Повний текст джерелаBenin, like most African countries, embarked on the decentralization process following the national conference of the nation's forces of life in February 1990. The new municipalities, created in place of the former sub-units. prefectures, are called upon to implement competences devolved to them with the aim of local democracy and grassroots development. But for some authors such as Vigoda-Gadot et al (2018) and Chitou (2013), public administrations (State, public enterprises) are generally poorly managed and display recurring poor performance. The question that arises is whether the new Beninese municipalities which are also public structures can be an exception to this general observation of poor quality management of public administrations.- The main objective of this study is to identify the main determinants of the quality of the management of municipalities in Benin. The methodological approach is based on econometric models with panel data through the STATA software on the one hand and the performance evaluation method called Data Envelopment Analysis (DEA) on the other hand. In particular, the DEA model made it possible to measure the overall technical efficiencies, pure and of scale in order to make a link with the quality of the management of the municipalities. According to the study, the results obtained are as follows:- - the efficiency in the functioning of governance bodies, the quality of management tools and the quality of the information system positively and significantly influence the quality of management;- - the results show that there is a relationship between efficiency and the quality of management. The overall technical efficiency score positively and significantly influences the quality of management when it is above thresholds which vary from 76.4% to 82.9% depending on the estimated models. Below these thresholds, overall technical efficiency negatively influences the quality of management

Повний текст джерелаThe thesis in hand entitled through the link between clinic workers and those who are working out of clinics. The analysis has been carried out throughout the 1995 sanitary implementation concerning the national sanitary system organization. The reorganization is noticeable through the setting up of sanitary zones, new operational units, taking into account better health care, whether they curative, preventive or promotional. The three case of studies based on the implementation of sanitary zones allude difficulties related to independent and functional sanitary zones organization. Then, rise at different level of sanitary questions related to the personnel qualification, the management of financial establishment and other health centers, medicine selling, private cabinets, reference and non reference organization between different structures. The implementation of this reform focuses more and more on the public health emergency and its importance. People then prefer public health care than private clinics. This situation has impacts on the real way sanitary zones function. Patricians in health care centers and hospitals do not always accept health professional "injunctions" and the non functionality of sanitary zones are partly due to the conflict between coordinating physicians (public health) and zone hospitals leaders (clinicians). Though there is no mutual interaction between clinic owners concerned about their clinics survival and public health administration managers, they still remain the two main actors of the implementation of this reform in Benin

Повний текст джерелаOn the basis of a comparative work, we argue that “State Reform” is a continuous, self-conflicting and overall public policy that challenges any stable conceptualization of Administrative Law. We do not only argue that the transformations of the State in the last twenty years have affected the previous paradigm of Administrative Law. Beyond that, the new paradigm is deprived of any programmed content: the commitment is to not be committed to any fixed set of tools to elaborate and implement public policy. Hence, there is a potential approximation between public law and public policy phenomena. Indeed, Chile pushed this approximation in a more aggressive way: the “pragmatic Weber” profoundly reformed the State without being revolutionary and articulated its parts without renouncing its unitary character. In Chile, nothing sounds truly public, but nothing seems to be completely out of the State control. Public and private confusion is further acknowledged. In turn, Brazil has absorbed some values from the public policy rational, but they only consolidate one more « chapter » of Administrative Law books. There is a fragmented understanding of Administrative Law in Brazil, which encompasses a bipolar (or even multi-polar) speech of a “confused Weber”, who manages a de-centralized State, deals with the tensions of the double legitimacy of regulatory agencies and bets on several public-private partnership models. Finally, neither is Argentinean Administrative Law confused, nor is it real. The “would-be Weber” pursues an ideal structure of the State that actually enlarges the gap between administrative law and public policy phenomena. The legal speech still seeks to provide a coherent and predictable system. However, the Argentinean institutional fragility constantly transforms this speech into a set of rhetoric arguments to allow the application of emergency measures. Administrative Law in Argentina has not become closer to public policy phenomenon, but a server of it

