В статье рассматривается восприятие интеллектуального наследия философа истории и культуролога XX века Освальда Шпенглера в советской гуманитарной мысли. Авторы отмечают, что интерес к культурно-исторической и политической концепции Шпенглера возник у советских гуманитариев практически с момента выхода первого тома его главного труда «Закат Европы». Оппонирование идеям Шпенглера и его сторонникам в Советской России с точки зрения исторического материализма повлияло, по мнению авторов, на становление теоретико-методологических основ советской гуманитарной мысли. Однако, как подчеркивают авторы, несмотря на критическую оценку интеллектуального наследия автора «Заката Европы» в целом, советская гуманитарная мысль воспринимала Шпенглера как одного из значительных представителей западной «буржуазной» мысли XX века. The article examines the perception of the intellectual heritage of the famous German philosopher of history and cultural critic of the XX century Oswald Spengler in Soviet humanitarian thought. The authors note that the interest in the cultural-historical and political concept of Spengler arose among Soviet humanitarians almost from the moment the first volume of his main work «The Decline of Europe» was published. The rigid opposition to the ideas of Spengler and his supporters in Soviet Russia from the point of view of historical materialism influenced, according to the authors, the formation of the theoretical and methodological foundations of Soviet humanitarian thought. However, as the authors emphasize, despite the critical assessment of the intellectual heritage of the author of «The Decline of Europe», Soviet humanitarian thought perceived Spengler as one of the significant representatives of Western «bourgeois» thought of the XX century.

In the coverage of the problems of war and peace in Catholicism, researchers (V. Brudzinski, L. Velikovich, M. Duboust, etc.) sometimes omit the regional component of their manifestation. We are talking about local traditions in Catholicism, which have their own specific approach to solving this problem and sometimes may differ significantly from the "conventional" position. The study of this field is necessary because in the delineated field the position of those theologians who were on the "outskirts" of Catholicism in the intercultural dialogue (or collision, according to S. Huntington), on the one hand, led to a deviation from the humanistic orientation about Catholicism. the war. An example would be the concept of a "holy war" of the Crusades, which had the anti-Islamic rhetoric generated not only in the West but also in the East.

The article considers the main conceptual approaches to the definition of the phenomenon of intangible cultural heritage in contemporary humanitarian knowledge, in the international institutional and legal discourse of UNESCO, in Russian legislation and cultural policy. Despite the widespread use of the term “intangible cultural heritage” in international cultural practice in the interpretation of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage, national approaches to understanding and theoretical justification of this concept in all three of the above directions differ at the level of fundamental foundations.Structural changes in the Russian cultural sphere and the transition to sustainable development strategies using the potential of intangible cultural heritage led to the transformation of practical aspects of its protection and representation. In this regard, the issues of determining the intangible component of culture and improving the terminological base are an urgent area of research from both theoretical and practical points of view. The article analyzes the main stages of the formation of the term “intangible cultural heritage” in UNESCO’s international activities, the most significant directions of this discourse, its understanding in Russian normative and legal practice (in matters of defining and typologizing heritage, the relationship between its material, spiritual, contextual, spatial and landscape components, authenticity and integrity), as well as its impact on cultural policy and practice of protecting such heritage. In addition, the authors highlight the content and functional approaches to the determination of this phenomenon in social and humanitarian knowledge, examine the basis of the criteria of authenticity, and offer an author’s definition of intangible cultural heritage.

Given the fact that cultural heritage has been the subject of multi-dimensional crimes during or in the aftermath of armed conflicts, this article attempts to analyze why and how such crimes can be brought under transitional justice (hereinafter TJ) mechanisms. It starts with the challenge to ascertain the inbuilt relationship, importantly, how cultural heritage enters into the domain of TJ. To this end, it fragmentises the rights of heritage and laws associated with these rights and examines how multiple discourses (i.e. human rights, humanitarian law, and criminal law) come together to form the notion of heritage rights and how their recognition contributes to cultural heritage’s entrance into TJ project. Thereafter, it assesses the resonance of potential TJ mechanisms and elucidates how they can help reveal the truth concerning crimes against heritage, bring the perpetrators to justice, rehabilitate the destructed sites, redress the victims, and prevent future attacks. It reiterates the value of four measures widely accepted in the TJ discourse, namely, truth-seeking, prosecution, reparations, and the measures of guarantees of non-recurrence. Finally, it explains why a comprehensive approach in terms of implementing these measures is essential and how such approach facilitates taking into account all the factors associated with the crimes against heritage.

