La investigación que se propone intenta entregar una visión general de lo que se ha escrito en materia de métodos y técnicas de investigación jurídica en los autores más representativos en países como México, Venezuela, Colombia y Chile que han contribuido con una literatura aportativa en este tema. Por lo tanto, resulta necesario conocer lo que se ha hecho y lo que se sigue produciendo en este campo, para mejorar cualitativa y cuantitativamente el proceso de formación del abogado. Por otra parte, es indispensable generar un nuevo enfoque metodológico en las investigaciones jurídicas, desde esta perspectiva el trabajo intenta establecer los modelos que actualmente se proponen para ver cuál sería su posible aplicación en Chile. Como hipótesis se plantea lo siguiente: La controversia en la metodología de la investigación jurídica existe, reflejándose en dos posiciones: investigación documental o dogmática e investigación empírica o de campo. La literatura metodológica contiene una discusión que se refiere a la naturaleza del derecho, los métodos, las técnicas y los modelos o paradigmas. La nueva visión del Derecho exige utilizar un conjunto más amplio de métodos y técnicas de investigación, para ello está el nuevo enfoque o perspectiva que debe tener la investigación jurídica.

La psiquiatría es la rama de la medicina que se ocupa del tratamiento de las enfermedades mentales. Es una disciplina de la medicina que se ha provisto de todo un saber científico sobre la enfermedad mental. El presente trabajo es una indagación en este saber, una investigación de las principales corrientes de la psiquiatría. Pero, es sólo una investigación teórica, es decir, un intento por conocer las principales orientaciones teóricas de la psiquiatría, sus diferentes perspectivas. El objetivo consiste en que el mundo del derecho penal tenga un conocimiento más amplio de la enfermedad mental, disponga de más orientaciones que dote de mejores fundamentos la interpretación de las leyes que aluden a ella. En otras palabras, se trata de que el mundo jurídico penal tenga una visión más completa de la enfermedad mental, que no se reduzca a una sola perspectiva u orientación teórica.

Повний текст джерелаThis PhD thesis has focused its research on the didactic values that drama provides for day to day life skills. For the aforementioned, a didactic model has been proposed, mainly aimed to early teacher training, being consequent with the essential quality sense, which was granted internationally by the promoting institutions (OECD and the European Commission) with the main target of transforming and improving both labour and personal social sustainability. The innovative nature of this research emerges from its competence focus, as it encourages drama education on real didactic tasks, happening in their context and being totally unforeseeable, which allows to strategically confront the sociocultural complex dynamic typical from the 21st century. This is the reason why the model of drama pedagogy focused on a scientific interdisciplinar approach, verging on communication semiotic, combines formal school learning and knowledge with daily and informal learning, and doing so, it attempts to contribute to the current type of academic learning, which reduces drama to a specialized practice through certain conductist techniques. Likewise, it provides creative experiences that lead to communication, in which knowing, knowing how to do, and knowing how to be, combine to reach self knowledge, understanding of others and reality transformation. Therefore, the general target has been designing, applying and assessing a didactic dramatization model, destined to life skill development through educational teacher training. In order to do so, the specific goals have been: firstly, to research the scientific interdisciplinar inputs, that have provided to drama from an educational skill approach; secondly, to delimit the conceptual and legal effectiveness in drama and acting, towards its didactic promotion to the teaching curriculum; thirdly, to design a didactic method about drama from a leaning cooperative dialogue, based on tasks and projects, destined to an integrated development of like skills in formal and informal environments; fourthly, to develop a didactic intervention in three cycles of investigation-action, with alumni from Education Degrees (old plan and Bolonia plan) where the competence didactic model is applied over dramatic communication; fifthly, to asses the process of the educational milestones through drama production results and the quality of the didactic method applied in the classrooms, to improve and work on the model proposed like skills. The implied method has followed, from a qualitative - interpretative focus, the process method of investigation - action in the classroom, developed in three cycles, and the cooperative learning has been chosen as an appropriate dynamic for the drama practice and as the ideal didactic method for education based on these competences: complex tasks and shared projects. Consequently, in the research progress, the process investigation - action can be seen happening during the first quarter of the years 2010 - 2011, 2011 - 2012 and 2012 - 2013 with students from an Education Degree and coming from the old three year plan degree in Murcia university, funded by the department of exclusive degrees in Murcia university. Throughout these terms, after giving the participants an initial questionnaire to detect previous knowledge and personal expectations, the concepts that were mainly practiced were imaginative improvisation about daily life, such as drama games using introspection, socialization, crafting didactic materials and discursive invention of drama and didactic projects that focused on paying attention to the different disciplines during the performance. This last activity happened alongside the final questionnaire to asses the achieved knowledge. The research results reveal that with the effective achievement of the presented targets, the hypothesis has been proven as positively contributing to overcoming the problem considered in the process proof analysis, in which positive results have been obtained from the 9 like skills presented by the OECD, according to the TUNING project’s macrocategories: instrumental, interpersonal and systemic. They also confirm the didactic viability of the original thesis of this investigation: transversal condition of drama to train Spanish and Literature teachers and teachers of any other disciplines, in life competences and skills. This achievement took place thanks to the work in the classroom, that happened in learning contexts that are close enough to the pedagogy of the situations used in drama performances, where improvisation sets personal actions free in a democratic cohabitation in which, at the same time, imagination manages uncertainty with a human approach.

