AbstractRegulation on CSR under laws and regulations of Company Act have not given clarity and legal certainty as it does not stipulate sanction and control mechanism. In the practical level, the implementation of CSR is often mistargeted because the company does not have a clear guidance to fulfill people’s demand. It is the purpose of this research to understand how far CSR is obligatory towards Limited Liability Companies who perform business in the field of and or related to natural resources as well as to understand the reason behind mandatory CSR in Indonesia.

Human rights applied in Indonesia do not conflict with Pancasila, the 1945 Constitution and religion, and are relative-particularistic. All citizens have the basic rights to freedom. However, the freedom they possess has limits that apply to all citizens without exception, including for lesbian, gay, bisexual, and transgender (LGBT) people. The purpose of this research is to analyze the treatment and views of the society and the implementation of human rights on lesbian, gay, bisexual, and transgender. The method used was non-doctrinal research method. The results of the research showed that the presence of LGBT people is still accepted, but their behavior is not acceptable in society. In conclusion, human right is basically the basic right that every human being has from the womb, born until his death and this right is irrevocable for any reason, except by the Almighty God as the Creator. Indonesia strictly forbids LGBT because it is not in accordance with Pancasila and contradicts with Indonesian cultural values. Yet, in Human Rights Law context, LGBT should get the same rights as other citizens. Human Rights Law in Indonesia protects all citizens rights, without exception, especially their civil rights.

As implementation of the World Health Organization (WHO) Framework Convention on Tobacco Control (FCTC) accelerates and states seek to address risk factors for non-communicable disease more broadly, tension has increased between the law of the World Trade Organization (WTO) and public health. For example, Indonesia recently brought a successful claim against a U.S. law that prohibits cigarettes with a characterizing flavor other than menthol or tobacco. Indonesia succeeded in arguing that the regulation discriminates against clove-flavored cigarettes of Indonesian origin in favor of menthol-flavored cigarettes of U.S. origin. Also in the WTO context, the Dominican Republic, Honduras, and Ukraine have challenged an Australian law prohibiting the presence of branding on tobacco packaging other than product and variant names in a standardized location, font size, and style. This regulation, commonly referred to as “plain packaging,” is the first of its kind and may represent a turning point in the regulation of tobacco packaging.

This article examines gotong royong as social citizenship in the second half of the twentieth century in Indonesia. Gotong royong was traditionally understood as a collective spirit among neighbours to strengthen economic and social resilience. However, the institutionalisation of the system through massive development programmes since the 1940s has influenced the common people's perception and practice of it. This article argues that the co-option of gotong royong as part of the discourse of nation-state building transformed the popular view of labour and capital mobilisation from an openly critical stance to apparent submission. Gotong royong became a means of social engineering and an ingenious linguistic strategy by which state elites orchestrated control over the making of citizens. Still, Indonesians have remained vigilant of their participation in gotong royong, and about the potential for its misuse by corrupt officials.

<p>Abortion is a social phenomenon that is increasingly alarming. The concern is not without reason, because so far the behavior of abortion many negative effects both for themselves perpetrators and the community at large. In terms of positive law in Indonesia, there is still debate and opposition from the pros and cons about the perception or understanding of the laws that exist to this day. Objectives: In this study, we aimed to assess health beliefs, barriers, and motivations of individuals that will be useful in formulating the appropriate social and behavior change communication (SBCC) campaigns regarding dengue vector control. Methods: We conducted this qualitative study among adult residents of Gergunung and Kajen villages in Klaten, Indonesia. We conducted in-depth interviews (IDIs) and focus group discussions (FGDs) using interview an interview guide. We had audio-recorded interviews transcribed and coded. The analysis focused on general perspectives and practices of behaviors in the attempt of vector control. Results: We recruited 188 participants from 2 villages for the study. Our study revealed knowledge deficits among the villagers. Barriers include incorrect perceptions on disease severity, perceived mosquito breeding places, improper practice on mosquito source reduction, and perceived toxicity of the insecticides. Households tend to weigh the benefits of performing vector control versus perceived benefits. Conclusions: By using the Health Belief Model, a future SBCC campaign should address changing beliefs that DHF is a serious disease, increasing knowledge about mos- quito source reduction and insecticide use, and promoting benefits of performing dengue vector control.

