Over the last decade, investment treaty arbitration has been confronted with relatively extensive and fundamental criticisms. The problem with the system in fact boils down to a misconception by tribunals of the nature of investment treaty arbitration. Many scholars and tribunals have perceived and treated investment treaty arbitration as a reciprocal arrangement with a private function. This is so mainly because of the way they formulate the establishment of investment treaty arbitration. To put it simply, it has been though that investment treaty arbitration, similar to international commercial arbitration, is founded upon a reciprocal contract made through a merger of intentions of the host State and the foreign investor. This perception would necessarily lead to the application of the principle of party autonomy as the main governing principle over the process of arbitration; a principle that is well tailored to adjudications with private function. Contrary to this, a careful examination of the nature of investment treaty arbitration reveals not only the public dimensions of the system, but also the unilaterality of the framework on which the system stands. These two characteristics require a shift in paradigm; otherwise, the system will expose to more and more legitimacy crises. The present research, therefore, tends to make a clear distinction between the two systems of international commercial and investment treaty arbitration, and explore the implications of this paradigm-shifting for the process of investment treaty arbitration, in particular, the way tribunals interpret the instrument of consent and the autonomy of tribunals in the course of the arbitration.

Дисертація присвячена формулюванню теоретико-методологічних засад примирення сторін в адміністративному судочинстві та наданню пропозицій щодо вдосконалення адміністративного законодавства України в цій сфері в умовах євроінтеграції. В роботі визначено поняття та особливі ознаки примирення сторін в адміністративному судочинстві. Встановлено мету, завдання, функції, принципи досліджуваного примирення. Визначено суб’єктний склад процедури примирення, встановлено умови та підстави, порядок примирення сторін в адміністративному судочинстві. Враховано досвід окремих держав-членів ЄС (Іспанія, Нідерланди, Німеччина, Франція), а також положення ряду актів ЄС. Узагальнено основні актуальні проблеми в досліджуваній сферіта сформульовано комплекс конкретних пропозицій щодо вдосконалення адміністративно-правового регулювання примирення сторін в адміністративному судочинстві в умовах євроінтеграції України, враховуючи відсутність в ЄС універсальної моделі примирення сторін публічно-правового спору та фрагментарність регулювання примирення сторін в державах-членах ЄС. The dissertation is devoted to the formulation of theoretical and methodological principles of reconciliation of the parties in administrative proceedings and to provide proposals for improving the administrative legislation of Ukraine in this area in the context of European integration. The paper defines the concept and special features of conciliation of the parties in administrative proceedings. It is established that the purpose of conciliation of the parties, as a process, is manifested in the gradual achievement by the parties of a public law dispute of a real consensus on dispute resolution, and, as a result, in the effective resolution of substantive dispute by conciliation. In this sense, conciliation of the parties performs a set of tasks (creating conditions for dialogue between the parties to the dispute; formation in the negotiations of the parties a specific model of mutual concessions that they realize, want to perform such , stimulating, analytical, information and communication, control and supervision, educational and preventive). The system of principles of conciliation of the parties in administrative proceedings are: 1) common law principles; 2) special principles of resolving the case by conciliation (for example, transparency and informativeness of resolving the case by conciliation; dispositiveness, constructive adversarial nature of the parties to the dispute; mandatory entry into force of conciliation conditions after their approval by the court; reasonable terms of resolving the case, etc.); 3) special principles concerning: a) quality, features of dispute resolution through conciliation; principles of accessibility and efficiency; b) voluntary participation in dispute resolution; good faith of all participants in the dispute resolution procedure); characteristics of the qualities of the conciliator (in particular, the principles of competence; independence, impartiality of the conciliator; compliance with the requirements of confidentiality). It is established that the subjective composition of conciliation of the parties is manifested in three models: "simple" (parties to the dispute; the judge who supervises the conciliation, approves the terms of conciliation); "Relatively complicated" (parties to the dispute; a judge who persuades the parties to conciliation and / or fully performs the role of conciliator); 3) "complicated" (parties to the dispute; judge; conciliator). In modern Ukraine there is a "simple" model of the subjective composition of the reconciliation of the parties, which: is characterized by certain features of the "relatively complicated" model; but at the same time it has the potential to transform into a "complicated" model of the subjective composition of the parties. A set of grounds and conditions for resolving a dispute by conciliation in administrative proceedings has been determined. The system of such conditions consists of: 1) positive conditions (the existence of a public law dispute and filing a lawsuit to resolve it; the integrity of the voluntary intentions of the parties to the attempt to reconcile, the implementation of a specific model of conciliation during negotiations and at the time of conciliation; ; reality and rationality of the agreed conditions of conciliation; the presence of the subjects who apply for reconciliation, the appropriate degree of legal personality); 2) negative conditions (inconsistency with the tasks of administrative proceedings in the form of violation of the interests of third parties; the law). The system of grounds covers: normative (norms of the legislation on conciliation of the parties and on the status of the subjects who are parties to the dispute), factual (implementation by the parties of the public-legal dispute of actions on acquisition and realization of the right to conciliation) and procedural-procedural conciliation, court rulings that determine the emergence and exercise of the right to reconciliation). The stages of implementation of the conciliation procedure of the parties in administrative proceedings are: 1) informal and formal initiation and commencement of the conciliation procedure; 2) negotiations in which the parties make a joint statement of conciliation of the parties; 3) submission for approval and approval of the application for conciliation of the parties, in which the court: explains to the parties the consequences of the court decision in connection with the conciliation of the parties; checks the existence of all conditions and grounds for resolving the dispute by, approves the terms of conciliation closes the proceedings or refuses to approve the terms of conciliation and continues the trial. The main current problems in the research area are summarized and a set of specific proposals for improving the administrative and legal regulation of conciliation of the parties in administrative proceeding.

The doctoral research investigates the nature and elements of domestic mechanisms, including public private partnership (PPP) procedures, devised for the management of WTO disputes in selected developed and developing countries. With China, Brazil and India as its case-studies, the research explores various strategies to devise an effective PPP mechanism for handling international trade disputes in developing countries. The research objective is to explore the benefits of engaging the private sector in the intergovernmental process of WTO dispute settlement, and to identify the reforms that will be needed for devising a workable domestic framework for handling foreign trade disputes through PPP arrangements. The research highlights important issues and concerns that need consideration before any legal, institutional, regulatory and procedural reforms are carried out. Moreover, the research seeks to enable developing countries to critically evaluate a diverse range of PPP strategies employed so far, and to determine their individual approaches towards PPP and dispute management. The thesis constitutes a practical guidebook for policymakers in those developing countries which have the motivation to strengthen their WTO dispute settlement capacities. The topical area of research and pragmatic approach towards research questions, together with an empirical research methodology makes this study an original contribution to existing literature and knowledge.