Повний текст джерелаThis PhD Thesis proposes a model for literary creation based on the group cultivation of journey literature for the development of key competences. It supposes a newflanged enterprise in the literary education scene which claims for the epistemological and inventive power of imagination. The journey, as a topic of what is open and exotic, is connected to the essence of education based on competences, according to which the learner has to develop himself or herself in unpredictable contexts to which he or she should apply meaningful learning which he or she has developed in a process and in a team, in the development of the complex task given to him or her. The teacher is seen as a mere mediator that supplies strategic and social tools. So it is covered, from a democratic perspective, the problem of traditional teaching used to impose an academic canon based in conductivist methodological criteria exemplified by the authority sources that deplete innovative curricular iniciatives. This is why, procedures in this case differ from the compartimented view given in secondary schools, aiming that the thought journey lays out bridges towards fields and cultures from a number of countries, understanding that inside the subject of Spanish Language and Literature there is also place for other disciplines such as Social Sciences, Mathematics, Arts, Music, English… The development of key competences, shown by the model of research-action (Kemmis) carried out in a term of two academic cycles (each one following a process of planning- intervention- observation- reflection) advocates for a holistic treatment of knowledge in which enter into contact an interdisciplinar methodology of intercultural projection in which key competences are present for the development of a didactic with creative objective and the journey as a central axis for the development of fantasy. The theoretical frame of the research is articulated in two parts: a) the analysis of defining signs of journey from a canonic point of view and the interdisciplinar character of journey books.; b) a revision of contemporary tourism (M. Augé) and an analysis of mass tourism opposed to responsible tourism (D. Canestrini, L. Osborne). It is also included an essay on the purpose of the journey as a reading and writing connecting net (Reading Intertext by A. Mendoza). The plot will be built regarding the fantasy hypothesis and the fantasy binomial. (G. Rodari). And the symbiosis among life, literature and art will be reflected in the ekfrasis circle (P. Guerrero). Educating the learner with the motive of the journey as the core of a project means a reflection about the journey itself that lead us to the suitability of its use through different vias: interdisciplinarity, chance for the development of democratic values or responsibility with the physical and social environment. The hypothesis that gives place to this PhD Thesis states a teaching model ‘based in interdisciplinar creativity tasks for students of CSE around the interest of the literary journey’ with the general aim of ‘cultivating the educative excellence that reports the cultivation of the key competences in every cognitive level and in its integral reach of knowledge for life through the motive of the journey’. This great objective is spread in eight specific objectives that correspond with the cultivation of each key competence focused on the development of the journey in fantasy writings. The methodological frame of this research is narrowly linked to the definitions given in the theoretical frame about the journey and its discourses. The development of the research answers the experimentation and the analysis of what has been planned by the methodological frame in respect to the intervention in the classroom, and it is divided in two blocks that correspond to the two cycles of the research, in each one of which the develpment of the three phases is described: exploration, intervention and analysis of results. The conclusions sustain the suitability of the of journey literature for the improvement of the teaching practice. The hypertextual debt with “El viaje del Elefante” by José Saramago results in the students and teachers lengthening their sight towards the holistic contemplation of the key competences that dwell in compromising words that emerge from literary education and that invite us to read in order to write speeches based on authentic tasks related to life.

