The objective of this thesis is to analyze the conflicts and resistances caused by the expansion of the oil frontier in the territory of the Kichwa, Waorani peoples and the Tagaeri and Taromenane isolation groups of the Yasuní National Park (northeast of the Ecuadorian Amazon). Since 2008, these peoples have been confronted with a paradoxical situation. On the one hand, the inscription in the Ecuadorian Constitution (2008), of the rights of the Indigenous Peoples, of the rights of the Nature as well as of the Sumak Kawsay or Buen Vivir, materializes the indigenous demands of the 90s for the defense of their identities and their territories; On the other hand, within the framework of the extractivist development model, the Ecuadorian State multiplies the policies favorable to oil exploitation, annulling the constitutional advances and giving rise to the reactivation of numerous socio-environmental conflicts. For 40 years, the implementation of different oil projects has drastically transformed the living conditions of the Kichwa and the Waorani of Yasuní. However, these projects have not been exempted from responses and resistances from the communities, who, resorting to historical memory and the traumas caused by extractivism, have managed to raise their voice and negotiate the terms and conditions of oil exploitation, creating at the same time spaces of participation and expression of their opinions. This thesis will show how the Kichwa and the Waorani of the Yasuní feel and think today the territory, the identity, the development and how, through the appropriation of elements of the environmental discourse and the rights that concern them, they redefine their notions of Buen Vivir and its collective and community forms of organization to deal with extractivism

The respect of aboriginal peoples’ rights over their ancestral territory poses serious challenges for jurists. The challenge is best met by the conclusion of treaties. In Canada, this practice is hindered by the policy of “exchanging” vague rights for clearly defined ones. This policy affronts the aboriginal negotiating party, for whom the process should instead focus on the full recognition of aboriginal rights. The problem is a paradox for the jurist until a historical perspective coupled with a critique of legal thought shows how it results from the encounter between two different conceptions; not only of “aboriginal rights”, but of the very idea of “law”. This encounter is one between legal monism and legal pluralism. Even then, the jurist may feel ill-equipped to address the normative significance of the progressive recognition of the aboriginal juridical order by Canadian and supranational law. The defunct Innu Land Claims Agreement-in-Principle recognized ancestral rights as an expression of aboriginal identity. The Royal Commission on Aboriginal Peoples made “mutual recognition” the touchstone of its recommendations. The centrality of this theme of the “struggle for recognition” suggests that philosophy may provide much-needed guidance. Liberal multiculturalism and the politics of recognition authorize us to pose the hypothesis of a double struggle: for the legal protection of aboriginal legal cultures and for the presumption of their value. Yet, contrary to Charles Taylor, it was not multiculturalism that Axel Honneth had in mind when, at about the same time, he undertook the systematic reactualisation of what passes for a hegelian theme. This thesis presents itself as a philosophical inquiry into a legal problem. It also is a more general inquiry into the relevance of philosophy for the elucidation of legal problems.

This thesis seeks to account for the responses that the Noongar Aborigines from the South West of Western Australia display to the discourses of "tradition" and "modernity" that are built within institutions and by state actors, with whom they interact and to which they are in turn confronted. The study of these discourses, the conditions of their production and their effects makes it possible to consider the concepts of “tradition” and “modernity” as means of action and social techniques mobilised to eliminate cultural difference in the implementation of a “common becoming”.The Australian state produces its own antagonistic definitions of “tradition” and “modernity”, categories thought to be mutually exclusive. In some contexts, Noongars are expected to be “traditional”, while in others they must be “modern”. The Noongars are thus caught in a contradiction: they tend towards “modernity” to remain “traditional” and, conversely, they are kept in their “traditions” when they have to show “modernity”. In their various attempts to integrate into the Australian nation, while retaining their specificities, the Noongars are redefining their “cultural identity”. For this, they appropriate, challenge, negotiate the image of the Aboriginality presented to them and shape their own contemporary identity, without radically opposing the national myth of Aboriginality.By analysing the various processes by which the Noongar Aborigines claim their recognition and attempt to acquire a degree of sovereignty within a nation-state, this thesis enriches reflections on Indigeneity as a political and contingent category. It is about addressing indigenous issues as discursive realities that need to be analysed in the particular ethnographic contexts in which they are produced and articulated

The starting point of this research seeks to decolonize educational, pedagogical and research highlighting alternative epistemologies and modes of existence, based on experiences from the South. Decolonizing is understood as an epistemological shift that unties hegemonic colonial patterns of Western modernity. Patterns that inhabit our ways to the world and thus are present within all educational spaces. …/…The research focuses on decolonial pedagogical practices of Abya Yala. These are understood within the plurality of pedagogical expressions that arise from struggles against colonialism and globalized capitalism. They appear to be an exploratory path in order to overcome numerous limitations often set within the frames of forms of critical pedagogy such as French popular education, which is rooted in the legacy of eurocentrism. …/…The purpose of the research to connect experiences of land recuperation and Nasa community education in the Cauca region in Colombia, with voices of educators and activists of colonized descent in France. …/…The first part of the manuscript aims to develop a critical reading of academic coloniality within research practices and calls for decolonial forms of research. The second part develops a re-reading of the history of the colonized and their struggles, intertwined with the history of French popular education, revealing the whiteness of the latter and the silencing processes to which the former are subjugated. The third and last part, mainly based on practical experiences, highlights shifting points in the thinking of education and pedagogy from a décolonial perspective

Guatemala is not the largest country in Central America, but it is the most populous. Its main characteristic, besides its particularly mountainous relief, is its social structure, marked by a high rate of native population: about 60%. This country, like El Salvador or Nicaragua, is mainly known for the armed conflict that took place on its territory between 1960 and 1996. But unlike the Nicaraguan Frente Sandinista de Liberación Nacional (FSLN) and the Salvadoran Frente Farabundo Martí de Liberación Nacional (FSLN), the Unidad Revolucionaria Nacional Guatemalteca (URNG) failed. Our study concerns the reasons for this failure, and focuses on internal tensions and struggles for power guerrilla warfare and its relationship with indigenous peoples during the conflict. Our work provides an analysis of the inner workings of the guerrillas, based on testimonies collected by us, commanders and senior cadres of armed organizations

Climate change and the disruption it implies in the Arctic have really renewed the interest in this space. This raises issues of different scales (both regional and global), but also of different natures (economic, political, social, environmental), which constitute as many legal issues and question the relevance of the applicable law. However, and this is the main legal issue here: the existing legal framework is extremely complex, whose consistency and relevance concerning the region have been widely questioned. But to this unique problem - com-plexity - the authors do not seem to agree on the solutions to adopt. These differences underline the interest to determine whether the legal framework for the Arctic Ocean can be considered as "adequate" in the sense that it would enable a management that meets the criteria of a satisfying legal system. Regarding the method, the study demanded to put the apparent disorder in order. To this end, systematization was necessary; it was done through the creation of a synoptic table analyzing all the standards of international law applicable to the region,. In conclusion, despite its diversity, the legal framework can nevertheless be considered satisfactory from a substantive (completeness) and formal (coherence) point of view. Beyond simple coherence, the current cons-truction of an Arctic law leads to the identification of an scheduling process at the regional level, this framework resembling more and more a real "legal system". This regionalisation is legally essential. Nevertheless, it must be recognized that it does not ensure the worldwide action which remains essential in the face of the global problem that is climate change. If it constitutes a probably necessary step, it represents above all an additional step in this generalized implementation and therefore reinforces the fragmentation of international law, and its complexity