In this paper I develop a deconstructive analysis of the relationship between humanitarian aid and state sovereignty. First, I sketch Derrida's analysis of the Christian roots of contemporary concepts of tolerance, forgiveness, and hospitality. Second, I trace the history and etymology of the word ‘humanitarian’ to reveal its Christian heritage; and argue that ‘humanitarian’ is bound to the violence of Christ's crucifixion, on the one hand, and to the sovereignty of God, on the other. Third, I set out three phases in the politics of contemporary humanitarian aid in relation to an increasing concern for humanitarian warfare. I conclude that international humanitarian aid and humanitarian warfare are bound together through an autoimmune logic that simultaneously challenges and shores up state sovereignty. State sovereignty creates ‘refugees’, which necessitates humanitarian aid organizations to step in and literally fill the space between state borders, a space that has become a kind of ‘no-man's land’ beyond citizenship. Police and military respond to refugee camps by patrolling them to shore up national borders and state sovereignty. Non-governmental humanitarian aid organizations, supposedly operating outside of nation states, become a necessary supplement to state sovereignty.

Cultural property can be damaged to varying degrees during armed conflicts, such as the devastating blows inflicted on cultural property during WWII. In reality, when a country is at war, its cultural property is exposed to unintended or purposeful damage. Cultural property has been protected by laws and regulations since the early twentieth century, and humanitarian law provides specific measures on the issue. This article will examine the causes of attacks on cultural property in the context of today's armed conflicts and analyze the inadequacies of the protection of cultural property in today's international humanitarian law. Despite the growing concern of the international community for cultural heritage, there is still a lack of clear procedures and penalties for crimes against cultural heritage in the context of regional armed conflicts, and the international legal system needs to be further improved.

Abstract:This article presents the preliminary findings of a scoping study that Geneva Call is conducting to understand the existing dynamics between armed non-state actors (ANSAs) and cultural heritage. Geneva Call is a Swiss-based non-governmental organization dedicated to promoting the respect of international humanitarian law by ANSAs. The study centres on three case studies—Syria, Iraq, and Mali—on which information has been obtained through desk and field research, interviews with ANSAs operating in those countries, and with leading organizations committed to the protection of cultural heritage, globally or regionally. The article first maps the various attitudes of ANSAs toward cultural heritage, highlighting both positive and negative examples from current practices. Then it analyzes the response of specialized organizations to the impact of ANSAs on cultural heritage and their level of engagement with these actors on cultural heritage issues. Finally, the conclusion offers some tentative recommendations to enhance the respect of cultural heritage by ANSAs in non-international armed conflicts.

AbstractThe destruction of cultural heritage in armed conflicts has gained increasing political momentum and visibility over the last two decades. Syria, Iraq and Mali, among others, have witnessed the intentional destruction of their cultural heritage by non-State armed groups (NSAGs) that have invoked Islamic law and principles to legitimize their actions. The response of the international community has predominantly focused on the material aspect, to the detriment of the significant impact on the associated intangible manifestation of cultural heritage in local communities. This article argues that several Islamic legal rules and principles may, more adequately than international humanitarian law, safeguard the intangible dimension of cultural heritage in certain contemporary armed conflicts in Muslim contexts. It aims to demonstrate the importance of drawing from multiple legal traditions in order to enhance the protection of intangible cultural heritage in armed conflicts and to strengthen engagement with the relevant NSAGs.

At a time when some informed Muslims believe Islam to be “set on a collision course with the West” and some Christians warn of a “perhaps irrational but surely historical reaction of an ancient rival against our Judeo-Christian heritage,” it may be helpful to ask what both traditions teach about current issues of joint concern. One of the most urgent of these issues is the question of forcible humanitarian intervention. Setting aside broader questions of interpretation, such as the extent to which Islam can be identified with political radicalism and Christianity with Western political interests, this essay compares Muslim and Christian teachings on this issue. Both traditions have had to confront questions of political violence, suffering, and war since at least the time of the conversion of Constantine in one case (1,600 years ago) and the founding of the first Islamic state at Medina in the other (1,300 years ago). The central argument in this essay is that there is a surprising measure of agreement between the two traditions on the question of forcible humanitarian intervention, enough to provide the basis for a shared doctrine.

For centuries church bells have constituted an inherent element of religious and social life. Due to their artistic and pecuniary value, the bells have also been subjected to forced removal and/or pillage. This article discusses the role of church bells as vehicles of the collective memory and cultural identity of selected ethnic and religious communities in Europe which were deeply affected by the post-World War ii territorial arrangements: namely, the Italian, Slovenian and Croatian communities of Istria and Ukrainians re-settled from Poland. Against the background of these cases it explores the clashes within various layers of international law dealing with culture and cultural heritage: humanitarian law, state succession, protection of the integrity of cultural heritage sites, and human rights. Viewed through such a lens, some suggestions are offered on how to overcome these conflicts in order to enforce the cultural rights of communities and protect their right to enjoy their material and spiritual heritage.