In the post-reformation era, a new situation of religious life has challenged the Indonesian people at large. Several conflicts arose in many areas to dispute socio-religious harmony. Kupang, East Nusa Tenggara, is not an exception. In this area, the conflict occurs along with the presence of new religious groups within society. Through a phenomenological approach, this research deals with some religious groups, such as Lembaga Dakwah Islam Indonesia (LDII), Gafatar, Ahmadiyah, Hizbut Tahrir Indonesia (HTI), and Khilafatul Muslimin in Kupang. These groups have grown significantly under social and state control which keep an eye on them, especially for every political goal concealed behind the movement. They are perceived as a threat to the existence of the government and the state. This paper discusses how Management Control Systems is used to control performance in local government owned companies in Indonesia. Performance becomes important and unique in local government owned companies since those companies are not only targeted by profit but they also have responsibilities for social function. This study focuses on performance control in water supply companies as typical local government owned company in Indonesia. Balance Scorecard is chosen as the performance measurement tool in all water supply companies in Indonesia. This research applies quantitative research in order to analyze cause effect relationship between variables by using Multiple Regression Analysis. Data is collected through survey by using questionnaires. The respondents were the managerial team and employees of local government owned companies in Indonesia. The results show that four perspectives of Balance Scorecard are modified into four types of performance i.e. financial, service, operational, and human resource performance. This performance measurement is used to control people in achieving targeted performance. Moreover, this performance measurement becomes an important part of management control systems. This research also discovers that management control systems is effective to influence performance, even when some interventions exist.

AbstractA worldwide resurgence of local ethnic or religious identities has led to numerous conflicts locally, and also globally, since the end of the Cold War. This trend is exemplified by Indonesia, where political liberalisation after 32 years of authoritarian rule have allowed local identities and political aspirations to be expressed more freely and in new ways. In this paper, I look at new social movements that are demanding regional autonomy, more local control of local resources and greater recognition for traditional institutions. Such movements shed light on the challenges faced by the multi-ethnic nation of Indonesia today and, more generally, on shifting local identities in developing nations in a globalising world. An example of regional cultural revival movements in Indonesia is the Ajeg Bali Movement. This movement stems from a growing sense of disenfranchisement and desire for self-empowerment among Hindu Balinese. Contributing factors are political liberalisation and decentralisation, the 'touristification' of local culture, increasing dependence on the global economy, the threat of terrorism after the Bali bomb, the influx of Muslim labour migrants and fears of an Islamisation of the Indonesian state.

Vanilla is a high-value spice product and is used as a flavoring ingredient for food and beverages, pharmaceuticals and cosmetics. Indonesia is a major producer of vanilla in the world, however the production has declined since 2017, due to the high risk in vanilla cultivation, like economic risks (fluctuations of vanilla prices), technical risks (high attack of vanilla stem rot disease) and social risks (threats of vanilla fruit theft). Hence, vanilla cultivation has a low level of sustainability. This review aims to analyze risk control systems in vanilla cultivation to improve the sustainability of vanilla production. Given that the main risk in vanilla cultivation is the risk of attacks of vanilla stem rot disease, the risk control system uses it as a reference factor, while other factors as supporting factors. The hierarchy of risk control in the vanilla cultivation system when connected with its sustainability level follows reverse pyramids of vanilla cultivation systems in open land, shade houses and greenhouses. In its implementation, to increase the continued cultivation of vanilla in Indonesia is required cultivation with the highest risk control system, although there are consequences of increased investment costs but the opportunity to achieve high productivity will be better.

