to ensure the effective enjoyment and exercise of the rights of migrants at sea. In this respect, the thesis proposes to resolve issues that are insufficiently or not apprehended by positive law and which concern the content and scope of the fundamental right to emigrate applied to the maritime space, the question of the legality of a refusal to disembark opposed to a surviving migrant, or the apparent inability of supranational jurisdictions to control the practices of European States which attempt to dilute their responsibility with regard to the migrant at sea in that of third States

Background: Emigration of health-care workers is a problem within global health systems which affects many countries, including Peru. Several factors have caused health-care workers to emigrate, including burnout syndrome (BS). This study aims to identify the association between BS and its dimensions with the intention of physicians and nurses to emigrate from Peru in 2014. Methods: A cross-sectional study, based on a secondary analysis of the National Survey of Health Users (ENSUSALUD - 2014) was conducted. Sampling was probabilistic, considering the 24 departments of Peru. We include the questionnaire for physicians and nurses, accounting for 5062 workers. BS was measured by the Maslach Burnout Inventory-Human Services Survey. Adjusted odds ratio (OR) was calculated using multiple logistic regression. Results: Of the study population, 44.1% were physicians, 37.7% males, and 23.1% were working in Lima. It was found that 2.8% [95% confidence interval (CI): 2.19–3.45] of health-care workers had BS. The overall prevalence of intention to emigrate among health-care workers was 7.4% (95% CI: 6.36–8.40). Association was found between BS and intention to emigrate in Peruvian health-care workers (OR = 2.15; 95% CI: 1.05–4.40). Emotional exhaustion was the BS dimension most associated with intention to emigrate (OR = 1.80; 95% CI: 1.16–2.78). Conclusion: Physicians and nurses from Peru who suffered from BS were more likely to have intention to emigrate. Policies should be established to reduce BS as a strategy to control “brain drain” from health-care workers of Peru.Revisión por pares

Arrhythmogenic right ventricular cardiomyopathy (ARVC) is an inherited heart disease, where sudden cardiac death in young seemingly healthy persons may be the first symptom. There is a need for more sensitive and accurate diagnostic methods to detect signs of disease, at an early stage and in relatives of affected individuals. The aim of this thesis is the evaluation of new non-invasive modalities in assessment of right ventricular (RV) volume and function with focus on patients with ARVC. Clinical and non-invasive follow-up of fifteen patients with ARVC during a mean period of 8 years permitted the evaluation of disease progression. RV volume analysis by magnetic resonance imaging relies on short axis (SA) views. A new axially rotated modality acquisition was tested and its feasibility in assessment of RV volume was evaluated. This acquisition seems to be able to improve the assessment of RV volume and function by reducing the uncertainty in defining the basal slice of the RV. A third study concentrated on analysis of RV regional and general function by echocardiography, using tissue Doppler imaging as well as two dimensional (2D) longitudinal strain based on speckle tracking in patients with ARVC, their first degree relatives and in healthy subjects. 2D strain showed a good feasibility in analysis of the RV function in relatives and controls but less in ARVC patients probably due to the progressive myocardial cell death with fibro-fatty replacement of the RV wall. In order to detect and follow up echocardiographic changes an index was developed combining dimensional and functional parameters for the left and for the right ventricle. Advances in the molecular genetics of ARVC have provided new insights into the understanding of the disease. Hitherto, 9 candidate genes have been identified. A new mutation in the plakophilin 2 gene was detected in a three generation family. The clinical phenotype related to this mutation was investigated. The studies have evaluated and developed methods for studying the right ventricle with special emphasis on ARVC. With the ultimate goal of preventing sudden death in ARVC, a combination of genetic testing and improved diagnostic methods may create an improved algorithm for risk stratification and selection to prophylactic treatment.

