Šis magistro darbas skirtas fizinio asmens teisės palikti turtą testamentu įgyvendinimo analizei. Darbas suskirstytas į penkias pagrindines struktūrines dalis. Pirmojoje išsamiai nagrinėjamos testamento sudarymo sąlygos, kiekvieną iš šių sąlygų aptariant atskirai. Kitoje dalyje analizuojamos fizinio asmens teisės palikti turtą testamentu ribos, siekiant išsiaiškinti kiek laisvės turi asmuo spręsdamas savo turto likimą po mirties. Šioje darbo dalyje didžiausias dėmesys skirtas privalomosios palikimo dalies instituto analizei. Trečiojoje dalyje nagrinėjami tam tikri asmens tesės palikti turtą testamentu ypatumai. Didelis dėmesys šioje dalyje skiriamas specifinės testamentų rūšies – bendrųjų sutuoktinių testamentų aptarimui. Ketvirtoji darbo dalis skirta testamentų rūšių analizei Paskutiniojoje darbo dalyje išsamiai nargrinėjama kaip testatoriaus valia, išreikrta testamente, yra įgyvendinama. Atlikus išsamią magistro darbo temos analizę nustatyta, kad didžiausią įtaką testamento galiojimui turi testatoriaus veiksnumas testamento sudarymo metu, bei tinkama testatoriaus valios išraiška testamente. Išsiaiškinta, kad labiausiai palikėjo teisę laisvai spręsti turto likimą mirties atveju riboja privalomosios palikimo dalies institutas. Analizuojant atskirų testamentų rūšių privalumus nustatyta, kad nors oficialiojo testameno sudarymas susijęs su tam tikromis išlaidomis, formalumais ir procedūromis, šios rūšies testamentą nuginčyti sunkiau nei asmeninį, todėl didesnė tikimybė, kad... The exercise of a natural person’s right to leave property by a will is analyzed in this Master’s paper. The paper is divided in to five major sections. A thorough analysis of conditions of making a will is provided in the first part of this paper. Each condition is analyzed separately. The other part of the paper is for analyzing the limits of a persons right to leave property by a will, trying to clarify how much freedom in deciding the ownership of his property after death, one has. The biggest attention in this section is paid for the analysis of mandatory share of inheritance. Specific features of the natural person’s right to leave property by a will are analyzed in the third section. The types of testaments are analyzed in the fourth section. The biggest attention in this section is paid to the joint will of spouses. A thorough analysis of the way the last will of the testator is enacted is provided in the last section of the paper. After a thorough analysis of the Master’s paper topic the following conclusions were made. The biggest influence to the validity of a will is made by the legal capability of a person during the making of the will and the expression of the testators will. The research showed that the right to mandatory share of inheritance is the major restriction to leave property to specific persons. Questa tesi si propone di inserirsi in un contesto storiografico che analizza la peste nella storia con sguardo interdisciplinare, utilizzando le risorse della storia della medicina, della storia delle mentalità e della storia seriale, includendo discipline come la sociologia, l’antropologia e in parte i contributi della microbiologia. La documentazione esaminata è quella dei testamenti presenti nell’Archivio di Stato di Venezia per l’anno 1620 e gli anni di peste 1630-1631, permettendo così un confronto tra due anni storici che distano solo dieci anni l’uno dall’altro, ma con forti differenze sotto l’aspetto economico, sociale, istituzionale e sentimentale. L’obbiettivo è quello di analizzare il testamento e da lì il testatore, che esprime le sue ultime volontà in un momento particolare, cioè la violenta pestilenza che colpì Venezia nel 1630. In un primo momento, l’analisi sarà di tipo quantitativo per i diversi aspetti materiali che compongono il testamento. Questa parte sarà seguita da un’analisi qualitativa, cercando di interpretare, tramite il filtro del tempo e del documento storico, se sono visibili alcuni aspetti della storia delle mentalità, ossia come il testatore si pone di fronte la morte nella Venezia del XVII secolo. Questa tesi di laurea è frutto della collaborazione tra l’Università Ca’ Foscari e l’Université Grenoble-Alpes. Si tratta di una tesi nata dal progetto di doppio diploma (Double Degree), che vede coinvolto il professore dell’Università francese Gilles Bertrand, in qualità di secondo relatore.

Le De gratia noui Testamenti (= epistula 140), lettre-traité composée par l’évêque d’Hippone au début de l’année 412, présente la pensée d’Augustin sur les rapports entre grâce divine et liberté humaine d’une manière remarquablement synthétique – en raison de ses circonstances de rédaction tout d’abord, qui le placent à la croisée de polémiques très diverses, et de son originalité littéraire, qui le rattache simultanément à plusieurs genres. Cette thèse comporte trois parties. Nous proposons tout d’abord une introduction au traité, afin d’en présenter les principaux aspects – dont les problèmes historiques qu’il pose, les questions littéraires qu’il soulève et les aperçus qu’il offre sur la pensée d’Augustin. Nous en avons ensuite, à partir d’une étude de sa tradition manuscrite, établi l’édition (qui corrige celle du CSEL, datant du début du XXe siècle) et la traduction. Enfin, notre commentaire s’attache à éclairer les passages problématiques de la lettre, pour en dégager les principaux intérêts historiques, littéraires et théologiques
The De gratia noui Testamenti (= epistula 140), which is both a treatise and a letter composed by the Bishop of Hippo Regius at the beginning of year 412, presents Augustine’s thoughts on the connections between divine grace and human freedom in a remarkably synthetic way, first because of the circumstances in which it was written, which place it at the junction of very different debates, and secondly because of its originality on a literary point of view, which links it to several genres. This thesis comprises three parts. First, we propose an introduction to the treatise, which presents its main aspects – among which, the historical problems it poses, the literary questions it raises and the insight it offers into Augustine’s way of thinking. Then we have established the edition (which corrects that of the CSEL, which dates from the beginning of the 20th century) and the translation from a study of its manuscript tradition. Finally, our commentary strives to enlighten the debatable passages of the epistle in order to highlight its main historical, literary and philosophical interests

