In some jurisdictions, where individual privacy and property rights are afforded constitutional protection, legal disputes regarding police powers of entry and search sometimes extend beyond the law of tort into public law, where the challenge is to the power itself. The South African Constitutional Court has determined the constitutional validity of warrantless powers of entry and search on a number of occasions. This article discusses the most recent addition to this body of case law, as well as several related authorities from other jurisdictions. Where appropriate, reference to the position in English law also forms part of the discussion.

Recursively defined linked data structures embedded in a pointer-based heap and their properties are naturally expressed in pure first-order logic with least fixpoint definitions (FO+lfp) with background theories. Such logics, unlike pure first-order logic, do not admit even complete procedures. In this paper, we undertake a novel approach for synthesizing inductive hypotheses to prove validity in this logic. The idea is to utilize several kinds of finite first-order models as counterexamples that capture the non-provability and invalidity of formulas to guide the search for inductive hypotheses. We implement our procedures and evaluate them extensively over theorems involving heap data structures that require inductive proofs and demonstrate the effectiveness of our methodology.

The review dwells upon the problematic issues, uncertainties and prospects of establishing causal relationship between diseases and radiation exposure. The review discusses the challenges, uncertainties and prospects of establishing causation between exposure to radiation and diseases. The criteria that could be used to assess the radiation-induced health damage are considered. The existing practice of recognizing certain categories of citizens of the Russian Federation as people affected by radiation exposure, which is based on the establishing causal relationship between disease, invalidity, death with radiation exposure by Interdepartmental expert councils, is analyzed. Experts of Interdepartmental expert councils in taking the decision rely on to the list of diseases that should be updated consistently based on the findings of radio-epidemiological studies. To make the decision-making process objective, advanced scientific studies focused on individualization of the radiation risk and search for the biomarkers of radiation-induced effects, both deterministic and stochastic ones, are discussed.

Cardiovascular diseases are the leading cause of invalidity and mortality in the majority of developed countries and are recognized by the international community as a pandemic problem. An important task of modern cardiology is the search and study of new biological markers. This literature review aimed to consider chemerin as a new diagnostic and prognostic marker for cardiovascular pathologies. Thus far, studies on chemerin indicate the possibility of its use as a marker of cardiovascular pathology. Evidence points to the important role of chemerin in the development and progression of cardiovascular diseases. As an adipokine, chemerin modulates glucose, and lipid levels, thereby influencing lipid deposition in the endothelium and progression of atherosclerosis. As a chemoattractant, it facilitates the mobilization and interaction of macrophages with dendritic cells and natural killer cells in the vascular system and induces endothelial angiogenesis. The established role of chemerin in vascular inflammation, angiogenesis, and blood pressure modulation opens serious prospects for the development of therapeutics targeting this biomarker for the treatment of cardiovascular diseases. Several candidates targeting chemerin and the CMRK1 signaling pathway have shown promising potential in reducing vascular dysfunction in in vitro and in vivo studies. Further studies analyzing the efficacy and safety of new chemerin-targeting drugs are needed to assess their potential.

Higher level of functional incapacity and invalidity is noted in palliative patients, as a result of disease progression, which is the reason for a significant decrease in the quality of life not only of these patients, but also of the family members who care for them. Physical therapy and occupational therapy are aimed at improving the patient's quality of life through rehabilitation measures to restore body function, ensure physical independence and activity, optimal physical condition and well-being, and patient adaptation in the environment. Aim: to review modern literary sources regarding the relevance of physical therapy and occupational therapy in palliative and hospice care. The search for literary sources was carried out in international scientometric databases: PubMed, Scopus, Web of Science, Google Scholar. The search depth is 13 years (from 2010 to 2022). The review indicates that physical therapy and occupational therapy in palliative and hospice medicine around the world are not used enough today. These two specialties of interdisciplinary treatment in palliative and hospice medicine play an important integral role, which is manifested in improving the quality of life of both patients and their family members who care for them through the use of a wide variety of methods. Hospice physical therapists not only help patients to support/keep functional abilities as long as possible, but also to reduce the burden on persons who care for terminally ill patients. Physical and occupational therapy have numerous benefits for patients with progressive life-threatening illnesses in palliative and hospice care. Physical therapy in palliative and hospice care can have a preventive, educational, and/or supportive function depending on the patient's situation. There is especially large deficiency in palliative physical therapy and occupational therapy among adolescents and young people, which requires wide implementation with high-quality training of relevant specialists. Physical therapy and occupational therapy play an important role in palliative and hospice care; all patients in palliative and hospice care, regardless of illness or severity, should have access to physical and occupational therapy based on individual needs.

A set of skills thought to contribute to effectiveness in searching subject indexes is defined. Of these, one group was selected for study, namely skills thought to focus a search. An objective test to measure these skills was administered to 129 students and established to have content validity, and some degree of construct validity. The skills involved did not corre late highly with each other, and are to be regarded, at least for the time being, as five separate skills, An attempt to establish the criterion, or predictive validity of the subtests of the focusing skills failed to either validate or invalidate them because of wide errors of measurement in the subtests, but more particularly in a performance test of index searching. It is suggested that future work should attempt to find practicable ways of improving test accuracy, and also that the cognitive dimensions of document relevance be investigated.

The search for quality alternatives to fishmeal and fish oil in the fish feed industry has occupied many researchers worldwide. The use of black soldier fly meal (BSFM) as a substitute has increased. This study evaluated the effect of this substitution on fish growth and nutritional quality through a meta-analysis of the literature. A list of studies was selected after an exhaustive literature search followed by the extraction of growth and nutritional parameters. Two random-effects models were used to estimate the differences between the experimental parameters and the controls. The results showed significant heterogeneity between studies for all parameters. The sources of heterogeneity between studies were mainly fish species and protein substitution rate. High substitutions can be considered without necessarily worrying about an adverse effect. Financial profitability studies of the fish production chain from BSFM should be carried out to validate or invalidate the economic viability of this substitution.

In order to firstly assure the mating features of high importance during the selective assembly process, a selective assembly method considering the feature weightings is proposed. All of the features are evaluated by fuzzy entropy weight method. Their weight coefficients which present the importance are defined. Based on the dissymmetrical quality loss function and the weight coefficients, the multi-objective model for selective assembly is established. A specific generic algorithm considering target weightings is used to solve the optimization model. It can search the preference region using the Pareto dominant order to derive satisfactory solutions with high quality. Finally, the method is used for the selective assembly of a certain aero engine’s subassembly to invalidate the feasibility.

The contents of working memory (WM) guide visual attention toward matching features, with visual search being faster when the target and a feature of an item held in WM spatially overlap (validly cued) than when they occur at different locations (invalidly cued). Recent behavioral studies have indicated that attentional capture by WM content can be modulated by cognitive control: When WM cues are reliably helpful to visual search (predictably valid), capture is enhanced, but when reliably detrimental (predictably invalid), capture is attenuated. The neural mechanisms underlying this effect are not well understood, however. Here, we leveraged the high temporal resolution of ERPs time-locked to the onset of the search display to determine how and at what processing stage cognitive control modulates the search process. We manipulated predictability by grouping trials into unpredictable (50% valid/invalid) and predictable (100% valid, 100% invalid) blocks. Behavioral results confirmed that predictability modulated WM-related capture. Comparison of ERPs to the search arrays showed that the N2pc, a posteriorly distributed signature of initial attentional orienting toward a lateralized target, was not impacted by target validity predictability. However, a longer latency, more anterior, lateralized effect—here, termed the “contralateral attention-related negativity”—was reduced under predictable conditions. This reduction interacted with validity, with substantially greater reduction for invalid than valid trials. These data suggest cognitive control over attentional capture by WM content does not affect the initial attentional-orienting process but can reduce the need to marshal later control mechanisms for processing relevant items in the visual world.

Association rule mining is a common technique used in discovering interesting frequent patterns in data acquired in various application domains. The search space combinatorically explodes as the size of the data increases. Furthermore, the introduction of new data can invalidate old frequent patterns and introduce new ones. Hence, while finding the association rules efficiently is an important problem, maintaining and updating them is also crucial. Several algorithms have been introduced to find the association rules efficiently. One of them is Apriori. There are also algorithms written to update or maintain the existing association rules. Update with early pruning (UWEP) is one such algorithm. In this paper, the authors propose that in certain conditions it is preferable to use an incremental algorithm as opposed to the classic Apriori algorithm. They also propose new implementation techniques and improvements to the original UWEP paper in an algorithm we call UWEP2. These include the use of memorization and lazy evaluation to reduce scans of the dataset.

Cervical dystonia (CD) is characterized by cranial muscle overactivity leading to abnormal intermittent or continuous posturing of the head. Nowadays, the treatment of patients suffering from this condition focuses principally on the motor component of the disorder, certainly the invaliding part; however, it leaves out the non-motor one that has a similarly invalidated effect on the quality of the subject’s life. This review was conducted on studies investigating the impact of non-motor symptoms on levels of quality of life. We searched on the PubMed, EMBASE and Web of Science databases and screening references of included studies and review articles for additional citations. From an initial 150 publications, we included only five studies that met the search criteria. The results showed that anxiety, depression, pain and sleep quality have a great influence on patients’ health and on the outcome of the disease. Future studies should focus more on investigating the non-motor components of CD as an integral part of the clinical management of dystonic patients in order to improve their well-being.

