This thesis seeks to investigate the possibility that the binary opposition between retributive and restorative forms of justice that structures the discourse on justice is unhelpful and unnecessary, particularly for societies seeking to extricate themselves from violent conflict and towards building peace and democracy. I shall argue for the importance of considering restorative justice as conceptually and historically prior to the possibility of retributive justice rather than the negation of one or the other, as well as advocate the potentially greater transformative power of the values of restorative justice which may provide a constructive alternative to retributive justice in the context of post-conflict peacebuilding.

Since the 1980&rsquo
s, many dictatorships around the world have been replaced by new democracies. These old dictatorships were notorious for their human rights abuses. Many people were killed and tortured
and many others were disappeared. When the new governments came into power, they had to confront these injustices that were perpetrated under the predecessor regime. This was necessary to create a culture of human rights
promote a respect for the law and access to justice. Many confronted these injustices in different ways, some granted amnesty, some prosecuted and others instituted truth commissions. This research paper focuses on truth commissions. The research focuses particularly on the study of the South African Truth Commission. The mandate of the South African Truth Commission is analysed and the investigation into whether the commission served the purpose for which it had been established is discussed.

Transitional justice has undergone tremendous shifts since it was first used in Latin American and Eastern European countries to address post-authoritarian and post-communist legacies of atrocity and repression. In particular, the establishment of the International Criminal Court (ICC) has increased the demand for prosecutions within a field that was previously marked by compromise and non-prosecution. While there are increasing expectations that countries with unresolved claims of human rights abuses should enact transitional justice policies, most of the literature on the subject largely omits to explain how elites from those countries choose among the possible options of transitional justice, and specifically, how they choose among international prosecutions, domestic prosecutions, and truth-seeking. Using case studies of Kenya and Uganda, this dissertation examines this decision-making process to understand how elites choose and reject different transitional justice policies. Theoretically, the research examines how preferences for transitional justice policies are constituted through “judicial statecraft”: the strategic efforts by heterogeneous, interest-pursuing elites to use justice-related policies as carrots and sticks in the overall contestation of power. The research finds that the choices of elites about judicial statecraft depend on three factors: the extent to which the elites are secure that their policy choices cannot be subverted from within; the cost and credibility of transitional justice threats; and the effects, both intended and unintended, of history.

En réponse aux cycles de violences de masse et à la guerre civile qui ont jalonné son histoire douloureuse, le Burundi s’est engagé dans un processus de justice transitionnelle, officiellement depuis la signature des Accords de paix d’Arusha en 2000. Malgré la mobilisation des énergies internationales et l’omniprésence de la problématique au sein du débat public depuis douze ans, seules des consultations nationales destinées à recueillir l’avis de la population burundaise sur le sujet ont été organisées en 2009. Á l’aube de la mise en place d’une Commission Nationale de Vérité et de Réconciliation, à laquelle devrait être associé un tribunal spécial, le constat de la nature globale de la justice transitionnelle s’impose. Cette globalité s’exprime à travers le recours à des instruments à la fois judiciaires et extra-judiciaires mais également à des outils ayant vocation à s’appliquer de façon immédiate (ou conjoncturelle) et durable (ou structurelle). D’une part, dans une perspective normative et légaliste, le processus global de justice transitionnelle semble être cause d’inerties et de blocages comme peut a priori l’illustrer le cas du Burundi. D’autre part, à la lumière d’une approche systémique et inclusive, la globalité est au contraire source d’évolutions et d’émulations qui stimulent la créativité de la justice transitionnelle comme le démontre également le Burundi. Cette justice elle-même en transition est en réalité une justice réconciliatrice porteuse de doutes mais aussi d’espoirs. Elle est une justice complexe qui s’invente chaque jour, qui ne peut être efficace et efficiente qu’à condition d’être adaptée, légitime et appropriée par ceux à qui elle est destinée. Elle implique que soient trouvées des réponses satisfaisantes aux souffrances et aux besoins indissociables des victimes et des auteurs des violences de masse d’hier et des injustices sociales d’aujourd’hui. Elle a aussi pour ambition de prévenir la commission des crimes du futur en participant au renforcement de l’État de droit et, de façon plus globale, de rompre avec l’histoire de violences symboliques et actives subies et perpétrées au Burundi
As an answer to cycles of mass violence in Burundi, a transitional justice process has been opened. The Burundian case study presents some particularities among this kind of process. Whereas the Arusha peace and reconciliation agreement for Burundi in 2000 decided setting up two transitional justice instruments, a special court and a Truth Reconciliation Commission, the transitional justice process has not begun yet. Only National Consultations were organized in 2009. The negotiations and the mediation occurred during the ongoing war. There were no winners and no losers but just armed men who decided to discuss in order to conquer the power and then to keep it. That may explain why negotiations were so longer and staggered. A sort of consociativisme system was set up in Burundi as the model organization of power-sharing. Inside the politic game of power-sharing the peace-justice dilemma appears through instrumentalization of retributive justice which is assimilated to justice and the truth and pardon which claim referring to peace. Another particularity is found regarding numerous judicial and legal reforms relatively to children rights, lands conflict, electoral law or Criminal Code. On the eve of the implementation of the Truth Reconciliation Commission, the global nature of the transitional justice process is obvious. The Burundian context appears as an illustration of the extensive meaning of transitional justice which represents a justice in transition. The global nature of the matter is emerging through its temporal and disciplinary versatility. On one hand, transitional justice seems to be past justice, currently justice and future justice at the same time and on the other hand it may take several forms out of the official one, initially predicted. In a legalist and normative view, global nature of justice in transition might cause deadlock regarding the case of Burundi. In a systemic and multidisciplinary perspective, global nature of justice in transition reveals change capacities according to the case of Burundi. What really matter in such transitional justice process is relieving victims and perpetrators’sufferings which are undeniably linked and bringing answers to each protagonist of the crime as to the society with the permanent and ambitious aim of reconciliation

The professorial inaugural lecture is for the university an occasion to celebrate - celebrate in the full meaning of the word, i.e. to perform publicly and duly, to observe and honour with rites and festivities, to publish abroad, praise and extol. Through the custom of the inaugural lecture the university celebrates and affirms its basic function, that of creating, preserving, transmitting and applying knowledge, particularly scientifically-based knowledge. The university appoints to the position of professor one who has attained excellence in the handling of knowledge in her or his discipline, and through a jealous watchfulness over the dignity and esteem of this time-honoured position of excellence amongst scholars, defends the capacity of the university to advance human knowledge and human progress. The University of the Western Cape is particularly honoured to celebrate by way of this address the inauguration of its first ever Professor of Human Rights Law. We take pride from both the position and the incumbent: the post demonstrates our commitment to scholarly relevance, the incumbent to the pursuit of excellence. This university has distinguished itself amongst South African educational institutions for the way that it has grappled with questions of appropriate intellectual and educational responses to the demands of the social and political environment. That search involved debates and contests over what constitutes knowledge or valuable knowledge, over the nature of the process of knowledge production, over the relationship between theory and practice, about autonomy and accountability, about the meaning of "community" and about how the activities of a university are informed by the definition and conception of "community". The decision to establish a chair in Human Rights Law was arrived at as part of that process of searching for the appropriate forms of curricular transformation. South African society with its history of colonial conquest and latterly apartheid rule is one bereft of a rights culture; and where the discussion of a bill of rights and the general establishment of an awareness of human rights had been started in recent times, it has often been motivated by a concern with the protection of traditionally advantaged sectors of society. A university like ours has an obligation to contribute to the debate about and the promotion of human rights in ways which will also be concerned with healing, reparation and reconstruction in this severely brutalised nation. In this address marking his formal assumption of the University of the Western Cape’s Chair in Human Rights Law, Kader Asmal gives testimony of the depth of scholarly rigour and the breadth of humane concern brought to and emanating from this position. The integral coming together of Asmal the international scholar, the anti-apartheid activist of long standing, the seasoned international solidarity worker, the spirited publicist is evidenced in this address which is sure to stand as a signal point of reference in our national debate about this complex subject. The University had been privileged to attract to its staff some of the finest scholars from the ranks of the formerly exiled South Africans; this inaugural ceremony provides the institution with the opportunity to welcome into its midst one of those in the person of Kader Asmal.