The article provides for an analysis of the legal nature of Article 30 of the Charter of Fundamental
Rights of the European Union, which declares "the right to protection against unjustified
dismissal". In the focus of attention is the question, whether this right constitutes a human or a
fundamental right or it is a right without the status of being fundamental or alternatively only
a basic principle.
The considerations are based on the legal theory of human rights and particularly social rights,
as well as on the understanding of this right in the various international treaties and the constitutional
traditions of the Member States. Furthermore, the article addresses the question of
implementation of Article 30 in the national laws, scrutinizes the interpretation of Art. 51 Abs
1 of the Charter and highlights the deficiencies and possibilities. Also the image of this right
mirrored in the European Union's law and the case law of the Court of Justice of the European
Union is examined.

In the theoretical part I discuss the conception, idea and analogs of assemblage. I explain also the course of the work, means, the technique of implementation. The craetive job consists of the collection of three works. Every work (130cm x 130cm) is implemented on MDF – average density fibreboard using paper towels, universal glue, gypsum plaster and oil color. In the creative work‘s collection „Emigration“ the problem of people leaving to other countries is analyzed. Now people emigrate due to expectations of better life, as, according to Rimas Armaitis,in Lithuania employers try to gain too much from their employees. However, in my creative work I analyze this theme symbolically. For me the fact of „disappearing“ people is most important. That is like the game of „crosses and nills“. Just it is not clear who plays and manipulates with people.

We have only partially been able meet this aim. We have attempted to follow the general approach of Steenrod [27], where he defines neighbourhood deformation retracts, but there are some difficulties involved in the theory of smooth neighbourhood deformation retracts that have made it necessary for us to assume the existence of a 'suitable' smooth structure on products such as I x X x Y, where (X, A), and (Y, B) are smooth neighbourhood deformation retracts, such that the product, defined as (X x Y, Ax Y U X x A), is an SNDR pair under this 'suitable' product structure. This enables us to develop the theory of smooth neighbourhood deformation retracts in a similar way to the theory of continuous neighbourhood deformation retracts.

Purpose: the main objective of this paper is to study the right to be forgotten as a fundamental human
right and its legal basis. Methods of research: general scientific, philosophical and specially-legal methods
of scientific research have been used. A system analysis method was used to determine the term of the right
to be forgotten and regulations related to the right. The case method and doctrinal research method were
used for determining the general understanding of the right. A dogmatic method was valuable to formulate
conclusions and recommendations of practical character within the research issues concerning the correct
and effective usage of the right. Results: the growing pace and place of the Internet have put the processing
of personal data in a new light, and it is now accepted as a fundamental human right to request to be
removed from any databases under the provisioned circumstances, thus, “to be forgotten.” To examine the
right further, studies have been made both by international and national authorities. While the right to be
forgotten must be exercised with the utmost care, it must be ensured that it does not conflict with the freedom
of expression and freedom of the press; the balance between legal interest and rights must be maintained.
Discussion: it was based on the scope and limitations of the right to be forgotten and the effectiveness of
current laws.

Many public health and social issues faced by society today are multifaceted and require joint and collaborative efforts through health promotion partnerships. Community-based participatory research (CBPR) is one strategy that consists of engaging community stakeholders from various sectors to pool their expertise and resources in addressing health and social issues holistically. The literature indicates that the effectiveness of partnerships, such as those established within CBPR initiatives, is influenced by collaborative mechanisms that promote the creation of synergy among partners. There is, however, a lack of knowledge with regards to synergy and its key determinants in the context of health promotion partnerships. This qualitative thesis study is conducted as part of The EnRiCH Project, a CBPR initiative conducted in four communities across Canada, which aims at enhancing resilience and preparedness for disasters among high-risk populations. It explores the creation of synergy through the study of dynamics of collaboration shaping the EnRiCH-Québec City partnership and influencing its ability to leverage community resources for emergency preparedness. Emergent themes highlight that optimal collaboration in the EnRiCH-Québec City partnership is about having the “right people, in the right place, at the right time”. These findings provide evidence to inform community stakeholders, researchers and decision-makers on the dynamics of synergy creation and its implications for partnership growth and effectiveness.

