Анотація:

Between 1236 and 1240 the king's estate steward Walter de Burgo improved the productivity of about forty royal manors by systematically increasing agricultural investment to levels four to five times the medieval average. On estates where he managed the inland directly, de Burgo improved the quality of the draft animals and spent large sums on marling, smother crops, and on the purchase of foreign seed. Within four years he raised the net value of these manors 70 percent, thus demonstrating the direct link which could exist between investment levels and productivity in medieval agriculture.

This study discusses the healthcare supply of the Market Town Óbuda (Altofen) in the 18th century. The town belonged to the Zichy family and became part of the royal demesne Óbuda-Visegrád in 1766. A major driving force for its development was the neighbouring royal free town, Buda. Strong interrelations developed between the two settlements: in many cases, Óbuda’s people sought help in Buda (see apothecaries, doctors of medicine) and many hands-on health professionals (surgeons, midwives) came from this city to settle down in Óbuda or were licensed there. Based on 18th-century surveys it can be emphasized that Óbuda excelled in the number of hands-on health professionals if compared with similar towns of the region in terms of population density and legal status. Finally, in the last decades of the century, institutional forms of providing healthcare were established: a poorhouse and a so-called poor institution run by the Christian Community, while the Jewish Community founded its own hospital.

On the wave of religious enthusiasm and monastic reform under Cluny’s influence, monasteries focused their particular attention on the memory of the institution. Collective memory recorded and structured interactions of the brethren with the society, preserving the names of benefactors, patrons, and other emblematic figures. It helped communities shape their identities, demarcating their monastic networks and protecting and reclaiming their property from any exterior intervention or usurpation. This article considers three documents that have almost entirely escaped scholarly attention. This small dossier is a significant of example of how the brethren of Saint-Thierry in Reims disputed their property rights to the small demesne of Villers-Franqueux against powerful, local noblement and the Archbishops of Reims in the third quarter of the 11th century. Engaged in this property dispute, the community deployed different legal measures and appealed to exterior royal authority. The monks did not hesitate to forge the material and mention an influential person of the moment, Queen Anna, who ruled as regent around that time, in order to solidify their position. This manifold and detailed ‘protective narrative’ constructed by the monks of Saint-Thierry was also supplemented by hagiographical texts intended to provide the community’s claims to Villers-Franqueux with a sacred, transcendent legitimacy, which had to present the deeds of the monastery’s adversaries as not only illegal but also as going against God’s will. All of this, as the subsequent history of Saint-Thierry suggests, allowed the community to overcome in the struggle and retain Villers-Franqueux, which became one of the core elements of its demesne.

La Grammaire (1660) et la Logique (1662) de Port-Royal ouvrirent une ère nouvelle dans l'histoire des sciences du langage. On a beau insister sur la dette des Messieurs de Port-Royal (Arnauld, Nicole, Lancelot) envers Descartes, Augustin, Sanctius, ou meme Aristote, l'originalité de leur œuvre logico-grammaticale ne fait malgré tout aucun doute. Quant à l'influence de cette oeuvre sur les grammairiens philosophes des générations suivantes, elle est d'une remarquable persistance et demeure sensible pendant un bon siecle et demi, en dépit des critiques, corrections et innovations qu'elle a pu inspirer, et de la diversité des orientations philosophiques ou gnoséologiques des plus illustres grammairiens des Lumières. L'œuvre des Messieurs propose une vision unifiée des phénomènes langagiers et «l'appareil mis en place à Port-Royal continue à fonctionner pour l'essentiel» (cf. Dominicy, La naissance. …, p. 14), aussi bien chez les grammairiens philosophes de l'Encyclop'dic (Du Marsais, Beauzée), que chez Condillac et ses successeurs idéologues (en particulier Destutt de Tracy).

Malgré de nombreux écrits et une documentation abondante sur le personnage, Samuel de Champlain demeure une figure énigmatique de notre histoire. Ainsi, aucun portrait authentique du fondateur de Québec ne nous est parvenu et l’emplacement de son tombeau a fait l’objet d’une longue saga archéologique. Si le tombeau demeure un mystère, l’archéologie a effectivement relevé des traces du passage de Champlain en Acadie, à l’île des Sainte-Croix et à Port-Royal et en Nouvelle France, autour de l’Habitation de Québec et de la ferme du Cap-Tourmente. Ses fouilles dont le potentiel documentaire est immense nous révèlent non seulement des informations sur Champlain et sur les établissements qu’il a fondés, mais aussi sur la vie quotidienne des premiers habitants du pays.

