Els arxius catalans conserven un nombre excepcional de documents relacionats amb la justícia que gràcies a la publicació recent i sistemàtica ja estan disponibles per a una extensa investigació. El seu objectiu és analitzar el canvi de procediment legal d’una societat en ple procés de feudalització. Per fer-ho, el treball introdueix un nou mètode de visualització que permet fer una anàlisi detallada dels conflictes legals: la roda de la justícia. El cos principal de la tesi es divideix en tres capítols que segueixen l’ordre cronològic inherent dels casos judicials: preludis, judici i resolució. A la primera part, l'obra tracta de les dimensions: el lloc i la data, així com els prolegòmens necessaris per a les proves. La segona part se centra en el judici en si mateix: la composició del tribunal i els seus assistents i la dinàmica dels tribunals. Aquest capítol presta especial atenció a les proves i als duels judicials en la pràctica de la resolució de conflictes, així com a l’abandonament dels processos i la seva importància política, social i jurídica. Finalment, l'últim capítol tracta de noves formes de resolució per ressaltar els canvis al sistema. La tesi pretén donar una nova visió de les continuïtats i transformacions que es van produir a Catalunya durant aquest període, quin paper van tenir els tribunals i els administradors de justícia, així com la manera com es van narrar aquests processos.

Повний текст джерелаEsta tese trata do problema histórico do poder e da representatividade, situando-o na Catalunha do século XIV como um caso particular da tradição medieval europeia. Essa tradição foi lida através de seus repertórios textuais, deslocados no tempo até a Antiguidade, mas presa ao universo intelectual da Baixa Idade Média. Sob a hipótese de que a auctoritas e a potestas coexistem na tensão entre o soberano e a comunidade, enlaçam-se as linguagens que descrevem os lugares de atuação de cada um deles. Essas linguagens dependem do vocabulário do direito e da política, que são meras categorias operatórias de uma busca permanente de legitimidade dos vetores que exercem o poder histórico. Assim foram lidos os discursos de uma trajetória histórica de fortalecimento da autoridade régia e imperial. A seu lado, permanecem os vestígios da vida em comunidade, em que o problema da municipalidade e da participação citadina deram a materialidade ao problema da representatividade popular. Ambas doutrinas, da verticalidade do poder e da horizontalidade do governo inter pares, encontram-se nos debates aristotélico-tomistas e, logo, nos franciscanos da Baixa Idade Média. Eles dão as bases discursivas e materiais do ponto de partida interpretativo que ora se toma para analisar os expedientes das cortes do Principado da Catalunha, no século XIV. Por seu turno, o material dessas cortes assimilou três bases discursivas específicas: a gênese das instituições tardo-feudais, o aparecimento das formas complexas de municipalidade e o problema da soberania do príncipe. As três foram tocadas pela linguagem teológico-filosófica e pelo direito romano, a sua vez, eles foram usados em diferentes ocasiões para conferir padrões hierárquicos aos vetores no arranjo estamental da sociedade medieval. Nas cortes gerais, que evoluem em razão da necessidade de arrecadações mais constantes para suprir um débil patrimônio régio, o príncipe busca consolidar essa hierarquia por meio da ideia teológico-jurídica da autoridade pública da monarquia. Aí, o direito se apresenta como medium de adaptação de repertórios arcaicos, fornecendo uma ideia de continuidade que legitima as transformações e inovações do mosaico jurisdicional do Principado. Porém, a impostação da supremacia de uma autoridade pública se vê freada pela incapacidade fiscal da Coroa, que recorre com maior frequência aos subsídios graciosos concedidos pelos estamentos nas cortes, obrigando o rei a se submeter aos acordos constitucionais que elaboravam medidas de contenção sobre suas faculdades soberanas. Aos poucos, o mesmo repertório extraído do direito comum e da teologia política, que dava suporte às pretensões do príncipe, vai se tornando o substrato de uma doutrina da representação popular, em que a comunidade se assenhora de si e busca a imposição de uma unânime vontade, a do corpo místico, sobre as potestades judiciais e legislativas do soberano.
This thesis deals with the historical problem of power and representativity, placing it in Catalonia in the fourteenth century as a particular case of medieval European tradition. This some tradition was read through its textual repertoires, relocated in time to Antiquity, but tied to the intellectual universe of the Late Middle Ages. Under the hypothesis that the auctoritas and potestas coexist in the tension between the sovereign and the community, the languages that describe the places of action of each of them are interconnected. These languages depend on the vocabulary of law and politics, which are mere operative categories of a permanent search for legitimacy of the vectors that exercise historical power. Thus were read the discourses of a historical trajectory of consolidation of the regal and imperial authority. At his side remain vestiges of community life, in which the problem of municipality and city participation has given materiality to the problem of popular representation. Both doctrines of the verticality of power and the horizontality of inter pares government are found in the Aristotelian-Thomist debates, and thus in the Franciscans of the Late Middle Ages. They give the discursive and material bases of the interpretive starting point that is sometimes taken to analyse the records of the courts of the Principality of Catalonia in the fourteenth century. For its part, the material of these courts assimilated three specific discursive bases: the genesis of late-feudal institutions, the emergence of complex forms of municipality, and the problem of the sovereignty of the prince. All three were touched by theological-philosophical language and by Roman law; in turn, they were used on different occasions to bestow hierarchical patterns to the contending vectors in the arrangement of the medieval society. The general courts evolved because of the need for more constant tax revenues to supply an insubstantial royal patrimony; meanwhile the prince seeks to consolidate the notion of hierarchical superiority by applying the theological-juridical idea of his public authority. Thus, the law presents itself as a medium for adaptation of archaic repertoires, providing an idea of continuity that legitimates the transformations and innovations of the jurisdictional mosaic of the Principality. However, the imposition of the supremacy of a public authority is hampered by the fiscal incapacity of the Crown; which more frequently resorts to the graceful subsidies granted by the estates in the courts, forcing the king to submit to constitutional agreements that elaborated measures of containment on his faculties sovereign. Progressively, the same repertoire extracted from common law and political theology, which supported the pretensions of the prince, are becoming the substratum for a doctrine of popular representation, in which the community seizes itself and seeks the imposition of a unanimous will of the mystical body, over the judicial and legislative powers of the sovereign.

