De 1638 à 1648, tout a opposé les deux médecins parisiens Théophraste Renaudot (1586-1653) et Guy Patin (1601-1672) : empirisme contre dogmatisme, paracelsisme contre galénisme, arrivisme politique contre mépris de la cour royale, Université de Montpellier contre Faculté de médecine de Paris… Sans doute attisé par leur ancienne camaraderie, leur duel a produit un foisonnement de libelles, auxquels s’ajoutèrent procès et pieds de nez dans un déchaînement réciproque de haine et de dédain. En 1643, après la mort de Richelieu et de Louis XIII, Patin pouvait impunément injurier son ennemi désarmé ; en disgrâce à la cour, Renaudot dut s’avouer vaincu. À la fin du XIXe siècle s’engagea une joute posthume entre les deux ennemis : Patin pour ses Lettres caustiques (rééditées en 1846) et Renaudot pour son invention du journalisme en France (La Gazette créée en 1631). L’opinion plaça le journaliste sur un piédestal et le fit jouir d’une immense célébrité en attachant son nom à celui d’un prix littéraire (1926).

Su «Gazette» la pondrá enteramente al servicio de la política antiespañola de Richelieu, de quien recibirá todos los apoyos. Y, sin embargo, la actividad filantrópica y científica, aunque en parte efímera, que desarrolló este hombre fecundo e imaginativo, no merece ser desdeñada. En una época en que apenas ninguna actividad pública se concibe al margen de las estructuras y normas corporativas, máxime cuando viene a vulnerar fortísimos intereses, las creaciones imaginadas por Renaudot aparecen tanto más llamativas, y su combate tanto más meritorio.

The implementation of the family planning policy program launched by the Indonesian government is not only focused on women, but also on men. This study uses a phenomenological approach. This is because the main objective of this study is to understand deeply (verstehen) the phenomenon that is the target of the study, namely the relatively low coverage of male family planning participation. In interpreting this understanding, researchers will try to draw various generalizations or theories that can be used for the development of science itself or to be used as a basis for the benefit of theory application in people's lives. The research method used in this study is a qualitative method and the informant selection technique in this study uses the snow ball informant technique. The data analysis technique used is taxonomic analysis, which is a more detailed and in-depth form of analysis in discussing a theme or subject matter. The implementation of Family Planning Policy in Majalengka Regency has gone quite well, this is indicated by the issuance of regional regulations (PERDA). Number 14 of 2016 concerning the Formation and Composition of Regional Apparatus of Majalengka Regency (Regional Gazette of Majalengka Regency of 2016 Number 14) regarding the establishment of the Office for Empowerment of Women for Child Protection and Family Planning as a technical agency that handles the family planning sector in Majalengka Regency and as a response to the decentralization of field authority Family Planning from the central government to local governments

Deviant teaching is one of the most important subjects in the issuance of fatwa in Malaysia. Despite the fact that the subject is not much related to fiqh, most of the fatwa issued officially in state gazette was on deviant teaching. Once a particular teaching is considered deviant through fatwa, the state agency, especially the Islamic religious department will take necessary steps to enforce the fatwa by prosecuting individuals involved. It has been noted by many that prosecution of offenders under this category was difficult due to administrative and procedural issues especially matter of evidence. It is therefore the aim of this article to discuss some aspects of fatwa on deviant teaching and issues related to its enforcement in Malaysia. The article will also discuss briefly some introduction on subject of fatwa and provide some development on the enforcement of deviant teachings in Malaysia. Abstrak Ajaran sesat merupakan satu tajuk penting dalam pengeluaran fatwa di Malaysia. Sungguhpun tajuk ini tidak menyentuh aspek hukum fiqh, kebanyakan fatwa rasmi seperti yang terkandung dalam warta kerajaan adalah menyentuh ajaran sesat. Apabila sesuatu ajaran itu dianggap sesat melalui fatwa, agensi kerajaan yang berkaitan terutamanya Jabatan Agama Islam akan mengambil langkah-langkah untuk menguatkuasakan fatwa berkenaan melalui pendakwaan terhadap individu yang terlibat dengan ajaran berkenaan. Ramai pihak beranggapan bahawa tindakan pendakwaan dalam kategori kesalahan ini agak sukar untuk disabitkan memandangkan kesukaran dalam masalah pembuktian dan prosedur. Tujuan artikel ini adalah untuk membincangkan beberapa aspek dan isu fatwa mengenai ajaran sesat yang berkaitan dengan penguatkuasaan di Malaysia. Artikel ini juga akan menerangkan secara ringkas pendahuluan mengenai fatwa dan perkembangan mengenai penguatkuasaan fatwa ajaran sesat di Malaysia

