In this thesis I argue that there are qualities of literary writing which can illuminate human rights discourse and, specifically, its limit points. I focus on one such limit-point: the difficulty of fully possessing human rights. Rights are most likely to be securely guaranteed under the legal system of a nation-state. However, such rights – possessed on the basis of citizenship rather than through humanness – are not always considered human rights. The position of the nation-state, the possibility of legal enforcement and the category of the human are therefore ambiguities for the discourse. Literary texts from two countries which have been central to debates about human rights – Uganda and South Africa – will provide the focus for this study. Joseph Slaughter proposes that the plot of the Bildungsroman both resembles and promulgates the citizenship model of human rights-possession. However, in texts addressing the involvement of children in war in Uganda, I read experiments with the Bildungsroman form to indicate human rights discourse’s preoccupation with merely human identity. Child soldier narratives appeal to a decontextualized, universal image of the child, while in the fiction of Goretti Kyomuhendo there is an excessive repetition of familial language and symbol which throws the traditional narrative arc of the Bildungsroman off course. Critics including Slaughter see literature as compensating for the ambivalence of human rights discourse about the possibility of its own enforcement through the law. Instead, I explore the ways in which certain texts, in the context of South Africa, enact their own irreducibility to legal categories. I make this argument through a discussion of the way the literature and the literary appear in the Report of South Africa’s Truth and Reconciliation Commission alongside readings of Antjie Krog’s Begging to Be Black and Nadine Gordimer’s Burger’s Daughter and The House Gun.

This review is an attempt to analyze the published materials on precedent law of the European Court on Human Rights. The article analyzes the case law activity by the European Court on Human Rights, its influences on national legal systems. The precedent law of the European Court on Human Rights is one of the complicated issues, because there is not general theoretical view on it. The precedent law of the Court is developing and gains new features. The Court uses its previous consequences in previous decisions on a subsequent case as a precedent norm. The Court creates a case law system that influences legal reforms in national legal order.

Junot Diaz employs a variety of postmodernist literary strategies in The Brief Wondrous Life of Oscar Wao, such as conflating (and confusing) the role (and identity) of author and narrator, creating a parallel fictional (and semi-fictional) subtext in the form of numerous, often detailed footnotes, and incorporating a hybrid mixture of discourses throughout a self-referential, apparently self-undermining narrative. Yet by means of his persistent satirical tone, pervasive irony, occasional explicit commentary, and thematic inferences, Diaz simultaneously challenges the core tenets of postmodernist-poststructuralist theory. Diaz's creative concerns interrogate the notion of constructed histories, reestablish distinctions within binaries, and defy the poststructuralist prohibition against grand narratives, while contesting the postmodernist tendency toward moral and cultural relativism. Diaz appears to be consciously inviting a poststructuralist reading, even as he simultaneously undermines any possibility for such a theoretical analysis ever succeeding in fully coming to terms with his work. In effect, Diaz redirects the lens of the postmodernist-poststructuralist perspective back on itself, questioning its basic assumptions. Diaz creates a unique, innovative literary language in The Brief Wondrous Life of Oscar Wao, borrowing tropes from Dominican folklore and popular superstition, mixing in idioms and memes from sci-fi, horror, fantasy, Japanese animes and North American movies, television serials, comic books, hip-hop, and urban diction, in order to tell a story that reawakens repressed memories of historical trauma, and enhances awareness of egregious contemporary injustice. Diaz focuses on the devastating trajectory of the imperialist enterprise in the Western hemisphere since 1492, highlighting the rapacious ideology that ruthlessly engenders this ongoing project of exploitation, domination, and oppression. In setting private aggrandizement above collective wellbeing, the imperial mentality causes incalculable, completely unnecessary suffering, beginning with genocide against the native population, and extending into the extreme social disparities of the neoliberal present; the predatory practices of this avaricious agenda have become so destructive that they now threaten the very survival of the human species. Ruthless greed is the curse that afflicts us; the only possible counter spell that can save us will be a courageous return to instinctive solidarity, with timely recourse to the healing power of human love.

This analysis of apocalyptic rhetoric brings nine generations of the written text of the Johannine Apocalypse into a contemporary (1989-1994) framework which includes phenomena such as self-determination, mutual interdependence and psychoterror. The discussion is mediated by disciplines and backgrounds of Religion and Literature. The critical method is religio-literary. Literary themes from the Johannine Apocalypse, especially themes of annihilation, torment, blessedness and rapture, structure the discussion. These themes are related to ideas of self-determination such as were proclaimed at the United Nations World Conference on Human Rights (UNWCHR), Vienna, 1993. The discussion questions the axioms of self determination, especially the matter of indivisibility which came to issue during UNWCHR, Vienna, 1993. Some policies and practices of the Australian government's human rights activities are discussed. Attention is then redirected to the Johannine Apocalypse as a polyvalent source of apocalyptic ideation and a source of social empowerment.