Freedom of religious and belief is a recognized right in international law. In order to understand, interpret, develop and implement this right, it is important to go back and analyse the fundamental reasoning behind this right. Freedom of religion and belief is a contradictory right: a freedom for self-constraint. It is a double-sided right, a right of expression and a right of identity, two aspects related to individual and group perceptions of this right. Therefore, this right must be understood through a conflict between competing conceptions of individual and group rights. International law should protect the religious freedoms of individuals, and should protect groups only as derivative from the rights of individuals, and never in contravention of them, and generally does so. Current tendencies towards recognising group rights raise concerns, highlighting the importance of this determination. The conceptual analysis of the right serves as a critical tool for discussion of specific conflicts of rights regarding religious freedom, in different area of legal regulation. Different state constitutional structures concerning religion have important implications for analysis of the group/individual conflict. A categorization of constitutional arrangements shows that each presents problems for guaranteeing religious freedom. The constitutional analysis shows religions have public characteristics, and so must abide by human rights norms. The recognition of group rights compromises state neutrality, central to liberal theory. Whatever their constitutional arrangement, states must allow participation in religious communities while protecting individual rights. Particular conflicts are analysed: A conflict between group and individual rights exists between community religious autonomy and women's rights. While international law has been decisive in mandating supremacy of individual rights in this conflict, it has not addressed some of the root causes undermining women's individual rights. Children's religious freedom, in conflict between state, religious group, family, and child, has not always been amply protected in international law, due to absence of differentiation between group and individual interests. Lastly, use of speech by individuals directed against, or in conflict with, religious groups, such as blasphemy, proselytism or hate speech, is addressed. Discussion of these conflicts examines difficulties created, and shows that although some states, based on their respective histories, religions, and cultures, protect the group over the individual, ultimately only an individualistic approach of international law is a coherent way of protecting religious freedom as a human right.

The purpose of this study is to show that instructional methods designed for right-brained students will make a significant difference in the reading achievement scores of the students when compared with the scores of right-brained sixth grade students not receiving these instructional methods.The subjects were sixth grade students who use the right hemisphere of the brain to a greater degree than the left hemisphere. The subjects' cerebral preference was determined by a test known as the Cerebral Preference Index (CPI). Ten students each were chosen from two sixth grade classes. The study consisted of a Control Group and Experimental Group. During the study the Control Group received eight weeks of the regular school's program while the Experimental Group received eight weeks of instructional strategies that take hemispheric specialization into consideration. The results indicated that there was no significant difference in the reading achievement scores of those students who received the instructional methods designed for right brained students. The analysis of data did suggest that those scoring high on the pre-test scored high on the post test. The results indicated the same outcome for low scorers.

This article addresses over the regulation of the surface right in the Peruvian Law along with its main points of contact with other important institutions in the field of real estate. The author points the evolution of this figure in the Peruvian legislation and determinates its legal nature and its characteristics, establishing its relation with the principle of real estate accession property and the implications of the transitional division that the surface generates. In other relevant aspects, the article addresses the ways of acquisition of such ownership, the role of inscription in the configuration of the surface, the reimbursement of the value of the buildings and the extinction of this property right.Este artículo trata sobre la regulación del derecho real de superficie en el Derecho peruano y sus principales puntos de contacto con otras importantes instituciones en el ámbito inmobiliario. El autor aborda la evolución de dicha figura en la legislación peruana y determina la naturaleza jurídica y características del referido derecho, estableciendo su relación con el principio de accesión inmobiliaria y las implicancias de la división transitoria predial que genera la superficie. En otros aspectos relevantes, en este artículo se desarrollan las formas de adquisición de dicha titularidad, el papel de la inscripción en la configuración de la superficie, el reembolso del valor de las edificaciones y la extinción de este derecho real.