Toute réflexion sur la pensée politique africaine ne peut faire abstraction du problème du recouvrement de celle-ci, par le discours africaniste. L’hégémonie de ce discours est en partie à l’origine de notre réflexion sur les fondements théoriques de la modernité politique en Afrique qui souhaite poser les jalons d’un programme de recherche au long cours sur la pensée politique africaine. Notre thèse est également motivée par une anticipation de sens plus fondamentale, qui postule et voudrait montrer que la pensée africaine a toujours joué un rôle de premier plan dans la construction de la modernité politique du continent. Nous analyserons les contours et le contenu de cette pensée à l’aide d’une méthode de recherche et d’un principe de raison qui puissent en rendre compte avec conviction et lucidité. Notre thèse poursuit donc deux objectifs principaux. Premièrement, élaborer une critique de la raison africaniste qui fasse place à une herméneutique des discours endogènes sur le politique en Afrique, selon une méthode d’investigation que nous appellerons phénoménologie politique. Any consideration of African political thought cannot disregard the issue of its recovering by Africanist discourse. The hegemony of this discourse is partly at the origin of our reflection on the theoretical foundations of modernity in Africa, that seeks to lay the foundations for a long-term research agenda on African political thought. Beyond a contention with the Africanist discourse, my thesis is also motivated by a more fundamental objective that presupposes and seeks to demonstrate that African thought has always played a vital role in the construction of the political modernity of Africa. I will analyse the contours and content of the theoretical foundations of that african political modernity through a methodology and a principle of reason that will bear witness to those foudations with conviction and lucidity. My doctoral dissertation therefore has two main objectives. First, it seeks to develop a critique of Africanist reason that will lead to an interpretation of endogenous discourses on politics in Africa, through a method of investigation called political phenomenology. Such a phenomenological understanding of politics as an instrument that can elucidate African modernity in Africa will be based on a critical interpretation of major african political texts written in both French and English. Secondly, my thesis aims at developing a philosophizing history of African political thought, providing a precise understanding of its concepts and issues. In sum, this dissertation would have achieved its objective if it read as a philosophical meta-narrative on African modernity, the specificity of which I shall define

The seven women who shared their stories of rape at the human rights violation hearings of the Truth and Reconciliation Commission ('TRC') in South Africa offer a nascent public record of women's experiences of rape under apartheid. This project is motivated by a desire to examine how these testimonies of rape were affected by explicit and implicit underlying narrative frameworks associated with the language of the TRC, and that of rape. In particular, this project analyses the extent to which the juxtaposition of these two frameworks at the TRC may have either enabled or constrained the seven women's narratives.

This study focuses on the structure and process of forgiveness as experienced by individuals, from the East London and surrounding areas, who either suffered gross human rights violations or who are related to someone who suffered gross human rights violations during the Apartheid era. Those who participated in the study testified at the Truth and Reconciliation Commission and expressed forgiveness towards the perpetrators of the violations. The aims of the study were to reveal: the participants' structure cif forgiveness, i.e. how they define forgiveness; the process of forgiveness, i.e. the changes that took place from the time of the violation up until the participants forgave the perpetrators: and, the relation. if any. between the participants' structure and process of forgiveness. It is argued that mainstream Psychology has neglected to study forgiveness because the subject matter is incompatible with the natural scientific method. For this reason, the study was approached from a hermeneutical paradigm. This was motivated by its ability to explicate the meaning and content of phenomena. Unstructured qualitative interviews were conducted with the participants. Data was analyzed using a multi-layered process of progressively deeper interpretation, employing a reading guide technique. Results indicated that authentic forgiveness is an unconditional commitment on the part of victims and survivors to relate positively towards the perpetrators. The relationship should include non-bitterness, non-vengeance, unconditional love and respect for their human rights. Another significant dimension of the structure of forgiveness is the fact that the desire for the truth is not abandoned although forgiveness has taken place. Forgiveness also does not take away the effects of the violation. This means that one does not forget although forgiveness has been granted. Results further indicate that the forgiveness process is highly complex, individualized and not instantaneous. The individuals have to deal with various intrapersonal conflicts and anxieties as a result of the violation, before forgiveness is explored as an option, and before they can finally forgive. Significant interrelations between the structure and process of forgiveness were also identified.

In the last two decades, many countries going through transitional justice have established truth commissions. Unlike conventional war tribunals, most truth commissions are established by the local government and local human rights groups. Truth commissions are still a nascent political choice, yet a sizable literature has developed around it, evaluating its potential as a new institution for dealing with the past and moving towards restorative justice. This work examines four major questions debated in the transitional justice literature over truth versus justice: 1) whether or not a truth commission is an valid alternative mechanism to seeking out retributive justice, 2) whether or not truth commissions are the product of political compromise which avoiding justice, 3) if truth commissions can be the agent of new national identity and national unity founded on the principles of universal human rights, and 4) if amnesty can be legitimized. This work aims to determine to what extent the idea itself of truth commissions has been actualized up to now and what lot it may expect in the future, despite incidental political restrictions and difficulties in the political transition. Despite the common assertion that the goals of truth commissions are to bring about official acknowledgment of the past, restore the dignity of the victims, and achieve reconciliation in divided society, this paper does not intend to evaluate the truth commissions in the past based on these criteria; nor does this work intend to argue what truth commissions can resolve in the transitional justice societies. Rather, this paper seeks to uncover what social reaction or human emotions truth commissions in the past have evoked in a divided society. To explore the question, this paper focuses on the distinctive activities and merits of truth commissions from the standpoint of retributive justice and looks into the important implication in the interaction between the victims and the perpetrators, as well as between the audience and those two parties. Roger Errera, a member of the French Conseil d’Etat, stated that “Memory is the ultimate form of justice.” Inspired by the statement, this work argues that justice can be found in the act of pursing truth, remembering it, and responding to those voices from the past.

