However obsolete it may appear in the environment of the post-1989 Czech Republic, dissident activity has left its imprint on Czech society and politics. In Czech foreign policy, there is something like a dissident tradition, which dissidents themselves seem to uphold. In the Czech foreign policy process, there exists an explicit mechanism that has incorporated the dissident tradition, which, in quite a few cases, has affected policy outcomes. The introduction of the dissident tradition into Czech foreign policy was facilitated by the dissidents’ great concern for foreign policy and for human rights issues, and, in particular, for human rights issues outside the Czech Republic. We present evidence that dissidents have been concerned with foreign policy and with human rights issues by analyzing the membership of parliamentary committees of both chambers of the Parliament as well as the dissidents’ activities in the Senate and the Chamber of Deputies. Significantly, when activities tied to the dissident tradition emerge in the Parliament, the initiators of such activities are always (although not exclusively) dissidents; the opponents, always nondissidents.

Conformity with human rights norms is currently a standard component of democratic states’ policies. However, this conformity is reflected not only in domestic binding catalogues of human rights embodied in constitutions, but also in the continuous rise of international control and treaty commitments. States are widely expected to commit to and ratify international human rights documents. Nevertheless, a great deal of the research on state commitments disregards the effects and changes which might be brought upon these ratifications by the submission of reservations. This article proposes an in-depth analysis of state commitments and the practice of submitting reservations in two case studies: the Czech Republic and Slovakia, together with their common predecessor, communist (and, briefly, democratic) Czechoslovakia, and maps the way these regimes, in their different stages of transitional development, worked with reservations. This contribution has been elaborated within the framework of the project „International Human Rights Obligations of the Czech Republic: Trends, Practice, Causes and Consequences“, GA13-27956S, supported by the Czech Science Foundation GAČR.

Summary This paper deals with the question, whether, how and to what extent the Charter of Fundamental Rights of the EU could enter the scene of constitutional review before the Czech Constitutional Court. In connection to Czech Republic, this question must react on the special constitutional category – Czech constitutional order, which includes also international agreements on human rights which are binding for the Czech Republic. The paper analyses the question, whether EU Charter can be understood as such international commitment or not and what are the options of its application by the Czech Constitutional Court and also how we can define its relation to the constitutional order. Paper distinguishes 3 scenarios: 1) inclusion of the EU Charter into the constitutional order of the Czech Republic; 2) refusal of formal inclusion of the EU Charter into the constitutional order of the Czech Republic; and 3) understanding of the EU Charter as association of constitutional order, capable to be used within the constitutional order even without the formal inclusion into the set of Czech constitutional rules.

The reaction of the Belarusian authorities to the August 2020 demonstrations, drew strong condemnation from the Czech Republic. The article analyzes the reasons for such close attention of the Czech officials to the Belarusian problems. The historical context of the Czech Republic’s support for the Belarusian opposition is outlined; revealed the human rights and value aspects of the foreign policy of Prague, where support for democracy and human rights is an integral feature of Czech diplomacy at its present stage of development. The author examines the «Program of Transformational Cooperation» of the Czech Ministry of Foreign Affairs. He comes to the conclusion that the Belarusian direction has always been among the priorities and has not disappeared from the agenda. However, the stability of the Belarusian regime led to the fact that the Czechs began to contribute to the development of democracy in other countries, where its «implantation» was more real.

This paper deals with the legal regulation of the relationship between two human rights, freedom of artistic creation and protection of the value of religion as part of freedom of religion in the Czech Republic. It first gives an overview of three models of this relationship in three historical epochs: the period of democratic Czechoslovakia in the years 1918 to 1948 (excluding the period of World War II, where the protection of human rights was completely ignored), the period of domination of the Communist Party of Czechoslovakia in 1948 to 1989, that is, a period of general violations of human rights, and in a democratic society from 1989 (until 1992 in Czechoslovakia, from the disintegration of the Czechoslovak federation to January 1, 1993, in the Czech Republic). Most attention is paid to litigation caused by the presentation of two theater performances at the Brno Theater Festival in 2018. Both performances were directed by the Croat Oliver Frljić, known for controversial means of expression, often with a religious theme. The ensuing lawsuit, in which the then president of the Czech Bishops’ Conference was one of the plaintiffs, showed that the general courts preferred the protection of artistic freedom in the conflict between the two constitutionally guaranteed freedoms with only one significant restriction: vituperation or downsizing of beliefs. However, the dispute is not yet fully resolved: the plaintiffs have filed a complaint with the Constitutional Court of the Czech Republic, which has not yet ruled on the matter. Consequently, an application to the European Court of Human Rights in Strasbourg cannot be ruled out.

