The multiplication of legal systems in the field of the protection of fundamental rights leads to reconsider the classical theories of systemic relationships. New concepts intend to replace the former ones, heterarchy tries to substitute the idea of hierarchy, network replaces gradually the pyramidal structure. The equivalent protection of fundamental rights enters in this movement. Equivalent protection is a jurisprudential mechanism settled in the purpose of conciliating the relationships between the different legal systems of fundamental rights’ protection in Europe. This conciliation is allowed if there is a certain convergence in the level of protection of these rights. From the Solange II case of the German constitutional court in 1986, passing by the Bosphorus case of the European court of human rights in 2005, to Arcelor case of the French supreme administrative judge, the solution based on equivalent protection exists in several cases with different results. But the flexibility induced by the jurisprudential nature of equivalent protection can lead to a certain form of instrumentalization. As a result, if the equivalent protection is enable to establish the connection between the different legal systems of protection of fundamental rights, it still cannot be regarded as a true mechanism of legal systems articulation

This thesis presents an approach to ESD protection device modelling. Emphasizing is given to the study of the ggNMOS behaviour. In the first part, transmission line pulse (TLP) test system was used to reach the quasi-static high current device response under ESD conditions. The electrical response showed variations of the triggering parameters with the ggNMOS geometry. According to the TLP current level, defects can appears in the ggNMOS structure. We used EMMI and OBIRCh techniques to analyze those defects in silicon. In the second part, we propose model that take into account high density current effects. Indeed, actual models are based on the parasitic bipolar transistor to represents the effect of the bulk in high and transient current regime. We propose another circuit-simulation model represented by an equivalent-circuit of resistor, capacitance and current source. The compact model allows simulation of both transient response and quasi-static response of the snapback devices. The comparison between the test results and the simulations shows a good efficiency of the proposed model

Rockfall barriers are flexible structures that mitigate the risk of rockfall and thus protect people living in risk areas, as well as their property. These structures, placed on the trajectories of the moving blocks, are made of a steel net held on the natural ground by rigid posts. When they are impacted, they undergo large deformations that require modelling their behaviour by taking into account both geometric and material non-linearities. Their components are therefore represented in this work with discrete elements and the mechanical problem is thus solved with a calculation tool adapted to the large déformations problem. This algorithm is also used to assess the influence of different net modelling strategies, from the scientific literature, on the overall behaviour of a rokfall barrier. The conclusions of this study as well as experimental observations pave the way to new discrete modelling strategies, for which the net is represented by a limited number of degrees of freedom. The family of simplified models developed in this work makes it possible to simulate the behaviour of a structure with a low computation time costs, thus offering the opportunity of implementing complex parametric studies or probabilistic dimensioning methods

As the number of devices able to communicate grows, so does the need to secure their interactions. The design of cryptographic protocols is a difficult task and prone to human errors. Formal verification of such protocols offers a way to automatically and exactly prove their security. In particular, we focus on automated verification methods to prove the equivalence of cryptographic protocols for a un-bounded number of sessions. This kind of property naturally arises when dealing with the anonymity of electronic votingor the untracability of electronic passports. Because the verification of equivalence properties is a complex issue, we first propose two methods to simplify it: first we design a transformation on protocols to delete any nonce while maintaining the soundness of equivalence checking; then we prove a typing result which decreases the search space for attacks without affecting the power of the attacker. Finally, we describe three classes of protocols for which equivalence is decidable in the symbolic model. These classes benefit from the simplification results stated earlier and enable us to automatically analyze tagged protocols with or without nonces, as well as ping-pong protocols