Повний текст джерелаABSTRACT This thesis is meant to show the influence and relationship that the use of information and communication technology and formats by which young people are attracted (video games, films, comics) has with the development of the students´ language skills development, over the use of traditional analogue formats. The idea that, given the new forms of reading and writing imposed by mass society’s use of information and communication technologies, may be producing a gap between the academic literacy practices and literacy practices required by society, so it is necessary to reconsider new formats for developing communication skills within the education system. As demonstrated by the study, where the background is set, where the problem is questioned and the objectives are established, the thesis has been structured into three blocks as follows. The first part deals with the theoretical framework on which the thesis is based: reading in the curriculum set for Primary Education, reports on reading, reading literacy, digital literacy, development of language skills in the official curriculum of the European Common Reference for Languages, the Teaching of language and literature, literacy and textual multimedia. In the second part, the empirical component of the investigation is established: design, samples and contexts, variables, data collection, timing and analysis of results of work field samples done by means of multimedia done by reading Treasure Island by Robert Louis Stevenson in two classrooms of a primary school centre of Murcia. Finally, in the third block the conclusions of the thesis are collected. The references mentioned throughout the study are hereby attached, along with a series of annexes that complement the work done in theory and practice form. The main conclusion of the thesis leads to affirm that the incidence of the use of multimedia texts plays an important role in promoting reading, to be effective for the creation of communication situations among learners, thus developing language skills (speaking, reading, writing, listening and speaking). It has been shown that, based on a literary classic text and relying on information and communication technologies, they can construct a story whose main narrative thread generates different hyper-links between different formats, which leads to a multimedia reading and in this way establishing highly motivating and enriching communication situations between peers. Повний текст джерелаThis thesis aims to investigate the success of a testing methodology in which teachers, before posing questions to students, reflect on the design, level, and purpose of their questions based upon specific instructional objectives in the classroom setting. Additionally, it examines the extent to which such a methodology increases the quantity of student talking time as well as the quality of student responses both in secondary language acquisition, in this case English, as well as in the subject matter itself, in this case Natural and Social Science. This study makes use of a quasi-experimental design with non-equivalent groups and pre-test in which the experimental and control groups track the development of 73 student subjects between ten and eleven years old (n=24 control group; n=49 experimental group) over the course of a full academic year. The non-linguistic subject, Natural and Social Science, is taught in English through the CLIL approach in both groups. However the teachers in the experimental group receive specific training in the methodological approach – effective questioning techniques. The delivery of the questioning through this methodology concerns how the questioning is performed by the teacher including things such as the response time given, to whom the questions are directed, and how and in what ways the teacher directs the question session. Data about the questions formulated by the teachers during the time of their content explanation in the lessons of natural and Social Science, the techniques used to choose which students would answer, and their replies are collected and analysed. In order to analyse that data graphics and numerical descriptions are used for the qualitative data while in order to describe the quantitative data, descriptive statistical analyses and inferential procedures are used to check and verify the hypothesis and its parameters. The results show that the treatment of this research increases both the content knowledge as well as the cognitive processing that comes as a result of the students' participation in this method of teacher questioning. Furthermore the study confirms the importance for teachers to learn to optimise the methods of using questions whose design aids and supports learning objectives in specific and predictable ways as part of an integrated and purposeful linguistic project.