The article attempts to outline the main challenges faced by the Czech Republic in domestic and foreign policy. The author notes that the main threat within the country lies in the propensity of some part of the establishment to abuse of office. However, there are effective tools to counter these trends in the form of a developed system of democratic institutions and civil society. In foreign policy, a value-based approach has recently become widespread, which often damages the interests of the state and distorts the real picture of dangers. The author notes that the local political community is in a state of «Czech-Czech war», implying a confrontation between two groups of elites: pragmatists-technocrats and human rights defenders-liberals. These trends have become especially widespread since the beginning of the coronavirus pandemic, which has accelerated the development of international processes.

This exploratory case study considers the Czech Republic from 1993 thru 2002 by examining two links: first, between transition and the environment.; second, between the environment and human rights. The study examines data from the Czech Ministry of Environment, the European Union, the World Bank, and Freedom House. The purpose of this study is to better understand the Czech Republic and to generate hypotheses that might be used in future cross-national studies. Chapter III provides the underlying theory linking the environment and human rights. Chapters IV, V, and VI discuss the data and the two links and suggest hypotheses for future research. Chapter VII draws conclusions about states in transition, the environment, and human rights and encourages future integrative research.

This thesis explores the roles that medicine, human rights discourse, and the arts play in the project to improve the lives of patients suffering from severe forms of mental illness in the context of the post-socialist transformation of the Czech Republic. It is a study of the ways in which social solidarity and social exclusion intersect in the spaces of mental illness in a particular historical setting, and how the responsibility for care is negotiated between families, communities, the medical profession, and the state. The first part of the thesis focuses on the proposed reform of care for patients with severe mental illness that was put forward in the two decades after 1989. I examine the origins and aims of the attempted institutional change – the ‘humanization of psychiatry’ – in the context of the influential Charter 77 movement which demanded respect for the rights of those who are unable to claim them for themselves. I also trace how the re-establishment of a civil society that owed much to the concept of ‘apolitical politics’ and the process of the reintegration of Czech Republic into the European community impacted the attempted reforms. More than twenty years after the revolution, Czech Psychiatry still does not comply with international standards of care and, as I show, despite the explicit disclaimer with the totalitarian past and great hopes for change, there is in fact a clear continuation of many of the practices, ideas, interactions, as well as forms of governance of the preceding decades. These historical legacies, in combination with other factors, such as ideological disagreements within the psychiatric profession, a lack of political interest in this area, and a strong focus on other economic priorities have all contributed to the failure to improve mental health care. The second part of the thesis offers a complementary perspective on these processes – a view from ‘inside’ of the institutions that provide psychiatric care. The origins of institutional care in Central Europe date back to late nineteenth century, when large hospitals were built within parks as self-sufficient complexes surrounded by walls, outside of large cities. My research took place in two contrasting institutions: one a highly specialised clinical and research center for treatment of acute conditions, and the other a hospital for treatment of chronic conditions originally devoted to those with ‘incurable’ conditions. I show how the notion of ‘curability’ is a crucial factor in both the experience of the patients and the social responses to their conditions. In this part I also explore some epistemological issues in psychiatry, including knowledge, practices, and ideology, in the context of a strong scientific materialism where – unlike in many parts of the world – the tradition of psychoanalysis has been absent. Specifically, I examine the role of neurobiological paradigm in various interpretations of psychotic experience, its affect on patient’s self-understanding, and its role in the externalization of agency and responsibility. Finally I address the phenomenon of using ‘unclaimed bodies’ of psychiatric patients for anatomical teaching and research, and interpret this practice through notions of liminality, impurity, and sacrifice. I conclude the thesis by examining the ethical dimension of psychiatric care in the light of the writings by Emmanuel Lévinas.

The thesis is analysing contemporary relations bewteen Czech Republic and Cuba when taking the Czech membership in the EU into account. There is also a short historical introduction mentioning key moments which have influenced the development of mutual relations during and after the Cold War. Thanks to this backgroud, the thesis can further describe in detail partly the pure bilateral relations between Czech Republic and Cuba and partly changes in this relationship that have occured after 2004 when Czech Republic joined the EU. The goals of this thesis are following: to explain why Cuba has a priority in Czech human rights foreign policy, and to describe opportunities that Czech Republic has on its disposal to lead its own "anti-Castro" policy.

