The primary focus of the paper is on the right of religious communities to acquire legal personality. For religious communities this issue has existential importance. Denying access to such status imposes impermissible limitations on freedom of religion or belief. The majority of religious communities seek legal entity status, because it is necessary if they want to acquire property, hire personal, apply for governmental permits etc. The right to acquire legal entity status is one of the most critical arrangements needed for religious liberty in contemporary societies. The paper includes analysis of three important characteristics of this procedure. Access to legal personality for religious or belief communities should be non-mandatory, quick and transparent. It should be taken into account that competent authorities for various political or social reasons, made untimely decisions or refused to register religious organizations due to alleged formal deficiencies. In these cases, the procedures themselves and excessive formalism were used as a mechanism to control the number of recognized religious organizations and to deny the status of a legal entity to certain religious groups. In order to prevent such occurrences, it is necessary to protect the competent authorities from all those influences that prevent them from acting impartially and neutrally. There is a variety of ways that the right to legal personality can be provided for religious communities. Registration system should be compliant with international human rights norms and it is important to recognize that registration is not a primary mechanism for exercising social control of religion.

Abstract This article focuses on the rise of corporate religious freedom in EU law. In general, this legal category might be associated with not only a positive dimension (corporate freedom of religion) but also with a negative one (corporate freedom from religion). The present article centres around the latter, underscoring how the CJEU has taken for granted the necessity of neutrality within the private business world in reaching a decision in the case of Achbita v G4S Secure Solutions. And, in addition, to highlight how churches (but also the Belgian branch of a provider of secure global logistic services) can discriminate on religious grounds under Directive 2000/78EC. This article explains how the judicial extension of conscience exemptions from non-discrimination laws for religious institutions to a secular for-profit corporation has signalled a new ‘religious institutionalism’ in tension with employment and human rights law. Accordingly, if that is how secular commercial businesses have become ‘religious’ under the EU Single Market, this article calls for a new approach to employer/employees conflicts through a ‘freedom of the church’ analysis.

The contribution questions the preliminary rulings given by the CJEU in Achbita and Wabe and Müller Cases that define the corporate neutrality policies banning wearing of religious clothes in private employment as indirect discrimination. The contribution argues that such corporate neutrality policies, though applied to all employees in the same way, constitute in fact direct discrimination for the devout followers of orthopraxis religions, such as Islam, Judaism and Sikhism, provide preference to employer’s freedom to conduct a business and economic interests over the employee’s right to religious manifestation and social rights, put the right to religious manifestation at the bottom of the hierarchy of grounds of discrimination and cause to economic and social exclusion of such minority employees, notwithstanding the European values.

AbstractThe essay attempts to recover a language of liberty, a set of assumptions common participants in the mid-seventeenth-century discourse on religion and liberty. The current historiography of seventeenth-century liberty and contemporary consensus on the complementarity civil liberty and law are used as contexts. In the religious sense, liberty was commonly taken to imply submission to the will of a God of millennial purpose and providential power. In the struggle for appropriate submission to such divine authority issues of freedom arose in the Pauline paradoxes service as perfect freedom and in the process of liberation from inappropriate authorities. The polarization of liberty and authority in traditional accounts of the puritan revolution, the reduction of religious liberty to an element within a greater struggle over constitutional forms, and the identification of religious liberty with individual and corporate rights are called in question.

AbstractProponents of minority rights are calling for urgent measures to protect the Copts in Egypt, the Ahmadiyya in Pakistan, and the Baha'i in Iran to secure religious diversity, shield minority populations from discriminatory practices, and prevent the outbreak of religious violence. State governments, international organizations, nongovernmental organizations, and international tribunals promote religious liberalization as the antidote to the violence and discord that is often attributed to these divisions. Enshrined in international agreements and promoted by a small army of experts and authorities, legal protections for religious minorities are heralded as the solution to the challenges of living with social and religious diversity. This article examines how the complexities and ambivalences of ordinary religious belonging are translated and transformed through the process of becoming legalized and governmentalized. It documents the risks of adopting religion as a category to draw together individuals and communities as corporate bodies that are depicted as in need of legal protection to achieve their freedom. The argument is developed through an extended case study of the legal status of the Alevis in Turkey, a community and a category formally constituted as a single whole as part of the Turkish nation-building project. It evaluates two legal constructions of Alevism by the Turkish state and the European Court of Human Rights. While premised on differing assumptions about Alevism, both erase the indeterminacy and open-endedness surrounding Alevism as a lived tradition embedded in a broader field of social and cultural practices, while bolstering the role of the state in defining and overseeing Turkish religiosities.

It fi nds that business has avoided the notion of responsibility in favour of investment and philanthropy, and that meaningful and constructive approaches to gender ideals have not as a result been forthcoming. e article argues for a renewed understanding of and commitment to responsibility with special attention given to underlying perspectives impeding this approach, but sees much promise in the role that churches with their theology and partners could fulfil in assisting the public discourse on women's human dignity, equality and freedom amidst various economic challenges.

AbstractScholars frequently describe American religious disestablishment using commercial analogies, reckoning that states “privatized” religion or subjected churches to “free-market competition” by making them more like commercial businesses, yet this article demonstrates in part how churches pioneered many of the corporate devices that came to define American enterprise after the Civil War. Such descriptions are thus anachronistic. Antebellum jurists were not concerned about the similarity of churches to businesses, but rather their similarity to states, and the republican fear that churches could be rival sovereign states at first structured the law of disestablishment and incorporation. In most states, churches gained rights of general incorporation but faced significant limitations on their corporate governance and property holdings. InDartmouth College, the Marshall Court reimagined religious societies as private owners who, instead of governing as rival sovereignties, administered property in trust under their charters. But with the vague charters of general incorporation, state judges were left without a definite source of law to adjudicate church disputes. This article argues that courts thus allowed trust law to function as a conflict of laws analysis: Judges treated religious doctrine as a foreign legal system with rules that could be ascertained and accorded respect in American courts. Such a move created a positive, corporate right of religious liberty that becomes obscured if one conceives of religious freedom only as an individual right to be asserted against the state.

This article argues a theological case for “principled pluralism,” a particular stance regarding the proper attitude of the state towards the plural religious affiliations of its citizens. Its central claim is that the role of the state is both to defend the religious freedom of adherents to all faiths and to maintain a public square equally open to contributions from all faiths without publicly privileging any faith, even Christianity. It develops the argument in critical dialogue with a “Christian nation” position, according to which nations can exercise corporate religious agency, should be formed where possible according to Christian principles, and in which Christian citizens should call their governments to support the nation’s Christian character. The article primarily examines the Achbita judgment within the context of the struck balance of competing rights/freedoms, i.e., the right to manifest religion and the freedom to conduct a business. It argues that with its lenient and one-sided application of proportionality and by affording the freedom to conduct a business of an employer almost an unfettered prerogative against the right to religious manifestation of an employee, the Achbita judgment could be included into the line of case law, such as Viking, Laval, Alemo-Herron and AGET-Iraklis, which provides for preference and prevalence of economic rights/freedoms over conflicting social rights. The judgment even extends that preference and prevalence to the fields having no crossborder element. If not having confirmed horizontal direct effect of Article 16 of the Charter and so recognized it in nature as a right rather than a principle in the sense of Article 52(5) of the Charter, the CJEU paves the way for consolidating this judicial trend. As a consequence in respect of the principle of non-discrimination on certain grounds, the judgment establishes different levels of protection for different grounds of discrimination and consolidates it by downplaying the right to manifest religion towards the bottom. Public authorities in Europe are faced with increasing demands to accommodate religious diversity. This article traces some key issues concerning the limits of the secular State in Europe to accept and accommodate those ethno-religious minorities that are perceived to be partially different entities and claim some jurisdiction, without thereby rejecting guarantees from the receiving legal system. This multicultural challenge that minorities pose to institutionalized secularism is amongst the most complex political and long-term issues European states have to face. Such a challenge has not only to do with socio-economic disadvantage and discrimination in the labour markets but also with the constitutional status or corporate relationship with the State. On the other hand, European anxieties question whether or not Muslims can be and are willing to be integrated into European society and its political values; in particular, values of freedom, tolerance, democracy, sexual equality and secularism. Across Europe, multiculturalism seems to be in retreat and ‘integration’ is once again the watchword.

Abstract This article explores gradual manumission policies on the Order of Saint Benedict's slaveholdings in the Northeastern province of Pernambuco, Brazil, between 1866 and 1871. Relying on private religious records from the Monastery of Saint Benedict of Olinda (in Pernambuco) and parliamentary debates, we contend that the Benedictine order was the first corporate enslaver to implement institutionalized strategies of gradual manumission in Brazil. To do so, they relied both on enslaved women's reproductive capabilities and on their adherence to church-sanctioned gender roles. We further argue that the order's decisions and actions were ahead of national developments in several important ways, and that, to some degree, these projects were a test case for future national abolitionist policies. Although the congregation did not involve itself in political debates, its actions created a working example of gradual abolition based on enslaved women's bodies that abolitionists used to make their case nationally.

Science and technology have been associated with modern Enlightenment, in a manner that elevated the rational mind over emotions and the body, a separation of the subjective mind from the object of observation, universal categories, objective observation, and linear causality. These assumptions, consolidated by Descartes and then Kant, have underpinned the philosophies of science, economics, policy, and political theory. They have shaped the modern world and enabled corporate freedom to exploit all ‘resources’ in the name of consumerism and global trade. Idealism has alienated subjective rationality from an idealised universal created world. In contrast, ancient indigenous ways of knowing are emerging as better exemplars of the interrelationship between individuals, communities, and organic and anorganic life forms. Celtic shapeshifters and praise poems forge an interwoven dance of geology, weather, plants, animals, and humanity with wisdom and politics. The Māori concept of whakapapa is the kin relations of everything, tied into complex claves as a taxonomy of familial ties. Animism was understood as pagan misidentification by modernity, but if the alienation set out by modern linear physics is severed, then the intra and inter-relationship of strata, atmosphere, ocean, and species are better relayed by indigenous philosophy than by outdated, colonial, modern assumptions. Celtic and Māori pantheism show us how entangled we are, and how special relationships are in place that last across generations.

The Supreme Court’s 2010 decision in Citizens United v. FEC invalidated a longstanding restriction on corporate and union campaign spending in federal elections, freeing entities with diverse political goals to spend unlimited amounts supporting candidates for federal office. Houses of worship and other religious nonprofits, however, remain strictly prohibited from engaging in partisan political activity as a condition of tax-exempt status under Internal Revenue Code § 501(c)(3). Absent this “electioneering prohibition,” religious nonprofits would be very attractive vehicles for political activity. These 501(c)(3) organizations can attract donors with the incentive of tax deductions for contributions. Moreover, houses of worship need not file with a government agency to begin operating and deriving tax benefits, and the IRS has shown reluctance to aggressively audit their activities. Two circuits have previously upheld the electioneering prohibition against legal challenges, but recent jurisprudential shifts expose the tax code provision to challenge under the Religious Freedom Restoration Act (RFRA), which directs courts to apply strict scrutiny to facially neutral laws that substantially burden the free exercise of religion. First, Burwell v. Hobby Lobby Stores, Inc. greatly reduced the barriers to successful RFRA claims. Second, by lifting restrictions on political speech for many other types of organizations, Citizens United magnified the burden the electioneering prohibition imposes on religious organizations. The decision also rejected compelling state interests that might have previously shielded the law from invalidation. This Note is the first analysis of the electioneering prohibition’s vulnerability in this new legal climate. Despite these significant developments, this Note ultimately concludes that the electioneering prohibition can survive RFRA challenges because the prospect for widespread use of religious organizations as conduits for political activity undermines the values reflected in Establishment Clause jurisprudence.

ABSTRACTThis article examines the forces that shaped the responses of the urban commons to the Reformation in Augsburg. Developing work by Blickle and others, it considers the extent to which traditional communal ideals were reflected in measures to construct a system of ‘sacral corporatism’. An examination of the attitudes of guildsmen towards communal values and institutions shows variation in their views, even on such basic points as the identification and imposition of the ‘common good’. Case studies show how predominantly poor weavers were attracted to the call to enforce communal principles as a means of defending their status and incomes. To this end they welcomed evangelical teaching, for it provided scriptural and ethical endorsements of corporate action. In contrast, members of the butchers' guild, who were involved in a capital intensive occupation, resisted communal restraints on their freedom to trade and make profits. The butchers' opposition to the Reformation rested more on their rejection of ‘sacral corporatism’, as advocated by reformers in Augsburg, than on support for Catholicism. Augsburg shows the significance of communal values in the urban Reformation, but it demonstrates that these were neither static nor uniformly accepted. On the contrary they were themselves the subject of dispute.

The article critically examines the philosophy of neoliberalism. The author finds a wide destructive potential of neoliberalism for society and the state. The privatization promoted by the neoliberal ideology, the withdrawal of the state from the economic and social spheres, the rejection of protectionism have a negative impact on the development of the economy and on the standard of living of society. The economic freedom exalted by liberal philosophy makes it possible for speculative activity to develop. Ethical foundations are undermined by the substitution of personal responsibility for social protection. Liberal philosophy creates numerous myths, with the help of which an ideological defense of the growth of inequality and many other socially unacceptable results of the functioning of the liberal economic and political system is built. The article proves the mythological nature of liberal theses about free competition and equality of chances, about hard work as the key to success. The unreasonableness of pairing neoliberalism with democracy is postulated. Anti-democracy seems to be inherent in neoliberalism. The social disfunctionality of neoliberal reforms and their anti-national character are proved. The growth of inequality, the loss of sovereignty by states, the expansion of poverty, the development of the corporate sector (including socially irresponsible speculative capital) is a natural result of the functioning of the neoliberal project. This project is a methodology in the hands of transnational business for opening up the economies of sovereign states and enslaving societies. The growth of inequality in the world is associated with the policy of neoliberal reforms. The modern “postmodern economy” is characterized by virtualization, simulacrization, and financial speculation. In the article, the greatest attention is paid to the development of the speculative financial sector, which has become widespread due to the implementation of neoliberal policies. Financial speculation is considered as a socially harmful phenomenon, bearing its share of responsibility for the growth of inequality. Special attention in the article is paid to the recently expressed positions of analysts who have long stood on the ideological ground of defending neoliberalism. However, it is interesting that due to the disastrous results that this project brings to humanity, they have in some way changed their attitude towards it.