This dissertation stands at the intersection between human rights, contemporary postcolonial literature, and medieval folkloric texts, specifically the One Thousand and One Nights, also known as the Nights, by an unknown author. The Nights was first translated to French by Antoine Galland, when it appeared as a series from 1704 to 1715. This was followed by subsequent English translations and other translations into many other languages. Today, the Nights continues to captivate the world’s literary imagination. The dissertation focuses on selected popular textual and visual human rights narratives published from 1994 to 2014. These narratives are by celebrated human rights artists and authors from different parts of the globe: they are both non-Western and Western, but all have spent a significant portion of their personal lives and careers preoccupied by rights and social justice issues, both locally and universally. I focus on the following texts: Dreams of Trespass: Tales of A Harem Girlhood (1994) by Moroccan author and feminist Fatima Mernissi; Women Without Men (2009) by the exiled Iranian artist and director Shirin Neshat; Women Without Men by exiled and celebrated Iranian novelist called Shahrnush Parispur; Habibi (2011) by novelist Craig Thompson; and The Dream of Shahrazad (2014) by Emmy-Award-winning South African documentary film maker/director François Verster. The varied texts tackle human rights issues such as colonization, wars, human trafficking, rape, violence, torture, women’s subjection, environmental justice; freedom of speech and movement; forms of classism; and racism. I attempt to explore how and why these works are employing the Nights’ narrative model, as well as its formal and aesthetic aspects, to enable modern human rights narratives. While the direct connection to the Nights is obvious, I also trace obscure references to the Nights’ stories, genres, and themes. I focus on how “The Story of King Shahryar and Shahrazad” and its plot about storytelling to heal and save lives interplays with a modern sense of rights issues such as violence, genocide, trauma, healing, and legal appeals for justice. I offer a reading of the Nights’ stories referenced in each work to theorize why human rights artists and authors include them directly or obscurely within their narratives. I conclude that these stories from the Nights were chosen for their themes of social justice, discrimination, trauma, torture, judicial discourse, and feminist empowerment. I also conclude that contemporary human rights artists and authors incorporate elements from the Nights in intertextual ways that enable them to construct currently applicable allegories of human rights advocacy.

The right to health is perceived by most as a matter of course and a right. In my study, I have examined that right with the help of the UN Declaration of Human Rights, which clearly highlights the equal value of human beings, that rights should apply to everyone and that no one should be discriminated against. The purpose of the study was to investigate whether the right to health is a human right regardless of background. The study was a systematic literature study. Five articles were included in the sample and analyzed with qualitative content analysis. The results show that there are societal and individual factors that govern the right to health. It is not a matter of course, nor is it an absolute right. Inequality is a fact, socioeconomics, education, and ethnicity have a major impact on health, and who has access to good health care. Social factors are important and play an important role, eg: allocation of resources, priorities, etc. The conclusion is: The right to health is governed by who you are and where you live and the governments responsible for the UN Declaration of Human Rights fail a large group in society.
Rätten till hälsa uppfattas av de flesta som en självklarhet och en rättighet. I min studie har jag undersökt den rättigheten med hjälp av FN:s deklaration om de mänskliga rättigheterna som belyser tydligt människans lika värde, att rättigheterna skall gälla alla och att ingen får diskrimineras. Syftet med studien var att undersöka om rätten till hälsa är en mänsklig rättighet oavsett bakgrund. Studien genomfördes som en systematisk litteraturstudie. Fem artiklar ingick i urvalet och analyserades med kvalitativ innehållsanalys. Resultatet visar att det finns samhälleliga och individuella faktorer som styr rätten till hälsa. Det är inte en självklarhet och inte heller en absolut rättighet. Ojämlikhet är ett faktum och socioekonomi, utbildning, och etnicitet har stor påverkan på hälsan och vem som har tillgång till god vård. Samhälleliga faktorer är betydelsefulla och spelar en viktig roll, ex: tilldelning av resurser, prioriteringar etc. Slutsatsen blir: Rätten till hälsa styrs av vem du är och var du bor och regeringarna, som är ansvariga för tillämpningen av FN:s deklaration om de mänskliga rättigheterna, sviker en stor grupp i samhället

Partindo de uma perspectiva lingüística de análise do discurso, esta pesquisa investiga a situação dos direitos humanos no Brasil, focalizando os direitos da mulher, em relação à discriminação de gênero e à violência doméstica. Documentos descritivos e normativos do assunto foram publicados por instituições governamentais internacionais e nacionais e também por instituições não-governamentais como movimentos feministas. Entretanto, poucos estudos foram realizados para investigar esses documentos e desvendar as realidades representadas. Considerando o exposto, analiso um dos capítulos do 'Relatório da Situação dos Direitos Humanos no Brasil', elaborado em 1997 pela OEA, intitulado 'Os Direitos Humanos da Mulher no Brasil'. Desenvolvo esta pesquisa baseando meus objetivos na perspectiva do discurso de Fairclough e de Halliday, na qual as identidades e hierarquias sociais são criadas e mantidas através do discurso entre os membros da sociedade. Utilizo a teoria e método da Lingüística Sistêmica Funcional de Halliday para analisar os processos de transitividade que ocorrem no objeto de estudo, para obter as respostas às perguntas da pesquisa. Com este procedimento, a análise revela que as mulheres são representadas como vítimas das violações aos seus direitos humanos, assim como responsáveis por algumas dessas violações e, ao mesmo tempo, ocupam uma posição de submissão na sociedade. Esta pesquisa representa uma contribuição na busca de soluções que possam ajudar a atenuar o problema.

The primary aim of this master’s thesis has been to examine how the dystopian, young adult novel, The Hunger Games (2008) by Suzanne Collins could entail depictions of violations against the articles of the Universal Declaration of Human Rights (1948). The analysis has been conducted based on a theme-based close reading of the novel using the Universal Declaration of Human Rights as a contextualization device. In addition, the literary analysis has been divided into three sections, namely global, group and the individual perspectives of how incidents in the novel hypothetically violate the Universal Declaration of Human rights. The division was made in order to delineate the social perspective of how literature can amplify the understanding of human rights and societal issues. Furthermore, the secondary aim of this master’s thesis has been to discuss how upper secondary students, when using a critical literacy lens in the English as a Foreign Language classroom, may establish an awareness about other people’s living conditions and fundamental rights that are present in their immediate social vicinity and in this novel.