In Lebanon, the public function has never been to the level of the modern public function. The main problems it faces are the result of the gap between the offerings of the said public function and the needs of the citizens. In fact, the lebanese public function is still a quasi-archaic, slow, and inefficient institution. It is composed of three parts. The preliminary part discusses the general background concerning the political institutions, the dominant ideology and the evolution of the system. The first part aims at the study of the important changes of reform between nineteen seventy eight and nineteen eighty seven. The main themes are about the new political orientation as regards cadres and personnel, the devolution of administration and new managements systems and procedures set up during this period. The second part specially deals with the establishment of a new regime of civil service in china. It lays emphasis on the elaboration and the promulgation of the first general statute of the state civil servants ; it also treats the experimental application of this new regime. The general statute now with the title of provisional ordinance relative to the state civil servants is published as an annexe at the end of this thesis

Elle donne une approche générale des réformes de "nouvelle gestion publique" (NGP), mais aussi de la nouvelle architecture budgétaire publique en France à la lumière de la "loi organique relative aux lois de finances" (LOLF).
Une deuxième partie s'intéresse aux modélisations économiques du fonctionnement des administrations publiques, autour de la question des contrôles hiérarchiques et de celle des designs institutionnels optimaux de services administratifs interdépendants.
Une troisième partie se consacre exclusivement à l'évaluation empirique des réformes dans plusieurs domaines administratifs, notamment en faisant appel aux bases de données de l'organisation de coopération et de développement économiques (OCDE) et aux réformes françaises : décentralisation, recrutements, rémunération à la performance et "knowledge management" sont des thèmes majeurs. Enfin, ce travail met en relief les enjeux de l'administration électronique, en France mais aussi selon une approche comparée, sans omettre de considérer l'interdépendance des reformes de NGP.

However, the process of evolution of the French public service takes on an entirely different appearance when the creation of the metropolitan public service is compared with the creation of colonial French public service. This creation is twofold and thus reveals the two folded logic of the French state. On the one hand, we can identify the logic of social control in metropolitan France, on the other hand we can identify a performance logic nurtured by the influence of liberal doctrine. Consequently, colonial administration will become an administrative and legal “laboratory” for the French state in which a good amount of administrative reforms draw to this day their origins and influences

Повний текст джерелаThe requirement of the user's satisfaction is acquiring in our days the features of a collective statement, i. E. Of a formula which summarizes commonly shared aspirations and which directs the action of people although leaving them the choice of the exact meaning they wish to give to it. The object of our thesis is to understand how this movement of "modernization by the user" is translated in the local public utilities. We initially characterized general registers of action which structure the activity of municipal utilities, but also those resulting from the instigating vector to the change constituted by the collective statement of user's satisfaction. We used these general registers of action to put in perspective the analysis for the change in action, based on the monographic study of a modernization project realized in the water and sewage utilities of a large city, called Aquacity. This modernization project specifies the collective statement of the user's satisfaction in a clientelistic register, equipped with a discontinuous train of innovations which ended taking up the more integrated shape of a quality process. The case study is based on an original reading grid of the change in organization. Our contribution to sociology of organisational change stresses the reflexive dimension of the phenomenon. It conceives the change as a flow of logics of action which transmit at the same time as they transform the social and technical properties of the project and of its context of implementation. From this point of view, the change is spread out according to a temporality which is not a simple chronological support, but which conceals an own effectiveness able to act on its course. This principle of effective temporality is rooted at the same time in the identity of the actors, in the objects and in the mechanisms of resources accumulation