The present thesis seeks to problematize the UN discourse within transitional justice. Many scholars have pointed out that the discourse has been normalised and that is why it is in need for deconstruction. The study aims to critically analyse how justice and reconciliation are understood in the field. For the purpose of the study Derrida’s concepts on justice and forgiveness have been chosen as theoretical frameworks. The method of study is a deconstructive analysis, based on Derrida’s notion of deconstruction. The method implies analysis of language of the research material, i.e. four UN reports regarding transitional justice from 2004, 2009, 2010 and 2011. The study has shown, firstly, that the rule of law concept is closely connected with the idea of justice and, secondly, justice is often reduced to accountability. That in turn explains the dominance of the juridical instruments in transitional justice processes. Apart from this, based on Derrida’s concept of forgiveness, reconciliation and mechanisms applied represent a conditional forgiveness, seeking to re-establish normality. Another problem is that reconciliation is not sufficiently approached in the reports. Nevertheless, the history of the transitional justice development has shown that there is a potential for further changes and that is why it necessary to continue question the established norms.   Finally, deconstruction analysis has proved to be an adequate method for analysing transitional justice discourses and contributed to a nuanced analysis. The use of two languages, English and Russian versions of the reports allowed to identify and visualise some conceptual constructions that could otherwise have been missing.

The African Court on Human and Peoples’ Right (the Court) is the most recent of the three regional Human Rights Bodies. Envisioned by the African Charter on Human and Peoples’ Right, its structures was not planned until the Organisation of African Unity (OAU) promulgated a protocol for its creation in 1998. The Court complements the protective mandate of the African Commission on Human and Peoples’ Rights (‘The Commission’) and the Court has the competence to take final and binding decisions on human rights violations. Unlike its European and inter-American versions where their courts are integral parts of the cardinal instrument of the system ab initio, the establishment of the African Court was merely an afterthought. At the initial, protection of rights rested solely with the Commission upon African justice system which emphasises reconciliation as it is non-confrontational method of settlements of. The Commission is a quasi-judicial body modelled after the United Nations Human Right Committee without binding powers and with only limited functions covering examination of State reports, communications alleging violations and interpreting the Charter at the request of a State, the OAU or any organisation recognised by the OAU. The thesis answers the question whether the adoption of the African Court means that the African model of enforcing human rights has failed or whether having the Court constitute a concession to the triumph of the western model of law enforcement. The imperative of the 30th Ordinary Session of the OAU in 1994 where the creation of an African Court of Human and Peoples’ Rights was viewed as the best way of protecting human rights across the region would be treated. The relevance of such an examination is highlighted by the fact that the African Charter did not make any provision for the establishment of a Court to enforce the rights guaranteed thereunder. If we are to assume that justice by reconciliation has failed and should be replaced by or complimented with justice by adjudication as the primary means of conflict resolution, what guarantees are there that the latter form of justice will not also fail? This thesis therefore will critically evaluate the African Court on Human and Peoples’ Rights and assessed its potential impact on the African human rights system. It will also probe the power of the Court and see whether a clear and mutually reinforcing division of labour between it and the African Commission can be developed to promote and protect human rights on the continent. This research brings to focus an area that requires attention if the African human rights regime is to be effective. It put to test the criticism against the African Charter and the Protocol to the African Charter on the Establishment of an African Court on Human and Peoples’ Rights and also identified the present existing flaws in the African regional system. Furthermore, it ascertained whether or not, given the availability of other options, a regional Court is, in fact, the ideal mechanism for the protection of human rights in Africa.

Transitional justice (TJ) in Zimbabwe can be gleaned as a maze of detached filaments mainly championed by civil society organisations. Though the origins of TJ as a discipline are polemic and debatable, going as far back as Athenian times, TJ was visibilised in the 1990s during the third wave of democratisation, when it developed globally as a self-consolidating field and transdisciplinary concept which focused on outcomes such as prosecution, truth-telling, guarantees for non-recurrence, vetting, and the payment of reparations for victims of conflicts. The traditional focus of TJ was largely template-based or some kind of one-size-fits-all concept which focused on truths and reconciliation concepts. Significantly for victims of violent conflicts, repressive rule and serious human rights abuses, the emerging approach to TJ at the United Nations (UN) and regional institutions such as the African Union (AU) and institutions such as African Commission on Human and Peoples’ Rights (ACHPR) has been to focus on country-specific, localised, and holistic approaches that enhance transformative transitional justice in countries striving to find lasting solutions to deep problems caused by armed conflicts or serious human rights violations. While there is a robust nexus between human rights, democracy, and TJ, the link is weaker for TJ as it remains an elusive concept in Zimbabwe. Besides, TJ efforts yield different considerations and impacts on racialised, ethnicised, politicised, and institutionalised challenges in Zimbabwe. In most cases, the elusive nature of TJ is felt by victims, their family members, community dwellers, community-based organisations, and faith-based organisations than alleged perpetrators. TJ is perceived in this thesis to be a critical concept that should be properly aligned with internationalised and localised responses. This thesis shows that international agencies now recognise and essentialise the important roles that national institutions (formal or informal), can play in preventing the occurrence and/or recurrence of conflicts and can also play in fostering sustainable cultures of human rights. Specifically, the thesis covers examination of how institutional complementarity between two independent institutions supporting democracy in Zimbabwe; the National Peace and Reconciliation Commission (NPRC) and the Zimbabwe Human Rights Commission (ZHRC) can be innovatively used to enable the Zimbabwean society to formalise transitional or post-conflict justice using the Constitution and international normative frameworks. The overarching research question in this thesis is: what are the main challenges/limitations and opportunities/openings for the ZHRC and the NPRC to advance TJ in Zimbabwe? The specific research questions are 1. What does the international and national TJ normative framework entail and what is its theoretical force? 2. What constitutes a genuinely contextualised and holistic transitional justice in Zimbabwe? 3. How innovative have the NPRC and ZHRC been in making TJ a reality in Zimbabwe? 4. How can the Zimbabwean TJ framework be improved constitutionally, statutorily, and in practice? In this milieu, adherence to the normative principles of domestic constitutionalism, rule of law and human rights is essential to advance TJ and in identifying victims and most affected groups. The NPRC and ZHRC should thus be innovative in utilising international normative frameworks and aligning them with their constitutional mandates that speak to TJ. Sadly though, the NPRC and ZHRC are yet to align their mandates or work to international frameworks. The thesis concludes with an emphasis on the need for a coherent and transformative TJ policy that is informed by the root causes of societal problems in Zimbabwe: racial, ethnic, economic, political, doctrinal, pandemic-induced and so forth. Through constitutionally-established institutional independence, the NPRC, ZHRC and other Chapter 12 institutions supporting democracy in Zimbabwe must thrive on public legitimacy, confidence, and trust to promote dialogic democratisation and democratic consolidation which also recognise that the victim’s voice in TJ initiatives must be prioritised. Lethargic governance, toxic politics and confidence deficits should be addressed from a human rights as well as transformative TJ perspective. Ultimately, the TJ outcomes expected in this thesis should help Zimbabweans fully reconcile, achieve total peace, and move towards permanent healing. A context-sensitive and coherent TJ should be seen as a precious fruit of the normative frameworks espoused by the Constitution and regionalised or globalised TJ frameworks. Truth commissions have been identified as a key to uniting, reconciling and helping the people to confidently deal with their past. Whilst these are noble notions, practically, truth commissions face serious challenges. The dissertation shall seek to highlight these problems and offer recommendations. ... The dissertation is divided into five chapters. Chapter one is the general introduction. It gives a brief political history of Ghana and South Africa and their impact on the enjoyment of human rights. The chapter shall also discuss the need for national reconciliation in both countries. Chapter two discusses truth commissions in contemporary societies. It briefly discusses the establishment of national reconciliaton commissions and their mandates. The constant clash of African culture and traditions with human rights continue to militate against the adequate protection of women’s rights. Thus, African women constantly face challenges resulting from restrictions under customary laws of succession and inheritance, witchcraft violence, degrading treatment to widows, domestic violence; women killed by their partners, rape of women and children under all kinds of circumstances. This thesis was prompted by the issues raised in the Bhe case of the Constitutional Court of South Africa. In this landmark judgment, Ngcobo J dealt with the development of customary law, and how it must be approached by the courts in a manner that would have due regard to the rights of women on one hand and, on the other, would also accord customary law of its proper place, purpose and values within the African context. Against this background, the thesis focused on South Africa, Nigeria and Lesotho as excellent models of the broader challenges for women as well as governments; despite certain legislative measures put in place by the latter, the battle continues unabated for the balance of traditions and culture with women’s rights issues. Although South Africa is more progressive in terms of Constitution and practice than Nigeria and Lesotho, a lot still needs to be done particularly in the area of harmonization of laws. Regrettably, in Nigeria and Lesotho respect for the Constitution is superficial and lacks substantive policies that would promote women’s rights. To this extent, the balance of democratic values and promotion of women’s rights issues within the continent lie in women being partners in development rather than unduly suffering under intense burden of culture, tradition and societal stereotypes.

