This article is the second in a line of research entitled "Instruments for territorial management", which seeks to analyse the use and valuation, by municipalities, of instruments such as the Municipal Master Plan (MP), the Educational Charter (EC), the Municipal Civil Protection Plans and also the identification of existing participation instruments in the different municipalities. In the present case, we seek to know practices and perceptions about the Educational Charter through the analysis of 44 Educational Charters and by conducting interviews with municipal representatives about this instrument for territorial management. The data collected indicate that, despite the explanation about the importance of this document, it is, in many municipalities, completely out of date and, probably, of no use. There seems to be, currently, a perspective that it should contemplate other educational dynamics than those of formal education and that it is essential to contemplate its connection to other territorial management instruments in the sense of an effective implementation of municipal educational policies considering an integrated territorial vision.

Topicality. Tax instruments that are aimed on stimulation of economic activity are widely used as regulators of regional territorial economic systems in developed countries, especially in the EU, and for Ukraine this practice, on the author's opinion and on the opinion of many experts in taxation sphere, will also support economic development priorities and would be appropriate and effective. The processes of voluntary formation of united territorial communities and decentralization of administrative-territorial organization in Ukraine did not bring the expected growth in the economic development of territorial economic systems and this necessitates the formation of a comprehensive policy to promote economic development of territorial complexes with special emphasis on economic growth. Supporting the priorities of economic development of regional, subregional economic systems and parts of functional areas at the basic level can be effectively implemented through tax instruments, because such measures are effective and can stimulate the rapid direction of financial, commodity, logistics, investment flows towards favorable business conditions. A promising direction for the development of territorial economic systems is the support of economic cooperation in communities, because this will provide conditions for the division of labor in the territorial dimension and will stimulate the creation of extended value chains.Aim and tasks. The purpose of the article is to substantiate the feasibility and determine the potential effectiveness of tax instruments that are to stimulate the economic development and cooperation of territorial communities in Ukraine in the context of administrative and territorial reform and according to the impact of modern challenges of the ensuring of the competitiveness of domestic economic complexes in context of integration into world economic systems.Research results. The article considers the tools of economic cooperation of communities as means of functional territories creating, which is an alternative to the process of united territorial communities forming, and as a universal mean of ensuring of the economic capacity of communities in terms of unification, which is especially relevant during the completing of decentralization reform, when delegation of all powers is provided to the Cabinet of Ministers of Ukraine.Measures of economic capacity increase of territorial communities with the use of economic cooperation tools are developed in the article, including tax, organizational, financial, informational levers that are relevant to the current conditions of development of territorial communities in Ukraine and regions. Particular attention is paid to tax measures and mechanisms that are to stimulate economic development and cooperation of local communities, as it is proved that such levers of regulation are among the most effective.Conclusion. It is determined that stimulation of investment activity, general economic development and cooperation by tax regulation measures is already possible and appropriate institutional support for such tools has already been formed, but for further introduction of a comprehensive mechanism of tax stimulation of cooperation and formation of functional territories on the basis of effective division of labor support, additional more significant and systemic changes to the current institutional environment, especially to the Tax Code of Ukraine are needed.