This new organic law regarding the financials laws and the budget execution has been submitted as Gabon's new “Constitution financière”.Resulting from a long process, the organic law deal with two topics: on one hand, improve public expenditure by updating public management and on another hand, support the transparency by strengthening parliament's role in budgetary matters. The budgetary reform from the organic law is not a simple process and rules modernization. This reform modifies deeply the Gabonese financial right because this inasmuch as this law introduces a new result-oriented program budgeting system and modernized the classics mode of public management. This law helps parliament to follow up public action by defining clear objectives, quantified indicators, accurate and measurables. The new budgetary management frame is focused on results reaching instead of compliant rules and processes. However, many issues have been identified during its implementation, following that, the republic president during the ministery council decided on May 17th 2018 to set up the budgeting system three years after its implementation

Повний текст джерелаTo address the theoretical issue of administrative reform, and taking the evolution of the British civil service as an ampirical test, it is essential to see it as the construction of paradigmatic social realities both practical and representational which are made by coalitions of actors involved in administrative change and or immobility. The administrative reality can be defined as the combination of two basic elements : the administrative work (or else the administrative space or structure) and the character of the administrator (or else his social, professional and individual value in society). Thus, historically, the civil service has been built" successively through various experiences of administrative construction-reform : from 1830 to 1900 through an experience of integration, from 1900 to 1960 through an experience of differenciation, from 1960 to 1990 through an experience of instrumentality. This historically broad and sociologically dynamic view of reform leads in particular to a reassessment of the "thatcher phenomenon" in the example of administrative reform since the 1979-1990 period can be analyzed as a radical stage in a broader experience of administrative reform whose framework had already been set by the Wilson government in the 1960s and which is characterized by a trans-organisational managerialism to control the administrative work and by a peculiarly mean definition of the character of the. .

Повний текст джерелаThis thesis is a study about the political brazilian transition, from the passage of the autoritarian gouvernment to the democratic one (1974-1985). We consider the interests and the ideologies of the national private investors, wich are connected to foreign ones that follow the privatisation evangile, wich wants the liberalisation of the brazilian market. It means that we do not stay attached to one specifical gouvernement in particular,instead several gouvernements are studied in the mesure that the work requires in order to their context. In others words, it is a study of the contemporary brazil, when the state stops to finance the public investments, giving the place to an open market. The advent of an open market asks for a modernisation of the ancient structures of the country, in order to be able to receive the international investments and to enter in the new order era, in the era of the third industrial revolution. But we are also interested in the most obscur phase that political brazilian system had lived during a moment of its history : the military autoritarism. In this context, we take into consideration the movement of the political and financial elites in the interior of the state's machine, including the federation, mainly after 1930's years. These elites are seen as the principal actors ol the society in the process of political opening of the country to commercial liberalization. The theoretical reference analysed in this thesis corresponds to the ideas that are accorded the best to the proposition of a stale reform, and to the role of the national elites in this process. The explicative elements that turns around this question are adapted to the political, economical and institutional aspects of the country. We also consider the participation and the influency of these elites in the process of strategical decision of the slate and the liberalization of its internal market. All the analysis consider current difficulties of the country that are attached to its structural anachronism and its historical past

Повний текст джерелаThe main goal of this research is to understand the 'paralysis' of public utilities in the dynamics of electronic government development (that is to say the use of ICT in the modernization process of public utilities). In addition to a managerial interest, the theoretical contribution of this research lies in the analysis of the dynamics of interactions between technologies, organization and its environment that extends structurational theories. Our study is an 'intervention research'. However, our research may be considered in the continuation of many studies that claim a multi-paradigmatic approach: according to the stages of our research, we rest on the use of qualitative or quantitative data. In order to understand the dynamics of electronic government development, this research demonstrates the relevance of the link between the structurational theories and Weick’s works on the sensemaking in organization. Indeed, this dynamics is equivocal and suggests taking into account the representation systems of the actors to analyze the process of structuration between technologies, organization and its environment. A direct implication of this approach in terms of equivocity is that a stage of fuzzy front end is important in the project management to discuss the leaders’ representations and to enact the future dynamics of electronic government development. Moreover, a multi-projects management becomes necessary because the management of the interdependences between the changes is currently essential to develop electronic government