The author questioned why state attorneys, prosecutors and magistrates/judges in South Africa rarely review the compensation concerns of sexual violence complainants and witnesses in criminal sentencing matters, and in quasi-criminal civil forfeiture proceedings, as is frequently done for other classes of complainants (namely, commercial crime complainants and victims of violent crime in general). A conclusion was reached, after conducting extensive research for this thesis, that offender and state compensation processes were sparingly utilized in cases of sexual violence, in part, due to institutional biases that resulted in discrimination. The above finding was substantiated by way of twenty-seven (27) interviews with criminal justice role-players, eight (8) court file case studies and forty-seven (47) victim surveys. The above subject matter is important because failures by criminal justice state role-players to review the compensation concerns of sexual violence victims, on account of biases, causes real harm to these vulnerable complainants. For example, research in this thesis confirmed that state and offender compensation can assist sexual violence complainants with their cultural obligations, court appearances and post-assault health expenses and to pre-empt compensation reviews on account of biases disrupts victims' post assault recoveries. Further, compensation can assist sexual violence complainants with security related expenses, including relocation costs, so as to avoid repeated victimization.

The meaning that Justice has after a conflict in a society might vary regarding the political development and cultural and shared values of a certain society.

Rawls, in his Theory of Justice gives his idea of what justice is and presents two principles of justice that he argues are required to live in a good society: a first principle that secures equal rights and liberties for all individuals and a second egalitarian principle that restrains the consequences of economic inequalities within societies. He also introduces the concept of “overlapping consensus” which I will use regarding the idea of Reconciliation, at the end of this paper.

In the cases presented in this paper (i.e. Argentina and South Africa), essential human rights were violated, therefore wrongdoers made the society unjust.

The aim of this thesis is to elucidate the conditions that are necessary to re-establish justice when a society goes through a conflict. I will introduce some ideas concerning that issue: ideas of retribution, reparation and reconciliation. These are seen as different paths for several countries when trying to tackle to the matter of achieving justice.

In my view, this question can be answered appealing first to an intuitive conception of moral justice that may exist at an individual and collective level, as well.

The ethical dilemmas both levels have are in relation to the harm done, punishments and how to balance them, limiting, for instance, the punishment in order to accomplish a just and a better society. I will also present how shared values can result from a process of reconciliation, which is considered as the ideal alternative to achieve justice.

However, when the equilibrium between members of a community is broken, some people claim that punishment can restore that lost equilibrium that existed before in the community.

Nevertheless, peace, reconciliation and justice cannot be constructed under the basis of silence. One way to keep memory alive is to let survivors, for instance, narrate what they have lived through; telling stories also creates a new space to share with others their experiences, revealing their fears and emotions. Regarding this theme, I will present the NUNCA MAS (Never Again) report, which is fundamental as it gives some testimonies, facts and proposals that will help to reach a consensus and therefore, future reconciliations.

Why is important to achieve justice? Because then members of a certain community will be able to interact in the present with common shared values and thus, deal with the past.

Not to consider reconciliation as one important step to achieve justice, and only think in terms of punishment, instead of giving way to peace and justice, could perhaps promote the possibility of further conflicts. To consider both punishment and reconciliation might just be one possible blueprint in the long and difficult way of searching for a just society.

The Constitution 1995 of the Republic of Uganda is silent on how to admit evidence obtained through human rights violations in Uganda. The decided cases are inconsistent in the way courts have dealt with this evidence. This research establishes how jurisdictions like South Africa, Canada, Kenya, Zimbabwe and Hong Kong deal with evidence obtained as a result of human rights violations. It establishes the position of international law on evidence obtained through human rights violations. The research then employs the comparative study to establish the status of evidence obtained through human rights violations in Uganda. This study helps in the improvement of the practice of evaluating evidence in courts, by providing recommendations to policy makers and judicial officers in the criminal justice system on how to handle evidence at the pretrial stages in order to greatly attempt to contain the consequences of this evidence.

This study examines the degree to which the Truth and Reconciliation Commission hearings in East London have mitigated the impact of gross human rights violations on some of the Duncan Village victims. The research draws upon responses from a convenience sample of victims of apartheid atrocities guided by their own individual experiences, literature on conflict management, and TRC hearings that took place in other African states. The East London TRC hearings alert one to the brutality of the apartheid regime whose political intolerance unleashed violence against ordinary citizens of East London. Despite being seen as a witch hunt against the apartheid security establishment, most of the victims feel the TRC opened lines of communication between former enemies, although one cannot conclusively say that total reconciliation between victims and perpetrators has been achieved. Insofar as telling the truth is concerned, the concept defies unanimous acceptance as a contributor to peaceful co-existence. The mere fact that some perpetrators refused to appear before the TRC is an indication that the value attached to it differs from person to person, particularly in a situation where the political landscape is characterized by intimidation and fear. The treatise unveils the East London TRC as a platform for compromise as some of the victims felt anger and hatred for the perpetrators would amount to perpetual self-imposed ostracism. Noting that the TRC was never meant to hurt anyone, the treatise ushers one into a space where reconciliation takes precedence over vengeance.

The difference notwithstanding, all the three have been rated as the best national institutions in Africa. Due to time and space constraints, one will focus specifically with the mandates of the three commissions and in particular, on the different or distinct mandates assigned to them, namely, that of CHRAJ to deal with corruption, that of SAHRC to deal with economic, cultural and social rights and UHRC of dealing with torture matters and generally of constituting a tribunal. This study was motivated by the fact that Lesotho will be setting up a national institution in 2008 and one would like to draw lessons from these institutions and pick up elements that could best suit Lesotho.

