A bedrock principle in pragmatics is that the linguistic signals produced by speakers generally underdetermine the meanings that are communicated to interpreters. For Grice, for instance, utterance meaning lies close to what is overtly encoded, allowing only for the resolution of indexicals, tense, reference, and ambiguity. Lepore and Stone (L&S) agree, but with a stunning twist: they analyze all extrasemantic content as being derived from ambiguity resolution, leaving no work for Gricean tools. Despite significant areas of concurrence with L&S, we ultimately find their analysis to be untenable. To establish this, we focus on a form of pragmatic enrichment that recruits coherence establishment processes to apply within the clause—‘eliciture’—for which we see no credible analysis in terms of ambiguity resolution. We argue that an adequate account of language understanding must recognize the robust roles of both ambiguity resolution and pragmatic enrichment, using tense interpretation as a case study.

Every reading of Process and Reality has to start by declaring the initial problem on the basis of which the book is to be interpreted. It has become clear to readers of Whitehead that different perspectives never stop reorganising the system, perspectives that determine relative and changing areas of importance, connecting problems with ever fluctuating forms. One of Process and Reality’s particularities – connected to its style and philosophical form – is that it resists being ‘surveyed’ from above, it resists readings introduced as mere explanations. As such, ‘there are distinct lineages of readers of Whitehead in accordance with different approaches. Each reader inherits one particular movement out of all the movements that the original work tangles up.’These tangles are the transformative power of the system to which one must become sensitive. An adequate reading cannot avoid taking a particular path. The only constraints are those shared by all systematic thought: coherence must be maintained.

In metaphysics, Spinoza associates reasons with causes or explanations. He contends that there is a reason for whatever exists and whatever does not exist. In his account of the human mind, Spinoza makes reason a peculiarly powerful kind of idea and the only source of our knowledge of objects in experience. In his moral theory, Spinoza introduces dictates of reason, which are action-guiding prescriptions. In politics, Spinoza suggests that reason, with religion, motivates cooperation in society. Reason shapes Spinoza’s philosophy, and central debates about Spinoza—including his place in the history of philosophy and in the European Enlightenment—turn upon our understanding of these claims. Spinoza on Reason starts with striking claims in each of these areas drawn from Spinoza’s two great works, the Ethics and the Theological Political Treatise; the book takes each characterization of reason on its own terms, explaining the claims and their historical context. While acknowledging the striking variety of reason’s roles, this work emphasizes the extent to which these different doctrines build upon one another. The result is a rich understanding of the meaning and function of each claim and, in the book’s conclusion, a detailed and accurate account of the contribution of reason to the systematic coherence of Spinoza’s philosophy.

Global governance has come under increasing pressure since the end of the Cold War. In some issue areas, these pressures have led to significant changes in the architecture of governance institutions. In others, institutions have resisted pressures for change. This volume explores what accounts for this divergence in architecture by identifying three modes of governance: hierarchies, networks, and markets. The authors apply these ideal types to different issue areas in order to assess how global governance has changed and why. In most issue areas, hierarchical modes of governance, established after World War II, have given way to alternative forms of organization focused on market or network-based architectures. Each chapter explores whether these changes are likely to lead to more or less effective global governance across a wide range of issue areas. This provides a novel and coherent theoretical framework for analysing change in global governance.

The world’s oceans constitute a single, interconnected planetary system, and their effective protection, therefore, demands an integrated approach. Yet, the decentralized nature of the international legal order means that the challenges for coordination are immense. Chapter 10 explains the difficulties of developing a coherent and comprehensive legal framework for the protection of the marine environment, with a particular focus on the challenges of promoting multipurpose marine protected areas in light of the proliferation of sectoral regulatory regimes. The chapter then assesses the possible mechanisms for promoting coordination between relevant treaties. Both top-down global coordination of environmental protection and bottom-up cooperation are considered. The prospects for this issue to be addressed through the ongoing negotiations on a new legally binding instrument for the conservation of marine biodiversity in areas beyond national jurisdiction are also taken into account.