Introduction. The article investigates the conceptual problems of interaction of law and morality in the context of modern value and ideological realities. Expanding the space of freedom in a democratic legal development, the rapid nature of scientific and technological progress, comprehensive informatization of all spheres and spheres of public life, increasing social inequality and other crisis realities of today objectively require clarifi cation and rethinking issues of interaction and interconnection of different social regulators, in particular, law and moral, the rules of which regulate the greatest number of social relations. The aim of the article. The purpose of this article is to identify the main problems of interaction of law and morality in the context of the socio-cultural realities of today. Results. In our opinion, problems of interaction of law and morality in modern realities are due to the transformation of understanding of the essence and nature of social norms in general and, in particular, its moral component, which increasingly loses its transcendent, absolute origins, thus becoming more democratic, individualistic, capable of endless meaningful experiments. and the perception of many alternatives. Among the specifi c features of the moral life of modern democratic society in the scientifi c literature are rightly noted such features as moral pluralism, development of professional and corporate codes of ethics (institutionalization of morality), the division of morality by ethnicity, orientation of moral requirements to a certain external standard, which opposes the traditional moral call for unlimited human self-improvement in a Christian or religious context, as well as a utilitarian approach that involves decision-making based on the so-called logic of lesser evil. In the context of these aspects, it can be argued that not morality as a special socionormative phenomenon converges with law, but its understanding and interpretation within modern discourse is fully consistent with the legal sphere of public life, whose mission is to serve purely utilitarian needs and interests of society and citizens, their material well-being. At the same time, morality as an objective socio-normative phenomenon that constitutes the highest value-teleological priorities of spiritual improvement of the individual, on the contrary, is increasingly moving away from the content of modern law, which has lost the status of a stable and solid basis for enduring moral values in public life. The loss of clear criteria for distinguishing between good and evil, morally permissible and inadmissible actions of people, measuring human happiness only by the degree of possession of a person’s material goods, etc., has led not only to the fact that law can solve only some practical problems of local nature, but also to the fact that today the law actually plays the role of one of the important factors of moral regression of society. The latter is manifested, in particular, in the strengthening of the global trend of legal regulation of such morally shameful phenomena as euthanasia, same-sex marriage, prostitution, and so on. At the same time, the logic of providing legal guarantees for such phenomena is based, as a rule, on a purely economic calculation and the need to ensure the fullest possible freedom of individual choice. Conclusions. Modern realities of legal systems, based only on the idea of ensuring and protecting human rights and freedoms, determine the equivalence of all lifestyles, each individual choice, because there are no general universal grounds for determining which way of life brings more benefi ts and happiness, and which is less. This normative approach, due to which traditional moral values have undergone signifi cant revision and even destruction, deprives the individual of life of relationships with the relevant social whole, denies or at least negates the importance of fi nding the ideal of moral development of the individual, the goals of his spiritual activity. This article identifies the liberties of the Church and the City of London which were intended to be protected by Magna Carta from 1215. The liberties intended were a recognition of a form of autonomy for the Church and the City and have no connection with the individual freedoms that are identified for protection by modern human rights instruments. The clauses in Magna Carta conferring that autonomy are among the very few that have not been repealed, but they have not been asserted for hundreds of years. While the idea of church autonomy has resonance with the ideas of subsidiarity and sphere-sovereignty developed in Catholic and Calvinist social teaching from the late nineteenth century, recent American jurisprudence suggests that religious autonomy may be the best way to defend religious liberty in the future. This article suggests that, just as English kings were persuaded to provide towns, colonial endeavours and eventually corporate free enterprise with limited autonomy for a fee, so charters conferring limited autonomy on religious communities may provide a philosophical and practical basis from which to defend religious liberty in the future, even if the assertion of individual religious liberty becomes politically incorrect.

This paper explores the Naha Confucius Temple case, resolved by the Supreme Court in February 2021, in light of postwar decisions on Articles 20 and 89 of the Japanese constitution. Religion is a contested category in Japanese legislation, appearing both in the constitution and in laws regulating the freedoms and restrictions of legally registered religious organizations. While the organization behind the Confucius Temple in Naha was registered as a general corporate juridical person, the majority opinion sided with the plaintiffs’ argument that the free lease granted to the temple by the municipality of Naha constituted a violence of the ban on public sponsorship of religious institutions and activities. In order to reach their decision, the Supreme Court and the lower courts not only had to decide on whether Confucianism was a religion or not, but also on whether the organization behind the temple—a group dedicated to the history and memory of the Chinese immigrant community in Naha—should in fact be considered a religious organization. The outcome of the case is a good example of religion-making in courts of law, with a central institution of power employing notions of sui generis religion to regulate and define civil actors.

In the United States, the steadfast refusal of the Jehovah's Witnesses to perform some of the most basic rituals of citizenship has led champions of Americanism to cast them as unpatriotic and even seditious. The Watch Tower Society, the corporate body of the Witnesses, has responded to these accusations by presenting Witnesses as upstanding citizens, only ever departing from the letter of the law when there is a conflict between secular legal directive and scriptural injunction. This essay argues that the gulf between the popular perception of the Witnesses as poor citizens, particularly during the middle decades of the twentieth century, and the society's own representation of its members as assets to their communities highlights the contested and mutable nature of the label un-American. Furthermore, it argues that there is a paradox in the place of the Jehovah's Witnesses in modern American history: though operating beyond the pale of understood norms of citizenship, they have been fundamental to shaping the First Amendment freedoms enjoyed by all citizens. It seeks to contribute to two largely unwritten histories, namely the place of the Witnesses in American religious history, and the ever-changing yet resolutely politicized concept of the un-American.

Problem setting. Although modern humanity has proclaimed the universality of human dignity and desperately upholds this value, which is fully in harmony with freedom, equality and fraternity, the truth is that in reality it has not yet been able to go beyond the status of a citizen of the nation state in its legal and political conventions. . In this sense, a very important issue is the representation of the real situation around the categories of "universal citizenship", "human rights" and "globalization" in the midst of the geopolitical conflict in Latin America caused by the persecution of 21st century socialism. Paper objective. This critical essay aims to discuss the real significance of such political and legal categories as "universal citizenship", "human rights" and "globalization" in the midst of the geopolitical conflict that led to the persecution of 21st century socialism in Latin America. Methodology. The methodological field of the research uses documentary observation and dialectical hermeneutics, which help to compare and reconcile categories with different semantic contexts to reconstruct their true meaning. The technique of writing this research was the methodological procedure of the hermeneutic circle, which is a sequential analysis of numerous written documentary sources, combined in a kind of dialogic context with hidden messages that can be read between the lines, as well as interpretive theories and critical thinking. Paper main body. There is much in common between the contemporary political and philosophical programs of the Western cultural space, of which Latin Americans are a part, and the ideas of universal citizenship, globalization, and human rights in a spirit of deep militant universalism that function fully today not only as abstract theories at the disposal of peoples and nations who continue to work to improve their living conditions and strengthen their freedom to exist and act in a better world. As for the tradition of human rights as a modern expression of natural law, it dates back to ancient times and even dates back to the great religions, which in their own way developed and substantiated the idea of human dignity. The history of the Institute of Human Rights has a pronounced anthropocentric character and deserves to be expanded in accordance with the geopolitical realities of the modern world, in order to protect the indisputable value of all life forms affected by such phenomena as global warming and the associated greenhouse effect. economic growth that requires technological and industrial modernization. For its part, "globalization with a human face" means the ability to interconnect and enrich not only material and financial resources, due to the insatiability of international markets, but also the cycle of knowledge and people required by modern world democracies to strengthen their social and human capital. . In this context, the idea of global or universal citizenship, while seeming utopian, is of paramount importance as it broadens the political phenomenon of citizenship, which is vital to modern democracies or polyarchies, forgetting the tradition of history ruled by supreme forces and structures. Although, according to K. Popper, already the historicist concept assigned a fundamental role in building a reality conducive to the exercise of freedom, the citizen, conscious and active. Thus, if globalization is reduced purely to the internationalization of capital and selective human and technological resources solely in the interests of corporate elites and does not turn into a globalization of social welfare and dignity - a process in which universal citizenship would be a logical consequence, then partial globalization, which can do little to promote an open society in the 21st century. Conclusions of the research. The study concludes that if globalization is reduced to the internationalization of capital and individual human and technological resources for the benefit of the corporate elite and does not extend to the globalization of social welfare and dignity, where universal citizenship would be a logical consequence, such globalization is unlikely to contribute building an open society of the XXI century.

The article is devoted to the study of the nature of social obligation, its genesis and variants. It has been established that historically social obligations have arisen with the emergence of the beginnings of morality in human society and the awareness of human responsibility towards one another within their community. In the future, with the development of humanity and the diversity of social interactions, the institute of obligation was modified to take on new features. Thus, if in the early periods of existence of human society, it was impossible to speak about their belonging to the legal field, given the absence of any, at least minimal, fixation of this category at the normative level, then the development of law and legislation led to the emergence of legally binding obligations. It has been researched that social obligation means a socially recognized need for a certain behavior of a person, a kind of proper or useful, which is objectively conditioned by the needs of existence and development of other persons, social groups, nations, humanity. The article also analyzes that, depending on the particular nature of the emergence of specific social obligations, the characteristics of the subject that establishes them, and defines the guarantees of its implementation, distinguish varieties of social obligation. Allocated moral obligations, religious obligations, corporate, professional, legal and other obligations. Moreover, the author considers it inappropriate to completely differentiate between these phenomena, since all of them, as embodiments of certain socially necessary behavior, are interconnected and can be considered as a logical continuation of each other. In addition, it is emphasized that the substantive characteristic of a legal obligation as a special type of social obligation is a "legal necessity". The latter, on the one hand, indicates that the obligation exists and develops within the limits of the lawful and statutory conduct required by law. On the other hand, it expresses the content of the obligation and its inherent behavior. The "need" to disclose the obligation plays the same role that the "opportunity" plays in the concept of the rights and freedoms of the individual.

Abstract In recent years, a variety of corporate litigants, from houses of worship to for-profit enterprises, have brought religious liberty suits to the US Supreme Court. Interestingly, the metaphysical status of such litigants has been subject to intense debate by judges and commentators alike. Are these litigants corporate moral persons or mere aggregates of individuals? How, if at all, does their metaphysical status affect our assignment of corporate rights to religious freedom? While many have entertained such questions, others reject them as morally distracting. This article challenges that latter position. Drawing upon the natural law tradition, I argue that group ontology can be used in the assignment of corporate rights in a morally illuminating way. I point out the tradition’s distinctive ontology, which views groups primarily as social actions, subject to moral evaluation. I then discuss how this conception moves attention away from polarizing rights-based discourse towards measured consideration of what is morally right. Finally, I show how this ontology helps practical reasoning to discover a variety of (non-rights-based) reasons and means to protect religious freedoms as well as other moral stakes. Far from causing moral distraction, a natural law group ontology facilitates careful moral deliberation.

AbstractIf a firm signals that they identify on one end of the conservative-liberal spectrum, will political affiliation help predict how an investor will allocate their investment dollars to that firm? Using an experimental survey design with 1,494 participants, evidence was found that political affiliation does materially predict the allocation decisions of investors to firms engaged in corporate sociopolitical activism (CSA). More specifically, Democrats were more likely than Republicans to allocate investment dollars towards firms signaling a liberal political identity through their support of LGBT social issues and Planned Parenthood. By comparison, Republicans were more likely than Democrats to allocate investment dollars towards firms signaling a conservative political identity through their support of the Religious Freedom Institute. In addition, evidence was found that both Democrats and Republicans will under-allocate (relative to a control group) to firms that engage in CSA. Corporations should consider the potential costs from investor under-allocation for taking public stands on controversial partisan issues that favor some constituents at the expense of others.

Abstract Background Interventions in which individual older patients with multi-morbidity participate in formulating goals for their own care are being implemented in several countries. Successful service delivery requires normative integration by which values and goals for the intervention are shared between actors at macro-, meso- and micro-levels of health services. However, health services are influenced by multiple and different institutional logics, which are belief systems guiding actors’ cognitions and practices. This paper examines how distinct institutional logics materialize in justifications for patient participation within an intervention for patients with multi-morbidity, focusing on how variations in the institutional logics that prevail at different levels of health services affect vertical normative integration. Methods This qualitative case study of normative integration spans three levels of Norwegian health services. The macro-level includes a white paper and a guideline which initiated the intervention. The meso-level includes strategy plans and intervention tools developed locally in four municipalities. Finally, the micro-level includes four focus group discussions among 24 health professionals and direct observations of ten care-planning meetings between health professionals and patients. The content analysis draws on seven institutional logics: professional, market, family, community, religious, state and corporate. Results The particular institutional logics that justified patient participation varied between healthcare levels. Within the macro-level documents, seven logics justified patients’ freedom of choice and individualization of service delivery. At meso-level, the operationalization of the intervention into tools for clinical practice was dominated by a state logic valuing equal services for all patients and a medical professional logic in which patient participation meant deciding how to maintain patients’ physical abilities. At micro-level, these two logics were mixed with a corporate logic prioritizing cost-efficient service delivery. Conclusion Normative integration is challenging to achieve. The number of institutional logics in play was reduced downwards through the three levels, and the goals behind the intervention shifted from individualization to standardization. The study broadens our understanding of the dynamic between institutional logics and of how multiple sets of norms co-exist and guide action. Knowledge of mechanisms by which normative justifications are put into practice is important to achieve normative integration of patient participation interventions.