The main aims of the investigation conducted here are to draw out important debates in theory and in the South African social context over the concepts of responsibility and accountability for human rights abuse, and to look at how these were present within, and impacted on, discussions within and around the Truth and Reconciliation Commission. The TRC did not specifically discuss or define theoretical concepts of responsibility or accountability. However, I argue that it is possible to draw out some important features of its implicit approach ??? particularly in terms of its emphasis on collective responsibility and social context (in addition to individual responsibility), and its emphasis on moral arguments for individuals and collectives to accept responsibility and hold themselves accountable by contributing to future change. This ambitious and complex approach raised some important theoretical issues, which have been discussed and debated in the theoretical literature. These include: the relationship between individual responsibility, collective responsibility and the influence of ???the system???; the nature of collective responsibility; the nature of morality; the distinction between moral and political responsibility; and how individuals and collectives can or should be held accountable. In South Africa, these theoretical debates inter-mingled with a range of other factors, including individual and collective interests, motives and political perspectives. From an analysis of the existing literature on the TRC and original interviews conducted with key informants, I draw out three main opposing views which I argue arose in the South African social context about responsibility and accountability, and what the TRC could and should have done to address these. In a detailed analysis of the TRC???s hearings and Final Report, I draw out how theoretical debates, and these three opposing views, were present within and impacted on the TRC???s work. I argue that it was impossible for the TRC to satisfy everyone and resolve these debates, and that its approach led to unrealistic expectations of its work and its role more generally. This has impacted negatively on how the TRC was and is perceived.

Few legal developments in South Africa and elsewhere in the world in recent times have excited such controversy as the legal recognition of social and economic rights. South Africa has created a special place for itself in world affairs for being one of the countries that recognise socio-economic rights in a justiciable Bill of Rights. Partly this is in response to the appalling levels of poverty prevalent in the country which could potentially destabilise the new democracy. Improvement of the quality of life of every citizen is a crucial step in consolidating the constitutional democracy. The question that will face any court in giving effect to socio-economic rights is: how are these rights to be judicially enforced in a given context? The crux of this thesis lies in the resolution of this question. Firstly this thesis traces the philosophical foundations to the legal recognition of socio-economic rights. It is stated that the recognition of these rights in a justiciable bill of rights requires a conceptually sound understanding of the nature of obligations that these rights place on the state. It is emphasised that it is imperative that access to justice be facilitated to poor and vulnerable members of society for the realisation of the constitutional goal of addressing inequality. Particular concern and priority should in this context be given to women, children and the disabled. The study explores various judicial remedies and makes suggestions on new and innovative constitutional mechanisms for judicial enforcement of these rights. It is concluded that there is an important role to be played by civil society in giving meaningful effect to socio-economic rights.

Juvenile justice is a core facet of international child law aimed at protecting children who come into conflict with the law. The international and regional juvenile justice frameworks outline the standards expected of States party to the international instruments. Both South Africa and Scotland are obligated to adhere to these rules and principles by way of creation and implementation of domestic laws in furtherance of a child-centered approach to justice. This dissertation analyses the effectiveness of both national systems and assesses the extent to which they respect, protect and fulfill children's rights in the context of international child law. This study also aims to highlight areas in which South Africa and Scotland fail to meet the prescribed standards and proposes various recommendations in order to do so more effectively.

ENGLISH ABSTRACT: In recognition of the socio-economic imbalances inherited from the past and the abject poverty experienced by many, the people of South Africa adopted a Constitution fully committed to protecting socio-economic rights and advancing social justice. Apartheid constituted a violation of every internationally recognised human right. Seen in this light the emphasis on socio-economic rights in the new South African Constitution represents a commitment to guarantee to everyone in society a certain minimum standard of living below which they will not be allowed to fall. As the Constitution recognises socio-economic rights as justiciable rights, they can be of assistance to those who are unable to support themselves when challenging the state for the non-delivery of basic services. The duty to deliver the services lies first with the state and the court becomes involved only once it is alleged that the state has failed to fulfil its duty. The primary purpose of the study is aimed at determining the effectiveness of the South African Human Rights Commission in monitoring court orders in respect of the implementation of socio-economic rights. Non-Governmental Organisations, involved in the promotion and protection of human rights including socio-economic rights, cannot be left out of the process. It is argued that where the Courts issue structural interdicts, which have of late been used by them, albeit not enough in the context of socio-economic rights, they are responsible for the implementation of such orders. It is also argued that the South African Human Rights Commission and NGOs must be enjoined to ensure that court orders are better implemented. Court orders in respect of socio-economic rights in almost all the cases to date were neither implemented nor monitored adequately.
AFRIKAANSE OPSOMMING: Ter erkenning van die sosio-ekonomiese ongelykhede wat post-apartheid Suid- Afrika geërf het en die volslae armoede waaraan talle Suid-Afrikaners onderwerp is, het die mense van Suid-Afrika 'n grondwet aanvaar wat verbonde is tot die beskerming van sosio-ekonomiese regte en die bevordering van maatskaplike geregtigheid. Apartheid het elke internasionaal-erkende mensereg geskend. Teen hierdie agtergrond verteenwoordig die klem op sosioekonomiese regte in die nuwe Suid-Afrikaanse grondwet 'n verbondenheid daartoe om vir elkeen in die maatskappy 'n bepaalde minimum lewensstandaard te waarborg, waaronder hulle nie toegelaat sal word om te sak nie. I believe that the most important components of transitional justice must be the rights of victims, which include the right to the truth, the right to acknowledgment, the right to reparations and the obligation to take steps to ensure that violation will not occur again. In many societies, transition from war to peace or from dictatorship to democracy has been dominated by a debate on how best past massive human rights violations can be addressed without undermining a fragile and transitional peace. Therefore, political considerations have entirely shaped legal solutions adopted to bring about transitions with less regard to accountability and appropriate remedy for victims of human rights abuses and violations.

The African Court on Human and Peoples’ Rights (AfCHPR) was created amidst great criticism to the ineffectiveness of the African Commission on Human and Peoples’ Rights (AfCmHPR) in protecting human rights on the content. After much debate, spanning four decades the Protocol on the Establishment of an African Court on Human and Peoples’ Rights (the Protocol) was adopted by the Organisation of African Unity Assembly and entered into force on the 25th of January 2004. Later the 4th AU summit in January 2006 elected the eleven judges of the Court.

This is a study of Zimbabwe's National Peace and Reconciliation Commission Bill (hereafter NPRC Bill). The NPRC Bill seeks to bring the National Peace and Reconciliation Commission (hereafter NPRC) of Zimbabwe into operation. The NPRC is a truth commission set to promote post-conflict justice, national peace and reconciliation in Zimbabwe. The study discusses the prospects of establishing an effective NPRC in Zimbabwe by examining the provisions of the NPRC Bill. The view of the paper is that, without proper guidance from a comprehensive law, the NPRC is bound to be a victim of its own failure.