Modern Slavery is a complex type of crime. It may take many forms starting from the forced labor, servitude, sexual exploitation, organ harvesting, slavery, to trafficking and others. UK’s Modern Slavery Act, 2015 is undoubtedly an admirable effort to tackle such heinous crimes in the society however the act is criticized as weak regarding the victim support and wellbeing during and after the identification. All potential victims upon consent are referred at first by the first responders to National Referral Mechanism (NRM) process which is a UK framework adopted in 2009 in line with the council of Europe’s directives to identify & support victims of modern slavery. There are two separate guidance’s regarding the NRM process one is for England & Wales and the other is for Scotland & Northern Ireland. The aim of this literature review study is to explore the wellbeing status of the modern slavery victims during the post identification (NRM) period and how does the act support such victims. The study finds that it lacks a needs-based support system for victims that addresses issues like safe housing, advocacy, adequate so called “reflection and recovery” time period of support resulting in poor trust and confidence among the victim groups upon the authorities. Moreover, structural changes like amendments to the labor, immigration laws are required to make a long-term meaningful impact on the lives of the victims. At last the author provides some recommendations about the matters affecting the lives of the victims the most.

Al investigar este problema en el caso específico de Ecuador podemos ver algunos patrones que otros investigadores y políticos podrían aplicar en otros contextos de abusos laborales y trabajo infantil. En un mundo más consciente de los derechos humanos, es necesario impedir el trabajo infantil donde se pueda o por lo menos asegurar que los niños que trabajan lo hagan en la forma más sana y segura. En esta investigación se analizan las leyes y regulaciones de las últimas dos décadas, la implementación, y los efectos en las vidas de los niños trabajadores. La implementación de las leyes y regulaciones es mayormente analizada a través del papel de las inspecciones. Las entrevistas mencionadas en la investigación son realizadas por otros grupos pero muestran las experiencias de los niños. Usando reportes anuales de Ecuador, Estados Unidos, y organizaciones internacionales la investigación explora las varias razones por las cuales Ecuador no ha logrado eliminar el trabajo infantil. La investigación sugiere recomendaciones para realizar inspecciones más eficaces y hacer esfuerzos más impactantes en el campo de trabajo infantil. Ecuador ya lleva dos décadas de regulaciones e iniciativas dirigidas al trabajo infantil sin embargo no ha logrado erradicar este fenómeno. En fin el bienestar y protección de los derechos de los niños es lo que está siendo comprometido; por eso es urgente poder encontrar las soluciones que harán Ecuador el país exitoso en erradicar trabajo infantil.

OBJETIVO: Pretendeu-se, primeiramente, realizar uma proposta de ressignificação dos direitos humanos, interpretando a liberdade e a igualdade a partir da filosofia da existência, de uma forma sensível à essência existencial do homem; traduzindo, assim, a liberdade e a igualdade em autenticidade, cuidado e preocupação com o outro. Em um segundo momento, pretendeu-se analisar o papel da literatura enquanto forma de promoção dos direitos humanos, por sua capacidade formadora e de efetivação dos direitos humanos, permitindo a experiência da liberdade, da autenticidade e do reconhecimento na vida de cada um. MATERIAL E MÉTODOS: Trata-se de trabalho teórico em sentido estrito. O material corresponde a toda a bibliografia que foi percorrida utilizando-se primordialmente o método hermenêutico. Não se pretendeu exaurir o exame da bibliografia de algum autor específico, mas sim se buscou realizar uma abordagem seletiva dos autores e obras, na medida de sua contribuição para o tema e visão propostos. O tema proposto suscita uma abordagem interdisciplinar que muitas vezes encontra-se no limite entre os direitos humanos, a filosofia e a literatura. Por esse motivo, foi necessário percorrer a bibliografia de forma a propiciar uma conexão harmoniosa das idéias trazidas pelos textos, conexão esta que só é possível a partir de uma abordagem dialógica e criativa. Por conta disso, textos teóricos e literários puderam dialogar e se validarem mutuamente. CONCLUSÕES: Conclui-se que a literatura atua por meio de seu modo de ser como um acontecimento e uma experiência que se incorpora na existência dos escritores e leitores como forma: (i) de entendimento do mundo e formação da personalidade autêntica, bem como da ética humana; (ii) de discurso e de diálogo com o outro e com a tradição, através da fusão de horizontes e do compartilhamento de visões de mundo. GOAL: Firstly, this work intended to re-signify human rights, by interpreting freedom and equality from existentialism philosophy grounds, in a way that is sensitive to the existential essence of man; meaning that freedom and equality could be translated in authenticity and concern for others. Secondly, the present work intended to analyze the role of literature in promoting human rights, by its educational capacity, and of effecting these rights, by allowing the experience of freedom, authenticity and recognition into the life of those who come into contact with it. MATERIAL AND METHODS: The present work is strictly theoretical research. The material corresponds to the bibliography read principally under the hermeneutical method. We had no intention of going through the entire work of any specific author, but to accomplish a selective approach of the authors and their work, in terms of their contribution to the theme and perspective here adopted. The proposed theme raises an interdisciplinary approach which many times can find itself at the frontier between human rights, philosophy and literature. For this reason it has been necessary to examine the bibliography in a manner that allows a harmonious connection between the ideas brought by the texts, only possible by means of a creative and dialogical approach. Thus, theoretical and literary texts could dialogue and validate themselves mutually. CONCLUSIONS: We could conclude that literature acts by its way of being as an event and experience that is incorporated in the existence of writers and readers, as a way: (i) of understanding the world and building authentic personality and human ethics; (ii) of discourse and dialogue with another and with tradition, by the fusion of horizons and sharing of world views. Therefore, literature plays an important role in forming personality, ethics and the way of being of individuals, so that people are able to be-in- the-world and share it in an authentic manner, by allowing the comprehension and understanding of human rights in a familiar way, which makes sense in their existence.