The present thesis consists of three parts. The first one deals with the implementation of definition of will both in the Civil Code of the Republic of Lithuania and in the civil codes of foreign countries. When all the essential features of will individualizing it as a legal instrument are put into one, the definition of will is formed. The second part focuses on types of wills. While comparing different types of wills enacted in the legal acts of Lithuania and foreign states many will making peculiarities can be distinct and some attention given to the evolving legal regulation and practical application problems. The doubtful meaning of joint will of spouses, obstacles of discovering the existence of holographic will are of particular interest. The third part of the thesis concerns the recently established Will register, its activity prospects and the abilities of ensuring the rights of heirs after Lithuania’s accession to the Convention on the Establishment of the Scheme of Registration of Wills.

Genom ett testamente kan en person se till så att han får sin yttersta vilja fram efter hans bortgång. Vid upprättande av testamente måste dock en testator ta hänsyn till de formkrav som gäller för handlingen, vilka är kraven på skriftlighet, underskrift och bevittning. Dessa formkrav brukar traditionellt sett bestå av en fysisk del, så som att testamentet ska upprättas på papper, testatorn ska egenhändigt skriva under testamentet och bevittningen ska ske genom fysisk närvaro. Vi lever dock i ett allt mer digitaliserat och teknikvänligt samhälle och en naturlig följd av det vore om en person kunde upprätta ett digitalt testamente. Syftet med denna uppsats är att fastställa gällande rätt avseende testamentets formkrav och utreda om de kan uppfyllas genom ett digitalt testamente. Eftersom formkraven inte kan uppfyllas elektroniskt traditionellt sett, kommer författaren istället att utgå ifrån syftena bakom formkraven. Bakom kravet på skriftlighet ligger främst bevis- och äkthetsfunktionen som syftar till att säkerställa ett testamentes tillblivelse, giltighet och innehåll. Kravet på underskrift grundas främst på viljeförklaringsfunktionen, med andra ord att testatorn ska intyga om att testamentet utgör hans yttersta vilja. Kravet på bevittning syftar till att kunna säkerställa testamentets legala upprättande och underskriftens äkthet. Syftena bakom kraven på skriftlighet, underskrift och bevittning kan uppfyllas även vid användning av elektroniska rutiner. Dock finns inte idag den teknik som behövs för att spara och arkivera elektroniskt underskrivna handlingar under en längre period. Därmed kan inte ordinära testamenten upprättas i digital form, medan holografiska testamenten som bara är giltiga i tre månader borde kunna upprättas digitalt.
Through a will, a person can make sure that he gets his last wishes taken care of after his death. When establishing a will, however, you have to take into account the formal requirements of the act, such as that the will have to be in writing, signed and witnessed. These procedural requirements traditionally consist of a physical part, for example the will shall be written on paper, the testator must personally sign the will and the witnessing shall be achieved through physical presence. However, we live in an increasingly digitized and technology-oriented society and the natural consequence of this would be if a person could establish a digital will. The purpose of this paper is to determine the applicable law in respect of the formal requirements of a will and investigate whether they can be met by a digital will. Since the formal requirements can not traditionally be met electronically, the author will instead look at the underlying aims of the formal requirements. Behind the requirement of writing is primarily the evidence and authenticity feature which aims to ensure the wills creation, validity and content. The requirement of signature is based primarily on the intent function, in other words, the testator must certify that the will contains his last wishes. The requirement of witnessing aims to ensure the wills legal establishment and signature authenticity. The purposes behind the requirements of writing, signed and witnessing can be met even when using electronic procedures. However, the technology available today is not able to save and archive electronically signed documents for a longer period. Because of this ordinary wills cannot be drawn up in digital form, whereas holographic wills, that are only valid for three months, should be able to be drawn up in digital form.

Questo lavoro di tesi si inserisce in un progetto di ricerca internazionale denominato “Venice Time Machine” dove collaborano fianco a fianco l’Ecole Polytechnique Fédérale de Lausanne e l’Università Cà Foscari di Venezia. Grazie al coinvolgimento dell’Archivio di Stato di Venezia, decine di chilometri di documenti verranno digitalizzati e indicizzati, al fine di creare un database open access da utilizzare per la ricerca e l’istruzione. Molti di questi documenti tuttavia sono particolarmente fragili oppure, come nel caso di diversi testamenti, non sono mai stati aperti, per cui le tecniche tradizionali di digitalizzazione non sono applicabili. Di qui deriva l’interesse per sperimentare nuove tecniche non invasive al fine di digitalizzare e quindi rendere fruibili al pubblico anche questi documenti altrimenti inaccessibili. Lo scopo dell’analisi tomografica è quello di creare un modello 3D del documento, su cui effettuare successive elaborazioni al fine di ottenere una separazione virtuale delle pagine e quindi permetterne la lettura anche se il manoscritto è chiuso e non può essere aperto. In particolare in questo lavoro di tesi sono stati analizzati due testamenti: un testamento del 1679, usato come campione di prova per verificare la migliore sorgente di raggi X ai fini della ricostruzione tomografica e anche per valutare l’efficacia della tecnica, e il testamento Alchier-Spiera (dai nomi dei testatori), datato 1634, di maggiore interesse poiché ancora chiuso. I risultati ottenuti sono molto soddisfacenti, poiché elaborando le ricostruzioni tomografiche è possibile la lettura virtuale sia di parole che di intere frasi. Questo risultato porta nuova linfa al progetto che, di base, si pone l’obiettivo di convertire in formato digitale decine di km di testi conservati in Archivio, ma che ha trovato, in questo tipo di testamenti chiusi, un ostacolo molto difficile da superare.