This study identified three non financial factors that influence to level of ISRD such as Media Exposure, main institusional ownership, and Islamic governance score (IG-score). Average ISR disclosure for three years had reached 55%. The test result by multiple linear regression test showed that only Media Exposure and IG-score have a significant to level of ISRD positively. On the other side, main institusional ownership doesn’t have a significant to level of ISRD. In addition, this study found profitability as control variable doesn’t have a significant to level ISRD too.

The resistance of the peasants is inseparable from the social class that is intertwined in it so that this resistance is only a tool of the interests of the actors to secure land. The resistance of Wonogoro farmers in opposing social forestry was due to the redistribution of 2 hectares of land. This study uses a theoretical analysis of class dynamics and agrarian change in rural areas. Seeing the social class of farmers who can mobilize farmers to oppose social forestry based on control over land tenure. This research uses a critical paradigm. The research location is in the Wonogoro area, Malang Regency, East Java, Indonesia. This study used purposive sampling with 20 respondents. The results of the research are the mystification of peasant resistance as shown by the mobilization of proletarian farmers by capital farmers. The mystification of peasants 'resistance shows the disparity of the peasants' social class with land management. Unbalanced land management is due to massive privatization. Unequal land tenure forms the social class of farmers. The capital peasant class by controlling the land can control the proletarian peasants as agricultural laborers. The resistance of farmers against social forestry shows that there is the mobilization of resistance by capital farmers to secure land with a 2-hectare land redistribution scheme.

This article describes the concept of civil society, which is more popular among the Muslims as Madani Society. The position of civil society is construct by the formation of various social institutions, particularly the non-government organizations. Non-Government Organization, which has autonomy and control of process’s government activities, is essential for the creation of Madani Society. Pluralism, Freedom of speech and expression, and control’s function are the important elements of democracy. It is apparent that there is a close connection between democracy and civil society. There will be no democracy without the development of civil society.

Gerakan Indonesia Tanpa Pacaran (GITP), as a <em>da’wa</em> movement, rises because of moral panics encouragement. It is concerned that promiscuity among youths is increasingly out of control. The Movement presenting its mission through social media is opposed by many circles. Nonetheless, it develops rapidly and obtains many followers. This research is meant to answer questions: 1) why does GITP develop rapidly although it is opposed by many circles? 2) What propaganda techniques are used by GITP so that it receives many followers? 3) How does GITP mobilize youths’ social praxis? To answer these questions, I use Fairclough’s critical discourse analysis. The research concludes that the triumph of GITP is not separated from the totality of propaganda. It uses seven propaganda techniques. Mobilization of social praxis is done through three discourse functions namely ideational, identity, and relational function of discourse till it produces personal piety and militant community.

This paper aims to conduct a legal analysis of the development of Marine Protected Areas (MPAs) in Indonesia. This article discusses the international legal framework and national legislation related to MPAs, progress and control, and problems in developing MPAs in Indonesia and its solutions. The international legal frameworks discussed include the United Nations Convention on the Law of the Sea 1982, the Convention on Biological Diversity 1992, and Code of Conduct for Responsible Fisheries 1995. Subsequently, the Indonesian legislation analyzed includes the Act on Conservation of Living Resources and their Ecosystems, the Act concerning Fisheries, the Act concerning the Management of Coastal Areas and Small Islands, and the Act on Marine Affairs. The progress and control of the establishment of MPAs in Indonesia have now reached the target area of more than twenty million hectares. Apart from the success of these achievements, Indonesia also has problems in developing MPAs. Current problems related to MPA development include dualism of permits, conflicts over zoning and regional spatial planning, multiple interpretations of penal sanctions, and overlapping management authorities between government agencies. The solutions offered to solve these problems include synchronizing marine tourism permits, integrating zoning and spatial plans into one regional government regulation, imposing the most severe criminal sanctions for perpetrators of destroying marine ecosystems, and transfer of full authority over the management of seven marine protected areas to the Ministry of Marine Affairs and Fisheries.