In this paper we present an extension to the hybrid A* (HA*) path planner. This extension allows autonomous underwater vehicle (AUVs) to plan paths in 3-dimensional (3D) environments. The proposed approach enables the robot to operate in a safe manner by accounting for the vehicle’s motion constraints, thus avoiding collisions and ensuring that the calculated paths are feasible. Secondly, we propose an improvement for operations in unexplored or partially known environments by endowing the planner with a tree pruning procedure, which maintains a valid and feasible search-tree during operation. When the robot senses new obstacles in the environment that invalidate its current path, the planner prunes the tree of branches which collides with the environment. The path planning algorithm is then initialised with the pruned tree, enabling it to find a solution in a lower time than replanning from scratch. We present results obtained through simulation which show that HA* performs better in known underwater environments than compared algorithms in regards to planning time, path length and success rate. For unknown environments, we show that the tree pruning procedure reduces the total planning time needed in a variety of environments compared to running the full planning algorithm during replanning.

Abstract This paper is aimed at proposing an analysis of the Russian geopolitical self-perception in the light of a “culturalist” approach. The paper uses Samuel Huntington’s “model of civilizations” as an interpretative prism, following a multidisciplinary approach which allows to epistemologically validate certain points of the Huntingtonian thesis, and to reject others. This approach does not invalidate the neo-realist theories of international relations regarding the Russian search for a relative increase of power through the use of material factors. If anything, the culturalist perspective must be placed side by side with the neo-realist one in order to better grasp some intangible elements, in particular the attention paid by Moscow to its (former) imperial dimension, the influence exercised by the autocratic tradition on Russia’s international posture, together with the role of geographic space, the ascendency of the Orthodox church, as well as Eurasianist cultural inclinations. Finally, through a critical analysis and a selective review of the academic literature on these issues (as well as of the political texts published by some of the most prominent Russian politicians and intellectuals), the paper aims to demonstrate the self-perceived originality of the Russian model and its difficulty in being placed within the Western political categories.

Objective: Concurrent chemoradiotherapy (CCRT) is widely regarded as the gold standard for locally advanced cervical cancer (LACC). Radio Therapy encompasses pelvic external beam radiation therapy (EBRT), followed by intracavitary brachy therapy (BT) to boost the cervix. However, in developing countries, there is a tendency to prefer surgery over other types of treatments for several reasons - surgery is easily obtainable, more acceptable, and understandable culturally. On the other hand, in developed countries, The utilization of brachy therapy (BT) to boost the cervix in patients with Cervical Cancer (CC) has been gradually declined because of the advent of sophisticated techniques for EBRT. Recently, the treatment of LACC has been a point of controversy. We have no prospective data to justify that surgery or modern EBRT can be used in place of intracavitary BT boost in women with locally advanced CC. This study aims to review existing information about brachytherapy alternatives after neoadjuvant chemoradiation. Material and Methods: An electronic search of the PubMed database was conducted to obtain key cervical cancer literature. The MEDLINE/PubMED (www.ncbi.nlm.nih.gov) database was chosen as it remains the most widely used resource for medical literature. Additional records were searched in other resources. Results: The first phase of screening identified 18 articles for the first search term (“Adjuvant hysterectomy” AND “Cervical Cancer”), 10 article for the second search term (“IMRT boost” AND Cervical cancer”) and 11 articles for the third search term (“SBRT” AND “Cervical Cancer”). In sum 39 articles were identified to be relevant for the second phase of screening. Studies that included less than five patients with investigated intervention or did not provided enough information about at least one primary endpoint were excluded. A total of 20 (11-adjuvant hysterectomy, 4-IMRT boost, 5-SBRT boost) papers met the selection criteria and were found eligible for this review. Conclusion: When all these alternative approaches to ICB are evaluated, adjuvant hysterectomy appears to have treatment outcomes comparable to standard of care, while SBRT appears to have only modest yearly results. As a result, the majority of writers believe that neoadjuvant chemoradiation followed by radical surgery or SBRT may be a realistic therapeutic option for patients with LACC, not merely when ICB is unavailable, technically impractical, or rejected. Large, randomized-controlled trials are required to conclusively demonstrate or invalidate non-ICB alternatives for cervical cancer treatment.

The Severe Acute Respiratory Syndrome (CoVID 19) provoked by Coronavirus 2 (SARS CoV 2) require science-based responses. The aim of this work is to assess pitfalls found during the search of viral genomes due to sampling timing, swabbing, storage, heat-infectivity inactivation and further sample processing. According to several meta-analysis, on the day of symptom onset, the median false-negative rate is estimated to be 38% and decreased to 20% on day 8 (3 days after symptom onset) then increased to 66% on day 21 suggesting that rRT-PCRs adds little information immediately after exposure. RNA isolation from samples requires cautious handling using RNase-free solutions, pipet tips and glassware. The rRT PCR detection limits are estimated between 39 and 779 copies/mL but 3000 to 20.000 copies/ml for the antigen test. External cross contamination by imperceptible splatting requires risk management integrating the Pharmacopoeias by processing at least 10 negative contiguous to 10 positive controls in each sennries of 100 tests. . For Ct >34 it was suggested no transmissible disease. The detection of antibodies one month or later after clinical signs may confirm positivity. Lack of immune response in non-immune compromised asymptomatic people may invalidate positivity. False positive disrupts efficiency for containing infections and leads to societal anxiety undermining health workforce. Because spurious methods create confusion, each step of diagnosis requires quality-control and risk assessment, knowing that rRT PCRs amplify more than 10.000 million times the signal of 1 viral element

A very common problem in designing caching/prefetching systems, distribution networks, search engines, and web-crawlers is determining how long a given content lasts before being updated, i.e., its update frequency. Indeed, while some content is not frequently updated (e.g., videos), in other cases revisions periodically invalidate contents. In this work, we present an analysis of Wikipedia, currently the 5th most visited website in the world, evaluating the statistics of updates of its pages and their relationship with page view statistics. We discovered that the number of updates of a page follows a lognormal distribution. We provide fitting parameters as well as a goodness of fit analysis, showing the statistical significance of the model to describe the empirical data. We perform an analysis of the views–updates relationship, showing that in a time period of a month, there is a lack of evident correlation between the most updated pages and the most viewed pages. However, observing specific pages, we show that there is a strong correlation between the peaks of views and updates, and we find that in more than 50% of cases, the time difference between the two peaks is less than a week. This reflects the underlying process whereby an event causes both an update and a visit peak that occurs with different time delays. This behavior can pave the way for predictive traffic analysis applications based on content update statistics. Finally, we show how the model can be used to evaluate the performance of an in-network caching scenario.

Although it is common to measure bone lengths for study, methodological errors in data measurement and processing often invalidate their clinical and scientific usefulness. This manuscript reviews the validity of several published equations used to determine the maximum height in older adults, since height is an anthropometric parameter widely employed in health sciences. A systematic review of original articles published in the English, Spanish, or Portuguese languages was performed in PubMed, ScienceDirect, EBSCO, Springer Link, and two institutional publisher integrators (UACJ and CONRICYT). The search terms were included in the metasearch engines in a combined way and text form using the Boolean connectors AND and OR {(Determination OR Estimation OR Equation) AND Height AND (Elderly OR “Older adults”)}. Eleven manuscripts were selected from 1935 records identified through database searching after applying the following criteria: (1) original articles that designed and validated equations for the determination of height by anthropometric methods in adults 60 years of age and older and (2) manuscripts that presented robust evidence of validation of the proposed regression models. The validity of the reported linear regression models was assessed throughout a manuscript review process called multi-objective optimization that considered the collection of the models, the prediction errors, and the adjustment values (i.e., R2, standard error of estimation, and pure error). A total of 64 equations were designed and validated in 45,449 participants (57.1% women) from four continents: America (85.3%, with 46 equations), Asia (8.1%, with 10), Europe (4.6%, with 7), and Africa (2.0%, with 1); the Hispanic American ethnic group was the most numerous in participants and equations (69.0%, with 28). Due to various omissions and methodological errors, this study did not find any valid and reliable equations to assess the maximum height in older adults by anthropometric methods. It is proposed to adjust allometric mathematical models that can be interpreted in the light of ontogenetic processes.