Martin de Leon, chanoine à Saint-Isidore de Leon où la communauté suit la règle de saint Augustin depuis 1148, compose entre 1185 et 1203 un homéliaire de cinquante-quatre sermons et quatre commentaires bibliques qu'il intitule la Veteris ac Novi Testamenti Concordia. Avec l'étude de cette œuvre et des structures politiques et savantes qui soutiennent sa production puis sa promotion, la thèse vise à enrichir les connaissances sur l'éthique et les savoirs des chanoines réguliers ibériques aux XIIe-XIIIe siècles, en s'interrogeant sur l'existence d'une culture qui soit à proprement parler canoniale. Pour ce faire, l'enquête s'est ordonnée autour d'une œuvre qui peut être qualifiée d'insuccès sur le moyen à long terme, tant est frappante la dissonance entre, d'une part, les intentions de ses auteurs et promoteurs jusqu'en 1240 et, d'autre part, la circulation et les lectures qu'on lui connaît par la suite. La Concordia marque une renaissance documentaire des études bibliques dans la péninsule Ibérique chrétienne: la figure de Martin a fait l'objet de tant de promotions probablement pour avoir mis fin à un hiatus exégétique de près de quatre siècles. L'attraction qu'exerce la production des écoles parisiennes sur le chanoine est décisive dans cette évolution. Between 1185 and 1203, Martin of Leon -a canon of San Isidoro of Leon, whose community had been following the Rule of St. Augustine since 1148 -wrote a large homiliary of fifty four sermons and four biblical commentaries which he entitled the Veteris ae Novi Testamenti Coneordia. By examining his work as well as the political and academic structures which supported both its production and promotion, this dissertation aims to exp and academic knowledge on the ethics and science of Iberian Canons in the twelfth and thirteenth centuries and attempts to determine whether or not there was in those days such a thing as a distinguishable canonical culture. To that purpose, the inquiry focuses on a work which can be considered a failure in so far as there is indeed a striking discrepancy between the intentions of its authors and promoters before 1240 and the way it was later used and interpreted. The Coneordia lead to a resurgence of biblical studies in the Christian Iberian peninsula. The reason why Martin of Leon became briefly so popular may be that his work put an end to an exegetical hiatus which had been lasting for nearly four centuries. Martin felt drawn to the production of Parisian schools, and this sense of attraction was crucial in that evolution. However, the weakening of his collegiate in the Iberian Church from the 1200s onwards, the development and consolidation of new ways of religious life promoted by the Leonese sovereignty and the appearance in the first half of the thirteenth century of new forms of preaching and of new postures on the lectio divina, may explain why Martin's opus aroused little interest after 1240

As from of exegetical analysis of Deuteronomy 6,4-9, this work approach the meaning of unicity of God, your respect with the law, and the mutual relation between the Trinity´s Persons in defence of one God represented by Persons. In beginning we think in Deuteronomy 6,4-9 about text located in one of books more importants in formation of Israel´s nation. The importance happen with legal constitution that manage nation´s life, and the feeling that nation sustain during her history. Our investigation conduct us to one God that today we sustains yet, with perception of presence and prominence of three Trinity Persons. Our conclusion will find comprise that God Javé of Deuteronomy 6,4-9 be present and proceed, with involvement active how Father, Son through Jesus, and Holy Spirit, that move and talk together with nation, similar called attention of Israel with the voice that invite to listen.
A partir da análise exegética de Deuteronômio 6,4-9, esta pesquisa aborda o significado da unicidade de Deus, sua relação com a Lei, em defesa do Único Deus representado por elas. Em princípio, pensamos em Deuteronômio 6,4-9 por ser um texto localizado em um dos livros mais importantes na formação do povo de Israel. A importância se faz em meio à constituição legal que rege a vida do povo, como também no sentimento que o povo nutre durante sua história posterior. Nossa investigação nos conduzirá ao Deus Único que hoje ainda sustentamos, com a percepção de sua presença, e em sua relevância. Nossa conclusão buscará compreender que o Deus Javé de Deuteronômio 6,4-9 ainda se faz presente e atuante, com sua participação efetiva que se move e caminha em meio ao seu povo, da mesma forma como chamou a atenção de Israel por meio da voz que convida a ouvir.