AbstractThe International Committee of the Red Cross (ICRC) Library was first created at the initiative of the ICRC's co-founder and president, Gustave Moynier. By the end of the nineteenth century, it had become a specialized documentation centre with comprehensive collections on the International Red Cross and Red Crescent Movement, international humanitarian law (IHL) and relief to war victims, keeping track of the latest legal debates and technological innovations in the fields related to the ICRC's activities. The publications collected by the Library until the end of the First World War form a rich collection of almost 4,000 documents now known as the ancien fonds, the Library's Heritage Collection.Direct witness to the birth of an international humanitarian movement and of IHL, the Heritage Collection contains the era's most important publications related to the development of humanitarian action for war victims, from the first edition of Henry Dunant's groundbreaking Un souvenir de Solférino to the first mission reports of ICRC delegates and the handwritten minutes of the Diplomatic Conference that led to the adoption of the 1864 Geneva Convention. This article looks at the way this unique collection of documents retraces the history of the ICRC during its first decades of existence and documents its original preoccupations and operations, highlighting the most noteworthy items of the Collection along the way.

Abstract. This paper aims to highlight the importance of fast and safe documentation of the damage to cultural heritage after a natural or anthropic catastrophe, with greater relevance of civil society. In these situations, in which humanitarian aid to the population and care needs are the priorities for the local authorities, proper prior planning of data collection and their transmission may aid faster and better decision-making in an emergency. New technologies are among the most effective tools to carry out such damage assessments actions. Therefore, we are currently establishing adequate planning and training of the local civil society, through projects that aim to achieve specific goals, enhancing their capacity to protect heritage, and improving the resilience of the inhabitants after disasters. Most heritage projects that work towards the recovery and conservation of heritage after an emergency occurred do not consider the local population. Therefore, in this paper we offer an approach for heritage workers in the hope that by including the local population, the documentation of heritage destruction can lead to better methods in the future.

In this paper, I look into the moral foundation of humanitarian intervention in international law and its Islamic counterpart. My objective is to identify the traits shared by both sets of laws, and to see if the same or similar justification can be used across cultures to reach the same goal. In other words, one goal is to assess the claims that the basis upon which humanitarian intervention is justified has a universal appeal. Both international and Islamic law justify humanitarian intervention on moral grounds. International law bases its justification upon the human rights discourse. Islamic law provides enough bases for legitimizing humanitarian intervention, and Qur’anic verses, scholarly opinions, and Islamic principles provide a sound background for it. Paramount in this task is the concept of human dignity (karamah al-insan). We found no disagreement on this fundamental issue between the Universal Declaration of Human Rights (UDHR) and Islamic law. Human dignity, as understood in international human rights and its Islamic counterpart, thus could form the jus cogens of international law, a common human heritage upon which everybody can agree.

Résumé Un bref regard sur l'histoire de la Chine montre que les princes et les stratèges ont toujours insisté sur la nécessité de ménager la population civile dans la guerre, car, sans le soutien du peuple, il ne serait pas possible de contrôler un pays. Un proverbe chinois dit: «Pour gagner une guerre, il faut d'abord gagner le cœur des gens». Au début de la guerre révolutionnaire en Chine, Mao Zedong a promulgué des directives qui vont dans le même sens, en insistant particulièrement sur la discipline des soldats. Sous une forme adaptée, ces directives sont valables encore aujourd'hui. L'auteur décrit les mesures prises et les programmes en cours actuellement au sein de l'armée chinoise pour diffuser les connaissances nécessaires en droit international humanitaire parmi les officiers et la troupe. Il conclut en constatant que même après la fin de la guerre froide, les Conventions de Genève n'ont rien perdu de leur importance.

The research paper deals with innovations brought about in educational programs bythe national strategic program "Cultural Heritage" (2004-2011), developed for studying, restoring and keeping the historical and cultural heritage of the country; reviving historical and cultural traditions; propaganda of material and spiritual heritage of the Republic of Kazakhstan abroad. The program’s contribution to the development of secondary and higher education in the country is estimated on the basis of comprehensive analysis of the results of various studies which have contributed to the formation of innovation in educational processes of Kazakhstan in the context of Eurasia. All this is made through identification of common trends in various scientific studies on humanitarian grounds, review of similar research in the world. The main chronological range of historical processes reconstructed for implementation into educational programs, is determined from the Paleolithic era to the ethnographic present. This article presents research on museums during the occupation and annexation of Crimea since 2014, as well as information relating to institutions in the Kyiv, Kherson, and Zhytomyr regions of Ukraine following Russia’s full-scale invasion in 2022. The first part of the article analyzes the situation of the Museum of Crimean Tatar Heritage housed in the sixteenth-century Bakhchysarai Palace. In the second part, the article discusses museums dedicated to Joseph Conrad, Polina Rayko, and Maria Prymachenko, together with activist ‘open-air’ museums by Banksy in the de-occupied part of the Kyiv region. With these geographical emphases, this article complements others in this collection.