Here is the question asked in march 2003 by the constitutionnalisation of the expérimentation of local collectivities. Despite its constitutional base, the approach remain ambiguous. Inspired by the exacts science experiments, local experimentation is before all a fundamentally pragmatical process of reforme. It consists in submitting new rules to the test of the facts before the public authorities decide of its destiny according to the evalutation of its effects. With a brand new legislative dimension, local experimentation can appear as real local freedom which authorizes the local collectivities not to respect the national laws. Isn't it the way of emergence of real local powers ? So, the local experimentation is swinging between two directions. The principle of local experimentation allows a real autonomy of the local collectivities showing the way to a transformation of our Unitarian state. If the process of local experimentation is innovative as a principle, it is less according its implements which still traduce the traditional conception of the local autonomy. It is interessant to observe that reforms in the two lands present similarities in gain of autonomy and in reinforcment of new forms of evaluation. Then, in a second point are presented the modalities of the reforms from two points of views : the contractual aspects at first and the budgetary aspect secondly. The second part about the new regulation of activities deals at first with the way by which the state is keeping control on the services although it is giving them more autonomy. Two systems are identified wich are complementary : the respect of the rules on a part, and the accordance of more responsabilities on the other part. Secondly comes the question of "choices of society" : how should the service be delivered and which typt of service should be offered? finally, those considerations lead to the question of the role of the state in itself

The introduction of a new economic logic in public institutions has resulted in airports adopting new combinations of ownership, governance and operational management around the world. Modernizing airports has mainly consisted in projecting them into the competitive environment, in forcing them to become self-sufficient and in empowering them to handle the pressure of becoming more competitive in a context where air transport demand grows exponentially and continuously. Airport managers now seek to offer user-friendly and efficient infrastructures to airlines and passengers which are also capable of containing current and future traffic flows. The industry’s contemporary stakes compelled airport managers to conceive new business models for these commercialized airports. This thesis intends to answer the following question: What are the components of the business model of an airport operating in a competitive environment? The airport business model is shaped by opportunities and constraints stemming from demographical, economic and geographical peculiarities. Повний текст джерелаThe main hypothesis of this research relies on the discrepancy between the evolution of the state and that of the other components of the socio-economic system as a factor of nations competitiveness. By adopting an evolutionist and historical perspective, the state is analyzed as an actor of the nations' evolution in their ability to absorb technological progress. The framework relies on the northian distinction between organizations and institutions, focusing on innovation's dynamics within public institutions and organizations. Both are analyzed as adaptive systems co-evolving in two temporal dimensions: the braudelian long-term since the Renaissance, and the present short-term of the information technologies revolution. The first part focuses on innovation as a socio-economic process stepping from disruption to continuities. Chapter I put in perspective the evolution of the state and of the technology. Chapter II analyzes what is at stake with the information technologies revolution. Chapter III assesses the role of the state and its evolution in the history of Great Britain and the US. The second part studies what are the possibilities for the state to get transformed (chapter I) drawing on an assessment on the New Public Management movement. The analyze goes on organizations (chapter II) through a comparison between cases of organizational transformation in France and in the US. A compared analysis between the ongoing institutional change in the budgetary framework in France and Canada allows to assess how to link institutional and organizational transformation. As a conclusion, the steering of such a reform appear to be socially feasible and technically mature, but suffers from a lag of evolution at the institutional level where politicians and mainstreams ideas dally in integrating the parameters of the third industrial revolution paradigm