Повний текст джерелаThe purpose of this thesis/research is to have a vision of the residents’ routine life in Mataró, Argentona and Òrrius, from mid XIV century till end of XV Century. This research is based in three fundamental facts to explain it: the manor, the population and the society. The demography has allowed us to see how Mataró was rapidly increasing its population against Argentona and Òrrius where it was declining. We have documented a high amount of territorial manors, being the jurisdictional manors in hands of their own castles. During the second half of XIV Century, the "remences" (servile people) represented half of the territory’s population. The manor implied some sort of rights and for the payment of taxes. The census where paid mainly in kind, although, while years were passing by, this will turn into money. Among the manors rights we emphasize the mills and iron mongeries, but also the scribes, stoves, markets and meat shops. All the territory was populated, mainly with farms. Mataró since the second half of XVI Century, have experimented an urban growth surrounding the market square where it was located the water well, the communal stoves, the meat shops and the arcade stores. Some of the facts we have been able to document properly are the abandoned farms, which started on the XIII Century. Many farmers have taken the farms to their heritage buying them either through establishment which were always under advantageous conditions for the sirs. The farms usually have lands under the dominion of various manors and were fragmented around the territory, sometimes without territorial continuity. The last chapter is mainly based on the family, in two important facts: marriage and death. We've studied the dowry and the territorial origins of the consorts and spouses. Thanks to the will/testament we know about the religious environment of the testators being able to going deeper among the churches and chapels of each parish and acknowledge the altars. The family legacy is taking us closer to the family core. This research ends explaining the role and the relevance of the male heirs and the 'pubillas' (the female version of the male heir, the eldest daughter) and with the last review: the universal heir.

Повний текст джерелаThis thesis has arisen from fieldwork intended to track all landmarks in the old village of les Corts, district of present-day Barcelona. Its aim to state what was, has been and is today’s neighbourhood. City planning, art and testimonies throughout the town’s history are studied. From 10th century Torre Rodona to present day. The aim of this research is to state the conditions of the birth of les Corts. It begins with the study of the spread-out masies, mainly located between Riera de Magòria and Riera Blanca and the Torrent dels Morts. This makes for an in-depth analysis of the town’s origins and the idiosyncrasies of its peoples and families. This investigation also analyses other significant locations and landmarks such as cultural centres and small palaces located in streets now sadly gone, as well as hospices and religious, educational and leisure institutions. Special attention is put on industries and workshops that set up in town. In addition to the aforementioned, this investigation features analyses of furniture and tools used between the end of the 19th century and the beginning of the 20th, such as the ones stored in the Monestir de Pedralbes museum, as well as studies of other significant institutions of that time such as the Dolsa asylum, the women’s prison, the Maternitat hospital, the Sant Rafael and Sant Joan de Déu shelters, as well as the Remei parish and other important leisure and cultural centres. This research has been made possible through access to old archive photographs as well as to living testimonials of people still living in the neighbourhood who were born before 1936. To all of them we sincerely thank for opening the doors to their homes and letting us access their archives and files, which credit all the research. All in all, this thesis aims to start an in-depth study of the evolution of the land in les Corts through oral testimonies, as well as archive research that will help broaden knowledge on city planning, architecture, leisure, culture, craftsmanship and industry that have existed in les Corts from medieval times until present day.

Повний текст джерелаNowadays the historiographical debate on the formation of feudalism in Catalonia fluctuates between the Pierre Bonnassie’s breaking model and Gaspar Feliu’s continuity model. The present level of knowledge does not yet allow for a clear positioning one way or another. Thus, we still accept, not without nuances, that everything changes when, in the 10th Century, the county of Barcelona borderland, after several centuries of depressive tendency, becomes a land coveted by count elites. Related to the desire to own the land, this thesis explores in its own small scale the decisions made the day after the conquest in determining the size of castral boundaries, the execution of land demarcation, the selection of the type of bordered land and the choice of the number of settlements per boundary, as well as the constants of introduction of castles and churches. The aim of this analysis is to find out the kind of relationship that occurs on the one hand between the pre- existing ones in the land, and castles and churches on the other hand. In other words, the goal is to obtain evidence about the extent to which these decisions are the result of simple chance or if they have already been determined, that is to say, conditioned only by behaviours engraved in the subconscious under the form of archetypal ideas adapted to the territory conditions, or else models that are applied regardless of these conditions. In short, this thesis aims to clarify the nature of the scenario in which count elites impose a new social and political order to ensure their continued channelled income from the land revenues.

Повний текст джерелаThe cloister of the Benedictine monastery of Sant Benet de Bages, in the Spanish Catalonia, has a large number and diversity of ornamental elements in its capitals, what sets us a fertile field of study. The few studies on this cloister indicate little attention by art historians to ornamentation, generally engaged in studying the historiated images. This is greatly due to the overemphasis of the idea of images as a \"Bible of the illiterate\", at the expense of a deeper analysis on the structural presence and complexity of the various elements that compose the images, among which, the ornamental elements. The existing papers on the subject of ornamentation and its presence in medieval images are generally superficial, limited to studies for stylistic categorizations, occupying a marginal place because they are supposed to be additional and unnecessary elements. At Sant Benet de Bages, like some other Romanesque cloisters, the amount of ornamental capitals exceeds that of historiated, which reveals the possibility of ornamentation to constitute a critical field to the aesthetic functioning of medieval art. This research aims to study such elements present in the cloister considering their structuring aspects in medieval imagetic economy, and the diversity of functions that can carry the concepts of \"ornemental\" and \"ornementalité\", proposed by the medievalist and French art theorist Jean-Claude Bonne, opening new possibilities for their study.