The Law of Equity is a unique junction where doctrinal private law, moral theory, and social perceptions of justice meet. This book explores the general principles that underlie Equity’s intervention in the Common Law, with Chapter 1 arguing that Equity should be preserved as a separate body of law which aims to align moral and legal duties in private law. Chapter 2 discusses the importance of proprietary estoppel and concludes with the argument that Equity, via the doctrine of proprietary estoppel, is redressing a significant failure in the Common Law to tackle behaviour that disregards both morality and efficiency. Chapter 3 deals with fiduciary law, highlighting the disadvantages of transforming the equitable duty of loyalty into an ordinary contractual obligation. Chapter 4 examines the clean hands doctrine, in which Equity employs the concept of integrity to construct a coherent system of reasoning about this highly-complex area. Finally, Chapter 5 discusses some findings from the analysis of fiduciary law, proprietary estoppel, and the clean hands doctrine. It highlights the family resemblance between the different doctrines we survey, and points out three areas where the distinctive nature of Equity serves the legal ideal of Accountability Correspondence, in a way that often increases the efficiency of the system.

This chapter summarizes the volume's main ideas, a common thread of which is a renewed democratic politics, an ecological democracy. Each of the discourses analyzed in the text offers a reasonably comprehensive account of and orientation to environmental affairs at all levels, from the global to the local, and across different issue areas such as pollution, resource depletion, biodiversity, and climate change. Of the discourses surveyed, only Promethean discourse and ecological modernization provide any coherent analysis of what to do with the liberal capitalist economic order. The chapter considers how democratic pragmatism, sustainable development, ecological modernization, and green radicalism seem to provide more possibilities for learning. It also discusses several specific claims that can be made on behalf of deliberative democracy in an environmental context and concludes by arguing that ecological democracy should transcend the boundary between human social systems and natural systems.

Both areas often focus rather narrowly on migration policy without considering systematically and rigorously other economic, social, and political drivers of migration. To be successful in recruiting on the global skill market, countries have to implement coherent whole-of-government immigration policy packages which are to be embedded in a country’s broader economic, social, and political structures and the broader context of international migration processes and dynamics. Societies and economies that are able to create a welcoming environment for people, attractive professional conditions for workers, and a business climate for employers are likely to succeed in attracting and recruiting skilled workers that are in demand. The chapter concludes with some proposals aimed at improving the efficiency of the global skill market.

This book provides a systematic exposition of the theory of Fourier-Mukai transforms from an algebro-geometric point of view. Assuming a basic knowledge of algebraic geometry, the key aspect of this book is the derived category of coherent sheaves on a smooth projective variety. The derived category is a subtle invariant of the isomorphism type of a variety, and its group of autoequivalences often shows a rich structure. As it turns out — and this feature is pursued throughout the book — the behaviour of the derived category is determined by the geometric properties of the canonical bundle of the variety. Including notions from other areas, e.g., singular cohomology, Hodge theory, abelian varieties, K3 surfaces; full proofs and exercises are provided. The final chapter summarizes recent research directions, such as connections to orbifolds and the representation theory of finite groups via the McKay correspondence, stability conditions on triangulated categories, and the notion of the derived category of sheaves twisted by a gerbe.

The Anglo-American law of obligations was profoundly reshaped in the two centuries after 1800, driven by social and economic changes, and changes in legal institutions and doctrines. In contract law, nineteenth-century jurists increasingly sought to put the rules of law into a coherent rational framework (inspired by continental models resting on will theory), though they soon found that this theory could not explain many contractual doctrines. In tort law, jurists were also divided over whether unifying principles underlying tort could be uncovered, with formalist efforts to find such principles being challenged by Realists who argued that tort was in effect ‘public law in disguise’. The quest for underlying principles was also pursued by scholars of unjust enrichment, first in the United States and subsequently in England; though as in the other areas of obligations, by the end of the twentieth century, there was no consensus on whether this was possible.