Effective, efficient and expeditious resolution of labour disputes plays a crucial role in terms of the realization of one of the primary objectives of the Labour Relations Act (hereinafter referred to as “the Act”) which is the achievement of labour peace. Although there is no proper definition of a dispute offered by the Act, there are several elements raised by authors within the labour relations and labour law fields which constitute a dispute. Two types of disputes are discussed, namely disputes of right (emanating from entitlement) and disputes of interest (based on demands not provided for, and these are also known as disputes based on matters of mutual interests). Labour relations in South Africa has a history that is tarnished by segregation and dualism, where there was a system of labour relations and labour statutes for all races (except for Africans). The first statute dealing somewhat comprehensive with labour disputes, the Industrial Conciliation Act, did not apply to Africans. This situation (exclusion of Africans) prevailed until the early 1980’s. Therefore, although the apartheid system was legislated in 1948, its segregation practices based on race existed long before 1948 and also extended to the workplaces. The turning point in the labour relations arena in South Africa was the appointment of the Wiehahn Commission. As a result of the recommendations by this Commission, African Workers were for the first time included in labour legislation. So, of great interest is the fact that African Workers attained labour rights before the demise of the apartheid system. The birth of the Act with its dispute resolution fora like the Commission for Conciliation, Mediation and Arbitration (hereinafter referred to as “the CCMA”), Bargaining Councils, Labour Court and the Labour Appeal Court, revolutionized dispute resolution in the country. However, there are some challenges that have emerged even within the new system. Prior to 1993, labour relations in the public service, simply just did not exist. This was mainly due to the fact that the public service was excluded from mainstream legal framework governing labour relations. The State was very much in control of what was happening with regards to employment relations in the public service. There were some structures developed for engagement with the State like the Public Service Commission (PSC) which was politicized to push the agenda of apartheid, Public Servants Association (PSA) for White Public Servants, Public Service Union (PSU) for Indian Public Servants and Public Service League for Coloured Public Servants. There was no structure established for African Public Servants though. Nevertheless, these established structures were useless. One of the recommendations of the Wiehahn Commission was the inclusion of public servants within the mainstream labour relations framework and this was never pursued by the then government. It took the wave of strikes in the early 1990’s for the Act to be extended to the public service. Even with the inclusion of public service within the scope of the Act, there are still challenges pertinent to the public service. Central to these challenges is the problem of fragmentation in terms of approach regarding dispute resolution and the fact that there are too many pieces of legislation dealing with dispute resolution. This situation has also resulted in a jurisdictional debacle within the public service. Also, there is a huge challenge in terms of dealing with abscondments / desertion within the public service. In terms of the way forward, there is an initiative to streamline the public service. In this regard, there is a Draft Single Public Service Bill and also the Public Service Amendment Bill.

Public Education like other sectors such as Health, International Relations, Finance, Local Government and Environmental Affairs that fall under Public Administration as well as business in private, factory and industrial institutions are embraced or characterized by the concept of employer and employee relationships. These relationships are not always wholesome and harmonious but are overshadowed by disputes and strikes which bring about paralysis and polarization of the operation of business and educational stability in public service and administration sectors as well as at learning institutions. These disputes arise from inter alia, disagreements regarding wage negotiations, unfair dismissals, unfair labour practice involving appointments, promotions and transfers, mutual interest, severance pay, automatically dismissals, operational requirements dismissals (both single and multiple), disclosure of information disputes, organizational rights disputes, agency shop disputes, picketing disputes, unfair discrimination disputes in terms of the Employment Equity of Act as amended, and disputes involving the enforcement of collective agreements or the non-compliance with the Basic Conditions of Employment Act and others. Whilst there are similar trends and patterns of disputes in all these sectors, they are, however, not only differ in intensity and rapid occurrence but also in how they are negotiated and settled because the work environments are different at the level of operation, administration and management. What is common in all disputes is that they are all conciliated and arbitrated by arbitrators at the Commission for Conciliation, and Arbitration (hereafter referred to as the CCMA), Education Labour Relations Council (ELRC), Private Resolution Agencies and the Labour Court. The Apartheid era administration had labour laws which dealt with these disputes, but were not progressive and effective in handling them. This placed a heavy burden on the new ANC led government to change the laws of the previous regime. Most of these changes happened in the labour relations and the labour policies. In view of the above situation, the new political dispensation that came into existence and operation in 1994 developed a new labour legislative framework with specific focus on the review of the collective bargaining dispensation. Of significant importance was the entrenchment of labour rights in the Constitution of the Republic of South Africa, 1996. Section 23 of the Constitution is extensive in highlighting the importance to protect amongst others, the right of every trade union to organize and engage in collective bargaining, disclosure of information, restricted rights in domestic sector, rights to establish threshold of representativeness, organizational rights in collective agreements and disputes about organizational rights.

This study explored family members� experience of, and satisfaction with, New Zealand Family Court dispute resolution processes concerning children�s care arrangements following parental separation. A qualitative method was employed, using individual interviews with 22 parents and 8 children from 15 families, in three court districts, during 2001-2002. Follow-up interviews were also conducted with the parents one year later to assess the factors affecting compliance with their agreements and court orders. Focus groups were held with 16 Family Court professionals (lawyers, counsellors, specialist report writers and judges) in two cities to obtain their views on the family members� perspectives. Sociocultural and ecological theories, the sociology of childhood and the UNCRC provided the conceptual basis for the research. Historical developments in child custody and divorce laws, which provided the impetus for the establishment of Family Courts internationally, have also been reviewed. Each parent was legally represented, with 87% of the families also attending Family Court counselling and judge-led mediation conferences. Defended hearings occurred in 27% of the cases. Family members reported a broad range of views about their legal and court experiences. They valued their interactions with professionals who took an interest in them and their children, provided clear information and support, let them have their say, and competently managed the dispute resolution processes. Dissatisfaction was frequently expressed with the conduct of ex-partners and with professionals� styles of practice, particularly where these involved erratic or uncompromising attitudes and adversarial tactics. The desire to respond to what was written in an ex-partner�s affidavit escalated some parenting disputes onto a litigation pathway. Delay, cost, gender bias, lack of enforcement of court orders, and inadequate opportunities to feel heard, understood and respected were also identified as problems associated with Family Court proceedings. Earlier access to a wider range of information, support and conciliation services was recommended, together with more post-order explanation and support. The professionals wanted a stronger emphasis on the Family Court as a court of law, rather than a social agency. A clearer demarcation between the court�s conciliation and adjudication functions was considered necessary to avoid clients having unrealistic expectations of the Family Court. Family members� therapeutic needs were important, but thought best met within community-based agencies. The children were aware of their parents� court proceedings and most wanted the opportunity to play a more direct role in the decision about their future living arrangements. Significant or modest changes had occurred in 60% of the families by the time of their follow-up interviews. Some changes had led to a reversal in the original care arrangements, while others had impacted upon the frequency of a child�s contact with their non-resident parent. A new conceptual model for the resolution of post-separation parenting disputes has been developed. This integrates the theoretical framework underpinning the study with the international research evidence on the impact of parental separation and the principles and practices of an effective child-inclusive and culturally responsive family law system.

This study examined the legal issues of public employee labor relations in the United States. Included in this study is a review of relevant case law as it pertains to collective bargaining in the public sector. In addition to reviewing the case law, this study researched the statutory language of each state for public sector collective bargaining. The study includes a review, analysis, and summary of the state and federal laws for public sector collective bargaining. The collective bargaining process in the United States is designed to resolve disputes between two parties, the employer and the employee. The resolution of these disputes often depends on the relative bargaining power of each party. The private sector has a collective bargaining process that has been well established since the passage of the National Labor Relations Act in 1935 and the Labor-Management Relations Act of 1947. The federal laws that have been implemented in the last fifty years, to include the Civil Rights Act of 1964, the Equal Employment Opportunity Act of 1972, the American with Disabilities Act of 1990, among others, cover the scope of almost all of the private sector collective bargaining (Oberer, 1994). The public sector contains 50 different state laws and several federal laws defining the scope of collective bargaining for public employees. The bargaining process in the public sector takes place in the context of the political arena. This political influence, which is unique in each state and at each level of government, provides additional steps to the bargaining process that further differentiate public sector bargaining from private (Valletta, 1985). This study provides conclusions on certain aspects of public sector collective bargaining that lead to dispute resolution and contract negotiation to include fact-finding procedures, mediation, arbitration, and strike policies, in the current state of the law. Recommendations are made to public officials, policy makers, and other stakeholders for the future of public employee labor relations in the United States.