Despite the evolution of deep-learning-based visual-textual processing systems, precise multi-modal matching remains a challenging task. In this work, we tackle the task of cross-modal retrieval through image-sentence matching based on word-region alignments, using supervision only at the global image-sentence level. Specifically, we present a novel approach called Transformer Encoder Reasoning and Alignment Network (TERAN). TERAN enforces a fine-grained match between the underlying components of images and sentences (i.e., image regions and words, respectively) to preserve the informative richness of both modalities. TERAN obtains state-of-the-art results on the image retrieval task on both MS-COCO and Flickr30k datasets. Moreover, on MS-COCO, it also outperforms current approaches on the sentence retrieval task. Focusing on scalable cross-modal information retrieval, TERAN is designed to keep the visual and textual data pipelines well separated. Cross-attention links invalidate any chance to separately extract visual and textual features needed for the online search and the offline indexing steps in large-scale retrieval systems. In this respect, TERAN merges the information from the two domains only during the final alignment phase, immediately before the loss computation. We argue that the fine-grained alignments produced by TERAN pave the way toward the research for effective and efficient methods for large-scale cross-modal information retrieval. We compare the effectiveness of our approach against relevant state-of-the-art methods. On the MS-COCO 1K test set, we obtain an improvement of 5.7% and 3.5% respectively on the image and the sentence retrieval tasks on the Recall@1 metric. ObjectivesTo systematically review and meta-analyse the evidence for effect modification by refractory status and number of treatment lines in relapsed/refractory multiple myeloma (RRMM); and to assess whether effect modification is likely to invalidate network meta-analyses (NMA) that assume negligible modification.DesignSystematic review, meta-analysis and simulation.Data sourcesWe systematically searched the literature (e.g., OVID Medline) to identify eligible publications in February 2020 and regularly updated the search until January 2022. We also contacted project stakeholders (including industry)Eligibility criteriaPhase 2 and 3 randomised controlled trials reporting stratified estimates for comparisons with at least one of a prespecified set of treatments relevant for use in Norwegian RRMM patients.OutcomesWe used meta-analysis to estimate relative HRs (RHRs) for overall survival (OS) and progression-free survival (PFS) with respect to refractory status and number of treatment lines. We used the estimated RHRs in simulations to estimate the percentage of NMA results expected to differ significantly in the presence versus absence of effect modification.ResultsAmong the 42 included publications, stratified estimates were published by and extracted from up to 18 (43%) publications and on as many as 8364 patients. Within-study evidence for effect modification is very weak (p>0.05 for 47 of 49 sets of stratified estimates). The largest RHR estimated was 1.32 (95% CI 1.18 to 1.49) for the modifying effect of refractory status on HR for PFS. Simulations suggest that, in the worst case, this would result in only 4.48% (95% CI 4.42% to 4.54%) of NMA estimates differing statistically significantly in the presence versus absence of effect modification.ConclusionsBased on the available evidence, effect modification appears to be sufficiently small that it can be neglected in adequately performed NMAs. NMAs can probably be relied on to provide estimates of HRs for OS and PFS in RRMM, subject to caveats discussed herein.

<p><em>This study aims to determine 1) How is Istidlal (the process of searching for and using arguments) to invalidate ablution according to Imam Hanafi and Imam Syafii and 2) What are the factors that cause the difference of opinion between Imam Hanafi and Imam Shafii regarding the cancellation of ablution. The research method used in this study is descriptive qualitative with a comparative approach that compares the opinions of two scholars about the cancellation of wudlu. The research results obtained are: 1) Istidlal: Imam Hanafi's istidlal regarding the cancellation of ablution was inspired by analogues and qiyas, because he was nicknamed "ahlu alra'yu", while Imam Shafi'i's istidlal regarding the cancellation of ablution is to look for the rules and ushul of the problem of canceling wudlu, then after finding him combine it with a valid argument or basis and this is also chosen from a valid argument. 2) Factors: The factors that cause differences of opinion between Imam Hanafi and Imam Shafi'i regarding the cancellation of ablution are the time or era factor, the scientific factor possessed, the legal basis used, the search for a legal basis in determining the law, and the experience factor.</em></p><p>Penelitian ini bertujuan mengetahui, 1) <em>Istidlal</em> (proses pencarian dan penggunaan dalil) batalnya wudlu menurut Imam Hanafi dan Imam Syafii dan 2) Faktor-faktor apakah yang menyebabkan perbadaan pendapat antara Imam Hanafi dan Imam Syafii tentang batalnya wudlu. Context. Most massive stars belong to multiple systems, yet the formation process leading to such high multiplicity remains insufficiently understood. To help constrain the different formation scenarios that exist, insights into the low-mass end of the companion mass function of such stars is crucial. However, this is a challenging endeavour as (sub-)solar mass companions at angular separations (ρ) below 1″ (corresponding to 1000–3000 au in nearby young open clusters and OB associations) are difficult to detect due to the large brightness contrast with the central star. Aims. With the Carina High-contrast Imaging Project of massive Stars (CHIPS), we aim to obtain statistically significant constraints on the presence and properties of low-mass companions around massive stars in a previously unreachable observing window (Δmag ≳ 10 at ρ ≲ 1″). In the second paper of the series, we focus on the Trumpler 14 cluster, which harbours some of the youngest and most massive O-type stars in the Milky Way. Methods. We obtained VLT-SPHERE observations of seven O-type objects in Trumpler 14 using IRDIFS_EXT mode. These provide us with a 12″ × 12″ field of view (approximately ((3 × 3)×104 au) centred on each O star and allow us to search for companions at separations larger than 0″​​.15 (approx. 360 au) and down to magnitude contrast > 10 mag in the near-infrared. We used angular and spectral differential imaging along with Point Spread Function (PSF) fitting to detect sources and measure their flux relative to that of the central object. We then used grids of ATLAS9 and PHOENIX Local Thermodynamic Equilibrium (LTE) atmosphere models combined with (pre-)main-sequence evolutionary tracks to estimate the mass of the detected candidate companions. Results. We detected 211 sources with near-infrared magnitude contrast in the range of 2–12. Given the large surface number density of stars in Trumpler 14, one cannot reliably distinguish between cluster members and genuine companions for most of the detected sources. The closest companion, at only 0″​​.26, is characterised as a 1.4 M⊙ star with an age of 0.6 Myr, in excellent agreement with previous age estimates for Tr 14. The mass function peaks at about 0.4 M⊙ and presents a dearth of stars in the 0.5–0.8 M⊙ mass range compared to previous estimates of the initial mass function in Tr 14. While statistically significant, part of these differences may result from contamination of the K-band fluxes by circumstellar material. Conclusions. SPHERE is clearly suitable to probe the low-mass end of the mass function in the vicinity of massive stars. Follow-up SPHERE observations to obtain the full Y to K spectral energy distribution would allow for better constraints on the masses of the detected sources, and to confirm (or invalidate) the curious mass function that we derived for low-mass stars in the vicinity of the O-type objects in Trumpler 14.

Intellectual Property Rights (IPR) have played a crucial role in promoting innovations across the globe and of late the industry has seen a steep rise in innovation activity. There is an unprecedented urgency to help global IP offices in shortening the processing time, managing bureaucratic delays, and improving operational transparency. Patents are one of the most critical IP types among the 6 types where there is significant traction over the last couple of years. From ideation to the grant of the patent and its commercial use, the past patent data is required to be searched for and referred to for; 1] patentability assessment, 2] invalidity assessment, etc. Therefore, ‘Search’ becomes the most critical process across the patent lifecycle. Literature study indicates that issues involved in patent search (when traditional search techniques are employed) usually are around 1] data processing errors, 2] errors due to language pitfalls, 3] errors due to faulty syntax, and 4] classification errors. These erroneous searches result in a large number of false positives and false negatives. Artificial Intelligence (AI) and Machine Learning (ML) are leading the wave of technology development - both from a research and development perspective as well as their commercial use. Adopting these next-generation technologies presents great potential to help address the growing challenges in the patent search process. AI/ML based models are suitable predominantly for multi-lingual search, handling diverse data formats, image comparisons, and keyword matching. As IP databases across countries still lack standardization, advanced technologies such as generative AI are best suited to help accelerate the patent search process. Feasibility assessment of leveraging various AI/ML models to address efficiency and effectiveness issues of patent search can be performed through a 3-part framework (3i) focussing on various dimensions such as Integrate, Infer, and Intelligence. AI/ML model applicability can be assessed against specific objectives of each part viz. 1. Integrate – integration with various patent databases, 2. Infer – data extraction and transformation into a standardized data set suitable for comparative analysis and 3. Intelligence – comparison, matching, and decision-making for search objectives. At a global scale, further deliberations and studies on this subject are of immense value in the areas of knowledge and policy-making thereby benefiting practitioners, the academic fraternity, and society

The international community has expressed its efforts in the field of protecting human rights and various freedoms through international conventions and regional and Arab pacts. Countries have made great efforts to develop the justice system over the past decades. International and local efforts in the Gulf countries in general and in the United Arab Emirates and Saudi Arabia in particular focus on providing a legal and just environment that works to guarantee the rights of every person in general. Everyone is equal before the law. The regulatory and technical authorities in both countries, through Visions 2030, have worked to raise the level of coordination and cooperation between the criminal justice and security sectors in legal, organizational, executive, and judicial terms; to develop the judicial sector in both countries and the security sector in particular; and to prepare and train their men to preserve human rights during the exercise of their work. They wrote this protection into the texts of their rules and laws, which made it easier for them to work faster and cut down on the time it took to find out the truth about the crime they were looking into. They also made sure that people's physical and moral freedoms were protected during housing inspections. An inspection is one of the most important and most dangerous criminal procedures that security men can carry out, and its content is a violation of human rights. It is also one of the most important and urgent investigation procedures, whether it is on the person of the accused, or in his residence, with the aim of revealing the truth of the crime that actually occurred and is not probable, and the search and careful investigation of its evidence that may prove or may deny the conviction of the person of the accused or the accused who have been ordered to search, or those previously ordered to arrest them. The problem of the study here is the question of the adequacy of international and regional legal texts with regard to judicial inspection, which is capable of protecting the human right to preserve the sanctity of his home or not. As a result, the study intends to examine international and regional legal texts in both the Saudi system and UAE law, as well as discuss their statutory authority in protecting the human right to the sanctity of their private lives during home inspections. The study revealed the inadequacy of international and regional texts in protecting human rights to the sanctity of their private lives. It appears to be law enforcement officials carrying out the procedure in the manner in which they adhere to the sanctity of the home, and the Saudi system corrects the evidence for it despite the invalidity of the procedure. Because of this, it is important to change some texts to protect the right to the sanctity of the home.

