L'appel d'offres est un mode de transaction commerciale rattache aux processus d'enchères : le choix du fournisseur se fait au mieux disant. Au niveau international, l'appel d'offres est particulièrement utilisé pour les marchés de projets: dans ce cas le choix se fait plus "au mieux coopérant" qu'au "mieux disant", tant pour les marchés industriels que pour les marchés publics. Le marketing de projets doit donc autant se fonder sur une approche relationnelle que sur une approche concurrentielle de la soumission aux appels d'offres internationaux
Competitive bidding is a means of business transaction related to the auctions group: choice is at first price. On an international level, competitive bidding is especially used for the procurement of projects: in this case choice is at the best partner instead of first price, for both public and industrial contracts. Анотація:

Ce travail de recherche naît du désir de contribuer à enrichir le domaine de l’analyse du discours en explorant des productions peu étudiées jusqu’à présent : les discours de la publicité sociétale. Avec ce terme, nous nous référons à des campagnes ayant pour objectif d’entraver ou promouvoir certains comportements au nom du bien-être collectif, ou de demander un don. Notre corpus se compose de 57 campagnes sociétales, promues en Italie et en France entre 2018 et 2020. Relativement aux thématiques traitées, nous n’avons fixé aucune limite. En ce qui concerne les annonceurs, nous avons examiné des campagnes promues par les institutions publiques, les entreprises privées, et le tiers secteur. Notre questionnement concerne les stratégies discursives employées au sein de ce corpus, très récent et actuel, que nous avons étudié sous un angle comparatif. Notre but était de voir si des analogies ou des différences majeures ressortaient en fonction des thèmes touchés, des annonceurs, des destinataires ciblés et de l’effet visé. L’approche que nous adoptons pour notre analyse relève des sciences du langage et précisément des études sur l’analyse du discours et de l’argumentation, la rhétorique, et la sémantique et pragmatique énonciatives. Afin d’investiguer les messages de notre corpus en appliquant les outils analytiques mis au point par différentes branches des sciences du langage, nous avons élaboré une grille d’analyse qui s’articule sur plusieurs plans : ces angles d’observation, qui ne correspondent pas à une hiérarchisation, sont le plan linguistique, le plan pragmatique inférentiel et illocutoire, et le plan rhétorique
This research aims at enriching the field of critical discourse analysis through the study of messages which have been little explored until now, namely the discourse of social advertising. This term refers to campaigns that ask for a donation, or try to discourage or advocate certain behaviours in the name of public interest. The corpus is made of 57 social campaigns, promoted in Italy and in France between 2018 and 2020. No limit of topic has been fixed. As far as advertisers are concerned, campaigns promoted by public institutions, private companies and non-profit organisations have been analysed. The focus lies on the discourse strategies used in this corpus, which is very recent and has been studied from a comparative point of view. The aim was to see if major similarities or differences would be revealed, depending on the topic, the advertiser, the target and the objective. This research has been carried out from a sociolinguistic perspective, and more specifically from the point of view of critical discourse analysis, argumentation, rhetoric, semantics and pragmatics. In order to examine the corpus chosen, an analysis table has been created, so as to make the most of the resources provided by the different branches of linguistics. This table is organised into three plans – which do not correspond with a hierarchisation –, namely a linguistic plan, a pragmatic plan and a rhetorical plan

In this essay the authors are trying to level the success in the IT-company Apple’s market communication. The problem investigated is if the company’s profile, the picture they are trying to implement onto the market, is the same as the market consider the image of the company to be. The problem is studied in a method which combines both a qualitative and a quantitative survey. A number of people were interviewed and a number of commercials and earlier studies were used. The authors came to the conclusion that Apple’s profile, due to a well performed market strategy, in many ways are equal to the markets image of the company, which this essay hopefully will show.

La finalité de cette étude est de préciser la valeur juridique de l’obligation de mise en concurrence, qui en vertu des dispositions normatives issues du droit communautaire, doit être respectée lors de la passation des contrats de la commande publique. Notre étude démontre que l’obligation de mise en concurrence au statut de l’obligation fonctionnelle dans le cadre de passation des contrats de la commande publique doit être considérée comme un moyen garantissant le respect des principes de la commande publique, ainsi que l’efficacité et la transparence de l’emploi des fonds publics. Elle ne doit pas pour autant être confondue avec le droit de la concurrence, dont l’application en matière est aujourd’hui également acquise. D’une manière plus générale, notre étude démontre que l’introduction des exigences communautaires en droit interne des contrats de la commande publique a eu pour conséquence la remise en cause des fondements mêmes du droit de la commande publique au niveau des définitions, des typologies des contrats, des régimes juridiques, mais également au niveau du contrôle tant juridictionnel, que celui émanant d’autorités indépendantes
The purpose of this study is to define the place of the obligation to put out to competition, which, according to the European Community public procurement laws must be respected during the procedures of public contracts awarding. Our study demonstrates that the obligation to put out to competition is the functional one and it should be considered as the way to guarantee the respect of the public procurement principles, as well as the efficiency and transparency of public funds. The obligation to put out to competition should not be confused with competition law that is also applicable in the field of public procurement. Generally speaking, the present study emphasizes the fact, according to which the introduction of European Community public procurement laws into the French national public procurement law system has influenced the public contracts legal terms, the categories of the public contracts, the procedures for the award of public contracts, as well as the control operated by courts and independent authorities

Анотація:

Digital marknadsföring möjliggör nya sätt att sprida information. Ett problem för företag som erbjuder teknologiska produkter är däremot den stora konkurrensen. Innehållsmarknadsföring ses som ett bättre sätt att nå ut med sitt varumärke till potentiella kunder. Uppsatsens syfte är att undersöka innehållsmarknadsföring i relation till branding, och dessa områdes påverkan påproduktvärde, värde samt lojalitet. Metoden som använts är djupintervjuer av Apple-användare. Studiens resultatet visar främst hur betydelsefull branding är för att skapa en positiv uppfattning av ett varumärkes produkter. Resultatet visar även att innehållsmarknadsföring har en positiv påverkan, men det lyfts inte fram i resultatet som lika viktigt. Främst är det olika former av brandingaktiviteter så som innovation och nya lösningar som ger högt värde. Slutsatsen är att Apple är ett företag som har lyckats skapa premiumprodukter med ett högt produktvärde vilket bidrar till att Apples användare blir lojala kunder.