This thesis explores the question of conflicts between the ECHR and other international obligations for State parties by focusing on the case law of the ECtHR. The ECtHR's approach reflects the need for consistency in law and harmonisation of conflicting obligations. Setting the objective of harmonising potential conflicts, the Court of Strasbourg did not raise the question about the causes of those conflicts. This thesis seeks to examine whether there are any legal rules that could prevent conflicts by obliging States to establish norms that createcompatible obligations. In addition, the study aims to systematise conflicts between the ECHR and other international obligations in cases which were lodged with the ECtHR, in order to highlight the conditions of emergence of these conflicts and to examine the means of their coordination. The overarching theme of the study goes beyond the criticism of the effectiveness of the means of harmonisation applied by the case-law of the Court of Strasbourg, proposing solutions for the avoidance of conflicts. The analysis of the applicability of the means of conflict resolution is part of the management of conflicts in which the obligations of the ECHRare involved. In this context, the thesis delves into the means of conflict resolution that could be applied in the future, should the ECtHR explicitly recognise a situation of conflict between the ECHR and another international obligation

The constitutive materials of dikes are often silty sands whose mechanical behavior can become unstable at stress states located well under the Mohr-Coulomb plasticity limit criterion. This failure mechanism could explain several dike breaches whose occurrence has not been assigned to conventional mechanisms of dike failure such as internal erosion. The objective of this thesis is to better understand, with respect to the instability phenomenon, the mechanical behavior of a silty sand which is collected in the area adjacent of a breach of the Rhone embankment dike during the flood of 2003, by means of triaxial tests.The test results obtained on clean sand show that this material is very sensitive to the instability phenomenon. The occurrence of the latter can be predicted by an instability curve relating, at the onset of instability, the stress ratio to the state parameter. The analysis of these results suggests that a strong contractiveness of the material is the necessary condition for instability of loose sand and an appropriate direction of stress increment vector is the sufficient condition.The test results obtained on mixtures of sand with fines show that a removal of fine particles caused by an erosion, such as suffusion for example, favors the occurrence of instability in the dikes. Moreover, these results indicate that the equivalent void ratio is a relevant parameter in analyzing the behavior of silty sand. The calculation of the equivalent void ratio requires the determination of the parameter b for which a new formula has been proposed

Procedural autonomy is a term often misused when talking about the very real phenomenon “judicial subsidiarity”. It is more accurate to talk in terms of competence considering the principle of subsidiarity regulates the role they play between Member States and the Union. As such, when discussing judicial subsidiarity in relation to the procedural aspects of implementing EU law, one should talk about procedural competence. This change in meaning ultimately leads to a revision of all relevant case law. Such a review brings to light a number of elements that, when juxtaposed, reveal an overarching rationale behind the Court's rare law. First, both equivalence and effectivity, long perceived as regulators of procedural competence national judges, are not in fact principles but criteria. Furthermore, they are not the only regulating criteria as the right to an effective judicial protection also comes into play. It then becomes apparent that effectivity is an obstacle to EU law having primacy over national law. Moreover, for a long time the ECJ has taken into account requests made by Member States to, on occasion, bypass the criteria of effectivity. As such, the ECJ accepts that national identity can serve as corrective justification of the very content of effectivity. In other words, Member States can put forward more and more arguments in the name of “public interest” to justify non-compliance with EU law effectivity

Gathered under the term “economic instruments” – or market-base instruments -, mechanisms for ecological compensation and payments for environmental services have established themselves as the essential tool for the biodiversity and ecosystem protection policies. Built around a plurality of principles (polluter pays principle, beneficiary pays principle, etc.) and concepts (ecosystem services, natural capital, etc.) largely influenced by economical approaches of biodiversity and ecosystems, these two instruments characterize the oncoming of a new take on environmental policies. The study reveals the plurality of judicial links that unite ecological compensation and payments for environmental services. Sometimes close together, sometimes distinguishable, these mechanisms are, in fine, both sides of a same coin. The use of payments for environmental services, as ecological compensation, appears however as a preoccupying orientation, likely to deflect this instrument from its purpose. In spite of their theoretical virtues, the efficiency of ecological compensation mechanisms and payments for environmental services for the protection of biodiversity turns out to be questionable, justifying a reinforcement and more consistency in their legal framework
