This book provides timely analysis of the cross-border exercise of banking activity in the EU and its supervision, from the perspective of the ‘home-host rule’. It examines the current system and the efficacy of recent reforms considering whether the centralization of decision making and a more effective mutualization of financing tools could increase the efficiency of the EU banking system. The EU banking market is very integrated since banking institutions based in the Union are free to perform their activities within the common market. This has allowed EU banking institutions to significantly increase their cross-border operations. This way of working is based on the home country control principle according to which EU institutions performing cross-border activities continue to be supervised by their home country supervisor. However, this system has raised challenges for effectively performing supervision and resolution. The book analyses how far recent reforms under the banking union regime have addressed these issues. It analyses the main pillars of the banking union. It also analyses how international standards and EU requirements undertake to divide responsibilities between the home and host state and the extent to which they align interests between the home and host and minimize potential conflicts of interests. The book provides a valuable resource for academics researching on central banking union and regulation, and helps legal practitioners to address questions of supervision, resolution, and insolvency with a cross-border element.

This article reviews the literature concerning supervised and unsupervised classification of functional data. It first explains the meaning of unsupervised classification vs. supervised classification before discussing the supervised classification problem in the infinite-dimensional case, showing that its formal statement generally coincides with that of discriminant analysis in the classical multivariate case. It then considers the optimal classifier and plug-in rules, empirical risk and empirical minimization rules, linear discrimination rules, the k nearest neighbor (k-NN) method, and kernel rules. It also describes classification based on partial least squares, classification based on reproducing kernels, and depth-based classification. Finally, it examines unsupervised classification methods, focusing on K-means for functional data, K-means for data in a Hilbert space, and impartial trimmed K-means for functional data. Some practical issues, in particular real-data examples and simulations, are reviewed and some selected proofs are given.

This chapter looks at the advantages and disadvantages of out-of-court workouts in both the US and UK. It starts by looking at the reasons for which companies seek reorganization relief. When considering the advantages, it shows how in many instances an out-of-court workout may be a more efficient method of debt restructuring than a court-supervised bankruptcy proceeding. The chapter then looks at the considerations that are fundamental to the workout process, irrespective of the restructuring process that a debtor might choose. It also considers typical out-of-court approaches. Successful execution of an out-of-court restructuring begins with an analysis of the debtor’s business. Such analysis should identify the specific problems that led to the necessity of a restructuring and should address the company’s financial prospects on a realistic basis.

Preventive cardiology (PC), as performed in various cardiac rehabilitation (CR) settings, is effective in reducing recurrent cardiovascular events after both acute coronary syndromes or myocardial revascularization. However, the need for newly structured PC programmes and processes to provide a continuum of care and surveillance from the acute to post-acute phases is evident. Phase I CR serves as a bridge between acute therapeutic interventions and phase II CR. After clinical stabilization, phase I CR ideally provides a multifaceted and multidisciplinary intervention, including post-acute clinical evaluation and risk assessment, general counselling, supportive counselling, early mobilization, discharge planning, and referral to phase II CR. All these are important and contribute to achieving the preventive target. All the interventions within phase I CR should be supervised and provided in a comprehensive manner involving several healthcare professionals. For explanatory purposes this chapter analyses and describes these components separately.

This book examines the Italian army’s occupation of the French Riviera during the period 1940–1943 at three different levels, each involving a triangular relationship. At a more general level, it analyzes the military occupation with the lens of historical sociology, making references to the triangular comparison of the Italian occupation of France to the German occupation of France and to the Italian occupation of the Balkans. It also considers “the structural effects of occupation on the occupied society’s environment and living conditions,” with particular emphasis on the triangular and rocky relationship between the representatives of the French state, especially the prefects and mayors, and the Italian military authorities, the officers of Italian units deployed on French soil, and Italian civilian authorities who were officially dispatched by Rome to supervise the implementation of the Franco-Italian armistice and to secretly prepare for the annexation of the occupied territories. Finally, at a grassroots level, the book explores the “face-to-face interaction between occupiers and occupied people” and how it was shaped by both groups’ habits, culture, prejudices, and tensions.

This chapter traces the confluence of drugs and mystical experience from the late 1950s through the early 1970s, a significant period during which powerful psychedelics were legal and could be used in experiments. Influenced by the claims of Aldous Huxley, many of these experiments included some analysis of the mystical accounts of users. The most well-known of these was Walter Pahnke’s “Good Friday experiment” in 1962. Pahnke’s supervisor and the principal protagonist throughout the chapter is Timothy Leary who, influenced by Huxley and the popular Orientalism of the 1960s, significantly contributed to the construction of a psychedelic culture that informed the thinking of a generation of spiritual seekers. A number of other important figures are discussed, some of whom are relatively well known, such as Alan Watts, Ram Dass, and Huston Smith, while others are less well known, such as Michael Hollingshead and Art Kleps.

This chapter ties together the loose threads of the preceding discussions. It suggests that the role of the in-house lawyer has become further involved with risk management rather than simply the provision of legal advice. It presents some legal and conduct risk management objectives as a starting point for legal departments planning to take a ‘risk-based’ approach to its function. The role of regulators will be also crucial in managing risk, not merely as ‘supervisor’ and ‘enforcer’ in the traditional sense, but also as an effective cross-pollinator of ideas. Moreover, it is important that the Financial Markets Law Committee (along with other similar bodies) continues to perform the valuable roles of: (1) identifying concerns; (2) providing expert analysis of the relevant law in relation to specific concerns; (3) acting as an informal ‘bridge’ to the judiciary; and (4) being an authoritative voice for City lawyers when representations need to be made.

