Повний текст джерелаThe end of the Second World War, the cold war, the peaceful cohabitation, the movements of independences, the bipolar end of the world, the multi-form and successive crises (cultural, social economic and financial), here is so many events which changed the designs and the vision of the world. The private initiative is again approved by a large majority on the world scene. Indeed, the meeting enters the know-how (financial and technical) of the private sector and the ambitious but very limited public sector, symbolized in the initials "PPP", becomes the winning formula.New spaces make their appearance encouraged by the wind of the regional and economic integration. The movement of decentralization propelling that of the cross-border cooperation, we assist more and more a slow but very promising reconfiguration of the cross-border dynamics almost everywhere in the world. Certain regions offer very interesting perspectives, as well from the point of view of the cross-border cooperation as the PPP. It is in particular the case of the French-speaking region of Africa of Great Lakes. Encircle the PPP and the cross-border cooperation, to check their complementarities and finally to follow the mechanism of reappropriation of these two concepts in the French-speaking region of Africa of Great Lakes: here are the main objectives that assigned this research work

On the international level, the use of the PPP model raises complicated challenges and difficulties. The complex nature of such projects increase the probability of disputes between the parties. The comparative analysis of the British and French experience allows the elaboration of a reference for the Egyptian government in the legal and economicreforms. In order to improve the management of PPP projects in Egypt, two approaches can be addressed in our research. First, the development of an effective risk management methodology through the analysis of the types of risk associated with PPP during the life cycle of the project. Повний текст джерелаThe infrastructure and public services are in crisis in many developing countries (LDCs), and for various reasons (lack of funds, public mismanagement). This situation represents a major stumbling block preventing the economic and social development today and sustainable development in these countries. It must be remedied as quickly and efficiently as possible, but the technical and financial resources required far exceeds local capabilities. Developing countries must therefore resort to the (foreign) private sector participation for the implementation of infrastructure and the management of public services. This remedy can be done within the framework of a Public Private Partnership (PPP) which represents the middle ground between the " all public " and " private everything " and which offers state a lot of technical, financial, economic, social and even political advantages. Because of all these inputs, the use of different forms of PPP (leasing, concession, BOT. . . ) is actively promoted by the international financial institutions, the WTO and development agencies who see it as an instrument for sustainable development and poverty alleviation. The use of PPP was nevertheless criticized by its detractors (some associations, NGOs,. . . ) who expose some irregularities (remedies imposed, imbalance of power in favor of the multinationals,. . . ) which caused the failure of some projects. But this should not prevent developing countries reaping the greatest contributions of the private sector and to try to exploit the infrastructure done in an efficient manner allowing widespread access to quality services. The PPP can be a tool for sustainable development as long as all the success factors come together (a good legal and financial montage of contracts, involvement of civil society and users). The PPP is also a means of international solidarity and a complement to other efforts to be strengthened such as official development assistance (ODA), debt concellation, decentralized cooperation,. .

Although well developed in the North, cultural industries are less developed in Africa. In the continent, while some countries have successful models of development in this sector, like Nigeria or South Africa, the cultural industries in francophone countries of sub-Saharan Africa are still in a precarious level. This seems likely due to a late awareness of their issues, socio-political considerations, or a misunderstanding of the roles of the actors. Hence our interest in studying the role of public authorities in the process of cultural industries development in Burkina Faso, through the following subject: Cultural industries in francophone countries of sub-Saharan Africa: case of Burkina Faso. To carry out our reflection on the subject, the methodology consisted as well of a theoretical brusaillage and field investigations, allowing to confirm the hypotheses emitted.In Burkina Faso, the cultural industries are dynamic, by their organization, despite some shortcomings in the development of cultural sectors. This dynamic, favorable to the implementation of major initiatives and cultural events, makes the country as a "cultural crossroads" in Africa. Cultural industries generate considerable social, political and economic impacts for the country. However, these profits are the subject of conflicts between mainly industrial culture sector and the public sector. It is therefore essential that public authorities and cultural private sector work in synergy, with well-defined roles, to take the challenges seriously, for a more viable, dynamic and sustainable sector