ENGLISH ABSTRACT: South African law does not recognise an inherent right to the existing, unobstructed view from a property. Nevertheless, seemingly in disregard of this general principle, property owners often attempt to protect such views and courts sometimes in fact grant orders that provide such protection. This dissertation aims to establish whether South African law does indeed not acknowledge a right to a view and whether there are any exceptions to the general rule against the recognition of the right to a view. The principle that the existing view from a property is not an inherent property right is rooted in Roman and Roman-Dutch law. This principle was received in early South African case law. Inconsistency in the application of the principle in recent case law renders its development uncertain. An analysis of recent decisions shows that the view from a property is sometimes protected in terms of servitudes or similar devices, or by virtue of legislation. In other instances, property owners attempt to prevent the erection of a neighbouring building that will interfere with their existing views, based either on a substantive right or an administrative shortcoming. When the protection of view is based on a limited real right (servitudes or similar devices) or legislation, it is generally effective and permanent. Conversely, when it is founded on a substantive right to prevent building on neighbouring land or an administrative irregularity rendering a neighbouring building objectionable, the protection is indirect and temporary. A comparative study confirms that the position regarding the protection of view is similar in English and Dutch law. Constitutional analysis in terms of the methodology developed by the Constitutional Court in FNB indicates that cases where view is protected are not in conflict with section 25(1) of the Constitution of the Republic of South Africa, 1996. The investigation concludes with an evaluation of policy considerations which show that the position with regard to a right to a view in South African law is rooted in legitimate policy rationales.
AFRIKAANSE OPSOMMING: 'n Inherente reg op die bestaande, onbelemmerde uitsig vanaf 'n eiendom word nie deur die Suid-Afrikaanse reg erken nie. Desnieteenstaande poog eienaars dikwels om die uitsig vanaf hul eiendomme te beskerm en soms staan die howe bevele tot dien effekte toe. Dit skep die indruk dat die Suid-Afrikaanse reg wel die bestaande uitsig vanaf 'n eiendom as 'n inherente eiendomsreg erken of dat sodanige uitsig minstens onder sekere omstandighede beskerm kan word. Hierdie verhandeling het ten doel om onsekerhede betreffende die algemene beginsel oor 'n reg op uitsig uit die weg te ruim en om lig te werp op gevalle waar 'n onbelemmerde uitsig wel beskerm word. Die Romeinse en Romeins-Hollandse reg het nie 'n reg op uitsig erken nie. Hierdie posisie is deur vroeë regspraak in die Suid-Afrikaanse regstelsel opgeneem. 'n Ondersoek na latere Suid-Afrikaanse regspraak toon egter aan dat howe wel onder sekere omstandighede, skynbaar strydig met die gemeenregtelike beginsel, beskerming aan die onbelemmerde uitsig vanaf eiendomme verleen. Hierteenoor het 'n aanval op die goedkeuring van 'n buureienaar se bouplanne hoogstens indirekte en tydelike beskerming van die uitsig tot gevolg. Regsvergelyking bevestig dat die Engelse en Nederlandse reg die Suid-Afrikaanse posisie ten opsigte van'n reg op uitsig tot 'n groot mate eggo. Grondwetlike analise aan die hand van die FNB-metodologie dui daarop dat die gevalle waar uitsig wel beskerming geniet nie strydig is met artikel 25(1) van die Grondwet van die Republiek van Suid-Afrika, 1996 nie. Bowendien regverdig beleidsgronde die behoud van die huidige beginsel in die Suid-Afrikaanse reg.

The Public Service Commission (PSC) is an independent oversight body established in terms of chapter 10 of the Constitution, 1996. Although, its powers and functions were enacted in the Public Service Commission Act, 1997, this institution has been in existence since the early 1900’s. As an institution which was birthed during an era wrought with injustice, inequality upon a labour law framework which barely existed as the concept is understood today, the PSC played a leading role in the management of the public service. The influence of the Treasury, Governor-General and socio-political forces throughout the 1900’s negatively impacted the manner in which the PSC was effectively able to exercise its’ powers and functions. Subsequent thereto, the rise of staff associations and their concerted effort to be party to matters pertaining to the employment relationship, placed the PSC in a precarious situation which created the perception that the PSC was a “toothless organization”. Although the PSC has since transitioned significantly in that many of the functions it performed are now exercised by the Ministry of Public Service and Administration, today, this perception is still as real as it was in the 1970’s. The primary purpose of this treatise is to provide a historical background to present time, depicting the role undertaken by the PSC and whether the perception of being ineffective in the administration of the public service, remains. The researcher will provide a distinction of the nature of grievances dealt with by the PSC and other alternate dispute resolution bodies, with specific attention being drawn to the methodologies applied in the execution of its mandate relating to labour relations and personnel practices, and the overall bearing it this has on the effective administration of the public service. In the conclusion it is submitted that the powers and functions of the PSC may extend to directions, advice and recommendations (unenforceable), however in comparison to other dispute resolution bodies, these powers and functions are centred around the promotion of constitutionally enshrined values and principles. PSC prides itself in the fruits of its labour as it is able to make a far greater impact by investigating root causes of grievances and redressing systemic issues, emanating from yesteryear to date. It is therefore submitted that as a result of different methodologies applied in comparison to other dispute resolution bodies, the highly administrative processes embarked proves far more thorough and effective and as a result cannot be compared or perceived to be ineffective. Lastly, it is submitted that the co-operative rather than adversarial approach embarked upon by the PSC is befitting for a young democratic country where impact-driven bears far reaching results, extending over the public service administration at large. To this end, the researcher refutes the misconception that the PSC is a toothless, ineffective organization which no longer plays a meaningful role within the Public Service Administration.

Discipline is crucial in the provision of quality public service work. This is because most citizens are serviced through the public service work. Adhering to rules and orders, exercise of self control and the ability to put needs of others over one’s own needs are fundamental aspects of discipline. Every workplace has its own pieces of legislation that are used as a guide on expected conduct as well as a tool to deal with failure to adhere to the outlined pieces of legislation governing the conduct in the workplace. There are institutions in place that deal with the crafting of the pieces of legislation which clearly outline the manner in which both the employer and employee should conduct themselves as well as rights of both parties as they interact in the employment relationship. The existing pieces of legislation as well as their implementation and relevance in this era needs to be closely scrutinised and critique with proposals within the prescripts of legislation is necessary as some pieces of legislation seem to be conclusive, thereby undermining procedures followed when dealing with cases of misconduct. In any disciplinary process, the sanction should be in line with the process as it has unfolded and not be influenced by how a piece of legislation is crafted. The Public Service Act, Employment of Educators’ Act and the Labour Relations Act 66 of 1995 are key statutes in dealing with discipline in public education. Sanctions for misconduct are dependent on the gravity of the misconduct. In order to discipline educators, sections 17 and 18 of the Employment of Educators Act are used as guides on processes and procedures to be followed.