The thesis deals with the protection of private property in the law and practice of the European Convention on Human Rights and in the Czech and French constitutional law and practice. It provides a comparative inquiry into the scope of the respective property protection clauses and their judicial interpretation with a view to extracting convergent and divergent elements of the normative and jurisprudential approaches to the protection of private property as a human right. The main focus of the inquiry is to examine and compare the treatment of property in the European Convention on Human Rights and in constitutional law of France and the Czech Republic. Aidai Idinova Abstract The thesis will look at the how effective human rights protection can be, and especially regarding the Roma population in the Czech Republic. As there is a huge number of human rights, this thesis will focus on the right to education. Moreover, the case study of this thesis is the Roma population in the Czech Republic, therefore the rights and livelihoods of the Roma population will be analysed, examined and evaluated in this country. The thesis will also look at four hypotheses and try to find out if there really exists discrimination in the country, and to what extent; whether religion has an effect towards perceptions towards Roma; whether longer education changes one's attitudes towards Roma; and whether a communist past correlates with greater discrimination. But most importantly, this thesis will look at the right to education and the access to education for Roma students. Education is such an important human right as it has long-term effects in Roma's employment, health care and housing opportunities. Therefore, the Czech educational system will be analysed in regards to the socially disadvantaged group of the Roma population.

This doctoral thesis inquires into the role and perspectives of the ‘European’ (mandatory) and ‘USA’ (persuasive) constitutional models of the right to freedom of expression for the constitutional debate in Central and Eastern Europe (CEE). This survey is based on the study of socio-legal developments in the Czech Republic, Hungary, and Poland, embracing the period of post-communist transition until 2010. The research focuses on three controversial issues in the realm of freedom of speech, namely (1) hate speech, (2) historical revisionism, and (3) pornography, before the U.S. Supreme Court and European Court of Human Rights. The essential novelty of the project is an assessment of European standards of free speech and non-discrimination beyond the mechanisms of the Council of Europe, encompassing the relevant aspects of EU law (judgements of the European Court of Justice and harmonised instruments) as mandatory standards for courts and legislators, including those in CEE. The research methodology transcends a standard case law assessment (comparative constitutional, public international, and EU law), normative jurisprudence and analytical philosophy, incorporating critical approaches stemming from post-structuralist scrutiny, rhetoric, sociology, legal history, history of ideas, and art criticism.

Thesis deals with the issue of dissolution of political parties. States should recognise that everyone has the right to associate freely in political parties. As a particularly far-reaching measure, enforced dissolution of political party may only be justified in the case of party that advocates the use of violence as a political means to overthrow the democratic constitutional order, thereby undermining the rights and freedoms guaranteed by the constitution. The dissolution of a political party is an exceptional measure in a democratic society and should be govern by the principle of proportionality. Apart from Czech legislation and recent judicial cases, this thesis is focused on Slovak and German experience with political party ban. Relevant decisions of European Court of Human Rights are introduced as well. In the first chapter the term "political party" is defined. Essential role of the political parties in parliamentary democracy as well as its extraordinary status among associations is emphasized. This part of thesis discusses situations when state can interfere with freedom of association or freedom of speech. Legally defined reasons for the dissolution of political parties are explained. Анотація:
The Bankovic case is one of few cases in which the European Court of Human Rights took a position that, without an acceptable explanation, restricts the application of rights granted by the European Convention on Human Rights. The application was submitted by individuals who put forward that in 1999 seventeen states parties violated art. 2 (right to life) of the Convention by bombing by aircraft the television and radio station in Belgrade. As a consequence of this NATO directed operation sixteen civilians were killed and another sixteen were seriously injured. The Court found that it had no jurisdiction to entertain the case, as at that time Yugoslavia was not a party to the Convention. The Court gave a too restrictive interpretation of the word ‘jurisdiction’ to basically conclude that the Convention applies only within the territory of states parties. The Bankovic decision has been contradicted by subsequent judgments.

AbstractThe text aims to reconcile the bioethical principles (autonomy, beneficence, non-maleficence and justice) (Beauchamp TL, Childress JF in Principles of biomedical ethics, 6th edn. Oxford University Press, 2009) with the principles used by legal institutions (primarily, the European Court of Human Rights) to evaluate possible human rights infringements due to mandatory vaccination against Covid-19 (legality, necessity, proportionality and legitimate aim) (This is the so-called ‘structural approach’ that the ECtHR follows when considering interferences of the qualified right and is also stipulated in article 26 of the Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine (Oviedo Convention).) by National Public Health policies of the Member States of the Council of Europe. (Even more, the idea is to bring closer the methodology of teaching/learning and researching via the HELP platform of the Council of Europe in the course on Bioethics to the law students.) The trigger is to test these principles using deductive reasoning in the pioneering Austrian case of mandatory vaccination, while inductive methodology is used to evaluate how recent similar cases (such as Vavřička and Others v. Czech Republic) contributed to support the theory that next to human rights, there are also duties. Since circumstances with the pandemic are rather turbulent and constantly changing (even as this article is being written), the time factor significantly influences the conclusions drawn. Namely, the author holds the opinion that with a carefully chosen methodology and model, any severe disease that significantly threatens the individual and public health at particular time, period or might constantly be a reason to restrict individual autonomy with scientifically proven, safe and efficient vaccines. Nevertheless, regarding Covid-19, at the current time, even if the means of coercion do not include applying direct physical force (As in the case of Vavřička or in the pioneering but suspended legislation for mandatory vaccination in Austria.), they are not proportionate to the possible infringement on one’s private life and individual consent for the sake of public health, or at least not anymore.