In his 1974 novella The lost Honor of Katharina Blum Heinrich Böll argues for the constitutional guarantee of presumption of innocence. He states that this principle is violated when defamatory media headlines make unwarranted accusations against a private citizen destroying their reputation as part of a targeted smear campaign. The novella characterizes such intentional campaigns as both criminalizing and dehumanizing. Böll argues that the government should influence the press to conform to the limits implied in the institution of freedom of press. He shows the helplessness of a private citizen under attack from a smear campaign when the government takes a laissez-faire attitude toward sensationalized media. This thesis, "Neither citizen nor human: Prisoner of the media and the state: systematically linked dehumanization and radicalization: Two Interpretations of Heinrich Böll's: The Lost Honor of Katharina Blum," evaluates the sympathetic role that media and government play in the radicalization of the private citizen. This thesis establishes a direct relation between smear campaigns and radical or extremist behavior. This thesis shows that the victim of the media acts out erratically in a state of panic and terror brought on by feelings of helplessness. This thesis supports Boell's position that this erratic behavior leads to suicide or violence against perceived oppressors or others. This thesis argues for the habitualization of violence as a precise definition of the radicalization of the individual to violence. This thesis utilizes Böll's fictionalized account of Katharina Blum. This thesis makes comparisons between targeted smear campaigns in the BRD in the period 1967-1974, roughly the period of the Brandt Administration, and the case of Katharina Blum. This thesis demonstrates the systematically linked oppression of oppositional voices by the West German government with media-driven smear campaigns. Böll's essays on topics including human rights and the potential benefits of political radicals help inform this study. Böll's novella demonstrates the vulnerability of all citizens to victimization of the press. Boell shows that violent radical behavior results from smear campaigns against private citizens. Boell argues that this radicalization is clearly rooted in a sales-driven media sympathetic to the state's abuses of power.

No campo da prevenção ao HIV, a maior parte dos esforços se dedica as pessoas soronegativas que nos programas e pesquisas aparecem como sinônimo de todos. A noção de Prevenção Positiva produzida no âmbito da resposta brasileira , por outro lado, considerou que as PVHA também necessitam de cuidados preventivos únicos. A presente dissertação se propõe a examinar a produção científica que descreve intervenções de prevenção positiva, bem como as suas possíveis contribuições na resposta à epidemia de HIV/AIDS, analisadas na perspectiva informada pelo quadro das vulnerabilidades e dos direitos humanos, que possibilitou a produção de uma noção singular de prevenção positiva ao longo da 3a década de epidemia. Para tanto, utilizamos como método de pesquisa a revisão de escopo (scoping review) que permitiu sintetizar o conhecimento sobre intervenções de prevenção positiva disponibilizadas nas bases de dados escolhidas (CINAHL, ERIC, Lilacs, MedLine, PsycInf, Scopus, Web of Science e Google Acadêmico). Dos 700 artigos recuperados, foram selecionados 15 artigos, a partir dos critérios de busca. Entre outros achados, os estudos confirmaram o entendimento de que, historicamente, a prevenção do HIV se constituiu no campo sócio-comportamental. Não à toa, as intervenções centraram-se quase inteiramente na prevenção da transmissão do HIV e controle da epidemia, não no bem-estar das pessoas vivendo com HIV. Discutimos que as intervenções disponíveis na literatura, apesar da esperada inovação cunhada como prevenção positiva, sustentam a mesma prioridade de proteger as pessoas HIV negativas de serem infectadas por seus parceiros HIV positivos e perdem a oportunidade de inovar programas existentes, a partir do momento que não levam em conta os contextos diferentes de vulnerabilidade social e ação programática, que excluem os marcadores de [8] desigualdade (como classe ou gênero) e os projetos de cada pessoa vivendo com HIV na sua vida cotidiana e sua vulnerabilidade pessoal. Defendemos a maior produtividade de uma concepção que supere esse modelo que leva à culpabilização das PVHA e à sobreposição de estigmas que enfrentam, para fortalecer uma noção de prevenção solidária e compartilhada realizada em intervenções de prevenção positiva balizadas pela atenção integral à saúde e pela defesa e promoção dos direitos humanos das pessoas afetadas pela AIDS
In the HIV prevention field, most part of the emissions are dedicated as seronegative people that appear in programs and researches as synonymous of all. The notion of Positive Prevention produced within the scope of the Brazilian response, conversely, considered that PLWHA also need single preventive care. This thesis proposes to examine the scientific production that describes positive prevention interventions as well as their possible contributions for the response to HIV/AIDS epidemic, analyzed from an informed perspective by the vulnerability and human rights framework, which made possible the production of single notion about the positive prevention throughout the 3rd epidemics decade. For this purpose, was used as a research method, a scoping review that allowed synthesizing knowledge about positive prevention interventions available in the chosen databases (CINAHL, ERIC, Lilacs, MedLine, PsycInf, Scopus, Web of Science and Google Scholar). Of the 700 recovered articles, were selected 15 articles based on the search criteria. Among other discoveries, the studies confirmed the understanding that, historically, HIV prevention has been in the socio-behavorial field. Not by accident, the interventions focused almost entirely on preventing HIV transmissions and controlling the epidemic, not on the well-being of people living with HIV. Was discussed that interventions available in the literature, despite the expected innovation named as positive prevention, support the same priority in protecting HIV negative people from being infected by their HIV positive partners and miss the opportunity to innovate existing programs, from the moment that they dont consider the distinct contexts of social vulnerability and programmatic action that exclude markers of inequality (such as class or gender) and the projects of each person living with HIV in their daily lives and personal vulnerability. We defend the higher productivity of a conception that [10] overcome this model that blames the PLWHA and the overlapping of stigmas they face in order to strengthen the notion of solidarity and shared prevention carried out in interventions of positive prevention defined by integral health care and the defense and promotion of the Human Rights of people affected by AIDS