Повний текст джерелаThis doctoral thesis proposes an innovative approach to the monastic landscape of the Catalan counties in the 9th and 10th centuries using two clearly-differentiated levels of detail. Firstly, a study of a more general nature is undertaken, starting by identifying all the monasteries that can be documented, to create a comprehensive cartography of the monastic phenomenon with which to analyse its spatial distribution, the parallels to be detected and the different models of behaviour that can be distinguished. Secondly, a meticulous study of three specific landscapes with a high concentration of monasteries is undertaken, all with the aim of establishing just how these centres interacted with their physical and social settings, clearly transforming them but at the same time being profoundly conditioned by them. This gives a comprehensive, holistic view of the monastic phenomenon to allow a better understanding of the reasons for the rapid proliferation of sites in the 9th and 10th centuries, as well as the complex role
La presente tesis doctoral propone una aproximación innovadora al paisaje monástico de los condados catalanes de los siglos IX y X mediante dos niveles de detalle bien diferenciados. En primer lugar, se plantea un estudio de carácter más general que, partiendo de la identificación de todos los monasterios que se pueden documentar en ese territorio, crea una cartografía completa del fenómeno monástico sobre la cual analizar su distribución espacial, los paralelos que se detectan en ella y los diversos modelos de comportamiento que se pueden distinguir. En segundo lugar, se propone un estudio más minucioso de tres paisajes concretos, todos ellos con una elevada concentración de monasterios, para precisar cómo estos centros se relacionaron con su entorno físico y social, transformándolo de forma evidente, pero, a su vez, viéndose profundamente condicionados por él. De esta manera se consigue dar una visión holística e integral del monacato que permite entender mejor el porqué de la rápida proliferación de cenobios a lo largo de los siglos IX y X, así como el papel tan complejo que jugaron en la articulación social, política, económica y religiosa de los condados catalanes.

Повний текст джерелаThis doctoral thesis, carried out as part of the Glossarium Mediae Latinitatis Cataloniae (UB-CSIC), offers the lexicographical study of the names of trade attested in Latin documents written between the 9th and the 12th centuries in the territories of the Catalan linguistic domain, a corpus made of more than 24.000 notarial documents. The analysis of these sources has allowed us to register a total of 196 lemmata of different areas such as craftwork, the countryside or cavalry. These words are presented systematically in well-structured entries through which we have conducted a comprehensive analysis in terms of etymology, semantics, morphology and evolution of the term. The lexis compiled consists of terms inherited from the different stages of the Latin language prior to the Middle Ages, as well as a considerable number of semantic (already existing words that incorporate new acceptations) and lexical innovations. The latter can be divided into neologisms and loanwords from other languages, among which Catalanisms stand out. The blend of Latin and the Romance language that takes place in this geographical area turns the analysed texts into a fundamental source for the knowledge of preliterary Catalan and provides us with the earliest date of a great deal of words.

Повний текст джерелаLa presente tesis pretende, a través del estudio de la pintura mural de los siglos IX y X en Catalunya, llegar a la comprensión del proceso por el cual este territorio que había pertenecido al Imperio Romano entra en la Edad Media. Para alcanzar este objetivo, se realiza un análisis exhaustivo de los conjuntos conservados de pintura mural entre los siglos IX y X, esto es: los restos descontextualizados que se conservan en el Museu d'Historia de Barcelona; las decoraciones in situ de San Miguel y de Santa María de Tarrasa (Vallès occidental); los frescos llamados prerrománicos de San Quirico de Pedret (Museu Diocesà de Solsona, Solsonès); y los frescos desaparecidos de San Cristóbal de Campdevànol (Ripollès). Los estudios monográficos se centran, fundamentalmente, en la iconografía, sin olvidar las cuestiones estilísticas. La finalidad última es situar con la mayor precisión el momento de su ejecución y si se trata de obras locales o fruto de la conexión del territorio de Cataluña con centros exteriores. Del análisis realizado deriva la constatación de una fuerte y directa, pero puntual, influencia carolingia a finales del siglo IX en el obispado de Barcelona –pinturas de Barcelona y Terrassa–, y una influencia no menos importante pero más dilatada en el tiempo de la cultura carolingia en el gran centro monástico de Ripoll que se prolongará desde el siglo IX hasta el siglo XI, confirmado, así, algunas de las hipótesis mantenidas para la comprensión de la producción de manuscritos ilustrados del citado monasterio. Fruto indirecto y testimonio de esta conexión son las pinturas de Campdevànol. Al lado de esta vinculación de Cataluña con el mundo carolingio, el siglo X –pinturas de Pedret– también nos ofrece la asimilación local de algunos elementos foráneos con elementos autóctonos

Повний текст джерелаThe present study aims to analyze the process of political conformation of a local community during the Middle Ages. As historiography has shown, the factors that intervene in the consolidation of a dynamics of collective action can be diverse: conflicts with lords, mutual defense capacity, judicial function of the councils, the constitution of a tax system on the basis of public debt, etc. Taking these factors into account, the research will focus on the interaction of the three most relevant levels that, in our opinion, framed this dynamic: the creation and development of a public notary office from 1236; the establishment of a municipal regime; and the consolidation of a municipal tax habit resulting from a rising royal pressure. The chosen chronological window, 1180-1322, includes from the first reference to prohoms who participate in the resolution of conflicts in a stable court chaired by the castlà and the royal bailiff until the request for subsidy for the conquest of Sardinia. In these one hundred and forty years, we will see the emergence of a new political subject, the universitas villa et termini Terracie, which will allow the inhabitants of Terrassa to institutionally articulate the dialectic generated due to the confrontation between lordly pressures and the, not always homogeneous, interests of the community.