In this thesis we find deep results on the structure of normal right n-Engel subgroups that are contained in some term of the upper central series of a group. We start with some known results, and one new result, on the structure of locally nilpotent n-Engel groups. These are closely related to the solution of the restricted Burnside problem. We also give specific details of the structure of 2-Engel and 3-Engel groups in the context of these results. The main idea of this thesis is to generalise these results to apply to normal upper central right n-Engel subgroups. We also consider the special case of locally finite p-groups and again generalise some deep results on the structure of n-Engel such groups to apply to right n-Engel subgroups. For each of the theorems on right n-Engel subgroups, complete details are given for the case n = 2. Right 3-Engel subgroups have a more complicated structure. For these we prove a Fitting result, for which we exclude the prime 3, and using this we also find a sharp bound on the upper central degree in the torsion-free case. In fact we only need to exclude the primes 2, 3 and 5 for this result. This gives some further information on the structure of right 3-Engel subgroups in the context of the main theorems.

Research has shown that video modelling can improve social behaviours in children with ASD. In addition, research in behaviour modelling training from the field of organisational psychology has shown that using a mix of positive and negative exemplars can assist in acquisition and generalisation of a skill. The current study compared the use of one negative and one positive exemplar, with the use of two positive exemplars to determine which combination would result in faster acquisition and/or superior generalisation of a skill. No other studies have examined this with children diagnosed with ASD. Seven children, aged between 5 and 15 years, and diagnosed with ASD participated in a multiple baseline design across children; within child across two modelling conditions; and within each modelling condition across two tasks. In one condition, a participant watched a video containing one exemplar of a model (same sex and of similar age but with normal development) perform a task the wrong way, and one exemplar of the same model perform the same task the right way (wrong/right). In another condition, the participant watched a video containing two different exemplars of the model perform a matched task the right way (right/right). During the intervention, 1 participant refused to watch the videos. For 13 of the 16 tasks, where training was completed, participants either reached criterion or made some gains in acquisition of the social skills. However, for seven of the tasks criterion was not reached. Generally, neither modelling condition was superior in acquisition or generalisation of the targeted social skills. Confounds occurring during the course of the study may have contributed to the equivocal results. For some children with ASD, video modelling in combination with the delivery of preferred reinforcers may be required for successful skill acquisition. Further implications, particularly the potential negative effects of vicarious reinforcement when an observer does not gain reinforcement for imitation are discussed, as are recommendations for future research.

The lean approach model presented by Allway and Corbett (2002) was used to eliminate wasteful activities in service company. A tool that would help streamline this sub-process was suggested to be implemented in EDP SC. A substantial time reduction is expected to be obtained.

Os referidos direitos, em situação de conflito nos discursos leigos e acadêmicos, leva-nos a indagar sobre as possibilidades e obstáculos do direito à cidade. O crescimento acelerado das áreas urbanas, a pobreza generalizada, a ausência de políticas públicas, entre outros fatores, têm inviabilizado a moradia digna e situada em área regularizada com infra-estrutura adequada de muitos habitantes, os quais passam a se instalar em áreas de ocupação restrita, como as de preservação ambiental. Buscando a compreensão de tão complexo tema o trabalho privilegia o alcance do direito à cidade, direito humano, considerado um feixe de direitos constitucionalmente garantidos. No sentido da função social da cidade, em sintonia com os marcos institucionais da Constituição Federal, Estatuto da Cidade e Planos Diretores dos municípios, a questão foi encaminhada sob a ótica da preservação do meio ambiente e a questão da habitação popular. No âmbito da ordem constitucional e do campo do direito urbanístico o estudo visou equacionar os desafios teórico-metodológicos no sentido da eficácia social da norma. À luz do método do diálogo das fontes, identificou pontos de equilíbrio entre os dois direitos fundamentais, complementares e compatíveis, pois necessários para a plena realização do direito à cidade.O processo da nova interpretação do conflito contou com extensa pesquisa doutrinária, legislativa e jurisprudencial incluindo o levantamento da literatura recente no campo do direito e áreas afins, além da análise da jurisprudência pertinente nos Tribunais de Justiça do Estado do Rio de Janeiro e do Estado de São Paulo.
This dissertation intends to reflect on the contemporary debate concerning the fundamental rights to housing and to environment. The aforementioned rights, conflicting in the discourses of both the academia and the laymen, conduct us to question the possibilities and barriers to the right to the city. The rapid growth of urban areas, the generalized poverty and the absence of public policies have, among other factors, made impracticable for many inhabitants to live in a worthy housing, with the adequate infra-structure and the required documentation. They end up moving to restricted places, often environmental preservation areas. In a quest to understand such a complex subject, this work privileges the reach of the right to the city, a human right, considered a beam of constitutionally granted rights. Given the social function of the city - in accordance with the institutional landmarks brought by the Federal Constitution, the City Statute and the Zoning Regulations of the municipalities - the matter was developed from the standpoint of the environment preservation and the popular housing issue. In the scope of the constitutional order and the urban law, this study goal was to equate the theoretical and methodological challenges posed by the social effectiveness of the norm. Using the dialogue of sources method, it was able to identify equilibrium between the two fundamental rights, complementary and compatible, because necessary to the complete realization of the right to the city. The course of the new interpretation to the referenced conflict counted on extensive doctrinal, legal and jurisprudential research, including state-of-the-art literature on the field, besides the analysis of Courts of Appeal rulings from the states of Rio de Janeiro and São Paulo.