Denna rapport behandlar arbetsprocessen bakom skapandet av konceptillustrationer av miljö till Testament som är ett dataspel som ska lära konfirmander Gamla Testamentets historia. Ambitionen har varit att skapa konceptillustrationer av miljö som den kan ha sett ut där händelserna i Gamla Testamentet utspelade sig. Jag har dock haft anledning att tro att Gamla Testamentet inte har tillräckligt utförliga miljöbeskrivningar för att det ska vara möjligt att skildra en miljö endast utifrån det som står där. Frågeställningen har därför varit: hur skildrar jag med konceptillustrationer en miljö som inte finns detaljerat beskriven i ursprungstexten. För att besvara den här frågan har jag tagit fram ett tillvägagångssätt för skapandet av konceptillustrationerna till Testament. Detta tillvägagångssätt har bestått av att fastställa vilken miljö som konceptillustrationerna avser, en textanalys av Gamla Testamentet där miljöbeskrivningar har eftersökts, en litteraturstudie av arkeologiska källor som bidragit med information som inte Gamla Testamentet har kunnat ge, en analys av Testaments grafiska stil och framtagandet av riktlinjer som jag sedan har följt vid skapandet av konceptillustrationerna.

Min förhoppning är att andra som är i färd med att utveckla ett spel som på något sätt har förankring i en befintlig berättelse eller historisk händelse, kan få idéer och förslag från mitt arbete till hur man kan gå tillväga för att skildra miljö.

La presente ricerca mira ad analizzare la genesi e lo sviluppo della successione necessaria materiale nell'ordinamento romano, attraverso lo studio delle querelae di inofficiosità, ossia la querela inofficiosi testamenti, la querela inofficiosae donationis e la querela inofficiosae dotis. Mentre la prima costituisce uno strumento di impugnazione dei testamenti inofficiosi, quelli cioè redatti in spregio dell'officium pietatis (in cui il defunto ingiustamente disereda o pretermette i più stretti congiunti, non lasciando loro alcunchè ovvero beneficiandoli di un lascito esiguo), le ultime due querelae consentono l'impugnazione di donazioni o doti effettuate in vita dal de cuius, che siano lesive degli interessi successori dei più stretti congiunti. Il lavoro è strutturato in sei capitoli, nei quali si delineano gli aspetti principali dei mezzi giudiziari in parola: peraltro, l'alta risalenza nel tempo, la più radicata attestazione nelle fonti e la maggior importanza hanno determinato una più ampia analisi della querela inofficiosi testamenti, che del resto costituisce pure la matrice delle altre due azioni. Nel primo capitolo si indaga l'origine del rimedio avverso l'inofficiosità testamentaria: origine ricondotta all'attività giudicante del collegio dei centumviri. Il secondo capitolo è dedicato alla ricostruzione della disciplina processuale dell'azione di inofficiosità del testamento, esperibile sia davanti ai centumviri con il rito dell'agere sacramento, sia davanti al iudex extra ordinem. Nel terzo capitolo si analizzano le principali caratteristiche dell'impugnazione del testamento inofficioso: il suo carattere personale, i legittimati attivi, il regime della prescrizione, la sussidiarietà, la retroattività dell'efficacia rescindente, la possibilità di intervento e di appello autonomo da parte dei legatari e degli altri beneficiari di disposizioni a titolo particolare, la subordinazione al mancato conferimento della porzione di legittima, il suo carattere dichiarativo o costitutivo. Gli sviluppi postclassici del rimedio di inofficiosità testamentaria sono scrutati nel quarto capitolo, attraverso lo studio delle costituzioni imperiali dall'età dioclezianea sino alle soglie dell'età giustinianea. Nel quinto capitolo si considera la legislazione di Giustiniano in tema di querela inofficiosi testamenti, suddividendo le costituzioni a seconda che esse siano confluite nel Codex repetitae praelectionis ovvero nelle Novellae. Il sesto capitolo ospita, infine, le riflessioni in tema di querela inofficiosae donationis e querela inofficiosae dotis.
The aim of the research is the analysis of the rise and the development of forced heirship in roman law through the study of "actions on inofficiosity", i.e. querela inofficiosi testamenti, querela inofficiosae donationis and querela inofficiosae dotis. The first one is a remedy against wills written in breach of officium pietatis: the deceased does not mention or disinherits unfairly the closest relatives, by bequeathing them nothing or less more. On the contrary, the other querelae are remedies against donations or dowries which de cuius made during his life and which violate the succession interests of the closest relatives. The work is designed in six chapters, where the main characters of the above remedies are described: querela inofficiosi testamenti is the main subject due to its ancient origin, the most frequent confirmation in the sources and its prominent role. The querela inofficiosi testamenti itself is also the matrix of the other two legal actions. The first chapter is intended to inquire the origin of the remedy against inofficiosum testamentum, which is related to the judging activity of centumviri. The second chapter is entirely dedicated to tracing the judicial discipline of querela inofficiosi testamenti, which could be proposed both to the centumviri through the agere sacramento rite or before the extra ordinem judge. The main features of inofficiosum testamentum are analysed in the third chapter: the active entitled, the statute of limitations, the subsidiarity, the retroactivity of rescinding effectiveness, the possible intervention and independent appeal by legatees and other beneficiaries of singular inheritance, the subordination to the failure to confer the legitime and its declaratory or constitutive nature. The postclassical developments of querela inofficiosi testamenti are examined in the fourth chapter by studying imperial constitutions from Diocletian age to Justinian age. The fifth chapter is focused on Justinian legislation about querela inofficiosi testamenti through the partition between the constitutions included in Codex repetitae praelectionis and the ones coming from Novellae. Ultimately, the sixth chapter describes querela inofficiosae donationis and querela inofficiosae dotis.