Cette thèse traite de la dynamique du marché des introductions en bourse et de son effet sur l'investissement dans les nouvelles industries. Après un exposé dans le chapitre 1 des travaux théoriques et empiriques concernant les trois principales régularités observées du marché des IPOs, le chapitre 2 teste l'hypothèse d'une courbe de demande à pente négative sur le marché français pour expliquer la relation décroissante entre le volume d'IPOs contemporaines et la rentabilité initiale individuelle. Le chapitre 3 présente une introduction à l'approche des options réelles utilisée dans le chapitre 4 pour étudier le comportement de timing des introductions en bourse. Une analyse économétrique des principaux enseignements du modèle théorique est ensuite proposée pour les introductions réalisées aux Etats-Unis. Enfin, le chapitre 5 étudie dans quelle mesure l'activité du capital-risque aux Etats-Unis dépend de la performance du marché des introductions non expliquée par les variables réelles de l'économie
This thesis deals with the dynamics of the IPO market and its effect on investment in new industries. After an exposition in chapter 1 of theoritical and empirical studies related to the three main anomalies of the IPO market, chapter 2 tests the hypothesis of a downwards sloping demand curve for the French IPO market to explain the negative relation between contemporaneous IPO volume and individual initial returns. Chapter 3 presents an introduction to the real options approach used in chapter 4 to study to timing of initial public offerings. An econometric analysis of the main propositions of the theoritical model is then proposed for the U. S. Market. Finally, chapter 5 studies to what extent fundraisings by U. S. Venture capitalists depend on IPO market activity not explained by real factors

The purpose of this thesis is to identify deficiencies in the Federal Government's acquisition process through an analysis of ASBCA decisions for the period 1981 through 1985. The study focused upon Department of Defense contract default terminations whose conversion to terminations for the convenience of the Government resulted from Board decisions. The essence of the study was to determine if meaningful conclusions could be drawn from the analysis that could be used to improve the acquisition process. Using this research methodology several deficiencies were found, such as, actions and inactions by the acquisition team that waived the Government's right to subsequently pursue a default termination, lack of communications and basic contract knowledge, inadequate training, and a general misunderstanding of the substantial compliance aspects in contracts requiring first article units. Additional research is required, however this study concluded that analysis of sustained ASBCA appeals could be a useful technique for making improvements to the acquisition process.

Cette thèse explore le lien entre les coûts de transaction, l’asymétrie d’information et les émissions d’actions. Dans un premier temps, nous analysons l’impact de la liquidité des titres sur les caractéristiques des émissions et montrons que celle-ci est un déterminant important du choix de la procédure d’émission. Nous observons que l’émission publique pure et l’émission avec droits garantie sont les procédures les plus chères mais qui améliorent également le plus la liquidité. Dans un second temps, nous analysons le comportement stratégique de la banque garante et des actionnaires au cours de la période de souscription d’une émission avec droits et montrons qu’ils appliquent une pression à la vente sur le marché secondaire des titres générant ainsi des rentabilités anormales négatives. Par ailleurs, nous observons que les droits s’échangent à un prix inférieur à leur valeur intrinsèque. Enfin, nous documentons la présence d’agents informés avant une émission avec droits qui reflètent leurs informations dans leurs ordres contribuant ainsi à l’efficience informationnelle des prix. Ces résultats permettent une meilleure compréhension des échanges informés autour des augmentations de capital et du choix des modalités d’émission
This thesis examines the link between transaction costs, information asymmetry and equity offerings. First we analyze the impact of market liquidity on SEO characteristics and find that liquidity is an important determinant of flotation method choice. We show that pure public offerings and standby rights are the most expensive methods but also more liquidity improving. Second, we document short selling activity by shareholders and underwriters during rights issues leading to significant negative abnormal returns and show that rights tend to be sold below their fair value. Finally, we find evidence of informed trading before rights issues and show that informed traders trade in a direction consistent with their private information, thus, enhancing price efficiency. Our results provide new insights into informed trading as well as flotation method choice

Abstract

Purpose/Aim: My study aims to analyse, using Pierre Bourdieu´s theory, whether the social background plays a significant part in the attitudes and use of Apples mp3-player iPod. The study also aims to determine whether it is possible to group the focus groups used in my study and iPod into Bourdieu´s model.

Material/Method: The reference material used in this paper is mainly gathered from books concerning Pierre Bourdieu´s theories. I have also had four focus groups of two different characters, to study their attitudes towards Apples mp3-player iPod. I have then applied the results of the focus groups to Bourdieu´s theories and models concerning habitus, social fields, capital and lifestyles, and studied whether there are any divergences in attitudes between the groups.

Main results: My findings are that the focus groups as well as iPod can be put into Bourdieu´s model. According to the responses from the people in the focus groups, the attitude and usage of iPod do not mirror people’s social class or background, which goes against Bourdieu´s’ theory. Instead, the taste and attitude towards iPod seem to be based on people’s individual choices, which better ties in with Anthony Gidden’s reasoning. Thus, it seems that Apple have managed to develop a product that attracts people of different social class and background.

Resumo: Na resolução de problemas de engenharia existem diversas metodologias que podem ser aplicadas. Normalmente, estas envolvem novos conceitos, as vezes inéditos em termos de aplicação como é o caso da teoria dos jogos. Por outro lado, pesquisadores vêm buscando novas técnicas para o desenvolvimento de ferramentas computacionais para o auxílio no processo ensino- aprendizado em diferentes níveis. Nesta dissertação apresenta-se um simulador computacional que apresenta uma interface gráfica, denominada ENGTJ, como proposta para o ensino de conceitos básicos da teoria dos jogos, via Web. Os conceitos relacionados com a teoria dos jogos , são apresentados sob forma de exemplos, no contexto dos jogos não-cooperativos e cooperativos, com os módulos do Jogo Dilema do Prisioneiro (JDP) e o Jogo Coalizacional entre Empresas (JCE). Estes módulos foram desenvolvidos utilizando-se a linguagem de programação Java, sob a forma de Java applets, com o auxílio do ambiente de desenvolvimento Eclipse. O processo de desenvolvimento de software baseado nos padrões de engenharia de software foi utilizado para criar a interface da aplicação, e apresenta uma série de técnicas e atividades que procuram dar suporte a definição de processos de desenvolvimento, levantamento e especificação de requisitos, projeto e testes. Como resultado, tem-se uma interface gráfica que permite ao usuário interagir através de jogos modulares referentes a teoria dos jogos, permitindo ao mesmo inferir alguns conceitos básicos abordados nesta teoria, suportada por tutoriais, geral e específicos
Abstract: In solving engineering problems there are several methodologies that can be applied. Typically, these methods involve new concepts, sometimes unprecedented in terms of application as game theory. Moreover, researchers are seeking new techniques to develop computational tools to aid in the teaching-learning at different levels. This paper presents a computational simulator that presents a graphical interface, called ENGTJ, as proposed for teaching basic concepts of game theory, through Web. The game theory concepts are presented using examples, in the context of non-cooperative games and cooperative, especially the Prisoner's Dilemma Game (JDP) and the Coalitional Games between Companies (JCE). These modules were developed using the Java programming language, under "Java applets" form with the Eclipse developing environ- ment. The software development process based on software engineering patterns was used to create an application interface combining several techniques and activities that could support the developing procedures, requirements, projects and tests. I denna uppsats har jag ämnat göra en kritisk fallstudie av Apples riskkommunikation kring iPhone 5c och dess miljöpåverkan. Detta innefattar ett holistiskt perspektiv av informations- och kommunikationsteknik i vardagen som medievetenskapen börjat inkludera allt mer. Det är vidare också ett exempel på hur utvecklingen av medietekniken börjat få en allt större uppmärksamhet. Främst från teknikjournalister men också, som redovisat i denna uppsats, från medieteoretiker. Anmärkningar och synpunkter som handlar om att dagens medieteknik hade kunnat göras miljövänligare än vad den gjorts. I denna studie har jag ämnat utforska och besvara frågan: – Hur kommuniceras iPhone 5c:s livscykel och hur kan denna kommunikation sättas i förhållande till den kritik som riktats mot dagens informations- och kommunikationsteknik? Genom att ha undersökt och samlat ihop de källor som behandlat kritiken inom miljö- och medieforskningen, har jag i denna uppsats kunnat värdera men inte avgöra slutgiltigt hur detta förhållande ser ut. Snarare har min uppsats inneburit en kritisk granskning som kan påbörja att belysa dessa komplexa samband. Jonas Jonsson skriver om företags olika kommunikationsstrategier där företag kommunicerar ut sin verksamhet för att bejaka kraven från allmänheten (Larsson, 2008:135), men hur ska allmänheten veta vilka krav som ska/kan ställas på företagen? De ny-materiella medieteoretikerna har bevisat att det finns ett flertal ouppmärksammade faktorer som företagen borde ta hänsyn till (Parikka 2012:3). Med större spridning av denna kunskap kan vi bredda vår förståelsehorisont och hjälpa varandra att tillsammans ställa högre krav på företagen. Det jag kommit fram till är att det finns ett flertal problematiska faktorer och att iPhone 5c kanske inte är så miljövänlig som Apple påstått. Deras produktion må vara mer miljövänlig än andra företags, trots detta vill jag poängtera att studier som denna är viktig - speciellt då de visar på att företag definitivt kan göra mer än vad de påstår sig göra. The purpose of this essay is to show how femininity is construed in a visual hipster discourse. The material used mainly consists of four adverts from the fashion company American Apparel and four blogs with the word hipster in the title. The method used is inspired by semiotics and discourse analysis and the theory is based on feminist visual culture. Focus is placed on both a deep analysis of the images and texts individually, and a review of the discourse and context in which they interact, in order to discover how femininity is construed among hipsters. Throughout the course of the analysis, gender and sexuality is a consistent focus and leads to other aspects related to power not being prioritised. The analysis section is divided into two main areas of focus where American Apparel is the first part and the hipster blogs the other. Each section begins with an analysis of images and text and is concluded with a summary. In the concluding discussion, it becomes clear that sexist images are used to represent women primarily by American Apparel, but this stereotype is also apparent in the blogs. It is also clear from the analysis of the material that unique and alternative fashion is promoted. Rather than re-contextualising femininity, the traditional objectification of women is hidden behind the hipster ideal. The essay concludes with several brief thoughts and discussion on whether it is possible to apply this ideal of women on a larger part of society than just hipsters.