ENGLISH ABSTRACT: The aim of this dissertation is to conceptualise the principle of "environmental justice". In doing so it attempts to determine its meaning, assess its possible use for the protection of environmental rights in the light of the South African Bill of Rights, and draw, in a comparative manner, on examples from two other jurisdictions, namely the United States of America (USA) and India. In the first part of the study "environmental justice" is defined and thereafter the ways in which the idea of "environmental justice" has found expression in the USA and Indian jurisprudence as well as in legislative and administrative practices in these two countries are analysed comparatively. In reviewing the US experience the study concludes that the courts have shown a conspicuous measure of self-restraint in the conceptualisation of environmental justice. Due to its non-activist and formalistic approach, the judiciary has failed to address systemic environmental inequities, and to carve out remedies whereby environmental injustice could have been dealt with in an effective and meaningful way. The more activist approach of the Indian judiciary, on the other hand, has led to more effective protection of the environment and of people adversely affected by environmental degradation. The judiciary has imposed positive obligations on the state to carry out its social duties as laid down in the Directive Principles of the Indian Constitution. Although India does not have a constitutionally entrenched environmental right, the courts have interpreted the right to life proactively so as to include quality of life. The study concludes by examining possible applications of the principle of environmental justice for the protection of environmental rights in South Africa, assessing the law as it stands and exploring new avenues in the light of the Bill of Rights. In this respect the following guidelines are proposed by this study: o Environmental problems in South Africa must be placed within their specific historical and political context. Consequently environmental injustice must be understood as a form of inequity that impacts on people disproportionately on the basis of race and socio-economic status. The concept "environment" can therefore not be narrowly understood, whether it is being dealt with in the Constitution, legislation or common law. It must be recognised that the concept goes beyond ecosystems and that it includes a multiplicity of relationships, in many of which humans are the focal point. o Environmental justice claims in South Africa may best be framed as constitutional claims. Regard should be had not only to the environmental right in section 24 of the Constitution, but also to other rights that support the notion of environmental justice, such as the rights to life, equality and dignity. o Judicial activism is a key to the promotion of environmental justice. The judiciary plays an important role in ensuring that the state and other actors fulfil their obligation to respect, protect, promote and fulfil the rights in the Bill of Rights. Transformation requires a judiciary that is prepared to reconsider the traditional boundaries of the doctrine of separation of powers and to lay down directives for other branches of government, in particular the executive.
AFRIKAANSE OPSOMMING: Die doel van hierdie proefskrif is om die beginsel "omgewingsgeregtigheid" te konsepsualiseer. Die studie poog dus om die betekenis van hierdie beginsel, sowel as die moontlike gebruik daarvan in die beskerming van omgewingsregte vas te stel in die lig van die Suid Afrikaanse Handves van Regte. Verder poog die studie om deur middel van regsvergelyking insigte te bekom uit voorbeelde in twee jurisdiksies, die Verenigde State van Amerika en Indië. "Omgewingsgeregtigheid" word in die eerste deel van die proefskrif gedefinieer. In die tweede deel word die wyse waarop omgewingsgeregtigheid uitdrukking vind in Amerikaanse en Indiese reg, sowel as in statutêre en administratiewe praktyk vergelykend geanaliseer. In die beoordeling van die Amerikaanse ervaring word tot die slotsom gekom dat die howe 'n ooglopende mate van selfbeheersing toon in die konsepsualisering van omgewingsgeregtigheid. As gevolg van die regsbank se nie-aktivistiese en formalistiese benadering, het dit in gebreke gebly om sistemiese omgewingsongelykhede aan te spreek, en om remedies te ontwikkel wat omgewingsgeregtigheid op 'n effektiewe en betekenisvolle wyse aanspreek. Die aktivistiese benadering van die Indiese regsbank aan die ander kant, lei tot meer effektiewe beskerming van die omgewing en diegene wat nadelig geaffekteer word deur omgewingsbeskadiging. Die regsbank plaas positiewe verpligtinge op die staat sodat die staat sy sosiale pligte kan nakom soos bepaal in die Direktiewe Beginselsin die Indiese Grondwet. "A well functioning judiciary is a central element of civil society. It is the sole adjudicator over the political, social and economic spheres. Judiciaries in many African countries suffer from backlogs, delays and corruption. In countries such as Nigeria, South Africa, Ghana, Tanzania, and Uganda, speedy resolution of disputes is becoming increasingly elusive. Although many African countries have constitutional provisions against delay, and have identified congestion, excessive adjournments, local legal culture and corruption as some of the major causes of delay, nevertheless, the problem continues to be a feature in African Courts. In Nigeria, the average period to commence and complete litigation is six to ten years. In some instances, the litigation period is even longer. For example, in the case of Ariori v. Muraimo Elemo proceedings commenced in October 1960 and took 23 years to reach the Supreme Court of Nigeria. In South Africa, despite many programs and projects in place to solve the problem, delay in the administration of justice is still a problem. Appraising the extent of the problem, Penuell Maduna addressing the National Judges Symposium stated: “The public is perturbed by substantial backlogs in the criminal courts and in finalising prosecutions...” Mindful of the increase of this problem, especially in view of the consequences it poses, this study perceives a need to eradicate delay in the administration of justice. Thus, this study analyses the problem of delay in Nigerian and South African Courts with a view to ascertaining the nature, extent and causes of delay in the two countries, and suggests possible solutions to the problem. South Africa and Nigeria were chosen because they have similar judicial systems and experience delays in judicial proceedings." -- Chapter 1.

The thesis contributes to the search for sound anti-corruption laws and practices that are effective and fair. It argues for the respect for human rights in the crafting and implementation of anti-corruption laws as a requisite for successful control of corruption. The basis for this argument is threefold: First, human rights provide a framework for checking against abuse of state’s police power, an abuse which if allowed to take root, would make the fight against corruption lose its legitimacy in the eye of the people. Second, human rights ensure that the interest of individuals is catered for in the crafting of anti-corruption laws and practices thereby denying perpetrators of corruption legal excuses that can be exploited to delay or frustrate corruption cases in the courts of law. Third, human rights provide a useful framework for balancing competing interests in the area of corruption control – it enables society to craft measures that fulfils the public interest in the eradication of corruption while concomitantly assuring the competing public interest in the protection of individual members’ liberties – a condition that is necessary if the support of the holders of these competing interests is to be enlisted and fostered in the fight against corruption. The thesis focuses on the study of the non-conviction based assets recovery mechanism, a mechanism that allows the state to apply a procedure lacking in criminal law safeguards to address criminal behaviour. The mechanism is thus beset with avenues for abuse, which if unchecked could have debilitating effects not only to individual liberties but also to the long term legitimacy of the fight against corruption. In this regard, the thesis examines how the human rights framework has been used in Kenya and South Africa to check on the potential dangers of the non-conviction based mechanism and to provide for a proportional balance between the imperative of corruption control and the guarantee against arbitrary deprivation of property. The aim is to unravel the benefits of respecting human rights in the fight against corruption in general and in the non-conviction based assets recovery in particular. Kenya and South Africa are chosen for study because they provide two models of non-conviction based mechanisms with different levels of safeguards, for comparative consideration.

Social protection has become an important tool in efforts to eradicate poverty in developing countries and also risen strongly on the global development agenda the last decade. This thesis will look at different approaches to social protection and their relation to the human right to social security with South Africa as a case study. In using different scholars in the field of social protection and social justice together with qualitative fieldwork, the thesis explores the importance of social protection and the politics underlying efforts to protect the right to social security of South Africans living in poverty. The thesis suggests that South Africa’s social protection system lies somewhere in between rights and relief and more universal systems comply better with a rights based approach to social protection. Although significant progress has been made to social protection in South Africa the last decade, more needs to be done for South Africa to reduce rampant inequalities and combat poverty in the future.

