Повний текст джерелаIl presente lavoro si correla al recente intervento legislativo rappresentato dall’emanazione del nuovo Codice della crisi d’impresa e dell’insolvenza (D.Lgs. 12 gennaio 2019, n. 14). L’obiettivo che si pone è quello di verificare se, nel contesto di una maggiore considerazione di interessi diversi da quelli attinenti ai rapporti obbligatori di tipo pecuniario, il nuovo codice, accanto alla tutela privilegiata dei crediti riconosciuta ai lavoratori, dia rilievo anche al loro interesse alla conservazione del posto di lavoro, con conseguente maggiore protezione non solo nella fase della crisi, ma anche nell’ambito delle vicende conseguenti all’apertura delle procedure concorsuali. Si prenderanno le mosse dall’analisi del complesso rapporto tra il diritto concorsuale e il diritto del lavoro mettendo in evidenza la diversità dei beni giuridici protetti per poi analizzare gli istituti volti a favorire la conservazione dell’azienda e con essa dei rapporti di lavoro. Si evidenzierà una linea di tendenza della nuova disciplina diretta a favorire la rilevazione precoce dello stato di crisi e la conservazione del complesso aziendale e dei rapporti di lavoro in capo all’imprenditore insolvente, ad un soggetto terzo e/o alla procedura.

Повний текст джерелаNon si può parlare di diritto del lavoro e di tutela dei diritti dei lavoratore senza pensare alla necessità di proteggere i lavoratori nei casi in cui essi rischiano veramente il tutto per tutto, in quelle situazioni cioè di patologia in cui non solo il lavoratore vede compromesso il proprio lato economico ma in cui viene messo a rischio il bene che dovrebbe ricevere maggiore protezione: il posto di lavoro. Il problema della crisi d’impresa, che sempre più frequentemente è all’attenzione di giornali e dibattiti politici, viene qui studiato e analizzato da un punto del lavoratore subordinato dipendente di un’impresa assoggettata alla procedura concorsuale. L’attenzione è rivolta ai risvolti pubblicistici che inevitabilmente conseguono alla crisi d’impresa, rispetto ai quali la logica del legislatore fallimentare del 1942 appare del tutto estranea. E’ dunque all’introduzione della procedura di amministrazione straordinaria piuttosto che alla riforma della procedura fallimentare operata in questi ultimi anni, che si deve il merito di un maggior riconoscimento degli interessi dei lavoratori, non solo dal punto di vista economico quanto di prosecuzione del rapporto di lavoro.

It aims at encompassing the three hypotetical systems of the setting of the Transnational Labour Law as following : transnational company, industrial relations, and arbitration as a mean of fixing the corporation customs (lex mercatoria, lex sportiva). This dissertation focuses on the way to insert in the local law (i. E. The Italian and the French law) the different legal act related to each legal system that is : company unilateral norms, collective transnational agreements, and arbitration awards. Furthermore, this thesis addresses the difficulty to determine the type of each and problems of international private law. The author concludes that it is necessary to establish new links between States law and these new forms of regulations

Повний текст джерелаThis thesis aims to investigate the concept of sustainable development, with an overview of the concept’s evolutionary stages, in order to get its intrinsic characteristics and to understand the different meaning it has in its three fundamental pillars (environmental, economic and social). After investigating the sustainable development roots and critics in economic theories, an overview of the legislation and case law references to this concept, both at the national and international level, is offered. The reconstruction of the doctrinal debate on the theme of sustainable development follows, and some examples of sustainable development practical application (TTIP, CSR, GSP and Horizontal Social Clause) are analyzed. Finally a reflection on the similarities between this paradigm and the labour law and on the future potential relations between sustainable development and labour law is proposed.

In chapter III is a short pass of the main administrative labour crimes. Particular attention is given to administrative time work and undeclared work crimes because of the importance of values concerned and the numerous laws recently occurred. In chapter IV labour vigilance is examined considering the importance that controls have to ensure laws’ respect.