ABSTRACTFor twenty years we searched to understand the Staebler-Wronski effect (SWE). New results continue to emerge which invalidate prior interpretations. Recent evidence shows that the SWE is not associated with impurities. Long-range hydrogen diffusion is ruled out because the SWE occurs with comparable efficiency between 400K and the lowest temperatures. Nonradiative geminate recombinations might be important since high fields reduce the SWE significantly. It disappears when the bandgap or the photon energy falls below a critical value. The creation of a metastable density of dangling bond defects has been considered to be its sole manifestation. However, there is mounting evidence for light-induced structural changes which extend throughout the material. The weak bond breaking model emerges as the only viable explanation of the SWE if the expected spatial correlation between defects and hydrogen is destroyed by subsequent recombination events. The SWE is reduced by a favorable microstructure and low hydrogen content. It is suggested that defect pairs have larger recombination coefficients than isolated defects.

In modular robotics modules can be reconfigured to change the morphology of the robot, making it able to adapt to specific tasks. However, optimizing both the body and control of such robots is a difficult challenge due to the intricate relationship between fine-tuning control and morphological changes that can invalidate such optimizations. These challenges can trap many optimization algorithms in local optima, halting progress towards better solutions. To solve this challenge we compare three different Evolutionary Algorithms on their capacity to optimize high performing and diverse morphologies and controllers in modular robotics. We compare two objective-based search algorithms, with and without a diversity promoting objective, with a Quality Diversity algorithm—MAP-Elites. The results show that MAP-Elites is capable of evolving the highest performing solutions in addition to generating the largest morphological diversity. Further, MAP-Elites is superior at regaining performance when transferring the population to new and more difficult environments. By analyzing genealogical ancestry we show that MAP-Elites produces more diverse and higher performing stepping stones than the two other objective-based search algorithms. The experiments transitioning the populations to new environments show the utility of morphological diversity, while the analysis of stepping stones show a strong correlation between diversity of ancestry and maximum performance on the locomotion task. Together, these results demonstrate the suitability of MAP-elites for the challenging task of morphology-control search for modular robots, and shed light on the algorithm’s capability of generating stepping stones for reaching high-performing solutions.

Introduction: There is limited information of the contrast-associated acute kidney (CA-AKI) prevention in critically-ill patients. Applying the evidence for CA-AKI prevention from non-critically-ill to critically-ill patients could potentially invalidate the data. Therefore, we find it necessary to assess the benefits of preventive strategy by summarizing existing evidence from clinical trials in this systematic review and network meta‐analysis (NMA). Methods and analysis: We will search electronic databases, including PubMed, Embase, and Scopus from their inception dates with no language restrictions. Both randomized trials and non-randomized studies using validated measurement tools that investigated the benefits of pharmacological interventions among patients who undergo contrast enhanced computed tomography (CECT). The primary outcome is the incidence of CA-AKI in medical and surgical critically-ill patients who undergo CECT after receiving medication. The risk of bias assessment and analysis of the strength of the evidence will be performed independently by a pair of reviewers. A two-step approach of traditional pairwise and NMA will be performed. Based on a random-effects model, standardized weighted mean differences and ORs with corresponding 95% CIs will be pooled as effect estimates for the continuous and categorical endpoints, respectively. Statistical and methodological heterogeneities will be assessed. Preplanned subgroup analyses and univariate meta-regression will be conducted to quantify the potential sources of heterogeneity. Evidence-based synthesis will be based on the magnitudes of effect size, evidence certainty and the surface under the cumulative ranking curve values. Ethics: Ethical approval is not required because this study is based on existing published data. PROSPERO registration number: CRD42022328974

Cryptanalysts have been looking for differential characteristics in ciphers for decades and it remains unclear how the subkey values and more generally the Markov assumption impacts exactly their probability estimation. There were theoretical efforts considering some simple linear relationships between differential characteristics and subkey values, but the community has not yet explored many possible nonlinear dependencies one can find in differential characteristics. Meanwhile, the overwhelming majority of cryptanalysis works still assume complete independence between the cipher rounds. We give here a practical framework and a corresponding tool to investigate all such linear or nonlinear effects and we show that they can have an important impact on the security analysis of many ciphers. Surprisingly, this invalidates many differential characteristics that appeared in the literature in the past years: we have checked differential characteristics from 8 articles (4 each for both SKINNY and GIFT) and most of these published paths are impossible or working only for a very small proportion of the key space. We applied our method to SKINNY and GIFT, but we expect more impossibilities for other ciphers. To showcase our advances in the dependencies analysis, in the case of SKINNY we are able to obtain a more accurate probability distribution of a differential characteristic with respect to the keys (with practical verification when it is computationally feasible). Our work indicates that newly proposed differential characteristics should now come with an analysis of how the key values and the Markov assumption might or might not affect/invalidate them. n this direction, more constructively, we include a proof of concept of how one can incorporate additional constraints into Constraint Programming so that the search for differential characteristics can avoid (to a large extent) differential characteristics that are actually impossible due to dependency issues our tool detected.