Na comarca do Rio das Mortes, no século XVIII, a morte era assunto de grande relevância para os católicos e, da boa morte, em grande parte, dependia a salvação da alma. Esta pesquisa mostrará como a Igreja construía e controlava a visão dos fiéis a respeito do processo de saída do mundo terreno e a entrada para o outro mundo, e as representações que davam suporte aos modos de imaginação das realidades sobrenaturais. Tem como objetivo compreender um complexo sistema que definia a estrutura das atitudes diante da morte, elaborado para dar resposta e sentido aos últimos momentos. Espera-se, sobretudo, oferecer indícios das condições cotidianas da vivência espiritual dos testadores. Pretende-se, assim, colaborar para melhor compreensão da religiosidade nas Minas do século XVIII, sobretudo das atitudes, práticas sociais e culturais que fundamentaram as identidades do homem que viveu na comarca, nesse período, e sua relação com o fenômeno da morte e seu valor explicativo. Através de legados espirituais buscar-se-á conhecer um pouco os espaços de vivências sociais e culturais da região. Essa área de investigação revelará relações extremamente intricadas, ligadas a uma religião cristã marcada por um espaço de representação simbólica do Além que dava sentido à existência dos habitantes da Comarca nesse período.
In the region of the Rio das Mortes, in the eighteenth century, death was a matter of great relevance to Catholics, and from good death the salvation of the soul depended largely. This research will show how the Church constructed and controlled the view of the faithful regarding the process of leaving the earthly world and the entrance to the other world, and the representations that supported imagination modes of supernatural realities. Its objective is to understand a complex system that defined the structure of attitudes towards death, designed to give an answer and meaning to the last moments. Above all, it is hoped to offer indications on testers’ daily living conditions. The aim is to contribute to a better understanding of religiosity in the Minas of the eighteenth century, especially the attitudes, social and cultural practices that underpinned man identities who lived in the region, and his relation to the phenomenon of death and its explanatory value. Through spiritual legacies we will seek to know a little the spaces of social and cultural experiences of the region. This area of investigation will reveal extremely intricate relationships linked to a Christian religion marked by a space of Beyond symbolic representation that has given meaning to the existence of the county inhabitants in this period.

Testamentas – tai tam tikros nustatytos formos asmeninio pobūdžio vienašalis sandoris, kuriame išreikšta testatoriaus valia dėl jo turto ar turto dalies paveldėjimo jo mirties atveju, ir kurio teisiniai padariniai atsiranda testatoriui mirus. Tam, kad testamentas galiotų, jis turi atitikti Lietuvos Respublikos civiliniame kodekse įtvirtintus reikalavimus – testamento galiojimo sąlygas: (1) testamentas turi būti sudarytas paties testatoriaus, kuris yra veiksnus ir testamento sudarymo metu suvokia savo veiksmų reikšmę, (2) testamente turi būti išreikšta tikroji testatoriaus valia, nesant jo suklydimo bei kitų neteisėtų aplinkybių, galėjusių daryti įtaką jo sprendimų priėmimui, (3) testamento turinys privalo būti teisėtas ir aiškus, (4) testamentas turi atitikti jo formai įstatyme keliamus reikalavimus. Svarbu pabrėžti, kad testatorius privalo atsižvelgti į visus Lietuvos Respublikos civiliniame kodekse įtvirtintus testamento galiojimui keliamus reikalavimus, priešingu atveju testamentas negalios ir testatoriaus turtas bus padalintas pagal įstatyme numatytą tvarką, neatsižvelgiant į jo valią. Taigi testamento galiojimo sąlygų analizė aktuali ne tik notarams, kurie su šios srities reglamentavimu susiduria savo kasdieniame darbe, bet ir kitiems asmenims, kurie susiduria su paveldėjimo pagal testamentą teisiniais santykiais sudarydami testamentą arba paveldėję turtą šiuo pagrindu.
Testament is an unilateral deal of the personal nature which requires a specific form, expresses the will of the testator for his assets to be inherited after his death and which legal consequences arise after the death of the testator. In order for the testament to be valid, it shall satisfy the requirements established by the Civil Code of the Republic of Lithuania – the conditions of validity of the testament: (1) the testament shall be concluded by the testator who has his full capacity and full awareness of the meaning and consequences of his actions; (2) the testament shall express the true will of the testator without him being mistaken and without other unlawful factors that could influence his decisions; (3) the content of the testament shall be lawful and clear; (4) the testament shall meet all the requirements established by the law for its form. It is important to emphasize that testator must take into consideration all the requirements for the validity of the testament established by the Civil Code of the Republic of Lithuania, otherwise his testament will not be valid and the assets of the testator will be split according to the rules established by the law without regard to the testators will. Domingos, no período de 1440 a 1520, através da fonte que serviu de suporte a este trabalho, o Tombo do Convento de S. Domingos de Évora. A partir do século XIII o mosteiro estava em íntima relação com a cidade, porque os dominicanos, além de serem mais ligados ao ensino e à pregação popular, à cultura e às elites urbanas, privilegiavam as cidades mais importantes. Como espaço de implantação dos seus conventos, a crescente importância de Évora no final da Idade Média explica a instalação relativamente precoce desta Ordem e o engrandecimento deste mosteiro. Vários membros da nobreza escolheram este mosteiro dominicano para apoio espiritual ao qual acabaram por deixar em testamento, herdades, casas e outros bens em troca de favores espirituais dos frades como forma de alcançarem o céu; ### ABSTRACT: Testaments, donations and spirituality of St. Dominic’s Monastery of Évora in the period between 1440 and 1520 The present study consists of an analysis of testaments and donations to St. Dominic’s Monastery in the period between 1440 and 1520 according to the source used for this work, the Cartulary of St. Dominic’s Monastery of Évora. From the 13th century onwards the monastery was in close relationship with the city, since the Dominicans, besides being more attached to teaching and to popular preaching as well as to culture and the urban elite also favoured the most important cities. Known as a space of implantation of its convents, the growing importance of Évora at the end of the Middle Ages explains the relatively precocious installation of this Order here and the elevation of this particular monastery. Several members of the nobility chose the Dominican monastery as the place for seeking spiritual support and thus leaving it, by will, properties, houses and other valuable assets in exchange for the spiritual favours of its monks as a means to reach eternal life.