Resulta sorprendente que algunas publicaciones periódicas, editadas por personas con enfermedad mental en diversos entornos psiquiátricos, se remontan a hace casi dos siglos. Primero en las grandes instituciones psiquiátricas como parte integrante del tratamiento moral, para más recientemente dar el salto a otros entornos asistenciales y comunitarios, como son hospitales de día y comunidades terapéuticas. Sin embargo, a pesar de su dilatada historia y haber sobrevivido a las diferentes corrientes teóricas y asistenciales, siendo un fiel reflejo de sus postulados y métodos, llama la atención el poco caso e interés despertado en los ámbitos académicos en relación con su estudio y conservación, habiéndose perdido irremediablemente muchas de ellas para el futuro. El trabajo pretende rescatar del olvido dos de aquellos pioneros periódicos. Uno, “un periódico de considerable interés” en Essex (Inglaterra), que reclamaría para sí el honor de ser el primero de esas características en la historia, desplazando de esa posición a la Retreat Gazette de Connecticut (Estados Unidos). El segundo, el Sotto-Pancia, en Florencia, que precedió en el tiempo al Diario dell’ ospizio di San Benedetto promovido por Lombroso en Pesaro y considerado hasta ahora el primero en Italia.

Dalam sistem pembentukan peraturan perundang-undangan di Indonesia, masih kita temui adanya pemberlakuan teori fiksi hukum.Dimana semua orang dianggap tahu hukum apabila sudah diundangkan dalam lembaran resmi dan ketidaktahuan seseorang atas hukum atau peraturan perundang-undangan yang berlaku tidak membebaskan seseorang itu dari tuntutan hukum (igronantia iuris neminem excusat).Hal ini tentu bertentangan dengan nilai-nilai keadilan yang ada di masyarakat.Diperlukan upaya-upaya untuk mengikis keberlakuan teori fiksi hukum ini.Hal inilah yang menjadi pokok permasalahan dalam tulisan ini.Metode penelitian yang digunakan adalah metode penelitian hukum normatif dan untuk memperoleh data digunakan studi perundang-undangan dan telaah kepustakaan.Dari hasil penelitian memperlihatkan bahwa teori fiksi hukum masih diberlakukan dalam sistem peraturan perundang-undangan di Indonesia. Untuk mengikis keberlakuan teori fiksi hukum dapat dilakukan 2 (dua) upaya baik dari pemerintah maupun dari masyarakat, yaitu publikasi oleh lembaga pembentuk peraturan perundang-undangan dan partisipasi aktif dari masyarakat dalam proses pembentukan peraturan perundang-undangan tersebut.AbstractIn Indonesia, we still find an enactment of law fiction theory in the system of legislation formation. Where everyone is regarded to know the law when it is legislated in the official gazette and one`s ignorance on the law or provisions of legislation do not make one free of prosecution (igronantia iuris neminem excusat). It is against the justice values in the society. It is needed effort to erase its enactment, that is the main problem in this research. It uses normative law method. Collecting data by literature and legislation search. The result of this research shows that Indonesia still enact law fiction theory in legislation system. To efface its efficacy can be conducted 2 (two) attempts, both government and society as well, that is publication by lawmaker or legislator and society participation in the establishment of legislation process.