The following essay constitutes a theoretical journey through the landscape of the NAMES Project AIDS Quilt, one narrated from the perspective of those who live on to mourn, to remember. To some critics, my approach might at once appear radical or unorthodox since I focus on how Quilt spectators engage with the artifact and are thereby implicated in the history of the epidemic, rather than on how the dead are made to speak from beyond the grave. My intent is not to invalidate the claims made or the conclusions reached by other critics who have written persuasively about how the Quilt facilitates a voice (both individual and collective) for those who have died of AIDS-related illnesses; indeed, such critics have contributed a wealth of significant knowledge to critical understandings of the pedagogical and political functions of the Quilt. My intent, rather, is to respond to a set of as yet unexplored questions about how the ever-evolving landscape of the AIDS epidemic has altered the nature and purpose of Quilt spectatorship. When the Quilt was created in 1985, “naming names” was an important strategy for political survival, especially given the institutional apathy that silenced and marginalized all who were infected and/or affected by the epidemic. However, over the past sixteen years, apathy has slowly given way to increased attention by medical and media institutions. No longer is memory and reverence enough. Now, we must ask ourselves how the Quilt can continue to be used to combat the emergent obstacles that have sprung up in the wake of apathy and silence. This is not to suggest that remembrance, mourning, and reverence are not still significant responses to the epidemic; we cannot forgot the past, lest we repeat it. But it is to suggest that as we look back, we also must move forward and continue to chart new horizons for how our minds and bodies engage with the Quilt as a social and political space. Throughout this essay, then, my conclusions are at best tentative, offered more as a gesture of hope than as a model for survival. It is my hope that critics can continue to press against social spaces both with caution and determination because those actions matter. We must act with caution because there can be devastating consequences of asserting claims to visibility and location. We must act with determination because there are equally perilous consequences of not doing so. Since its meager beginnings, the NAMES Project AIDS Quilt has undergone exponential changes in size, shape, and scope, but critical responses to the Quilt have remained stagnant with most critics attributing to the Quilt a single meaning and purpose: to revere the dead. Cultural critic Peter S. Hawkins, for instance, argues that "the Quilt . . . is most profoundly about the naming of names" (760), while journalist Jerry Gentry suggests that the Quilt bespeaks "a national and international constructive expression of grief" (550), a grief which most powerfully resonates in the loss of individual lives. While "naming names" is a politically important function of the Quilt, critics who read the artifact as only motivated by memory assume that exhibitions of the artifact facilitate a static model of performance. For such critics, the Quilt represents a mass graveyard--both as a place of interment and as a place in which ideological meanings are circumscribed by the fixity and stillness of reverence. (This reading is partly enabled by the fact that each panel measures the size of a human grave.) Not only does this reading universalize the meaning of the Quilt but also it establishes a monolithic viewing position from which to receive that meaning. Here, I outline an alternative model of reception which is implicit in the design and display of the Quilt. While this model acknowledges reverence as one potential response to the Quilt, it does not foreclose other ways of reading. Rather than facilitating a grave performance, then, the Quilt enables performances within the grave. These performances are constituted in/through a dynamic exchange between speaker and listener, text and context, and work to produce a range of ideological meanings and subject positions. To understand how the Quilt locates its viewers within a particular subject position, it is first necessary to specify the speaker-listener relationship established in displays of the Quilt. This relationship is played out through a series of confessional utterances which, as Michel Foucault explains in The History of Sexuality, Volume 1, imply a dialectic relationship between speaker and listener in which subjectivity is predicated on subjection (61-62). The speaker's desire to confess necessitates the presence of a listener, one not wholly passive since his/her presence incites and enables the will to confess. In this way, both speaker and listener are marked as active/passive agents in an exchange characterized by reciprocity and negotiation. Because speakers and listeners simultaneously serve as subject and object of the confession, the exchange cannot be represented as static (active/passive) or unidirectional (sender-message-receiver). Since many critics already have carefully delineated the processes through which the Quilt directs the address of the panels and constitutes the dead as subjects, here I want to focus on how spectators are constructed as subjects who bear witness. Critics typically posit viewers of the Quilt as unified, coherent, monolithic subjects; yet Foucault's discussion of the confessional exchange assumes a subject-in-process. For me, this process is most accurately characterized as schizophrenic. My use of schizophrenia is tropic rather than diagnostic, in that the term works figuratively to describe subject formation rather than to identify the nature of psychiatric disturbance. Two characteristics (which are derived from the symptomatology of the psychic disorder schizophrenia) define the schizophrenic spectator: one, the loss of "normal" associations; and two, the presence of "auditory hallucinations." The first characteristic of schizophrenic spectators is the loss of "normal" associations. Remi J. Cadoret notes that in schizophrenics, "[t]hought processes appear to lose their normal associations, or usual connecting links, so that the individual is often unable to focus his [sic] thinking upon a particular mental task" (481). For schizophrenics, conventional relational markers (such as chronology, causality, temporality, and spatiality) no longer order cognition; instead, these markers are distorted (if not entirely ineffectual), creating for the schizophrenic a fractured sense of self in/and world. Without these normal associations, the schizophrenic wanders aimlessly (and often in isolation) through a chaotic world in search of structure, meaning, and purpose. Temporal associations provide perhaps the most common means of ordering experience. Viewed as a linear progression characterized by movement, change, and renewal, time structures the historical and the everyday by sequencing, demarcating, and hierarchizing events. Within the Quilt, this sense of progression is supplanted by perpetual repetition of the present. Elsley has offered a similar observation, noting that the Quilt operates in a "transitory present" tense, it "exists in a continual state of becoming" (194). In one sense, this perpetual present tense derives from the fact that no two displays of the Quilt are identical. Panels are ordered differently, new names and panels are added, older panels begin to show signs of wear-and-tear. A perpetual present tense also derives from the fact that the Quilt charts the progression of an epidemic that is itself ongoing, incomplete. Thus, the landscape of the Quilt is re-mapped in light of advances in HIV-treatment, softening/tightening of social mores, and changes in AIDS demographics. Another common means of ordering experience is though spatial associations. Location orders the social through architecture, urban planning, and zoning, endowing spaces with a well-defined purpose and layout. Yet the Quilt provides few signals regarding how spectators are intended to navigate its surface. As Weinberg notes, the Quilt is a "great grid" with "no narrative, no start or finish" (37). By describing the Quilt as a "grid," Weinberg implicitly ascribes to the artifact a controlling logic, a unified design--what in quilting parlance is termed a patchwork sampler. This design pattern, however, does not direct the flow of spectators in a single stream of traffic. This is so because, unlike a Drunkard's Path or Double Wedding Band pattern in which the individual panel blocks work together to create a unified design across the surface of the quilt, a patchwork sampler is constituted by a series of single panel blocks, each with a unique design, history, and logic. As a result, patrons' movements are guided by associations and punctuated by pauses, interruptions, and abrupt changes in course. The randomness of engagement is further enabled by the muslin walkways which visually separate the panels, marking each as distinct and disallowing any sense of continuity (narrative, spatial) among them. The routes which visitors of the Quilt traverse thus are transitory and ephemeral, simultaneously charted and erased in the moment of passing by. The second characteristic of schizophrenic spectators is the presence of auditory hallucinations. Cadoret defines these hallucinations as "the perception of auditory stimuli, or sounds, where none are externally present . . . . The voices . . . may repeat his [sic] thoughts or actions, argue with him [sic], or threaten, scold, or cure him [sic]" (481). Auditory hallucinations can lead the schizophrenic to believe that s/he is under constant surveillance or can cause the schizophrenic to slip further into a self-contained, isolated world of delusion. That the Quilt is made up of "a myriad of individual voices" (Elsley 192) is immediately apparent in the number of individuals who have taken part in its construction and display. With each quilt panel, spectators are confronted with multiple voices--the person who has died, the person(s) who made the block, the person(s) who stitched the block to others for a specific display, and so on. Moreover, the Quilt places these "individual voices . . . in the context of community" (Elsley 191). For Quilt spectators, then, memories of a life lived coexist with grief over a life cut short, anger at institutional apathy and systemic homophobia, faith in the import of remembering those who have died, and so on. Each of these voices vie for the spectator's attention, facilitating a gaze that is dynamic, multidirectional, mobile. Because the gaze is not fixed, the Quilt cannot convey a solitary truth claim to its viewers; rather, spectators must immerse themselves within the delusion and confusion of voices, imposing some sense of order on their own viewing experiences. Given that persons with AIDS continue to be marginalized within American culture, my use of the schizophrenic spectator to trace the reception dynamic of Quilt exhibits might appear to perpetuate, rather than unsettle, dominant ideological formations. Of course, this is the critical conundrum at the center of all investigations into subject formation: that is, "how to take an oppositional relation to power that is, admittedly, implicated in the very power one opposes" (Butler 17). Despite the potential pitfalls, I nonetheless use the trope of schizophrenia precisely because it recognizes the ways in which Quilt spectators, persons with AIDS, and persons who have died of AIDS-related illnesses are divested of the power and authority to speak even before they begin speaking. Furthermore, because the schizophrenic subject is founded on ever-shifting affinities (in time, across space), the position enables spectators to chart alternative lines of relation among institutional practices, ideological formations, and individual experiences, thus potentially mobilizing and sustaining a shared political program. It is on these twin goals of pedagogy and polemics that the NAMES Project originally was founded, and it is to these goals that we now must return. References Butler, Judith. The object of mapping is to produce a "correct" relational model of the terrain. Its assumptions are that the objects in the world to be mapped are real and objective, and that they enjoy an existence independent of the cartographer; that their reality can be expressed in mathematical