Повний текст джерелаThis paper presented to the Graduate Program in Social Psychology at the State University of Rio de Janeiro (UERJ), the Interinstitutional Doctorate Course (DINTER) conducted in partnership with the Federal University of Maranhão (UFMA), was proposed search the vision of the social actors directly involved with the admission a socioeducative measure in Maranhão. The objective of this research was to identify the vision of social actors on issues related to the implementation process, implementation and enforcement of a socioeducative measure deprivation of liberty. With the purpose of understand the perception of people who act in three stages a socioeducative measure admission, there was a field research with three groups of which each group was represented by individuals who were linked to each step of the measure. Data were collected through interviews with their subjects, using as support a semi-structured, prepared in line with the research objectives. For categorization, measurement and analysis of data and registers of daily records we used the technique of content analysis. The results achieved from research grants to provide a reflection on the process and give conditions under which the implementation and enforcement of the measure socio admission in Hope Youth Center (CJE) Foundation for Children and Adolescents (FUNAC) in Maranhão (MA). The search results point to an incongruity between what the law provides n 8.069/1990, which established the Child and Adolescent (ECA), which advocates the National Socio-Educational Services (SINASE) and that in fact has been effected by the unit (CJE) admission and implementation of the measure of deprivation of liberty. Besides these issues the search results also indicate that the System Guarantees Rights of the Child and Adolescent (SGDCA) in Maranhão not have worked in accordance with the principles and guidelines provided by ACE, and that the main objective of the measure socio-admission, which are the aspects of education, training and social, would not be happening in the State of Maranhão.

With the development of information technology, many kinds of living habits for everyone have been changed. Especially in 21st century, computers and mobile devices were considered as an important necessity for everyone daily lives. New information technology has brought our living standards to a higher level. These new technologies can keep us connecting with family, friends, colleagues and so forth. Moreover, social networking sites such as Facebook, Twitter and Instagram for young users were increasing in recent years. Combining these new information technologies with the sprung up social networking sites, lots of people have largely altered their way of lifestyle. However, due to the new information technologies are getting much more prosperous, new technology has provided perpetrators a newer way to commit a crime which is called as cybercrime. There are many kinds of cybercrime, including hacking, phishing, spamming, child, pornography and so on. As a result, these important issues we should concern in time. Many digital forensic tools and procedures have become a significant part for investigation of cybercrimes. Furthermore, investigators should collect important digital evidences from all the digital devices at the sceneof the crime, such as computer, mobile phone, tablet and so forth. In our work, we focus on forensics and anti-forensics of Dcard and LinkedIn applications which are running on Windows 10 computer system and Android mobile phone. In the experiment, we strive to find digital evidences that user has been done on the Windows 10 operating systems and Android mobile phone. The experiments consisted of installing Dcard and LinkedIn social networking applications, conducting user common activities through applications, acquiring image files of hard disk and physical memory, and performing manual forensic analysis on each acquired image file. The forensic analysis was aimed at determining whether activities conducted through Dcard and LinkedIn applications were stored on the device's internal memory and hard disk. If so, the significance and location of the data that could be found and retrieved from the hard disk image and physical memory image. Our study shows which features of Dcard and LinkedIn applications leave evidentiary traces allowing for suspect data to be reconstructed or partially reconstructed, and whether device forensics permits the reconstruction of that activity. All of the findings could be significant references for law enforcement agency (LEA) to investigate a crime.

