Zircon macrocrysts in (sub)volcanic silica-undersaturated rocks are an important source of information about mantle processes and their relative timing with respect to magmatism. The present work describes variations in trace element (Sc, Ti, Y, Nb, lanthanides, Hf, Ta, Pb, Th, and U) and isotopic (U-Pb) composition of zircon from the Drybones Bay kimberlite, Northwest Territories, Canada. These data were acquired at a spatial resolution of ≤100 µm and correlated to the internal characteristics of macrocrysts (imaged using cathodoluminescence, CL). Six types of zircon were distinguished on the basis of its luminescence characteristics, with the majority of grains exhibiting more than one type of CL response. The oscillatory-zoned core and growth sectors of Drybones Bay zircon show consistent variations in rare-earth elements (REE), Hf, Th, and U. Their chondrite-normalized REE patterns are typical of macrocrystic zircon and exhibit extreme enrichment in heavy lanthanides and a positive Ce anomaly. Their Ti content decreases slightly from the core into growth sectors, but the Ti-in-zircon thermometry gives overlapping average crystallization temperatures (820 ± 26 °C to 781 ± 19 °C, respectively). There is no trace element or CL evidence for Pb loss or other forms of chemical re-equilibration. All distinct zircon types are concordant and give a U-Pb age of 445.6 ± 0.8 Ma. We interpret the examined macrocrysts as products of interaction between a shallow (<100 km) mantle source and transient kimberlitic melt.

Clause 1(b) of the Canadian Bill of Rights specifies that every person has the right to equality before the law. The purpose of this article is to analyse, on the one hand, the meaning that the judges of the Supreme Court have given to this concept of equality before the law and, on the other hand, the way in which they have applied this aforementioned principle of Clause 1(b) of the Canadian Bill of Rights. Four judgements are the subject of Mr. Bourque's study. He concerns himself with the Drybones, Lavell, Burnshine and Canard judgements. In the course of analysing these cases, Mr. Bourque brings out the shilly-shallying of the judges in connection with their concept of equality before the law. In spite of this beating about the bush two concepts emerge at the level of the judges of the Supreme Court, namely an equalitarian concept of equality before the law, and a concept which makes equivalent equality before the law and the rule of law. According to Mr. Bourque, the analysis of these four judgements shows that it is the concept which makes equivalent equality before the law and the rule of law, which represents, the position of the Supreme Court, at the present time.

Abstract Local merchantable board foot, cubic foot, and weight equations are developed for six economically important hardwood species in central Appalachia. Equations were based on a simple power function and were fit to volumes from the US Forest Service Forest Inventory Analysis data for West Virginia and parts of Ohio, Pennsylvania, Maryland, Virginia, and Kentucky. Five ecoregions were identified and the volume equations were tested to determine whether differences by ecoregion were statistically significant. Results varied by species, volume type, and ecoregion. Average bias between a single-species region-wide model and specific ecoregion forms ranged from −9.1 to 8.5% for gross board foot volume (International ¼ in.), −3.5 to 9.2% for gross merchantable cubic foot volume, and −9.5 to 16.7% for merchantable drybole weight (pounds).

The Drybones Bay and Mud Lake kimberlites are Ordovician kimberlites located in the Slave Geological Province. The Drybones Bay pipe formed by multiple discrete eruptions, producing several texturally distinct phases of kimberlite, including hypabyssal kimberlite (HK) autoliths, tuffisitic kimberlite (TK), pyroclastic kimberlite (PK) and resedimented volcaniclastic kimberlite (RVK). The recognition of TK suggests this pipe represents a Class 1 kimberlite. The nearby Mud Lake kimberlite is a dolomite-rich HK dyke characterized by macrocrystic and segregation textures. Although the kimberlites are proximal, U-Pb zircon dates indicate they were not emplaced contemporaneously, and geochemical discrepancies that cannot be explained by known magma evolution processes indicate that these rocks formed from distinct parental magmas. Mineralogical and geochemical data is used to evaluate crystallization conditions and diamond potential. New geochemical modeling of compatible trace elements reveals convincing evidence of magma evolution by olivine fractionation, adding substantially to the published research on kimberlite geochemistry.

Ideas that are migrating from Canada are already guiding advocates who seek greater judicial and constitutional recognition of Aboriginal and Torres Strait Islander peoples. However, there is a need for a conceptual framework through which to approach the lessons that can be learned from Canada in this area. Inspired by The Migration of Constitutional Ideas, an edited work by Sujit Choudhry, in this thesis I argue that by thinking about the migration and transplantation of foundational ideas and by differentiating between four ‘modes’ of migration (arguments of counsel, judicial determinations, academic critique and constitutional reform deliberations), it is possible to better understand some of the processes that are at play. In particular, by adopting the terminology of the ‘migration’ and ‘transplantation’ of ‘foundational’ ideas, I aim to demonstrate that it is dangerous to transplant foundational ideas, whether derived from the common law or constitutional law, without other ideas (particularly in relation to implications) also migrating. This thesis is a response to two distinct but related topics: ‘Topic 1 — The Potential for Judicial Recognition of Indigenous Self-Government Rights: The Migration of Foundational Ideas from Canada to Australia’ and ‘Topic 2 — Constitutional Recognition of Aboriginal and Torres Strait Islander Peoples, the Race Power and an Anti-Discrimination Guarantee: Contemplating Canadian Approaches to Equality’. Through these two topics I examine two of the recognised modes of recognition — judicial and constitutional — and focus on two discrete types of recognition — self-government and non-discrimination — and the lessons that can be learned from Canada. In response to the first topic I consider the extent to which foundational ideas are migrating from Canada to Australia in the field of Indigenous self-government rights and whether these ideas could be used in Australian courts. In response to the second topic I consider the extent to which Canadian experiences may assist when exploring the potential implications of prohibiting discrimination in the Australian Constitution and when examining the various options that are available. As far as the migration of foundational ideas from Canada is concerned, in Topic 1 my starting point is to consider what could be learned from the Canadian jurisprudence in order to understand the ideas that have migrated or could potentially migrate to Australia. In contrast, in Topic 2 I start with an appraisal of the lack of recognition of Aboriginal and Torres Strait Islander peoples in the Australian Constitution and the perceived problems with s 51(xxvi) (the ‘race power’), and in so doing I consider what benefits (modified) Canadian transplants may offer, if any.

Till (n=196) and stream sediment (n=60) samples were collected in the area south and west of Great Slave Lake, Northwest Territories (NTS 85B, C, F, and G), over the course of 3 summer field seasons. Samples were processed to recover kimberlite and other indicator minerals. This report summarizes results of the kimberlite indicator mineral (KIM) studies, including measures of KIM mineral types, abundances, and chemistry (major, trace, and rare earth elements). KIMs were present in 24% of the samples collected, and only 183 KIM grains in total were recovered, of which Cr-pyrope garnets were the most abundant (65.6%). Chemical analyses revealed strong similarities to the Drybones Bay and Mud Lake kimberlites which are situated 50 to &amp;gt;100 km to the northeast, roughly aligned with prominent glacially streamlined landform flowsets in this field area. Results suggest there is little evidence for undetected kimberlite outcrop or sub-crop in the study area.