AbstractThe Peace of Westphalia released forces leading to the Industrial Revolution, ultimately freeing sovereign states to develop competing systems of economic development that had in common the uncontrolled exploitation of the environment. Over time, a law of humanity developed in response to the failings of a law of sovereign states in two main spheres: that of the dignity of the individual and that of matters of “common concern” that require a global, humanitarian response. Environmental issues have moved to the forefront of the latter, as can be demonstrated by an examination of terms used in international law to describe environmental matters, and have given rise to new forms of international and transnational cooperation. By being reminded that humanitarian issues of common concern were at the root of the Westphalian shift itself, we see that it is the radical form of sovereignty that developed in the 19th and 20th centuries that in fact proved inadequate. The key questions, therefore, are what the global environmental challenge teaches us about the potential for sovereignty to be “reclaimed” for humanity, and how and whence authoritative norms to modulate sovereignty will arise.

Over the past four decades, building modeling has taken numerous forms utilizing available technologies and software. Building information modeling (BIM) has significantly developed with the continuous advancements in the information technology and hardware industries. The evolution of BIM has attracted many researchers to explore its possible applications in modeling buildings and facilities with a humanitarian heritage value. However, researches have not been limited to that, as they later expanded to test the applicability of BIM in progressing the fields of maintenance and rehabilitation, operation and management, and even checking the durability of such buildings against varying circumstances and usability as well. As a result of a deep literature review, this research is developed to provide a critique of the previous studies conducted on the fields of heritage building information modeling (HBIM), the relevant software and equipment used in those studies, as well as case studies and applications used to demonstrate HBIM capabilities. Also, two case studies of Qasr Al Farid and Al-Bugiry buildings in KSA were implemented in this research to demonstrate the capabilities of HBIM in preserving the heritage value of historic buildings and monuments and to provide possible means of archiving the heritage value of those buildings utilizing state-of-the-art technologies. This study is expected to aid governments and decision makers of heritage buildings in understanding the positive impacts of including the HBIM in their management and operational processes, and will also act as a beneficial guiding tool for academic researchers to identify the gaps and limitations in previous studies to work towards overcoming them.

After losing control of the capital Sanaa to Yemen's northern Houthi movement, which is aligned with forces loyal to the former president ʿAli ʿAbd Allah Salih, current Yemeni President ʿAbd Rabbu Mansur Hadi turned to Saudi Arabia for help. In March 2015, Saudi Arabia and its coalition of nine states began a bombing campaign in Yemen, the poorest country in the Arab world. Prior to the conflict, Yemen was already 90-percent dependent on imported food and had been battling a severe water deficit. A twenty-eight-month-long siege of its civilian population has left the country in a situation that some humanitarian groups deem to be worse than the crisis in Syria. The media has barely covered Yemen's catastrophic crisis, partially because of overt censorship by the Saudi kingdom and a shielding of its systemic violations of international law by powerful allies including the United States, the United Kingdom, and France. These countries are clearly more concerned with billion-dollar arms deals with the kingdom than with putting an end to what has been described as the worst food crisis since the establishment of the United Nations.

For half a century, the Nuremberg and Tokyo trials and national prosecutions of World War II cases remained the major instances of criminal prosecution of offenders against fundamental norms of international humanitarian law. The heinous activities of the Pol Pot regime in Cambodia and the use of poison gas by Iraq against its Kurdish population are among the many atrocities left unpunished by either international or national courts. Some treaties were adopted that provide for national prosecution of offenses of international concern and, in many cases, for universal jurisdiction; but, with a few exceptions, these treaties were not observed. Notwithstanding the absence of significant prosecutions, an international consensus on the legitimacy of the Nuremberg Principles, the applicability of universal jurisdiction to international crimes, and the need to punish those responsible for egregious violations of international humanitarian law slowly solidified. The International Law Commission, veterans of the Nuremberg and Tokyo proceedings, individuals such as Rafael Lemkin (who advocated the adoption of the Genocide Convention) and a handful of academics (most notably M. Cherif Bassiouni), among others, helped keep alive the heritage of Nuremberg and the promise of future prosecutions of serious violators of international humanitarian law.