La Estrategia Territorial de Navarra (ETN), el instrumento de ordenaciónterritorial de ámbito de toda la Comunidad, fue aprobada en junio de 2005.Es un instrumento programático que contiene criterios, directrices y guías de actuación,pero no contiene determinaciones, normas o preceptos normativos quevinculen directa o indirectamente, a través del planeamiento urbanístico local alos particulares y administraciones públicas. Pero la naturaleza jurídica, el carácterorientativo de sus determinaciones y la escasa repercusión de la ETN, pareceque hace evidente una necesaria reformulación del instrumentos y revisión de lafigura. Ello supondría optar por un instrumento con carácter de norma, o mantenerel exclusivo carácter de documento estratégico no vinculante. Los efectos deun modelo de carácter normativo deberían tener un valor jurídico como principiosinformadores de cualquier actuación en el territorio. Nafarroako lurralde-estrategia (NLE) erkidego osorako eremuarenlurralde-antolamendurako tresna da, eta 2005eko ekainean onartu zen. Tresnaprogramatikoa da, irizpideak, gidalerroak eta jarduketa-gidak ditu, baina ez tokikohirigintza-plangintzaren bitartez partikularrak eta administrazio publikoak zuzeneanedo zeharka lotuko dituen zehaztapen, arau edo arau-agindurik. The Navarra Territorial Strategy (ETN), the highest-ranking territorialplanning instrument in the entire Community, was approved in June 2005. It isa programmatic instrument that contains criteria, guidelines and action guides,but does not contain determinations, norms or normative precepts that linkdirectly or indirectly, through local urban planning, to individuals and publicadministrations. But the legal nature, the guiding nature of its determinations andthe limited impact of the ETN, seems to make evident a necessary reformulationof the instruments and revision of the figure. This would mean opting for astandard instrument or maintaining the exclusive nature of a non-binding strategicdocument. The effects of a normative model should have a legal value asprinciples that inform any action in the territory.

Cet article analyse la trajectoire de deux observatoires territoriaux situés dans les régions québécoises de l’Abitibi-Témiscamingue et l’Outaouais. Cette analyse a pour but de montrer qu’au Québec les observatoires peuvent être d’importants instruments de développement : ils permettent de produire de la connaissance territoriale utile aux acteurs du développement de leurs régions respectives. En prenant appui sur des catégories développées par la littérature sur le transfert de connaissances et le développement territorial, nous montrons que les deux observatoires suivent des trajectoires différenciées de partage de connaissances et des façons propres d’organiser le rapport entre la recherche et l’action.

The spatial development of territories in Ukraine, in particular in the context of the introduction of decentralization principles into the public administration system, is characterized by the identification of an additional wide range of internal and external factors and problems of functioning in various spheres of society, as well as the actuation of issues regarding the need to find and implement more effective instruments that can solve them. Domestic experience in overcoming various kinds of territorial problems is limited and insufficient, therefore, the study of the best foreign theories and practices in this regard, including the use of instruments for the implementation of project activities, as well as the analysis of opportunities for their implementation, remains relevant. In the context of the spatial development of territories, project activities can be considered as a purposeful system of actions organized by any public governance entities or established in the process of their interaction with each other, aimed both at solving a specific territorial problem and at stimulating the development of various spheres of community life, involving a wide range of mechanisms and instruments for managing spatial development based on planning, financing and implementation of a specific project in order to achieve the final result. The article provides an analysis of the global and European experiences in the use of an instrumentarium for the implementation of project activities in public management of spatial development of territories; approaches are generalized and features of the use of projects depending on the priorities of spatial development, individual characteristics and the presence of territorial problems within each country are determined; the possibilities and relevance of using positive examples of the implementation of multidirectional project activities in the process of managing the spatial development of territories in Ukraine, which is expedient in the period of their post-war recovery, are considered. Acquaintance with the global and European experiences of formation by individual countries, in accordance with national characteristics and the chosen model of development, of priority goals, objectives, mechanisms and instruments of territorial management will allow using positive achievements and, on the basis of the formed strategic directions, introducing effective instruments, in particular for the implementation of project activities, support and stimulation of the development of their own territories, taking into account the characteristics inherent in Ukraine.