This thesis is an in-depth discussion and analysis of the alternative dispute resolution process of arbitration in the United States. It begins by providing a basic explanatory overview of arbitration clauses and the arbitration process. It then goes on to highlight the various benefits over traditional court litigation that arbitration has to offer. From there, the paper presents a detailed discussion of the many shortcomings of the arbitration process. It identifies the overall lack of procedural fairness that exists in arbitration today due to the fact that arbitration currently tends to favor businesses over consumers and workers during dispute settlements. The paper then identifies the various negative potential consequences that exist as a result of the unfair nature of arbitration today. This thesis concludes by presenting various ways that the arbitration process can be improved upon to make for a fairer, more neutral dispute resolution alternative.

The purpose of this thesis is to examine if there is a problem with compliance in the World Trade Organization, to investigate the validity of the managerial and the political economy approaches to compliance and to analyze reform proposals that tackle the issue of compliance, pursuing improvement of the system.

Drawing on the scenario of increasing legalization and cooperation in trade, the first question is examined by way of interviewing trade experts and officials as well as analyzing case studies that are pertinent to the research at hand. The second question – if management is preferred to enforcement as to induce compliance – is answered by analyzing official WTO Dispute Settlement reports, interviews, case reviews and articles on retaliation and compliance written by different authors. The third question is answered as a reflection of the findings of the first two questions.

Analysis on the managerial theory of compliance examine whether enforcement plays a minor role in inducing compliance in the WTO, if there is a propensity to comply amongst states and if noncompliance is inadvertent rather than a result of calculation of interests. In the other hand, tests conducted on the enforcement approach to compliance investigate the importance of retaliation in WTO Dispute Settlement, the necessity of an enforcement tool and the claim that noncompliance is a political decision.

Tests conducted suggest that the enforcement school of compliance is correct when stating that noncompliance is a political decision, resulted from careful calculation of interests. The research indicates that the WTO Dispute Settlement presents a dual facet of compliance, in which the enforcement tool is responsible for allowing the managerial effects to take place. In this regard, the enforcement tool alone is seen as inappropriate, especially if economic asymmetries are present. An approach that accommodates both enforcement and managerial aspects is prescribed.

The research has indicated that successful reform proposals should aim at increasing the credibility of the threat of retaliation as to follow the diagnosis verified by the tests conducted.

Conflict is an inherent part of any service relationship, and is one of the important methods of effective organisational functioning. Depending on its management, it has both constructive and negative outcomes. The most extreme outcome of conflict in an industrial relationship is a strike. The South African Public Service strike of 2007 was the most protracted and united strike in the history of South Africa. In order to provide an insight into this strike, this treatise explores the following key aspects: • To present a short background of collective bargaining in the public sector through time. • To provide a short background to the public sector strike in 2007. • To develop a conflict model for analytic purposes based on a literature review and to use the conflict model to analyse the strike. A study of the strike was deemed essential because of its current nature and it being charged with political undertones. Moreover, conflict in the employment relationship has had an important influence on theories of industrial relations. The South African labour relations system is pluralist in nature, with a focus on the formal institutions of industrial relations. The focus should be on the motives and actions of parties in the employment relationship. Hence, one should look beyond conventional explanations in understanding conflict.

This dissertation explores the legal issues raised by the participation of private persons in the settlement of international economic disputes, using the potential enlargement of legal standing in the World Trade Organisation (WTO) as a case study. In the first part, a typology of the special regime of responsibility of WTO Members is drawn, to serve as a "normative bridge" between the twin phenomenon of legalisation of international trade relations and judicialisation of international trade dispute settlement. In the second part, a comparative study of the participation of private persons in the settlement of international economic disputes is conducted, using the doctrine of diplomatic protection from general international law as the analytical framework. This permits an inventory of the various means of private participation in the current practice of States, as well as shedding light on the main systemic problems that are raised, notably in the field of foreign direct investment, where important developments have taken place. In the third part, a study de lege feranda on the enlargement of legal standing in the WTO dispute settlement mechanism is undertaken. The study is rooted in the previous analysis of the special regime of responsibility of WTO Members and the comparative survey on the participation of private parties in the settlement of international economic disputes. The dissertation demonstrates that the problems concerning private persons in the current mechanism should not be answered by offering them direct access to the WTO, but rather by refocusing attention on the central role of the State in the mediation of diverging interests in the governance of the world trading system. It proposes as a conclusion that WTO Members should instead look into formalising the process of handling private complaints at the domestic level.