The article is dedicated to the research into the problem of historical and cultural heritage, the preservation of which is especially important for the survival and development of small nations. The relevance of the chosen topic is justified by the search for a comprehensive mechanism for the preservation of cultural heritage, which is underrepresented in cultural theory and practice. The research subject is the development of this mechanism. The article aims to determine the strategic directions for the preservation and prospective development of the small nations’ cultural heritage on the example of the Republic of Abkhazia. The methodological basis of the study is the cultural and system-level approaches. A set of methods, including comparative and SWOT analysis are used to achieve the goal. The novelty lies in defining for the first time a system-level mechanism for the preservation of historical heritage as non-material cultural legacy. The authors have identified the basic levels in the system of measures for the preservation and prospective development of the cultural heritage of Abkhazia, which consist of international, multi-country, state, individual (humanitarian). The individual level allows us to consider the studied problem taking into account a wide sociocultural and socio-political field. To sum up, in this article the authors substantiate the role and place of the system-level mechanism in the development of promising directions for a unified Strategy for the Preservation of Cultural Heritage, which is still missing in the socio-cultural discourse.

Urbanization is a relentless trend: while cities grow and expand, armed conflicts spill into urban areas, making cities the battlefields of our time. This has warranted the creation of new warfare tactics, which challenge the basic principles of International Humanitarian Law (IHL), and cause devastating consequences to civilian population, hospitals, schools, infrastructures, and cultural heritage.After having secured a thorough definition of “urban warfare”, still lacking in international law, this paper will explore the legal and political consequences that this phenomenon entails, paying particular attention to the protection of urban cultural heritage.During urban warfare, cultural sites are often destroyed as specific military targets, especially by Armed Non-State Actors (i.e. Palmyra) or transformed into battlefields (i.e. Aleppo and the Damascus Citadels). Moreover, urban cultural heritage is increasingly suffering the reverberating effects of armed attacks, as shown in Sana’a, Mosul, Raqqa, Gaza, Sabratha, Lubumbashi and Donetsk.To contrast this scenario, a reassessment of local, national, and international regulations is required. The 1954 Hague Convention and its Protocols, together with the 1977 Additional Protocols to the 1949 Geneva Conventions, oblige States to guarantee the protection of cultural heritage but lack any specific provision concerning urban warfare, where it is actually more threatened.Guaranteeing accountability for perpetrators of violations is also crucial. With reference to the destruction of mausoleums in Timbuktu in 2012, the International Criminal Court referred to armed attacks against urban cultural heritage as a war crime for the first time. No other judgments like this were made by the ICC though, regardless of the letter of intent signed with UNESCO (2018), still poorly implemented to date.This paper sets out to outline innovative and concrete solutions to guarantee the protection of urban cultural heritage, particularly through a better implementation and/or a revision of the relevant local, national, and international regulations. It will also explore effective ways to strengthen accountability mechanisms, thereby guaranteeing deterrent effects to future violations. Lastly, the role of international and regional organizations will be analyzed, with a view to propose pioneering practices, such as the establishment of a permanent annual forum for cooperation.

Archives, being significant institutions for protection and promotion of written cultural heritage should have programs for permanent training of employees dealing with preservation of cultural heritage in educational and cultural institutions as well as workshops and seminars that would prepare experts for education of pupils, students and elderly people. Appropriate methodology of education of professional staff is necessary in order to apply certain conservation treatments. Many problems appear when the professional training of staff who are supposed to work with sensitive archival material is in question. In order to create a proper preservation system within the archives network of Serbia, adequate education is necessary as well as training of professional staff. Concept of preventive and curative preservation should rely on appropriate interdisciplinary approach to the problem. Modern educative programs for conservation of written cultural heritage that could satisfy requests and problems of preservation are not available in Serbia. Without application of natural and humanitarian sciences, it is not possible to attain measurable results in the field of conservation whether it is matter of preventive preservation or curative conservation.