Повний текст джерелаInternational public procurement holds a central role in official development assistance flows. As the channel for the execution of development projects, it is a link between the States and entities benefiting from the financing and the holders of those financing, whether they are specialized multilateral institutions or within the framework of bilateral relations. In the same way, it stands at the crossroads of relations between the afore-mentioned actors and those of the private sector which compete to obtain these markets.Our study aims to identify in its formulation, its content and its orientation, the legal framework of this flagship instrument of development strategies, while questioning it in relation to the challenges of said development.Our analysis shows that the formulation and evolution of the legal framework for international public procurement are determined by many issues. These extend beyond the development of the beneficiary countries to embrace the global issues of international trade and those specific to the preservation of the interests of the stakeholders in the financing. It follows that it is a legal framework marked by a strong imprint of the singularities of international economic law. It is also characterized by a clear trend towards harmonization.In the context of international public procurement, it is notable that the international harmonization of the legal framework uses the regional channel which facilitates the implementation of the objectives of international actors while responding to certain problems specific to national levels. In this perspective, the preexisting regional economic integration organizations play a fundamental role.In order to analyze this trend, we choose to study the harmonization process of the public procurement legal framework of WAEMU. Then, the analysis of the singular case of Côte d'Ivoire highlights the issues and challenges related to the transposition of this legal framework at the national level. It appears that even if regional reforms taking into account international requirements have been widely implemented, challenges remain.Finally, with regards to an economic and social development reflecting the vision and challenges specific to the beneficiary countries, the symmetrical transposition of international models at the national level is not always appropriate. They must be adapted to the particular context

Повний текст джерелаIn developing countries, problems brought about by HIV/AIDS and inaccessibility of antiretrovirals (ARVs) are proving to be the cause of serious damages at all levels (demographic, political, social and economic). Within the context of the World Trade Organization, and in particular the Agreement on Trade-Related Aspects of Intellectual Property Rights (“TRIPS Agreement”), a growing number of developing countries have integrated or are in the process of integrating into their national law an international standard of patent protection for pharmaceutical products and processes. Such integration continues to play a major role in the issue of access to medicines in developing countries. The conditions and effects of the protection regime respecting innovations give rise to heated debates between supporters of an increased patent protection and defenders of the access to essential medicines. One of the main motivations for our research is to provide a study that helps to find solutions that are both in favour of improving access to medicines and protecting innovation. The complex problem of access to ARV drugs in developing countries is influenced by the multidisciplinarity and interdependence of many factors. The patent system does not solve the problem on its own. However, it should be seriously considered in its function of balancing the private and collective interests. It is a valuable legal tool for the economic and technological development of the developing countries and to achieve the common interest against the pandemic

Повний текст джерелаThis thesis proposes a study of State transformation and of the exercise of power from the observation of political instruments used to develop the big Moroccan solar power plants. This work is based on two long participative observations, which consist of a double ethnography of development in the public institution beneficiary of the aid as well as in the institutions that control this aid. I summon up both public policy sociology and studies in management and in economic sociology on finance and Public - Private Partnerships. The Public – Private Partnership contractualisation seems to become a new mode of public policy in favour of aid to development. Besides, the choice of a type of contract, of a type of mode of financing, are political choices as well. Euro-Mediterranean policies for the renewable energy studied in this thesis illustrate a shift of state-centered public policies towards a multilevel public policy. The analysis of the making of tools and instruments of the Mediterranean Solar Plan highlights a mode of governance based on consensus and expertification. The framing of the public policy for renewable energy in Morocco is erected by private and public actors and leads to the diffusion of the formalities coming from big companies and from the financial market.Compelled by these actors, the Moroccan solar energy market has been institutionalized since 2009, in keeping with a process of neoliberal bureaucratization. In this institutionnalisation, international financial institutions and private consortiums convey, through their expertise and their participation to public policy, many political instruments. This instrumentalization goes through competitive and international calls for tender, loans for economic development aids, or climate change funds, and at last contractual solutions such as Public-Private Partnership. The synergy between aid to development instruments and the policies in favour of renewable energylead to a transformation of the modes of government and of the role of State. The use of these aids to development and private expertise instruments allows bureaucratic regulation and control, as Weber says, of the solar energy market. Повний текст джерелаThe deficiency of the financial system, the dichotomy of economic activities of the public and the private sectors, and the dependence on exterior economic resources in the long run are the essential causes of the inefficient allocation of financial and other economic resources in developing countries. Moreover, the ambiguity of the economic strategies and the lack of an exact determination of the specific roles of the public ant private sectors are the reasons behind the failure of governmental economic policies. The main question here is to determine how and in what areas the government should intervene and invest in order to encourage the private sector and economic development. This question is worth discussing within the general framework of all developing countries, but with the specifics of each country taken into account when discussing economic policies in that particular country. Our objective is to analyze the financial problems and linkage between the two sectors in developing countries in general and in iran in particular. The main results are that the monetary and financial policies applied since 1973 in iran had negative effects on the economic growth of real gdp. Also, the petroleum revenues had a crowding out effect on the productions of other economic activities. Finally, the econometric results show the existence of complementarity relations between investments in both public and private sectors, i. E. That the public investment has a crowding in effect on the private one