Повний текст джерелаOn 16 April 2002, the French Journal officiel announced the creation of a new grand corps merging the former Ponts et Chaussées, Aviation Civile, Météo France and the Institut geographique national. Founded in 1716, the Ponts et Chaussées thus re-emerged in a completely redefined form if under the same name. The merger of these four high ranking French civil servants attached to the Ministry of Equipment was accompanied by an in-depth reflection on the identity of the new grand corps. The model favoured by these civil servants was that of ‘managing engineers’. Accordingly, the teaching content of the national school of the Ponts et Chaussées was entirely revamped to favour a focus on public management. It took seven years to move from the initial formalisation of the fusion process to the development of a new unified training approach. It has been claimed that this reform answers a need for enhanced managerial competence as part of the wider modernisation of the state. This study reveals a number of other essential factors that shaped the reform; these factors resulted from the interaction of corporatist and administrative logics. The focus on this reformed framework and the changing status of these high-ranking civil servants underlines the importance of inter-ministerial negotiations, and bargaining between the body itself and the rest of the state apparatus. It points to tensions in relation to symbols and resources, identities and self-perceptions, strategies and interests. Perhaps even more importantly, the study reveals the images that were embraced in the course of attempts to reshape perceptions regarding the role of the state and appropriate public action in the light of managerial needs. The systematic study of this interaction between managerial ethos and civil service values points to a reform which embodies the attempts of civil servants to use public management to reassert and reinforce their position, and to ‘bring the state back in’

The Mingongs appeared at the same time with the reform of 1978. They are the elite of the Chinese countryside. They have been contributing much to the modern Chinese society. Floating between the countrysides and the cities, they belong to a special society which is marginalized by both the countryside and city. In general, they have been exploiting heavily and living in the miserable conditions. More and more Mingongs have been becoming the criminals. Their children, following them to enter cities or stay alone in the countryside, can not get enough care and help to grow up well. As part of the future of China, they are in danger. The society of Mingong is a dangerous society. Explosion is bad to everyone. China is a huge country and an old country. Unlike the leaders of the high level or the intellectuals of the middle-class, the amount of Mingong is shocking and impossible to ignore. They will definitely push the political reform of China strongly. If the leaders of the high level and the intellectuals of the middle-class control and help them well, the people's republic of China may reach democracy in peace its own way. The world needs to be patient to see the election, participation and supervision in politics appear in China. But first at all, there needs to appear a society of qualified citizen in China

The current study's main objective is to evaluate IAA assignment after twenty years from the democratic process, and sum up the legal reflection on this unusual orientation and even revolutionnary in the african landscape. This reflection consists in stressing on the way a succession of authorities which sprouted twenty yars ago, have become a particular way of protecting fundamental liberties, and ask ourselves on the relations those institutions maintain with the public authorities. .

Повний текст джерелаSince 1986, because of the maladjustment of the public (civil) service law and the choice of a centralised system of administration, the congolese administration became inefficient and absorbed all state ressources to the detriment of public investment. On account of the deterioration of the exchange terms, the administration became a source of debts for the nation, blocking the economic , political and social development of the country. In order to increase development, the I. M. F. And the World Bank proposed a series of policies centred on the reduction of manpower and the cost of administration and its structural and qualitative improvement. But the success of this reform was conditioned by the success of annex and allied politicies. This explains why, the evolution of the principles governing the management of public(civil)service was insufficient. Furthermore, and because of the difficulties in application of some politicies and the incoherence of others, the general impact of these politicies brought no concrete results. Indeed,these various and interdependent politicies were difficult to apply. In same cases, their application made difficult the application of others. For example, the objective of stabilizing public money through the reduction in the numbers of civil servants was annihilated by the blaze of military manpower and expenses. Finally, the difficulties of democratic transition increased the weaknesses which a true transition would have solved

First of all because she cannot remain indifferent ot the expansion of new methods of management, then because of the numerous constraints press on her : development of competition and implementation of communal mail politics. How does she react ? It is not a question of drawing up a balance sheet of the reforms, but to see the logic around which gets organized the change and the margin of actions which has "La Poste" in her determination and implementation. A glance on the last four decades allows to put in evidence two periods : the first one, which ended up with the reform of 1990 and it's implementation, in the course of which the change is mastered by "La Poste" who controls not only the axes but also calendar ; other one, opened in the middle of 1990s, during which she loses an important part of her autonomy and undergoes an impulsed change, oriented and sanctioned by the community authorities

