This chapter considers the issue of ‘proof of terms’. It first describes the modern approach to proof of terms is described, and introduces the impact of ‘entire agreement’ clauses. Traditionally most cases concerned with the construction of private law instruments involved deeds or other documents signed by one or more parties. To this day a signature on a contract or form is the most effective way for a party to ensure that its terms form the basis for the relationship. However, it is clear that a signature on a document is not the sole or even principal means by which it can become the basis of the contract. The straightforward question to be addressed is if the parties intended to embody their agreement in a document, or to reduce it to writing in the form of a document.

This chapter discusses the application of the criminal law to computer-related crime. Criminal law was traditionally seen as the province of national authorities. However, as developments in technology gathered pace, it became increasingly apparent that national legislation might be of limited effectiveness. Beginning with the Council of Europe Cybercrime Convention, which was opened for signature in 2001, there have been a number of international initiatives with the EU also becoming increasingly active in the field. As well as making provision for harmonising substantive criminal offences, there have been moves to enhance cooperation between law enforcement agencies at a procedural level.

This chapter focuses on the neuroscience of compassion and related social emotions such as empathy, empathic concern, or empathic distress. First, we review neuroscientific literature on empathy and relate empathy to similar social emotions. We then turn to neuroscientific research on caregiving and social connection before describing cross-sectional studies on the neural signatures of compassion. To investigate whether training of compassion can change neural functions, the neural “fingerprints” of compassion expertise were studied in both expert and inexperienced meditators. The latter included the comparison between functional plasticity induced by empathy for suffering as opposed to compassion training. These studies show that compassion training changes neural functions, and that the neural substrates related to empathy for suffering differ experientially as well as neuronally. This is in line with the observation of distinct behavioral patterns related to feelings of empathic distress and compassion, described towards the end of the chapter.

This article focuses on typical trajectories of numerical cognition from infancy all the way through to adulthood (please note that atypical pathways of numerical cognition will be dealt in‘Brain Correlates of Numerical Disabilities’). Despite the fact that developmental imaging studies are still scarce to date there is converging evidence that (1) neural signatures of non-verbal number processing may be observed already in infants; and (2) developmental changes in neural responsivity are characterized by increasing functional specialization of number-relevant frontoparietal brain regions. It has been suggested that age and competence-related modulations of brain activity manifest as an anterior-posterior shift. On the one hand, the recruitment of supporting frontal brain regions decreases, while on the other hand, reliance on number-relevant (fronto-)parietal neural networks increases. Overall, our understanding of the neurocognitive underpinnings of numerical development grew considerably during the last decade. Future research is expected to benefit substantially from the fast technological advances enabling researchers to gain more fine-grained insights into the spatial and temporal dynamics of the neural signatures underlying numerical development.

This chapter considers the significance of prominent women's leadership in the movement to stop mountaintop removal. The prominence of women in leadership positions is a signature characteristic of Appalachian community activism, including the CRMW and the Friends of the Mountains (FOM) networks. However, the role of women is related to the decline of the union and the shifting sites of organizing within the community. Though women have always been active in social issues in the coalfields, the union's historically dominant role in organizing activism limited women's ability to rise to leadership positions. Organizing outside of the union affords women greater flexibility to link together social issues that a labor perspective may not have addressed directly. As such, women are able to forge a more comprehensive approach to social justice built upon different symbolic capital foundations.

Damage to the human inferior parietal lobe produces an attentional disturbance known as contralateral neglect, and neurophysiological studies in monkeys have begun to unravel the cellular basis of this function. Converging evidence suggests that LIP encodes a sparse topographic map of the visual world that highlights attention-worthy objects or locations. LIP cells may facilitate sensory attentional modulations, and ultimately the transient improvement in perceptual thresholds that is the behavioural signature of visual attention. In addition, LIP projects to oculomotor centres where it can prime the production of a rapid eye movement (saccade). Importantly, LIP cells can select visual targets without triggering saccades, showing that they implement an internal (covert) form of selection that can be flexibly linked with action by virtue of additional, independent mechanisms. The target selection response in LIP is modulated by bottom-up factors and by multiple task-related factors. These modulations are likely to arise through learning and may reflect a multitude of computations through which the brain decides when and to what to attend.

The connection between topics and meter was supported by Wye Allanbrook (1983) with references to eighteenth-century authors representing an old tradition of metric notation in which meter was closely related to tempo, affect, and genre. In the late eighteenth century this tradition was continued by Johann Philipp Kirnberger, who posited a standard tempo for each meter: the so-calledtempo giusto. But the tradition oftempo giustowas dissolved by another tradition of metric notation in which time signatures had no tempo significance and no affective implications. While the new tradition enabled eighteenth-century composers to include several topics in one piece, it complicates the task of the analyst by making identification of topics contingent on identification of the composed meter and, in some cases, on analysis of phrase structure. This chapter demonstrates the problem of topical identification in relation to the main theme of Mozart’s Symphony in G minor, K. 550/i.

