Повний текст джерелаAgainst the backdrop of French public law with its separate administrative and ordinary courts, French lawyers often assume that English law does not have a system of public law. This is inaccurate. This thesis aims to demonstrate the existence of a substantive public law in the English legal system. It does so by identifying a number of public assets. Substantive public law should be distinguished from judicial review, which is not substantive but procedural public law. The substance of English public law lies in a multitude of rules that deviate from the rest of the legal system. These rules are found not only in common law and equity, but also in statute and in delegated legislation. From the analysis of these derogative rules, it appears that public assets enjoy privileged legal treatment. This is triggered either by the "publicness" of the asset, such as the Crown or the public itself, or by the pursuit of the public interest, regardless of the public nature of the owner. My research reveals two sets of substantive public law rules applying to public assets. The first comprise adverse possession when applied to Crown lands and town or village greens. The second set encompasses charities, and assets owned by privatised services

Повний текст джерелаIn France, like in England, the Public Prosecutor is historically intended to ensure the judicial nature of criminal justice. Reciprocally, the strengthening of the judicial nature of the criminal justice traditionally restricts the prerogatives of the Public Prosecutor's Office. However, the link between the reinforcement of the judicial nature of the criminal justice and the existence of the Public Prosecutor, albeit obvious, evaporates slowly in multiple shades. The French and the English lawmakers, supported by case law, have come to considerably strengthen the Public Prosecutor's investigation and pre-trial powers, thus ousting the judicial nature of the criminal justice. Although it may seem that the judicial nature of repression is preserved when the Public Prosecutor is required to obtain coercive measures or ultimate retribution, it turns out to be deprived of substance. An a priori control by a judge who grants judicial investigative powers to the Public Prosecutor is always formalistic, whereas an a posteriori control by a judge who may annul decisions taken during the investigation is flawed and random. However, a guarantee of a regular use of investigative powers and of treatment of offenses cannot come out of the strengthening of judicial nature of the Public Prosecutor. A comparative analysis of the structure of the Public Prosecutor’s Office in France and in England reveals that the dues that are to be considered -independence and impartiality of the French Public Prosecutor -do not suffice. It is a reestablishment of the judicial functions of the body, coherent with its true ratio, that should be implemented

It has become a primary care activity at the heart of the diagnosis and treatment of many pathologies in oncology, neurology and cardiology, for instance. Its essential role in the care path of the patient is the result of the important development of the technologies, but also of the clinical indications. The framing of medical imaging in the French healthcare system remains nevertheless unclear and bordered by legal and economic constraints. This legal and economic uncertainty is an obstacle to the effective access to medical imaging technology for patients through, in particular, an exacerbated control of equipment installations and a disorganized acts pricing procedure. Furthermore, the lack of medico-economic evaluations delays the implementation of innovations and even creates risks to the safety and quality of the imaging tests performed

Повний текст джерелаThe question of the treatment of uncertain/unforeseen events affecting public contracts seems to oppose in an immeasurable way English and French laws. While, in French law, general rules provide, in the public interest, the treatment of uncertain/unforeseen events affecting public contracts without the consent of the contractors, no such provisions exist in English law, where the sanctity and intangibility of contract prevails. Thank to this antagonism, the proposed comparison enables to highlight the deep motivations of the treatment of uncertain/unforeseen events affecting public contracts, through the theoretical opposition between sanctity of contract and public interest. In this respect, the general rules allowing, in French law, the treatment of the uncertain/unforeseen events without the consent of the parties appear to be based on an economic and teleological approach of the contract and its biding force. Surprisingly, the latter approach can also be noticed, in some respects, in the English law of contracts. Moreover, the priviledged mean to treat uncertain/unforeseen events in England as well as in France is the agreement of the parties – whether ex ante or ex post. Nonetheless, the possibilities of variating the contract in the course of its performance have been drastically limited by the European Union law. By contrast, the intial terms which tends to erect an autonomous regime of treatment of uncertain/unforeseen events through the spreading of standard terms appear to be the major and indispensable mean of adaptation of public contracts in the course of their performance