Using the Group Method of Data Handling (GMHD) tool to discern the strength of the relationship between the two representative entities, Bank Muamalat Indonesia and Baitulmaal Muamalat, it also followed the hyper postphenomenology approach to sharpen the result by obtaining essential confirmation from key informants with respect to determining the ideal model. The result showed a robust and reciprocal correlation between the account variables and its influence was statistically significant. Furthermore, it was interpreted as an effort to improve the image of the banking system while providing added value, forms of corporate responsibility and a spirit of service to customers. The results led to convergence on the formulation of the ideal model, which depends on the moral intentions of the owners of capital, government alignment and the literacy of directors, control needs and public awareness. Thus, it bridges the findings of previous studies and recommends a model that inseparable moral economic instruments.

Social distancing shall be effective to control Covid-19 spread. However, its effectiveness is doubtfully due to late response of authority in a low-resource setting such as Indonesia. This study aims to present the effectiveness of large-sale social restriction (LSSR) as the social distancing policy by analyze the chronological as well as the difference between before and after LSSR implementation in Jakarta, Indonesia. The secondary data analysis was derived from surveillance data for Covid-19 from government authorities, including the Ministry of Health and the local government of Jakarta. Two statuses related to Covid-19 were examined in the study: incidence and suspect. These Covid-19 statuses were presented in daily rates with pre and post of LSSR policy in Jakarta, Indonesia. LSSR policy had just implemented over a month after the first multiple cases found. The number of positive confirmed patients increased significantly after the LSSR (p-value = 0.000; mean difference = -70.532). This study’s findings showed that social distancing was not effective to control Covid-19 incidence which indicates the late response of the authorities.

These two things are compared with the conclusion that you can understand the factors that cause differences in the development of Islamic insurance in Indonesia and Malaysia. With a comparative approach, the conclusion is that Islamic insurance regulations in Indonesia and Malaysia are formed based on the soul of the nation by historical flow of law. Have the same foundation, but Indonesia is slower in responding to regulations. As a result, the growth of the Islamic insurance industry in Indonesia lags behind that of Malaysia. The basic couse is due to the role of law in Indonesia is less responsive because the law acts as a means of social control, for changes in Islamic insurance to be more developed.

This article looks in detail into the process of indonesianisasi at Internatio, a major Dutch trading firm in Indonesia. I draw on Dutch archival records and the voluminous Dutch and international literature on the changing environment for Dutch private business in Indonesia in the 1950s. Internatio’s case is particularly instructive for the following reasons: – Internatio was a leading trading firm in Indonesia and regarded as a ‘trendsetter’ among the so-called ‘Big Five’, the leading Dutch import houses in the archipelago. – Successive Indonesian cabinets considered import trade crucial in the process of indonesianisasi, and for this reason the sector was targeted for policies aimed at wresting control from Dutch firms and encouraging the development of indigenous ones. – Internatio had a pivotal role in the Indonesian economy due to its extensive interests, not only in import trade but also in exports, estates, manufacturing, shipping, and insurance. The article is chronologically structured, distinguishing five periods: depression and diversification (1930-1940); the end of Dutch supremacy (1940-1945); revolution and rehabilitation (1945-1950); adjusting to new realities (1950- 1956); confrontation and nationalization (1956-1960).

The lifestyle of Indonesian people who are very consumptive makes it difficult for people to invest. This can be shown in the number of capital market investors in Indonesia which is only 0.61% of the total population. The low level of financial literacy in Indonesia is one factor. Many people do not understand finance so they cannot manage finances properly. In this study, we look for 130 respondents who are college students to find out how financial socialization and financial experience influence on investment intention through financial literacy. The theory used in this research is theory of planned behavior and social learning theory. In this study, financial literacy can only mediate the financial experience of investment intention. The results of this study are in accordance with the theory of planned behavior in which one of the elements is perceived behavioral control with self-control factors originating from within, namely experience so that the financial experience is expected to generate interest in investing.