Abiotic variables and biotic interactions can act on variation in life history traits, ultimately leading to divergence in reproductive mode. Marine invertebrates have a remarkable diversity in such strategies, sometimes even between closely related species. It is this natural diversity that lends itself to employing a powerful comparative approach, both for particular morphological characteristics as well as molecular signatures from developmental genes. For example, complex life histories, where a larval stage is interposed between the embryo and juvenile, likely represent the product of numerous selection pressures, historical and current, that have shaped the diversity of larval stages in extant marine species. In fact, the very question about “what is a larva?” has to be addressed, as it is so intimately connected to bentho-planktonic life cycle and metamorphosis. Furthermore, novel larval types have evolved in particular lineages and larvae have been secondarily lost in others. This in itself creates an interesting and exciting playground to test evolutionary developmental hypotheses....

This first three chapters or first third of this book documents the ups and downs in the conflictual correspondence between Sigmund Freud and India’s first psychoanalyst, Girindrasekhar Bose. They trace the relationship through three phases of their 1920–1937 correspondence, and also compare their correspondence with Freud’s contemporary correspondence with Romain Rolland, noting similar disaffections while documenting in both exchanges Freud’s evasions about India. Psychoanalytic topics covered in these chapters include maternal transference as it relates to Bose’s work, to Freud’s therapeutic work with the poet H. D., to Bose’s and Freud’s treatments of the Oedipal and pre-Oedipal, and to André Green’s “dead mother complex.” The middle three chapters each treat a concept by which Bose sought to challenge Freud, producing conflicts between tham that had a much richer content than either of them realized or cared to elaborate upon. New answers to two questions are posed: why Bose never wrote an article for Freud on his signature concept of “opposite wishes,” the topic of chapter 4; and why Bose chose an icon of Viṣṇu for Freud’s 75th birthday gift rather than a Bengali goddess, which is asked through the last three chapters.

Bonobos and chimpanzees are closely related, yet they exhibit important differences in their wild socio-ecology. Whereas bonobos live in environments with less seasonal variation and more access to fallback foods, chimpanzees face more competition over spatially distributed, variable resources. This chapter argues that bonobo and chimpanzee cognition show psychological signatures of their divergent wild ecology. Current evidence shows that despite strong commonalities in many cognitive domains, apes express targeted differences in specific cognitive skills critical for wild foraging behaviours. In particular, bonobos exhibit less accurate spatial memory, reduced levels of patience and greater risk aversion than do chimpanzees. These results have implications for understanding the evolution of human cognition, as studies of apes are a critical tool for modelling the last common ancestor of humans with nonhuman apes. Linking comparative cognition to species’ natural foraging behaviour can begin to address the ultimate reason for why differences in cognition emerge across species. Les bonobos et les chimpanzés sont prochement liés, pourtant ils montrent d’importantes différences dans leur sociologie naturelle. Alors que les bonobos vivent dans des environnements avec peu de diversité de climat entre saisons et plus d’accès à des ressources de nourriture alternatives, les chimpanzés ménagent une compétition étalée spatialement et des ressources plus variées. Je soutiens que la cognition des chimpanzés et bonobos montre les signatures psychologiques de leur écologie naturelle divergente. Les témoignages courants montrent que, malgré les forts points communs dans en cognition, les grands singes expriment des différences au niveau de compétences cognitives importantes au butinage. En particulier, les bonobos démontrent une mémoire spatial moin précise, moin de patience, et plus d’aversion de risques que les chimpanzés. Even to experts, Colombia is one of the most confusing countries in the Americas. Its democratic tradition is among the richest and most long-standing in the hemisphere, with only eleven years of military rule during its 200 some years of independence. Except for the United States and Canada, Colombia has had the highest growth rate in the Americas over the last 75 years. It is widely seen as having some of the continent's best universities and deep intellectual traditions along with a dazzling array of fine and industrial arts and now globally-popular tropical music. But despite these admirable achievements, Colombia has also experienced what its Nobel laureate Gabriel García Marquez once called “a biblical holocaust” of human savagery. Along with the scourge of politically-motivated assassinations (averaging 30 per day in the 1990s) have been drug-related massacres, widespread disappearances, rapes and kidnappings, and even the signature defilement of murder victims. The relentless dynamics of the illegal drug industry raises a puzzling question: how did Colombia capture and control that enormously-lucrative industry and then leverage its status as America's No. 1 drug supplier into a $7 billion military partnership with the world's superpower? Framing Robinson’s fiction within the dynamics of everyday life, this study highlights the tensions of form and content that haunt moments of transcendence in her work. Robinson’s novels, it argues, construct a world that is mimetic as well as symbolic and revelatory. Although the heightened apprehension of the quotidian in Robinson’s novels often registers powerfully and beautifully in representational terms, its aesthetic intensity is enacted at the expense of characters who patrol the margins of the ordinary with unceasing vigilance. Inhabiting the everyday self-consciously, her protagonists perform a forced relationship to the ordinary that seldom relaxes into the natural or the familiar; scarred by grief, illness, aging, and trauma, they inhabit a world of transcendent beauty suffused with the terrifying threat of loss. The signature acts of transfiguration that punctuate Robinson’s narratives originate from and anticipate the inevitability of absence: the death of loved ones (Housekeeping), the impending death of the self (Gilead), the fracture of family (Home), the repetition of trauma and abandonment (Lila), and the prohibition of everyday intimacy in interracial romance (Jack). Highlighting the tensions of the uncomfortable ordinary that disrupt a trajectory of transcendence in her fiction, this book situates Robinson’s novels within sociological, psychological, and phenomenological studies of trauma, grief, aging, race, and gender, as well as narrative theory and everyday life studies. Focusing on the experiential dynamics of the lived worlds her novels invoke, The Elusive Everyday argues for the complexity, relevance, and contemporaneity of Robinson’s fiction.

