In recent years we have observed some shift toward viewing children as human beings with a distinct set of rights instead of as passive objects of care and charity. In this point, the preventive policy for street children is an interesting topic of sociological research. Street children aren’t well known in France and the public authorities don’t recognise this phenomenon as a public issue. Comparing the situation in Poland and in France is interesting and bring new perspectives. Our thesis aims to understand this public policy and especially how children’s participation can change its application.This thesis explores the hypothesis that preventive policy for street children are a part of public policies that focus on the child and that the normative references are ambivalent. The concept of child’s participation also reveals the ambivalent normative references. The idea of child’s participation can be a purpose or a mean. The implementation of these concepts causes several normative decompositions.Our research allows to understand that the meaning given to street children’s participation does not only varies between regions, but is also different at the official orientation level given to the social policy, the policy-makers discourse, and the forms of local policy. The family and collective vision also has an impact on the social policy in France and results in few actions taking into account the participation of children in Ile-de-France. On the other hand, in Mazovia, the importance of liberal and individualistic ideology makes it possible to legitimize policy guidelines that support the participation of children

In the setting of access to health that is a right for all, the drug has an important place in France and in Japan, which are countries where life expectancy and level of life are high and keeps on increasing. It is in consideration of this, that we are asking ourselves, through this thesis, about the drug user's right place in drug regulation in France and Japan which are countries different by their culture but sometimes converging in law.We can validly hold up that a good health system can be recognized by the level of protection given to the drug user. But this is not so easy because various interests are at stake. It is important to know how these kinds of conflicts are solved in drug law: is it human or science which is protected? If we can hold up that the protection of the "scientific human" exists, we have to research the reality of the existence of rules insuring a “more human” science. We know and it has been said that the field of health, emotional, individualistic, structured in strong lobbies and often capitalistic, is very difficult to comprehend

The principle of unavailability of the human body has been thought in two different ways : as a prohibition of selling or giving someone, as a prohibition of causing a breaching physical integrity. We defend that the principle of unavailability of the human body still remains under these two apsects, but not exactly within the same meaning. It takes the form of a violation-saving principle, which prevents from all unnecessary violations of bodily integrity, and which aims not to prohibit but to avoid the bodily integrity violations, by its external side, and to limit those, by its internal side. It also takes the form of a principle of non-negociation, which prohibits that pressures may be exercised onto someone to make a person accept an infringement on her body. These two aspects extend in public law the principle of unavailability which already existed in private law. This principle is however threatened by the health requirement, more and more subjective, and by the interference of profit-making interests. These two logic allow some violations of bodily integrity for reasons unlinked to health, but for economic ones

The general purpose of the thesis is to study the impact of psychological and psychiatric testimonies in the context of sentencing. More specifically, this consists of examining the role of the motives for punishment in the consideration of expert information relating to altered mental state or the risk of recidivism in the sentencing process. Expertise can be defined as "all the forms that the introduction of a technical-scientific rationality takes in the institution, process and judicial decision" (Dumoulin, 2005, p.202). The literature generally shows that expertise plays a role in the decision-making of jurors. Nevertheless, only few studies (Krauss, Lieberman, & Olson, 2004; Krauss, McCabe, & Lieberman, 2012) highlights the interindividual variables that can explain this decision-making process. This thesis specifically proposes to focus on the motives for punishment as potential explanatory variables for the impact of expertise on sentencing in France. The research programme is divided in two axes. The first two studies (axe 1) deal with the role of the motives for punishment in taking into account expert information relating to altered mental state (study 1) or risk of recidivism (study 2) when sentencing. The third study (axe 2) examines the impact of criminal records and expert information on the risk of recidivism on sentencing. In general, the results of the thesis highlight the need to take into account interindividual variability in the study of the impact of expertise on judicial judgments. More specifically, the results suggest that the use of expert information when assigning a sentence to the perpetrator of a crime depends on the purposes that individuals associate with the sentence

Alcohol Use Disorder (AUD) represents a major health and social issue. However, in France, only 10% of people with AUD (PWAUD) receive associated medical care. General Practitioners (GP) play a pivotal role in AUD screening, managing and treatment referring. Until very recently, the standard of care for AUD was based on stopping consumption, maintaining abstinence, preventing chronic complications and managing withdrawal symptoms. However, alcohol-related risk reduction is now becoming an acceptable therapeutic goal for caregivers and patients.The objectives of this thesis were (1) to improve knowledge on barriers and levers to PWAUD accessing care (among GP and people with AUD) for AUD and (2) to explore the challenges of better management of AUD among populations with severe comorbidities.This work is based on data from the ASIA study as well as data from the ANRS CO13 HEPAVIH cohort of HIV-HCV co-infected patients.Among PWAUD, we identified two types of barriers: socio-environmental and structural. We also identified two levers: family influence, whereby the PWAUD accesses care with the aim of improving family relationships, and being a smoker. However, being aware that AUD care no longer necessitates abstinence was not linked to receiving or seeking care.Among GP, systematic screening and AUD management were associated with a favourable attitude toward controlled/reduced drinking strategies. GP who managed AUD were also more likely to manage smoking cessation and to prescribe opioid substitution treatments.Finally, among the HIV/HCV co-infected population, AUD remained independently associated with sleep disorders

In Canada, the number of temporary foreign workers has been steadily increasing since 2003. Temporary foreign workers have neither political citizenship nor permanent residency; their professional mobility is restricted and their length of stay limited and predetermined. Formally, these workers can benefit from the protection of labour law despite their migratory status. Many studies have however shown that “low-skilled” temporary foreign workers are generally less likely to report the violation of their labour rights. Does labour law constitute a useful buttress for these workers? Using a mixed methodology involving a field study with key actors, this study pursues two objectives. On the empirical level, it allows to shed light on the impact of the singular employment system of these workers on their mobilization of labour law’s protections. Such mobilization is neither contingent nor predetermined; it depends on the constraints and on the opportunities arising from the employment system. Our research also reveals that strategies elaborated by actors who are not, from a legal perspective, parties to the employment relationship, also have a significant impact on the way these workers take advantage of labour law's ressources ; such impact largely depends on the power these actors have in the employment system. On the theoretical level, this study is situated in the broader field of studies concerning the effectiveness of law. It purports to distinguish between the study of the effects of the law and the analysis of its use. It elaborates an analytical framework addressing the relationship between the law and its recipients.