terms; that systematic observation and measurement offer the only route to cartographic truth; and that this truth can be independently verified. -- J. B. Harley, "Deconstructing the Map" Cartography, in its pragmatic operation under these assumptions, avoids almost all of the problems of representation with which cultural studies is only too familiar. Maps are representations, and all representations, even "scientific" ones, are cultural signs rather than truths produced in an ideological vacuum. The notion that mathematics, as a tool of Renaissance rationality, allowed real, objective detachment from an object of study was slowly absorbed into the cartographic tradition of Europe about four hundred years ago. "From at least the seventeenth century onward there was an epistemic break in activities such as cartography and architecture, and European map makers increasingly promoted what we would describe today as a standard scientific model of knowledge and cognition" (Harley 234). This model, in its increasing reliance upon mathematics and mathematical probability, essentially avoids or denies the objection that scientific observation and interpretation, and especially the technological gaze of its lens, produce anything other than objective, "real" knowledge. Through a mathematical detachment from the world, aided by the gaze of the lens, we see not the world itself (which includes us in its unmappable flux) but the numbers, straight lines and generalisations (which do not) that modern maps, including photographs, must employ to give the world fixed form and meaning. We find this model of cartography most impressively represented today in NASA's Mars Global Surveyor (MGS) probe, not merely as a sign of the technical success of mathematics, but also of its conceptual failure to provide the "true" representations of terrain to which a truly scientific cartography must aspire. MGS's 1998 attempt to "solve" the controversy surrounding a particularly contentious area on Mars, called Cydonia, with newer, "truer" images of the infamous Face on Mars was, contrary to popular opinion, an unsuccessful one; unsuccessful because NASA failed to remove all reasonable doubt that the Face was a natural geological formation. Not that this was particularly evident from media coverage of the image's release and reception -- the maverick researchers who comprised the protest were given a less than admirable hearing at the trial. Australian headlines reported that the Mars "romantics" (The Australian) had their Face theory "scuttled" (Courier-Mail). Professor Stanley V. McDaniel was demoted to "Mr McDaniel" in the The Australian, someone who wants NASA to continue re-imaging Cydonia to document other nearby features because "he believes [they] are further evidence of a Martian civilisation" (6). Also misrepresented was the like-minded, if slightly more adventurous researcher, Richard Hoagland, author of the underground classic, The Monuments of Mars: A City on the Edge of Forever (1987). Hoagland carelessly became (in both newspapers) Richard "Hoaglund", "leader of the movement" that believes the face is a monument left in Mars's Cydonia region by an ancient civilisation. The Australian, in line with the rest of the Earth's media, was apparently closing the door on the annoyingly persistent research into the Artificial Origin at Cydonia (AOC) hypothesis, which actually "does not claim that there is proof of artificial features on Mars, but that the probability of there being artificial features is strong enough to make new high-resolution photographs a top priority for any future mission to that planet" (McDaniel 2). Rather than confront the hypothesis itself, The Australian merely reminded us that "despite the image being 10 times better than the Viking photograph [a simplified qualification of the imaging process], it seems that some people still want to dream about ancient Martians building huge monuments to themselves" (The Australian). Dr. Mark J. Carlotto, a widely published specialist in the areas of digital image processing, pattern recognition, and computer vision, apparently still wants to dream that dream. An advocate of the AOC hypothesis, he notes that close examination of the image reveals the formation to be rough and highly eroded. Many have therefore concluded that the Face is natural. But others contend that if the Face is artificial it must certainly be very old and highly eroded. Thus the question remains as to how to distinguish an eroded artificial feature from a natural one. (Carlotto) This interestingly portentous question is one which NASA's Jet Propulsion Laboratory (JPL) and their contracted image processors, the privately owned Malin Space Science Systems (MSSS) have been somewhat reluctant to confront since the image of the Face was first captured in Viking frame 35A72. NASA's inaugural public statement on the Cydonia issue, for example, was handled ... "clumsily". As McDaniel reports: Upon the discovery of the Face in July, 1976, a Viking Project Scientist held up Viking frame 35A72, containing the Face, and announced to the assembled press corps that in a picture taken a few hours later "it all went away; it was just the way the light fell on it" -- but with a significant omission: the alleged later photograph, in which the facial features were supposed to have disappeared, was not shown for comparison [because] the statement could not possibly have been true. Frame 35A72 was taken in the early evening at approximately 6pm local time (sun angle 10 degrees). The object was in darkness a few hours later; the spacecraft, with an orbital period of about 24 hours, was no longer in a position to re-photograph the site; nor would it return to the site for many more orbits to come. Thus NASA's first official response to this strange object was an inexplicable misstatement based upon an apparent impossibility. (McDaniel 11-2) Things did not improve from there. NASA was never able to produce the elusive second photograph, yet continued to maintain that it both existed and conclusively disproved that the landform in question could possibly be artificial. In May 1993 the paradox attracted the attention of Senator John Glenn, who received (along with at least ten other members of the House and the Senate) a copy of the NASA document "Information on NASA's Re-Photographing of the Cydonia Region of Mars", which still held that the Face disappeared in the different lighting angles of a separate frame, which it did not reference. Finally in June 1993, after another inquiry by Senator Dianne Feinstein, a revised draft was issued which omits reference to the mysterious "real" photograph of the Face (McDaniel 12-3). NASA's next attempt to re-image Mars, including Cydonia, was the Observer probe, which failed to observe much at all and was declared lost in space. In conjunction with the recent mysterious failure of the Russian Phobos probe, and NASA's constant public relations blunders, conspiracy theories abounded. Was there something lurking at the threshold? The answer came in 1998 through the MGS, from which MSSS had produced a newer, clearer, "truer" image of the contentious feature which seemed to confirm Dr. Michael Malin's own earlier (and strangely self-contradictory) evaluation of 35A72: "it's simply a funny looking hill -- there is nothing unusual about it" (McDaniel 55). The MGS image certainly appeared, at least to the "naked eye" perusing the newspaper, to be just that. The wilderness had been tamed, and the coals cooled, temporarily. We had melted the witch. But exorcisms are never "final". Although NASA had apparently relegated the monstrous Face back to the realm of nature, restoring it within the parameters of conventional geology, McDaniel, Carlotto and others have maintained that NASA's conclusions were drastically premature, noting, as mentioned previously, that if the Face is artificial it must certainly be very old and, considering the Martian environment, highly eroded (Carlotto). According to their independent research, detailed analysis of the MGS image (which NASA appears not to have commissioned), does not invalidate the hypothesis that the Face may be artificial. Rather, it confirms many of the facial features recorded by the Viking, provides further evidence for the formation's high degree of lateral symmetry, and illuminates more anomalous internal detail (Carlotto). The Face on Mars, like the classical monsters of history, will not die easily. Ironically, perusal of Carlotto's dense research is an entry into the latent but undeniable plasticity of numbers, which itself is the quality of the monster that haunts modern cartographic representation. Mathematics, in almost every field of application, is finding it increasingly difficult to keep its disordering unknowns at bay. Geographer Erol Torun, for example, examined the angles formed by the facets of the two-mile long "D & M pyramid" (named after its discoverers, Vincent DiPietro and Gregory Molenaar). As Brian O'Leary writes, he subsequently found that the ratios between the five principal angles at the pyramid apex "express the universal mathematical constants of the square roots of 2,3,5,6, e, and pi ... . These constants should be known by any civilisation possessing Egyptian level technology (or greater) ... . The constants themselves are universal because they exist regardless of the number of the base being used". Regarding the other angles, Torun continued to find mathematically significant numbers "no matter how I looked at the object" (O'Leary 210). As the Cydonia controversy seems to clearly demonstrate, rather than revealing obvious, fixed truths about the world, mathematics and the observational tools they inspire require us to learn to see an approximation of the object they construct and represent as "real". We are thus compelled to draw the Other closer, but not "really", through the technological gaze of the artificial lens, a gaze that works to mask its own latent epistemic crisis. Indeed, this very compulsion inspired the growth of popular microscopy in the mid-eighteenth century, which required a new mode of seeing that could only very generously be termed "observation". Captain Basil Hall vividly recalls a meeting of the Geological Society, when a bottle was produced which was said to contain certain zoophytes. It was handed round, in the first instance, among the initiated on the foremost benches, who commented freely with one another on the forms of the animals in the fluid; but, when it came to our hands, we could discover nothing in the bottle but the most limpid fluid, -- without any trace, so far as our optics could make out, of animals dead or alive, the whole appearing absolutely transparent. The surprise of the ignorant at seeing nothing was only equal to that of the learned who saw so much to admire; nor was it till we were specifically instructed what we were to look for, and the shape, size, and general aspect of the zoophytes pointed out, that our understandings began to co-operate with our eyesight in peopling the fluid, which, up to that moment, had seemed perfectly uninhabited. The wonder then was, how we could possibly have omitted seeing objects now so palpable. (Mantell 8) Indeed, as Harley indicates, the relationship between the geographic and microscopic gaze is fundamental to the modern cartographic tradition. He cites Monmonier and Schnell's Map Appreciation (1988) as a recent example: Geography thrives on cartographic generalisation. The map is to the geographer what the microscope is to the microbiologist, for the ability to shrink the earth and generalise about it ... the microbiologist must choose a suitable objective lens, and the geographer must select a map scale appropriate to both the phenomenon in question and the "regional laboratory" in which the geographer is studying it. (in Harley 245) Importantly for this discussion, through both microscopy and cartography, "photography has also played a large role in twentieth-century ethnological representation", writes James Duncan. What better way to assert the primacy of the visual, produce a "true" representation of the place in question and establish presence than through the use of photography? But the mimetic claims of photography can also be called into question. A camera is a machine constructed to produce an image based upon artificial perspective. Only if one accepts the claims of the naturalness of Renaissance artificial perspective can we accept photography