Magistro darbe nagrinėjamos testamento sudarymo sąlygos. Pateikiama testamento sąvoka, testamento istorinė raida, pagrindiniai paveldėjimo pagal testamentą bruožai. Aptariamas testamentas kaip vienašalis sandoris, kuriame išreikšta testatoriaus valia. Konstatuojama, kad testamentas turi atitikti sandoriams keliamus reikalavimus dėl: testatoriaus veiksnumo, jo valios tikrumo, turinio teisėtumo, testamento formos. Autorius daugiausia dėmesio skiria testatoriaus veiksnumui ir valiai kaip būtinoms testamento galiojimo sąlygoms aptarti, nagrinėjami testamento formų ir sudarymo tvarkos ypatumai, reikalavimai testamento turiniui. Darbe palyginami testamento sudarymo teisinio reglamentavimo skirtumai ir panašumai su 1964 metų Civiliniu kodeksu. Pateikiama teismų praktika testamento sudarymo, papildymo, pakeitimo, patvirtinimo, nuginčijimo ir kitais su paveldėjimu pagal testamentą susijusiais klausimais. Dėl darbo apimties reikalavimų tik trumpai ir fragmentiškai apžvelgtas užsienio šalių testamento sudarymo teisinis reglamentavimas.
The present MA thesis deals with the conditions of testament conclusion. It presents the concept of a testament, shows its historical development, and expounds on the main features of inheritance by a testament. The paper approaches a testament as a unilateral transaction which expresses the will of a testator. It also states definite requirements for a testament as a transaction, concerning testator’s legal capability, the certainty of his/her will, the legitimacy of the contents, and the format of a testament. The author devotes his major attention to the discussion of testator’s legal capability and his/her will, as the essential conditions for testament validity; he also deals with testament forms and the peculiarities of testament drawing, also touching upon the requirements for testament contents. The submitted MA thesis parallels differences and similarities of current legal regulations for testament drawing with the regulations drafted by the Civil Code of 1964. It introduces judiciary cases and practices on concluding, supplementing, modifying, validating, or withdrawing testaments. Due to the limitations added by the scope of an MA thesis, the paper only briefly dwells upon foreign practices of legal regulations for testament setting.

Teen die agtergrond van 'n dorp wat al vir 'n geruime tyd in verval is weens die opskorting van mynaktiwiteite, konstrueer Fabian fabelagtige gebeure en karakters om sy bestaan te verglans. 'n Ondier maak sy opwagting in Fabian se tuin en vorm die spilpunt waarom die daaropvolgende gebeure draai. Mossie, 'n tronkvoël wat pas vrygelaat is, word Fabian se handlanger en saam werk hulle onverpoos om vir die dier 'n hok te bou, hom te voed en vir hom te sorg. Ander karakters wat deel vorm van die intriges sluit in: Merinda, Fabian se vrou, 'n wynsuiper wat 'n pandjieswinkel in die dorp bedryf; Konstand, 'n geheimsinnige besigheidsman wat die dier leer dans en Aviva, Fabian se baas, wat hom 'n verhoging aanbied om mense (die uiteindelike voedingsbron vir die dier) wat selfmoord pleeg op die casinogronde te laat 'verdwyn'. Fabian en Mossie se soeke na individualiteit, betekenisvolle verhoudings en 'n behoefte aan eenvoudige en gesonde ouerskap, dryf hulle tot die uiterste van hul intellektuele en kreatiewe vermoë – met waansin as eindresultaat. Die titel van hierdie roman, Die Nuwer Testament, sinspeel op die feit dat die oorhoofse tema van die Nuwe Testament (liefde) ontoepaslik en verouderd is in die fiktiewe dorp waarin die verhaal afspeel. 'n Nuwe messias word in Fabian se tuin gebore en 'n nuwe messias beteken 'n nuwe boodskap – loodreg in teenstelling met die 'uitgediende' weergawe.