This research uses normative legal research methods, with a law approach and historical approach. Primary legal material namely Law Number 6 of 2014 concerning Villages (Additional State Gazette Number 5495), Secondary Legal Materials contained in the book, legal and internet journals. Research result (1) Local Governments both from the district until village levels are obliged to hold good Village Information facilities. Bendega is a traditional institution in the field of maritime and fisheries on indigenous peoples in Bali in the coastal region, economic, social, cultural and religious that has historically continued to grow, evolving in accordance with the culture, and also the local wisdom of Bali. Bendega is one of three traditional institutions in Bali, namely, Desa Adat, Subak and Bendega. This purpose of this study to understand and interpret the characters of the form and character of the contents of the Bali Regional Regulation 11/2017 which are based on formal and material principles, and study settings using the method of thinking Regulatory Impact Assessment. This research used a normative research method. The results showed that the formation of the Bali Regulation 11/2017 was based on philosophical, sociological and juridical considerations. The establishment of the Bali Regulation 11/2017 is based on attribution authority and delegation. The content character of the Bali Regulation 11/20 is discretionary, in the sense of giving the Governor and the Regency / City Government the freedom of space. Bali Regional Regulation 11/2017 has addressed the character of responsiveness to pluralism in the legal order that applies in areas that have certainty and fulfill people's desires. The certainty of the rules of traditional socio-cultural and religious institutions in the field of fisheries which are part of the culture of traditional Balinese society. Furthermore, it is hoped that there will be a further scientific review of the Bali Provincial Regulations that have been stipulated in the Regional Gazette Bendega adalah lembaga tradisional di bidang kelautan dan perikanan pada masyarakat adat di Bali yang ada di wilayah pesisir, bersifat ekonomi, sosial, budaya dan religius yang secara historis terus tumbuh, berkembang sesuai dengan budaya dan kearifan lokal Bali. Bendega merupakan salah satu dari tiga lembaga tradisonal yang ada di Bali, yaitu, Desa Adat, Subak dan Bendega. Tujuan penelitian adalah memahami dan menginterpretasi karakter bentuk dan karakter isi Perda Bali 11/2017 yang berlandaskan pada asas formil dan materil, dan kajian pengaturan dengan menggunakan logika berpikir Regulatory Impact Assessment. Jenis penelitian ini adalah penelitian hukum normatif. Hasil penelitian menunjukan bahwa pembentukan Perda Bali 11/2017 adalah berdasarkan pertimbangan filosofis, sosiologis, dan yuridis. Pembentukan Perda Bali 11/2017 didasari pada kewenangan atribusi dan delegasi. Karakter isi Perda Bali 11/20 bersifat diskresioner, dalam pengertian memberikan ruang kebebasan kepada Gubernur dan Pemerintah Kabupaten/ Kota. Perda Bali 11/2017 telah menujukan karakter responsifitas terhadap kemajemukan tatanan hukum yang berlaku di daerah yang memiliki nilai kepastian dan memenuhi keinginan masyarakat. Kepastian aturan lembaga tradisional yang bersifat sosial budaya dan religius di bidang perikanan yang merupakan bagian dari budaya masyakat tradisional Bali. Untuk selanjutnya diharapkan adanya pengkajian ilmiah lebih lanjut tentang Perda-Perda Provinsi Bali yang telah ditetapkan dalam lembaran Daerah.

Penglibatan masyarakat dalam kawasan perlindungan merupakan isu kritikal terutama dalam konteks kawasan pemuliharaan alam semulajadi. Kejayaan pembangunan di kawasan perlindungan dan pemuliharaan alam semulajadi adalah sangat penting terutamanya untuk melibatkan penyertaan masyarakat setempat dalam proses membuat keputusan atau komuniti setempat mendapat keuntungan daripada kawasan perlindungan atau pemuliharaan alam semulajadi tersebut. Ini kerana penubuhan Imbak Canyon Conservation Area (ICCA) memberi kesan positif dan negatif kepada masyarakat setempat. Masyarakat setempat di kampung Imbak telah lama tinggal berhampiran di kawasan ICCA sejak dulu lagi. Bagaimanapun, pihak kerajaan Negeri Sabah telah mewartakan Kawasan Imbak Canyon sebagai Hutan Simpan Kelas 1 (Perlindungan) pada tahun 2009. Oleh itu, terdapat beberapa cabaran yang dihadapi oleh masyarakat setempat demi meneruskan amalan dan aktiviti penghidupan harian mereka selama ini yang berasaskan sumber hutan sebelum ICCA ditubuhkan. Kajian ini menggunakan pendekatan kualitatif. Kaedah temu bual mendalam adalah kaedah pengumpulan data yang digunakan; enam orang informan yang terdiri daripada ketua kampung Imbak, penduduk Kampung Imbak dan tiga orang penduduk kampung yang bekerja sebagai kakitangan di kawasan Pemuliharaan Imbak Canyon telah ditemu bual. Dapatan kajian menunjukkan bahawa terdapat kesan positif penubuhan ICCA ke atas ahli komuniti setempat sebagai hasil daripada penglibatan mereka dalam aktiviti ekopelancongan seperti menjadi penyedia inap desa di ICCA. Oleh itu, hasil kajian ini diharapkan dapat memberikan sumber data lapangan kepada pihak berkepentingan untuk mempertimbangkan kebijakan pembangunan alam semulajadi yang disebut sebagai pendekatan pemuliharaan berasaskan komuniti di ICCA. Community involvement in a conservation area has become a critical issue especially in the context of a nature conservation area. The success of the development in the conservation area is essential to involve local community participation either in the process of decision-making or the local community is gains advantages benefits brought about by the conservation area. This is because the establishment of the Imbak Canyon Conservation Area (ICCA) has a positive and negative impact on the local community. The local community of Imbak village has been stayed in nearby areas for a long time ago. The Sabah State government, however, gazette Imbak Canyon as a Class 1 (Protection) Forest Reserve in 2009. Thus, there are some challenges faced by the local community to sustain their daily livelihoods practices and activities of which were based on forest resources used before the ICCA was established. This study applied a qualitative approach. An in-depth interview of the data collection method was used; six informants comprising the village chief of Imbak, residents of Kampung Imbak, and three other villagers are working for staff at the Imbak Canyon Conservation Area were interviewed. The research findings show that there is also a positive impact attained by the local community as a result of their involvement in ecotourism activities such as become as homestay providers in the ICCA. Therefore, the results of this study will hopefully provide some grounded data for the stakeholder to consider the policy of so-called the community-based conservation approach in the ICCA.