Law is usually understood as an orderly, coherent system, but this volume shows that it is often better understood as an entangled web. Bringing together eminent contributors from law, political science, sociology, anthropology, history and political theory, it also suggests that entanglement has been characteristic of law for much of its history. The book shifts the focus to the ways in which actors create connections and distance between different legalities in domestic, transnational and international law. It examines a wide range of issue areas, from the relationship of state and indigenous orders to the regulation of global financial markets, from corporate social responsibility to struggles over human rights. The book uses these empirical insights to inform new theoretical approaches to law, and by placing the entanglements between norms from different origins at the centre of the study of law, it opens up new avenues for future legal research. This is force planning, the interactive, intertemporal art intended to ensure that deficiencies in today’s force structure are being corrected while preparing for a future that may resemble the present or differ from it in unexpected ways. While force planners must think about what the future security environment might look like, what technologies might be available, and how future forces might leverage these emerging technologies to meet the challenges of a future security environment, they must always be cognizant of domestic structural factors. This chapter argues that a force planner must always be guided by a coherent strategic logic. Structural factors can never be eliminated, but a strong strategic rationale can minimize them.

The chapter argues for an interdisciplinary approach to comparative constitutional inquiry that is methodologically and substantively preferable to doctrinal accounts. It suggests that for historical, analytical, and methodological reasons, maintaining the disciplinary divide between comparative constitutional law and other closely related disciplines that study various aspects of the same constitutional phenomena, artificially and unnecessarily limits our horizons and restricts the questions asked as well as the answers provided. Traditional disciplinary boundaries, both substantive and methodological, between comparative (public) law and the social sciences continue to impede the development of comparative constitutional studies as an ambitious, coherent, and theoretically advanced area of inquiry. By engaging in a dialogue with the social sciences, and political science in particular, comparative constitutional inquiries would go beyond the traditional realms of judicial review to consider extrajudicial factors such as judicial behaviour, the origins of constitutional change, constitutional design, and the real-life effects of constitutional jurisprudence.

This chapter considers the global and comparative dimensions of sentencing and explains their significance for developing a more positive relationship between sentencing policy and social justice. It assesses the influence of globalization on the formulation of sentencing policy in England and Wales, before focusing on the wider problems of drawing comparisons and policy transfer. It then reflects on sentencing as a transitional concept, arguing that notions of transitional justice offer some valuable insights in conceptualizing sentencing policy’s relationship to social justice, particularly in situations where the state lacks a coherent moral mandate for criminalizing and punishing offenders. Finally, the chapter considers whether the 2008 global financial crisis has influenced the approach taken to the sentencing of financial crime in the domestic context, explaining why and how the proposed changes to ideology and practice are more likely to enhance the moral credibility and social value of sentencing in this area.

This edited volume is based on the European Law Institute's project, 'The Prevention and Resolution of Conflicts of Exercise of Jurisdiction in Criminal Law', co-ordinated by the European Law Institute (ELI) and the University of Luxembourg. The project ran from 2013 to 2017 and was conducted under the auspices of the ELI and the Luxembourg National Research Fund (FNR). The study sought to explore options for a coherent regulatory mechanism for the prevention and settlement of conflicts of jurisdiction in criminal law. Currently, there is no binding instrument establishing a mechanism to resolve conflicts of (exercising) jurisdiction in criminal matters in the EU, although such a mechanism is essential for the effective functioning of a European criminal justice area based on mutual recognition. Building on empirical research and a comparison with civil law solutions to the problem of conflicts of jurisdiction, this volume seeks to impact the EU policy debate by proposing three fully-formed models for legislative action, coupled with extensive analysis of related themes.