Knowledge sharing process is an interactive communication activity between individuals, aimed at increasing each individual’s competence. An organization shares knowledge as an organizational learning medium so the organization can continue to grow and update information owned by individuals. This study discussed the knowledge sharing process in organizational learning at the National Library of the Republic of Indonesia (PERPUSNAS). As the parent library institution in Indonesia, PERPUSNAS has a vital role in improving the quality of librarians, through organizational learning in the form of knowledge sharing activities. This research was conducted to determine the process of applying knowledge sharing, which included aspects of knowledge sharing behavior and the benefits of its application in organizational learning in PERPUSNAS Preservation and Conservation Sub-Division. This qualitative research used a case study approach. Data were collected through observation, interviews, literature study, and documentation. Based on study results, the knowledge sharing process in organizational learning at PERPUSNAS consisted of four aspects, including aspects of subjective norms, attitudes, aspects of behavioral control, and social networking. Librarians in the subjective norm, always directly accepted new policies from superiors. Regarding attitude, librarians succeeded in bringing the organizational direction in a better and non-monotonous direction. Regarding the behavioral control aspect, PERPUSNAS maximized staff potentials by giving the freedom to work outside the sub-field. Also, social networking issues added to the librarian’s convenience when sharing knowledge through social media groups, such as WhatsApp. Knowledge sharing activities at PERPUSNAS become a means to improve individual competencies to become better human resources.

Indonesia is well known amongst Southeast Asian countries for it multi- cultural identity in terms of ethnicity, religion, race and social stratification. Indonesia embodies its motto of Unity in Diversity, which refers to the culturally rich configuration of Indonesia, containing cultural capital and cultural power. However, cultural diversity also yields conflict due to inter-ethnic and inter- religious disputes that have the potential to generate social disintegration and even threaten the fragmentation of Indonesia as a Nation State. In the eyes of legal anthropologists, sources of conflict are often based on discriminatory policies expressed within the State’s law and legislation with regard to the recognition and protection of local communities across the country, namely ‘adat’ communities practising traditional, customary law, known as ‘adat’. Thus, State laws enacted and enforced by the Government tend to dominate and marginalise, even ignore the rights of the local communities, particularly regarding access to and control over natural resources, which is otherwise governed by the adat law of the region. This paper attempts to offer an answer to the fundamental question of whether the 1945 Constitution recognises and protects the traditional communities and their adat laws by employing a legal anthropological approach, with the purpose of obtaining a better understanding of development of State law in a multicultural Nation and looking towards a more just and equitable Indonesian State law.

To control the spread of COVID-19 transmission, Indonesia government has broadcasted information about the pandemic. The aim of this study is to evaluate the understanding of young people, about COVID-19 during the early outbreak in Indonesia. An online-based cross-sectional data collection was conducted from adolescents aged 10 to 25 years, based on 10 questions regarding general COVID-19 information. There were 355 subjects from 25 out of 34 Indonesian provinces who participated in the study, with mean age of 19.93 ± 2.91 years. Better understanding was found in the female and higher-income population. Largely, the subjects got the information from social media, instead of the official government site for COVID-19. Lack of understanding about crucial preventive measures was found, such as handwashing and physical distancing. In conclusion, the participants have an overall moderate-good initial understanding toward COVID-19 during the early outbreak in Indonesia. These results can be used as baseline data for development of awareness measurement tools.

Content analysis is used to measure the CSR disclosure based on the GRI-G4 index which consists of 91 items. This study also uses age, size, and leverage as control variables. A total of 139 samples of manufacturing companies registered on the Indonesia Stock Exchange in 2017 met the criteria using the purposive sampling method. The hypothesis was tested using multiple regression analysis techniques. We found that slack resources have a significant positive effect on CSR disclosure and family ownership has a significant negative effect on CSR disclosure. As control variables, size has a significant effect, while leverage and age have no effect on CSR disclosure.