Das Beharren auf der nicht-Bestimmung des Menschenbildes oder auf dem Begriff ‚Gott’ in der Präambel des Deutschen Grundgesetzes, wie es sich in der Deutschen Dogmatik widerspiegelt, gepaart mit dem Bestreben nach einer Fall-zu-Fall ad hoc Konkretisierung dessen, was Menschenwürde bedeutet, inspiriert diese Untersuchung von ‚etwas fehlt’ [‘something missing’]. In postmoderner Art und Weise beschreibt diese Geschichte das Gesetz der Menschenwürde als Trojanisches Pferd und bietet hermeneutische und literarische Grundlagen für eine affirmative Haltung gegenüber einer ''leeren'' Rede im juristischen Diskurs. Die Forschungsfrage erweckt und umkreist die polemisch verbrämten Begriffe von ‚Leere’ und ‚Black Box’: Warum erscheint der Rechtsbegriff der Menschenwürde ‚leer’? Oder wie ist er ‚leer’? Warum und wie ist er eine ‚Black Box’? Wie erscheinen Manifestationen des Konzepts abstrakt wie Universalien, aber im Einzelnen konkret? Die ontologischen, sprachlich-analytischen und phänomenologischen philosophischen Erkenntnisse, vorgestellt im ersten Kapitel, bilden die Linse, durch die fünf maßgebliche Fälle des Bundesverfassungsgerichtes – über Abtreibung, lebenslange Freiheitsstrafe, Transsexualität, staatliche Reaktion auf Terroranschläge und die Gewährleistung eines menschenwürdigen Existenzminimums – im zweiten Kapitel analysiert werden. Die philosophischen Quellen werden nicht als Momente im langen Verlauf der Menschenwürde in der Geschichte der Ideen eingeklammert.
The philosophical underpinnings of what may be called the meta-dimension of the law of human dignity trigger a question that surpasses the boundaries of the discipline of law: how could the transcendental as an aspect of human dignity meaning be portrayed? The insistence on non-determination of the Menschenbild [human image] or ‘God’ in the Preamble to the German Basic Law [Grundgesetz] reflected in German legal doctrine, paired with the commitment to case-by-case ad hoc concretization of what human dignity means inspire this story of ‘something missing’. In postmodern fashion, this story portrays the law of human dignity as a Trojan Horse and provides hermeneutic and literary foundations for an affirmative stance towards ‘emptiness’ talk in legal discourse. The research question rekindles and twists polemically framed ‘emptiness’ and ‘black box’ contentions: Why does the legal concept of human dignity appear ‘empty’? Or, how is it ‘empty’? Why and how is it a ‘black box’? How do manifestations of the concept appear abstract as universals and concrete as particulars? The ontological, linguistic-analytical, and phenomenological philosophical insights presented in Chapter One compose the lens through which five benchmark Bundesverfassungsgericht cases – on abortion, life imprisonment, transsexuals, state response to terrorist attacks, and the guarantee of a dignified subsistence minimum – are analyzed in Chapter Two. The philosophical sources are not bracketed as moments in the long course of human dignity in the history of ideas.

Why did ASEAN agree a to a human rights regime? The 10 member countries launched the ASEAN Intergovernmental Commission on Human Rights in October 2009, a little less than a year after the ASEAN Charter was ratified, bestowing the organisation legal personality. Article 14 of the Charter provided for the establishment of a “human rights body”. These events transpired just over a decade after the Asian Values Debate reached its apogee in the mid 1990s, and over four decades after the founding of the organisation in 1967. The existing literature points to the plurality of actors in the regional campaign for human rights and power of norms on domestic change. This study looks deeply into the validity of the following hypothesis: ASEAN agreed to an international human rights regime because rights discourse was able to accommodate contradictory notions of human rights and the different social and political orders of the organisation, its member states, elite groups and civil society. The use of text and discourse gave rise to the admissibility of what would otherwise have been, or constantly branded as, a “Western liberal project”. My argument goes against the common observation that rhetoric can become a substitute for real change: one cannot say what one cannot do, one cannot write that which (almost always) one cannot commit to do. Social and political change does not happen without the representational and constitutional power of language. For this I draw up what I call the “language pendulum”. It is a model that explains the power of language and discourse in international politics. I use as a my case study the drafting process of the ASEAN Human Rights Declaration (a “bill of rights”) to illustrate how human rights norms are socialised in a variety of transactions through the use of discursive strategies.