Повний текст джерелаThe vast body of documentation we have studied from the twelfth and thirteenth centuries have helped us understand the magnitude of the existing records on liturgical vessels in precious metals (gold and silver) and other metals (bronze, copper, tin, etc.) of the Catalan churches.Their study has enabled us to define the Catalan workshop in two ways, based on the types of pieces it worked on.First, we call it generically “Catalan metal workshop" (c. X-XIII). In defining it as such, we have based our analysis on the documentation, the remaining works and the artistic comparison. The Catalan workshop that worked on precious metals has little representative work. Had it been preserved, the large number of liturgical pieces that we found referenced in the documentation would have represented a huge wealth. In some documentation references silver vessels and other objects left to melt for a silver piece, indicates that there must have been a workshop close in distance that allowed the process.Discovering the Catalan metal workshop has been extremely helpful in that it has provided information on one of the types of works, the censer. A workshop that does not work in isolation but takes into account known models of the Catalan illustration of manuscripts, mural or table painting, or sculpture without discarding, of course, the influence of foreign styles.Second, we have also defined a Catalan workshop as working "the Limoges way" (c. XII-XIV). This workshop developed at the end of the twelfth century and lasted until the fourteenth century and bore fruit after the arrival of the works of the L’Œuvre de Limoges. These works had a decisive influence on the Catalan workshop from which developed, "a Catalan workshop in the way of Limoges." This workshop was less creative as it followed the Limoges style but had its one personality.
La documentación de los siglos XII y XIII que hemos trabajado nos ha hecho percibir la magnitud de registros de vasos litúrgicos de metal noble y metal de las iglesias catalanas de época condal y real. Su estudio ha permitido la definición que hemos hecho del taller catalán en un doble sentido. Por un lado, lo denominamos genéricamente «taller catalán que trabaja el metal» (s. X-XIII). Para ello nos hemos basado en la documentación, en la obra conservada y en la comparativa. El taller catalán que trabaja el metal noble, la orfebrería, tiene escasa obra representativa. El gran número de obra litúrgica que hemos extraído de la documentación nos habría aportado toda la riqueza de este taller en caso de conservarse.Se legan objetos de plata para fundirlos y destinarlos a nuevas obras (litúrgicas) lo que indica que en un lugar no excesivamente lejano hay un taller que lo posibilita.El taller catalán que trabaja el metal nos ha sorprendido por la información que ha aportado una de las tipologías, la del incensario. Hay que reivindicar este taller como un taller extraordinario, un taller que no trabaja aisladamente sino que tiene en cuenta modelos conocidos por la ilustración de manuscritos, la pintura mural o de tabla así como la escultura catalana, sin descartar, por supuesto, la influencia foránea de la que pudiera tener conocimiento.Por otro lado, el taller catalán que definimos como el que «trabaja a la manera de Limoges», este taller se inició a finales del siglo XII, fructificó en el XIII y se extinguió en el XIV; fue a partir de la llegada de l’Œuvre de Limoges, obra que influyó decisivamente en este taller que no fue un taller creador sino más bien seguidor, con rasgos específicos que lo caracterizan.

Повний текст джерелаThis research wants to reconstruct the quotidian lives of the villagers of ‘El Camp de Tarragona’ district during the early years of the fourteenth century. The research was undertaken on the information contained in the notarial books preserved in the Archdiocesan Historical Archive of Tarragona about the villages of Alcover, La Selva del Camp I Valls. These three municipalities, integrated into the Lordship of the Archbishop of Tarragona, have a prominently agrarian nature and a series of features that allow to conduct a comparative study that venture into the field of the regional history. However, this is a work just focused on the first two decades of the 14th century due to the special characteristics of the documentary sources. Thus, given the large number of small contracts, it has been prioritized intensity rather than chronological extension. These documents have been analyzed from the point of view of economy, society, taxation system o governmental structures. Precisely this diversity has clearly influenced the final form of the thesis, which has been organized into different sections in order to provide it with a homogeneous structure. These sections are: the spatial context, the small peasant farming, legal aspects of economic relations established in the land market, economic and social aspects of transactions in the land market, the town, the lordly incomes, the municipal development, and society. To sum up, this is a job that has established a series of research areas that can still be studied in the future by emptying and analyzing these notarial volumes which, in general, contain better information, both quantitative and qualitative, as the researcher advances through the time.

Повний текст джерелаThe aim of this thesis is to analyze a particular territory, the castle and town of Sitges, between mid-fourteenth century and early fifteenth, based on three objectives: first, to analyze the manorial domain of this territory, held by the Almoina dels pobres de la Seu de Barcelona since 1342; secondly, to deepen in the study of the evolution of the rural and villager territory on which are based both the lordship as the community studied; and finally to know about the community settled on this site. This last objective has focused on three aspects: the organization of the universitat, the work of the sea and its people and the private credit and debt. The first objective has been developed in two parts: the first one describes the process of acquisition of the lordship by the Almoina, which occurred between 1326 and 1342. The second part of this first chapter focused on identifying and analyzing the different domains obtained by the institution: the lordship of the land, territorial, of the tithe and the jurisdiction. By this we want to understand what it meant for the charitable institution acquiring this manorial domain and its different levels of lordship and, in addition, how it managed the incomes obtained. Meanwhile, about the second objective, the analysis of the territory, shared out between the village and the countryside, will allow us to see the dynamics that occur in the rural context, with the progressive depopulation of the scattered habitat in contrast with the growth of the village. Regarding the third and last chapter, we focused the research on the three mentioned areas of community’s relationship. This last objective aims to bring the reader the reality of a rural and fishing community, the social and economic relationships established among its members, customizing and humanizing them. In conclusion, this research want to reach the reality of a rural and coastal lordship in the last centuries of the Middle Ages, serving both and as an example to others similar feudal territories while as a model of the heritage management of large institutions run by the Church as the Almoina de Barcelona.