Mathura is famous for its association with Vāsudeva‒Kṛṣṇa, an important deity of the Hindu pantheon. However, apart from the sanctity attached to this place by Hindus, it has also provided conditions for the nurturing of Buddhist, Jaina, nāga and yakṣa traditions. This book engages in a wide range of epigraphic, archaeological and art historical data from the various sites in the Mathura area and weaves this to present a coherent picture of the variegated religious history of the area from c.600 CE to c.1000 CE, which witnessed various religions/cults/sects competing for attention and patronage. The chapters in this book have been divided according to religious traditions, namely, Jainism, Buddhism and Hinduism, along with the Kṛṣṇa, yakṣa, nāga, and mātṛkā cults. It raises many important issues related to Jainism, Hinduism, Buddhism and Jainism as well as older cults of the yakṣas and nāgas. The objects of donation ranged from images, stūpas, temples to tanks and gardens. Donations by monks and nuns; together with laity from different locations within and beyond Mathura, amply reflect on the social mosaic of the time. The role of monastics and laity, the nature of patronage, and the social and political underpinnings of the religious history are also examined, all within a long, diachronic frame. This book reveals the complexity of the religious history of Mathura to provide the reader a taste of its diversity and plurality.

This handbook offers an extensive cross-linguistic and cross-theoretical survey of polysynthetic languages, in which single multi-morpheme verb forms can express what would be whole sentences in English. These languages and the problems they raise for linguistic analyses have long featured prominently in language descriptions, and yet the essence of polysynthesis remains under discussion, right down to whether it delineates a distinct, coherent type, rather than an assortment of frequently co-occurring traits. Chapters in the first part of the handbook relate polysynthesis to other issues central to linguistics, such as complexity, the definition of the word, the nature of the lexicon, idiomaticity, and to typological features such as argument structure and head marking. Desert Lake is a book combining artistic, scientific and Indigenous views of a striking region of north-western Australia. Paruku is the place that white people call Lake Gregory. It is Walmajarri land, and its people live on their Country in the communities of Mulan and Billiluna.
This is a story of water. When Sturt Creek flows from the north, it creates a massive inland Lake among the sandy deserts. Not only is Paruku of national significance for waterbirds, but it has also helped uncover the past climatic and human history of Australia. Paruku's cultural and environmental values inspire Indigenous and other artists, they define the place as an enduring home, and have led to its declaration as an Indigenous Protected Area.
The Walmajarri people of Paruku understand themselves in relation to Country, a coherent whole linking the environment, the people and the Law that governs their lives. These understandings are encompassed by the Waljirri or Dreaming and expressed through the songs, imagery and narratives of enduring traditions. It critically investigates the changing nature and significance of China’s “red classics” at each point of their (re/)emergence in three key areas: their socio-political and ideological import, their aesthetic significance and their function as a mass cultural phenomenon. The book is organised in two parts in chronological order covering the Maoist period and post-Cultural Revolution respectively, and includes a representative range of genres including novels, short stories, films, TV series, picture books (lianhuanhua), animation and traditional style paintings (guohua). The book illuminates important questions such as: What determined what could and could not become a “red classic”? How was the real revolutionary experience of authors shaped by the regime to create “red classic” works? How were traditional forms incorporated or transformed? How did authors and artist negotiate the treacherous waters of changing political demands? And how did the “red classics adapt to a new political environment and a new readership in new millennium China? While most of the chapters focus primarily on one of the two periods under consideration many also follow the fate of their subject through both periods, creating overall a highly coherent overview of the changing phenomenon of the “red classics” over the seventy-five years since the Yan’an Forum and in the process simultaneously tracing the changing dynamic between the CCP and these classic narratives of the communist revolution.