as a mimetic representation of the world. Such claims can be cast in doubt, for example, by the failure of peoples unfamiliar with photographs to be able to "read" them. (43) At the end of the day, though, it all may have more to do with down-to-earth economics than Martian "geopolitics". For many researchers, McDaniel among them, NASA's evasive treatment of the Face and surrounding features (variously labelled the Tholus, the D&M pyramid, the Fort, and the City Square) suggests a cover-up. Specifically, a cover-up of NASA's own inexplicable lack of investigation into apparently artificial structures on the Martian surface. Since the Jet Propulsion Laboratory's data imaging is contracted to a private company legally unaccountable to the public, McDaniel has confronted the somewhat disheartening possibility that financial motives may be obscuring investigation into what seem to be the most intriguing features of the Martian surface. He "does not personally believe in the conspiracy theory", but simply suggests that the Cydonia controversy may demonstrate that the financial interests of Malin Space Science Systems have assumed higher priority than the search for extraterrestrial artefacts: The contract for the Mars Observer (now MGS) involved close to 10 million dollars for Malin Space Science Systems ... . If it became clear that the probability of artificial structures on Mars is very high [or even that such a probability existed], it seems the focus of investigation would shift radically. The emphasis would fall to an accelerated manned mission to Mars. Archaeologists and perhaps biologists would assume an increasingly important role. It would be the manned mission (Johnson Space Flight Centre), not JPL, that takes the driver's seat. (McDaniel 1999) In other words, by producing results which indicated that the Cydonia region was worthy of closer attention, MSSS would jeopardise the future of its own multi-million dollar contract with NASA's Jet Propulsion Laboratory -- hardly a wise business venture, regardless of their geopolitical stance. But whatever the "true" source of the Martian controversy (it is, after all, the mythic planet of war), it seems undeniable that the Face on Mars is at once both an appropriately postmodern enigma and a genuine cartographic anomaly. For we find embodied within its monstrous form (through the lens), the message that our gaze is destined to be returned by ourselves. From the stars to the quarks, "we" seem to forever inhabit the very wilderness our technological gaze functions to both distance and draw closer; to abject. References Berland, Jody. However, what happens when doubt, reasonable or otherwise, is embedded in the media reporting of criminal cases, even before charges have been laid? This paper will analyse newspaper reports of recent rape cases involving Australian footballers, and identify narrative figures that are used to locate blame solely with the alleged victims, protecting the footballers from blame. I uncover several stock female “characters” which evoke doubt in the women’s claims: the Predatory Woman, who hunts down footballers for sex and is always sexually available to any and all footballers; the Woman Scorned, who makes a false rape complaint out of revenge; and the Gold Digger, who makes a false complaint for money. I will argue that the news media thus effectively provide footballers with a criminal defence, before the cases can even reach court. Rape and Football in Australia The issue of football and rape first came to mass public attention in February 2004, when six players from National Rugby League (NRL) team the Canterbury Bulldogs allegedly raped a woman while at a New South Wales resort. Two weeks later, two players from the St Kilda Australian Football League (AFL) team allegedly raped a woman following their pre-season cup victory. These two football codes are the nation’s most popular, with rugby league dominating the north-eastern states, with the southern, eastern and western the domain of Australian Rules. In neither case were charges laid, and although at least twenty distinct cases have been reported in the Australian media, involving more than fifty-six footballers and officials, only one–NRL star Brett Stewart–has yet been tried. Stewart was acquitted in September 2010. Former AFL footballer Andrew Lovett has also been ordered to stand trial in July 2011 for allegedly raping a woman on Christmas Eve, 2009. Nevertheless, the majority of cases never reach court. In criminal cases, the Director of Public Prosecutions (DPP) ultimately decides whether to pursue charges through the courts, and, as most cases will be decided by a jury drawn from the general public, the DPP must decide whether the general public would accept the prosecution’s evidence as proof of guilt “beyond reasonable doubt.” This means that if a jury retains any doubt that the accused person is guilty, as long as that doubt is reasonable, they must return a verdict of “not guilty.” Public opinion in high-profile cases is therefore extremely important. If the DPP perceives a high level of public scepticism about a particular case, this indicates that the likelihood of the general public accepting the prosecution’s evidence is low, and they will often decide not to pursue the case. My analysis will show that media reports of the cases, which were published before any decision about laying criminal charges was made, can in fact work to create doubt, taking popular, victim-blaming stories to cast doubt on the complainants’ testimonies. Thus “reasonable doubt,” or a doubt that seems reasonable to many or most readers, is created before the case can even reach court. Predatory Women, Gold Diggers and Women Scorned When debate began in 2004 and explanations were sought for the high numbers of cases, stories abounded in which women have consensual sex with footballers, and then make a false rape complaint. I identify the principal characters of these stories as the Predatory Woman, Gold Digger and Woman Scorned. These stories were particularly prevalent amongst football representatives, blog contributors and talkback radio callers. Some media commentators provided alternative explanations (Magnay, for example), and others were explicitly critical of such stories (Pinkney, Wilson, for example); however, other journalists in fact evoked these same stereotypes. All of these characters have “common currency” (Smart 39), and have been used by defence lawyers in criminal trials for centuries, which means they are likely to be believed. These commentators therefore (indirectly) portray the complainants as liars, and reinforce the pervasive victim-blaming discourses in the wider public. The Predatory Woman The Predatory Woman character can be traced back at least as far as the early nineteenth century, when so-called “fallen” women were frequently “scorned as predatory creatures who lured young men into sin” (Clark 59). In her study of newspaper articles on football and sexual assault, gender theorist Kim Toffoletti identified the “predatory female” as a recurrent figure who is used to portray footballers as victims of “deviant” female sexuality (432-3). Toffoletti argues that the assumption underlying the use of the predatory female is that “incidents of sexual assault can occur when women deviate from the ‘conventions’ of heterosexual relations that expect them to be passive and sexually available, and men to exude sexual virility” (433). However, I argue that commentators’ usage often carries this further, and rather than using the story to claim that a victim of rape “deserved” it, the Predatory Woman actually serves as a replacement for the Raped Woman, therefore implicitly claiming that the complainant was lying. The Predatory Woman is the aggressor in all sexual encounters with footballers, a “sexual predator” (McCabe 31) who is said to “target” players and “hunt in packs” (Lyon 1). In a 2004 interview, one footballer described the phenomenon as “frightening” (McCabe 31), and another in 2009 claimed that footballers are “given temptations,” and “some of them [women] are downright predators” (Cunningham 30). The hunting animal metaphor clearly represents women as sexual aggressors, virtually suggesting that they are committing violent acts–moving in on unsuspecting footballers for the “kill” (sex). Thus portraying a complainant as one who seeks out sex with footballers implies that she victimised the players. As a woman cannot be both sexual aggressor and rape victim, the character of the Predatory Woman replaces that of the Raped Woman, therefore invalidating a complainant’s testimony and creating doubt. The Woman Scorned The Woman Scorned, another popular character in footballer sexual assault narratives, has also been evoked by the defence in criminal rape trials for centuries (Sanday; Benedict 2, 39-40, 83; Larcombe 100, 104-106, 111; Lees 78). The prevalence of footballers’ beliefs in the Woman Scorned story when NRL player Simon Williams commented about the prevalence of group sex/rape incidents involving NRL players on the 2009 Four Corners “Code of Silence” episode: It’s not during the act, it’s the way you treat them after it. Most of them could have been avoided, if they [players] had put them [women] in a cab and said thanks or that sort of thing not just kicked her out and called her a dirty whatever. It’s how you treat them afterwards that can cover a lot of that stuff up. Williams’ implicit claim here is that no woman would make a rape complaint as long as footballers always “said thanks” after sex. He thus implies that “most” of the complaints have been about revenge from women who felt mistreated after consensual sex: Women Scorned. The Gold Digger The Gold Digger is also an established character in both football rape stories and criminal rape trials; Peggy Sanday identifies her in cases dating from the eighteenth century. In rape cases, the Gold Digger can be evoked when a prominent and/or wealthy man–such as a noble in the eighteenth century, or a footballer in the present context–is accused of rape, whether or not the alleged victim seeks or receives a financial settlement. Many football fans evoked the Gold Digger on Internet blog sites, even when there were no observable characteristics corresponding to the Gold Digger in any of the media narratives. One declared: “My mum said she was probably being a slut, then after they ‘did’ her, she decided 2 say summin coz she thought she could get money or summin out of it [sic]” (in Baird 41). The Gold Digger stereotype invalidates a rape complaint, as a woman who alleges rape for financial gain must be lying, and was therefore not raped. Her claims are to be doubted. Narrative Immunity From 2009 onward, although traces of these characters remained, the focus of the debate shifted, from the possibility of sexual assault to players’ alcohol intake and the prevalence of “group sex.” Nina Philadelphoff-Puren identifies implicit claims that the complainants were lying in the statements of football representatives (37, 41-43), which imply that they must be Predatory Women, Women Scorned or Gold Diggers. In order to show clearly how journalists mobilised these characters more directly to evoke doubt, I conducted a search of the “Newsbank” newspaper database, for opinion pieces that sought to explain why the allegations were made, using varying combinations of the search terms “AFL,” “NRL,” “football,” “sexual assault,” “rape,” “rugby,” “sexual violence,” “sex” and “women.” Articles were sought in broadsheet newspapers The Age (Melbourne) and The Sydney Morning Herald, and tabloids The Herald Sun (Melbourne) and Daily Telegraph (Sydney), the most widely read newspapers in the cities where the alleged incidents occurred. The time-frame selected was 27 February 2004 to 1 May 2004, which covered the period from when the Canterbury Bulldogs case was first reported, until debate died down after the announcement that no charges would be laid against St Kilda footballers Steven Milne and Leigh Montagna. Twenty articles were collected for analysis: two from the Daily Telegraph, eight from the Herald Sun, seven from the Age, and three from the Sydney Morning Herald. Of these, half (ten) overtly blamed the alleged victims, with seven of those explicitly evoking Predatory Woman, Woman Scorned and/or Gold Digger stereotypes, and one strongly implying them. Although it might be expected that tabloid newspapers would be much more likely to (re-)produce popular