To achieve this objective, we have analyzed the municipal documentation, chancery registers and notary protocols in order to take a picture of the situation of medieval prostitution in the city. We have documented numerous data that were unknown about the subject: we have documented a third brothel that had not been studied so far, we have structured how the privilege of 1390 against the pimps of the city worked, and we have seen the conditions of Life of the monasteries for prostitutes of the city of Barcelona.

Se proponen nuevas hipótesis sobre la pretendida continuidad de estas emisiones locales a lo largo del tiempo, sobre la identificación de los tipos monetarios emitidos y también sobre los motivos y el lugar de su origen, ubicado en Lleida poco antes del año 1300. El estudio se centra en tres periodos diferenciados. El primero abarca el área catalana de circulación de la moneda jaquesa entre 1298 y 1350, con alguna excepción que se alarga hasta 1460. El segundo período se inicia con la Guerra contra Juan II (1462) y se alarga hasta la reforma monetaria del año 1494. El tercer período, de más baja intensidad, se pone en marcha desde la primera crisis de la moneda barcelonesa reformada (1508) hasta el estallido de la segunda gran crisis de la moneda menuda barcelonesa (1556).
The thesis sets new models of coinage in Catalonia of the fourteenth to sixteenth centuries, from the study of minor currency issued by local councils and its relation to the main general currency issued in Barcelona. New hypotheses are proposed about the alleged continuity of these local emissions over time, about the identification of the coin types, and about its causes and origins, which must be located in Lleida shortly before 1300. The study focuses on three distinct periods. The first covers the “jaquesa” (aragonese) currency circulation area in Catalonia between 1298 and 1350, with some exceptions that lasts until 1460. The second period begins with the War against John II (1462) and continues until the currency reform of 1494. The third period, of lower intensity, starts from the first crisis of the reformed coinage in Barcelona (1508) until the outbreak of the second great crisis of minor coins in Catalonia (1556).

The aim of the present PhD dissertation is to answer who these readers were, which social stratum did they belong to, which were the links that can be traced, which were their interests, which books did they have and for what purpose did they use them, where did these works come from, in which milieus did the readers meet to talk about literature, etc. The ultimate reason to answer these questions is the firm conviction that a romance like the anonymous Curial e Güelfa, which indulges in signaling out the readings on which the fictional narrative is based, can be addressed to potential readers beyond courtly circles who might become such readers because of the affinity of their readings.

This is the most frequent typology it can be found among the documentation studied and also the one who shows the real situation of the men and women who lived in Cubells during the Late Middle Ages. The appendices include: transcription of significant documents; a small study of the important artistic treasure of this small village, nowadays disperse; and Indexes of toponyms and antroponyms.

Повний текст джерелаThis research focuses on the Catalan witch-hunt, from its origins during the Late Middle Ages until its development during the Early Modern period. The research provides, in the first place, a considerable amount of unpublished witchcraft trials form the XVth and XVIth centuries, which becomes the basic ground for a global approach to this historical phenomenon. Through this material, together with the sources already known, we have structured the analysis around three main axes. First, we address the elements that formed the witch stereotype during the Late Middle Ages. Next, we study the firsts witch-hunts developed in Catalonia during the first decades of the fifteenth century, by also comparing them with other contemporary European sources. Finally, we analyze in detail the unpublished trials in the aim of understanding the articulation of the witch-hunts in Catalonia during the fifteenth and sixteenth centuries. The results of this work include the creation of a first documentary corpus for the first two-hundred years of witch-hunts in Catalonia, thus revealing the abundance of sources in the Principality for the study of this phenomenon. Also, the work provides some conclusions about the origins and the development of this phenomenon in medieval and modern Catalonia. First, we emphasize the importance of the changes operated at the end of the Late Middle Ages, concerning both theology and the new demonological debates, as well as the inquisitorial action against maleficium and its influence on secular courts, or the anti-superstitious discourse deployed by Late Medieval preachers. Second, this research also proves the precocity, intensity and harshness of the witch persecution in Catalonia, a fact that stresses the Catalan uniqueness in the context of the Hispanic kingdoms. This situation of the Principality is due to its own political and judiciary status, with a strong autonomy of local authorities and a lack of control by centralized judiciary institutions, either the Inquisition or the Royal justice. On that sense, Catalonia follows the model described by authors such as Brian P. Levack, according to which those areas with a strong central government and a centralized judicial system, would have experienced a very low intense persecution, and an almost total lack of death sentences. A model which is perfectly valid for the highly centralized and almost witch-free kingdom of Castile, and also, only in the opposite way, for the jurisdictionally fragmented and full of gallows Principality of Catalonia. Finally, the last conclusion resulting from this research points to the importance of the local context in the development of the witch-hunt, with a prominent role played by local authorities, often spurred by the population itself. This observations moves us away from traditional historiographical conceptions that linked the persecutions with the State mechanisms or the post-Tridentine Church, both faced with an alleged popular culture. Instead, in the Catalan case, prosecutions would be mostly instigated by the people in a context of disasters such as epidemics, bad weather and deaths of children or cattle. A persecution, then, that appears to be bottom-up, initiated among the communities from accusations of maleficium or poisoning and then articulated in the context of the local courts, with a clear subversion of the legal order, a current use of torture and an acute predisposition to issue death sentences.