Abstract The year 1989 was not the beginning of the history of the Czechoslovak state. The totalitarian state which governed from 1948 collapsed during the chilly days of the Velvet Revolution. Legislative space was opened for a major metamorphosis of domestic law.3 Human rights and the rule of law became the turning point for the process of the transformation of law. Human rights suddenly ceased to be subject to the strong impact of political and ideological indoctrination and were now intended to become the quintessence of legal existence for an individual.

The Article solves Purposes, Object and Reasons of Filing of the subversive Crimes in the Territorium of the Czech Republic from the Year 1948 up to the Prezent. It consists in two parts – the historical and the juristic Parts. In the first Part it is described the short Knowledge in the Czech Penal Legislatur from the Year 1948 up to the present. On that Background is the Public introduced with the Adjustment of the Crime of the Unlegitimate Leaving of the Republic. The Article concerns its basic Principles and Problems, it shows Deficiences in The Legislatur and Problems with its Realisation in the Practice. It is showed its antidemocratic Character too. On the Base of Statistic this Crime was out of the historical point of view very frequent in the Practice. At the present is its Regulation out of Czech Penal Code, that is in the opposite to Basic Human Rights and it had political and ideological Charakter. It must be but observed, that any subversive Crimes must be maintained in modern democratic States.

The paper discusses the challenges, benefits, and risks of the digitization in public services; argues the internet access right as a fundamental human right and the obligation of a state to provide digital services in the public administration; points out the main tasks of public administration when introducing the principles of good governance; addresses the development of the mentioned principles in the European public space as well at the examples of the Czech Republic. The authors critically describe evaluation methods of digitized public administration and e-Government, including the general model of user acceptance of information technology and benchmarking within the global worldwide information society. The paper highlights practical examples of digitization of the public space in the European Union and in the Czech Republic. The paper concludes with the issues of the state obligation to cover gaps between the legal and economic demand for digitization and provision of digital public services and needs of communities and individuals. The authors use the economic approach to examine legal issues of digitization in public administration. The comparison of the European legislation and Czech national legislation form the primary methodology of the interpretation of the rights of users as well as the obligations of the public administration. Practical examples, figures and tables highlight the argued issues.

In the introduction The work focuses on the concept of radiation accident and deals with its causes and consequences. Thesis examines the legislation of the Czech Republic dealing with the solution of a radiation event from the constitutional level to individual decrees and individual emergency plans. The work also deals the issue of human rights restrictions due to an emergency security situation. The role of the public administration in modern states is diverse and extensive. The state administration is traditionally connected with the activity of lordship and decision-making. The municipality and community administration is more user-oriented and supportive in difficult life situations. Both types of public administration execute permanent and daily control of their users. They check how the addressees follow laws, by-laws and orders or instructions of the public administration. Contemporary modern global society born new challenges and for both parties of the relationship. The paper examines the needs of users for a more friendly, supportive approach. The public administration's daily practice must connect particular and general interests regarding, on the one hand, the protection of human rights, on the second-hand goods of a community or the whole society. The paper analyses the thin line between support and control when delivering public service based on the Czech Republic experience. The article focuses on managerial and legal issues and possible tools for transitioning from lordship to procuring and assisting public administration.

The paper examines the issue arising when delivering healthcare in the modern information society. Throughout the past decade, the Internet has seen a significant rise of the "Web 2.0" trend, which carried on its wings a health industry trend often referred to as "Health 2.0" or "Medicine 2.0". More recently, we have also witnessed the crowning of concepts such as Health Social Media, eHealth and mHealth. European Union as well as the national states develop strategies implementing new technologies for personal and medical data sharing, including the prescription of medicals as well as their validation through websites. Healthcare data privacy and security is one of the top challenges, healthcare providers face. The huge amount of data the medical care generates holds potential for researchers, providers, pharmaceutical companies as well as for doctors, who can use it to improve care or find new treatments and insights into disease. The key issue to examine is how to balance the competing interests of privacy and data-sharing and not exclude the patient as a holder and owner of the information. The paper addresses the issue of privacy protection in digitized healthcare, using the analysis of the legislation and case-law of the Czech Republic, stressing the demands for human rights and privacy protection of a member state of the European Union. The paper introduces several proposals for providers on how to re-design digital healthcare with respect to laws and patients´ rights. The paper concludes that even modern and digitized medicine is based not only on evidence and modern technologies but also on human interaction and face-to-face approach and trust between the doctor and patient.