For a long time, conflict studies have focussed on the grand national projects of negotiating peace, concluded by the major actors in the country, like political parties, as well as international mediating actors like the UN. This view on solving conflict as a set top-down process were in recent years challenged by new theories on how to solve conflict. The conflict settlement theory had to make ideological and practical space for others like conflict resolution and conflict transformation, in the broader arena of conflict management. In the last 3 decades, conflict transformation has grown into a formidable tool in explaining conflict and moves toward peace-building. The fact that so many countries had collapsed back into civil war after their settlements, surely has something to say about the lack of longevity of some countries’ conflict settlement or conflict resolution approaches. This is why conflict transformation is such an attractive approach, especially in the case of South Africa. The political settlement of the early 1990s, that lead to an official peace, were also backed up by policies and programs to deal with the underlying causes and grievances that caused the conflict. The TRC was one aspect on post-1994 peace-building and enduring conflict transformation. The importance of the TRC as a transformative vehicle has been highlighted by the fact that so many institutions and individuals have made work of it to study the impact of the TRC on social transformation in the post-war era. Although many surveys indicate that South Africans have come to deal with the past to varying degrees and are seeing the various groups in the country as intertwined with the future of the country, there are still many worrying aspects that have to be addressed: interracial understanding and trust, and tolerance for one’s former enemies. The TRC has done much to build bridges between the formerly segregated groups of South Africa and the aim of this paper is to shed some light on these changes in attitudes.

What conditions lead to confidence among civil war combatants that they will not face accountability for perpetrating sexual violence? This study investigates the causes of impunity for sexual violence among armed actors. It develops a theoretical framework which identifies three explanations for armed group impunity for sexual violence, namely (1) flawed prohibitions inside an armed group; (2) negligent enforcement by its authorities; and (3) pardons in the form of amnesties during the peace process. Adopting a two-pronged approach, the study first explores the associations between amnesties arising from concluding peace agreements and post-settlement levels of sexual violence in Burundi, the Democratic Republic of Congo, Liberia, Mozambique, Sierra Leone and South Africa. A small-scale, events-based dataset of sexual violence by governments and rebel groups in the first three years after war was constructed. The second and main part of the study is a comparison between two rebel groups in Burundi’s civil war (1994-2008), CNDD-FDD (National Council for the Defence of Democracy-Forces for the Defence of Democracy) and Palipehutu-FNL (Palipehutu-Forces for National Liberation) and their practices of prohibition and punishment of wartime sexual violence, taking into account also the possible influence of amnesties. Based on original data from 19 focus groups of ex-combatants from these rebel organisations, it is found that flawed prohibitions and negligent authorities are the main explanations for armed group impunity. The findings do not support amnesties as a cause of armed group impunity for sexual violence. Moreover, additional findings suggest that accountability for sexual violence is triggered by dependency on civilian support, while impunity is facilitated by an armed group’s ability to secure recruits, material and other resources without the help of local communities.

This thesis focuses on the chronology of post-election violence in Kenya. It explores how it started, peaked, faded, and returned. The Truth, Justice, and Reconciliation Commission created in 2008 in Kenya documents 35 years of past human rights injustices and malpractices from independence in 1963. Multiple factors combine and trigger violence in multiparty presidential elections. The conscientious final reports and recommendations by the Commission remain in limbo as the government is part of the problem. Unequally shared land resources and a grave presidential contest cause post-election violence. Empowering the Supreme Court is a necessity for fair justice.

The goal of this study is to generate a more holistic picture of the diffusion and assimilation of universal human rights norms in diverse cultural and political settings such as the Middle East and North Africa (MENA). The overarching question to be investigated in this thesis is the relationship between the evolving international human rights regime and the emerging human rights normative and legal culture in the Middle East. This question will be investigated in detail with reference to regional human rights schemes such as the Arab Charter of Human Rights, as well as local human rights developments in three Middle Eastern states, Egypt, the United Arab Emirates, and the Islamic Republic of Iran. Having gauged the take-up of human rights norms on the ground at the local and regional levels, the thesis examines in full the extent of socialisation and internalisation of human rights norms across the Middle East region at large.

The purpose of this thesis will be to explore some aspects of Barth's theological anthropology in an attempt to show that Barth's concept of the neighbour as ethical criterion is a basis for perceiving and seeking the good of human life. The attempt will be to demonstrate that Barth's construct of neighbour as ethical criterion can be understood in terms of his theological anthropology. That is, through fellow-humanity as the basic form of humanity, the command of God to "humanise", as the basis for ethical responsibility can be heard in a universal and public sense as that which determines the basis for moral reason. It is true, according to Barth, that the motivations for moral decisions and moral actions cannot be based on formal, universal moral principles. But what is argued here is that on the material level the content of the moral agenda as well as the consequence of moral action can be a matter of common discussion and action between Christian and non-Christian when the issue of human rights is at stake. I will argue against the critics who claim that Barth's theological ethics are sectarian and not applicable to universal moral standards of conduct. I will show that these critics misunderstand Barth in locating his ethics in the formal principle of the command of God. Rather, I will argue that his theological ethics are derived out of the material content of human relationships; that is, the concreteness of the neighbour, as a form of the command of God.

Macédoine à propos de la restitution extraordinaire d’un citoyen allemand dans le cadre de la « lutte contre le terrorisme » menée par les États-Unis avec la complicité d’États européens (Grande chambre, arrêt du 13 décembre 2012).

Comment une notion aussi floue a-t-elle pu être consacrée si rapidement auprès de ces institutions, alors qu’elle n’est reprise dans aucun catalogue des droits fondamentaux ?Quelle est la portée de ce nouvel objet en droit international, et quels en sont les usages ?Mis à part son appellation, le « droit à la vérité » aurait-il réellement un contenu propre qui se distinguerait du catalogue des droits existants ?Sa reconnaissance offre-t-elle une illustration de la « rhétorique des droits » ou traduit-elle la cristallisation d’un nouveau droit justiciable?

Alors même que le « droit à la vérité » est aujourd’hui convoqué de manière croissante par la communauté internationale pour légitimer la mise en place de nouvelles politiques de pacification internationales, à l’instar des « commission de vérité et de réconciliation » préconisées dans des sociétés affectées par des crimes d’ampleur massive (rapports du Secrétariat général et du Haut-Commissariat aux droits de l’homme des Nations Unies, 2004, et de la Banque mondiale, 2011), cet objet d’étude demeure largement inexploré. Palliant cette lacune, ma thèse consiste en une reconstitution généalogique du « droit à la vérité » dans une perspective chronologique, des luttes sociales concrètes pour sa reconnaissance à ses développements juridiques contemporains, afin de déterminer les enjeux sociaux, politiques et juridiques de sa reconnaissance.

À travers une méthode interdisciplinaire qui articule l’approche critique du droit à la sociologie politique du droit, mes recherches apportent ainsi des connaissances originales sur deux plans :sur le plan juridique, d’une part, il s’agit de la première étude exhaustive des textes et décisions juridiques sur le « droit à la vérité » qui analyse de manière systématique sa nature, ses bénéficiaires, son contenu et ses contours en droit international; sur le plan de la sociologie du droit, d’autre part, elle offre une cartographie inédite des mobilisations sociales et professionnelles du « droit à la vérité » et propose une analyse des motivations qui les animent, susceptible d’enrichir les débats en sociologie du droit et de la justice sur la création et la diffusion empirique de nouvelles normes en droit international.