Cet article examine les représentations des femmes architectes au Canada au 20 e siècle telles qu'elles apparaissent dans les pages d'un périodique national, la revue de l'Institut royal d'architecture du Canada, de 1924 à 1973. L'analyse montre qu'à une époque où les femmes faisaient des progrès significatifs au sein de la profession d'architecte, qui demeure dominée par les hommes, dans les revues professionnelles elles étaient représentées comme des utilisatrices passives de l'espace alors que leurs confrères apparaissaient comme des concepteurs actifs et la profession, comme essentiellement masculine. L'analyse montre aussi que, malgré leurs positions marginales en tant qu'étudiantes, décoratrices ou journalistes, par exemple, les femmes architectes ont néanmoins apporté une contribution vitale à la profession.

Notre-Dame de l’Assomption est la patronne nationale de l’Acadie. Deux statues symbolisent la dévotion des Acadiens, l’une à l’Église-Souvenir de Grand-Pré, l’autre à l’Oratoire Saint-Joseph du Mont-Royal. La première est intimement liée à l’oeuvre du père André D. Cormier, surnommé « le second fondateur de Grand-Pré ». La deuxième est peu connue et l’auteur révèle à la fois son existence et les liens, inattendus, de cette madone montréalaise avec l’Acadie. Cet article devient alors une enquête afin de découvrir l’origine et l’histoire de cette statue. Si le fin mot de l’intrigue n’est pas trouvé, il n’en demeure pas moins que Montréal et Grand-Pré, l’Oratoire Saint-Joseph et l’Église-Souvenir sont unis par des liens jusqu’à ce jour insoupçonnés qui démontrent la ferveur mariale, la vive foi des Acadiens et l’apport inestimable de la congrégation de Sainte-Croix à la vie spirituelle et culturelle des Acadiens.