Von 2003 bis 2011 wurden 65 Apfelsorten und Mutanten im Rahmen einer Sortensichtung am Standort Dresden-Pillnitz getestet, um geeignete Sorten für die notwendige Erneuerung der Sortenstruktur im sächsischen Erwerbsobstbau zu ermitteln. Neben Erhebungen zum Blühverhalten, zum Ertrag, zur Farb- und Größensortierung der Früchte sowie zur Lagerfähigkeit wurden wertgebende Inhaltsstoffe bestimmt und der Geschmack bewertet. Ergänzend dazu erfolgten Kundenbefragungen zum Kaufverhalten. Grenzwerte zur Bestimmung des optimalen Erntetermins von bekannten und neuen Sorten wurden aktualisiert bzw. neu aufgenommen. Im Ergebnis können zwei Sommer-, vier Herbst- und vier Lagersorten oder Mutanten für den Intensivobstanbau in Sachsen empfohlen werden.

The transformation of the Swedish Armed Forces is bringing about major changes in many areas. Indirect fire is one capability affected by these changes. Financial savings, a shrinking organization and higher eligibility requirements mean that fewer soldiers will gain access to exclusive high-tech support resources such as the JAS 39 Gripen aircraft and the ARCHER artillery system. This thesis aims to examine whether access to indirect fire capability can be increased through the use of civilian products and communication networks. Technology development in the civilian mobile communications area is exponential and nations such as the USA, facing challenges similar to those of the Swedish Armed Forces, devote substantial resources to research and development. Is the use of mobile phones for military purposes the innovation needed by the Swedish Armed Forces, do the necessary technical conditions exist and is the technology applicable during peace and wartime operations? The results indicate that the military use of commercial technology is too low at the moment, but that the technology itself sets no limits, and that there is a need and a demand to develop military mobile apps. The robustness of commercial networks does not meet Armed Forces’ requirements and the Armed Forces need a clear strategy that states the aims and objectives before procurement and implementation is possible. The results show further that, regardless of the challenges identified, there are good reasons to continue to pursue these issues in order to build up experience and knowledge in this area of technology. The development of civil mobile phone technology for military purposes will mean that there is an economically viable resource to use in the future.

I denna studie undersöks i vilken utsträckning som teknikföretaget Apple syns i storstadspressen. För att göra detta har produkten Iphone 4S och konkurrenten Samsungs produkt Samsung Galaxy S II valts ut, eftersom båda lanserats samma år och riktar sig till samma målgrupp, i egenskap av att båda är så kallade “smartphones” med fingerstyrning och i övrigt likvärdiga funktioner.De storstadstidningar som undersökts är DN, SvD, Expressen, Aftonbladet, Göteborgs-Posten, Metro och Dagens Industri, eftersom de är de största tidningarna inom den svenska storstadspressen. Med hjälp av en kvantitativ undersökning har mängden artiklar som publicerades för vardera produkten under fyra veckor i samband med deras respektive lanseringar på den svenska marknaden undersökts. Resultatet visar att Iphone 4S förekom i betydligt större utsträckning än Galaxy S II.Vidare undersöks hur texterna i storstadspressen förhåller sig till Pressens samarbetsnämnds spelregler, det vill säga kriterier för vad som kan anses vara textreklam. Resultaten visar att flera av texterna bryter mot kriterierna i spelreglerna och passerar gränsen för vad som kan anses vara opartisk journalistik. I undersökningens slutsats ställs resultaten mot tre teorier: dagordningsteorin, innovationsteorin samt Gartners hypekurva.När resultaten granskats utifrån genre på artiklarna så kan det noteras att merparten av de fällda artiklarna var antingen notiser eller krönikor. Vanliga nyhetsartiklar förhöll sig oftast till spelreglerna.

Анотація:

Teams are being used more in organizations to do important work. However, both positive and negative effects come with the increased use of teams. One problem is the "bad apple" effect where a highly disagreeable team mate, for example, damages team performance. This research aims to study how this person damages team performance and what can be done to minimize the negative impact. I propose that a disagreeable teammate negatively impacts team affective states which in turn give rise to defensive behaviors among teammates. These defensive behaviors impact team processes which in turn impact the team's performance. In addition, I propose that team interdependence moderates the impact of disagreeableness on teammate affective reactions such that teammates in less interdependent contexts will react less negatively to the "bad apple." I designed a 2x2 lab experiment with a confederate, or trained research participant, to test these hypotheses. I manipulated disagreeableness through the behaviors of the confederate and I manipulated interdependence through the information, goals, and rewards of the teams. Results support all the hypothesized relationships. Of note, I found that interdependence interacted with disagreeableness to predict team affective reactions as measured by salivary cortisol - a well established biomarker for affective reactions. I also found support for a mediating model using team core affect or affective culture mediating the impact of disagreeableness on team process. Finally, I found support for a mediated moderation model demonstrating that the moderation of interdependence and disagreeableness on team process was mediated by team cortisol. However, the impact on process was in the opposite direction than expected. Namely, that more interdependent teams had higher processes despite elevated cortisol levels indicating a negative affective, or stress reaction. This counterintuitive finding has implications for future research attempting to discover useful methods of minimizing the impact of a disagreeable teammate on the team.