L’hypothèse de travail mise à l’épreuve tout au long de l’étude est la suivante :la reconnaissance d’un « droit à la vérité », notion à contenu variable par excellence, permettrait à une multitude d’entrepreneurs de normes de défendre, derrière la formalisation de ce droit, d’autres causes controversées en droit international. La thèse montre ainsi comment les mobilisations du « droit à la vérité » tentent d’orienter dans des sens particuliers certains débats qui demeurent ouverts en droit international et qui sont liés à des enjeux de justice contemporains :les victimes d’atrocités ont-elles un droit à la punition des responsables ?Les amnisties sont-elles licites en droit international, et le cas échéant, à quelles conditions ?Peut-on restreindre le privilège du secret d’État et contraindre les autorités à communiquer des informations aux victimes lorsqu’elles sont soupçonnées de couvrir des crimes internationaux ?Quelle est l’étendue et la nature de l’obligation des États d’enquêter et de poursuivre les auteurs de crimes de masse ?En cas de circonstances exceptionnelles, comme la menace d’un coup d’État ou l’insuffisance de ressources financières, les gouvernements ont-ils une marge de discrétion sur ces questions ?Emblème des dilemmes de la justice transitionnelle, le « droit à la vérité » est ainsi revendiqué dans des directions opposées.

En particulier, la thèse révèle la diversité irréductible des mobilisations du « droit à la vérité » en explorant la polysémie de ses usages, les jeux de compétition entre ses promoteurs et les tensions qui jalonnent sa formalisation en droit international. Cette analyse empirique permet de comprendre pourquoi ce droit fonde aujourd’hui des politiques contradictoires, à savoir tant des politiques de répression des violations graves des droits de l’homme, axées sur la condamnation pénale des responsables, que des politiques mémorielles axées sur la « réconciliation » des sociétés à travers des amnisties au bénéfice des auteurs de crimes, ainsi que des mesures de réparation matérielles et symboliques au bénéfice des victimes. Droit à une vérité judiciaire des victimes, et droit à une vérité « historique » et collective des peuples sur les causes de conflits passés coexistent ainsi au sein du même droit pour justifier un déploiement de la justice pénale international(isé)e ou à l’inverse, pour la paralyser au nom d’impératifs de démocratisation et de concorde civile.

Ma thèse démontre ainsi l’ambivalence du « droit à la vérité », qui agit tantôt comme ressource, et tantôt comme contrainte pour ses promoteurs :au final, il n’offre qu’une ressource limitée à ses promoteurs en raison de la compétition qui continue à se jouer au sujet de sa définition, sa nature et ses titulaires.

This thesis considers the extent to which the International Criminal Court's Office of the Prosecutor ('OTP') has been successful in realising its self-defined mandate of ending impunity in Kenya. In particular, it focuses on the OTP's attempts to encourage domestic investigations and prosecutions as part of its strategy of positive complementarity. This strategy has been hailed as being the best and perhaps the only way that the OTP may use its finite resources to make a significant contribution to ending impunity. Despite this, no empirical study has been published that evaluates the effectiveness of this strategy and the impact that it has on ending impunity in the targeted situation country. This thesis seeks to address this gap in the literature by conducting a case study on the OTP's implementation of its strategy of positive complementarity in Kenya following that country's post-election violence in 2007/08. In doing so, I also hope to make a modest contribution to existing debates over the effectiveness of the ICC as an institution as well as international criminal justice and transitional justice more generally.

"It is the responsibility of every government to protect the fundamental rights and freedoms of its citizenry and to ensure that the rule of law and justice prevails at all times. Hovewer, children accused of committing crimes are more susceptible to human rights abuses and violations of their legal rights while in detention, either in police cells, prisons or authorised detention centres. They mostly suffer from both the agents of the state as well as from inmates. These violations often take place [behind] closed doors, and society being primarily concerned with keeping offenders locked up rather than about their conditions and human rights being respected, the cries of these children to be treated with dignity and worth go unnoticed despite the constitutional and international guarantee of their rights. The problem therefore is first to examine what rights do children in trouble with the law have under international law in general and specifically within the African human rights sytem with special emphasiis on the rights of children deprived of their liberty. Secondly, to examine how these international instruments are given effect domestically and whether there are challenges encountered in realising these rights. These are the main issues that this research intends to grapple with using South Africa and the Gambia as case studies with a view to making recommendations for better protection of the rights of this category of children. ... This research consist of four chapters. The first chapter is the introduction. It will give the basis and structure of the research which will include a general overview of the problem in the two countries under study. In the second chapter, it will explore the relevant international and African normative framework that protects the rights of children in trouble with the law and the obligations of states towards these children. However, the main focus will be the Convention on the Rights of the Child (CRC) and the African Charter on the Rights and Welfare of the Child (ACRWC), because they are the two main human rights instruments providing specific protection for children's rights in all spheres. The third chapter will be a comparative analysis of the rights of children deprived of their liberty as provided in the municipal laws of South African and the Gambia vis a vis the minimum standards set [out] in the CRC and ACRWC. It will discuss the following issues, namely: defintion of a child, age of criminal responsibility, the best interest, detention as a last resort and for the shortest possible time, separation from adult detainees, role of parents, establishment of separate criminal procedures, right to legal respresentation and assistance, and sentencing options. It will also examine the problems and challenges for implementation. The fourth chapter will conclude and make recommendations on how best to implement the laws and who should be the role players in ensuring that the rights of these children are well protected." -- Introduction.

"Although the United Nations (UN) has often been pivotal in forging the international response to serious human rights crimes in such settings, the justice gap in countries such as the Democratic Republic [of] Congo (DRC) (the focus of this study) underscores the need for more systematic UN efforts. The war in the DRC has resulted in one of the world's worst humanitarian crisis with over 3.4 million displaced persons scattered throughout the country. An estimated 3.5 million people have died as a result of the war. The armed conflict has been characterised by appalling widespread and systematic human rights violations, including mass killings, ethnic cleansing, rape and the destruction of property. The most pressing need to be addressed is the question of justice and accountability for these human rights atrocities in order to achieve a durable peace in the country and also in the Great Lakes region (Rwanda, Burundi, Uganda, Angola and the DRC, to name just a few). In this respect, this study will address the grave human rights violations committed in the DRC and the mechanisms for dealing with them. It is particularly true in post-conflict situations where justice systems have been either partially or completely destroyed, that national courts are not capapble of arriving at a uniform stance, or willing to provide justice for atrocities in the immediate future. As a result, international justice seems to be a crucial and last resort that must continue to be fortified against efforts to undermine it. ... Chapter one will set out the content of the research, identify the problem and outline the methodology. Chapter two will discuss the state obligations in international law to prosecute gross violations of human rights and gives a summary of the human rights violations situation during the Congolese war. Chapter three will discuss the available naitonal mechanisms for accountaiblity in the DRC. It will discuss if national courts and TRC are able to deal with these atrocities committed in the DRC. Chapter four will analyse the extent to which the ICC could deal with the Congolese case and challenges. Chapter five will discuss the trends towards accountability in the DRC and the way forward.