Повний текст джерелаThe hieronymites were a monastic movement, with an eremitic origin, that was born in the kingdom of Valencia in 1374 and arrived in Catalonia at the end of fourteenth century with the foundation, by queen Violant de Bar, of the monastery of Sant Jeroni de la Vall d’Hebron (1393), in Sant Genís dels Agudells, near Barcelona, which was followed by Sant Jeroni de Montolivet, founded by the merchant of Barcelona Bertran Nicolau. This second monastery moved to Badalona in 1416 and became Sant Jeroni de la Murtra. Both monasteries and their communities remained until 1835. The aim of this research is a global study of these two monasteries from their respective foundations until 1500. It is based on diverse documentary sources: the documentation conserved of the ancient monastic archives (parchments, administration and management books, inventories, etc.), notarial, royal and municipal documentation, etc. This work has three fundamental blocks that cover all areas: community, activity and relationships with the outside. This last chapter has been subdivided into four main sections that focus on the interaction with benefactors, economic sources, Church and political power. After these three main chapters, there is a study of the two monastic buildings and their construction process. Finally, a periodization of the establishment of the hieronymites in Catalonia is proposed in four main stages. This study closes with and appendix that contains 52 documentary tables, the complete transcription of 128 documents and a collection of 72 pictures.

Повний текст джерелаDuring the Courts of Barcelona (1412-1413), presided successively by Ferdinand I and the Prince Alfonse, a Constitution was approved, entitled “Per tal que les leys”, that prescribed that the majority of the juridical corpus of Catalonia, basically Constitutions and “Capitula Curiae”, were collected in Latin and in its Catalan translation (besides some exceptions in reverse). The distribution of this collection followed the titles of the first ten books of the Justinian’s Code. The project, known as Compilation, was initiated by jurists such important as Bonanat Pere and Jaume Callís, i.e. the first commission elected by Ferdinand I; and it was continued by Francesc Basset and Narcís de Sant Dionís, selected a posteriori by the “Diputació del General”. However, this collection partially failed. Two volumes in parchment were designed, one in Latin and another in Catalan, to be located in the Royal Archive, and two copies, to be guarded by the “Diputació”. Nevertheless, only three copies in parchment are preserved in the present Archive of the Crown of Aragon that could be identified with those ones. One of the Catalan copies is still lost. The jurist Narcís de Sant Dionís wrote a Latin brief treatise .named Compendium by himself. that could be useful as a handbook to the specialists, structured like the Justinian’s Code. We still have a translation to Catalan, probably by the same Sant Dionís. The Compendium is a short handbook that surpasses the Compilation, because it quotes a higher number of laws since it only presents summaries of the legal dispositions. The Edition of the three Latin manuscripts that contain the work of Sant Dionís is the main object of the present thesis. In front of the Latin Edition, it is provided the transcription of one copy of the Catalan version, the manuscript 1 of the “Generalitat”, in the Archive of the Crown of Aragon. An introductory study about the biography of Sant Dionís intends to clarify his genealogy. The formation of the Compilation is also evaluated. The thesis finishes with tables that identify the legislative dispositions contained in the Compendium.

Повний текст джерелаThe present doctoral thesis aims to analyze the effects of taxation on the society of a city in Late Medieval Catalonia, specially with regard to the making of consolidated local elites. The selected case study is Girona and it focuses on the period between 1345 and 1445. Once the historiography about this subject reviewed, this project is divided into two main sections. The first one is devoted to reconstruct the platform in which the presumed elites acted. In so doing, it describes the driving forces (fiscal pressure, communal needs, debt and economic policies) for the consolidation and the evolution of the local administration in Girona during the indicated period. It also pays attention to its institutional framework from the viewpoint of people interacting with it. The second section of this research deals with a prosopography of the leading characters of the mentioned system. To begin with, it identifies the people who participated in the local government and held offices. Secondly, it characterizes those managing the local treasury as chamberlains or syndics in economic operations for the benefit of the community. Finally, it examines people who took part in the fiscal and financial business connected with the municipal treasury (credit, indirect tax leasing, financial services and product supplying). On the whole, this thesis seeks to shed light (so to confirm hypothesis as well as to refine other aspects) on the existence, in the principality of Catalonia during the 14th and 15th centuries, of local elites whose political and economic foundations rested in large part on the municipal institutions.

Повний текст джерелаThis PhD thesis analyses the cathedral chapter of Barcelona and its members at the end of the 15th century. This institution proves to be a major urban actor. Beyond their religious powers, bishops and canons proved to be closely involved in the history of Barcelona. Their functions grant them lands, which turn them into important landlords in the city and its surroundings. The canonicate gives them access to the "ecclesiastical arm" of the Crown of Aragon’s political institutions such as the Diputació del General de Catalunya and the Corts. Their social origins integrate them into the networks of personal relations that structure the urban oligarchy: they are fully part of the ruling elite of Barcelona and they occupy a very specific place there, because of their belonging to the Church. This situation places them at the junction of power networks, sometimes antagonistic and sometimes allied: those of the Church, those of the municipal political elite, and those of the family groups constituting the oligarchy. At the end of the Catalan Civil War of 1462-1472, Barcelona, main city of Catalonia, undergoes profound socio-political transformations: an official list of the patricians is established, the municipal government opens to the nobility and undertakes several economic recovery measures after the disturbances caused by the war. The study shows that the cathedral chapter, fully integrated with the ruling elite of the city, has to play a real role in the public life of the city during this period

Повний текст джерелаThe Liber diversarum artium, second copy of a treatise on artistic technology probably written in the 1350s, is held at the Inter-university Library of Medicine of Montpellier, in a fifteenth century manuscript, Ms H277 (1470). The innovative structure of this text, the pre-1300s sources it draws on, and their dissemination, enabled us to compare it with works painted on wood and walls in the twelfth and thirteenth centuries preserved in Catalonia, as with any other coherent corpus. By virtue of the "historical" territory it covers in the Middle Ages, the number of works conserved and their wide aesthetic and technical variety, Catalonia provided this coherence. The selected paintings were considered from the perspective of materiality. The methodology developed for the task was structured as a constant dialectic between written and theoretical knowledge contained in the Liber or other treatises, and the practical knowledge applied by painters in Catalonia in the Romanesque period. Macroscopic observation of the works, the collection of physicochemical data concerning some of them, and our own experience, provided us with material that was conducive to understanding the painter's craft. This comparison produced a singular reading, in which thinking is focused on the painter in the learning and the exercise of his craft