Abstract. The focus of this article is the theory of integration advanced by Alan Cairns in his book, Citizens Plus: Aboriginal peoples and the Canadian State. Cairns' theory has had a mixed reception since its publication. Like much scholarship and public policy in the Aboriginal rights field, Citizens Plus has attracted strong proponents and opponents. At present Citizens Plus remains one of the primary competitors vying for influence in guiding the postcolonial reconfiguration of the relationship between Aboriginal peoples, the Canadian state and civil society on terms of justice that may be perceived as legitimate by both Aboriginal and non-Aboriginal peoples. The prime alternative, as conceived by both Cairns and his critics, is the nation-to-nation constitutional vision of the Royal Commission on Aboriginal Peoples. The author provides a political theoretical reading of Citizens Plus. She seeks to disclose the normative and conceptual structure of Cairns' argument and to situate Cairns' theory in the context of debates concerning the future of Aboriginal peoples and the constitution of Canada. This reading foregrounds an alternative interpretation of the relationship between Citizens Plus and the constitutional vision of the Royal Commission on Aboriginal Peoples, which makes it possible to see them as complementary rather than opposed constitutional visions. The author also raises broader questions concerning the reasons for continuing the search, at the heart of Cairns' work, for a post-colonial theory and praxis of normative integration in diverse societies, and the conditions of the possibility of such a theory and praxis. Ultimately the author argues that whether one agrees or disagrees with Cairns' prescription, at a minimum Citizens Plus should be understood as raising a fundamental question to which multinational constitutional theory must respond.Résumé. Le présent article a pour objet d'examiner la théorie avancée par Alan Cairns dans son ouvrage, Citizens Plus : Aboriginal Peoples and the Canadian State. Cette théorie est loin de faire l'unanimité; comme beaucoup d'autres ouvrages ou initiatives dans le domaine des droits autochtones, Citizens Plus a ses partisans et ses détracteurs. Le droit anglais ne connaît ni propriété publique ni service public, personnalité morale de droit public ou dualisme juridictionnel. À défaut, le droit anglais met en œuvre une "échelle" de publicisation des biens. Pour identifier les biens publics, cette étude s'appuie sur l'existence d'un droit public substantiel, qui n'a pas encore fait l'objet d'une reconnaissance formelle en droit anglais. Ce droit public substantiel doit être distingué du judicial review, qualifié par les juristes anglais d'administrative law, mais qui ne constitue qu'un droit public processuel. La substantialité du droit public anglais réside dans l'exorbitance diffuse de règles par rapport au droit commun, lequel comprend les règles de common law et d'equity, mais aussi les règles issues du corpus législatif. Grâce à ce régime exorbitant, nous identifions deux catégories de biens publics sur le fondement des critères organique et fonctionnel. D'abord, les biens sont publics sur le fondement du critère organique, en raison du caractère public de la qualité de leur propriétaire. En droit anglais, il existe, selon nous, deux catégories de propriétaires publics : la Couronne, propriétaire public par les privilèges dont elle bénéficie par la logique organique inhérente au souverain ; et, en raison de l'acception anglaise de la propriété, le public lui-même. Ensuite, les biens sont publics sur le fondement du critère fonctionnel en raison de l'intérêt public poursuivi par leur affectation. Against the backdrop of French public law with its separate administrative and ordinary courts, French lawyers often assume that English law does not have a system of public law. This is inaccurate. This thesis aims to demonstrate the existence of a substantive public law in the English legal system. It does so by identifying a number of public assets. Substantive public law should be distinguished from judicial review, which is not substantive but procedural public law. The substance of English public law lies in a multitude of rules that deviate from the rest of the legal system. These rules are found not only in common law and equity, but also in statute and in delegated legislation. From the analysis of these derogative rules, it appears that public assets enjoy privileged legal treatment. This is triggered either by the "publicness" of the asset, such as the Crown or the public itself, or by the pursuit of the public interest, regardless of the public nature of the owner. My research reveals two sets of substantive public law rules applying to public assets. The first comprise adverse possession when applied to Crown lands and town or village greens. The second set encompasses charities, and assets owned by privatised services

The aim of this thesis is to explore work as an idea and a practice for the construction and maintenance of differences and power relations, and to examine what the consequences were for the individual and society in early modern Sweden. The period saw an expansion of the state apparatus which created numerous new opportunities for employment. There also exists a body of literature from this period, in the form of instructions relating to work and households. The thesis draws both on these instructions and descriptions and on sources produced by the crown. The thesis shows that gender was a crucial factor for the organisation of work. Operating The service of the crown was characterised by two principal organisational forms: the household, and a precursor of a bureaucratic system. The household had its basis in the couple, and had a clear gendered division of power, the couple together constituted the management of the household, at the same time there was an element of male superordination. The other form was exclusively male and based on delegation of power within the organisation and on an attempt to formalise relations by written instructions. The majority of the jobs created were held by men. In crafts and administration, men took over a number of female areas of competence. In this process was occupational positions created for these men. Women’s opportunities to work were heavily affected by an idea of a female area of expertise, ‘womenfolk’s work’ which never become specialiced, but the investigation also shows that work created in the crowns households in positions of leadership created livelihoods for married adult women. Among employees that were young and unmarried the similarities between the genders were often more striking than the differences. Greater differences emerge from a comparison of the entire workforce of the crown, which shows women’s annual wages to be 75 per cent of those of men. Overall women had few opportunities to make careers and get well paid employments.

and keywords This thesis deals with the topic of authoritarian apparatus of chamber estate of Pardubice between 1560 -1630. It represents not only the structure and form of bureaucratic machinery, duties and competences of its representatives, but also their influence in the context of the estate. Very important role is played not only by relation between the machinery and superior authorities, but also its contact and communication with local administrations and residents of the estate themselves. Interest is also devoted to personalities of some representatives of officials whose life stories are discussed in the individual chapters. The thesis also follows manifestations of chosen trends in early modern history and its reflection to the environment of the estate - especially the process of bureaucratization, professionalization and extent of (in)discipline of bureaucracy. Very important is also the question how much the reality of official practise was equal with provisions and requirements proclaimed in instructions and regulations.