This research considers the potential motivations of using a social app for the realization of donations and probe the symbolic interactions that occur during solidarity exchanges mediated by technology. Smartphones and their applications are inseparable increasingly part of the daily lives of people who spend all their time with their devices: always on, always connected, as close as the shirt itself. Applications for mobile devices -apps- are the software installed in these smartphones that perform or assist in performing tasks for their users. Among the tools that the various types of apps present, there is a category of social apps, which are those facing a social cause. The conducted study noted when addressing the social application Solidarius, created for realization of donations to the group of welfare Sociedade S??o Vicente de Paulo, Vicentinos, which by enabling the realization of solidarity mediated by technology, materializes a new type of solidarity , anonymous, but allows the existence of a link, which excludes the direct involvement with people in common vulnerability in voluntary actions, but allows the user a sense of belonging, even if momentarily, to a larger institution or cause himself, and generate feelings of satisfaction and gratitude. These observations were made possible by the bibliography study published on the subject, the data analysis and information gathered during interviews with the developers of social application on screen and representatives of the institution that it will use, and the above discussion in focus group held with potential users of the application. As a result, to be detailed in subsequent research, it was realized that social applications allow its users an empowerment, regarding the perception that are interfering with reality and contributing to a cause, and that the technology of apps, for convenience, ease and closeness they have with the user, can be instruments of social change.

Creating websites providing dynamic services is an extensive process. Intelligent systems are used to create websites with dynamic services. Current intelligent systems are hard to use and configure by the average user. The generated websites are usually custom built to solve one problem and cannot be fully customizable for users on different environments. This thesis presents a technological solution that enables the average user to create websites with dynamic services by providing a number of parameters. The website generator is a web-based application that generates all the components of the website. The components act as portlets and the generated website will be the portal application. The data engine generator creates the website's underlying database. To enable distributed enterprise/business architecture, the data engine generator records the metadata about the database and the website to be generated. The website generator is a cost effective, dynamic, secure, reliable, and scalable solution that outperforms current website generators and portal applications.

The present study proposes the development of electrospun fibrous membranes with high selectivity and affinity for patulin retention throughout the apple juice clarification process. Nanostructured bi- and tridimensional materials can be obtained by electrospinning with very large surface-to-volume ratio, high porosity and interconnectivity, making them very attractive for a large number of applications including separation processes. Other remarkable methodology is the molecular imprinting. This is a technique that creates molecularly imprinted cavities with memory capacity from the interaction between a template molecule and a functional monomer or polymer segment for binding specific target molecules. The main objective of this work is the development of new nanofibrous membranes with affinity and performance to remove patulin from apple juice during its processing. The strategy implemented to reach the proposed objective combines molecular imprinting and electrospinning processes. The main polymer poly(ethylene terephthalate) (PET) was blended with chitosan (Chi) and polyallylamine (PAA) to constitute the base of electrospun membranes. The patulin analogs, 6-hydroxynicotinic acid and 5-indanol, were used as template molecules for molecular imprinting and thereby enhance retention capacity of the non-woven electrospun fibrous membranes. The clean-up of patulin analogs reached retention levels of 10 % by PET-Chi membranes and 80 % by PET-PAA membranes. Furthermore, the PET-Chi membranes demonstrated high stability and improved mechanical properties when compared with those of PET alone and good performance as a filter for juice clarification.
O presente estudo propõe o desenvolvimento de membranas nanofibrosas com elevada afinidade e seletividade para a retenção de micotoxinas durante o processo de clarificação do sumo de maçã. Através de electrofiação obtém-se nanomateriais bi- e tridimensionais com alto rácio superfície-volume, elevada porosidade e interconectividade, características que potenciam a aplicação destes materiais em inúmeras áreas incluindo em processos de separação. Outra metodologia aplicada neste estudo foi a impressão molecular. Esta técnica permite a criação de cavidades molecularmente impressas a partir da interação entre a molécula molde e o monómero ou polímero funcional para a ligação especifica de determinada molécula alvo. O principal objectivo deste trabalho é o desenvolvimento de novas membranas com afinidade e performance para a remoção da patulina durante o processamento do sumo de maçã. As estratégias implementadas para alcançar este propósito combinam os dois processos anteriores: electrofiação e impressão molecular. O polímero poli(etileno tereftalato) (PET) serviu de base para a formação da membrana fibrosa por electrofiação, na qual foram incorporados outros polímeros como a quitosana (Q) e a polialilamina (PAA). Por sua vez, os análogos da patulina - ácido 6- hidroxinicotinico e 5-indanol - foram usados como moléculas molde para a impressão molecular de modo a aumentar a capacidade de retenção das membranas nanofibrosas. Deste modo, foram alcançados níveis de retenção dos análogos da patulina de 10 % para as membranas PET/quitosana e de 80 % para as membranas PET/PAA. Para além disso, as membranas PET/quitosana demonstraram elevada estabilidade com melhoria das propriedades mecânicas face à membrana de PET e também apresentaram boa performance como filtro para a clarificação do sumo de maçã.

Specific assumptions have the jurisprudential harvest, normative, legalistic and constitutional, provided for in art. 896 of the Labor Code. So it remains therefore direct the course of this work, for specific assumptions (= art. 896 of the Labor Code) of admissibility of review appeal. Como se trata de uma instância extraordinária foram criados pré-requisitos para esse conhecimento. Ao recurso de revista se aplicam os pressupostos recursais genéricos, pertencentes a todos os recursos, e mais os específicos de cabimento da medida. Como genéricos tem-se: Sucumbência, representação, preparo e tempestividade. This research explores how probation officers utilise certain aspects of attachment theory as they supervise service users in the community. An action research methodology was used to follow the work of a sample of probation officers over a six month period, focusing on four key attachment based themes. A selection of cases were followed and the discussions between researcher and participants analysed. The findings supported the idea that a probation officer could come to represent something of a secure base to their service users, and demonstrated how attachment histories could be used constructively in supervision. However, the concepts of mentalization and the reflective function had only limited utility, and that of attachment style very little at all. The evidence suggested that the first two concepts were sufficiently digestible and memorable to be applied by non-specialists, whereas the latter two concepts had too many theoretical ambiguities to be useful or offer anything unique to practice. There was an absence of formal theoretical terminology in the practitioners' discussions, and the process by which theory featured in practice resembled that of practice wisdom. The data for this project was gathered at the end of 2013 and the beginning of 2014, and soon afterwards the Probation Service in England and Wales underwent a restructuring; it is not clear if the Probation Service/Community Rehabilitation Companies of the future will allow the type of practice described by the practitioners here.