A randomised survey in Texas found that 22 per cent of the public identified themselves as consumers of New Age media. Despite widespread recognition of the ‘spiritual supermarket’ there has been little sustained analysis of the production of spiritual commodities and related issues of cultural property. This article presents a case study of the bestselling spiritual self-help book and DVD The Secret, which features various teachers and sacred wisdom traditions seen to hold the key to the meaning of life—but which has also been the subject of copyright disputes. Through this example the article examines ways informational commodities are produced by transforming freely available spiritual traditions into intellectual property for a contemporary market in self-help products. Two related tensions raised by this reconstruction are explored. The first is between cooperation and competition in the liberal New Age milieu where entrepreneurs present marginally differentiated goods and services side-by-side. In contrast with exclusionary organisation of religious doctrine, freedom to adapt the lingua franca of holistic spirituality allows for coefficiency among providers, but also new forms of ownership distinction, as exemplified by The Secret. The second tension is between these private property relations and the corporate cultural property of the custodians of knowledge traditions that are commodified. The Secret, as with much New Age syncretism and multiculturalism, depends upon particular processes of transvaluation that inscribe diversity as positive by rendering selected instantiations of it equivalent—in this case through universalising the therapeutic value of specific traditions have for modern life. Drawing in particular upon debates about New Age use of Indigenous Australian knowledges, the author questions how the reworking of wisdom into a commodity may bear upon the ethnocultural significance of sacred traditions and upon other attempts to fashion their roles in contemporary public spheres