The internet and social media expand public space has been much associated with public space and digital networks in many studies, where Habermas's public space theory and the theory of the Castells network society have been much debated about its relevance to the techno-social development. Both Habermas and Castells tend to see the public space of the Internet as a contestation space where corporate and state forces work in various ways to control and dominate it. This study emphasizes more on the creativity of citizens forming community networks through the use of the Internet and social media and conducting autonomous conversations in the public space. Netnographic studies of the dynamics of the discourse of public space in the social movement networked Indonesia Berkebun show that the Internet and social media become creative means for citizens to package global discourse locally to voice their demands. This study concludes that the concepts and theories of public space, network society are relevant as tools for analyzing public space and Internet networks and social media. The potential of the Internet network and social media as autonomous communication spaces depends on the design and purpose and the utilization of available features. Conversations - conversations that are restricted to the agenda of the 3E program help communities focus on discourse and shape the character of a rational Indonesian gardening space. This community from the beginning realized the potential of the Internet and social media to form networks and public spaces. But like gardening, public space requires commitment, such as caring for the garden from pest attacks, weeds, giving it fertilizer so the plants grow as expected.

Da`wah – usually spelt dakwah in Indonesian – has been an important aspect of Islam from its very birth. Since the late nineteenth century, however, as a result of political and social transformations it has taken new forms. In one form or others, da`wah has been practised by a large variety of Islamic movements and organizations. Although complementary to each other in certain cases, in others their relations have rather been characterized by competition for authority and power, not only between various da`wah organizations, but also, through these organizations, between regimes, categories of religious and social leaders, and social categories of Muslims. For this reason, da`wah has had important dimensions beyond the domain of religion proper. Moreover, da`wah has been connected to political and social causes such as the struggle against communism and Christianity – sometimes emulating them in certain respects – and community development. Quite a few da`wah initiatives, state-sponsored or non-governmental, have taken transnational scopes. Indonesian dakwah has shared most of the above features. This article, analyzing dakwah in Indonesia, confirms their existence and adds to their understanding. It substantiates theories on the objectification of Islam in modern societies: the spread of mass education has led to the fragmentation of religious understanding, which has stimulated a fierce competition for religious authority and the control of religious institutions and organizations. Just as in many other Muslim-majority countries, in Indonesia the state has played a prominent role in the development of mass education, the ensuing competition for religious authority, as well as the functionalization of religion. As was the case elsewhere, in Indonesia dakwah has had important dimensions beyond the religious domain. On the other hand, Indonesian dakwah has shown a number of particularities. In order to illustrate the combination of similarities with da`wah as it developed elsewhere and Indonesian particularities, the article pays particular attention to dakwah pembangunan – development da`wah – of the New Order period. It concludes that, although both the functionalization of Islam for the benefit of economic development and state involvement in religious beliefs and practices have been known in other countries, dakwah pembangunan was a unique, Indonesian phenomenon.

Religious leaders influence people's lives in increasing community satisfaction and support through their contributions and presence. The expressions of behavior and humility of religious leaders inspire self-transparency, trust, and community satisfaction. The problem in Indonesia today is that many followers or people try to kill their religious leaders. They try to kill religious leaders because religious leaders do not establish trust. In addition, religious leaders do not understand how to apply the basic ethics that form the basis of people's lives. It can divide and violate between communities. This study investigates the problem of attempted murder of religious leaders and finds out the real problem. Almost all religious leaders cannot control their emotions and cannot apply basic ethics in social interactions in society. The research method used is a mixed-method using a questionnaire distributed on Google forms for three months to 247 respondents from all over Indonesia and interviewing eight respondents as a qualitative research method. The results showed that 34.3% of respondents indicated a low level of public trust in religious leaders in people's lives. Religious leaders who can control their emotions in dealing with the community and understand how to apply basic ethics are ideal religious figures. Respondents stated that religious leaders must be consistent and protect their followers; otherwise, people can backfire on religious leaders.