Повний текст джерелаCreated by the decentralization, territorial civil service was based on three principles of equal importance unity, parity with the state civil service and the local specificity recognized through the assertion of free administration of local authorities councils principal of constitutional value. Gradually, and through out the changing policies, the local representatives in their quality of territorial authorities responsible for managing their own personnel, denounce the strict rules of the general status presented as limits. In 1987, the low maker gave them satisfaction by deregulating the recruitment of non-permanent members of staff, which, together with job cuts and reduction in working hours will disrupt the system. Faced with this situation, some local representatives prone a change of status, whereas the government wishes to reform it, in agreement with associations of local authorities. It is thus, that general status has its twenty fourth legal modification with the voting of the 27 December 1994 law. By favouring local specificities, the legislator increases the influence of politics in local civil service, corollary of modernisation of territorial administration. The quality of local civil service depends on and effectively protective status. Replacing the status by a form of collective labour agreement would radically endanger the notion of territorial civil service in particular and the civil service in general

The reform was initiated in 1989 under the aegis of the then prime minister, michel rocard, with a view to enhaucing individual accountability in the civil service, through greater budgetary flexibility and effective use of skills. It relies on a body of beliefs gradually constituted since the end of the forties around the entrepreneurial world, through business management institutions and scientific validation mechanisms. Inspired by conclusions presented by a senior official's association ("service publics"), reformers around michel rocard defined the main lines of the reform. Its materialization opposed the pro-reform ministry of civil service and the budget ministry, guardian of traditional budgetary rules. Within the reformed administrative services, different degrees of involvement were seen in three different staff categories : the managers, in favor of budgetary flexibility and a symbolic dimension;innovative personnel, often at line management level, seizing reform-related opportunities; and the subdued rank and file who gradually lost interest. Повний текст джерелаThis study is related to the Libyan state who testified of weakness and instability since the Ottoman Empire until the fall of Gaddafi, which hindered any administrative reform effort that could have been undertaken to confirm the concept of state, which has always struggled even a real absence. The country lives without state since Gaddafi's fall in 2011, although the transitional period has passed through several stages such as the introduction of a new Constitution and elections to put in place the important institutions. The thesis also exposes the various changes and modifications that have occurred administering, analyzing their objectives and impacts. The objectives of the administration should be in line with those of the state and the needs of society in general and in particular citizens.The need for an effective management system in the state has resulted in considerable changes in political, administrative and social levels. Among the concerns listed on the political agenda since the fall of Gaddafi’s regime are the institutional reforms. This reflects the deeply degraded nature that has characterized and still characterizes the relationship between the State and the Libyan society, this situation resulting, in most cases, the weak state apparatus and organizational deficiencies and supervision that followed. It should however be clarified that the public administration is a sphere of the state, it cannot therefore represent only the administrative state. Thus, it must act in close cooperation with the political state and social bodies. Повний текст джерелаThe public management reforms that have been under way over the past thirty years are based on the widely held belief that the welfare state is at least partially lacking in efficiency, both in its so-called bureaucratic organization and in its actions, which are considered to be unsuited to the user’s needs. Regularly disputed in its objectives, its methods but also in its results, the Civil Service is since subjected to a “crisis of legitimacy” which makes necessary an overall modernization of its organization and its way of operating. The recent introduction of PRP (Performance-Related Pay) in the public service hospital reflects the wish to reform human resources management practices carried out until now. The aim of this thesis is to question the foundation of this individualization of remunerations which are based, on a theoretical point of view, on the principles of the New Public Management. Our approach aims to show that work design is at least as important, and perhaps more, than the introduction of PRP as a mean to manage motivation and satisfaction of hospital doctors. Beyond, we show that PRP could contradict the intrinsic determinants of motivation and job satisfaction of the hospital doctors, which are, in reality, widely affected by the characteristic of their job. We propose a research model that we then validate on a sample of 2 502 hospital doctors