The left-right concept is considered to facilitate communication and
orientation in the political world. It has a long tradition in European
politics due to its capacity to absorb different associations over
time. However, this dynamic nature of the concept requires
periodical reassessments in order to assure that a common
conceptualisation endures. This dissertation focuses on reassign
what individual left-right orientation means. Usually, this is
measured by asking people to place themselves on a scale labelled
‘left’ and ‘right’ at its endpoints. The first empirical analysis of this
dissertation shows that this measure is comparable across groups
and countries. Thereafter, the relationship between an individual’s
issue preference and left-right orientation is considered. The second
empirical analysis shows that this relationship is conditioned by the
importance people assign to the respective issues. The final analysis
demonstrates that what explains left-right orientation is contingent
on individual and contextual factors. This implies that in order to
understand left-right orientation, it is not enough to identify what
has an impact on a person’s position but also account for all those
factors that predict variation between individuals. Given this
complexity, my conclusion is that the left-right concept runs the risk
of becoming too complicated to serve as an analytical tool to shed
light on political attitudes and behaviour.El concepte esquerra-dreta és considerat com un factor facilitador de la comunicació en el món polític. Té una llarga tradició’ en la política europea degut a la seva capacitat d’absorbir diferents associacions a través del temps. Tanmateix, aquesta natura dinàmica del concepte requereix revisions periòdiques per assegurar que persisteix una conceptualització comuna. La present tesi es centra en resignar el que significa l’orientació esquerra-dreta. Normalment, es mesura tot demanant als enquestats posicionar-se a ells mateixos en una escala que va de l’esquerra a la dreta. El primer anàlisi empíric de la present tesi mostra que aquesta mesura és comparable entre grups i països. Seguidament, es considera la relació entre les preferències temàtiques dels individus i llur orientació esquerra-dreta. El segon anàlisi empíric mostra que aquesta relació està condicionada per la importància que les persones assignen als temes respectius. L’anàlisi final demostra que el que explica l’orientació esquerra-dreta depèn de factors contextuals i individuals. Això implica que per entendre l’orientació esquerra-dreta no és suficient identificar què té un impacte en la posició d’una persona sinó també una explicació per a tots aquells factors que preveuen la variació entre individus. Donada aquesta complexitat, la meva conclusió és que el concepte esquerra-dreta corre el risc de convertir-se en massa complicat per a servir com a eina analítica per a l’estudi de les actituds i el comportament politics.