This study proposes to critically analyze the mechanisms implemented as a result of reforms in the Brazilian civil procedure in the last two decades, that aims to standardize court decisions and expedite procedure. The study sustains that , given the conditions under which the Law operates in contemporary society, these mechanisms are unusable to provide court decisions with predictability nor certainty, because these mechanisms tends to become, themselves, a source of uncertainty and unpredictability. Mechanisms of court decisions standardization, such as the Brazilian binding precedent ( súmula vinculante ), depends upon proceedings and legal requirements that undermine the autonomy of the Legal System s operational code, which exposes the system to attacks from the code of other systems, such as Economy and Politic. Mechanisms to expedite proceedings, such as the Court s monocratic ruling by the reporting Justice, by their turn, engender losses in the system s capacity to legitimate judicial decisions by means of the legal proceeding, which also generates uncertainty regarding the social adequacy of the judicial decision. The present work uses Niklas Luhmann s system theory to describe the conditions under which the Law operates in the society, as well as the interrelated Guilherme Leite Gonçalves s thesis, also based upon system theory, to whom problems related to certainty of Law arises out of modern society s semantic inadequacy to describe a society that no longer can count on the old metaphysic certainty centers of the pre-modern societies. The application of the system theory to the Brazilian s Judiciary is based upon Celso Fernandes Campilongo and Orlando Villas Bôas Filho s theoretical approaches, according to which Brazilian Law is a case of an autopoietic system, to which the system theory may be applied, and that suffers with the overload of burdens arising from its environment and hardship to protect the system s center (the Courts) from such burden, which jeopardize the system s autonomy. With this instrumental, the study analyzes the history of the control mechanisms of Court s interpretation of the Law, upon which standardization of Court decisions is based, as well as its main theoretical references, such as common Law s stare decisis et non quite movere and the recent jurisprudence on equality on the application of Law and the right to a expedite trial
Este trabalho propõe uma análise crítica dos mecanismos de uniformização de jurisprudência e de aceleração do procedimento processual implementados pelas reformas no processo civil brasileiro nas últimas duas décadas. Defende-se que, nas condições em que o direito da sociedade contemporânea opera, esses mecanismos não são capazes de propiciar previsibilidade para as decisões judiciais nem certeza do direito, uma vez que eles próprios tendem a se transformar em fontes de incerteza e imprevisibilidade. Mecanismos de uniformização de jurisprudência, como a súmula vinculante, dependem de procedimentos e requisitos que minam a autonomia do código operacional do sistema jurídico, expondo o sistema a investidas de outros sistemas, como a política e a economia. Por sua vez, mecanismos de aceleração do procedimento, como os julgamentos monocráticos pelo relator, importam em perdas na capacidade de legitimar as decisões pelo procedimento, gerando também mais incerteza com relação à adequação social da decisão judicial. O trabalho faz uso do instrumental da teoria dos sistemas de Niklas Luhmann para descrever as condições em que o direito opera na sociedade, bem como da correlata proposta de Guilherme Leite Gonçalves, igualmente baseada na teoria dos sistemas, para quem os problemas de certeza do direito decorrem da inaptidão da semântica da sociedade moderna para descrever uma sociedade que já não conta com os antigos centros de certeza metafísicos das sociedades pré-modernas. Para aplicar o instrumental sistêmico ao Poder Judiciário brasileiro, faço uso das propostas de Celso Fernandes Campilongo e Orlando Villas Bôas Filho, que consideram o direito brasileiro um caso de sistema autopoiético, ao qual a teoria dos sistemas pode ser aplicada e que sofre com a sobrecarga de demandas do ambiente e dificuldade de proteger o centro do sistema (os tribunais) do ônus de lidar com essas demandas, pondo em risco a autonomia do sistema. Dans un avion, un hélicoptère ou un lanceur actuel, des milliers de capteurs, pour la plupart non critiques sont utilisés pour la mesure de divers paramètres (températures, pressions, positions...) Les résultats sont ensuite acheminés par des fils vers les calculateurs de bord qui les traitent. Ceci implique la mise en place de centaines de kilomètres de câbles (500 km pour un avion de ligne) dont le volume est considérable. Il en résulte une grande complexité de conception et de fabrication, des problèmes de fiabilité, notamment au niveau des connexions, et une masse importante. Par ailleurs l'instrumentation de certaines zones est impossible car leur câblage est difficilement envisageable par manque d'espace. En outre, s'il est souvent intéressant d'installer de nouveaux capteurs pour faire évoluer un aéronef ancien, l'installation des câbles nécessaires implique un démantèlement partiel, problématique et coûteux, de l'appareil. Pour résoudre ces problèmes, une idée innovante a émergé chez les industriels de l'aéronautique : commencer à remplacer les réseaux filaires reliant les capteurs d'un aéronef et leur centre de décision par des réseaux sans fil. Les technologies de communication sans fil sont aujourd'hui largement utilisées dans les marchés de l'électronique de grande consommation. Elles commencent également à être déployées pour des applications industrielles comme l'automobile ou le relevé à distance de compteurs domestiques. Cependant, remplacer des câbles par des ondes représente un défi technologique considérable comme la propagation en milieu confiné, la sécurité, la sureté de fonctionnement, la fiabilité ou la compatibilité électromagnétique. Cette thèse est motivée d'une part par l'avancée non négligeable dans le milieu aérospatial que pourrait être l'établissement d'un réseau sans fil à bord d'aéronefs dans la résolution de problématique classiques comme l'allégement et l'instrumentation. Il en résulterait donc : * Une meilleure connaissance de l'environnement et de la santé de l'aéronef * Un gain sur le poids. * Un gain en flexibilité. * Un gain en malléabilité et en évolutivité. * Un gain sur la complexité. * Un gain sur la fiabilité D'autre part, étant donnée la complexité de la conception de ce réseau de capteur sans fil, il a été nécessaire d'appliquer une méthodologie évolutive et adaptée mais inspirée de l'ingénierie système. Il est envisageable, vu le nombre de sous-systèmes à considérer, que cette méthodologie soit réutilisable pour d'autre cas pratiques. Une étude aussi complète que possible a été réalisée autour de l'existant déjà établi sur le sujet. En effet, on peut en lisant ce mémoire de thèse avoir une idée assez précise de ce qui a été fait. Une liste a été dressée de toutes les technologies sans fil en indiquant leur état de maturité, leurs avantages et leurs inconvénients afin de préciser les choix possibles et les raisons de ces choix. Des projets de capteurs sans fil ont été réalisés, des technologies sans fil performantes et personnalisables ont été développées et arrivent à maturité dans des secteurs variés tels que la domotique, la santé, l'automobile ou même l'aéronautique. Cependant aucun capteur sans fil n'a été véritablement installé en milieu aérospatial car de nombreux verrous technologiques n'ont pas été levés. Fort des expériences passées, et de la maturité qu'ont prise certaines technologies, des conclusions ont été tirées des projets antérieurs afin de tendre vers des solutions plus viables. Une fois identifiés, les verrous technologiques ont été isolés. Une personnalisation de notre solution a été à envisager afin de remédier tant que faire se peut à ces points bloquants avec les moyens mis à disposition. La méthodologie appliquée nous a permis d'identifier un maximum de contraintes, besoins et exigences pour mieux focaliser les efforts d'innovation sur les plus importantes et choisir ainsi les technologies les plus indiquées.