ENGLISH ABSTRACT: The first part of this thesis deals with the right of lateral and subjacent support and explains how it should be applied in South African law. The thesis illustrates how the neighbour law principles of lateral support were incorrectly extended to govern conflicts pertaining to subjacent support that arose in South African mining law. From 1911 right up to 2007, these two clearly distinguishable concepts were treated as synonymous principles in both academic writing and case law. The thesis plots the historical development of this extension of lateral support principles to subjacent support conflicts. In doing so, it examines the main source of South Africa’s law of support, namely English law. The thesis then shows how the Supreme Court of Appeal in Anglo Operations Ltd v Sandhurst Estates (Pty) Ltd 2007 (2) SA 363 (SCA) illustrated how the English law doctrine of subjacent support, with all its attendant ramifications, could not be useful in resolving disputes that arise between a land surface owner and a mineral rights holder in South African mining law. The second of half of the thesis investigates the constitutional implications of the Supreme Court of Appeal’s decision in Anglo Operations in light of the systemic changes introduced by the Minerals and Petroleum Resources Development Act 28 of 2002. In terms of this new Act, all the mineral and petroleum resources of South Africa are the common heritage of the people of South Africa, and the state is the custodian thereof. This means that landowners are no longer involved in the granting of mineral rights to subsequent holders. In light of the Anglo Operations decision, landowners in the new dispensation of mineral exploitation face the danger of losing the use and enjoyment of some/all their land. The thesis therefore examines the implications of the statutory provisions in South African legislation (new and old) that have/had an impact on the relationship between landowners and mineral right holders with regard to the question of subjacent support, as well as the implications of the Anglo Operations decision for cases where mineral rights have been granted under the statutory framework.
AFRIKAANSE OPSOMMING: Die eerste deel van die tesis handel oor die reg op sydelingse en oppervlakstut en hoe dit in die Suid-Afrikaanse reg toegepas behoort te word. On January 27, 2014 the International Court of Justice, principal judicial organ of the United Nations ruled in the case of the maritime dispute (Peru v. Chile), being Peru the one that brought forth the case in January 2008. During the proceedings in Court, the parties presented fundamentally different positions on the existence of a maritime boundary between them and how the Court should proceed solving the dispute. The Court should have considered the multiple legal reasonings presented by the States parties over the years to arrive to its ruling. Particularly, some of the legal reasonings presented by Peru were accepted by the Court and considered in the ruling, beginning from the interpretation given to the proclamations of Peru and Chile in 1947, going through the reasonings Peru presented about the 1952 Santiago Declaration (It was the main topic presented by Chile, which was discarded by the Court) until the reasoning presented by Peru saying that the 1954 Special Maritime Frontier Zone Agreement didn’t create a zone of tolerance that extends to 200 nautical miles. However, the Court considered that in the 1954 agreement the parties accepted the existence of a tacit agreement, but this existence was not presented by them in the Court even though it has a legal support in the jurisprudence of the International Court of Justice. Then, the Court had to determine the extent of the tacit agreement, a very difficult duty because the parties hadn’t considered the existence of that situation and its extension. After establishing the implied legal agreement was for 80 nautical miles along a parallel of latitude, the Court proceeded to establish a maritime boundary applying thoroughly the rules and principles of maritime delimitation presented by Peru, which applied to the case determine the presence of an equidistant line. In relation to the starting-point of the maritime boundary, the Court didn’t use the point presented by Peru but, in a correct way, made it clear that the starting-point of the maritime boundary and the starting-point of the land boundary don’t have to match necessarily. Finally, the way how the Court established the maritime boundary recognizes, with no doubt, that the area previously named “outer triangle” belongs to Peru, as this country claimed and as Chile opposed repeatedly over the years. In summary, it is a decision based on International Law and adopted under the evidence presented in Court. The Court applied and confirmed various legal arguments presented by Peru during the process, in spite of the opposing position of Chile.
El 27 de enero de 2014, la Corte Internacional de Justicia (CIJ), órgano judicial principal de la organización de las Naciones Unidas, dio su sentencia en el caso de la controversia marítima (Perú c. Chile), el cual el Perú presentó ante ella en enero de 2008. Durante el proceso ante la Corte, las partes presentaron posiciones fundamentalmente distintas sobre la existencia de un límite marítimo entre ellas y sobre cómo la Corte debía proceder para resolver este caso. Para llegar a su fallo, la Corte debió evaluar esos múltiples argumentos legales planteados por ambos Estados a lo largo de años. En particular, varios de los argumentos legales planteados por el Perú fueron aceptados por la Corte y acogidos en el fallo, desde la interpretación que dio a las proclamaciones de Perú y Chile de 1947, pasando por los argumentos que planteó el Perú sobre la Declaración de Santiago de 1952 (que había sido el núcleo del caso argumentado por Chile, el cual fue descartado por la Corte), hasta el argumento peruano en el sentido de que el Convenio sobre Zona Especial Fronteriza Marítima de 1954 no creó una zona de tolerancia que se extienda por doscientas millas marinas. Sin embargo, la Corte consideró que en ese tratado de 1954 las partes reconocieron la existencia de un acuerdo tácito, figura que no argumentaron las partes ante la Corte, pero que tiene su fundamentación legal en jurisprudencia previa de la CIJ. La Corte luego tuvo que determinar la extensión de ese acuerdo legal tácito, labor sumamente difícil ya que las partes no habían contemplado la existencia de esa figura ni argumentado hasta dónde se habría extendido la misma. Luego de establecer que el acuerdo legal tácito se extendía por ochenta millas marinas a lo largo de un paralelo de latitud, la Corte procedió a establecer un límite marítimo siguiendo exactamente las normas y principios sobre delimitación marítima planteados por el Perú, los cuales aplicados al caso determinan el establecimiento de una línea equidistante. Con relación al punto de inicio del límite marítimo, la Corte no empleó el punto planteado por el Perú pero, correctamente, dejó en claro que el punto de inicio del límite marítimo y el punto de inicio del límite terrestre no tienen necesariamente que coincidir. Finalmente, la manera como la Corte estableció el límite marítimo reconoce sin lugar a duda que el área antes llamada «triángulo exterior» corresponde exclusivamente al Perú, como ese Estado argumentó y Chile se opuso repetidas veces a lo largo de los años. En resumen, se trata de una decisión ajustada al derecho internacional y tomada sobre la base de la evidencia a disposición de la Corte, en la que esta emplea y confirma diversos de los argumentos legales planteados por el Perú durante el proceso, a pesar de todo lo que Chile argumentó contrariamente.

Section 213 of the Labour Relations Act defines ’strike’ as the partial or complete concerted refusal to work, or the retardation or obstruction of work, by persons who are or have been employed by the same employer or by different employers, for the purpose of remedying a grievance or resolving a dispute in respect of any matter of mutual interest between the employer and employee, and any reference to “work” this definition includes overtime work, whether it is voluntary or compulsory. According to Mcllroy: “As long as our society is divided between those who own and control the means of production and those who only have the ability to work, strikes will be inevitable because they are the ultimate means workers have of protecting themselves.” 1 The Constitutional Court justified the exclusion of a constitutional right to lock out and the inclusion of a constitutional right to strike by indicating that the right to strike is not equivalent to a right to lock out and is essential for workplace democracy. 2 The right to strike is essential to bolster collective bargaining and thereby to give employees the power to bargain effectively with employers. The employers on the According to the Constitutional Court employers enjoy greater social and economic power compared to individual workers and may exercise a wide range of power against workers through a range of weapons, such as dismissal, the employment of alternative or replacement labour, the unilateral implementation of new terms and conditions of employment, and the exclusion of workers from the workplace. To combat this and have a say in the workplace, the Constitutional Court held that “employees need to act in concert to provide them collectively with sufficient power to bargain effectively with employers and exercise collective power primarily through the mechanism of strike action”. The research methodology used includes information gleaned from annual reports published by the PSCBC. Interviews of selected stakeholders such as government officials and labour organisations involved in the PSCBC were conducted.The thesis holds that historically an adversarial relationship existed between the state as employer and the recognised trade unions.

It is known the case of the public attorneys that, having the opportunity to settle a controversy aroused between the public entity and the contractor, prefer to submit that dispute to arbitration with higher costs that this decision cause to the State. The reason? The concern of having «the reasonableness of his decision to settle the dispute» subjected to an administrative responsibility procedure.This paper aims to discuss this problem and analyze a possible solution. Thus, taking into consideration the Colombian experience and the recent Peruvian regulation in the «Reglamento de la Ley de APPs», the authors suggest to include in the «Nueva Ley de Contrataciones del Estado» the «Amicable Compositor» as a mechanism of alternative dispute resolution.
Es conocido el caso del procurador público que ante la posibilidad de transar los conflictos que surgen entre las entidades públicas y los contratistas, prefiere llevarlos a arbitraje con los mayores costos que dicha decisión genera para el Estado. El motivo responde a la preocupación de que se cuestione «la razonabilidad de su decisión de transar» imputándole responsabilidad mediante acciones de control.El presente artículo tiene como finalidad traer a discusión esta problemática así como una posible solución. De esta forma, teniendo en consideración la experiencia colombiana así como su reciente regulación en el Reglamento de la Ley de APPs, los autores proponen incluir en la Nueva Ley de Contrataciones del Estado la figura del «Amigable Componedor» como mecanismo alternativo de solución amigable de conflictos.

International investment agreements largely cover today’s transnational investments. These agreements confer certain substantive rights to foreign investors while simultaneously obliging host-states to act in a given manner so as to not interfere with the investments. Most international investment agreements further contain an arbitration clause which provides the investor with the means to enforce the substantive rights of the agreement by directly bringing a claim against the host-state before an arbitral tribunal. Consequently, privately contracted arbitrators have the authority to scrutinize and overrule essentially any sovereign act of the host-state that may affect the investment – judicial and legislative acts included. This practice affects not only the parties of the dispute; when the arbitral award claims superiority to the state’s electoral choices, it further constrains the exercise of sovereignty by the population of the host-state. As a result, the arbitrators who manage the disputes and the investors who initiate them have become central power-holders in the context of both international and domestic law. Meanwhile, the arbitrators and investors alike seem to be unaccountable to the states and individuals who are adversely affected by their power assertions. A commonly accepted feature of democracy is that those who govern and wield power should be accountable to those who are governed and subjected to this power. This thesis relates this notion to a Foucauldian understanding of power, domination and resistance. The primary aim of the thesis is to examine the interplay between the prominent subjects involved in investor-state arbitration and to what degree these subjects hold power in the form of transformative capacity. After this investigation into the relations of power, the thesis scrutinizes the subjugated subjects’ ability to exercise effective resistance through institutionalized accountability mechanisms. The thesis detects an accountability deficit in the regime and concludes that foreign investors and arbitrators hold a dominant position within the context of investor-state arbitration, while states and individuals find themselves in a state of domination. The international investment regime, as it currently stands, is thus found to suffer from a democracy deficit, while it concurrently seems to undermine domestic democratic institutions.