When an act is right or wrong, there may be an explanation why. Different moral theories recognize different moral facts and offer different explanations of them, but they offer no account of moral explanation itself. What, then, is its nature? This thesis seeks a systematic account of moral explanation within a framework of moral realism. In Chapter 1, I develop a pluralist theory of explanation. I argue that there is a prima facie distinctive normative mode of explanation that is essential to moral theory. In Chapter 2, I characterize normative explanation through its formal properties. I then draw on John Mackie’s claim that moral explanations are queer to develop a powerful form of moral scepticism. In Chapters 3–4, I reject attempts to reduce normative explanation to logical necessity, metaphysical necessity, or conceptual (analytic) necessity. The failure of these accounts is taken to reinforce Mackie’s scepticism. In Chapter 5, I defend a partial analysis of normative explanation in terms of irreducible normative laws. I argue that irreducible normative laws offer a realist, though non-naturalist, answer to Mackie’s scepticism. The existence of irreducible normative laws then is defended as offering the best realist explanation of why rightness and wrongness supervene on descriptive properties. In Appendix A, I discuss the claim the normative explanation has an essential connection to the motivation of virtuous agents. I defend this claim from certain difficulties posed by Jonathan Dancy’s recent work.

Contemporary debates about the right to privacy were inaugurated by Samuel Warren and Louis Brandeis’ article on the topic. While Warren and Brandeis understand the right to privacy as a stand-alone right, J. J. Thomson interprets it as a cluster of rights that itself intersects with other rights. Despite such disagreement, both accounts point to a deep connection between property rights and one’s right to herself. A close examination of the Lockean and Kantian concepts of property confirms this. In particular, Arthur Ripstein’s Kantian account of innate right and property rights suggests that property rights are derived from the innate right one has in herself. Building on this account, I suggest that one’s innate right and property rights grant one the exclusive control to herself and to her property. Such exclusive control can be conceptualized as the basis for one’s privileged space, any unauthorized access to which and any unauthorized use of what lies within which constitute violation of one’s right to privacy.

The present thesis explores Article 19 of the United Nations Convention on the Rights of Persons with Disabilities, which recognizes the right of all persons with disabilities to live in the community, with choices equal to others. The relationship between Article 19 and the other articles of the Convention are explored, in order to discuss the role of Article 19 in the Convention. The thesis examines whether the right to live in the community, set out in Article 19, can be considered as the most central right of the Convention. The thesis applies the legal analytical method, and it is based on the Convention on the Rights of Persons with Disabilities; the communications of the Committee on the Rights of Persons with Disabilities; official reports of the United Nations as well as international non-governmental organizations; and scientific articles from books and journals. By using Arendt’s idea of “the right to have rights” as a theory, this thesis argues that the right to live in the community, contained in Article 19, constitutes the right to have rights for persons with disabilities and therefore it can be considered as the most central right of the Convention.

The rights that govern a person's workplace relationship, worker rights, are an important part of everyday lifefor many people on earth. As these rights are violated, the safety of the workers livelihood is threatened and as such the lack of security undermines the social contract in society. The social contract approach to corruption, as championed by Bo Rothstein, holds that as the social contract is rejected, corruption ensues. This study examines the relationship between worker rights violations and corruption using OLS regressionwith a range of control variables. The essay finds that there is a relationship between the degree of worker right violations and corruption, but only in higher welfare countries. In the studied countries with the lowest welfare, the relationship does not manifest itself. The essay also finds that in comparison to other factors of rule of law worker right violations is perhaps not the most important one when finding determinants of corruption.