stereotypes than broadsheets, the same numbers were found in each type of newspaper. The “common currency” (Smart 39) these stories have means that they are more likely to be considered credible than other stories. Their use by respected media commentators–particularly broadsheet journalists, whose publications lay claim to an educated readership and more progressive attitudes–is of even greater significance. In this paper, I will analyse three broadsheet articles in detail, in order to illustrate the various strategies used to evoke the stereotyped characters for an educated readership. The articles selected are by writers from very different backgrounds–a former footballer, a feminist and a “life-skills” coach to AFL footballers–and although it might seem that they would provide markedly different perspectives on the issue, I will show that all three evoke stereotypes that cast doubt on the complainants’ claims. The Story of the “Insider” Former AFL footballer Tim Watson’s “AFL Players and the Trouble Zone” was published shortly after the allegations against the St Kilda AFL players were made public in 2004. The article features a number of Predatory Women, who make “victims” of footballers; however, while Watson does not provide direct narrative accounts of the alleged rapes, he instead recounts narratives of other interactions between footballers and women. Predatory Women therefore come to replace Raped Women as characters and invalidate the alleged victims’ claims; as Watson represents these women as the sole agents, full responsibility for these incidents is attributed to women. The bulk of Watson’s article relates two stories unconnected with any (known) sexual assault cases, about AFL teams travelling to the country for training and being harassed by women. Placing the narratives immediately after warnings about “trouble zones,” when the article is clearly responding to the sexual assault allegations, suggests that his narratives explain what “potential trouble” and “trouble zones” are. He therefore implies that his narratives illustrate what “really” happened with the St Kilda (and Canterbury) players. The only instances where players are given grammatical agency in this narrative is when they “mingled with the locals” and “left the function as a group”; all the narrative action is attributed to women. Mingling has no sexual connotation, and “the locals” is a gender neutral term, implying that the players’ only action at the function was to interact with men and women in a non-sexual way. The characters of “a couple of girls” are introduced, and according to Watson these “girls” made it clear to everyone that they were keen to attract the attention of a couple of the players. One girl was so convinced of her intentions that she sidled up to the coach to explain to him what she planned to do later in the night to one of his players. The team left the function as a group and went back to the hotel without the adoring fans. In order to portray the women more clearly as the sole sexual aggressors–Predatory Women–Watson leaves out any events where players actively participate, events which are highly likely to have occurred. For example, in Watson’s narrative there is no two-way flirtation, and the players do not seek out, encourage or even respond in any (positive) way to the female attention they receive, although anecdotal evidence suggests this is extremely unlikely to have happened (Mewett and Toffoletti 170, 172-73). The women are only grammatical agents with intentions–their agency relates to what they plan to do–however, emphasising the fact that the team left as a group suggests that it was only this defensive action which prevented the women from carrying out their intentions and instigating sexual activity. Using “sidled” rather than “went” or “approached” characterises the woman as sly and manipulative, casting her in a negative light and adding to the sense that she was solely responsible. The second story is described as “almost identical” to the first, but Watson takes even greater pains to emphasise the players’ passivity, again portraying them as victims of Predatory Women. Watson attaches only the passive voice to the players: he says that they were “woken in their hotel rooms” and “subject to determined, but unwanted, advances.” The women are entirely absent from these statements. They appear only as shadows presumed responsible for waking the players and making the unwanted advances. This erasure of the female agent only emphasises the players’ passivity in the face of female seduction and general resistance to overwhelming female sexual aggression. As in the first story, the only action attributed to a footballer is defensive: a senior player convincing the women to leave. This reinforces the idea that male footballers are the victims when it comes to casual sexual relations, and casts doubt on any claims of rape. The Story of the “Insider-Outsider” The second article, “When an Elite Footballer Has Sex with a Girl…,” is by “life skills” coach to AFL players Damien Foster, who calls himself “a classic insider-outsider” to football (SBS). As a partial outsider, Foster would therefore presumably have less vested interest in protecting footballers than Watson; however, his narrative also denies the complaints’ credibility, clearly evoking a victim-blaming character: the Woman Scorned. Foster obliquely claims that the St Kilda and Canterbury cases arose simply because women and men view sex differently and therefore “a footballer may land himself in trouble because it just doesn’t occur to him to develop tactful, diplomatic methods of saying goodbye”. He continues, “When the girl [sic] realises the total indifference with which she is being treated after intimacy, bitterness sets in and it lingers. There are many girls in Australia now in this situation.” While Foster does not directly say that the “girls” who made rape complaints against the Bulldogs and St Kilda are Women Scorned, the fact that this story is used to explain why the allegations were made says it for him. According to Foster’s logic, if footballers learnt to say “thanks, love, that was great” after sex, then no rape complaints would ever be made. A “Feminist” Story? Controversial feminist Germaine Greer would seem even more likely to avoid victim-blame than men involved with football clubs, and she does not follow Watson’s portrayal of utterly passive, squeaky-clean footballers, or Foster’s narrative of undiplomatic players. In “Ugly Sex Has Just Got a Lot Louder,” she does acknowledge that some harm may have been done; however, Greer nevertheless portrays the complainants as Predatory Women, Women Scorned and Gold Diggers. Greer elects to tell a “history” of male footballer-female interactions, establishing male athletes’ disrespect for and mistreatment of women as a given. However, she goes on to evoke the Predatory Woman, portraying her as utterly desperate and willing to go to any lengths to have contact with players. Greer laments, good family men have been known to succumb to the groupies’ onslaught, believing that as long as they don’t kiss these desperate creatures, as long as they make no move that could be interpreted as a sign of affection, they haven’t been genuinely unfaithful to their wives and sweethearts. Indeed, the more brutal the treatment of the women they have casual sex with, the less they have to reproach themselves for. Pack rape in such circumstances can come to seem guiltless, a condign punishment for being a stupid slag, even. This explanation of footballers’ behaviour contains several grammatical patterns which represent the players as passive and not responsible for anything that takes place. In the first sentence, the only things these footballers actually do are succumbing and believing, both passive verbs; the rest of the sentence is devoted to what they do not do: “as long as they don’t kiss… as long as they make no move.” Thus it would seem that the players do not actively participate in the sexual activity instigated by these women, that they simply lie back and allow the women to do as they will. That the women are labelled “desperate creatures” who launch an “onslaught” to which footballers “succumb” confirms their sexual aggression. Although the second and third sentences depict violence and rape, these actions are not directly attributed to the players. The brutal treatment of the women the players have casual sex with has no grammatical agent–“the more brutal the treatment of the women they have casual sex with”–dissociating them from the brutality and subtly implying that “someone else” is responsible for it. Similarly, “pack rape” has no agent: no player commits or is involved in it, and it appears to happen independently of them. As Susan Ehrlich demonstrates, this denial of agency is a common tactic for accused rapists to use, in order to deny that they were responsible for their actions (36-61). Thus Greer uses the same grammatical patterns which deflect blame away from footballers, even when the behaviour involved is violent rape. This continual emphasis on the players’ passivity reinforces the portrayal of the women as sexually aggressive Predatory Women. Greer also introduces the figures of the Woman Scorned and Gold Digger. She claims that the only difference between the “old days” and the present scenarios is that now women are “not embarrassed to say that they agreed to sex with one man they’d only just met, or even with two, but they hadn’t agreed to being brutalised, insulted or humiliated, and they want redress.” This paragraph appears almost directly after the one where Greer mentions pack rape and violence, and it may seem therefore that the redress these women seek is for rape. However, since Greer claims that at least some of the women who “want redress” want it because they have been “insulted or humiliated,” rather than raped, this evokes the Woman Scorned. Greer continues by introducing the Gold Digger as a further (and complementary) explanation for these insulted and humiliated women to seek “redress.” Greer writes that women now “also seem quite interested in another factor in sex with footballers – namely, indecent amounts of money.” With this statement, she implies that some women have sex with footballers just so that they can make a rape complaint afterwards and obtain a large payment. She concedes that the women who make allegations against footballers may have been “abused,” but she trivialises them by claiming that they “scream and holler,” portraying them as hysterical. She thus discredits them and casts doubt on their claims. Greer ignores the fact that only one woman has either sought or obtained a financial settlement from footballers for a case of rape, and this woman only applied for it after charges against the players responsible were dropped. Whilst this argument is clearly unfounded, the strength of the Gold Digger story, along with the Woman Scorned and Predatory Woman, is likely to give the impression that the rape complaints made against the footballers were unfounded. Conclusion: The Benefit of the Doubt The fact that a significant number of media commentators employed tactics similar to those defence lawyers use in rape trials suggests that a de facto “trial” took place; one in which stories that discredit the complainants were prominent. These stories were enough to evoke “(un)reasonable doubt” in the women’s claims, and the accused footballers were therefore “acquitted.” That doubt can be evoked so easily in such high-profile cases is particularly problematic as rape cases in general are those least likely to be believed (Jordan 64-83). Further, many victims state that the fear of disbelief is one of the most important factors in deciding not to pursue criminal charges (Warshaw 50). Even if one leaves aside the likelihood that the prevalence of doubt in the media and the “blogosphere” contributed to the DPP’s decision not to pursue charges, the media “acquittal” is likely to have two further effects: it may deter future complainants from coming forward, if they assume that their claims will similarly be doubted; and it contributes to more generalised beliefs that women habitually lie about rape, particularly those who accuse footballers. While of course any accused person must be held innocent until proven guilty, it is equally important to give an alleged victim the benefit of the doubt, and not presume that all rape complainants are liars unless proven otherwise.