Повний текст джерелаThis Doctoral Thesis comes as a result of researching into the production of interdisciplinary (art, literature and maths) and inter-textual art installations. Such strategy is efficient for an encompassing teaching both inside and outside exhibition spaces. We take children literature as a key stone, as a teaching resource and as a guiding theme that allows us to work in art and maths jointly. We aim to focus in emotions through the illustrated album “menudo punto”, which was produced for this installation, and also develop creativity in the laboratory where it is experimented and investigated. The laboratory has developed in two different venues: a museum and a classroom in a school. Students in the third, fifth and sixth year in primary education have attended the laboratory, from who we have gathered data about the knowledge gained and the evaluation of the workshop by the participants. This has shown the usefulness of the designed method, specially because it has make students strengthen their inter-textual reading skill and value literature, art and maths. Besides, it has allowed them to investigate new terms by new ways of working in which game has taken a key role.

Повний текст джерелаThe overall objective of this study was to improve school life, with the inclusion of a program of theatrical teaching in secondary schedules, based on the stimulation and development of various factors in the development of self-concept, through dynamic proposals in tutorials. The tutors, in applying its methodology, had to be aware that they needed to have a battery of teaching to be used as the situation required, as no single teaching strategy for the multiplicity of learning situations strategies. They had to choose, adapt and / or recreate, depending on the context, the "content" and the "purpose" teaching . The teacher's role was to provide incentives that favor the production of students applying strategies aimed at promoting autonomy, implying a progressive and ongoing monitoring work. One purpose, "Develop social activities through dramatic expression skills," he was widely worked in a formal workshop at the beginning of the investigation and the proposed sessions over five years in tutorials. There was also an implication level Centre when pursuing the aim of promoting prosocial behaviors and reduce antisocial behavior because they were proposals for further action, as a result of the influence that supposed to instill a critical and decisive spirit in students. A third objective: " To seek an increase in communication and personal satisfaction " had a positive development, since the classroom work was easier on individuals capable of listening and intervene. The fourth objective: " To facilitate the expression and understanding of emotions " had its benchmark in different improvised exhibitions voluntarily by students on the porch recreation, working mainly Onomastic. The objectives of "Developing the acceptance of social norms and" learn conflict resolution techniques :, had their extrapolation to the Hall of Coexistence, analysis techniques and defining them as well as constructive solutions found , in which teachers it had involved texts, the most literary and proposals offered to the reflective work with students . A "analyze stereotypes and prejudices", another objective, contributed largely faculty Citizenship and Ethics, who used an attractive methodology for some sections of their curriculum. The objective of "Encouraging the development of strategies for curriculum design. Motivating teachers in the selection of theatrical strategies and materials that will be valid in its curriculum", I must say, they were the teachers of Language and Literature the most involved, since on the one hand offered literary fragments tutors to work certain themes (biographical texts for self-concept stories fables for conflict resolution ...) and the other included in his work some theatrical strategies for motivation knowledge of literature, but also other teachers of other materials, primarily Citizenship and Ethics, and matters of artistic field, plastic or music, contributed looking for a content selection according to some tutoring sessions or the Language and Literature (exhibitions photographs or posters on bullying, cyber harassment, design of songs about self-concept "one like you", etc.) Another influence tutorial produced from work, was that many of the dynamic proposals for “other-presentation " were worked in teaching 1st and 2nd foreign language. In conclusion of this paper I will say that literature and theater, received from a pedagogical way, they are a pleasure worth bringing our youth.