Abstract This paper examines the right to family life and how it can conflict with the child’s right to protection against harm. The paper examines how the international community views the family and what rights the family has in international law. In addition to this, the paper also looks at the different family structure a family can have and it also examine whether there are a universal definition of family. Furthermore, the paper also talks about the children and the rights afforded to them and how the rights has developed through time. The concept of childhood is a much-debated issue. There have been debates on when the childhood begins but also on when it ends and the views of the States differs somewhat. Childhood is a concept that is heavy with different psychological, physical, religious and cultural believes and practices. When the States was working on the Convention on the Rights of the Child they had to try to consolidate the different views on both the beginning and the end of childhood but it proved to be problematic. To say that the childhood began at conception would have made the convention incompatible with the national law that allows abortion and it could therefore risk that some States did not sign the convention. They therefore made a compromise that meant that the States could keep their own definition on the beginning of childhood. The family as well as the well-being of the child is important and this is reflects in international law. This paper therefore also examines the articles in international and regional treaties concerning the family and the protection of the child. It also examines several cases from the European Court of Human Rights to illustrate how the Court has reasoned in cases where rights of the parents has been in conflict with the children’s rights and best interest. The conclusion drawn from this paper is that no set of rights weigh more than the other. They are both very important and if it is possible, the authorities shall try to balance them with each other. They have to have both what would be best for the child and the parents right to family life in mind. Even if the authorities have to remove a child from the parents care they need to have a reunification of the family as a ultimate goal to work towards.

This thesis begins with some old questions about the French conservatism. Why has the French right failed to create a united party on the British model'? Why have conservatives so regularly turned to authoritarianism? More precisely, how is the emergence the Croix de Feu in the 1930s to be accounted for? Was it fascist? Did it pose a threat to the established order? These questions have been addressed by means of a detailed study of the right and the extreme right in one French department, the Rhone. It is argued that from 1870 until the early 1960s the French right was divided by two fundamental problems: the desirability or otherwise of industrialization and the legacy of the French Revolution, especially the historic quarrel over the place of the Catholic Church in French society. Neither of these issues were primary; what is important is the way in which they were related in the minds of conservatives. In the 1930s these problems became acute. The efforts of conservative governments from 1928 to 1932 to stabilize and modernize the Republic initiated, on the contrary, a process of fragmentation. Instability was exacerbated by the world economic crisis. By 1935 coalition politics had become impossible. Government could be carried on only thanks to the grant of special powers. This was the context in which the Croix de Feu emerged. The league represented a mobilization of the rank and file of the right against leaders who were perceived to have failed in domestic and foreign politics. Hence its combination of radicalism and reaction. It is argued that the Croix de Feu (though not its successor, the PSF) was a fascist movement. It is also suggested that in the period which ended with the "fascist riots" of 6 February, 1934, a crisis had been developing out of which a fascist regime might have emerged. But the formation of the Popular Front and its success in manipulating the French Republican tradition, prevented this crisis from developing beyond its early stages. The electoral victory of the Popular Front, the strikes of June 1936 and the dissolution of the leagues put paid to the fascist threat. But the right remained as unstable as ever. So authoritarianism survived in different ways. In the Rhone this crisis took the form of a breakdown of the liberal tradition which had dominated conservative politics since the 1840s, and which was deeply rooted in the silk industry. In the 1920s this liberal conservative tradition was concretized in the Chamber of Commerce and the Federation republicaine. From the end of the decade it was undermined from two directions. On the one hand th~re was a challenge from a coalition of Catholic integrists, merchant-manufacturers and large landowners who were worried by certain aspects of economic and social change. In the early 1930s this group won control of the Federation republicaine. On the other hand there emerged a reformist challenge to the liberal tradition. In the countryside independent peasant proprietors turned to the Jeunnesse agricole chretienne. In Lyon the bureaucratization and feminization of white collar work coincided with the formation of a Catholic trades union movement. The diversification of the economy led to the emergence of a challenge from engineering employers. In the late 1920s these groups were sympathetic to the parties of the centre right. During the crisis of the 1930s they turned to the Croix de Feu and the PSF.