In the summer of 1999, four ships carrying 599 Fujianese people arrived on the west coast of Canada. They survived a desperate and dangerous journey only for the Canadian Government to put them in prison. After numerous deportations, there are still about 40 of these people in Canadian prisons as of January 2001. They have been in jail for over a year and a half under mere suspicion of flight risk. About 24 people have been granted refugee status. Most people deported to China have been placed in Chinese prisons and fined. It is worth remembering that these migrants may have been undocumented but they are not "illegal" in that they have mobility rights. The Universal Declaration of Human Rights recognizes everyone's right to leave any country and to seek asylum. It can be argued that it is not the migrants who are illegal, but the unjust laws that criminalize their freedom of movement. In considering people's rights, we need to keep in mind not only the civil and political rights that the West tends to privilege, but equally important social and economic rights as well. As a local response to a global phenomenon, Direct Action Against Refugee Exploitation (DAARE) formed in Vancouver to support the rights of the Fujianese women, eleven of whom at the time of writing are still being held in the Burnaby Correctional Centre for Women (BCCW). In DAARE’s view, Immigration Canada's decision to detain all these people is based on a racialized group-profiling policy which violates basic human rights and ignores Canadian responsibility in the creation of the global economic and societal conditions which give rise to widespread migration. In light of the Canadian government's plans to implement even more punitive immigration legislation, DAARE endorses the Coalition for a Just Immigration and Refugee Policy's "Position Paper on Bill C31." They call for humanitarian review and release for the remaining Fujianese people. This review would include a few released refugee claimants who are still in Canada, children, women who were past victims of family planning, people facing religious persecution and, of course, those who are still in prison after 18 months and who have never been charged with any crime. Suspicion of flight risk is not a valid reason to incarcerate people for such a long time. Who Is a Migrant? The lines between "voluntary" and "forced" migration are no longer adequate to explain the complexities of population movements today. Motives for forced displacement include political, economic, social and environmental factors. This spectrum runs from the immediate threats to life, safety and freedom due to war or persecution, to situations where economic conditions make the prospects of survival marginal and non-existent. (Moussa 2000). Terms like "economic migrant" and "bogus refugee" have been used in the media to discredit migrants such as the Fujianese and to foster hostility against them. This scapegoating process oversimplifies the situation, for all refugees and all migrants are entitled to the basic respect due all human beings as enshrined in the UN Declaration of Human Rights. There can be multiple reasons for an individual to migrate—ranging from family reunification to economic pressures to personal survival; to fear of government corruption and of political persecution, to name just a few. The reduction of everything to merely the economic does not allow one to understand why migration is occurring and likely to increase in the future. Most immigrants to Canada could also be described as economic migrants. Conrad Black is an economic migrant. The privileging of rich migrants over poor ones romanticizes globalization as corporate progress and ignores the immense human suffering it entails for the majority of the world's population as the gap between the wealthy and the poor rapidly increases. Hundreds of years ago, when migrants came to this aboriginal territory we now call Canada, they came in order to survive—in short, they too were "economic migrants." Many of those migrants who came from Europe would not qualify to enter Canada today under its current immigration admissions guidelines. Indeed, over 50% of Canadians would not be able to independently immigrate to Canada given its current elitist restrictions. One of the major reasons for an increase in migration is the destruction of rural economies in Asia and elsewhere in the world. Millions of people have been displaced by changes in agriculture that separate people from the land. These waves of internal migration also result in the movement of peoples across national borders in order to survive. Chinese provinces such as Fujian and Guangdong, whose people have a long history of overseas travel, are particularly common sources of out-migration. In discussing migration, we need to be wary of how we can inadvertently reinforce the colonization of First Nations people unless we consciously work against that by actively supporting aboriginal self-determination. For example, some First Nations people have been accused of "smuggling" people across borders—this subjects them to the same process of criminalization which the migrants have experienced, and ignores the sovereign rights of First Nations people. We need ways of relating to one another which do not reenact domination, but which work in solidarity with First Nations' struggles. This requires an understanding of the ways in which racism, colonialism, classism, and other tactics through which "dividing and conquering" take place. For those of us who are first, second, third, fourth, fifth generation migrants to this land, our survival and liberation are intimately connected to that of aboriginal people. History Repeating Itself? The arrival of the Fujianese people met with a racist media hysteria reminiscent of earlier episodes of Canadian history. Front page newspaper headlines such as "Go Home" increased hostility against these people. In Victoria, people were offering to adopt the dog on one of the ships at the same time that they were calling to deport the Chinese. From the corporate media accounts of the situation, one would think that most Canadians did not care about the dangerous voyage these people had endured, a voyage during which two people from the second ship died. Accusations that people were trying to enter the country "illegally" overlooked how historically, the Chinese, like other people of colour, have had to find ways to compensate for racist and classist biases in Canada's immigration system. For example, from 1960 to 1973, Canada granted amnesty to over 12,000 "paper sons," that is, people who had immigrated under names other than their own. The granting of "legal" status to the "paper sons" who arrived before 1960 finally recognized that Canada's legislation had unfairly excluded Chinese people for decades. From 1923 to 1947, Canada's Chinese Exclusion Act had basically prevented Chinese people from entering this country. The xenophobic attitudes that gave rise to the Chinese Exclusion Act and the head tax occurred within a colonial context that privileged British migrants. Today, colonialism may no longer be as rhetorically attached to the British empire, but its patterns—particularly the globally inequitable distribution of wealth and resources—continue to accelerate through the mechanism of transnational corporations, for example. As Helene Moussa has pointed out, "the interconnections of globalisation with racist and colonialist ideology are only too clear when all evidence shows that globalisation '¼ legitimise[s] and sustain[s] an international system that tolerates an unbelievable divide not only between the North and the South but also inside them'" (2000). Moreover, according to the United Nations Development Programme, the income gap between people in the world's wealthiest nations and the poorest nations has shifted from 30:1 in 1960 to 60:1 in 1990 and to 74:1 in 1997. (Moussa 2000) As capital or electronic money moves across borders faster than ever before in what some have called the casino economy (Mander and Goldsmith), change and instability are rapidly increasing for the majority of the world's population. People are justifiably anxious about their well-being in the face of growing transnational corporate power; however, "protecting" national borders through enforcement and detention of displaced people is a form of reactive, violent, and often racist, nationalism which scapegoats the vulnerable without truly addressing the root causes of instability and migration. In short, reactive nationalism is ineffective in safe-guarding people's survival. Asserting solidarity with those who are most immediately displaced and impoverished by globalization is strategically a better way to work towards our common survival. Substantive freedom requires equitable economic relations; that is, fairly shared wealth. Canadian Response Abilities The Canadian government should take responsibility for its role in creating the conditions that displace people and force them to migrate within their countries and across borders. As a major sponsor of efforts to privatize economies and undertake environmentally devastating projects such as hydro-electric dams, Canada has played a significant role in the creation of an unemployed "floating population" in China which is estimated to reach 200 million people this year. Punitive tactics will not stop the movement of people, who migrate to survive. According to Peter Kwong, "The well-publicized Chinese government's market reforms have practically eliminated all labor laws, labour benefits and protections. In the "free enterprise zones" workers live virtually on the factory floor, laboring fourteen hours a day for a mere two dollars—that is, about 20 cents an hour" (136). As Sunera Thobani has phrased it, "What makes it alright for us to buy a t-shirt on the streets of Vancouver for $3, which was made in China, then stand up all outraged as Canadian citizens when the woman who made that t-shirt tries to come here and live with us on a basis of equality?" Canada should respond to the urgent situations which cause people to move—not only on the grounds upon which Convention refugees were defined in 1949 (race, religion, nationality, social group, political opinion) which continue to be valid—but also to strengthen Canada's system to include a contemporary understanding that all people have basic economic and environmental survival rights. Some migrants have lives that fit into the narrow definition of a UN Convention refugee and some may not. Those who do not fit this definition have nonetheless urgent needs that deserve attention. The Canadian Centre for Policy Alternatives has pointed out that there are at least 18 million people working in 124 export zones in China. A living wage in China is estimated to be 87 cents per hour. Canadians benefit from these conditions of cheap labour, yet when the producers of these goods come to our shores, we hypocritically disavow any relationship with them. Responsibility in this context need not refer so much to some stern sense of duty, obligation or altruism as to a full "response"—intellectual, emotional, physical, and spiritual—that such a situation provokes in relations between those who "benefit"—materially at least—from such a system and those who do not. IntroductionThe existential question today is not whether to be or not to be, but how one can become what one truly is. (Golomb 200)In contemporary Western culture the ideal of living authentically, of being “true to yourself,” is ubiquitous. Authenticity is “taken for granted” as an absolute value in a multitude of areas, from music, to travel to identity (Lindholm 1). A core component of authentic selfhood is to find an occupation that is a “passion:” work that is “really you.” This article draws on recent qualitative interviews with Australians from a range of occupations about work, identity and meaning (James). It will demonstrate that for these contemporary individuals, occupation is often closely linked to perceptions of authentic selfhood. I begin by overviewing the significance and presence of authenticity as a value in contemporary culture through discussions of reality television and self-help literature focussed on careers. This is followed by a discussion of sociological theories of authenticity, drawing out the connections between the authentic self, modernity and work. The final section uses examples from the interviews to argue that the ideal of work being an extension of the authentic self is compelling because in providing direction and purpose, it helps the individual avoid anomie, disenchantment and other modern malaises (Taylor).The Authentic Self and Career Guidance in Contemporary Popular CultureThe prevalence of authenticity in contemporary Western popular culture can be seen in reality television programs like Master Chef (a cooking competition) and The Voice (a singing competition). Generally, contestants take part in the show in order to “follow their dreams” and pursue the career they feel they were “destined” for. When elimination is immanent, those at risk of departure are given one last chance to tell the judges what being in the competition means to them. This usually takes the form of a tearful monologue in which the contestant explains that the past few weeks have been the best of their life, that they finally feel “alive” and that they have found their “passion.” In these shows, finding work that is “really you”—that is an extension of your authentic-self—is portrayed as being a fundamental component of fulfillment and self-actualization.The same message is delivered in self-help media and texts. Since the 1970s, “finding your passion” and “finding yourself” have been popular subjects for the genre. The best known of these books is perhaps Richard Bolles’s What Color is Your Parachute?: a job-hunting manual aimed primarily at people looking for a career change. First published in 1970, a new edition has been released every year and there are over 10 million copies in print. In 1995 it was included in the Library of Congress’s Center for the Book’s 25 Books That Have Shaped Readers’ Lives, placing Bolles in the company of Cervantes and Tolstoy (Bolles).Bolles’s book and similar career guidance titles generally follow a pattern of providing exercises for the reader to help them discover the “real you,” which then becomes the basis for choosing the “right” occupation, or as Bolles puts it, “first deciding who you are before deciding the kind of work you want to pursue.” Another best-selling self-help writer is Phil McGraw or “Dr. Phil,” better known for his television program than his books. In his Self Matters—Creating Your Life from the Inside Out, McGraw begins bytelling the story of his own search for his authentic “passion.” Before moving into television, McGraw spent ten years working as a practicing psychiatrist. He recalls:So much of what I did—while totally okay if it had been what I had a passion for—was as unnatural for me as it would be for a dog. It didn’t come from the heart. It wasn’t something that sprang from who I really was ... I wasn’t doing what was meaningful for me. I wasn’t doing what I was good at and therefore was not pursuing my mission in life, my purpose for being here … You and everyone else has a mission, a purpose in life that cannot be denied if you are to live fully. If you have no purpose, you have no passion. If you have no passion, you have sold yourself out (7–12).McGraw connects living authentically with living meaningfully. Working in an occupation that is in accordance with the authentic self gives one’s life purpose. This is the same message Oprah Winfrey chose to deliver in the final episode of the The Oprah Winfrey Show, which was watched by more than 16 million viewers in the U.S. alone. Rather than following the usual pattern of the show and interview celebrity guests, Winfrey chose to talk directly to her viewers about what matters in life:Everybody has a calling, and your real job in life is to figure out what that is and get about the business of doing it. Every time we have seen a person on this stage who is a success in their life, they spoke of the job, and they spoke of the juice that they receive from doing what they knew they were meant to be doing [...] Because that is what a calling is. It lights you up and it lets you know that you are exactly where you're supposed to be, doing exactly what you're supposed to be doing. And that is what I want for all of you and hope that you will take from this show. To live from the heart of yourself.Like McGraw, Winfrey draws a link between living authentically—living “from the heart”—and finding a “calling.” The message here is that the person whose career is in accordance with their authentic self can live with certainty, direction and purpose. Authenticity may act as a buffer against the anomie and disenchantment that arguably plague individuals in late modernity (Elliott & du Gay).Disenchantment, Modernity and Authenticity For many sociologists, most famously Max Weber, finding something that gives life purpose is the great challenge for individuals in the modern West. In a disenchanted society, without religion or other “mysterious incalculable forces” to provide direction, individuals may struggle to work out what they should do with their lives (149). For Weber the answer is to find your calling. Each individual must discover the “demon who holds the fibers of his very life” and obey its demands (156).Following Weber, John Carroll has argued that in modern secular societies, individuals must draw on their inner resources to find answers to life’s “fundamental questions” (Ego 3–4). As Carroll stresses, it is not that the religious impulse has disappeared from contemporary society, but it is expressed in new ways. Individuals still yearn for a sense of purpose but they are “more likely to pursue their quests for meaning on their own, in experimental ways and with their main resource being their ontological qualities” (Carroll, Beauty 221).Other Australian academics, like Gary Bouma and David Tacey, argue that rather than a decline in religiosity in Australia, what we are seeing is a change in the way people pursue the spiritual. Tacey suggests that while many Australians may “slink away” from the idea of God as something external to our lives, they may find more resonance with a conception of God as a “core dimension” of the person (167). Contemporary Australians continue to yearn for guidance, but they are more likely to look within to find it.There is a clear link between this process of turning inward to pursue the spiritual, the prevalence of authenticity in contemporary Western culture, and modernity. With the breakdown of traditional structures, individuals become more “free to self-create” (Bauman, Identity 3). As Charles Lindholm describes it: “The inclination toward a spontaneous mode of expressive self-revelation correlates with the collapse of reliable and sacralised institutional frameworks that once offered meaning and succour” (65–66).For Charles Taylor, the origins of this “massive subjective turn of modern culture” (26) lie in the 18th-century romantic period with the idea that each individual has an intuitive moral sense. To determine what is right, the individual must be in touch with their “inner voice” and act in accordance with it. It is in this notion that Taylor identifies the background to the belief, which is so prominent today, that “There is a certain way of being human that is my way. I am called upon to live my life in this way, and not in imitation of anyone else’s” (28–29). Lindholm points to Rousseau as the “inventor” of this ideal, with his revelatory Confessions becoming “the harbinger of a new ideal in which exploring and revealing one’s essential nature was taken as an absolute good” (8). According to Rousseau, social norms suppress the individual’s true nature, and so it is only possible for one to be authentic if they break these chains and act in accordance with their inner depths. For employees in today’s service-oriented knowledge economy, there are significant risks involved in following Rousseau’s advice and expressing one’s “true feelings.” As many researchers have noted, in the new capitalism, workers are increasingly required to regulate their emotions and present themselves as calm, agreeable and above all positive (Hochschild; Sennett; Ehrenreich). To offer criticism or express frustration, to drop the “mask of cooperativeness” (Sennett 112), may mean risking one’s employment.Nevertheless, while it is arguably becoming more difficult to express authentic feeling at work, for contemporary workers, choice of occupation is still often closely linked to perceptions of authentic selfhood. In fact, in a time of increasingly fragmented careers and short-term, episodic work, it becomes more necessary to create a meaningful narrative to link numerous and varied jobs to a core sense of self. As Richard Sennett argues, today’s flexible employees—frequently moving from one workplace to the next—are at risk of “drift:” a sensation of aimless movement (30). To counter this, individuals must create a convincing story that provides a rationale for career changes and can thereby “form their characters into sustained narratives” (31).In the next section, drawing on recent empirical research, I argue that linking authentic selfhood to work provides individuals with a way to make sense of the trajectory of their work lives and to accept change. Today’s employees are able to interpret even the most unexpected career changes as a beneficial occurrence—something that was “meant to be”—by rationalising that such changes are part of a process of finding work that is an expression of the authentic self.The Authentic Self at Work: Being True to Your EssenceThe following discussion focuses on how authenticity as an ideal influences individuals’s work identity and career aspirations. It draws examples from recent qualitative interviews with Australian workers from a range of occupations (James 2012). A number of interviewees described a search for an occupation that was authentically “them,” a task that was well-suited to their capabilities and came “naturally:”I have a feeling that I was sort of a natural teacher. (Teacher, 60)Medical is what I like, that’s me. (Paramedic, 49)I found my thing, I stick to it. (Farrier, 27) These beliefs are quite clearly influenced by the idea of vocation, in that there is a particular task the individual is most suited to, but they do not invoke the sense of duty that a religious “calling” entails. Often, the interviewees had discovered the occupation that was “really them” by working in other jobs that were not their “true passion.” Realising that performing a particular role felt inauthentic helped them to define their authentic self and encouraged them to pursue more fulfilling work. This process often required experimentation, since “one knows what one is only after realising what one is not” (Golomb 201).For instance, Olivia, a 33-year old lawyer had begun her career in a corporate law firm. She had never felt comfortable in the corporate environment: “I always thought, ‘They know I don’t belong here’.” Her performance at work felt inauthentic: “I was never good at smiling and saying yes.” This experience led her to move into human rights, which she found more fulfilling. Similarly Hazel, a 50 year-old social worker, had started her career in what she described as “boring administration jobs.” Although she had “always wanted” to work in the “caring sector” her family’s expectations and her low self-confidence had stopped her from applying for university. When she finally quit the administration work and began to study it was liberating: “a weight had come out off my shoulders.” In her occupation as a social worker she felt that her work fitted with her authentic self: “the kind of person I am,” and for the first time in her life she looked forward to going to work. Both of these women, and many of the other interviewees, rationalised their decision to work in a particular field by appealing to narratives of authentic selfhood.Similarly, in explaining why they enjoyed their work, a number of interviewees looked back to their childhood for signs of what was “meant to be.” For instance, Tim, a 27 year-old farrier, justified his work with horses: “Mum came from a farming background, every school holidays I was up there…I followed my grandpa around like a little dog, annoyed and pestered him and asked him ‘Why’ and How?’ I’ve always been like that … So I think from an early age I was destined to do something like this.” Ken, a 50 year-old electrician, had a similar explanation for his choice of occupation: “Even as a little kid I was always mucking around with batteries and getting lights to work and things like that, so I think it was just a natural progression.”This tendency to associate childhood interests with authentic selfhood is perhaps due to the belief that childhood is a time of innocence and freedom, where the individual had not yet been moulded by society. As Duschinsky argues, childhood is often connected with an “originary natural essence.” We are close here to Rousseau’s “sentiment of being,” or its contemporary manifestation the “real you.” Of course, the idea that the child is free from external influence is problematised by ideas of socialisation. From birth the infant learns by copying “significant others” and self-conception is formed through interaction (Cooley; Mead). Therefore, from the very beginning, an individual’s interests, dispositions and tastes are influenced by family and culture.Shane, a 29 year-old real estate agent, had resisted working in property because it was the family business and he “didn’t want to be as boring as to follow in Dad’s footsteps.” He saw himself as “academic” and “creative” and for a number of years worked as a writer. Eventually though he decided that writing was not his calling: it was “not actually me … I categorise myself as someone who has the ability to write but not naturally.” When Shane began working in real-estate however, it felt almost automatic. Like the other members of his family he had the right skills and traits to thrive in the business and was immediately successful. Interestingly, Shane’s conception of his authenticity includes both a belief in an essential, pre-social “true” self and at the same time an understanding of the importance of the influence of family in the formation of the self.Regardless of whether the idea of a natural, inner-essence discernable in childhood pastimes can be disproven, it is clear that the understanding of authentic selfhood as an “immediate expression of our essence” continues to influence how individuals conceive of their work identities. However, at the same time, the interviewees’ accounts of authenticity also acknowledged the role of parents in influencing traits and dispositions. In these narratives of the self, authenticity encompasses opposing understandings of childhood as being both free from social influences and highly influenced by primary agents of socialisation. That individuals are willing to do the necessary mental and emotional work to maintain these contradictory beliefs suggests that there is a strong incentive to frame work identity as an expression of authentic selfhood.Authenticity Provides PurposeThe great benefit of being able to convincingly rationalise one’s work as a manifestation of the true self is that it gives the individual direction and purpose. Work then provides answers to Carroll’s fundamental questions: “who am I?” and “What should I do with my life?” A number of the interviewees recalled their attempts to secure a sense of purpose by linking their current occupation to their inner essence. As Greg, a 36-year-old fitness consultant described it:You just gotta think ‘What do you really wanna do, what makes you happy, what are you about?’ … I guess the strengthening and conditioning work, the fitness, has been the constant right the way through. It’s probably the core of what I’ve done over the years, seeing individuals and teams get fit. It’s what I do. That’s my role, if you put it in a nutshell. That’s what I’m about … I was sort of floating around a little bit … I need to go ‘This is what I am.’ By identifying his authentic self and linking it to his work, Greg was able to make sense of his past. He had once been a professional runner and after an injury was forced to redefine himself. He now rationalised that his ability to run had led him into the fitness field: You look at what is your life mission and basically what are you out here for … with athletics it’s allowed me to deal with any sport, made me flexible in my career … if I was, therefore born to run? Yeah, quite possibly, there had to be a reason. Like many of the interviewees, Greg had been forced to change his plans, but he was able to rationalise that this change was positive by forming a narrative that connected both his current and previous occupations to his perception of his authentic self. As Sennett describes it, he is able to from his character into a “sustained narrative” (31). Similarly, Trish, a 42 year-old retail coordinator, connected both her work as a chef and her job in a hardware store back to her sense of authentic self. Both occupations, she thought, were “down and dirty” and she linked this to her family “roots” and her identity as a “country girl.” In interpreting these two substantially different occupations as an expression of her true self, Trish is able to create a narrative in which unexpected career changes are as seen as something beneficial that was “meant to be.” These accounts of career trajectories suggest that linking authenticity to work identity is a strategy individuals employ to cope with the disorienting effects of fragmented work lives. Even jobs that are unfulfilling and feel inauthentic can be made meaningful by interpreting them as necessary steps leading towards the discovery of one’s “ true passion”. This is quite different to the ideal of a life-long calling in one occupation, which as Bauman has noted, has become a “privilege of the few” in late-modernity (Work 34). In an era of insecure and fragmented work, the narrative of an authentic self becomes particularly appealing as it allows the individual to create a meaningful work-narrative that can accommodate the numerous twists and turns of contemporary “liquid” existence (Bauman, Identity 5) and avoid “drift” (Sennett). Conclusion Drawing on qualitative research, this paper has analysed the connections between authenticity, work and modern selfhood. I have shown that in an era of flexible and fragmented working lives, work-identities are often closely tied to understandings of authentic selfhood. Interpreting particular kinds of work as being expressions of the authentic self provides individuals with a sense of purpose and in some cases assists them in coming to terms with unexpected career changes. A meaningful career narrative acts as a buffer against disorientation, disenchantment and anomie. It is therefore no wonder that authentic selfhood is such a prominent theme in reality television, self-help and other forms of popular culture, since it is taps into an existential need for a sense of purpose that becomes increasingly elusive in late-modernity. It is clear from the accounts presented in this paper that the pursuit of authenticity is not merely a narcissistic endeavor, and is employed by individuals to work through fundamental existential questions. Future work in this area should continue to make use of empirical research to add depth and complexity to theoretical accounts of authentic selfhood. Over time, many groups have sought to offer alternatives to the dominant culture of the day; for example, the civil-rights movements, antiwar protests, and environmental activism of the 1960s and 1970s. Not all groupings however can be considered countercultural. Roberts makes a distinction between group culture where cultural patterns only influence part of one’s life, or for a limited period of time; and countercultures that are more wholistic, affecting all of life. An essential element in defining a counterculture is that it has a value-conflict with the dominant society (Yinger), and that it demonstrates viability over time: long enough to pass on the values to the next generation (Roberts). Each society has images of what it means to be a good citizen. These images are driven by ideology and communicated through media channels, educational values and government legislation. Ideologies are not neutral and compete for the “common sense” of citizens; seeking to shape desires and allegiance to a particular way of life. A way of life is expressed in the everyday practices, or routines and choices that make up an ordinary day, the sum of which express the values of individuals and communities. A number of groups or movements have sought to counter the values and practices of dominant cultures only to find themselves absorbed into it. For example, the surfing magazine Tracks was an Australian countercultural text that chronicled the authentic surfing lifestyle of the 1970s. As surfing became big business, the same magazine was transformed into a glossy lifestyle publication. The surfing lifestyle had become part of the expanding field of consumption and Tracks had become one more tool to promote it (Henderson). As the “counter” is absorbed into the dominant consumer culture, new ways to engage the hegemonic culture emerge that offer fresh possibilities of living and engaging in contemporary society. Positioning I hold to a critical postmodern perspective of consumption. That is, while I acknowledge some of the pleasures of consumption, I see a dominant posture of detachment as a result of consumer cultures increased distance from production, producers and the products we buy (Cavanaugh; Sandlin, Kahn, Darts and Tavin). The market is a powerful educator of individuals (Kincheloe; Steinberg), but it is not the only educator. Families, schools, churches and other interest groups also seek to educate, or shape, individuals. These competing influences do not however hold equal power. In many instances the families, schools, churches and interest groups have uncritically adopted the dominant ideology of the market and so reinforce the values of consumerism; such is its hegemonic power. I hold that individuals, and more importantly communities, have some agency to consume in alternative ways that give rise to the formation of different identities. I see critical practices as important in the awareness raising, or awakeness, and shaping of an individual and a community (Freire; Rautins and Ibrahim). Contemporary Cultures Consumption has become the organizing principle of many contemporary cultures (Hoechsmann). The message that to be a good citizen is to be a good consumer is pervasive and promoted as key to economic growth and the remedy to lift countries out of recession. This message of consumption falls on fertile ground with the development of consumerism, or consumer culture. Smart (5) sees this expressed as a way of life that is “perpetually preoccupied with the pursuit, possession, rapid displacement, and replacement of a seemingly inexhaustible supply of things.” These “things” have increasingly become luxury goods and services as opposed to the satisfaction of basic needs and wants (de Geus). Contemporary Alternatives There are examples of contemporary alternatives that open spaces for people to imagine that “another world is possible.” Sandlin, Kahn, Darts and Tavin (102, 103) call upon educators to “critically analyze what it might mean to resist a consumer society predicated on the normalization of overconsumption” and to “celebrate the creative and critical agency of all those who resist and interrogate the hegemony of multinational companies/industries.” A number of examples are worth celebrating and critically analysing to offer input in the engagement with the dominant culture of consumption. The examples of the Adbusters Media Foundation, Bill Talen’s work as a political-theatre activist, and the voluntary simplicity movement will be briefly examined before exploring the contribution of monasticism. The Adbusters Media Foundation produces a glossy bimonthly publication and website that seeks to unmask the destructive power of global corporations. Through the use of cultural resistance techniques such as “culture jamming,” Adbusters remix advertisements to catch the reader by surprise, to make the taken for granted problematic, and to open them to the possibility of an alternative view of reality. These “subvertisements” offer the opportunity for detournement; a turning around or a change in perspective (Darts; Sandlin and Callahan). As people get involved in “culture jamming” they become producers of artifacts and not just consumers of them. The work of Adbusters uses the tools of the media saturated consumer culture to critique that very culture (Rumbo). Advertising performs an ideological function within a consumer culture that addresses people as individual private consumers rather than citizens concerned for the public good (Scatamburlo-D’Annibale). Given the ubiquity of advertising, individuals become ambivalent to its messages but still soak in the dominant narrative. The very form of resistance reinforces the culture of the individualistic citizen as consumer. While it might be seen that the “culture jamming” artifacts of the Adbusters type might not have substantial effect on the broader public, it does provide an accessible means of resistive action for the individual (Haiven). Bill Talen is a political-theatre activist who plays the Southern evangelical preacher Reverend Billy as leader of the Church of Stop Shopping. The Reverend stages “retail interventions” or performances in public spaces and retail stores as an act of “culture jamming”. Reverend Billy uses humour, music, art and theatre in his “services” to create strangeness, discomfort or ambiguity in the lives of the public. In doing so he calls people into transitional spaces where what was normal is disrupted and they are free to imagine differently. This disruption that causes a movement into the unknown is a central pedagogical strategy that seeks to encourage people to question their taken for granted understandings of life (Littler; Sandlin, Learning). Reverend Billy and the Church of Stop Shopping offer a fuller bodied experience of “culture jamming” that engages both the body and the emotions. The act of creating culture together is what fosters a sense of community amongst culture jammers (Sandlin, Popular culture). And yet Reverend Billy and the Church of Stop Shopping appear not to be focused for their own good in that they have formed a number of coalitions with other organisations to work on campaigns that oppose global corporations and the influence of consumerism’s ideology on everyday life. Reverend Billy not only creates disruption in people’s relationship with consumption, he also provides an alternative place to belong. The voluntary simplicity movement involves a growing number of people who choose to limit their incomes and consumption because of new priorities in life. Those involved call into question the dominant cultures view of the “good life” in favour of a less materialistic lifestyle that is more “personally fulfilling, spiritually enlightening, socially beneficial, and environmentally sustainable” (Johnson 527). Grigsby’s research (qtd. in Johnson) found that participants were involved in forming their own identities through their lifestyle choices. The voluntary simplicity movement, it appears, is a niche for those who understand consumption from a postmodern perspective and participate in alternative lifestyle practices. Sandlin (Complicated) sees the formation of collective identity as crucial to a movement’s ability to effectively engage in external education. A shared vision, or telos, is central to that forming of collective identity. However, the voluntary simplicity movement is focused primarily on individual lifestyle changes, thus making it ineffectual as a collective to challenge dominant ideologies or to engage in external education to that end. Each of the examples above provides some insight into a considered engagement with the dominant culture: the creation of Adbuster like “culture jamming” artifacts provides an accessible means of engagement for the individual; Bill Talen’s interventions show an appreciation of the importance of community in supporting countercultural choices; and the voluntary simplicity movement promotes a “whole of life” approach to countercultural engagement. However, when comparing the above examples with Roberts’s definition of a counterculture they appear to be lacking. Roberts (121) holds that “the term counter-culture might best be reserved for groups which are not just a reaction formation to the dominant society, but which have a supporting ideology that allows them to have a relatively self-sufficient system of action.” The remainder of this article examines monasticism as an example of a counter-culture that offers an alternative model of “the good-life” based on a clear ideology and a fifteen hundred year history. Considering Monasticism As seen above, the work of countering the dominant ideology is not without its difficulties. bell hooks found that offering an education that enhances students’ journey to wholeness went against the anti-intellectualism of the current education system. What enabled her to stand within and resist the oppressive dominant culture, and offer alternatives, was the sustaining power of spirituality in her life, the basis of her hope. Tolliver and Tisdell appreciate that spirituality can be an elusive term, but that amongst the definitions offered there are commonalities. These are that: spirituality is about a connection to what is referred to by various names, such as the Life Force, God, a higher power or purpose, Great Spirit, or Buddha Nature. It is about meaning making and a sense of wholeness, healing and the interconnectedness of all things. […] As many have noted, those who value spirituality generally believe that it is possible for learners to come to a greater understanding of their core essence through transformative learning experiences that help them reclaim their authenticity. (Tolliver and Tisdell 38) There is a growing interest in the age-old traditions of Christian monasticism as a means of addressing the challenges of contemporary life (Adams; Jamison). When the BBC broadcast the television series The Monastery in 2005, millions of viewers tuned in to follow the way five ordinary men were affected by the experience of living in a monastery for forty days and nights. Similarly in Australia in 2007, the ABC broadcast the television series The Abbey that followed the experiences of five ordinary women enclosed for 33 days and nights in the space and routines of the Benedictine nuns at Jamberoo Abbey. It was when watching these television series that I was led to consider monasticism as an example of cultural resistance, and to ponder the contribution it might make to the conversation around counter-cultures. As an observer, I find something compelling about monasticism, however I am aware of the possibility of romanticising it as a way of life. The tensions, difficulties and struggles represented in the television series help to temper that. Benedictine spirituality is the foundation for life at the Worth Abbey (The Monastery) and the Jamberoo Abbey (The Abbey). The essential dynamic that underlies this spirituality is a shaping of life according to the Bible and the guidelines set out in the sixth century Rule of Benedict. Monastic life in a Benedictine abbey is marked by certain routines, or rhythms, that are designed to help the community better love God, self and one another (Benedict, chapter 4). “Listen” is the first word in the Rule of Benedict and is closely linked to silence (Benedict, chapter 6). As a key part of monastic life, silence gives the monastics the freedom and space to listen to God, themselves, one another, and the world around them. As Adams (18) points out, “the journey to knowing God must include the discipline of coming to know yourself, and that risky journey invariably starts in silence.” The rhythm of monastic life therefore includes times in the day for silence and solitude to facilitate listening and self-reflection. For Benedict, distractions in the head are actually noises inside the heart: the result of human desires and preoccupations. Silence, and the reflection that occurs within it, allows the monastic to listen for, and see their own relationship to, competing ideologies. This everyday practice of listening might be explained as paying attention to what is noticed, reflecting on it and the internal response to it. In this way listening is an active engagement with the words read (Irvine), the stories heard, the conversations had, and the objects used. Hoffman (200) observes that this practice of attentive listening is evident in decision making within the monastery. Seen in this way, silence acts as a critical practice counter to the educative agenda of consumerism. Physical work is a basic part of monastic life. All members of the community are expected to share the load so that there is no elitism, no avoiding work. This work is not to be seen as a burden but an outlet for creativity (Benedict, chapter 57). By being involved in the production of goods or the growing of crops for the community and others, monastics embody practices that resist the individual consumer identity that consumerism seeks to create. Monastics also come to appreciate the work involved in the products they create and so become more appreciative of, and place greater value on them. Material things are not privately owned but are to be seen as on loan so that they are treated with a level of gratitude and care (Benedict, chapter 32). This attitude of not taking things for granted actually increases the enjoyment and appreciation of them (De Waal). De Waal likens this attitude to the respect shown towards people and things at the Japanese tea ceremony. She says that “here in the most simple and yet profound ceremony there is time to gaze at things, to enjoy them, and to allow them to reveal themselves as they truly are” (87). Such a listening to what products truly are in the dominant consumer culture might reveal chairs made from the denuded forests that destroy habitats, or shoes made with child labour in unsafe conditions. The monastic involvement in work and their resulting handling of material things is a critical practice counter to the ideology of consumerism and the attitude towards products flooding markets today. Community is central to monastic life (Veilleux). Through vows, the monastic commits to life in a particular place with particular people. The commitment to stability means that when conflict arises or disagreements occur they need to be worked out because there is no running away. Because a commitment to working things out requires attention to what is real, monastic community acts as a counter of all that is not real. The creation of false need, the promise of fulfilment, and the creation of identity around consumption can be viewed through the same commitment to reality. This external stability