Повний текст джерелаFrom the legal point of view The compensation for damage is a very important subject, in relation to the contract conditions (art. 1218 Civil Code), Extra-contract conditions (art. 2043 Civil Code), property damage (artt. 1223 ss. cod. civ), no property damage (art. 2059 cod. civ.) or in relation to the quantification and procedural analysis, the penal clauses have been much studied both in doctrine or in jurisprudence or in positive rights. There are many legal factors in the damage analysis and it is impossible make a study only trough civil law, criminal law or administrative law. Повний текст джерелаThe relationship between subordinate work and self-employment is one of the most interesting topics for labour lawyers. Many academics, both in the past and recently, have questioned the imbalance of protections that sees the subordinate workers as the privileged beneficiary of working and social security rights, while the latter excluded from most of them. A topic that in the last two decades became pivotal at the European level, especially following the changes in the labour market and technological innovations that have increased the number of vulnerable self-employed workers in the EU. Given the interest of the European institutions, this survey aims at investigating the role of European labour law in extending the scope of protection and rights towards self-employment. Specifically, the research deals with the classification of dependent self-employment, proposing the introduction of an intermediate category within European Labour law. The latter considered as a privileged vehicle to raise the level of protection of these workers, more and more integrated functionally and operationally into the client's company. During the research we will focus on areas where European labour law has already extended the scope of application towards self-employment, leading to a rapprochement with subordinate work, and then looking to other subjects where these extensions could be possible at EU level.

Повний текст джерелаThe thesis is inspired by the study of several concepts that, nowadays, cannot be considered even simple and acquired to the juridical doctrine, like legal set of rules, law and juridical norm. A preliminary reflection about the point is a fundamental step in order to better understand the characters of the norm within the system of right’ springs in general, with particular interest for the labour law; the conjecture is that if we consider as springs of right the “situations” in which the right arises and develops itself, then we have to accept that collective bargain is the well of right, even if it is sui generis. Pursuant to this hypothesis, the examination carried out along the present thesis has checked different models of interaction between law and collective bargaining from the beginnings to the present day of what today we refers to as “labour law”, in order to understanding a various relationships of supremacy between law and collective bargaining; in the past, indeed, the power of waiving the law by collective bargain it was considered an exception, but this relationship was slowly became a stable model of Italian legislation, model that today considers as similar law and collective bargain in the matter of business relationships. In the end of this dissertation, the constitutional limits of this approach that prevent to the legislator of abdicating, as a figure to speech, its “traditional” protective role of workers through arrangement of fundamental rights, are investigated, by means of an accurate and deepened analysis of Clauses 1 and 2 of Italian Consitution.

The post industrial labour law is the result of the bourgeois and industrial revolutions, when the individual will was shaped through the contract. Afterwards, the individual autonomy ceases to have its supremacy as source and is put amongst the less important level of the sources of labour law, after acts and collective autonomy. Then, a present, individual autonomy is increasingly affecting the recent transformation of labour law and represent one of the most important elements qualifying the process of change.

Повний текст джерелаThe thesis addresses the issue of protection instruments for the condition of unemployment. In the absence of a general legal concept of unemployment, the goal is to find the common elements to different institutions which define the protection scope afforded to persons without a job. The study provides, at first, a comprehensive historical-critical survey of the tools for income support in the event of lack of work. The analysis of the legislative intervention models highlights goals, characteristics and problems of each legal institution, the more established as well as the most recent ones. The second part of the thesis tries to integrate the recognition of forms of economic protection through the analysis of active policies in the labour market and measures to support employability. The intent is to verify how legislative initiatives try to connect income protection and employment promotion. The research also addresses the question of limits to freedom of movement of EU citizens and restrictions determined by measures that reduce or discourage the exportability of social security benefits in other European countries. The final section seeks to identify the fundamental elements of the complex of institutions analyzed in order to define events to which legal order provides protection. The study identifies two important elements characterizing all the protection instruments: first, the condition of "lack of work"; second, the current state of unemployment, stated as general parameter for protective action. The analysis points out, however, that the mechanisms of so-called conditionality for access to economic benefits and employment services do not allow a successful promotion of quality of work and workers skills. The thesis identifies a possible field of development for the protection of the unemployed in the integration between tools supporting employment and general universal interventions.

The second part of the thesis tries to integrate the recognition of forms of economic protection through the analysis of active policies in the labour market and measures to support employability. The intent is to verify how legislative initiatives try to connect income protection and employment promotion. The research also addresses the question of limits to freedom of movement of EU citizens and restrictions determined by measures that reduce or discourage the exportability of social security benefits in other European countries. The final section seeks to identify the fundamental elements of the complex of institutions analyzed in order to define events to which legal order provides protection. The study identifies two important elements characterizing all the protection instruments: first, the condition of "lack of work"; second, the current state of unemployment, stated as general parameter for protective action. The analysis points out, however, that the mechanisms of so-called conditionality for access to economic benefits and employment services do not allow a successful promotion of quality of work and workers skills. The thesis identifies a possible field of development for the protection of the unemployed in the integration between tools supporting employment and general universal interventions.