One expression of cultural rights is the right to enjoy cultural heritage. However, the latter is not efficiently protected in situations of armed conflict. In many cases, armed non-State groups (ANSGs) have destroyed or looted cultural heritage items. The United Nations Security Council has intervened with Resolution 2347 (2017), welcomed by many as a milestone in the international protection of cultural heritage in conflict situations. However, this Resolution presents several limitations. The protection of cultural heritage from destruction and exploitation does not appear as the main focus, but rather as a means to fight terrorist groups. The attacks against cultural heritage are considered “war crimes”, but only “under certain circumstances”. The Resolution encourages States “that have not yet done so to consider ratifying” treaties on the issue in question; however, these instruments are treaties drafted and ratified by States. Problems of compliance by non-State actors, as ANSGs, arise. Hence, the capacity of theResolution to effectively protect cultural heritage in conflicts involving ANSGs is debated. This paper analyses the text of Resolution 2347 (2017), resorting to traditional means of interpretation to highlight its limitations, and considers how a general sense of the necessity to protect cultural heritage from attacks committed by ANSGs has emerged, as demonstrated by the International Criminal Court's Al Mahdi case. The paper then considers other ways to guarantee the protection of cultural heritage from ANSGs. A proposal for stronger protection of cultural heritage by States through both international humanitarian law (IHL) and international human rights law (IHRL) is presented. In particular, the connection between the protection of cultural heritage, the guarantee of cultural rights and other human rights is presented, resorting to instruments of doctrine and analyzing instruments of practice. Finally, the case for the stronger international cooperation for the protection of cultural heritage is made; problems of compliance by ANSGs may persist, but the systematic destruction of cultural heritage items can be considered a violation of cultural rights, thus requiring the cooperation of all international stakeholders.

The purpose of the study is to reveal the contextual features of the actualization of the ancient heritage, in particular, the figure of Aristotle in German thought in the first half of the twentieth century, in particular, in the work of Werner Jaeger. The article examines the relationship between classical philology and philosophy in the academic environment, as well as the influence on the philosophy from the poetic circle of Stefan George. The scientific novelty lies in the identification of non-philosophical factors determining scientific research at the beginning of the twentieth century, which contributed to the appeal to the ancient heritage in Germany. As a result, authors identify the main stages that German humanitarian thought went through from classical philology to its own historical and philosophical studies of antiquity, in particular, the figure of Aristotle.

The relevance of the scientific article is due to the significant date of 2020 – the 1150th anniversary of the birth and 1060th anniversary of the death of Abu Nasr Ibn Muhammad al-Farabi-an outstanding thinker-scientist of the East, philosopher, encyclopedic, great humanist. At the world art history classes on the theme «Culture of the Arab-Muslim East», at creative seminars on the history of arts of Kazakhstan, the image of al-Farabi, recreated in the visual arts, and his humanitarian heritage are discussed. Al-Farabi is the author of commentaries on the writings of Aristotle (hence his honorary title of «Second teacher») and Plato. He is credited with the creation of the Otrar library. It should be recalled that in 1975, on a large international scale, Moscow, Alma-Ata and Baghdad celebrated the 1100th anniversary of the birth of al-Farabi. His irreplaceable intellectual heritage: he has works on ethics, politics, psychology, natural science, music, but especially known works on logic and philosophy. The main questions of the article: a brief biographical sketch of al-Farabi, about the artists A. Ismailov, S. Kalmakhanov, K. Azhibekuly, the creation of the image of al- Farabi in their creative heritage.

The article is dedicated to the research of the scientific heritage of Oleksandr Ivanovich Bondar – a famous Ukrainian linguist, professor, doctor of philological sciences, whose 70th birthday will be celebrated by the scientific community in 2022. The purpose of our article is to understand the place and significance of the scientific heritage of O. I. Bondar in modern linguistics. The object of observation is the scientific creativity of the professor. The subject of study is the problem of his linguistic development. The source base for our observation was the scientific heritage of the linguist. We set ourselves the following tasks: to reveal the problems of Professor Bondar’s scientific works; determine the specifics of his scientific activity; describe fragments of the ideological space of the linguist’s scientific discourse. The work uses such general scientific methods of research as analysis and synthesis, induction and deduction, observation, thematic and ideologue portraiture of the scientist’s personality. It was found that O. I. Bondar actively worked in such scientific areas as: history of the Ukrainian language, Ukrainian dialectology, word-form, syntax, lexicography, functional grammar, phonology, lexicology, terminology, linguistic ecology, Ukrainian orthography, text linguistics, sociolinguistics, general linguistics, Slavic studies, Japanese studies, comparison of Ukrainian and Japanese languages, translation studies, computer linguistics etc. Among them is linguistic ecology, a comparative analysis of the Ukrainian and Japanese languages, the study of which the scientist initiated himself. Knowledge of languages, non-standard thinking of a scientist and the desire to learn new things, not only in the field of his specialty, but also far beyond it – all this served as the basis on which the research self of Professor Bondar was formed. The article focuses attention on the innovative views of O. I. Bondar: the question of studying the category of temporality in the Ukrainian language is considered; the problem related to determining the time of emergence of the Ukrainian language; the quantitative composition of phonemes in the modern Ukrainian language and the degree of phonemicity of phonemes are substantiated; the theory of language as humanitarian capital; the issue of language as the main ethnic- forming factor for Ukrainians is highlighted. Conclusions. The ideological space of the researcher’s scientific works is based on the desire to study the language and its diverse phenomena as an integral dynamic object that is in close relationship with all other realities of human existence. Hence the multi-vector nature of the linguist’s works. Scientific work of O. I. Bondar, in particular the research perspectives outlined by him, his unusual “optics” of scientific observations, peculiar methods of studying linguistic phenomena, are the source of the further development of many areas of linguistic science.