ABSTRACT Kudat is located in the North part of the island of Borneo, with land area of 1,287.2 km2 or 130,787 ha. Out of the overall total area, 25% or 33,307 ha of area are gazetted under Forest Reserve. Most of the Kudat coastline area is patches of mangrove forest. A total of 19,507 hectares of the total mangroves in the Kudat district have been gazetted as permanent forest reserve under class-V Mangrove Forest Reserve. Mangroves play many important functions such as physical protection to the coastline, important breeding ground of marine life and nurseries, source of socio-economy activity to the local people, natural habitat for the living organisms, home to wide range of flora and fauna. Another function is they provide opportunities for the development for eco-tourism. Some locations in Kudat, which are of high potential for tourism development, are Kg. Sikuati, Simpang Mangayau, Sg. Ranggu, Pulau Banggi, Pulau Malawali and Pulau Balembangan. In 2005, about 2,440 ha or 0.8% of the Mangrove forest reserve in Sabah has been lost mainly due to land conversion for people’s settlement. As for Kudat, exploited area recorded are as follow; settlement/urban development (500 ha), aquaculture (15 ha), agriculture and infrastructure (13 ha) - power supply way leave, pipeline, and common tower. Illegal squatters involved about 2 ha and land use conflict of mangrove forest reserve in Kudat were lost to agricultural conversion due to uncoordinated and technical discrepancies of boundaries on the ground. Some challenges in mangrove conservation are, currently there is no management plan prepared for the management of mangroves in Kudat. The management of mangrove area thus far is focusing on protecting the gazetted area under permanent forest reserve under Class V – mangrove forest, gradually by the forest district. Apart from mangroves in PFR, there are also some scattered Stateland mangroves which are not quantified, monitored and protected under any legislation. Considering their locations, roles and functions, steps must be taken to gazette existing mangroves inside estuaries and lagoons as Permanent Forest Reserve (PFR). The apparent of boundaries between state land and Mangrove Forest on the ground are vital to be carried out by the authority. Important effort to better manage the Kudat mangroves is carrying out nourishment and planting activities in existing mangroves. Other challenges are to involve the local communities to conserve mangroves areas, especially thus living nearby the mangrove forest. This paper highlights the status of mangrove, to emphasize the important function of mangrove, and to distinguish the threat and challenge of mangrove conservation in Kudat district. Abstract.Globalization of information has placed Indonesia as part of the world information society, thus requiring the establishment of regulations on information and electronic transactions at the national level as answers to developments that occur, both at regional and international levels.Based on these conditions, the Government of the Republic of Indonesia has enacted the Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions (hereinafter abbreviated as ITE Law) in the State Gazette of the Republic of Indonesia of 2008 Number 58.Information technology is very useful for university development strategies. Some forms of university development strategies that can utilize information technology and electronic transactions, namely the fields of education, research and development of science, development of the field of community service, development of human resources, development of fields of cooperation, development of university management, development of facilities and infrastructure and development source of funds.The provisions in the ITE Law (including the threat of sanctions) certainly constitute one side of normative efforts to protect the development of higher education institutions that have used information technology. In addition to the provisions of the prohibitions in the ITE Law, it also regulates matters that are prohibited but are considered not criminal acts, because one's actions are intended to conduct research activities, test Electronic Systems, to