O marketing social aplica as técnicas de marketing a causas sociais de diferentes áreas, como a prevenção de doenças, a luta contra a violência doméstica e contra o tabaco, a prevenção do meio ambiente, a segurança rodoviária e infantil, entre outras, com o objetivo de influenciar a mudança de comportamentos e atitudes dos indivíduos. A publicidade social procura construir mensagens objetivas e eficazes para influenciar as mudanças de comportamento desejadas através de apelos que utilizam um tom emocional, através do estímulo de emoções negativas, como o medo, ou positivas, como a felicidade, ou um tom informativo, que fornece informações e factos sem estímulo de emoção. As teorias Health Belief Model e Regulatory Focus Theory são utilizadas de forma a prever como a persuasão dos anúncios de marketing social pode ser eficaz na motivação para atingir benefícios ou evitar riscos individuais ou coletivos, mas é notável que não existe um consenso a nível teórico quanto ao tom dos apelos mais eficaz – entre apelos emocionais, informativos ou a conjugação dos dois tons de apelo. A presente investigação tem como objetivo analisar a prevalência dos tons emocional versus informativo nas campanhas de marketing social sendo que já se verificaram muitos estudos sobre a eficácia do uso destes tons mas pouco se sabe acerca da prevalência deles nas mensagens dos anúncios. Assim sendo, a partir da análise da prevalência do tom emocional versus informativo pretende-se perceber como os estrategas de marketing estão a utilizar o tom dos apelos e se o estão a fazer de acordo com as evidências de eficácia descritas na literatura. Para realizar este estudo determinou-se como unidade de análise as campanhas de marketing social desenvolvidas em Portugal. Recolheram-se 40 vídeos publicitários de marketing social presentes nos canais de YouTube de Organizações Governamentais e Não Governamentais portuguesas. Através de uma análise de conteúdo classificou-se 25 como campanhas de tom informativo, 8 de tom emocional e 7 de tom misto. Os resultados da investigação demonstram que há uma preferência pelo uso do tom informativo nas campanhas de marketing social em Portugal e que, principalmente nos temas de prevenção, estas não seguem as recomendações teóricas que defendem um tom emocional. Esta análise mostra que há uma discordância entre a prática do uso do tom dos apelos e a teoria quanto à eficácia do uso destes tons, sugerindo que em futuras investigações se estude os motivos desta discrepância.
Social marketing applies marketing techniques to social causes in different areas, such as disease prevention, domestic violence, anti-smoking, environmental prevention, road and child safety, among others, with the objective of influence behavior and attitude changes. Social advertising seeks to construct objective and effective messages to influence desired behavior changes through appeals that use an emotional tone, through the stimulation of negative emotions, such as fear, or positive emotions, such as happiness, or an informative tone, which provides information and facts without any stimulus of emotion. The Health Belief Model and The Regulatory Focus Theory are used to predict how the persuasion of social marketing ads can be effective in motivating people to achieve benefits or avoiding individual or collective risks, but it’s notable that there is no theoretical consensus regarding the efficiency of the appeals – between emotional and informational appeals or the combination of the two tones appeal. The present research aims to analyze the prevalence of emotional versus informative appeals in social marketing campaigns, being that there have been numerous studies on the effectiveness of the use of these tones but little is known about their prevalence in ad messages. Thus, from the analysis of the prevalence of emotional versus informative tone, we intend to understand how marketing strategists are using the tone of the appeals and if they are doing it according to the efficacy evidence described in the literature. To perform this study it was determined as unit of analysis the social marketing campaigns developed in Portugal. Were collected 40 social marketing advertising videos on the YouTube channels of Portuguese Governmental and Non-Governmental Organizations. Through a content analysis we classified 25 with the informational tone, 8 with emotional tone and 7 with mixed tone. The results of the research demonstrate that there is a preference for the use of informational tone in social marketing campaigns in Portugal and that, mainly on prevention issues, these don’t follow theoretical recommendations that defend an emotional tone. This analysis shows that there is a disagreement between the practice of using the tone of the calls and the theory as to the effectiveness of the use of these tones, suggesting that in future investigations the reasons for that discrepancy will be studied.

Though the field of LGBT literary studies has expanded to a certain extent, the LGBT community is continuing to fight for their equal social rights. This thesis aims to address LGBT literature through an interdisciplinary approach, hoping to open up new research perspectives in limited amount of LGBT related texts. There are a lot of symbols in LGBT texts. Authors assign abundant meanings to these symbols, making them the media of resistance in texts when they face oppression from the society. In Dong Qizhang’s “Androgyny” and Qiu Miaojin’s “Notes of a Crocodile,” both authors use reptilian symbols, lizard and crocodile respectively, to signify homosexual people. If we relate the reptilian symbols in literary works to biological discourses, including biological perspectives in textual analysis, these discourses may provide LGBT literature in 1990s with the agency to resist gender frames. LGBT communities in the texts are described as unnatural deformed creatures. However, considering the theory of evolution mentioned in the texts, LGBT communities’ ability to break down gender norms is advantageous for evolution. Both Dong and Qiu use the biological theory of evolution and reptilian symbols to depict the course of forming gender identity and this is the strategy of gender politics shown in texts when they are oppressed by the society.

Le présent mémoire est consacré à l'étude de l'obligation faite à l'État canadien de consulter les autochtones lorsqu'il envisage de prendre des mesures portant atteinte à leurs droits et intérêts. On s'y interroge sur le sens que peut avoir cette obligation, si elle n'inclut pas celle de s'entendre avec les autochtones. Notre étude retrace d'abord l'évolution de l'obligation de consulter dans la jurisprudence de la Cour suprême du Canada, pour se pencher ensuite sur l'élaboration d'un modèle théorique du processus consultatif. En observant la manière dont la jurisprudence relative aux droits ancestraux a donné naissance à l'obligation de consulter, on constate que c'est en s'approchant au plus près de l'idée d'autonomie gouvernementale autochtone - soit en définissant le titre ancestral, droit autochtone à la terre elle-même - que la Cour a senti le besoin de développer la consultation en tant que véritable outil de dialogue entre l'État et les Premières nations. Or, pour assurer la participation réelle des parties au processus de consultation, la Cour a ensuite dû balancer leur rapport de forces, ce qu'elle a fait en admettant le manque de légitimité du pouvoir étatique sur les autochtones. C'est ainsi qu'après avoir donné naissance au processus de consultation, la jurisprudence relative aux droits ancestraux pourrait à son tour être modifiée substantiellement par son entremise. En effet, l'égalité qu'il commande remet en question l'approche culturaliste de la Cour aux droits ancestraux, et pourrait l'amener à refonder ces droits dans le principe plus égalitaire de continuité des ordres juridiques autochtones. Contrairement à l'approche culturaliste actuelle, ce principe fait place à la reconnaissance juridique de l'autonomie gouvernementale autochtone. La logique interne égalitaire du processus de consultation ayant ainsi été exposée, elle fait ensuite l'objet d'une plus ample analyse. On se demande d'abord comment concevoir cette logique sur le plan théorique. Ceci exige d'ancrer la consultation, en tant qu'institution juridique, dans une certaine vision du droit. Nous adoptons ici celle de Lon Fuller, riche de sens pour nos fins. Puis, nous explicitons les principes structurants du processus consultatif. Il appert de cette réflexion que l'effectivité de la consultation dépend de la qualité du dialogue qu'elle engendre entre les parties. Si elle respecte sa morale inhérente, la consultation peut générer une relation morale unique entre les autochtones et l'État canadien. Cette relation de reconnaissance mutuelle est une relation de don.
In this essay, we study the Canadian State's duty to consult Aboriginal peoples when it purports to infringe on their rights and interests. We start with the following question: What meaning, if any, does the duty to consult have, if it does not include a duty to reach a consensus ? Our study is divided in two parts. First, we trace the evolution of the duty to consult in the decisions of the Supreme Court of Canada. Secondly, we discuss a theoretical model for the consultation process. Our study of the genesis and subsequent evolution of the duty to consult reveals that this duty gains some ambit when the Court is called upon to define the notion of aboriginal title - the type of aboriginal right that cornes closest to full aboriginal self-government on a piece of land. In its effort to construct the consultation process, the Court soon realizes that if it wants both parties to really engage in it, it has to balance their relationship, something the Court does by admitting the State's lack of legitimate authority over the Aboriginals. But affirming the equal status of both parties in the consultation process leads to further consequences than the mere effectiveness of that process. Aboriginal equality does not fit weIl within the Court's cultural approach to aboriginal rights. The common law doctrine of continuity of the aboriginal legal orders is more congenial to that equality, as it leads naturally to the legal recognition of a measure of aboriginal autonomy within Canada. Thus, after giving birth to the consultation process, the law of aboriginal rights could itself be substantially modified through the logical implications of its own offspring. Having exposed the egalitarian logic inherent to the consultation process, we proceed to study that logic in further detail. We ground our quest for the inherent structure of consultation in a larger understanding of the law itself, which proceeds from Lon Fuller' s view of law as facilitating human interaction. We then discuss the principles that give content to a consultation process directed to achieve reconciliation. Effective consultation depends on the quality of the dialogue that it generates. Appropriately conceived and implemented, the consultation process between Aboriginal peoples and the State embodies a unique moral relationship, one of mutual recognition, capturing the' spirit of giving'.