This research paper will put forward innovative solutions to strengthen the protection of cinema during armed conflicts, in particular by contending that cinema could be qualified as cultural heritage, thereby falling under the protection of the relevant international Conventions. A special testimony made by artist Sergio Iovino will be first proposed, with a view to highlighting the importance to safeguard cinema and – broadly speaking – every kind of art in wartime. Moving from the current armed conflict in Ukraine, the paper will underline the need for a reassessment of the relevant international regulations. In particular, after having secured a comprehensive definition of cinema, still lacking in international law, it will propose an evolutionary interpretation of the UNESCO Convention for the Protection of the World Cultural and Natural Heritage (1972), the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (2003) and the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions (2005). The paper will then analyze the legal relations between International Humanitarian Law (IHL) and filmmaking, which remain nebulous. The 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict never refers to cinema, but simply mentions “objects of artistic interest” (art. 1), and already such a definition fails to accommodate cinema’s mongrel nature and complex production process. An adaption of IHL, starting from the 1949 Geneva Conventions and their Additional Protocols, will be therefore put forward in order to ensure that the art of filmmaking can enjoy legal protection in all phases of an armed conflict.

The article reveals the system of spiritual and moral virtuous values in the philosophical, pedagogical and socio- ethical heritage of Al-Farabi. The scientist’s ideas on spiritual and moral education are systematized. These ideas are illustrated by the main categories such as «virtuous city», «intellectual virtue», «ethnic virtue», «upbringing», «teaching», «intelligence», «judgment», «happiness». The educational heritage of al-Farabi is considered in terms of the philosophy of modern science. A brief biography of the thinker, the pedagogical concept of al-Farabi, including the methodology of pedagogy, the theory of upbringing, didactics, the theory of education, and methodology are described. The ideal of upbringing is presented, which is reflected in the human qualities of a resident of a virtuous city, such as culture, politeness, high discipline, wisdom, intelligence, intelligence, understanding, helping, supporting, collective, endurance, heroism, justice, generosity. The content of the categories «training», «upbringing», «education», «learning», «intelligence» has been clarified. The article reveals the potential of humanitarian methodology and humanistic principles in the study of the spiritual and moral heritage of al-Farabi. The definitions of the basic concepts of spiritual and moral education in the context of the national idea «Mangilik el» are given.

Over the years, the spiritual heritage of the great Abai Kunanbayev has been studied in terms of various aspects of socio-humanitarian science, such as linguistics, literary criticism, philosophy, history, psychology, sociology, etc. This article reflects the creative intentions of the thinker, who raised the spiritual potential of the Kazakh people to the world level, as well as the influence of European and Russian culture on Abai’s work. In Hakim Abai’s works, the problems of the national life of the Kazakhs, their worldview, character, religion, mentality, language and spirituality are raised, which are an invaluable heritage for the modern younger generation. As we know that in Abai’s studies, the main object is a person, i.e. personality who is perfect and worthy of respect. The scientist-thinker deeply impressed by aesthetic, ethical preferences, dreams, the meaning of life, feelings and intuition, the peculiarities of being and thinking of his imaginary image of a perfect Kazakh. Abai’s poems are rich in philosophical reflections and patriotic appeals. He found inspiration in Kazakh folklore and preached ideas and images of national heroes. Furthermore, the article represents the connection between the achievements of Abai’s poetic heritage and its creative potential in general.

The obvious vision for the future of our Muslim generations requires a depth study of our intellectual heritage and meditation. The interest of the nation of its inherited intellectual power is the scientific output of the Arab-Islamic culture. In our current study which includes four chapters we review the factors that influenced the construction and development of the Islamic educational thought since the era of prophecy until the demise of the Abbasid Caliphate, starting with religion and its role as a determinant of the educational values ​​in the community, both at the level of institutions or social values ​​ stating historical, political, social, scientific and cultural factors that played an influential role in the formulation, refinement and building the Islamic educational Thought and its evolution. And the most prominent Islamic educational thought that contributed in the identification and development of educational thought trends across the development of Arab-Islamic civilization.