Повний текст джерелаEl conflicto de los pueblos originarios y en particular de los mapuche tiene su origen en la colonización de Chile por los españoles, quienes tras siglos de lucha nunca lograron establecer su dominio sobre este pueblo, llegando finalmente a un Tratado o Parlamento de Quillén, 1641, que reconoce como territorio autónomo en Chile las tierras ubicadas al sur del río Bío Bio. A partir de aquel acuerdo, se generaron sucesivos cambios finalmente 'estabilizados' en lo que se llamó “Pacificación de la Araucanía”, una campaña militar emprendida por el gobierno chileno a partir de 1888 cuyo objetivo final fue la ocupación del territorio mapuche, pese a lo cual estos pueblos lograron mantener sus particularidades, siendo víctimas a través de los años de una verdadera expoliación de sus tierras bosques, aguas, recursos costeros. Un cambio de mentalidad o intento por reparar la política anterior, debido a la presión ejercida por el movimiento mapuche, se produjo con el gobierno de Eduardo Frei Montalva (1964 a 1970), que recuperó 3,5 millones de hectáreas para devolvérselas al pueblo mapuche. El proceso se aceleró con el Presidente Salvador Allende, que en tres años alcanzó a restituir a los indígenas otros 6,5 millones de hectáreas. El proyecto integral fue interrumpido por el golpe de Estado que encabezó Augusto Pinochet.

Повний текст джерелаThe study is divided in two parts, firstly it introduces the theoretical framework and secondly it gives a detailed account of the fieldwork carried out. In the theoretical framework, and after having outlined the current state of the matter, we devote a chapter to the appropriateness of developing communication skills in a comprehensive way which integrates both verbal language and non-verbal communication. In the following part we advocate for Education in an integral sense, Education which encompasses all types of intelligence of a person, whilst at the same time stressing the importance of creativity. Thus, in the following chapter we go on to justify the adequacy of dramatization in this regard. Finally we give concrete shape to the theoretical foundations of our proposal by describing theatre games based on clown work and improvisation, and we add the concept of clown teacher as well. Regarding the fieldwork we tried out a methodology based on clown and improvisation techniques with a sample group of forty students from fourth grade of Secondary Education. We followed a mixed methodology which combined the method of statistical analysis of hypothesis testing with the survey method. We describe, analyze and assess the results obtained via the three research tools we have used: checklist, survey and classroom diaries. Lastly we conclude that the clown methodology for improvisation improves the communication competences globally and more specifically it improves significantly certain skills of the students: their ability to communicate in front of an audience, their positive attitude before an audience, their ability to creatively improvise on stage and their ability to collaborate.

O presente trabalho tem por objetivo estudar, por uma perspectiva jurídica e bioética, o direito de acesso a medicamentos em fase de pós-pesquisa clínica farmacológica, e o dever de fornecimento. O problema ora enfrentado parte do momento em que a pesquisa é concluída, quando o patrocinador do estudo contabiliza e recolhe a medicação experimental remanescente, cessando o fornecimento do produto aos sujeitos de pesquisa, que, consequentemente, tem o tratamento paralisado. No caso destes sujeitos de pesquisa terem apresentado um quadro de melhora clínica ou terem auferido benefícios em razão do tratamento experimental, a suspensão do tratamento pode significar a ocorrência de danos à pessoa. Portanto, assevera-se que os sujeitos de pesquisa, em razão de sua participação no estudo, sucedida pelo alcance de benefícios com o tratamento experimental, detém o direito de acesso ao medicamento estudado em fase de pós-pesquisa clínica farmacológica. Partindose da constatação de que a relação de pesquisa dá origem a uma relação jurídica negocial tipicamente contratual entre os sujeitos de pesquisa, o patrocinador do estudo, o pesquisador responsável e a instituição de pesquisa, o dever de fornecimento de medicação em fase de pós-pesquisa clínica farmacológica constitui-se como uma obrigação post pactum finitum fundamentada na existência dos deveres pós-contratuais de solidariedade, proteção e lealdade, resultantes da boa-fé objetiva contratual.
El presente trabajo tiene por objetivo estudiar, por uma perspectiva jurídica y bioética, el derecho de acceso a medicamentos en fase de post investigación clínica farmacológica, y el deber de fornecimiento. El problema que se enfrenta parte del momento en que la investigación se ve concluída, cuando el patrocinador de la investigación contabiliza y recoge la medicación experimental remanente, interrumpiendo el fornecimiento del producto a los sujetos de investigación, que, consiguiente, tienen paralizado el tratamiento. En caso de estos sujetos de investigación presentaren un cuadro de mejoría clínica o que tengan auferido benefícios en razón del tratamiento experimental, la suspensión del tratamiento puede significar la ocurrencia de daños a la persona. Para tanto, se asegura que los sujetos de investigación, por ocasión de su participación en el estudio, sucedida por el alcance de benefícios con el tratamiento experimental, detienen el derecho de acceso al medicamiento estudiado en fase de post-investigación clínica farmacológica. Partiendo de la constactación de que la relación de investigación dá origen a una relación jurídica negocial tipicamente contractual entre los sujetos de investigación, el patrocinador del estudio, el investigador responsáble y la institución de investigación, el deber de fornecimiento de la medicación en la fase de post investigación clínica farmacológica constituyese como una obligación post pactum finitum fundamentada en la existencia de deberes post contractuales de solidariedad, protección y lealdad, resultantes de la buena-fé objetiva contractual.