Au carrefour de la sociologie de la culture et de la sociologie de la déviance, ce travail porte sur les dimensions festives et oppositionnelles du monde des free parties, qui s’articule autour de manifestations techno clandestines et marginales. A partir d’une enquête ethnographique, il s’agit d’examiner une pratique culturelle et musicale mais aussi de saisir la variété des expressions oppositionnelles que les jeunes engagés dans ce monde y déploient. A la suite d’un travail de clarification théorique, cette recherche s’inspire de la notion de contre-culture, dans laquelle l’idée de conflictualité est centrale. Cet outil conceptuel permet d’explorer diverses facettes de l’univers free, controversé et encore largement méconnu, et notamment sa composante « contre ». On peut ainsi montrer que, si le monde free est loin d’être réductible à ses dimensions oppositionnelles, celles-ci peuvent donner un relief particulier à la fête – et réciproquement. La pertinence du croisement entre l’objet « free parties » et l’outil conceptuel « contre-cultures » est due en partie à la double déviance, sociale et légale, qui caractérise les fêtes techno étudiées. At the crossroads of the sociology of culture and the sociology of deviance, this work focuses on the festive and oppositional dimensions of the free party world, which revolves around clandestine and marginal techno events. Based on an ethnographic research, this study aims to examine a cultural and musical practice but also to grasp the various oppositional expressions unfolding within this youth culture. After providing a theoretical clarification, I draw on the notion of counterculture, in which the idea of conflict is central. This conceptual tool enables me to explore various facets of the free party universe, controversial and still largely misunderstood, and in particular its antagonistic elements. Thus I show that, while the free party world does not amount to its oppositional dimensions, the latter can enhance the festive experience – and vice versa. The double deviance – both social and legal – characteristic of the studied techno parties makes it all the more relevant to bring together this object of study and the concept of counterculture. The various oppositional aspects of this youth culture I highlight, as well as the resulting distinction between nonconformity and contention, enable me to analyze the relationship between deviance, illegality, and conflict/counterculture in the light of the case of free parties

ENGLISH ABSTRACT: Collective bargaining has gained more prominence within the industrial relations system as the latter is undergoing a worldwide transformation process. None of the effects of this transformation process is potentially more important to workers than the impact on dispute resolution. Changes in world markets furthermore necessitate a renewed emphasis on quality of products and services. Within this context labour conflicts in the public service have potential crucial consequences for the South African government's ability to promote economic development and service delivery. The Education Labour Relations Council (ELRC) with its nine provincial chambers provides the infrastructure for collective bargaining in the public education sector and plays an important role in managing conflict and disputes within this sector. The goal of this research is to determine whether the Western Cape provincial chamber of the ELRC (PELRC) is effective in the fulfilment of its statutory functions, with specific reference to its collective bargaining and dispute resolution functions. Data has been collected by conducting interviews using an interview schedule. The research indicated that the PELRC does perform its statutory collective bargaining and dispute resolution functions. The PELRC, however, is more active in terms of dispute resolution than collective bargaining. The research established that the PELRC does not measure its effectiveness. Results were inconclusive regarding the PELRC's effectiveness in terms of its service delivery. The research, though did manage to identify those factors that contribute to effectiveness as well as those that counter it. It furthermore indicated that when effective, the PELRC's service delivery has a positive impact on the said statutory functions.
AFRIKAANSE OPSOMMING: Kollektiewe bedinging het in vernaamheid binne die arbeidsverhoudinge sisteem toegeneem soos wat laasgenoemde 'n wêreldwye transformasie proses ondergaan. Geen van die gevolge van hierdie transformasie proses is vir werkers moontlik belangriker as die invloed wat dit op dispuut oplossing het nie. Veranderinge binne wêreld markte het verder 'n hernuwe klem op die kwaliteit van produkte en dienste genoodsaak. Binne hierdie verband het arbeidskonflik in die staatsdiens potensieel kritieke gevolge vir die Suid-Afrikaanse regering se vermoë om ekonomiese ontwikkeling en dienslewering te bevorder. Die Raad van Arbeidsverhoudinge in die Onderwys (RAVO) met sy nege provinsiale kamers verskaf die infrastruktuur vir kollektiewe bedinging in die openbare onderwys sektor en speel 'n belangrike rol in die bestuur van konflik en dispute binne hierdie sektor. Die doel van hierdie navorsing is om te bepaal of die Wes-Kaap provinsiale kamer van die RAVO (PRAVO) effektief is in die uitvoering van sy statutêre funksies met spesifieke verwysing na sy kollektiewe bedinging en dispuut oplossing funksies. Data is ingesamel deur onderhoude te voer waartydens 'n onderhoud skedule gebruik is. Die navorsing het aangetoon dat die PRAVO wel sy statutêre kollektiewe bedinging en dispuut oplossing funksies uitvoer. Die PRAVO is egter meer aktief in terme van dispuut oplossing as kollektiewe bedinging. Die navorsing het vasgestel dat die PRAVO nie sy effektiwiteit meet nie. Resultate was onoortuigend betreffende die PRAVO se effektiwiteit in terme van sy dienslewering. Die navorsing het wel daardie faktore wat tot effektiwiteit bydra sowel as dié wat dit teenwerk geïdentifiseer. Dit het verder aangetoon dat wanneer effektief, die PRAVO se dienslewering 'n positiewe invloed op die genoemde statutêre funksies het.

This dissertation allowed the researcher to analyze 171 pieces of youth-created artwork and narratives by children aged six to nine who took part in the peace education, mentorship, and literacy program, READING PEACE PALS, implemented with an underserved population at a Boys and Girls Club in the U.S. Qualitative content analysis (Krippendorf, 1980; 2004) was used to analyze the artwork and narratives to gain insight into children’s conceptualization of peace, violence, and bullying and their strategies for addressing bullying and violence. The findings uncovered the myriad of unique ways youth conceptualize and define peace and the strategies they employ to combat the bullying and violence in their lives. Youth artwork demonstrated conceptions of positive peace. However, youth narratives included more descriptions of negative peace. Youth also addressed connection, empowerment, and their responsibility for creating peace. Strategies to combat bullying and violence included bringing in an adult, power in numbers, and ways to address the bully. In addition, the findings of this dissertation, when triangulated with the findings previously found in Georgakopoulos, Duckworth, Silverman, and Redfering (2017) in terms of student perceptions of affective, cognitive, and behavioral learning and the social impact that the learning in the peace education program had on them show similarities in terms of youth conceptions of peace and the strategies they employ to combat violence and bullying in their lives. Conversely, the artwork and narratives offered a unique lens and captured more vivid and detailed expressions than the surveys were able to convey.

