نتيجة استمرار الانتهاكات الصهيونية ضد المسجد الأقصى والشعب الفلسطيني في الضفة الغربية وقطاع غزة, وزيادة معاناة الأسرى الفلسطينيين وتوسع المستوطنات اليهودية ومحاولة عمليات التطبيع بين الدول العربية وإسرائيل وخاصة مع السعودية... انطلقت عملية طوفان الأقصى لتغيير هذا الواقع وترسم معالم المرحلة المقبلة للقضية الفلسطينية, حيث كان من تداعياتها الإيجابية فلسطينيا: استعادة القضية الفلسطينية زخمها إلى واجهة الأحداث العالمية, وتحرير الأسرى الفلسطينيين, وأعاقه المخططات والمشاريع الأمريكية الصهيونية كـ صفقة القرن ومشاريع التطبيع, وتعزيز موقع حماس, وتصاعد قوة محور المقاومة, في حين كان لها تداعيات سلبية على الكيان الصهيوني أهمها: تآكل الردع الإسرائيلي وانهيار الثقة بالجيش الإسرائيلي واستخباراته, وتغيير المشهد السياسي الإسرائيلي الداخلي مستقبلاً وخاصة انتهاء مستقبل نتنياهو السياسي وزيادة التكلفة الهائلة للعملية مادياً وبشرياً ومعنوياً على إسرائيل.

عند البحث في خيارات السياسية الأميركية تجاه الأعداء والخصوم نجدها متفاوتة مع كل مرحلة من مراحل السياسية الأميركية وبحسب الأولويات الاستراتيجية ، وتختلف تلك السياسات ما بين التصعيد تارة في مواجهة التهديدات والتحديات سواء أكانت أمنية أو اقتصادية أو صحية وما بين الانكفاء في ظل اختلاف التكتيكات تجاه بؤر التهديدات العالمية ، ومن بين تلك التحديات التي دخلت في دائرة الخطر الاستراتيجي للمصالح الأميركية ومناطق النفوذ (الفواعل العنفية) وعلى وجه التحديد عابرة الحدود ، ومنطقة الشرق الأوسط من اكثر تلك المناطق لمنابع الفواعل من دون الدول وعلى وجه التحديد الفواعل العنفية أو المسلحة ذات التوجهات الراديكالية، لذا اخترنا منطقتين من بين اكثر المناطق توتراً هي العراق وسوريا التي أفرزت فواعل من دون الدول بتغذية إقليمية في ظل المتغيرات التي طرأت على المنطقة من احتلال العراق عام 2003 وما تلاها من فوضى خلاقة خلفت انقسامات وعدم استقرار انعكس على دول المنطقة وما ثورات التغيير " الربيع العربي " إلا احدى تلك الانعكاسات والتداعيات التي شهدتها المنطقة وبالتحديد سوريا التي انتتجت فواعل متعددة الأطراف والاتجاهات منها ذات طابع عالمي عابر للحدود كالقاعدة وتنظيم داعش ومنها إقليمي كحزب الله اللبناني والفصائل العراقية المقاومة، ومنها محلي كالحوثيين في اليمن ، لذا نجد أن تعامل السياسية الأميركية ينقسم تجاه الفواعل في العراق وسوريا على أساس نوع الفاعل ودرجة تأثيره ما بين المنطقة الحمراء والبرتقالية والخضراء التي تتمثل ما بين الخطر والتهديد والتحدي ، وكان لأحداث 7 أكتوبر 2023 في غزة وما تبعها من تداعيات دور كبير للفواعل في سوريا والعراق اكثر من الدول في زيادة الزخم العسكري تجاه الولايات المتحدة الأميركية سواء كان في العراق او في سوريا او حتى دول الجوار كما حصل على البرج 22 في الأردن وان كانت المحصلة ذات طابع تتحكم به قوى إقليمية متمثلة بإيران التي تدير الصراع بطريقة تتناسب مع الظروف التي أنتجتها المنطقة.

Following the flood Al-Aqsa on October 7, 2023, the Israeli- Palestinian conflict witnessed an unprecedented escalation in terms of Israel’s excessive use of force and the civilian casualties in Palestinian side. Furthermore, the majority of western countries aligned themselves with Israel under the pretext of its right to self defense. Israel and its allies have often resorted to this justification to justify repeated Israeli attacks on the Palestinian people. The Importance of researching this topic lies in the fact that legitimate self-defence is a right recognized by both international law and international humanitarian law. And it is a common denominator between the conflicting parties. Just as Israel invokes this right in its military operation, the Palestinian side also asserts right to self-defense using all available means. The objectives of the study can be summarized as follows: to research and explain the provisions related to legitimate self-defense in the united nations charter and its resolutions, as well as in the texts of Geneva Convention, particularly in the first additional protocol. This is done to understand the legal conditions and regulations associated with use of force in any conflict, which, when met, can exempt the practitioner from international responsibility. However, in the Israeli-Palestinian conflict, given the defences in the legal positions of the two parties and in light of the conditions of legitimate self-defense the problem in this issue revolves around determining which party’s use force towards the other is considered a justified use falling within the realm of legitimate self defense? and what is the legal assessment of the other party using force outside the scope of legitimate self-defence?. To address this issue, this topic has been divided according to the following methodology : Firstly: the international legal system of to legitimate defense. 1- the legal basis for the right to legitimate defense. 2- conditions for the legitimacy of the right legitimate defence Secondly: legal evaluation of the use of in the Palestinian, Israel conflict under the pretext of legitimate defence. 1- the legal basis for Palestinian party’s right to legitimate defense. 2- the legal nature of Israel’s use of force against the Palestinian people

This paper argues that the al-Aqsa Flood operation launched by the Izz ad-Din al-Qassam Brigades –the military wing of Hamas– on the morning of October 7 has led to a psychological and epistemological rupture in the Palestinian-Israeli conflict and Middle East politics as the operation marked a paradigm shift in the philosophy of the resistance. The infiltration of al-Qassam into the occupied territories by land, sea, and air was a clear sign of a change in the strategy of the resistance to continue the active struggle against the aggressive expansionism and aggression of the Zionist Israeli government. In this context, the study tries to frame Operation al-Aqsa Flood and analyze the dimensions of the rupture. Besides this, it will also outline the possible impact of the operation on global and regional politics, considering that the ongoing process will change the political balance in the Middle East.

AbstractHamas's al‐Aqsa Flood operation, Israel's brutal response, and the regional escalation of the conflict, including Iran's and Israel's unprecedented strikes on each other's territory, mark a critical juncture for the Middle East. These events have brought a renewed focus on the Levant as a key area of Iranian geopolitical interest and rivalry with Israel. Syria and the broader subregion are viewed by Tehran as vital for its national security and that of its alliance network, the Axis of Resistance, and for the survival of the regime. This article explores Iran's policy toward the Levant, focusing on Syria as the crucible of Iran's engagement with the region over the last decade. The study highlights how Iran's approach is defined by its continued desire to maintain its projection of strategic depth, thus ensuring its own security and that of the Axis of Resistance. Israel looms large over this calculus as the Islamic Republic looks to strengthen its allies’ positions against its enduring rival.