Повний текст джерелаLa importància dels mals usos, és a dir, aquells pagaments que gravaven als serfs pel fet de ser-ho, a la Catalunya de la baixa edat mitjana és una qüestió fora de discussió. Bona part dels historiadors -Hinojosa, Vicens Vives, Freedman, etc.- atribueixen als mals usos, als homenatges i a la seva continuada exigència els dos alçaments remences contra les senyories feudals a partir de l'any 1462. Segons aquestes hipòtesis, la lluita per suprimir els mals usos i aconseguir la llibertat individual és la raó de les guerres remences de finals del segle XV. Com és sabut van quedar resoltes amb la Sentència Arbitral de Guadalupe, dictada pel rei Ferran II, que va suprimir definitivament la servitud de les terres catalanes.
Malgrat la importància que els historiadors han concedit a l'existència dels mals usos i, sobretot, a la manca de llibertat dels remences, no hi ha estudis sistemàtics sobre la seva aplicació a la pràctica. Per això, l'objectiu d'aquesta tesi és estudiar tots els mals usos i tots els homenatges aplicats i rebuts per una sola senyoria -l'Almoina del Pa de la Seu de Girona-, els remences de la qual van participar activament en ambdues guerres i que és representativa, sense cap mena de dubte, del que succeïa en la diòcesi gironina. A més a més, cal assenyalar que l'estudi comprèn un període de temps que inclou circumstàncies tan cabdals com la pesta negra i la resta de catàstrofes del segle XIV i el segle XV fins a la primera guerra remença.
Com és sabut, els remences catalans estaven sotmesos a sis mals usos: la redempció de persones (mitjançant la qual aconseguien la seva llibertat), les firmes d'espoli forçades (que havien de pagar quan es casaven en determinades circumstàncies), la intèstia i l'eixòrquia (que gravaven la mort intestada i sense descendents), l'àrsia (que penalitzava la crema accidental del mas o la masada) i la cugúcia (exigida a les dones considerades adúlteres). Els remences confirmaven la seva dependència d'una senyoria en els corresponents homenatges o reconeixements de domini que havien de prestar quan n'eren requerits.
Aquesta tesi consta de deu capítols a més d'una introducció (o primer capítol) i d'unes conclusions. El segon capítol és dedicat a la descripció de les fonts utilitzades, entre les que destaquen els llibres de comptes dels pabordes, i on queda prou palesa la importància del fet d'haver pogut disposar d'una excepcional font seriada, a més a més de pergamins. El tercer correspon a l'estudi de la institució tractada, que tenia terres a les actuals comarques del Gironès, La Selva, l'Alt i el Baix Empordà i el Pla de l'Estany. En el quart capítol hi analitzo els problemes generats a l'hora d' intentar conèixer el nombre de persones que eren pròpies de l'Almoina i saber de quins masos provenien.
A continuació segueixen els quatre capítols que constitueixen el cos central de la tesi. Al seu torn, la seva anàlisi va ocasionar l'elaboració dels tres darrers. En el capítol cinquè s'estudien tots els homenatges rebuts per l'Almoina entre els anys 1300 i 1457, tant els que figuren en els manuals de comptes com els conservats en pergamí. En total, tenim documentats 1258 dels homenatges o reconeixements de domini rebuts per la institució. El capítol següent és dedicat a l'estudi de les firmes d'espoli forçades i als 424 cobraments fets per l'Almoina per aquest concepte, entre els anys 1331 i 1452. En els capítols setè i vuitè, s'analitzen els mals usos que gravaven les sortides del domini, tant les voluntàries com les involuntàries. El resultat obtingut és que entre 1331 i 1458, la institució va concedir la llibertat a 557 persones bona part de les quals van tornar a adscriure's de nou a una altra senyoria. El nombre d'aquests sortides contrasta amb el cobrament per part de l'Almoina, entre aquestes mateixes dates, de només 105 intèsties i eixòrquies; dit d'una altra manera, fins l'any 1445 va ingressar diners en concepte de 23 intèsties, fins el 1458 per 68 eixòrquies i fins el 1406 per 14 intèsties i/o eixòrquies. Els capítols 9 i 10 tracten del significat i les limitacions que comportaven els mals usos, com a trets definitoris de la pertinença a la servitud, sobre les persones que hi estaven sotmeses. Finalment, el darrer capítol analitza el compliment de la sentència dictada pel rei Alfons el Magnànim l'any 1457 en la que suspenia la servitud al Principat de Catalunya. Queda fora de dubte que pocs anys abans de la primera guerra remença els homenatges i els mals usos havien deixat d'aplicar-se.
The aim of ths thesis is to study the real functioning of the mediaeval Catalan servitude. To accomplish this purpose, the servile homages and the bad customs' payments received and applied by the Almoina of the Cathedral of Girona from his remences (servile persons) are studied in depth. Theses homages had place along XIV and XV centuries and, more precisely, among 1331 and 1458, dates fixed by the documentation generated by that charitable institution, as the first account book preserved is from 1331. In these accounts books the Almoina's provosts consigned all its incomes and all its expenses. The final date has also been fixed by the documentation, because from that year on we don't have any more written evidences of bad customs' payments and of homages.
The importance of the bad customs -that is to say, those payments that the remences had to pay just because they were serfs- in the mediaeval Catalonia is a question out of argument. Most historians - such as Hinojosa, Vicens Vives, Freedman, etc.- attribute to the bad customs, to the servile homage and to its continued demand both remença uprisings against the feudal lordships from 1462 on. According to these hypotheses, the fight to suppress the bad customs and to achieve the individual freedom is the reason of the remença wars at the end of the 15th century. How it is well known, the Sentència Arbitral de Guadalupe, pronounced by the king Ferran II, suppressed definitively the servitude in Catalonia.
In spite of the importance that historians have granted to the bad customs and, especially, to the lack of freedom of the remences, there are not studies about its real application. That's why it was so important to study -not theoretically but with real data- all the bad customs and all the servile homages applied and received by one only lordship: the Almoina of the Cathedral of Girona, whose remences participated actively in both wars and that is representative, with no doubt, of what happened in the diocese of Gerona. Besides, it is necessary to point out that the study includes a period of time that contains circumstances such important as the Black Death and the rest of 14th and 15th centuries' catastrophes until the first remença war.
How it is known, the Catalan remences were subjected to six bad customs: the redemption of persons (through which they achieved their personal freedom), the firma d'espoli forçada (payment in return for the lord's guarantee of nuptial agreements over dowry and marriage portion), the intèstia (the lord's right to a substantial part of the movables left by a peasant householder who died intestate), the eixòrquia (a levy in the event of death without direct legitimate heirs), the àrsia (a fine resulting from the deliberate or accidental burning of a peasant's house or other property) and the cugúcia (the confiscation of a portion of a peasant's property by reason of his wife's adultery). The remences confirmed their lordship' dependence in a servile homage or dominium recognitionis that they had to do when were required.
This thesis is organized in ten chapters, an introduction (or first chapter) and the conclusions. The second chapter is devoted to the description of the sources used, among those highlight the annual accounts books of the provosts besides the parchments. The third chapter studies the Almoina institution, which had properties in the current regions of Gironès, Selva, Alt and Baix Empordà and Pla de l'Estany. In the fourth chapter, data problems are analyzed; problems that came when trying to know the exact amount of people, or the exact number of persons bounded to the Almoina and from which manses they came.
The next four chapters constitute the main part of the thesis. In turn, its analysis brought the need of writing the three last ones. In the fifth chapter I study all the servile homages received by the Almoina between 1300 and 1457, those that appear in the account books as well as the ones preserved in parchment. In total, we have data of 1258 homages or dominium recognitionis received by the institution. The following chapter is devoted to the study of the firmes d'espoli forçades and to the 424 payments collected by the Almoina by this concept, between 1331 and 1452. In the seventh and eighth chapters , I analyze the bad customs required to the exits of the lordship, the volunteers as well as the involuntary ones. The obtained result is that among 1331 and 1458, the institution granted the freedom to 557 persons; surprisingly, most of them bounded again to another lordship. The amount of these exits contrasts with the payment to the same lordship during these same dates, for only 105 intèsties and eixòrquies. In other words, until 1445 the provost charged by 23 intèsties, until 1458 by 68 eixòrquies and until 1406 by 14 intèsties and/or eixòrquies Chapters 9 and 10 are about the meaning and the limitations that entailed the bad customs, as features of the belonging to the servitude, over the persons who were bounded to a lordship. Finally, the last chapter analyzes the fulfillment of the sentence dictated by the king Alfons el Magnànim in 1457, where suspended the servitude in Catalonia. There is no doubt that few years before the first remença war the servile homages and the bad customs were not required any more.