The article 2014 of the Civil Code has been recently modified.  In  order  to  make this decision, the legislator took in consideration two reasons: theaffirmation that the record entry doesn’t countswith its own substantivity, and that the necessityof adopting measures to fight against fraudulentacts that might affect the owners.Following this modification, the author presents a comparative analysis of the before and after of the option the legislator took, and takes position after putting himself in the side of third parties. From a juridical and economical point of view, he studies the modification and concludes that, apart from not resolving the problems it had to solve, generates damages that affect the third parties and the market.
El artículo 2014 del Código Civil ha sido recientemente modificado. Para tomar esta opción, el legislador se basó en dos razones: la afirmación deque el asiento registral no cuenta con sustantivi-dad propia, y la necesidad de adoptar una acciónpara combatir los actos fraudulentos que puedanafectar a los propietarios.A raíz de dicha modificación, el autor nos plantea un análisis comparativo del antes y después de di- cha opción del legislador, y toma una posición al respecto al colocarse en el lugar de los terceros. Desde un estudio tanto jurídico como económico de la modificación, concluye que ella, además de no resolver los problemas que se planteó solucio- nar, genera un perjuicio tanto a los terceros como al mercado.

Advocates of restorative and transitional justice practice have long drawn from practices of indigenous peoples to form the basis for more sustainable, relational, participatory, community-based approaches to conflict resolution. With the resurgence in Kazakh nationalism since the Republic of Kazakhstan independence, repatriated diasporic Kazakhs, who through cultural survival in diaspora retain more of their ethno-cultural characteristics, influence a revival of Kazakh language and culture. The purpose of this study was to understand the indigenous informal restorative conflict resolution practices of the Kazakh people. The questions that drove this study were: What indigenous informal forms of dispute resolution have been in use among Kazakhs, as reflected in their folklore and proverbs; which have continued in use among diasporic semi-nomadic Kazakh populations; and, which, if any, are restorative in nature? This ethnographic multi-case study incorporates participant observation and semi-structured interviews of participants selected through snowball sampling from among diasporic Kazakhs in, or repatriated from, China. Kazakh folklore and proverb collections were examined for conflict resolution practices and values at the family and kinship levels. Key theories used to explore the topic include Post-Colonial Theory of Sub-Altern Agency, Essentialism Theory, Soviet Ethnos Theory, and Restoration of Trust Theory. This study expands the knowledge base regarding indigenous systems of conflict resolution and contributes to the ethnography of the Kazakh people. The existence of indigenous informal restorative Kazakh systems of conflict resolution can inform reassessment and reform of public policy as to alternatives to punitive criminal justice practices.

The research investigates whether the application of the transaction in tax law, understood as one of the possible outcomes of the consensual methods of dispute resolution, is compatible with the Brazilian judicial system and, in case it is, what are the limits imposed by the legal system to its federal regulation. This work starts with the assumption that language is constitutive of reality and seeks to identify what are the possible meanings of the word transaction; starting from the characteristics of the out-of-court methods of dispute resolution and the civil transaction, as well as from the analysis of the rule described in article 171 of the National Tax Code (CTN), a definition of the tax transaction concept is built. In face of the definition of this institute, this work studies the elements of the rule to be introduced by the Federal Legislative Power, as well as its compatibility with article 3rd of the CTN, with the constitutional norms that rule the national tax system and with the public interest. This work also analyzes the possibility of a legal claim on the transaction and the legal consequences resulting from possible flaws in the agreement between the State and the individual. Closing the research, this work investigates the cost-benefit in the insertion of a federal law regulating the tax transaction, taking into consideration the incentives generated on taxpayers for such legislative choice, the economic benefits reaped by the Fiscal Authority in the adoption of this institute and whether the perspective of an agreement with the State could increase tax evasion and corruption. Finally, the previous experiences of tax transaction in states and local legislations is analyzed considering the resulting conclusions of the present study
A pesquisa investiga se a admissão da transação, entendida como um dos resultados possíveis da autocomposição, em matéria tributária, é compatível com o sistema jurídico pátrio e, em caso afirmativo, os limites impostos pelo ordenamento para uma regulamentação do instituto em âmbito federal. Para tanto, parte-se da premissa que a linguagem é constitutiva da realidade e busca-se identificar as acepções de sentido do termo transação; a partir das características dos meios alternativos de solução de conflitos e da transação civil, bem como da análise da norma de competência prevista no artigo 171 do Código Tributário Nacional (CTN), constrói-se uma definição do conceito de transação tributária. À luz da definição do instituto, estudam-se os elementos da norma a ser introduzida pelo Poder Legislativo Federal, bem como a sua compatibilidade com o artigo 3º do CTN, com as normas constitucionais que regem o sistema tributário nacional e com a indisponibilidade do interesse público. O trabalho analisa, ainda, a possibilidade de rediscussão judicial dos termos da transação e as consequências jurídicas decorrentes de possíveis vícios no acordo entabulado entre o Poder Público e o particular. Encerrando a pesquisa, investiga-se o custo-benefício na edição de lei federal regulamentando a transação tributária, levando-se em consideração os incentivos gerados nos contribuintes por tal escolha legislativa, as vantagens econômicas para o Fisco na adoção do instituto e se a perspectiva de acordo com o Estado incrementaria a evasão fiscal e a corrupção. Por fim, expõe-se a experiência da transação tributária em outros entes da federação, confrontando-se as respectivas legislações com as conclusões resultantes do presente estudo