When in 1905 the Polish writer Henryk Sienkiewicz was awarded the Nobel Prize for Literature ‘for outstanding services as an epic writer’, it was his novel Quo vadis. A Narrative of the Time of Nero that motivated the committee to bestow this notable honour. The extraordinary international success of Quo vadis catapulted the author into literary stardom, placing him at the top of international league tables for the sheer quantity of his readers. But, before long, the historical novel began to detach itself from the person of its author and to become a multimedial, mass–culture phenomenon. In the West and East, Quo vadis was adapted for the stage and screen, provided the inspiration for works of music and other genres of literature, was transformed into comic strips and illustrated children’s books, and was cited in advertising and referenced in everyday objects of material culture. No work in English to date has explored in depth the mechanisms that released Quo vadis into mass circulation and the influence that its diverse spin-off forms exercised on other areas of culture—even on the reception and interpretation of the literary text itself. In the context of a robust scholarly interest in the processes of literary adaptation and classical reception, and set alongside the recent emergence of interest in the ‘Ben-Hur tradition’, this volume provides a coherent forum for a much-needed exploration, from various disciplinary and national perspectives, of the multimedial transformations of Quo vadis. Uniquely, also, for its English-speaking readers this collection of essays renders more visible the cultural conquests achieved by Poland on the world map of classical reception.

Any discussion of nineteenth-century religious Dissent must look carefully at gender. Although distinct from one another in important respects, Nonconformist congregations were patterned on the household as the first unit of God-given society, a model which fostered questions about the relationship between male and female. Ideas of gender coalesced with theology and praxis to shape expectations central to the cultural ethos of Nonconformity. Existing historiographical interpretations of gender and religion that use the separate spheres model have argued that evangelical piety was identified with women who were carefully separated from the world, while men needed to be reclaimed for religion. Despite their virtues, these interpretations suppose that evangelicalism was a hegemonic movement about which it is possible to generalize. Yet the unique history and structures of Nonconformity ensured a high degree of particularity. Gender styles were subtly interpreted and negotiated in Dissenting culture over and against the perceived practices and norms of the mainstream, creating what one Methodist called a ‘whole sub-society’ differentiated from worldly patterns in the culture at large. Dissenting men, for instance, deliberately sought to effect coherence between public and private arenas and took inspiration from the published lives of ‘businessmen “saints”’. Feminine piety in Dissent likewise rested on integration, not separation, with women credited with forming godly communities. The insistence on inherent spiritual equality was important to Dissenters and was imaged most clearly in marriage, which transcended the public/private divide and supplied a model for domestic and foreign mission. Missionary work also allowed for the valorization and mobilization of distinctive feminine and masculine types, such as the single woman missionary who bore ‘spiritual offspring’ and the manly adventurer. Over the century, religious revivals in Dissent might shift these patterns somewhat: female roles were notably renegotiated in the Salvation Army, while Holiness revivals stimulated demands for female preaching and women’s religious writing, making bestsellers of writers such as Hannah Whitall Smith. Thus Dissent was characterized throughout the Anglophone world by an emphasis on spiritual equality combined with a sharpened perception of sexual difference, albeit one which was subject to dynamic reformulation throughout the century.

Style has often been understood both too broadly and too narrowly. In consequence, it has not defined a psychologically coherent area of study. In the opening chapter, Hogan first defines style so as to make possible a systematic theoretical account through cognitive and affective science. This definition stresses that style varies by both scope and level—thus, the range of text or texts that may share a style (from a single passage to an historical period) and the components of a work that might involve a shared style (including story, narration, and verbalization). Hogan illustrates the main points of this chapter by reference to several works, prominently Woolf’s Mrs. Dalloway. Subsequent chapters in the first part focus on under-researched aspects of literary style. The second chapter explores the level of story construction for the scope of an authorial canon, treating Shakespeare. The third turns to verbal narration in a single work, Faulkner’s As I Lay Dying. Part two, on film style, begins with another theoretical chapter. It turns, in chapter five, to the perceptual interface in the genre of “painterly” films, examining works by Rodriguez, Mehta, Rohmer, and Husain. The sixth chapter treats the level of plot in the postwar films of Ozu. The remaining film chapter turns to visual narration in a single work, Lu’s Nanjing! Nanjing! The third part addresses theoretical and interpretive issues bearing on style in graphic fiction, with a focus on Spiegelman’s Maus. An Afterword touches briefly on implications of stylistic analysis for political critique.