Повний текст джерелаAs tecnologias de DNA têm vindo a assumir um papel crescente na governação da criminalidade. Tendo em consideração a seguinte questão de partida: Como é que os média reportam casos criminais de alto-perfil que envolvem o uso de tecnologias de DNA?, esta investigação tem como principal objetivo compreender as narrativas mediáticas sobre o uso de tecnologias de DNA em torno de casos criminais transnacionais. O presente estudo procura também explorar como a circulação destas narrativas, nos média, são interpretadas e percecionadas pelos peritos forenses que lidam com o controlo do crime. O contributo original da presente tese de doutoramento reside na elaboração de um estudo que contempla a análise dos impactos mediáticos de casos criminais de alto-perfil ocorridos no plano transnacional. A inovação desta tese diz ainda respeito à integração da análise da perspetiva dos peritos forenses envolvidos na cooperação policial e judicial na União Europeia, desconhecendo-se qualquer estudo desse tipo particular realizado até ao momento. No plano empírico, esta pesquisa utiliza uma abordagem metodológica que assentou, por um lado, na conjugação da recolha e análise de seis casos criminais transnacionais, tendo sido analisadas 306 peças jornalísticas publicadas nos seguintes países: Portugal, Reino Unido, Países Baixos, Áustria, Espanha, Itália, Montenegro, Sérvia e Suécia. Por outro lado, foram também estudadas 37 entrevistas a peritos forenses. Os resultados deste estudo confirmam a existência de uma produção e (re)construção de representações sociais e culturais sobre a(s) vítima(s) e os criminosos(as), a partir de uma leitura mediática que discorre em torno da tipificação e formatação estereotipada sobre determinadas comunidades suspeitas. Considero, por isso, a lente teórica de uma ‘performatividade da suspeição’ que permite compreender de que modo os significados atribuídos a indivíduos e grupos sociais considerados de ‘risco’ e/ou ‘suspeitos’ circulam num território transnacional e, como através dessa circulação se vão (re)criando e ‘exumando’ relações de poder e políticas entre si competitivas de identidade e de cidadania. Esta investigação concluí a importância de salientar o modo como os média assumem um papel relevante e influente na materialização e entendimento do papel da ciência forense na investigação criminal. Este papel atua no sentido da produção de um imaginário social que se traduz na (re)configuração de um ‘efeito CSI’ ao nível transnacional.
DNA technologies are taking on a growing role in crime governance. Considering the following research question: How do the media report high-profile criminal cases involving the use of DNA technologies? this research aims to understand the media narratives about the use of DNA technologies around transnational criminal cases. Also, the present study seeks to explore how the circulation of these narratives in the media, are interpreted and perceived by forensic experts dealing with crime control. The innovative contribution of this doctoral dissertation is two-fold. First, it lies in the focus of the study, e.g., the analysis of the mediatic impacts of high-profile transnational criminal cases. Second, its approach of analysis, e.g., assessing the media impact by integrating forensic experts' perspectives involved in police and judicial cooperation in the European Union. A study of this particular type to date is unknown. Empirically, this research uses a methodological approach that builds, on the one hand, the analysis focused on six transnational high-profile criminal cases. Data of 306 news articles related to these crime cases from newspapers published in Portugal, the United Kingdom, Netherlands, Austria, Spain, Italy, Montenegro, Serbia, and Sweden were collected and analyzed. On the other hand, 37 interviews with forensic experts were studied. Research results confirm the existence of production and (re)construction of social and cultural representation about the victim(s) and the criminal(s), from a media reading that discusses the typification and stereotyped formatting about specific suspect communities. Therefore, I consider the theoretical lens of a 'performativity of suspicion' which allows us to understand how the meanings attributed to individuals and social groups considered as 'risky' and/or 'suspects' circulate in a transnational territory and how through this circulation they are (re)creating and 'exhuming' competing political and power relations of identity and citizenship. The study concludes that it is essential to highlight how the media assume a relevant and influential role in the materialization and public understanding of the role of forensic science in criminal investigation. It does so by producing a social imaginary that translates into the (re)configuration of a so-called 'CSI effect' at the transnational level.

Повний текст джерелаA presente dissertação tem como objetivo analisar a forma como as narrativas construídas pelos media enviesam as lógicas do poder institucional. Identificando a influência que os órgãos de comunicação social incitam sobre a opinião pública, introjetando-se na construção das representações da realidade social acerca dos fenómenos criminais, pretende-se avaliar o influxo que estes exercem no processo criminalizador secundário. Caracterizando a forma como os media e o crime se entrecruzam, na discursividade e explanação, operam-se conceitos que se tornam, em certa instância, paradoxais como a liberdade de imprensa e o direito a julgamento imparcial. É, identicamente, determinante a relação que se estabelece entre os media e as políticas de justiça criminal. A vertente empírica circunscreve-se à recolha fáctica e processual de um caso criminal que auferiu significante destaque noticioso por parte da imprensa portuguesa. A medida de avaliação será de índole qualitativa, baseando-se no método que organiza a intervenção juspsicológica. A análise do discurso procura desconstruir e descodificar a discursividade mediática, indagando se as narrativas construídas pelos media envolvem-se na tomada de decisão judicial. Os resultados, ainda que meramente indicativos, demonstram haver uma imiscuição dos media em matérias judiciais, pelo que se verificou a presença de motivações ajurídicas nas decisões judiciais.
This thesis aims to analyze how the narratives constructed by the media skew the logic of institutional power. Identifying the influence that the media incite on public opinion, introjecting in the construction of representations of social reality about the criminal phenomena, is intended to evaluate the influence they exert on the secondary criminalization process. Featuring the way the media and crime intersect in discourse and explanation, operational concepts become, in some instance, paradoxical as freedom of press and the right to a fair trial. The relationship that is established between the media and criminal justice policies is, identically, determinant. The empirical aspect of this work is limited to the collection of factual and procedural of one criminal case, which received significant media attention and was highlighted by the press. The evaluation will be qualitative in nature, based on the method that organizes juspsychological intervention. The discourse analysis seeks to deconstruct and decode the media discourse, questioning if the narratives constructed by the media engage in the making of judicial decision. The results, though only indicative, show a media meddling in legal matters, which indicate the presence of non judicial motivations of the sentencing.