Os Testamentos Carnavalescos recolhidos em aldeias das faldas oeste da Serra do Montemuro, situada no norte de Portugal, são textos produzidos por rapazes e raparigas em processo ritual de Carnaval. Nesta dissertação é analisada uma amostra desses textos. Estes textos inserem-se numa longa tradição de discurso testamentário satírico cujas raízes se situam no século IV e na Idade Média. Esta dissertação mostra como essa tradição testamentária satírica vem até aos nossos dias, mantendo e exprimindo, de várias formas, o significado de inversão carnavalesca que põe o mundo às avessas e desrespeita jocosamente normas e hierarquias sociais. As características jocosas concretizam-se nos textos analisados, especialmente nos testamentos carnavalescos de compadres e comadres, em que os rapazes (compadres) e as raparigas (comadres) criticam os comportamentos e características dos membros do grupo oposto. A ironia exprime-se na linguagem usada para dar forma testamentária às críticas e suscitar o riso comunitário; Abstract: The Carnivalesque Testaments, which were collected in some villages of the westernsides of Montemuro Mountains, in the north of Portugal, are texts produced by boys and girls in a Carnival ritual process. In this dissertation a sample of these texts is analysed. These texts belong to a long tradition of satyrical testamental speech the roots of which are placed in the 4th century and in the Medieval Age. As this dissertation shows, this satyrical testamental tradition have come until our days keeping and expressing, by several ways, the significance of a carnivalesque inversion that turns the world upside down and jestingly disrespects social norms and hierarchies. The jocose characteristics become effective in the analysed texts, especially in the carnivalesque testaments of cronies (“compadres” and “comadres”), as the boys (“compadres”) and the girls (“comadres”) criticize the behaviours and characteristics of the members of the opposite group. The irony is expressed by the words that are used to give a testamental form to the censures and mockeries to make the community laugh ; Résumé: Les Testaments Carnavalesques recueillis en quelques villages des versants d’ouest de la Chaîne de montagnes Montemuro, au nord du Portugal, sont des textes produits par des jeunes hommes et par des jeunes filles dans un processus rituel de Carnaval. Dans cette dissertation est analysé un échantillon de ces textes. Ces textes s’insèrent dans une longue tradition de discours testamentaire satirique qui a ses racines au IVème siècle et au Moyen-Âge. Cette dissertation fait voir comment cette tradition testamentaire satirique arrive jusqu’à nos jours tout en conservant et en exprimant le sens d’inversion carnavalesque qui met le monde à l’envers et se moque des normes et des hiérarchies sociales. Les caractéristiques plaisantes se manifestent dans les textes analysés, notamment dans les testaments carnavalesques de compères et de commères, où les jeunes hommes (les compères) et les jeunes filles (les commères) critiquent les conduites et les caractéristiques des membres de l’autre groupe. L’ironie est exprimée par le langage utilisé pour donner une forme testamentaire aux critiques et provoquer le rire de la communauté.

Life insurance contract is a well-fitted instrument to ensure wealth transmission as an alternative to last will and testament. The possibility to state or revoke the beneficiary indication by will and its effectiveness since the death of the insured, gives the opportunity to avoid the ban of succession agreements or necessary succession. In addition, the social security aim, which characterizes this kind of contract, allows guaranteeing the insured amount of money and a favourable tax application. These reasons are suitable to make it a reasonable choice to optimize wealth distribution despite of or in accordance to last will and testament. The synergic adoption of these two options, which show to compensate the respective disadvantages, allows guaranteeing an optimal wealth distribution, in the case that the judicial system would continue to recognize the reserved share of an estate, assigned by law, to a specific relative regardless of the content of the will.

A presente dissertação tem como objetivo analisar em que medida os documentos com características testamentárias da Gália merovíngia refletem estratégias de transmissão de bens, ou seja, as ações planejadas pelos testadores para definir o caminho que devem tomar seus bens após sua morte, no reino merovíngio entre os séculos VI e VIII. A transmissão de bens é um ato importante da vida em sociedade. Para estudá-la, são analisados 12 testamentos do período, ou seja, todos os que sobreviveram até os dias de hoje, além da fórmula 17 do livro II do Formulário de Marculfo, que variam tanto no tempo quanto no espaço. A princípio, essa análise nos ajuda a visualizar as semelhanças entre os testamentos laicos e episcopais. Assim, podemos nos aproximar da compreensão dessas práticas legais no período, bem como da organização dos grupos sociais. A análise dessa documentação com o auxílio da historiografia é importante para que também notemos as variações dos testamentos ao longo do tempo e do espaço e como eles auxiliavam no cumprimento das últimas vontades dos aristocratas.
This dissertation aims to analyze how testamentary documents from Merovingian Gaul reflect strategies for transferring goods in the Merovingian kingdom from sixth to eighth centuries. These strategies are actions planned by testers to define what will happen to their goods after their death. The transfer of assets is an important practice of social life. To study it, 12 wills from the period are analyzed, all those which survived to the present day, plus the formula 17, book II from the Formulary of Marculf. All these testaments vary both in time and in space. At first, this analysis can help us visualize the similarities between the secular and the episcopal type of testaments. Therefore, we can understand these legal practices in the period as well as the organization of the groups. The analysis of this documentation and the aid of historiography are important to note the variations of the wills over time and space and understand how they helped the fulfillment of the aristocratic last wills.