The right to private and family life and the right to the protection of personal data are two fundamental rights of the EU. The protection of these rights is addressed in the new General Data Protection Regulation (GDPR), the Directive on Privacy and Electronic Communications (ePrivacyDirective) and the upcoming new Regulation on Privacy and Electronic Communications (draft ePrivacy Regulation). In this thesis these three legal acts are evaluated in light of profiling through ultrasound tracking technology. Their technology neutrality and their functioning as safeguards of the two fundamental rights against the use of profiling through ultrasound tracking technology is tested. The GDPR is found to differentiate between profiling in the context of automatic decision-making and profiling in other contexts. The process of profiling is described in general terms. It is shown how tracking technologies in general and ultrasound tracking technology in particular have a central role in the profiling process.It is found that ultrasound tracking technology enables far wider tracking and data collection than the other tracking technologies. Differences and similarities between ultrasound tracking technology and other tracking technologies are described. According to the findings, the three legal instruments, the GDPR, the ePrivacy Directive and the draft ePrivacy Regulation, all live up to their aim of technology neutrality on theoretical level, since profiling through ultrasound tracking technology is within the material scope of all of them. An exemption is Article 8(2) of the draft ePrivacy Regulation that, unlike Article 9 of the ePrivacyDirective, does not stretch to cover location tracking through ultrasound technology. However, as will be shown, there are risks related to the practical implementation of these legal frameworks.

This paper evaluates some arguments made against the conceptions of right action within virtue ethics. I argue that the different accounts of right action can meet the objections raised against them. Michael Slote‘s agent-based and Rosalind Hursthouses agent-focused account of right action give different judgments of right action but there seems to be a lack of real disagreement between the two accounts. I also argue that the concept of right action often has two important parts, relating to action guidance and moral appraisal, respectively, and that virtue ethics can deal with both without a concept of right action.

The study argues that implicit in the Universal Declaration of Human Rights, the principle of immigration as human rights is supported by principle of positive freedom, negative freedom, and equal autonomy. The study endorses a liberal egalitarian perspective by claiming that human right to immigrate promotes equal autonomy. The study also investigates why the principle of immigration as a human right has been dismissed by doctrines within Liberalism. It argues that a state lacks a legitimacy to employ a principle of national self-determination against the immigration issue. Instead, a state has a moral obligation to the protection of a human right to immigrate; it also has a duty to provide equal social rights to the immigrants in compared with those of the citizens.

Protecting children’s development is a key principle of international children’s rights law. However, while the meanings of children’s development are a central concern of disciplines such as psychology, sociology, neurology and pedagogy, so far there has been no systematic analysis of the meaning of the child’s legal right to development. This thesis remedies this significant gap in our knowledge by establishing the foundations for analysing the child’s right to development, as protected by the UN Convention on the Rights of the Child. Interpreting the child’s right to development first requires unpacking the meaning of the term ‘children’s development’. In international children’s rights law, the thesis argues that the meaning of this term derives from the concept of children as ‘human becomings’. The focal point of this concept is the protection of children’s socio-psychological development and caring for their future, as adults. Consequently, the UN Convention on the Rights of the Child provides a broad protection for eight segments of children’s development, on top of protecting children’s overall right to development. Based on an analysis of the UN Committee on the Rights of the Child’s jurisprudence between the years 1993 and 2010, the thesis concludes that the Committee interprets the Convention in a way that subjugated most of the Convention’s rights to protect children’s socio-psychological development, while overlooking the formulation of ‘development’ as a human right. Based on literature on childhood studies, children’s rights theory, children’s development, the Capability Approach, archival research of the drafting process of the Convention, the jurisprudence of the UN Committee on the Rights of the Child, and interviews with members of the UN Committee, the thesis challenges this absorption of ‘children’s development’ into legal terms, and suggests a new framework for analysis. This framework accommodates a hybrid conception of childhood, a respect for children’s agency, recognition of the importance of the process of maturation (‘development’) as well as its outcome, and a cross-disciplinary understanding of ‘development’. Under the suggested framework, the child’s right to development is interpreted as a composite right that aims to ensure the child’s abilities to fulfill her or his human potential to the maximum during childhood and adulthood alike.

The participants' detailed accounts demonstrate how age and timing decisions can have a significant impact on the lived experience of fatherhood. The apparent continuation of a standardised trajectory for parenthood and the challenges of deviating from this have particular implications for individualisation and life course theories. The thesis provides a detailed exploration of the way in which men negotiate the timing of fatherhood, thus making a significant contribution to the literature on men's fertility decision-making.