is a reflection of inner stability marked by a unity and coherence of purpose and life (De Waal). A monastic community is formed around a shared telos that gives it a collective identity. While people are welcomed as guests into the community with Benedictine hospitality, the journey to becoming a member is intentionally difficult (Benedict, chapter 58). The importance of committing to community and the sharing of the collective telos is not a rushed decision. The stability and permanence of monastic commitment to community is a counter to the perpetual chasing and replacing of other goods and experiences that is a part of consumerism. The deliberate attention to practices that form a rhythm of life involving the whole person shows that monastic communities are intentional in their own formation. Prayer and spiritual reading are key parts of monastic life that demonstrate that spirituality is central in the formation of individuals and communities (Benedict, prologue). The formation is aligned to a particular ideology that values humanity as being made in the image of God and therefore the need to focus on the connection with God. A holistic humanity addresses issues and development of the mind, body and spirit. Examining Ideology The television series The Monastery and The Abbey demonstrate that when guests enter a monastic community they are able to experience an alternative model of “the good life”. If, as Roberts suggests, a counter-culture looks to reform society by providing an alternative model, then change is based upon seeing the alternative. The guests in the monastic community are involved in discussions that make explicit the monastic ideology and how it shapes the countercultural values and practices. In doing so, the guests are invited to listen to, or examine the consumerist ideology that permeates their society and shapes their everyday experiences. In evaluating the conflicting ideologies, the guests are free to choose an alternative view, which, as the television series showed are not necessarily that of the monastic community, and may in fact remain that of consumerism. Conclusion While ideologies are not neutral, they are often invisible. The dominant ideology of consumerism reduces citizens to individualistic consumers and naturalises the need for never ending consumption. A number of groups or movements attempt to expose the logic of consumerism and offer alternative ways of consuming. Each has their own strengths and weaknesses; some are absorbed into the very culture they seek to counter while others remain apart. Christian monasticism, based on the Bible and the Rule of Benedict, engages in the social practices of listening, physical work, and commitment to community. The formation of individuals, and the community, is based explicitly on an ideology that values humanity as made in God’s image. This model has stood the test of time and shown itself to be a legitimate counterculture that is in value-conflict with the current dominant culture of consumption. References Adams, Ian. The Netflix/BBC eight-part limited true crime series The Serpent (2021) provides a commentary on the impact of the tourist industry in South-East Asia in the 1970s. The series portrays the story of French serial killer Charles Sobhraj (played by Tahar Rahim)—a psychopathic international con artist of Vietnamese-Indian descent—who regularly targeted Western travellers, especially the long-term wanderers of the legendary “Hippie Trail” (or the “Overland”), running between eastern Europe and Asia. The series, which was filmed on location in Thailand—in Bangkok and the Thai town of Hua Hin—is set in a range of travel destinations along the route of the Hippie Trail, as the narrative follows the many crimes of Sobhraj. Cities such as Kathmandu, Goa, Varanasi, Hong Kong, and Kabul are featured on the show. The series is loosely based upon Australian writers Richard Neville and Julie Clarke’s true crime biography The Life and Crimes of Charles Sobhraj (1979). Another true crime text by Thomas Thompson called Serpentine: Charles Sobhraj’s Reign of Terror from Europe to South Asia (also published in 1979) is a second reference. The show portrays the disappearance and murders of many young victims at the hands of Sobhraj. Certainly, Sobhraj is represented as a monstrous figure, but what about the business of tourism itself? Arguably, in its reflective examination of twentieth-century travel, the series also poses the hedonism of tourism as monstrous. Here, attention is drawn to Western privilege and a neo-orientalist gaze that presented Asia as an exotic playground for its visitors. The television series focuses on Sobhraj, his French-Canadian girlfriend Marie-Andrée Leclerc (played by Jenna Coleman), and the glamourous life they lead in Bangkok. The fashionable couple’s operation presents Sobhraj as a legitimate gem dealer: outwardly, they seem to embody the epitome of fun and glamour, as well as the cross-cultural sophistication of the international jet set. In reality, they drug and then steal from tourists who believe their story. Sobhraj uses stolen passports and cash to travel internationally and acquire more gems. Then, with an accomplice called Ajay Chowdhury (played by Amesh Adireweera), Sobhraj murders his victims if he thinks they could expose his fraud. Often depicted as humourless and seething with anger, the Sobhraj of the series often wears dark aviator sunglasses, a detail that enhances the sense of his impenetrability. One of the first crimes featured in The Serpent is the double-murder of an innocent Dutch couple. The murders lead to an investigation by Dutch diplomat Herman Knippenberg (played by Billy Howle), wanting to provide closure for the families of the victims. Knippenberg enlists neighbours to go undercover at Sobhraj’s home to collect evidence. This exposes Sobhraj’s crimes, so he flees the country with Marie-Andrée and Ajay. While they were apprehended, Sobhraj would be later given pardon from a prison in India: he would only received a life sentence for murder when he is arrested in Nepal in 2003. His ability to evade punishment—and inability to admit to and atone for his crimes—become features of his monstrosity in the television series. Clearly, Sobhraj is represented as the “serpent” of this drama, a metaphor regularly reinforced both textually and visually across the length of the series. As an example, the opening credit sequence for the series coalesces shots of vintage film in Asia—including hitchhiking backpackers, VW Kombi vans, swimming pools, religious tourist sites, corrupt Asian police forces—against an animated map of central and South-East Asia and the Hippie Trail. The map is encased by the giant, slithering tail of some monstrous, reptilian creature. Situating the geographic context of the narrative, the serpentine monster appears to be rising out of continental Asia itself, figuratively stalking and then entrapping the tourists and travellers who move along its route. So, what of the other readings about the monstrosity of the tourism industry that appears on the show? The Hippie Trail was arguably a site—a serpentine cross-continental thoroughfare—of Western excess. The Hippie Trail emerged as the result of the ease of travel across continental Europe and Asia. It was an extension of a countercultural movement that first emerged in the United States in the mid 1960s. Agnieszka Sobocinska has suggested that the travellers of the Hippie Trail were motivated by “widespread dissatisfaction with the perceived conservatism of Western society and its conventions”, and that it was characterised by “youth, rebellion, self-expression and the performance of personal freedom” (par. 8). The Trail appealed to a particular subcultural group who wanted to differentiate themselves from other travellers. Culturally, the Hippie Trail has become a historical site of enduring fascination, written about in popular histories and Western travel narratives, such as A Season in Heaven: True Tales from the Road to Kathmandu (Tomory 1998), Magic Bus: On the Hippie Trail from Istanbul to India (MacLean 2007), The Hippie Trail: A History (Gemie and Ireland 2017), and The Hippie Trail: After Europe, Turn Left (Kreamer 2019). Despite these positive memoirs, the route also has a reputation for being destructive and even neo-imperialist: it irrevocably altered the politics of these Asian regions, especially as crowds of Western visitors would party at its cities along the way. In The Serpent, while the crimes take place on its route, on face value the Hippie Trail still appears to be romanticised and nostalgically re-imagined, especially as it represents a stark difference from our contemporary world with its heavily-policed international borders. Indeed, the travellers seem even freer from the perspective of 2021, given the show’s production phase and release in the midst of the COVID-19 pandemic, when international travel was halted for many. As Kylie Northover has written in a review for the series in the Sydney Morning Herald, the production design of the programme and the on-location shoot in Thailand is affectionately evocative and nostalgic. Northover suggests that it “successfully evokes a very specific era of travel—the Vietnam War has just ended, the Summer of Love is over and contact with family back home was usually only through the post restante” (13). On the show, there is certainly critique of the tourist industry. For example, one scene demonstrates the “dark side” of the Hippie Trail dream. Firstly, we see a psychedelic-coloured bus of travellers driving through Nepal. The outside of the bus is covered with its planned destinations: “Istanbul. Teheran. Kabul. Delhi”. The Western travellers are young and dressed in peasant clothing and smoking marijuana. Looking over at the Himalayas, one hippie calls the mountains a “Shangri-La”, the fictional utopia of an Eastern mountain paradise. Then, the screen contracts to show old footage of Kathmandu— using the small-screen dimensions of a Super-8 film—which highlights a “hashish centre” with young children working at the front. The child labour is ignored. As the foreign hippie travellers—American and English—move through Kathmandu, they seem self-absorbed and anti-social. Rather than meeting and learning from locals, they just gather at parties with other hippies. By night-time, the series depicts drugged up travellers on heroin or other opiates, disconnected from place and culture as they stare around aimlessly. The negative representation of hippies has been observed in some of the critical reviews about The Serpent. For example, writing about the series for The Guardian, Dorian Lynskey cites Joan Didion’s famous “serpentine” interpretation of the hippie culture in the United States, applying this to the search for meaning on the Hippie Trail: the subculture of expats and travellers in south-east Asia feels rather like Joan Didion’s 60s California, crisscrossed by lost young people trying to find themselves anew in religion, drugs, or simply unfamiliar places. In Slouching Towards Bethlehem, Didion writes of those who “drifted from city to torn city, sloughing off both the past and the future as snakes shed their skins”. (Lynskey) We could apply cultural theories about tourism to a critique of the industry in the series too. Many cultural researchers have critiqued tourists and the tourism industry, as well as the powers that tourists can wield over destination cultures. In Time and Commodity Culture, John Frow has suggested that the logic of tourism is “that of a relentless extension of commodity relations, and the consequent inequalities of power, between centre and periphery, First and Third World, developed and undeveloped regions, metropolis and countryside”, as well as one that has developed from the colonial era (151). Similarly, Derek Gregory’s sensitive analyses of cultural geographies of postcolonial space showed that Nineteenth-century Orientalism is a continuing process within globalised mass tourism (114). The problem of Orientalism as a Western travel ideology is made prominent in The Serpent through Sobhraj’s denouncement of Western tourists, even though there is much irony at play here, as the series itself arguably is presenting its own retro version of Orientalism to Western audiences. Even the choice of Netflix to produce this true crime story—with its two murderers of Asian descent—is arguably a way of reinforcing negative representations about Asian identity. Then, Western characters take on the role of hero and/or central protagonist, especially the character of Knippenberg. One could ask: where is the Netflix show that depicts a positive story about a central character of Vietnamese-Indian descent? Edward Said famously defined Orientalism as “a way of coming to terms with the Orient that is based on the Orient’s special place in European Western experience” (1). It became a way for Western cultures to interpret and understand the East, and for reducing and homogenising it into a more simplistic package. Orientalism explored discourses that grew to encompass India and the Far East in tandem with the expansion of Western imperialism in the eighteenth and nineteenth centuries. It examined a dualistic ideology: a way of looking that divided the globe into two limited types without any room for nuance and diversity. Inclusive and exclusive, Orientalism assumed and promoted an “us and them” binary, privileging a Western gaze as the normative cultural position, while the East was relegated to the ambiguous role of “other”. Orientalism is a field in which stereotypes of the East and West have power: as Said suggests, “the West is the actor, the Orient is a passive reactor… . The West is the spectator, the judge and jury, of every facet of Oriental behaviour” (109). Interestingly, despite the primacy in which Sobhraj is posited as the show’s central monster, he is also the character in the series most critical of the neo-colonial oppression caused by this counter-cultural tourism, which indicates ambiguity and complexity in the representation of monstrosity. Sobhraj appears to have read Said. As he looks scornfully at a stoner hippie woman who has befriended Ajay, he seems to perceive the hippies as drop-outs and drifters, but he also connects them more thoroughly as perpetrators of neo-imperialist processes. Indicating his contempt for the sightseers of the Hippie Trail as they seek enlightenment on their travels, he interrogates his companion Ajay: why do you think these white children deny the comfort and wealth of the life they were given to come to a place like this? Worship the same gods. Wear the same rags. Live in the same filth. Each experience is only then taken home to wear like a piece of fake tribal jewellery. They travel only to acquire. It’s another form of imperialism. And she has just colonised you! Sobhraj’s speech is political but it is also menacing, and he quickly sets upon Ajay and physically punishes him for his tryst with the hippie woman. Yet, ultimately, the main Western tourists of the Hippie Trail are presented positively in The Serpent, especially as many of them are depcited as naïve innocents within the story—hopeful, idealistic and excited to travel—and simply in the wrong place, at the wrong time. In this way, the series still draws upon the conventions of the true crime genre, which is to differentiate clearly between good/evil and right/wrong, and to create an emotional connection to the victims as symbols of virtue. As the crimes and deaths accumulate within the series, Sobhraj’s opinions are deceptive, designed to manipulate those around him (such as Ajay) rather than being drawn from genuine feelings of political angst about the neo-imperialist project of Western tourism. The uncertainty around Sobhraj’s motivation for his crimes remains one of the fascinating aspects of the series. It problematises the way that the monstrosity of this character is constructed within the narrative of the show. The character of Sobhraj frequently engages with these essentialising issues about Orientalism, but he appears to do so with the aim to remove the privilege that comes from a Western gaze. In the series, Sobhraj’s motivations for targeting Western travellers are often insinuated as being due to personal reasons, such as revenge for his treatment as a child in Europe, where he says he was disparaged for being of Asian heritage. For example, as he speaks to one of his drugged French-speaking victims, Sobhraj suggests that when he moved from Vietnam to France as a child, he was subject to violence and poor treatment from others: “a half-caste boy from Saigon. You can imagine how I was bullied”. In this instance, the suffering French man placed in Sobhraj’s power has been promoted as fitting into one of these “us and them” binaries, but in this set-up, there is also a reversal of power relations and Sobhraj has set himself as both the “actor” and the “spectator”. Here, he has reversed the “Orientalist” gaze onto a passive Western man, homogenising a “Western body”, and hence radically destabilising the construct of Orientalism as an ideological force. This is also deeply troubling: it goes on to sustain a problematic and essentialising binary that, no matter which way it faces, aims to denigrate and stereotype a cultural group. In this way, the character of Sobhraj demonstrates that while he is angry at the way that Orientalist ideologies have victimised him in the past, he will continue to perpetrate its basic ideological assumptions as a way of administering justice and seeking personal retribution. Ultimately, perhaps one of the more powerful readings of The Serpent is that it is difficult to move away from the ideological constructs of travel. We could also suggest that same thing for the tourists. In her real-life analysis of the Hippie Trail, Agnieszka Sobocinska has suggested that while it was presented and understood as something profoundly different from older travel tours and expeditions, it could not help but be bound up in the same ideological colonial and imperial impulses that constituted earlier forms of travel: Orientalist images and imperial behaviours were augmented to suit a new generation that liked to think of itself as radically breaking from the past. Ironically, this facilitated the view that ‘alternative’ travel was a statement in anti-colonial politics, even as it perpetuated some of the inequalities inherent to imperialism. This plays out in The Serpent. We see that this supposedly radically different new group – with a relaxed and open-minded identity—is bound within the same old ideological constructs. Part of the problem of the Hippie Trail traveller was a failure to recognise the fundamentally imperialist origins of their understanding of travel. This is the same kind of concern mapped out by Turner and Ash in their analysis of neo-imperial forms of travel called The Golden Hordes: International Tourism and the Pleasure Periphery (1976), written and published in the same era as the events of The Serpent. Presciently gauging the effect that mass tourism would have on developing nations, Turner and Ash used the metaphor of “hordes” of tourists taking over various poorer destinations to intend a complete reversal of the stereotype of a horde of barbaric and non-Western hosts. By inferring that tourists are the “hordes” reverses Orientalist conceptions of de-personalised non-Western cultures, and shows the problem that over-tourism and unsustainable visitation can pose to host locations, especially with the acceleration of mass travel in the late Twentieth century. Certainly, the concept of a touristic “horde” is one of the monstrous ideas in travel, and can signify the worst aspects contained within mass tourism. To conclude, it is useful to return to the consideration of what is presented as monstrous in The Serpent. Here, there is the obvious monster in the sinister, impassive figure of serial killer Charles Sobhraj. Julie Clarke, in a new epilogue for The Life and Crimes of Charles Sobhraj (2020), posits that Sobhraj’s actions are monstrous and unchangeable, demonstrating the need to understand impermeable cases of human evil as a part of human society: one of the lessons of this cautionary tale should be an awareness that such ‘inhuman humans’ do live amongst us. Many don’t end up in jail, but rather reach the highest level in the corporate and political spheres. (Neville and Clarke, 2020) Then, there is the exploitational spectre of mass tourism from the Hippie Trail that has had the ability to “invade” and ruin the authenticity and/or sustainability of a particular place or location as it is overrun by the “golden hordes”. Finally, we might consider the Orientalist, imperialist and globalised ideologies of mass tourism as one of the insidious and serpentine forces that entrap the central characters in this television series. This leads to a failure to understand what is really going on as the tourists are deluded by visions of an exotic paradise. References Frow, John. On the morning of Thursday, 4 May 2006, the United States House Permanent Select Committee on Intelligence held an open hearing entitled “Terrorist Use of the Internet.” The Intelligence committee meeting was scheduled to take place in Room 1302 of the Longworth Office Building, a Depression-era structure with a neoclassical façade. Because of a dysfunctional elevator, some of the congressional representatives were late to the meeting. During the testimony about the newest political applications for cutting-edge digital technology, the microphones periodically malfunctioned, and witnesses complained of “technical problems” several times. By the end of the day it seemed that what was to be remembered about the hearing was the shocking revelation that terrorists were using videogames to recruit young jihadists. The Associated Press wrote a short, restrained article about the hearing that only mentioned “computer games and recruitment videos” in passing. Eager to have their version of the news item picked up, Reuters made videogames the focus of their coverage with a headline that announced, “Islamists Using US Videogames in Youth Appeal.” Like a game of telephone, as the Reuters videogame story was quickly re-run by several Internet news services, each iteration of the title seemed less true to the exact language of the original. One Internet news service changed the headline to “Islamic militants recruit using U.S. video games.” Fox News re-titled the story again to emphasise that this alert about technological manipulation was coming from recognised specialists in the anti-terrorism surveillance field: “Experts: Islamic Militants Customizing Violent Video Games.” As the story circulated, the body of the article remained largely unchanged, in which the Reuters reporter described the digital materials from Islamic extremists that were shown at the congressional hearing. During the segment that apparently most captured the attention of the wire service reporters, eerie music played as an English-speaking narrator condemned the “infidel” and declared that he had “put a jihad” on them, as aerial shots moved over 3D computer-generated images of flaming oil facilities and mosques covered with geometric designs. Suddenly, this menacing voice-over was interrupted by an explosion, as a virtual rocket was launched into a simulated military helicopter. The Reuters reporter shared this dystopian vision from cyberspace with Western audiences by quoting directly from the chilling commentary and describing a dissonant montage of images and remixed sound. “I was just a boy when the infidels came to my village in Blackhawk helicopters,” a narrator’s voice said as the screen flashed between images of street-level gunfights, explosions and helicopter assaults. Then came a recording of President George W. Bush’s September 16, 2001, statement: “This crusade, this war on terrorism, is going to take a while.” It was edited to repeat the word “crusade,” which Muslims often define as an attack on Islam by Christianity. According to the news reports, the key piece of evidence before Congress seemed to be a film by “SonicJihad” of recorded videogame play, which – according to the experts – was widely distributed online. Much of the clip takes place from the point of view of a first-person shooter, seen as if through the eyes of an armed insurgent, but the viewer also periodically sees third-person action in which the player appears as a running figure wearing a red-and-white checked keffiyeh, who dashes toward the screen with a rocket launcher balanced on his shoulder. Significantly, another of the player’s hand-held weapons is a detonator that triggers remote blasts. As jaunty music plays, helicopters, tanks, and armoured vehicles burst into smoke and flame. Finally, at the triumphant ending of the video, a green and white flag bearing a crescent is hoisted aloft into the sky to signify victory by Islamic forces. To explain the existence of this digital alternative history in which jihadists could be conquerors, the Reuters story described the deviousness of the country’s terrorist opponents, who were now apparently modifying popular videogames through their wizardry and inserting anti-American, pro-insurgency content into U.S.