Дисертація присвячена теоретичному узагальненню та новому розв’язанню наукової проблеми, яка полягає в розкритті сутності та змісту адміністративно-правового регулювання медіації, здійсненні комплексної теоретико-правової характеристики його сучасного стану і тенденцій розвитку. Розглянуто генезис наукових підходів щодо змісту, особливостей та процедур здійснення медіації; розкрито подвійну соціально-правову природу медіації та її значення у розв’язанні правових конфліктів; надано характеристику сутності медіації в адміністративно-правовому вимірі наукового аналізу; характеризовано етапи запровадження медіації в Україні; здійснено правову характеристику моделей медіації в світі; з’ясовано особливості запровадження медіації при вирішенні публічно-правових спорів; визначено загальні та спеціальні принципи адміністративно-правового регулювання медіації; розкрито сутність відносин у сфері здійснення медіації як об’єкта адміністративно-правового регулювання; визначено суб’єктів адміністративно-правового регулювання медіації в Україні. Окрема увага надається визначенню напрямів побудови ефективного адміністративно правового регулювання медіації в Україні. Розроблено пропозиції щодо формування етичного кодексу медіатора. Диссертация посвящена теоретическому обобщению и новому решению научной проблемы, которая заключается в раскрытии сущности и содержания административно-правового регулирования медиации, осуществлении комплексной теоретико-правовой характеристики его современного состояния и тенденций развития. Рассмотрен генезис научных подходов к содержанию, особенностям и процедурам осуществления медиации; раскрыта двойная социально-правовая природа медиации и ее значение в решении правовых конфликтов; охарактеризована сущность медиации в административно - правовом измерении научного анализа; охарактеризованы этапы внедрения медиации в Украине; осуществлена правовая характеристика моделей медиации в мире; выяснены особенности внедрения медиации при разрешении публично-правовых споров; определены общие и специальные принципы административно-правового регулирования медиации; раскрыта сущность отношений в сфере осуществления медиации как объекта административно - правового регулирования; определены субъекты административно - правового регулирования медиации в Украине. Особое внимание уделено определению направлений построения эффективного административно - правового регулирования медиации в Украине. Выработаны предложения по формированию этического кодекса медиатора. рассмотрена эффективность осуществления медиации в контексте надлежащего административно - правового регулирования. Предложена концептуальная основа построения надлежащей административной процедуры применения медиации в решении публично-правовых споров.
The dissertation is devoted to the theoretical generalization and new solution of the scientific problem, which consists in revealing the essence, content of administrative and legal regulation of mediation, implementation of complex theoretical and legal characteristics of its current state and development trends. It is established that mediation is a poly-systemic phenomenon and is considered by scientists in its various aspects – cultural, historical, philosophical, psychological, socio-psychological, conflict, communication, political science and law. The main features of mediation as an alternative dispute resolution procedure have been clarified. The social and legal content of mediation and its essence in the administrative and legal dimension of scientific analysis are studied. There are three stages of the introduction of mediation in Ukraine: the emergence and development of onciliation and mediation (up to the XIX century); emergence and development of mediation as a social nstitution (XX–XXI centuries); legal consolidation of mediation (XXI century), which continues to this day. The content of the concept of «mediation model» is considered, which is proposed to be understood as an abstract heoretical and legal construction of the generalizing character of the main features of mediation. It was found hat the world practice is dominated by three main models of mediation, which are divided according to the egree of integration into the judicial system: extrajudicial (autonomous, private), judicial and judicial mediation. The concept of principles of administrative and legal regulation is developed, which reveals their meaning as based on the principles of administrative law fundamental legal principles enshrined in law or those that follow from it and determine the content and essence of a particular administrative and legal institution. General and special principles of administrative and legal regulation have been established. The general and direct objects of administrative and legal regulation of mediation are singled out. The general object is defined as administrative-legal relations in the field of mediation, the direct object is the behaviour of mediation articipants related to the presence of a conflict (dispute) in public-law relations, one of the parties of which is n entity endowed with power. The subjects of administrative and legal regulation of mediation and perspective directions of their activity are determined. Taking into account foreign experience, the need to expand the owers of the Ministry of Justice of Ukraine in the field of mediation was emphasized. Particular attention is paid to identifying areas for building effective administrative and legal regulation of mediation in Ukraine. It was ound hat the ethical standards of activity of social mediation service providers are minimal and cannot omprehensively cover the professional conduct of mediators in Ukraine. Proposals for the formation of a ediator’s code of ethics have been developed. The effectiveness of mediation in measuring proper dministrative and legal regulation is considered. It is determined that the main indicator of the effectiveness of ediation is the modernization of the legal system and its compliance with European standards, which will ignificantly bring Ukraine closer to membership in the European Union.The conceptual basis of building a roper administrative procedure for the use of mediation in resolving public disputes is proposed, which identifies romising areas of mediation in resolving such categories of disputes and is based on the best experience of ractical use of mediation and theoretical ideas about its essence, purpose, principles and features. As a result the analysis of the current state of mediation in Ukraine, the main vectors of its development are its legal support as a legal institution and as an administrative procedure. The elements of the conceptual basis for the construction of a proper administrative procedure for the use of mediation in public law disputes are identified and the expected results from the implementation of the proposals and recommendations are identified.

Magistro darbe “Ypatingosios teisenos esmės problematika” siekiama išanalizuoti ypatingosios teisenos esmę Lietuvos Respublikos civilinio proceso kodekse, ginčo ir ypatingosios teisenos tarpusavio sąveiką, dabartiniame Civilinio proceso kodekse nustatytą ypatingosios teisenos ir ginčo teisenos reglamentavimą, atskleisti jo turinį ir pagrįsti nuostatų įtvirtinimo būtinumą Lietuvos civilinio proceso teisėje. Įsigaliojus dabartiniam Civilinio proceso kodeksui, buvo iš esmės reformuotas ypatingosios teisenos procesas pasirinkus germaniškąją ypatingosios teisenos koncepciją. Atsisakius ginčo dėl teisės kaip pagrindinio teisenas atribojančio kriterijaus, Civilinio proceso kodekse įtvirtinta nuostata, draudžianti perduoti ypatingosios teisenos bylą išnagrinėti ginčo teisenos tvarka, jei joje kyla ginčas dėl teisės. Pagrindinis kriterijus, kuriuo remiantis Lietuvos civilinio proceso teisėje atribojama ginčo ir ypatingoji teisena, yra tikslingumas bei viešojo intereso egzistavimas civiliniuose teisiniuose santykiuose. Įtvirtintas inkvizicinis ypatingosios teisenos proceso modelis su jam būdingais oficialumo, imperatyvumo, riboto viešumo bei žodiškumo principais. Įtvirtintas aktyvus teisėjo statusas nustatant objektyvią tiesą ypatingosios teisenos byloje. Darbe stengiamasi įvertinti šią įstatymo leidėjo poziciją, remiantis egzistuojančia teismų praktika ypatingosios teisenos bylose. In the master’s thesis titled "The issue of essence of the particular proceeding” is being tried to analyse the main features of the particular proceeding in Lithuanian Republic Civil Process Code, the interaction between disputes and particular proceeding, the interaction between those both proceedings, the innovation in the present Civil Process Code, which are related with the regulation of dispute and particular proceeding, to analyze innovation in detail, to exhibit its purport and to give a proof of the fixation of the attitudes in the Lithuanian Civil Process Law. While the present Civil Process Code took effect, the particular proceeding process was reformatted with the choice of the Germanic particular proceeding conception. Having rejected the dispute for law as the main criteria, which deliminates proceeding, in Civil Process Code the attitude is fixed, which prohibits to transfer particular proceeding case to a judge by the dispute proceeding method if the dispute for law (right) arises in it. The main criteria, as the ground of which in Lithuanian Civil Process Law the dispute and particular proceedings are deliminated and the public interest and expediency exist in civil legal regulation. There is consolidated inquisitorial model of particular proceeding with the official, inperative principles, also with the principles of limited publicity and of literal character, which are characteristic to this model. The main purpose of this essay is to demonstrate that the use of the alternative dispute resolution (mainly mediation and conciliation) is the most appropriate way to resolve conflicts of family matters. The study found that the alternative dispute resolution have characteristics that make them ideal for the resolution of family conflicts, for its possibility to take into consideration the most profound aspects of the family relations, that lead to most disputes. The adjudication of the controversy may analyze only the superficial aspects of the conflict, leading to the generation of new disputes amongst the members of the family, and does not contribute to the social peace, sought in all family relationships. The Public Defenders have the institutional obligation of using the alternative dispute resolutions, therefore have a key role in the promotion and effective use of non-adversarial methods of resolving family disputes. The practical experience has shown that the ADRs are effective for bringing social peace and justice distribution, ultimate purpose of the Law
O principal objetivo dessa dissertação é demonstrar que a utilização das formas consensuais de resolução de conflitos (principalmente mediação e conciliação) é a maneira mais adequada de resolver as disputas nascidas em Direito de Família. O estudo considerou que os meios consensuais de resolução de disputas possuem características que os tornam ideais para a resolução de conflitos familiares, já que têm a possibilidade de levar em consideração aspectos mais profundos das relações entre as pessoas, que culminam com a ocorrência dos conflitos. A adjudicação estatal, em tais matérias, analisa apenas superficialmente a questão, de modo que não impede a formação de novos conflitos, tampouco pacifica profundamente a relação das partes. A Defensoria Pública do Estado de São Paulo possui como missão institucional a utilização de tais formas consensuais de forma primordial, razão pela qual tem papel fundamental no fomento e na adoção de métodos não-adversariais de solução de conflitos familiares. A experiência prática tem demonstrado que as formas consensuais são eficazes para a pacificação social com justiça, finalidade última do Direito