protect the Electronic System itself legally and not fight law. This provision encourages and protects lecturers / researchers from universities or research institutes of universities to conduct research for research institutions. Abstrak.Globalisasi informasi telah menempatkan Indonesia sebagai bagian masyarakat informasi dunia sehingga mengharuskan dibentuknya pengaturan tentang informasi dan transaksi elektronik di tingkat nasional sebagai jawaban perkembangan yang terjadi baik di tingkat regional maupun internasional. Berdasarkan kondisi tersebut maka Pemerintah Negara Republik Indonesia telah mengundangkan Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 tentang Informasi dan Transaski Elektronik (selanjutnya disingkat UU ITE) dalam Lembaran Negara Republik Indonesia Tahun 2008 Nomor 58. Teknologi informasi sangat bermanfaat untuk strategi pengembangan perguruan tinggi. Beberapa wujud strategi pengembangan perguruan tinggi yang dapat memanfaatkan teknologi informasi dan transaksi elektronik yaitu bidang pendidikan, penelitian dan pengembangan ilmu, pengembangan bidang pengabdian kepada masyarakat, pengembangan sumber daya manusia, pengembangan bidang kerjasama, pengembangan manajemen perguruan tinggi, pengembangan bidang sarana dan prasarana dan pengembangan sumber dana. Ketentuan dalam UU ITE (termasuk ancaman sanksinya) tentu merupakan satu sisi upaya normatif untuk melindungi pengembangan perguruan tinggi yang telah memanfaatkan teknologi informasi. Di samping adanya ketentuan larangan-larangan tersebut dalam UU ITE juga mengatur hal-hal yang merupakan larangan tetapi dianggap bukan tindak pidana, karena perbuatan seseorang itu ditujukan untuk melakukan kegiatan penelitian, pengujian Sistem Elektronik, untuk perlindungan Sistem Elektronik itu sendiri secara sah dan tidak melawan hukum. Ketentuan ini mendorong dan melindungi para dosen/peneliti perguruan tinggi atau lembaga penelitian perguruan tinggi melakukan penelitian-penelitianbagi lembaga penelitian. Film is one of the artistic manuscripts that influences society. Islam, as a merciful religion towards mankind, does not neglect this aspect. In fact, it guides films to comply with the demand of shara‘. The recent development of films focuses on horror stories as a genre so favored by the general that it touches ‘aqidah issues. Therefore, the Fatwa Council plays an important role in tackling this issue to assist those in film industry in producing high quality film and complying with sharia. Hence, this study aims to analyses fatwas in the aspect of ‘aqidah associated to films to see whether the fatwas used are gazette or not. This study is in the form of qualitative. The method used is content analysis through literature review by examining the fatwas made on any related issues in films. The findings show that fatwas related to ‘aqidah in films are significant, however, they are not often discussed by the Fatwa Council in the national or state level.

Banking in Indonesia is now increasingly enlivened by the existence of Islamic banks, which offer financial and investment products in different ways than conventional banks that have long existed. Even conventional banks in Indonesia are now following the trend by establishing their own Islamic institutions or Islamic business units. Recorded in 2012 Islamic banks have increased rapidly to become 11 Islamic Commercial Banks (BUS) and 24 Sharia Business Units (UUS). Islamic banks were born and developed in Indonesia starting from the birth of Bank Muamalat in 1992. Law Number 7 of 1992 concerning banking was born because in that year Bank Muamalah was the only bank that carried out business activities based on the principle of profit sharing. Furthermore, the culmination point has been reached with the enactment of Law Number 10 of 1998 concerning banking which opens the opportunity for anyone who will establish a Shari'ah bank or who wants to convert from a conventional system to a sharia system. Until the issuance of Law No.10 of 1998. Furthermore, Law No.10 of 1998 was amended by Law No. 21 of 2008 concerning Islamic banking because on June 17 2008 the Law on Islamic Banking was adopted which promulgated in the State Gazette on July 16 2008.