Повний текст джерелаThe llotges are architectural structures of a Mediterranean origin, and they first appeared under this name in Catalonia at the end of the 13th century. As their Mediterranean counterparts, the llotges were porticoed structures, they usually had a public character, and the attention that was often paid to their construction and ornamentation bears witness to their official status. From a structural point of view, the term’s meaning was quite close to that of the traditional Catalan word porxo. As a consequence, the term llotja soon started to be used as a synonym for porxo, regardless of the structure’s specific function and decorative characteristics. At the end of the 14th century, a very significant evolution in the architectural and functional meanings of the word llotja took place in Barcelona: the city rulers promoted a llotja specifically conceived as a meeting place for merchants and as the seat of the city’s commercial institutions. It was not simply a porticoed structure, but a monumental public building. The architect Pere Arús (formerly known as Pere Arvei) was involved in the first constructive stages of this new Barcelona llotja, and he found inspiration and points of reference in the local architecture of power. In the fifteenth century, Marc Safont was responsible for some significant additions to the building, addressed to making visible the role played by trade in the city’s economy at a time of political conflict and economic struggle. The Barcelona llotja was the origin of a new type of monumental buildings, the llotges de mercaders. A few years after the Barcelona llotja had been started, one was built in Perpignan too. While it did not follow the Barcelona model exactly, it still was a monumental public Building, based on the architecture of existing official buildings. In the 15th century, architects Guillem Sagrera and Pere Compte took the basic features of the Barcelona llotja and lead them to a new architectural level.

Повний текст джерелаThe thesis consists of a new critical edition of the eight songs of the Catalan troubadour Pons de la Guardia. First, the edition opens with a brief status quaestionis that summarizes the previous bibliography on the troubadour. Secondly, in an introductory study, I presented the characteristics of the poet’s manuscript tradition illustrating the eight manuscripts (CEJNRSVa) who collect his poems and commenting on material data. It emerged that the tradition of the troubadour is entirely situated in the so-called tradition y, defined by Avalle, and documents its relations with Catalan sources. I then dealt with the attribution’s problems, distinguishing the texts with unambiguous attribution from those controversial. I dedicated a chapter to the biography of the poet and to the reconstruction of the historical and literary context in which he moved. An in-depth archive research enabled me to find a new document attesting the troubadour. The profile of the poet-knight that emerges from my reconstruction illuminates a dense network of different socio-cultural problems. As for Pons’s poetic culture, he places himself fully in the line of the trobar leu and, as a result of the punctual analysis of the songs in which numerous echoes of Bernart de Ventadorn appear, we can say that the latter was assumed by the Catalan Pons as a stylistic paradigm in order to address an Occitan public. As for the language, Pons, although he was a Catalan native speaker, proves to master the literary language properly. Only a few cases of rhyming Catalanisms are noted where the different results of tonic vocalism cause errors of versification that reveal the poet’s Catalan linguistic homeland. A complete glossary closes the edition with indication of the grammatical categories to which each term belong.