The creation of the Trade-Related Aspects of Intellectual Property Rights Agreement (TRIPs) in the mid-1990s altered the regulation of intellectual property under international law. Prior to the TRIPs Agreement, intellectual property regulation consisted of a patchwork of international treaties and conventions coordinating reciprocal national treatment of signatory states’ domestic intellectual property protection. Generally, those agreements strove for minimum standards of protection, but left levels and types of protection to member states’ national discretion. TRIPs’s strict uniformity represented a momentous change. Development theorists who have examined the practical implications of intellectual property regulation under international law have echoed critical theorists’ assertions of TRIPs as a watershed moment. However, they have expressed concerns over the domination exercised by developed countries over developing countries within the current international intellectual property regulatory system. Of particular importance are international impositions into developing countries’ national legal systems via TRIPs, and efforts of developed countries to extract from developing countries intellectual property concessions over and above those contained in TRIPs. A wide range of articles on intellectual property regulation under international law have also been published in legal journals and periodicals. Three broad themes stand out: concerns about practice and practical applications (i.e., practice tips, reviews of cases and WTO decisions); concerns about policy aspects and consequences of intellectual property law; and exploration of the philosophical underpinnings of the law.

The Nazis and their cohorts stole mercilessly from the Jews of Europe. In the aftermath of the Holocaust, returning survivors had to navigate unclear and hostile legal paths to recover their stolen property from governments and neighbors who often had been complicit in their persecution and theft. While the return of Nazi-looted art and recent legal settlements involving dormant Swiss bank accounts, unpaid insurance policies and use of slave labor by German companies have been well-publicized, efforts by Holocaust survivors and heirs over the last 70 years to recover stolen land and buildings were forgotten. In 2009, 47 countries convened in Prague to deal with the lingering problem of restitution of prewar private, communal, and heirless property stolen during the Holocaust. The outcome was the Terezin Declaration on Holocaust Era Assets and Related Issues, aiming to “rectify the consequences” of the wrongful Nazi-era immovable property seizures. This book sets forth the legal history of Holocaust immovable property restitution in each of the Terezin Declaration signatory states. It also analyzes how each of the 47 countries has fulfilled the standards of the Guidelines and Best Practices of the Terezin Declaration. These standards were issued in 2010 in conjunction with the establishment of the European Shoah Legacy Institute (ESLI), a state-sponsored NGO created to monitor compliance. The book is based on the Holocaust (Shoah) Immovable Property Restitution Study commissioned by ESLI, written by the authors and issued in Brussels in 2017 before the European Parliament.