Повний текст джерелаEl objeto del presente trabajo consiste en determinar la naturaleza jurídica del control de identidad del artículo 85 del Código Procesal Penal, en otras palabras, comprender cuál es la finalidad que cumple dicha institución en el ordenamiento jurídico. Para ello, realizamos un estudio pormenorizado de las modificaciones legales que ha presentado la normativa y los motivos del legislador para realizar dichos cambios en tan poco tiempo. En segundo lugar, para la mejor comprensión de la institución, recurriremos a los conceptos elaborados por la doctrina, haciendo una revisión general de los aspectos del procedimiento del control de identidad, desde sus supuestos habilitantes hasta el término del procedimiento. Enseguida, para lograr nuestro objetivo y acercarnos a las posibles finalidades de la norma, analizaremos las opiniones de la doctrina, la legislación comparada y la jurisprudencia. De lo anterior, advertiremos tres distintas finalidades de la figura: cautelar, investigativa o preventiva. Para determinar cuál de las finalidades descritas es preponderante en la norma, realizaremos un estudio detallado de la figura, contrastándola con su ubicación dentro del Código Procesal Penal, cada uno de los supuestos que autorizan a solicitar la identificación del sujeto, las medidas que faculta la institución, como el registro, cotejo de órdenes de detención pendiente; y las reformas efectuadas por la ley. Esto nos permitirá comprender a cabalidad el sentido y alcance de la figura. Por último, analizaremos las ideas centrales del proyecto de ley del año 2003 que establecía un nuevo control de identidad de carácter preventivo. Finalizando con el estudio y críticas de las reformas efectuadas por la ley 20.931 al artículo 85 Código Procesal Penal y la implementación de una nueva figura, denominada “control de identidad preventivo”.

During the last years of economic boom, the number of criminal organizations has been increasing. This situation is aggravated when the justice operators (Police, Public Ministry and Judicial Power) are not efficient in their operations, either due to reduced or no coordination, lack of synergy, or when they have been contaminated by acts of corruption generating a sense of insecurity and lack of justice. The present project attributes as main causes of the problem identified the weak interaction between the police intelligence bodies and the DIGIMIN with the criminal investigation forces, the practice of outdated paradigms and the lack of a decision of the Police Command to define integrated special teams. Against this, the application of Police Operational Intelligence is proposed, which will begin from the stage of information search and gathering of the elements of conviction by intelligence agents, through techniques and skills, as well as horizontal and complementary work. that the investigator carries out, strengthening the prosecutor's criminal action, achieving an effective trinomial (Intelligence - Criminal Investigation - Prosecutor's Office), by mutual and timely coordination and interaction.