This chapter presents a comprehensive review of the relationships between different types of person–environment (PE) fit—namely person–organization, person–group, person–supervisor, and person–job—and organizational citizenship behaviors (OCBs). Relying on both affinity and exchange explanations, we demonstrate that individuals who experience good fit are more likely to engage in OCBs. However, the strength of the relationship is contingent on many factors, especially with regard to the operationalization of fit (the kind of fit measure used), the characteristics on which fit is assessed (e.g., values, goals, personality), the types of OCBs studied (overall OCBs, OCBs focused toward the organization, and OCBs focused toward individuals), the source of the ratings of OCBs (self-report versus others’ reports), and the level of analysis (individual vs. unit). Mediators and moderators of the PE fit–OCB relationship are also reviewed. We conclude with recommendations for future research to better understand the PE fit–OCB relationship.

From the 1970s on, banking supervision grew in size and importance. Which were the characteristics of the regulatory elite leading this activity? Based on archival material from central banks and supervisory institutions and on a collective biography analysis, this chapter explores the profile of the Basel Committee on Banking Supervision members, their role in the construction of an international regulatory institution, and some of their first achievements. It shows that some Basel Committee members were deeply involved in transnational networks of governance, others used their experience as banking supervisor in the private sector, while still others had a more national-centred career and stayed in the central banking or banking supervision sector. The Basel Committee members were the elite of banking supervisors. Over time, their committee evolved from a club to a standard-setter institution, illustrating the newly acquired influence both of banking supervision and experts and expertise in international financial governance.

In many ways Evan McAra Sherrard was a Renaissance man: a master of not one but several trades - agriculture, education, ministry, and psychotherapy - and he liked the fact that he had several strings to his bow. He described his "basic sense of identity" as "a healing minister of religion" and that "my personal competence is as a psychotherapist". To many - family, friends, colleagues, trainees, supervises, and clients - he was compassionate, open hearted, thoughtful, and generous. Evan was intstrumental in setting up the Cameron Centre in Dunedin in the 1960s, the Human Development Team within Presbyterian Support Services in Auckland in the late 1970s, and the Psychotherapy Programme at Auckland Institute (now University) of Technology in the late 1980s. More broadly, he was hugely influentual in the practice, professions and organisation of transactional analysis, psychodrama, psychotherapy, and counselling in New Zealand. This book brings together Evan's mostly unpublished writings in these various fields of interest, together with contributions from some 40 people, including his family, who represent the breadth and depth of influence that Evan's work and life had - and continues to have today.

Philosophy of Psychedelics is the first scholarly monograph in English devoted to the philosophical analysis of psychedelic drugs. Its central focus is the apparent conflict between the growing use of psychedelics in psychiatry and the philosophical worldview of naturalism, which holds that the natural world is all that exists. The book reviews scientific evidence that psychedelics such as lysergic acid diethylamide (LSD) and psilocybin can be given safely in controlled conditions, and can cause lasting psychological benefits with one or two administrations. Supervised psychedelic sessions can reduce symptoms of anxiety, depression, and addiction, and improve well-being in healthy volunteers for months or even years. But these benefits seem to be mediated by ‘mystical’ experiences of cosmic consciousness, which prompts a philosophical concern: Do psychedelics cause psychological benefits by inducing false or implausible beliefs about the metaphysical nature of reality? The author integrates empirical evidence and philosophical considerations in the service of a simple conclusion: This ‘Comforting Delusion Objection’ to psychedelic therapy fails. Exotic metaphysical ideas do sometimes come up, but they are not the central driver of change in psychedelic therapy. Psychedelics cause lasting psychological benefits by altering the sense of self and changing how people relate to their minds—not by changing their beliefs about the ultimate nature of reality. The upshot is that a traditional conception of psychedelics as agents of insight and spirituality can be reconciled with naturalism. Controlled psychedelic administration can lead to genuine knowledge gain and spiritual growth, even if no cosmic consciousness or divine Reality exists.

Exchange rate volatility is said to exemplify the economic health of a country. Exchange rate break points (known as structural breaks) have a momentous impact on the macroeconomy of a country. Nonetheless, this country study makes use of both unsupervised and supervised machine learning algorithms to classify structural changes as regime shifts in real exchange rates in South Africa. Weekly data for the period January 2003–June 2020 are used. To these data we apply both non-linear principal component analysis and Markov-switching generalized autoregressive conditional heteroscedasticity. The former approach is used to reduce the dimensionality of the data using an orthogonal linear transformation by preserving the statistical variance of the data, with the proviso that a new trait is non-linearly independent, and it identifies the number of regime switches that are to be used in the Markov-switching model. The latter is used to partition the variance in each regime by allowing an estimation of multiple break transitions. The transition breakpoints estimates derived from this machine learning approach produce results that are comparable to other methods on similar system sizes. Application of these methods shows that the machine learning approach can also be employed to identify structural changes as a regime-switching process. During times of financial crisis, the growing concern over exchange rate volatility, including its adverse effects on employment and growth, broadens the debates on exchange rate policies. Our results should help the South African monetary policy committee to anticipate when exchange rates will pick up and be prepared for the effects of periods of high exchange rates.