This thesis examines how the displaced Sudanese in Egypt, Kenya, and the United Kingdom discuss the topic of "Human Rights". Whereas many studies on "Human Rights" are primarily concerned with the opinions of outsiders, an attempt is made here to provide an alternative perspective in that the focus of this dissertation is on how the displaced Sudanese, themselves, discuss "Human Rights" in view of their situation as exiles. The thesis begins by tracing the historical evolution of the 'Western' concept of "Human Rights" and investigating the historical relationship between Anthropology and "Human Rights". Attention is paid to the role of the doctrine of "cultural relativism" in the discipline of Anthropology. After briefly looking at Sudan's geographical and social makeup, I explain the difficulties I encountered as an independent scholar conducting research on "Human Rights" and Sudan. This is followed by descriptions of the fieldwork locations. What comes next is the heart and soul of the thesis. After giving brief descriptions of the interviewees, 1 analyse how the interviews were conducted and explain how the issue of "Politics" dominated practically every discussion with the interviewees. Next, excerpts from nineteen interviews are presented for the reader to get acquainted with the conversations between the Interviewees and myself. Finally, an examination is made of how "Human Rights" is employed as a manipulative device (or tool) by the interviewees. This is essentially the crux of the study. The chief aim of the thesis is to present various ways the notion of "Human Rights" can be (and is) interpreted and utilised by the displaced Sudanese in the context of their own circumstances as exiles.

After regaining its independence in 1990, Lithuania has demonstrated the will to establish the universal human rights standards in the country as soon as possible. However, taking into account the country’s policy in the later years of independence, it’s not clear whose interests – state of individual – are more important and how these concepts coexist in the framework of Lithuanian human rights policy. The aim of the research is to examine wherever state sovereignty and human rights are (in)compatible with each other in the policy-making context of Lithuanian human rights policy. Aiming to achieve the above mentioned aim the Lithuanian human rights policy-making context, factors affecting this policy, national legal basis on human rights, fourteen programmes of the Government through the prism of human rights are analyzed. In conducting the research the following research methods were used: documents and legal acts analysis, semi-structured interview, as well as comparative analysis. Empirical research data indicates that Lithuanian human rights policy could be described as fragmented, lacking integrity and balanced attention to all human rights; strongly expressed social economical dimension the other key feature of this policy. In the context of such policy the relation between the human rights and state sovereignty is rather mixed. Disertacijos tikslas – ištirti, ar valstybės suverenitetas ir žmogaus teisės yra (ne)suderinami vienas su kitu Lietuvos nacionalinės žmogaus teisių politikos formavimo kontekste. Siekiant užsibrėžto tikslo analizuojamas Lietuvos žmogaus teisių politikos formavimosi kontekstas, jį įtakojantys veiksniai, nacionalinė žmogaus teisių teisinė bazė, keturiolika Vyriausybės programų per žmogaus teisių prizmę. In the wake of the globalisation process and the subsequent breakdown of the Westphalian state system, transnational corporations (TNCs) have acquired augmented powers at a global level where previously states had been the only players; and yet TNCs have none of the human rights obligations of states, particularly under international law. This dissertation aims to examine why this accountability lacuna exists in relation to corporations, specifically in relation to state-sponsored human rights violations in which TNCs are complicit.

The United Nations Counterterrorism and Human Rights Committees’ current collaborative practices have failed to reduce global terrorists’ activities and human rights abuses associated with counterterrorism activities. The purpose of this qualitative case study was to explore and compare collaborative processes between the committees in combatting terrorism and human rights violations associated with counterterrorism. The researched was centered around two key questions: The similarities and differences with information sharing processes and the impacts of the committees’ collaborative processes on terrorists’ activities and human rights violations. For this study, the pragmatic paradigm theoretical framework was used, focusing on the descriptive exploratory design. Secondary data was used as a source. Additionally, face-to-face and telephonic interviews with subject matter experts were conducted. Eclectic coding was used as the primary coding methodology to integrate other coding methodologies in the analysis process. The research concluded that the current multidisciplinary collaborative process used by the United Nations Counterterrorism Committee and Human Rights Committee creates inefficiencies that enable terrorists’ activities to adapt while reinforcing their terrorist message. Strategically integrating the interdisciplinary process within both committees could expand each committee’s awareness and efficiency in specified areas while positively reducing terrorist activities and human rights violations. Developing an appreciation and understanding beyond one’s individual expertise while melding expert considerations is the basis of the interdisciplinary process that can positively effect social change for a more stable international forum.

This thesis is about Turkish accession to the European Union and criteria to be fulfilled in order to become a member state. At Helsinki summit there were defined four main areas, that are the main obstacles of Turkish membership in the structures of EU – military influence in domestic politics, economy disproportions, the issues of minorities living in Turkey and problems with obeying human rights and fundamental freedoms. In addition the attitude among European countries and Turkish political elites has changed dramatically since 1999. There is a great discussion, whose main purpose is, to show if Turkey should or shouldn’t become a part of united Europe. With the help of created conceptual framework, which is empirically based on qualitative methods and with theoretical approach in form of analysis considering human rights, I have developed a set of three hypotheses, that are based on primary and secondary sources like EU, Human Rights Watch, Amnesty International reports considering changes of Turkish attitude to the question of human rights. In the process of testing validity or invalidity of those hypotheses, I have tried to conclude, why the implication of reforms considering human is the main obstacle of Turkish membership in the EU.