This work aims to relate the organoleptic characteristics of the "Alcobaça Apple”, evaluated qualitatively and quantitatively through instrumental methods (°Brix, firmness, color and dry matter content) and sensory methods (appearance of the fruit and pulp, texture, sweetness, acidity and flavor) with the attitudes of consumers to the product, analyzed using a survey which seeks to identify the type of product in the market for apples and consumer preferences for the three varieties of apples (Golden Delicious, Jonagold and Royal Gala).We can verify that the storage time is the problem that has greater influence on the quality of apples. The varieties studied in this work have a good acceptance in the Portuguese market, as indicated by surveys and there is increasing tendency for consumers to prefer traditional products with authenticity. Analysis of three seasons indicate that consumers found taste, flavor and sweetness as essential attributes that apples should have, while in the sensory analysis panelists consider these essential parameters for the consumption of the varieties tested. Regarding acidity consumers prefer apples with low acidity. Looking forward, and to ensure quality, specificity and traditionality of the apples of “Alcobaça”, it should be used a protected designation of origin (IGP), which appears to the consumer as a safe alternative.---------------------------------O presente trabalho tem como objectivo relacionar as características organolépticas da “Maçã de Alcobaça”, avaliadas qualitativa e quantitativamente através de métodos instrumentais (ºBrix, dureza, cor e teor de matéria seca) e sensoriais (aparência do fruto e da polpa, textura, doçura, acidez e sabor) com as atitudes do consumidor face ao produto, analisadas através de um inquérito com o qual se pretende identificar a tipologia do produto no mercado da maçã, bem como as preferências dos consumidores, relativamente a três variedades de maçãs (Golden Delicious, Jonagold e Royal Gala). Podemos verificar que o tempo de armazenamento é o factor que maior influência tem na qualidade das maçãs. As variedades estudadas no presente trabalho têm uma boa aceitação no mercado Português, tal como indicado pelos inquéritos e há cada vez mais tendência para os consumidores preferirem produtos tradicionais com autenticidade. Da análise realizada nas três épocas aos consumidores foi constatado que o sabor, o aroma e a doçura são atributos fundamentais que as maçãs devem ter. Também na análise sensorial os provadores consideram estes parâmetros essências para o consumo das variedades testadas. Em relação à acidez os provadores preferem maçãs com acidez baixa. Conhecimento prévio: A dor lombar (LBP) é um problema de saúde pública com um impacto substancial na capacidade funcional do indivíduo e nas suas atividades de vida diária. O tratamento da LBP é desafiador e complexo e, por isso, requer novas abordagens que promovam uma reabilitação de qualidade, segura e de baixo custo.Objetivo: O objetivo deste estudo é fornecer uma visão geral da evidência disponível e avaliar se os estudos incluídos seguem uma estrutura comum e homogénea que permita avaliar o impacto da utilização de apps e intervenções baseadas na web na auto gestão da dor lombar.Materiais e Métodos: As bases de dados eletrónicas PubMed/Medline, PubMed Central (PMC), PubMed Health, Cochrane CENTRAL e PEDro foram pesquisadas de 2007 até dezembro de 2017. A estratégia de pesquisa incluiu o uso de termos MESH e termos de texto livre, combinando 3 conceitos: LBP, aplicações móveis e autocuidado/autogestão. Foram incluídos ensaios de controlo randomizado (RCTs) e protocolos de RCTs, que usam apps ou intervenções baseadas na web como parte do tratamento para doentes com LBP. Resultados: Um total de 17 artigos relativos a 14 estudos diferentes - 9 ensaios de controlo randomizado e 8 protocolos de RCTs - cumpriram os critérios de inclusão. Os nove RCTs incluíram um total de 1659 participantes, variando de 51 a 398 participantes por estudo. A maioria dos participantes eram mulheres com níveis educacionais elevados (faculdade parcial ou superior). Nenhum estudo analisou a utilização dos cuidados de saúde. Três estudos utilizaram uma app, acessível a partir de vários dispositivos. Elementos interativos foram relatados em todos os estudos.Conclusões: Foi fornecida uma visão geral da evidencia disponível relativamente à integração de apps e intervenções baseadas na web na auto gestão da dor lombar. Os estudos incluídos não seguiram uma estrutura homogénea e apresentaram inúmeros resultados e dados heterogéneos. Desta forma, não foi possível estabelecer uma ideia clara do seu verdadeiro impacto. Os protocolos de RCTs parecem avaliar resultados mais homogéneos e provavelmente fornecerão dados úteis no futuro. A utilização dos cuidados de saúde e períodos de seguimento mais longos devem ser avaliados em ensaios futuros. Os aplicativos e as intervenções baseadas na web podem ser a solução para superar barreiras atuais e aumentar o acesso a uma reabilitação de qualidade, segura e de baixo custo.
Background: Low back pain (LBP) is a highly prevalent public health related problem with a substantial impact on the individual's disability and daily functioning. The challenging and complex treatment of LBP requires new motivational, time and cost-effective approaches. Objective: The aim of this study is to provide an overview of the available evidence and to determine if the included studies follow a well-structured and homogenous design that allow an effective assessment of the impact of mobile health apps and web-based interventions in the self-management of LBP.Methods: Electronic databases such as PubMed/Medline, PubMed Central (PMC), PubMed Health, Cochrane CENTRAL and PEDro were searched from 2007 until December 2017. The search strategy included the use of MESH terms and free-text terms, combining 3 concepts: low back pain, mobile applications and self-care. Randomized control trials (RCTs) and RCT protocols using mobile health apps or web-based interventions as part of the treatment for patients with LBP were included.Results: A total of 17 articles concerning 14 different studies - 9 randomized control trials and 8 RCT protocols - met the inclusion criteria. The nine completed RCTs included a total of 1659 participants, ranging from 51 to 398 participants per study. The majority of the participants were females and reported educational levels as partial college or higher. A wide range of outcome measures were used, although none of the studies reported on health care utilization. There was a significant variation in the reported results, even though some studies indicated improvement in certain outcomes favouring the intervention group. Three studies delivered the content through an app, accessible from multiple devices. Interactive elements were reported in every study.Conclusions: An overview of the available evidence, concerning the integration of mobile health apps and web-based interventions in the self-management of LBP was provided. The included studies did not follow a homogenous design, reporting numerous outcomes and heterogenous data. Therefore, it was not possible to establish a clear idea of its true impact. The protocols for future trials seem to evaluate more homogenous outcomes and are likely to provide future useful data. Health care utilization and longer follow-up periods should be assessed in future trials. Apps and web-based interventions may be the solution to overcome current barriers and increase access to a quality, safe and cost-effective rehabilitation for LBP.