-made consumer technology. One of the latest video games modified by militants is the popular “Battlefield 2” from leading video game publisher, Electronic Arts Inc of Redwood City, California. Jeff Brown, a spokesman for Electronic Arts, said enthusiasts often write software modifications, known as “mods,” to video games. “Millions of people create mods on games around the world,” he said. “We have absolutely no control over them. It’s like drawing a mustache on a picture.” Although the Electronic Arts executive dismissed the activities of modders as a “mustache on a picture” that could only be considered little more than childish vandalism of their off-the-shelf corporate product, others saw a more serious form of criminality at work. Testifying experts and the legislators listening on the committee used the video to call for greater Internet surveillance efforts and electronic counter-measures. Within twenty-four hours of the sensationalistic news breaking, however, a group of Battlefield 2 fans was crowing about the idiocy of reporters. The game play footage wasn’t from a high-tech modification of the software by Islamic extremists; it had been posted on a Planet Battlefield forum the previous December of 2005 by a game fan who had cut together regular game play with a Bush remix and a parody snippet of the soundtrack from the 2004 hit comedy film Team America. The voice describing the Black Hawk helicopters was the voice of Trey Parker of South Park cartoon fame, and – much to Parker’s amusement – even the mention of “goats screaming” did not clue spectators in to the fact of a comic source. Ironically, the moment in the movie from which the sound clip is excerpted is one about intelligence gathering. As an agent of Team America, a fictional elite U.S. commando squad, the hero of the film’s all-puppet cast, Gary Johnston, is impersonating a jihadist radical inside a hostile Egyptian tavern that is modelled on the cantina scene from Star Wars. Additional laughs come from the fact that agent Johnston is accepted by the menacing terrorist cell as “Hakmed,” despite the fact that he utters a series of improbable clichés made up of incoherent stereotypes about life in the Middle East while dressed up in a disguise made up of shoe polish and a turban from a bathroom towel. The man behind the “SonicJihad” pseudonym turned out to be a twenty-five-year-old hospital administrator named Samir, and what reporters and representatives saw was nothing more exotic than game play from an add-on expansion pack of Battlefield 2, which – like other versions of the game – allows first-person shooter play from the position of the opponent as a standard feature. While SonicJihad initially joined his fellow gamers in ridiculing the mainstream media, he also expressed astonishment and outrage about a larger politics of reception. In one interview he argued that the media illiteracy of Reuters potentially enabled a whole series of category errors, in which harmless gamers could be demonised as terrorists. It wasn’t intended for the purpose what it was portrayed to be by the media. So no I don’t regret making a funny video . . . why should I? The only thing I regret is thinking that news from Reuters was objective and always right. The least they could do is some online research before publishing this. If they label me al-Qaeda just for making this silly video, that makes you think, what is this al-Qaeda? And is everything al-Qaeda? Although Sonic Jihad dismissed his own work as “silly” or “funny,” he expected considerably more from a credible news agency like Reuters: “objective” reporting, “online research,” and fact-checking before “publishing.” Within the week, almost all of the salient details in the Reuters story were revealed to be incorrect. SonicJihad’s film was not made by terrorists or for terrorists: it was not created by “Islamic militants” for “Muslim youths.” The videogame it depicted had not been modified by a “tech-savvy militant” with advanced programming skills. Of course, what is most extraordinary about this story isn’t just that Reuters merely got its facts wrong; it is that a self-identified “parody” video was shown to the august House Intelligence Committee by a team of well-paid “experts” from the Science Applications International Corporation (SAIC), a major contractor with the federal government, as key evidence of terrorist recruitment techniques and abuse of digital networks. Moreover, this story of media illiteracy unfolded in the context of a fundamental Constitutional debate about domestic surveillance via communications technology and the further regulation of digital content by lawmakers. Furthermore, the transcripts of the actual hearing showed that much more than simple gullibility or technological ignorance was in play. Based on their exchanges in the public record, elected representatives and government experts appear to be keenly aware that the digital discourses of an emerging information culture might be challenging their authority and that of the longstanding institutions of knowledge and power with which they are affiliated. These hearings can be seen as representative of a larger historical moment in which emphatic declarations about prohibiting specific practices in digital culture have come to occupy a prominent place at the podium, news desk, or official Web portal. This environment of cultural reaction can be used to explain why policy makers’ reaction to terrorists’ use of networked communication and digital media actually tells us more about our own American ideologies about technology and rhetoric in a contemporary information environment. When the experts come forward at the Sonic Jihad hearing to “walk us through the media and some of the products,” they present digital artefacts of an information economy that mirrors many of the features of our own consumption of objects of electronic discourse, which seem dangerously easy to copy and distribute and thus also create confusion about their intended meanings, audiences, and purposes. From this one hearing we can see how the reception of many new digital genres plays out in the public sphere of legislative discourse. Web pages, videogames, and Weblogs are mentioned specifically in the transcript. The main architecture of the witnesses’ presentation to the committee is organised according to the rhetorical conventions of a PowerPoint presentation. Moreover, the arguments made by expert witnesses about the relationship of orality to literacy or of public to private communications in new media are highly relevant to how we might understand other important digital genres, such as electronic mail or text messaging. The hearing also invites consideration of privacy, intellectual property, and digital “rights,” because moral values about freedom and ownership are alluded to by many of the elected representatives present, albeit often through the looking glass of user behaviours imagined as radically Other. For example, terrorists are described as “modders” and “hackers” who subvert those who properly create, own, legitimate, and regulate intellectual property. To explain embarrassing leaks of infinitely replicable digital files, witness Ron Roughead says, “We’re not even sure that they don’t even hack into the kinds of spaces that hold photographs in order to get pictures that our forces have taken.” Another witness, Undersecretary of Defense for Policy and International Affairs, Peter Rodman claims that “any video game that comes out, as soon as the code is released, they will modify it and change the game for their needs.” Thus, the implication of these witnesses’ testimony is that the release of code into the public domain can contribute to political subversion, much as covert intrusion into computer networks by stealthy hackers can. However, the witnesses from the Pentagon and from the government contractor SAIC often present a contradictory image of the supposed terrorists in the hearing transcripts. Sometimes the enemy is depicted as an organisation of technological masterminds, capable of manipulating the computer code of unwitting Americans and snatching their rightful intellectual property away; sometimes those from the opposing forces are depicted as pre-modern and even sub-literate political innocents. In contrast, the congressional representatives seem to focus on similarities when comparing the work of “terrorists” to the everyday digital practices of their constituents and even of themselves. According to the transcripts of this open hearing, legislators on both sides of the aisle express anxiety about domestic patterns of Internet reception. Even the legislators’ own Web pages are potentially disruptive electronic artefacts, particularly when the demands of digital labour interfere with their duties as lawmakers. Although the subject of the hearing is ostensibly terrorist Websites, Representative Anna Eshoo (D-California) bemoans the difficulty of maintaining her own official congressional site. As she observes, “So we are – as members, I think we’re very sensitive about what’s on our Website, and if I retained what I had on my Website three years ago, I’d be out of business. So we know that they have to be renewed. They go up, they go down, they’re rebuilt, they’re – you know, the message is targeted to the future.” In their questions, lawmakers identify Weblogs (blogs) as a particular area of concern as a destabilising alternative to authoritative print sources of information from established institutions. Representative Alcee Hastings (D-Florida) compares the polluting power of insurgent bloggers to that of influential online muckrakers from the American political Right. Hastings complains of “garbage on our regular mainstream news that comes from blog sites.” Representative Heather Wilson (R-New Mexico) attempts to project a media-savvy persona by bringing up the “phenomenon of blogging” in conjunction with her questions about jihadist Websites in which she notes how Internet traffic can be magnified by cooperative ventures among groups of ideologically like-minded content-providers: “These Websites, and particularly the most active ones, are they cross-linked? And do they have kind of hot links to your other favorite sites on them?” At one point Representative Wilson asks witness Rodman if he knows “of your 100 hottest sites where the Webmasters are educated? What nationality they are? Where they’re getting their money from?” In her questions, Wilson implicitly acknowledges that Web work reflects influences from pedagogical communities, economic networks of the exchange of capital, and even potentially the specific ideologies of nation-states. It is perhaps indicative of the government contractors’ anachronistic worldview that the witness is unable to answer Wilson’s question. He explains that his agency focuses on the physical location of the server or ISP rather than the social backgrounds of the individuals who might be manufacturing objectionable digital texts. The premise behind the contractors’ working method – surveilling the technical apparatus not the social network – may be related to other beliefs expressed by government witnesses, such as the supposition that jihadist Websites are collectively produced and spontaneously emerge from the indigenous, traditional, tribal culture, instead of assuming that Iraqi insurgents have analogous beliefs, practices, and technological awareness to those in first-world countries. The residual subtexts in the witnesses’ conjectures about competing cultures of orality and literacy may tell us something about a reactionary rhetoric around videogames and digital culture more generally. According to the experts before Congress, the Middle Eastern audience for these videogames and Websites is limited by its membership in a pre-literate society that is only capable of abortive cultural production without access to knowledge that is archived in printed codices. Sometimes the witnesses before Congress seem to be unintentionally channelling the ideas of the late literacy theorist Walter Ong about the “secondary orality” associated with talky electronic media such as television, radio, audio recording, or telephone communication. Later followers of Ong extend this concept of secondary orality to hypertext, hypermedia, e-mail, and blogs, because they similarly share features of both speech and written discourse. Although Ong’s disciples celebrate this vibrant reconnection to a mythic, communal past of what Kathleen Welch calls “electric rhetoric,” the defence industry consultants express their profound state of alarm at the potentially dangerous and subversive character of this hybrid form of communication. The concept of an “oral tradition” is first introduced by the expert witnesses in the context of modern marketing and product distribution: “The Internet is used for a variety of things – command and control,” one witness states. “One of the things that’s missed frequently is how and – how effective the adversary is at using the Internet to distribute product. They’re using that distribution network as a modern form of oral tradition, if you will.” Thus, although the Internet can be deployed for hierarchical “command and control” activities, it also functions as a highly efficient peer-to-peer distributed network for disseminating the commodity of information. Throughout the hearings, the witnesses imply that unregulated lateral communication among social actors who are not authorised to speak for nation-states or to produce legitimated expert discourses is potentially destabilising to political order. Witness Eric Michael describes the “oral tradition” and the conventions of communal life in the Middle East to emphasise the primacy of speech in the collective discursive practices of this alien population: “I’d like to point your attention to the media types and the fact that the oral tradition is listed as most important. The other media listed support that. And the significance of the oral tradition is more than just – it’s the medium by which, once it comes off the Internet, it is transferred.” The experts go on to claim that this “oral tradition” can contaminate other media because it functions as “rumor,” the traditional bane of the stately discourse of military leaders since the classical era. The oral tradition now also has an aspect of rumor. A[n] event takes place. There is an explosion in a city. Rumor is that the United States Air Force dropped a bomb and is doing indiscriminate killing. This ends up being discussed on the street. It ends up showing up in a Friday sermon in a mosque or in another religious institution. It then gets recycled into written materials. Media picks up the story and broadcasts it, at which point it’s now a fact. In this particular case that we were telling you about, it showed up on a network television, and their propaganda continues to go back to this false initial report on network television and continue to reiterate that it’s a fact, even though the United States government has proven that it was not a fact, even though the network has since recanted the broadcast. In this example, many-to-many discussion on the “street” is formalised into a one-to many “sermon” and then further stylised using technology in a one-to-many broadcast on “network television” in which “propaganda” that is “false” can no longer be disputed. This “oral tradition” is like digital media, because elements of discourse can be infinitely copied or “recycled,” and it is designed to “reiterate” content. In this hearing, the word “rhetoric” is associated with destructive counter-cultural forces by the witnesses who reiterate cultural truisms dating back to Plato and the Gorgias. For example, witness Eric Michael initially presents “rhetoric” as the use of culturally specific and hence untranslatable figures of speech, but he quickly moves to an outright castigation of the entire communicative mode. “Rhetoric,” he tells us, is designed to “distort the truth,” because it is a “selective” assembly or a “distortion.” Rhetoric is also at odds with reason, because it appeals to “emotion” and a romanticised Weltanschauung oriented around discourses of “struggle.” The film by SonicJihad is chosen as the final clip by the witnesses before Congress, because it allegedly combines many different types of emotional appeal, and thus it conveniently ties together all of the themes that the witnesses present to the legislators about unreliable oral or rhetorical sources in the Middle East: And there you see how all these products are linked together. And you can see where the games are set to psychologically condition you to go kill coalition forces. You can see how they use humor. You can see how the entire campaign is carefully crafted to first evoke an emotion and then to evoke a response and to direct that response in the direction that they want. Jihadist digital products, especially videogames, are effective means of manipulation, the witnesses argue, because they employ multiple channels of persuasion and carefully sequenced and integrated subliminal messages. To understand the larger cultural conversation of the hearing, it is important to keep in mind that the related argument that “games” can “psychologically condition” players to be predisposed to violence is one that was important in other congressional hearings of the period, as well one that played a role in bills and resolutions that were passed by the full body of the legislative branch. In the witness’s testimony an appeal to anti-game sympathies at home is combined with a critique of a closed anti-democratic system abroad in which the circuits of rhetorical production and their composite metonymic chains are described as those that command specific, unvarying, robotic responses. This sharp criticism of the artful use of a presentation style that is “crafted” is ironic, given that the witnesses’ “compilation” of jihadist digital material is staged in the form of a carefully structured PowerPoint presentation, one that is paced to a well-rehearsed rhythm of “slide, please” or “next slide” in the transcript. The transcript also reveals that the members of the House Intelligence Committee were not the original audience for the witnesses’ PowerPoint presentation. Rather, when it was first created by SAIC, this “expert” presentation was designed for training purposes for the troops on the ground, who would be facing the challenges of deployment in hostile terrain. According to the witnesses, having the slide show showcased before Congress was something of an afterthought. Nonetheless, Congressman Tiahrt (R-KN) is so impressed with the rhetorical mastery of the consultants that he tries to appropriate it. As Tiarht puts it, “I’d like to get a copy of that slide sometime.” From the hearing we also learn that the terrorists’ Websites are threatening precisely because they manifest a polymorphously perverse geometry of expansion. For example, one SAIC witness before the House Committee compares the replication and elaboration of digital material online to a “spiderweb.” Like Representative Eshoo’s site, he also notes that the terrorists’ sites go “up” and “down,” but the consultant is left to speculate about whether or not there is any “central coordination” to serve as an organising principle and to explain the persistence and consistency of messages despite the apparent lack of a single authorial ethos to offer a stable, humanised, point of reference. In the hearing, the oft-cited solution to the problem created by the hybridity and iterability of digital rhetoric appears to be “public diplomacy.” Both consultants and lawmakers seem to agree that the damaging messages of the insurgents must be countered with U.S. sanctioned information, and thus the phrase “public diplomacy” appears in the hearing seven times. However, witness Roughhead complains that the protean “oral tradition” and what Henry Jenkins has called the “transmedia” character of digital culture, which often crosses several platforms of traditional print, projection, or broadcast media, stymies their best rhetorical efforts: “I think the point that we’ve tried to make in the briefing is that wherever there’s Internet availability at all, they can then download these – these programs and put them onto compact discs, DVDs, or post them into posters, and provide them to a greater range of people in the oral tradition that they’ve grown up in. And so they only need a few Internet sites in order to distribute and disseminate the message.” Of course, to maintain their share of the government market, the Science Applications International Corporation also employs practices of publicity and promotion through the Internet and digital media. They use HTML Web pages for these purposes, as well as PowerPoint presentations and online video. The rhetoric of the Website of SAIC emphasises their motto “From Science to Solutions.” After a short Flash film about how SAIC scientists and engineers solve “complex technical problems,” the visitor is taken to the home page of the firm that re-emphasises their central message about expertise. The maps, uniforms, and specialised tools and equipment that are depicted in these opening Web pages reinforce an ethos of professional specialisation that is able to respond to multiple threats posed by the “global war on terror.” By 26 June 2006, the incident finally was being described as a “Pentagon Snafu” by ABC News. From the opening of reporter Jake Tapper’s investigative Webcast, established government institutions were put on the spot: “So, how much does the Pentagon know about videogames? Well, when it came to a recent appearance before Congress, apparently not enough.” Indeed, the very language about “experts” that was highlighted in the earlier coverage is repeated by Tapper in mockery, with the significant exception of “independent expert” Ian Bogost of the Georgia Institute of Technology. If the Pentagon and SAIC deride the legitimacy of rhetoric as a cultural practice, Bogost occupies himself with its defence. In his recent book Persuasive Games: The Expressive Power of Videogames, Bogost draws upon