Human rights and democracy are, today, indissoluble elements of the political reality. However, there are differences of origin and function between the two notions that they can, eventually, cause tensions and difficulties, especially when we try to attribute to the “majority principle” unlimited powers, including the determination and configuration, even pejorative, of the fundamental rights. this risk comes from adopting a purely “formal” or “procedural” conception of democracy, so it is necessary to affirm a “substantial” notion of it, in which fundamental rights are recognized. On the one hand, as a limit to the state power, whatever the source of legitimacy of it, and on the other hand, as indispensable ingredients for the free exercise of political rights on which democracy is based.
Derechos Humanos y democracia son, hoy, elementos inseparables de la realidad política. sin embargo, entre ambas nociones existen diferencias de origen y de función las que, eventualmente pueden plantear tensiones y dificultades, sobre todo cuando se pretende atribuir al “principio de la mayoría” potestades ilimitadas, que incluyen la determinación y configuración, incluso peyorativa, de los derechos fundamentales. Over the past several decades, the numbers of international nongovernmental organizations (INGOs) that focus on tackling human rights issues have grown rapidly. These organizations operate internationally and work with governments, legislatures, social movement leaders, activists, donors, and individual citizens. As the number of operating INGOs has risen dramatically, researchers have simultaneously begun to investigate the possibility of creating a global civil society that would govern itself in order to maintain peace, create global solidarity and achieve human rights. This research investigates the role of nonprofit organizations in developing a global civil society by evaluating U.S.-based organizations that are tapping into an often-uninvolved subset of societyâ American donors.

In 2011, the United Nations (UN) Human Rights Council endorsed the UN Guiding Principles on Business and Human Rights, which set out the norm of ‘corporate responsibility to respect human rights’. This interpretive qualitative study explores the meaning-making processes of human rights and business responsibility as articulated in governmental and corporate policy documents and by a variety of staff in the hospitality sector in the United Kingdom (UK). It aims to contribute to the literature on business and human rights by studying the context-specific meaning-making and implementation of human rights responsibility principles within hospitality organisations in the UK. I conducted interviews with people working in various positions in hospitality businesses (London and Oxford), investigated the policy documents of nine leading international hotel groups and examined the policy statements of the UK Government. I used framing analysis to explore and explain how human rights and business responsibility policies and ideas are understood, interpreted and articulated across these communities of meaning. Emphasising the socio-political nature of organisations, I identified significant differences and some overlaps between the expectations and experiences of these actors. Human rights policies and language are little known or used by work-floor participants and managers, and, conversely, their local knowledge of harms and ethical practice do not seem reflected in the more generic, legally responsive, public and overseas-oriented policies of the international hotel groups and the UK Government. While all actors use the language and/or ideas of human rights as means to craft and perform identities, the meanings of, knowledge about and ability to articulate human rights all depend on their social and organisational positionalities and political objectives. To overcome critical barriers in the development of human rights practice and consciousness in business, I propose a paradigm shift to human rights in business. This enhances a more participatory and contextual approach to human rights due diligence which is inclusive of and more sensitive to local knowledge of human rights.

This essay compares the figurative language of Bob Dylan’s albums The Times They Are A-Changin’ (1964) and Highway 61 Revisited (1965), with a focus on how Dylan remained engaged with societal injustices and human rights as he switched from acoustic to fronting a rock ‘n’ roll band. The essay argues that Dylan kept his critical stance on social issues, and that the poet’s usage of figurative language became more expressive and complex in the later album. In the earlier album Dylan’s critique, as seen in his use of figurative language, is presented in a more obvious manner in comparison to Highway 61 Revisited, where the figurative language is more vivid, and with a more embedded critical stance.

The liberal conception of the state is marked by an insistence upon the equal civil and political rights of each inhabitant. Recently, though, a number of writers have argued that this emphasis on uniform rights ignores the fact that the populations of most states are culturally diverse, and that their inhabitants have significant interests qua members of particular cultures. They argue that liberals should recognize special, group-based cultural rights as a necessary part of a theory of justice in multicultural societies. In this thesis I examine the idea of special cultural rights. In the first part (Chapters 1 to 4), I begin by setting out some of the different conceptions of culture and multiculturalism that are involved in the debate over cultural rights. I then discuss three claims made by supporters of special cultural rights: (1) that having culture is an essential part of individual autonomy; (2) that people have morally significant interests qua members of particular cultures; and (3) that these interests are inadequately protected by existing liberal conceptions of human rights. Although I conclude that (1) is correct, I argue that both (2) and (3) are mistaken. Among other things, I suggest that the version of culture relied upon by supporters of special cultural rights is an implausible one and I outline what I take to be a more plausible, cosmopolitan conception of culture. In the second part (Chapters 5 to 9), I begin by looking at specific instances of cultural rights-claims, and analyzing the concept of cultural rights qua rights. I consider the practical and conceptual difficulties with special cultural rights at great length. But the core of my thesis is that our interest in culture lies in its contribution of worthwhile goals and options, and that this interest lies in culture generally rather than in particular cultures. Hence, adopting a special or group-based distribution of any right to culture would seem to be inconsistent with liberal egalitarian principles. If there are such things as cultural rights, I argue, they are general rather than special rights. I conclude by offering a very preliminary account of what a cosmopolitan conception of cultural rights might involve in the case of the right to free association and language rights.

The purpose with this dissertation is to study the Intersex phenomenon in South Africa, meaning the interplay between the dual sex and gender norms in society. Hence, the treatment by some medical institutions and the view of some non-medical institutions upon this ‘treatment’, have been studied in relation to the Intersex infant’s human rights and citizenship rights. The thesis has moreover also investigated how young Intersex children are included/excluded and mentioned/not mentioned within South Africa’s legal system and within UN’s Convention on the Rights of the Child.

Furthermore, because Intersex children are viewed as ‘different’ on two accounts – their status as infants and born with an atypical congenital physical sexual differentiation, the thesis’ theoretical framework looks at the phenomenon from three perspectives – ‘the politics of difference’, human rights, and citizenship rights directed towards infants. The theoretical frameworks have been used to ask questions in relation to the empirical data, i.e. look at how the Intersex infants are ‘treated’ in relation to their status as ‘different’; and also in relation to the concept of being recognized, respected and allowed to partake in deciding whether to impose surgery or not. Moreover, what ‘treatment’ serves the best interest of the Intersex child? This has been done through semi structured interviews.