Colombia is in a privileged position to take advantage of international climate agreements to finance sustainable development initiatives. The country is a signatory of the United Nations Framework Convention on Climate Change (UNFCCC), the Kyoto Protocol, and the Paris Agreements. As a non-Annex I party to the UNFCCC, Colombia produces low emissions in relation to global numbers (0.46% of total global emissions for 2010) and exhibits biogeographical conditions that are ideal for mitigation of climate change through greenhouse gas sequestration and emission reductions. Simultaneously, recent extreme climatic events have harshly compromised the country’s economy, making Colombia’s vulnerability to climate change evident.While these conditions should justify a strong approach to climate change communication that motivates decision making and leads to mitigation and adaptation, the majority of sectors still fall short of effectively communicating their climate change messages. Official information about climate change is often too technical and rarely includes a call for action. However, a few exceptions exist, including environmental education materials for children and a noteworthy recent strategy to deliver the Third Communication to the UNFCCC in a form that is more palatable to the general public. Despite strong research on climate change, particularly related to agricultural, environmental, and earth sciences, academic products are rarely communicated in a way that is easily understood by decision makers and has a clear impact on public policy. Messages from the mass media frequently confuse rather than inform the public. For instance, television news refers to weather-related disasters, climate variability, and climate change indiscriminately. This shapes an erroneous idea of climate change among the public and weakens the effectiveness of communications on the issue.The authors contrast the practices of these sectors with those of nongovernmental organizations (NGOs) working in Colombia to show how they address the specific climate communication needs facing the country. These NGOs directly face the challenge of working with diverse population groups in this multicultural, multiethnic, and megadiverse country. NGOs customize languages, channels, and messages for different audiences and contexts, with the ultimate goal of building capacity in local communities, influencing policymakers, and sensitizing the private sector. Strategies that result from the work of interdisciplinary groups, involve feedback from the audiences, and incorporate adaptive management have proven to be particularly effective.

[Abstract] The 6th International Workshop on Rock Physics (6IWRP) was held A Coruña, Spain, between 13th and 17th of June, 2022. This meeting follows the track of the five successful encounters held in Golden (USA, 2011), Southampton (UK, 2013), Perth (Australia, 2015), Trondheim (Norway, 2017) and Hong Kong (China, 2019). The aim of the workshop was to bring together experiences allowing to illustrate, discuss and exchange recent advances in the wide realm of rock physics, including theoretical developments, in situ and laboratory scale experiments as well as digital analysis. While rock physics is at the core of the oil & gas industry applications, it is also essential to enable the energy transition challenge (e.g. CO2 and H2 storage, geothermal), ensure a safe and adequate use of natural resources and develop efficient waste management strategies. The topics of 6IWRP covered a broad spectrum of rock physics-related research activities, including: • Experimental rock physics. New techniques, approaches and applications; Characterization of the static and dynamic properties of rocks and fluids; Multiphysics measurements (NMR, electrical resistivity…); Deep/crustal scale rock physics. • Modelling and multiscale applications: from the lab to the field. Numerical analysis and model development; Data science applications; Upscaling; Microseismicity and earthquakes; Subsurface stresses and tectonic deformations. • Coupled phenomena and rock properties: exploring interactions. Anisotropy; Flow and fractures; Temperature effects; Rock-fluid interaction; Fluid and pressure effects on geophysical signatures. • The energy transition challenge. Applications to energy storage (hydrogen storage in porous media), geothermal resources, energy production (gas hydrates), geological utilization and storage of CO2, nuclear waste disposal. • Rock physics templates: advances and applications. Machine learning; application of imaging (X-ray CT, X-ray μCT, FIB-SEM…) to obtain rock proper ties. This book compiles more than 50 abstracts, summarizing the works presented in the 6IWRP by rock physicists from all over the world, belonging to both academia and industry. This book means an updated overview of the rock physics research worldwide.

The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) of 2018 is the most far-reaching “megaregional” economic agreement in force. Japan, the largest economy among the eleven signatory countries, played a leading role in bringing CPTPP into being and in the decision largely to preserve in its provisions the stamp of the original US involvement before the Trump-era reversal. The Trans-Pacific Partnership (TPP) is the first instance of “megaregulation”: a demanding combination of inter-state economic ordering and national regulatory governance on a highly ambitious substantive and transregional scale. Its text and ambition have influenced other negotiations ranging from the Japan–EU Economic Partnership Agreement (JEEPA) and the US–Mexico–Canada Agreement (USMCA) to the projected Pan-Asian Regional Comprehensive Economic Partnership (RCEP). This book provides an extensive analysis of TPP as a megaregulatory project for channeling and managing new pressures of globalization, and of core critical arguments made against economic megaregulation from standpoints of development, inequality, labor rights, environmental interests, corporate capture, and elite governance. Specialized chapters cover supply chains, digital economy, trade facilitation, intellectual property, currency levels, competition and state-owned enterprises, government procurement, investment, prescriptions for national regulation, and the TPP institutions. Country studies include detailed analyses of TPP-related politics and approaches in Japan, Mexico, Brazil, China, India, Indonesia, and Thailand.