The expansion and diversification of the museum space prompts researchers to return to the concept of «museum object», which is fundamental for all museum activities and theoretical museology. The interdisciplinary character of modern humanitarian knowledge gives way to the integration of the concepts of a museum object with new areas of material studies. These studies directly interact with museum practice and influence the construction of new museological theories. The dynamism of the new methodology of material research correlates with the performative nature of modern museum practices, therefore accentuating the mercurial relationship between material, intangible and digital heritage, the museum object itself and the museum collection. The developments and conceptual positions of material studies, transferred to museology, make it possible to substantiate the modes of soft musealization as a hybrid existence of an artifact in the museum and non-museum space, the legitimacy of creative research and interpretations of artifacts and collections, the relevance of their inclusion in museum practice. The considered methods can be fundamental not only for the fixation and representation of intangible heritage in the museum, but for creation and development of collections of digitized and digital heritage as well.

Summary The article examines the development of the concept of military necessity in relation to cultural property. Starting from 18th century and Emmerich de Vattel it continues to codifications of International Humanitarian Law in 19th century and finally focuses on 1954 Hague Convention and its 1999 Second Protocol. The article underlines the most significant trends in the development and aims to illustrate increasing respect for cultural property during the conflict. In its final section it presents more current issues related to cultural property protection and armed conflict: inclusion of human rights protection and matter of dual-use objects. Both questions are introduced in decision of the International Criminal Tribunal for the Former Yugoslavia in Prlić et al. case that investigates destruction of Stari Most in Mostar. The decision shows that some new elements have to be considered in assessment of military necessity related to cultural property.

The article deals with the role of classical falsafa heritage in the modern Islamic philosophical discourse. Based on interpretations of texts of modern Islamic philosophers, the authors come to the conclusion about the relevance of the philosophical heritage of the past for the development of directions and methodologies of modern humanitarian knowledge. Conducting a comparative analysis of the doctrines of the Islamic Middle Ages and modern philosophers, the authors substantiate the commonality of approaches to the conceptualization of subjectivity, obligation, and existence. Modern Islamic philosophy is an experience of interaction between philosophy and theology. In Islamic philosophy, ethical questions were posed in connection with the discovery of moral consciousness in man. Human being, defined by moral sense, is understood by Islamic philosophers as a moral sensible being, in which a moral man and a moral society are formed. Exploring this issue, the authors have come to understand the integrity of modern Islamic philosophy, its interpretation as a philosophy of morality and moral philosophy.

It is based on author's algorithms for the analysis of the state of the market of cultural values and the calculation of the "evaluation base", as well as the indicator of the level of the average annual expenditure of citizens to meet their own humanitarian needs. An example of the evaluation of a unique monument of archeology and a table of value indicators are provided, which greatly simplifies the work of professional appraisers.

AbstractThe purpose of this article is to suggest some historical milestones for a retrospective reflection on the photographic archives of the International Committee of the Red Cross (ICRC). This collection is little used by researchers, although the 120,000 photographs which it contains have helped to forge the symbolism and identity of the institution and to document its operations in accordance with a memory preservation policy which gradually emerged in the course of the 20th century. The photographs shown in this article are divided into three main themes (the ICRC delegate, the context of action, suffering and the victims), in order to make it easier to discuss the key aspects of this tremendous visual heritage which looks at humanitarian action, its protagonists and its beneficiaries from an anthropological and ethnological point of view.

Rapid urbanization is one of the main characteristics of the 21st century. Urban systems are critical in creating urban displacements during such rapid processes. In most cases, urban displacements are triggers and catalysts of some urban crises, generating extra obstacles and pitfalls to humanitarian and sustainable development in urban areas. One of the major impacts of the rapid urbanization process is the process of urban house displacement. In historic and heritage cities, towns, or villages, we see the trend of displacing urban homes as a result. In the name of urban heritage protection, cities and towns/villages are converted into large-scale open-air museums, where the local residents are often evicted. To understand the connections and interactions between urban house displacement and urban heritage protection, this study explores key influential factors of decision-making in the directions of urban development, using the grounded theory for cause extraction and categorization and providing political implications for urban planning and regeneration projects. The case studies for this brief study are three cities of Dali, Lijiang, and Shangri-La in western parts of Yunnan Province, China. This paper utilizes mapping studies of the heritage sites of these three cities based on the surveys conducted in July 2022. Issues of urban regeneration and displacement scenarios are observed, assessed, and discussed for us to open up further debates on what causes the displacement of local residents in such contexts.