the authority of the “2,500 year history of rhetoric” to argue that videogames represent a significant development in that cultural narrative. Given that Bogost and his Watercooler Games Weblog co-editor Gonzalo Frasca were actively involved in the detective work that exposed the depth of professional incompetence involved in the government’s line-up of witnesses, it is appropriate that Bogost is given the final words in the ABC exposé. As Bogost says, “We should be deeply bothered by this. We should really be questioning the kind of advice that Congress is getting.” Bogost may be right that Congress received terrible counsel on that day, but a close reading of the transcript reveals that elected officials were much more than passive listeners: in fact they were lively participants in a cultural conversation about regulating digital media. After looking at the actual language of these exchanges, it seems that the persuasiveness of the misinformation from the Pentagon and SAIC had as much to do with lawmakers’ preconceived anxieties about practices of computer-mediated communication close to home as it did with the contradictory stereotypes that were presented to them about Internet practices abroad. In other words, lawmakers found themselves looking into a fun house mirror that distorted what should have been familiar artefacts of American popular culture because it was precisely what they wanted to see. Did you see the videos where the cat jumps in the box, attacks the printer or tries to leap from the snowy car? As the availability and popularity of watching videos on the Internet has risen rapidly in the last decade, so has the prevalence of cat videos. Although the cuteness of YouTube videos of cats might make them appear frivolous, in fact there is a significant irony at their heart: online cat videos enable corporate surveillance of viewers, yet viewers seem just as oblivious to this as the cats featured in the videos. Towards this end, I consider the distinguishing features of contemporary cat videos, focusing particularly on their narrative structure and mode of observation. I compare cat videos with the “Aesthetic of Astonishment” of early cinema and with dog videos, to explore the nexus of a spectatorship of thrills and feline performance. In particular, I highlight a unique characteristic of these videos: the cats’ unselfconsciousness. This, I argue, is rare in a consumer culture dominated by surveillance, where we are constantly aware of the potential for being watched. The unselfconsciousness of cats in online videos offers viewers two key pleasures: to imagine the possibility of freedom from surveillance, and to experience the power of administering surveillance as unproblematic. Ultimately, however, cat videos enable viewers to facilitate our own surveillance, and we do so with the gleeful abandon of a kitten jumping in a tissue box What Distinguishes Cat Videos? Cat videos have become so popular, that they generate millions of views on YouTube, and the Walker Art Center in Minneapolis now holds an annual Internet Cat Video Festival. If you are not already a fan of the genre, the Walker’s promotional videos for the festival (2013 and 2012) provide an entertaining introduction to the celebrities (Lil Bub, Grumpy Cat, and Henri), canon (dancing cats, surprised cat, and cat falling off counter), culture and commodities of online cat videos, despite repositioning them into a public exhibition context. Cats are often said to dominate the internet (Hepola), despite the surprise of Internet inventor Tim Berners-Lee. Domestic cats are currently the most popular pet in the world (Driscoll), however they are already outnumbered by smartphones. Cats have played various roles in our societies, cultures and imaginations since their domestication some 8-10,000 years ago (Driscoll). A potent social and cultural symbol in mythology, art and popular culture, the historical and cultural significance of cats is complex, shifting and often contradictory. They have made their way across geographic, cultural and class boundaries, and been associated with the sacred and the occult, femininity and fertility, monstrosity and domesticity (Driscoll, Rogers). Cats are figured as both inscrutable and bounteously polysemic. Current representations of cats, including these videos, seem to emphasise their sociability with humans, association with domestic space, independence and aloofness, and intelligence and secretiveness. I am interested in what distinguishes the pleasures of cat videos from other manifestations of cats in folklore and popular culture such as maneki-neko and fictional cats. Even within Internet culture, I’m focusing on live action cat videos, rather than lolcats, animated cats, or dog videos, though these are useful points of contrast. The Walker’s cat video primer also introduces us to the popular discourses accounting for the widespread appeal of these videos: cats have global reach beyond language, audiences can project their own thoughts and feelings onto cats, cats are cute, and they make people feel good. These discourses circulate in popular conversation, and are promoted by YouTube itself. These suggestions do not seem to account for the specific pleasures of cat videos, beyond the predominance of cats in culture more broadly. The cat videos popular on the Internet tend to feature several key characteristics. They are generated by users, shot on a mobile device such as a phone, and set in a domestic environment. They employ an observational mode, which Bill Nichols has described as a noninterventionist type of documentary film associated with traditions of direct cinema and cinema verite, where form and style yields to the profilmic event. In the spirit of their observational mode, cat videos feature minimal sound and language, negligible editing and short duration. As Leah Shafer notes, cat videos record, “’live’ events, they are mostly shot by ‘amateurs’ with access to emerging technologies, and they dramatize the familiar.” For example, the one-minute video Cat vs Printer comprises a single, hand-held shot observing the cat, and the action is underlined by the printer’s beep and the sounds created by the cat’s movements. The patterned wallpaper suggests a domestic location, and the presence of the cat itself symbolises domesticity. These features typically combine to produce impressions of universality, intimacy and spontaneity – impressions commonly labelled ‘cute’. The cat’s cuteness is also embodied in its confusion and surprise at the printer’s movements: it is a simpleton, and we can laugh at its lack of understanding of the basic appurtenances of the modern world. Cat videos present minimalist narratives, focused on an instant of spectacle. A typical cat video establishes a state of calm, then suddenly disrupts it. The cat is usually the active agent of change, though chance also frequently plays a significant role. The pervasiveness of this structure means that viewers familiar with the form may even anticipate a serendipitous event. The disruption prompts a surprising or comic effect for the viewer, and this is a key part of the video’s pleasure. For example, in Cat vs Printer, the establishing scenario is the cat intently watching the printer, a presumably quotidian scene, which escalates when the cat begins to smack the moving paper. The narrative climaxes in the final two seconds of the video, when the cat strikes the paper so hard that the printer tray bounces, and the surprised cat falls off its stool. The video ends abruptly. This disruption also takes the viewer by surprise (at least it does the first time you watch it). The terse ending, and lack of resolution or denouement, encourages the viewer to replay the video. The minimal narrative effectively builds expectation for a moment of surprise. These characteristics of style and form typify a popular body of work, though there is variation, and the millions of cat videos on YouTube might be best accounted for by various subgenres. The most popular cat videos seem to have the most sudden and striking disruptions as well as the most abrupt endings. They seem the most dramatic and spontaneous. There are also thousands of cat videos with minor disruptions, and some with brazenly staged events. Increasingly, there is obvious use of postproduction techniques, including editing and music. A growing preponderance of compilations attests to the videos’ “spreadability” (Jenkins, Ford, and Green). The conventional formal structure of these videos effectively homogenises the cat, as if there is a single cat performing in millions of videos. Indeed, YouTube comments often suggest a likeness between the cat represented in the video and the commenter’s own cat. In this sense, the cuteness so readily identified has an homogenising effect. It also has the effect of distinguishing cats as a species from other animals, as it confounds common conceptions of all (other) animals as fundamentally alike in their essential difference from the human (animal). Cat videos are often appreciated for what they reveal about cats in general, rather than for each cat’s individuality. In this way, cat videos symbolise a generic feline cuteness, rather than identify a particular cat as cute. The cats of YouTube act “as an allegory for all the cats of the earth, the felines that traverse myths and religions, literature and fables” (Derrida 374). Each cat swiping objects off shelves, stealing the bed of a dog, leaping onto a kitchen bench is the paradigmatic cat, the species exemplar. Mode of Spectatorship, Mode of Performance: Cat Videos, Film History and Dog Videos Cat videos share some common features with early cinema. In his analysis of the “Aesthetic of Astonishment,” which dominated films until about 1904, film historian Tom Gunning argues that the short, single shot films of this era are characterised by exciting audience curiosity and fulfilling it with visual shocks and thrills. It is easy to see how this might describe the experience of watching Cat vs Printer or Thomas Edison’s Electrocution of an Elephant from 1903. The thrill of revelation at the end of Cat vs Printer is more significant than the minimal narrative it completes, and the most popular videos seem to heighten this shock. Further, like a rainy afternoon spent clicking the play button on a sequence of YouTube’s suggested videos, these early short films were also viewed in variety format as a series of attractions. Indeed, as Leah Shafer notes, some of these early films even featured cats, such as Professor Welton’s Boxing Cats from 1894. Each film offered a moment of spectacle, which thrilled the modern viewer. Gunning argues that these early films are distinguished by a particular relationship between spectator and film. They display blatant exhibitionism, and address their viewer directly. This highlights the thrill of disruption: “The directness of this act of display allows an emphasis on the thrill itself – the immediate reaction of the viewer” (Gunning “Astonishment” 122). This is produced both within the staging of the film itself as players look directly at the camera, and by the mode of exhibition, where a showman primes the audience verbally for a moment of revelation. Importantly, Gunning argues that this mode of spectatorship differs from how viewers watch narrative films, which later came to dominate our film and television screens: “These early films explicitly acknowledge their spectator, seeming to reach outwards and confront. Contemplative absorption is impossible here” (“Astonishment” 123). Gunning’s emphasis on a particular mode of spectatorship is significant for our understanding of pet videos. His description of early cinema has numerous similarities with cat videos, to be sure, but seems to describe more precisely the mode of spectatorship engendered by typical dog videos. Dog videos are also popular online, and are marked by a mode of performance, where the dogs seem to present self-consciously for the camera. Dogs often appear to look at the camera directly, although they are probably actually reading the eyes of the camera operator. One of the most popular dog videos, Ultimate dog tease, features a dog who appears to look into the camera and engage in conversation with the camera operator. It has the same domestic setting, mobile camera and short duration as the typical cat video, but, unlike the cat attacking the printer, this dog is clearly aware of being watched. Like the exhibitionistic “Cinema of Attractions,” it is marked by “the recurring look at the camera by [canine] actors. This action which is later perceived as spoiling the realistic illusion of the cinema, is here undertaken with brio, establishing contact with the audience” (Gunning “Attractions” 64). Dog videos frequently feature dogs performing on command, such as the countless iterations of dogs fetching beverages from refrigerators, or at least behaving predictably, such as dogs jumping in the bath. Indeed, the scenario often seems to be set up, whereas cat videos more often seem to be captured fortuitously. The humour of dog videos often comes from the very predictability of their behaviour, such as repeatedly fetching or rolling in mud. In an ultimate performance of self-consciousness, dogs even seem to act out guilt and shame for their observers. Similarly, baby videos are also popular online and were popular in early cinema, and babies also tend to look at the camera directly, showing that they are aware of bring watched. This emphasis on exhibitionism and modes of spectatorship helps us hone in on the uniqueness of cat videos. Unlike the dogs of YouTube, cats typically seem unaware of their observers; they refuse to look at the camera and “display their visibility” (Gunning “Attractions,” 64). This fits with popular discourses of cats as independent and aloof, untrainable and untameable. Cat videos employ a unique mode of observation: we observe the cat, who is unencumbered by our scrutiny. Feline Performance in a World of Pervasive Surveillance This is an aesthetic of surveillance without inhibition, which heightens the impressions of immediacy and authenticity. The very existence of so many cat videos online is a consequence of camera ubiquity, where video cameras have become integrated with common communications devices. Thousands of cameras are constantly ready to capture these quotidian scenes, and feed the massive economy of user-generated content. Cat videos are obviously created and distributed by humans, a purposeful labour to produce entertainment for viewers. Cat videos are never simply a feline performance, but a performance of human interaction with the cat. The human act of observation is an active engagement with the other. Further, the act of recording is a performance of wielding the camera, and often also through image or voice. The cat video is a companion performance, which is part of an ongoing relationship between that human and that other animal. It carries strong associations with regimes of epistemological power and physical domination through histories of visual study, mastery and colonisation. The activity of the human creator seems to contrast with the behaviour of the cat in these videos, who appears unaware of being watched. The cats’ apparent uninhibited behaviour gives the viewer the illusion of voyeuristically catching a glimpse of a self-sufficient world. It carries connotations of authenticity, as the appearance of interaction and intervention is minimised, like the ideal of ‘fly on the wall’ documentary (Nichols). This lack of self-consciousness and sense of authenticity are key to their reception as ‘cute’ videos. Interestingly, one of the reasons that audiences may find this mode of observation so accessible and engaging, is because it heeds the conventions of the fourth wall in the dominant style of fiction film and television, which presents an hermetically sealed diegesis. This unselfconscious performance of cats in online videos is key, because it embodies a complex relationship with the surveillance that dominates contemporary culture. David Lyon describes surveillance as “any focused attention to personal details for the purposes of influence, management, or control” (“Everyday” 1) and Mark Andrejevic defines monitoring as “the collection of information, with or without the knowledge of users, that has actual or speculative economic value” (“Enclosure” 297). We live in an environment where social control is based on information, collected and crunched by governments, corporations, our peers, and ourselves. The rampancy of surveillance has increased in recent decades in a number of ways. Firstly, technological advances have made the recording, sorting and analysis of data more readily available. Although we might be particularly aware of the gaze of the camera when we stand in line at the supermarket checkout or have an iPhone pointed at our face, many surveillance technologies are hidden points of data collection, which track our grocery purchases, text messages to family and online viewing. Surveillance is increasingly mediated through digital technologies. Secondly, surveillance data is becoming increasingly privatised and monetised, so there is strengthening market demand for consumer information. Finally, surveillance was once associated chiefly with institutions of the state, or with corporations, but the process is increasingly “lateral,” involving peer-to-peer surveillance and self-surveillance in the realms of leisure and domestic life (Andrejevic “Enclosure,” 301). Cat videos occupy a fascinating position within this context of pervasive surveillance, and offer complex thrills for audiences. The Unselfconscious Pleasures of Cat Videos Unselfconsciousness of feline performance in cat videos invites contradictory pleasures. Firstly, cat videos offer viewers the fantasy of escaping surveillance. The disciplinary effect of surveillance means that we modify our behaviour based on a presumption of constant observation; we are managed and manipulated as much by ourselves as we are by others. This discipline is the defining condition of industrial society, as described by Foucault. In an age of traffic cameras, Big Brother, CCTV, the selfie pout, and Google Glass, modern subjects are oppressed by the weight of observation to constantly manage their personal performance. Unselfconsciousness is associated with privacy, intimacy, naivety and, increasingly, with impossibility. By allowing us to project onto the experience of their protagonists, cat videos invite us to imagine a world where we are not constantly aware of being watched, of being under surveillance by both human beings and technology. This projection is enabled by discourse, which constructs cats as independent and aloof, a libertarian ideal. It provides the potential for liberation from technologized social surveillance, and from the concomitant self-discipline of our docile bodies. The uninhibited performance of cats in online videos offers viewers the prospect that it is possible to live without the gaze of surveillance. Through cat videos, we celebrate the untameable. Cats model a liberated uninhibitedness viewers can only desire. The apparent unselfconsciousness of feline performance is analogous to Derrida’s conception of animal nakedness: the nudity of animals is significant, because it is a key feature which distinguishes them from humans, but at the same time there is no sense of the concept of nakedness outside of human culture. Similarly, a performance uninhibited by observation seems beyond humans in contemporary culture, and implies a freedom from social expectations, but there is also little suggestion that cats would act differently if they knew they were observed. We interpret cats’ independence as natural, and take pleasure in cats’ naturalness. This lack of inhibition is cute in the sense that it is attractive to the viewer, but also in the sense that it is naïve to imagine a world beyond surveillance, a freedom from being watched. Secondly, we take pleasure in the power of observing another. Surveillance is based on asymmetrical regimes of power, and the position of observer, recorder, collator is usually more powerful than the subject of their gaze. We enjoy the pleasure of wielding the unequal gaze, whether we hit the “record” button ourselves or just the “play” button. In this way, we celebrate our capacity to contain the cat, who has historically proven conceptually uncontainable. Yet, the cats’ unselfconsciousness means we can absolve ourselves of their exploitation. Looking back at the observer, or the camera, is often interpreted as a confrontational move. Cats in videos do not confront their viewer, do not resist the gaze thrown on them. They accept the role of subject without protest; they perform cuteness without resistance. We internalise the strategies of surveillance so deeply that we emulate its practices in our intimate relationships with domestic animals. Cats do not glare back at us, accusingly, as dogs do, to remind us we are exerting power over them. The lack of inhibition of cats in online videos means that we can exercise the power of surveillance without confronting the oppression this implies. Cat videos offer the illusion of watching the other without disturbing it, brandishing the weapon without acknowledging the violence of its impact. There is a logical tension between these dual pleasures of cat videos: we want to escape surveillance, while exerting it. The Work of Cat Videos in ‘Liquid Surveillance’ These contradictory pleasures in fact speak to the complicated nature of surveillance in the era of “produsage,” when the value chain of media has transformed along with traditional roles of production and consumption (Bruns). Christian Fuchs argues that the contemporary media environment has complicated the dynamics of surveillance, and blurred the lines between subject and object (304). We both create and consume cat videos; we are commodified as audience and sold on as data. YouTube is the most popular site for sharing cat videos, and a subsidiary of Google, the world’s most visited website and a company which makes billions of dollars from gathering, collating, storing, assessing, and trading our data. While we watch cat videos on YouTube, they are also harvesting information about our every click, collating it with our other online behaviour, targeting ads at us based on our specific profile, and also selling this data on to others. YouTube is, in fact, a key tool of what David Lyon calls “liquid surveillance” after the work of Zygmunt Bauman, because it participates in the reduction of millions of bodies into data circulating at the service of consumer society (Lyon “Liquid”). Your views of cats purring and pouncing are counted and monetised, you are profiled and targeted for further consumption. YouTube did not create the imbalance of power implied by these mechanisms of surveillance, but it is instrumental in automating, amplifying, and extending this power (Andrejevic “Lateral,” 396). Zygmunt Bauman argues that in consumer society we are increasingly seduced to willingly subject ourselves to surveillance (Lyon “Liquid”), and who better than the cute kitty to seduce us? Our increasingly active role in “produsage” media platforms such as YouTube enables us to perform what Andrejevic calls “the work of being watched” (“Work”). When we upload, play, view, like and comment on cat videos, we facilitate our own surveillance. We watch cat videos for the contradictory pleasures they offer us, as we navigate and negotiate the overwhelming surveillance of consumer society. Cat videos remind us of the perpetual possibility of observation, and suggest the prospect of escaping it.