In conclusion, some of the dissertation’s most important features are that since the South African society, like many other societies, strongly live by the belief that there are only two sexes and genders, this implies that Intersex infants do not fit in and become walking pathologies who must be ‘fixed’ to become ‘normal’. Moreover, since most genital corrective surgeries are imposed without being medically or surgically necessary, and are generally imposed before the age of consent (18), the children concerned, are generally not asked for their opinion regarding the surgery. Lastly because early corrective surgery can have devastating life lasting consequences, this ultimately means that the child’s human rights and citizenship rights are of a concern. These conclusions do however not ignore the consequences one has to endure for the price of being ‘different’.

This thesis sets out the theory of ‘egalitarian rights recognition’, which is based on a novel combination of aspects of the work of Thomas Hill Green and Hannah Arendt. In doing so, it makes three key arguments. First, human rights must be grounded in social recognition, rather than in the innate qualities of the human. Second, rights recognition requires a serious commitment to equality - conversely egalitarian rights recognition provides a critical lens through which the problems of rights recognised in situations of inequality can be more clearly seen. Third, human rights, if grounded by egalitarian social recognition, are important for human freedom and flourishing. The thesis concludes by applying the theory of egalitarian rights recognition to the international level, arguing that rights recognition can provide a more plausible basis for cosmopolitanism than natural rights, and thus for human rights, rather than rights within a certain state.

This study examines the notion of universal human rights in the context of the importance of social and economic rights for the agency and dignity of human beings. It argues that the recognition of basic rights to what is necessary for physical well-being is essential to any adequate theory of human rights, and that rights of the civil and political variety depend on the recognition of social and economic rights if they are to be exercised. Therefore the secondary status which is usually accorded to social and economic rights results in an imbalanced ideal of human rights both in theory and in practice. This study is an attempt to place second generation rights in their proper context and to argue for them as human rights of equal status and importance. It focuses on the derivation of human rights in general, and shows that second generation rights may be accommodated within this structure. It further supports this position by showing that the categorical differences which are asserted to exist between first and second generation rights are based on a mistaken conception of positive and negative rights and duties, as well as an inadequate conception of liberty. The thesis shows that all rights generate a variety of duties, both positive and negative, and that an adequate theory of rights has to be able to accommodate the inevitability of conflicts of rights at the level of their enforcement. Consequently, this study argues there is no reason to give either class of right primary importance, as both first and second generation human rights are essential to the agency and dignity of a human being, and they are thus interdependent. Furthermore, the thesis shows that human rights can be balanced at the level of the obligations which they generate without compromising the deontological nature of such rights. This thesis argues that a theory of rights which is rooted in the liberal democratic notion of rights, such as that characterised by the choice theory of rights, is inadequate. It therefore argues that a benefit theory of rights must be adopted in order to accommodate conflicts of rights when they arise. The thesis argues that as such conflicts of rights are" most common in cases involving the assertion of social and economic rights, this balancing of rights is of special significance for the enforcement of second generation rights. Furthermore, this thesis argues for a theory of minimal interdependence of first and second generation rights, in order to accommodate the notion of first and second generation rights of equal status and importance, as well as to prevent an inflation of rights claims which would compromise the balancing of rights. It is argued that a reordering of values is necessary to take account of material well-being, as well as civil freedom, as both of these generate fundamental rights of equal status and importance.

Today the conception of human rights is an idea that preserves its intransitive, inalienable and indivisible quality with a cross-cultural reference. The idea of human rights, entering our lives from the 18th century onwards, has gained a worldwide recognition through the Universal Declaration of Human Rights. The idea occupies place both at the level of rules and principles as a project and at the level of our daily problem solutions, modifications and the daily course of our lives as a pragmatics. The political framework provides the idea of human rights such a justification that it constitutes a significant part of our decisions, thoughts and actions. On the other hand, the grounds of the idea has been questioned as a part of the Enlightenment project since it was first articulated and especially in recent decades certain radical criticisms originating from Nietzche&rsquo
s thought became prevalent. The thesis questions this easy alliance between Nietzsche and radical attacks to human rights thought. In the first chapter, I first provided a brief historical overview of the idea of human rights. Then, I had a closer look towards the principles of universality, equality, autonomy and is-ought distinction with special reference to Kantian formulations of these concepts and in the second chapter, I elaborate Nietzsche&rsquo
s perception of these same principles and our understanding of conventional morality in general, to reach an articulated answer to the question: Would Nietzsche be categorically against human rights? I conclude that his philosophical attitude to these four principles differ from each other. In this context the thesis regards Nietzschean informal structures over the Kantian formal ones as complementary for a full grasp of the idea of human rights by offering a connection of the transitionality between Kant and Nietzsche.

This thesis examines the contributions to the global constitutional process made by the human rights machinery of the United Nations. To do this, it considers the philosophical and theoretical positions related to understanding constitutionalism either as government or as governance. This contrast is then used to help develop the idea of the constitutional process, which is followed by a translation of these ideas into the international realm. Subsequently, it examines the United Nations Human Rights Council from the perspective of a polycentric international society. This is then followed by an examination of the Office of the United Nations High Commissioner for Human Rights from a cosmopolitan perspective. Ultimately, it is concluded that, whilst the existing contributions made by these organs are seemingly negligible, the particular theoretical approach undertaken is successful in highlighting certain opportunities for reforms that have hitherto been unexamined.