Este trabalho tem como tema “relevância do recurso de amparo na tutela directa dos direitos fundamentais: um olhar particular sobre a experiência cabo-verdiana”. Com base no tema acima exposto pretendemos, essencialmente, responder algumas questões que surgiram na praxis constitucional em Cabo Verde, decorrentes da introdução deste mecanismo na ordem jurídica desse arquipélago lusófono, sendo que uma dessas questões começou a ser debatida, como ver-se-á, mesmo antes da entrada em vigor da lei de amparo, que foi aprovada em 1994, na sequência da Constituição de 1992, que o institucionalizou, debate esse que se prendeu com a questão de saber se o recurso de amparo é diretamente aplicável ou se depende de uma medida legislativa para ser aplicado. Outrossim, com esta dissertação pretendemos dar resposta a outras questões que tem dividido a doutrina cabo-verdiana, bem como a de outros países que têm um mecanismo idêntico, quais sejam o âmbito do recurso de amparo, a questão da legitimidade e do objeto desse mecanismo, etc., esperando contribuir para uma melhor interpretação dessa lei e da Constituição de Cabo Verde no que tange a esse meio de defesa de direitos fundamentais dos cidadãos, bem como apresentar a experiência cabo-verdiana a Portugal, país onde, como se sabe, mantém vivo um debate na doutrina sobre a introdução ou não deste mecanismo de suma importância para a defesa dos cidadãos perante os atos dos poderes públicos lesivos dos seus direitos, liberdades e garantias.
This work is untitled " relevance of amparo´s appeal in the directs protection of fundamentals rights: The Cape Verdean´s experience". Based on the above theme aimed essentially to answer any questions that may have arisen in the constitutional praxis in Cape Verde Island, due to the introduction of this mechanism in the laws among our Portuguese-speaking archipelago, and one of these issues has begun to be discussed, as we will constact, even before the amparo´s right effectivation, approved in 1994, following the 1992´s Constitution that has implemented it, its debate has focused in the dilemma if the amparo´s appeal is directly applicable or its dependent on the legislative measurement to be applied. Furthermore, with this dissertation, we intend to address to other issues that have divided Cape Verdean´s and other´s countries doctrines that have similars mechanisms, namely, the scope of amparo´s appeal, the question of legitimacy and this mechanism incidence, etc., contributing to a better interpretation of this law and the Cape Verde´s Constitution regarding to this important and fundamental instrument of citizens’ rights defense, to present and socialize Cape Verde´s experience to Portugal, a country, as we know , keeps alive and consistency debate midst this doctrine and about the introduction or not of this tools extremely important and pertinent to defense citizens throughout the public damaging acts of their rights, freedoms and guarantees.

Esta dissertação surge num contexto específico, onde ressaltam as funções que o mestrando profissionalmente exercia e a relação com o seu orientador, Prof. Doutor Rui Morais. Numa prima facie, havia da parte do mestrando a preocupação de elaborar uma obra sobre o contencioso tributário (restrita aos meios de reação de que os sujeitos passivos dispõem) aproximando o mais possível os contribuintes e a Administração Tributária, no sentido de tornar exequível o que comumente cita “quanto mais elucidados forem os sujeitos passivos, melhor será a interação AT- contribuinte”. Entendeu o orientador, em conversa informal com o mestrando, e bem, que dissertar sobre todos os meios de defesa ao alcance dos contribuintes, seria uma matéria muito extensa e, como tal, deveria ser fracionada e relegada para futuras publicações, sugerindo que de momento o tema se cifrasse no presente título “Oposição vs Impugnação Judicial”, demarcando as situações de ilegalidade concreta e abstrata da liquidação e convolação processual. O autor, contemplando efetivamente tal sugestão, resolve abarcar de forma sucinta estes dois meios de defesa do contribuinte, desde a génese do ato administrativo, passando pela reação do sujeito passivo, até ao recurso jurisdicional. Passou por trilhos que não são muito inteligíveis, sobretudo quando entra nos casos específicos e excecionais dos dois meios processuais em questão. À primeira vista, parece fácil estabelecer a cisão entre tais meios, partindo do pressuposto de que num dos casos se discute a legalidade da dívida e no outro a sua inexigibilidade. Também não oferecem dúvidas os casos em que a notificação indica expressamente qual é o meio de reação. A situação já assume outra acuidade quando se está na presença de atos silentes da AT, situação em que a lei faculta ao sujeito passivo um impulso à sua defesa, partindo do pressuposto do indeferimento tácito da pretensão que administrativamente manifestou, como é o caso da reclamação graciosa e do recurso hierárquico. De todo o modo, também procurou deixar claro o instituto da convolação processual, desde que estejam reunidos os pertinentes pressupostos, e os casos em que, mesmo que intempestivamente, a lei não deixa o interessado sem meio de defesa, sempre na salvaguarda do princípio da tutela jurisdicional efetiva. Por isso mesmo, também se estendeu relativamente à matéria dos prazos, os quais na impugnação obedecem a um esmerado cuidado. Finalmente, preocupou-se com o que lhe parece ser em contencioso tributário a questão dos atos supervenientes, na ampliação da ação na presença de ato expresso da AT após a reação ao indeferimento tácito e sobre a dualidade de prazos de interposição de recurso entre o CPPT e o CPTA.
This dissertation emerges within a specific context, where the tasks that the master degree’s student was previously involved in and his relationship with his supervisor, Professor Rui Morais are relevant. In a prima facie stage, was part of the Master's student concern to develop a work on tax litigation (restricted to the means of reaction available to taxpayers), bringing as close as possible the taxpayers and tax administration (TA), in order to make what he commonly cites "the more taxpayers are elucidated, the better the interaction TA-taxpayer" feasible. From an informal talk with the student, the supervisor realized that to analyze all means of defense within the taxpayers’ reach, would be a very extensive field, and as such, it should be fractionated and relegated to future publications, suggesting that, at the present time, the issue should be limited to the subject of this title "Opposition vs Judicial Challenge", defining situations of specific and abstract illegality of tax assessment and procedural conversion. The author, having actually contemplated such a suggestion, decides to cover the whole topic succinctly, these two means of defense of the taxpayer, from the genesis of the administrative act, including the reaction of the taxpayer, to court appeals. The author also went through trails which are not very intelligible, especially when he addresses specific and exceptional cases of the two procedural means mentioned above. At first glance, it seems easy to establish the difference between these means, assuming that in one of the cases the legality of debt is discussed and on the other its unenforceability. In addition, there is also no doubt in cases where the notification indicates what the possible means of reaction is. The situation becomes more important when you are in the presence of omission situations of TA, in which the law entitles the taxpayer to a defense, assuming implied refusal of his claim that he has administratively expressed, as is the case of administrative appeal and hierarchical appeal . In any case, he also sought to clarify the procedural conversation conjuncture, as long as the relevant principles are met, and when, even if unexpectedly, the law does not let the person without means of defense, always safeguarding the principle of effective judicial protection. Therefore, he has also developed his thinking in what concerns to the deadlines that, when in judicial challenge, is a relevant matter. Finally, there was a concern about what seems to be in tax litigation, the issue of supervenient acts in the expansion of the action in the presence of the expressed act of TA after the tacit rejection reaction and in the duality of deadlines to appeal between CPPT (Code of Tax Procedure and Proceedings) and CPTA (Code of Procedure of the Administrative and Tax Courts).