Esta dissertação tem como proposta a edição semidiplomática justalinear de testamentos do século XVII (1651-1700), conservados no Arquivo Histórico Municipal de Taubaté, Felix Guisard Filho. O trabalho visa a oferecer a publicação de uma edição fidedigna de 37 testamentos, para os estudos filológicos, linguísticos, históricos e culturais do período colonial brasileiro. Apresenta-se o estudo histórico da vila de São Francisco das Chagas de Taubaté no século XVII, época em que foram escritos os testamentos, e o estudo filológico, que contempla a análise diplomática, codicológica e paleográfica dos manuscritos. Segue-se a edição semidiplomática e constam no fim do trabalho dois Apêndices com os índices de topônimos e antropônimos. A análise paleográfica apresenta-se em quadros dos 37 diferentes punhos que lavraram os testamentos. O exame paleográfico tem o objetivo de identificar as variações gráficas do período, buscando oferecer subsídios para o estudo da escrita seiscentista do Brasil colonial, visto que a bibliografia a respeito é muito escassa. A edição semidiplomática, acompanhada do fac-símile, será o resultado do trabalho. O corpus estudado é relevante para o estudo representativo do estado da língua portuguesa na segunda metade do século XVII
This dissertation proposes the justalinear semidiplomatic edition of testaments dated from 17th century (1651-1700), conserved at the Arquivo Histórico Municipal de Taubaté, Felix Guisard Filho. The work aims to offer a reliable publication of an edition of 37 testaments to philological, linguistic, historical and cultural studies of Brazilian colonial period. Presents the historical study of the Village of São Francisco das Chagas de Taubaté during 17th century, period that testaments were written, and a philological study, that include diplomatic, codicological and paleographic analysis of the manuscripts. It follows the semidiplomatic editing and listed at the end of work two appendices with Toponyms and Anthroponyms index. The paleographic analysis presents in tables with 37 different handwriting who wrote the wills. The paleographical examination aims to identify the graphics variation during the period, seeking to provide subsidies to the writing study in colonial Brazil during the 17th century, as literature about this subject is very uncommon. The semidiplomatic edition, followed by facsimile will be the result of the work. The corpus studied is relevant to representative study of the state of the Portuguese language in the second half of the 17th century

O presente trabalho teve como objetivo avaliar a evolução das práticas jurídicas no movimento Franciscano e, para esse fim, partimos da proto-Regra de 1210, Regula non bullata de 1221, da Regula bullata de 1223 e do Testamentum beati Francisci de 1226. Ao estudarmos a construção da norma no movimento da primeira geração menorítica, demonstramos que a pobreza franciscana e a Imitatio Christi, que tem por base as Regras e o Testamento, foram adequados paulatinamente ao modelo jurídico da Igreja da época, ajustando-se ao Corpus Iuris Canonici e ao IV Concílio de Latrão, igualando-se às demais instituições religiosas tradicionais. Para o período de 1230 a 1323, foi imprescindível avaliar a dissidência franciscana dos resistentes a esse ajustamento, a qual influenciou as relações sociais e políticas entre a Igreja e a Ordem. Este trabalho de mestrado também discutiu a institucionalização do movimento Franciscano na época de vida de Francisco de Assis (1182-1226) e as contendas jurídicas em torno dos seus escritos legislativos formuladas posteriormente à sua morte. Para fazer tal análise, avaliamos de maneira serial um conjunto de bulas exegéticas sobre a Regra e o Testamento formuladas por diversos papas. Ademais, os debates internos à Norma gravitaram em torno de dois frades de atuação significativa para a Ordem, a saber, Boaventura de Bagnoregio (1221-1274) que, ao longo de seu generalato (1257-1274), introduziu mudanças institucionais importantes na Ordem e Angelo Clareno (1245-1337), um dos dissidentes do movimento Franciscano, originário da região da Marca de Ancona, lugar de importante produção teórica por parte de uma série de frades. A partir da análise dos aspectos acima relacionados, o principal intuito deste trabalho será aquele de verificar a evolução do conceito de pobreza franciscana no âmbito das discussões jurídicas da Igreja e da Ordem dos Frades Menores.
The present work aims at evaluating the evolution of the judicial practices in the Franciscan movement and, to do so, we departed from the proto-Rule of 1210, the Regula non bullata of 1221, the Regula bullata de 1223 and from the Testamentum beati Francisci of 1226. By studying the construction of the norm in the first minorite generation, we demonstrated that the Franciscan poverty and the Imitatio Christi, which have the Rules and the Testament as their base, were adapted to the judicial model of that time, gradually adjusting itself to the Corpus Iuris Canonici and to the IV Lateran council, equalizing itself to the traditional religious institutions. The period from 1230 to 1323 was crucial for the research because we evaluated the Franciscan dissidence of the resistants to this adjustment, which influenced the political and social relations between the Church and the Order. This Masters dissertation also discussed the institutionalization of the Franciscan Movement during Francis of Assisis life and the judicial dissents about his legal writings formulated after his death. In order to analyze this, we carried out a serial evaluation a set of exegetic bulls about the Rule and the Testament formulated by several popes. Moreover, the internal debates to the Norm gravitated around two friars who had significant roles to the Order: Bonaventure of Bagnoregio (1221-1274) who, along his generalate (1257- 1274), introduced important institutional changes in the Order and Angelo Clareno (1245-1337), one of the dissidents from the Franciscan movement, who comes from the region of Marca of Ancona, a place of important theoretical production by several friars. By analyzing the aspects above, the main goal of this dissertation will be verifying the evolution of the concept of the Franciscan poverty in the context of the judicial discussions of the Church and the Minor Friars Orders.

This thesis begins from the observation that in both Jewish and'' Christian ethics humility has an accepted place among the virtues, despite the fact that not everyone would accept a positive evaluation of humility. Humility as a virtue can be defined as that, disposition which is the opposite of, pride, and which has three mutually interacting aspects. "Towards God it is a recognition of one's dependence upon him and a subjection of oneself to him. Towards oneself it is a realistic assessment of one's place and a curbing of undue ambition. ' Towards"others"it is a 'regard for them and a willingness to give oneself'in'"service'to them. This positive understanding of humility can be illustrated from early Jewish literature, including the Apocrypha, the documents from Qumran, the Talmud and the Midrash and from the New Testament.
