This book investigates where the European Convention on Human Rights (ECHR) as a living instrument stands on migration and rights of migrants. Individual chapters in the volume address how the tension between the textual silence of the Convention concerning migrant rights and the significant number of cases that the ECHR have addressed concerning migration and rights migrants are resolved or left to the discretion of European states. This book offers a comprehensive analysis of cases brought by migrants in different stages of migration covering the right to flee, who is entitled to enter and remain Europe, what treatment is owed to them when they come within the jurisdiction of a Council of Europe member state, not only to those who recently entered Europe, but also to those who have been living in Europe for a longer time. As such, the book evaluates the case law of the ECHR concerning different categories of migrants including asylum seekers, irregular migrants, those who have migrated through domestic lawful routes and those who are currently second- or third-generation migrants in Europe. The broad perspective adopted by the book allows for a systematic analysis of how and to what extent the Convention protects non-refoulement, migrant children, family rights of migrants, status rights of migrants, economic and social rights of migrants, as well as cultural and religious rights of migrants.

In this “for and against” book, Jeremy Waldron and Tamar Meisels defend competing positions on the legitimacy of targeted killing. The volume begins with a joint introduction, briefly setting out the terms of discussion, and presenting a short historical overview of the practice—i.e. what is targeted killing, and how has it been used in which conflicts and by whom. The debate opens with Meisels’ defense of targeted killing as a legitimate and desirable defensive anti-terrorism strategy, in keeping with both just war theory and international law. Meisels unreservedly defends the named killing of irregular combatants, most notably terrorists, during armed conflict. Additionally, she offers a possible moral justification for rare instances of assassination outside that framework, specifically with reference to recent cases of nuclear scientists developing weapons of mass destruction for the Iranian and Syrian governments. The debate continues with Waldron’s arguments focusing on the dangers and the inherent wrongness of governments’ having the right to maintain death lists—lists of named individuals who are to be hunted down and killed. Waldron notes the many differences between individualized targeting and ordinary combat, and he resists the attempt to assimilate targeted killing to killings in combat. Waldron also cautions us to consider carefully what a world of targeted killings will be like, the many abuses it is liable to, and why we should be very cautious, morally and strategically, in our thinking about it.

This book is concerned with the effects of European migration policy on migrants in the Global South. In particular, it uncovers how border enforcement policies and the crackdown on irregular migration affect the life of migrants in so called ‘transit’ countries outside the European Union. The material for this study is based on ethnographic research in Morocco with migrants from Sub-Saharan Africa. The book is mainly concerned with the human and social effects of immobility during the migratory journey. It describes how migration policies in and outside Morocco contribute to a situation where migrants get stuck in Morocco for years, and in the process become increasingly marginalized from participation in society. These prolonged periods of forced immobility negatively affect migrants’ life course, as well as their relation to the present, past and future. This alters their feelings of identity, their social relations to friends and relatives, and their aspirations for the future. The immense human suffering this situation implies has a tendency to further reinforce their wish to leave the country, rather than encouraging them to abandon their migratory projects. The book links these empirical insights on immobility to social theories of time. It argues that the fragmentation of migration processes and immobilization of migrants has an impact on migrants’ view of their own lives as ‘out of sync’ with modernity. Thinking about migration and immobility in relation to time offers a different perspective on migration processes which have until now mostly been theorized through reference to concepts of space.

This chapter argues that there is potential for conflict between common and civil law jurisdictions where the approach to preparation for trial, and through that the taking of evidence, differ to a large degree. In common law jurisdictions, where it is usual for private parties to be proactively involved in the evidence gathering process, it will not seem irregular for evidence to be taken by an agent of a foreign court for the purpose of proceedings on foot in that court. Such an approach may, however, offend the rules of civil law jurisdictions, where the obtaining of evidence, at least in criminal matters, is primarily the role of the judiciary. To address this potential for conflict, a number of pieces of legislation and bilateral and multilateral civil procedure conventions have evolved over time to facilitate official intervention in order to obtain cross-jurisdictional assistance in the gathering of evidence for the purpose of both civil and criminal proceedings. The various ways in which assistance may be sought by or obtained from the English courts are explored in this chapter.