The article substantiates the expediency of introducing an extended and multilevel classification of territorial communities in Ukraine on the basis of the use of various classification signs and features, as well as the development of appropriate instruments (methodical approach) to the formation of a generalized classification. Based on the generalization of the current approaches to existing varieties of territories by analyzing individual directions of their functioning and life support, instruments have been developed for the formation of a generalized classification of territorial communities in Ukraine on the basis of a combination of a wide range of features, which will further form universal recommendations for defining models and directions of spatial development of communities and develop targeted instruments for their development and support, depending on the specifics and features. The peculiarity of the developed classification of territorial communities of Ukraine is the allocation of three main blocks of classification features: block of resource conditions of spatial development, the purpose of which is to identify those resources of various types that the community has to ensure for its development; a block of achieving the development capacity, which is designed to assess the efficiency of resource use and substantiate the feasibility of special government support for community development; a block of the problem-oriented development, which identifies the main problems of the community that exist or may become relevant during the period of implementation of the community development strategy. The result of the practical application of the proposed instruments for the classification of territorial communities should be the creation of conditions for each of them ion order to determine the level of capacity for self-development, formation of development priorities, use of directions and opportunities of government support in the process of developing a model, strategy and plans for its implementation, application of the program-project approach to the spatial development of territorial communities in Ukraine, depending on the extant, relevant needs and future prospects for the development of the country and its territories, including in the period of post-war recovery and restoration.

Hori osatzeko, Pirinioak Garatzeko 2007-2009 Plan Estrategikoan jasotzen diren neurri substantiboak tartekatzen ditugu, plan hori garapenerako tresna integrala denez gero eta programa ekonomiko, ingurumenezko eta sozialak betearazteko helburua duenez gero. Azterlana amaitzeko, oraintsu onartutako Pirinioetako Lurralde Antolamenduko Planari heltzen diogu. Tresna administratiboa da, erregelamendu-izaerakoa, eta jendaurreko informazioaren aldietan eragile sozial eta politikoek egindako ekarpenak aintzat hartuz aztertzen dugu. RESUMEN: El trabajo estudia la regulación jurídica de la zona de montaña pirenaica de Navarra, con especial atención a la normativa sobre ordenación territorial, y a los principales instrumentos previstos en la misma. Se comienza con la presentación de las medidas contenidas en la Estrategia Territorial de Navarra por constituir el marco de referencia y ofrecer las orientaciones para la elaboración de los demás instrumentos. De forma complementaria, se intercalan las previsiones sustantivas contendidas en el Plan Estratégico de Desarrollo del Pirineo 2007-2009, considerado un instrumento integral de desarrollo y dirigido a la ejecución de programas económicos, medioambientales y sociales. El estudio finaliza con un acercamiento al recientemente aprobado Plan de Ordenación Territorial del Pirineo, instrumento de naturaleza administrativa y carácter reglamentario, analizado al hilo de las consideraciones aportadas por los distintos agentes sociales y políticos en los periodos de información pública. ABSTRACT: The work studies the legal regulation of the area of Pyrenees mountains in Navarra, with special attention to the normative on zoning and the main instruments therein envisaged. The study begins by introducing the measures contained in the Zoning Strategy of Navarra in order to create a framework of reference and to offer guidance to elaborate the rest of instruments. In addition, the substantive provisions contained in the Strategic Plan for the Development of the Pyrenees 2007-2009 are interspersed, by considering it an integral instrument of development and it is aimed at the execution of economic, environmental and social programmes. The study ends with the rapprochement to the recently approved Plan of Zoning for the Pyrenees, an administrative instrument of statutory character, by analyzing it in the light of the considerations provided for by the several social and political agents within the public information periods.

Los procesos de transformación del territorio en el Perú afectan la comprensión, protección y conservación de los sitios arqueológicos, desbordados por la intensidad y rapidez de los cambios. Sin embargo, los instrumentos de gestión patrimonial y territorial vigentes no facilitan espacios de integración del patrimonio arqueológico en las dinámicas territoriales actuales. El concepto de paisaje abre una oportunidad de alineación de sendas visiones sectoriales. En la región Lambayeque, en el norte del Perú, la elaboración de un diagnóstico territorial de su patrimonio arqueológico por el Ministerio de Cultura, permitiría ensayar una propuesta operativa del paisaje para la gestión de este patrimonio.Les processus de transformation du territoire au Pérou affectent la compréhension, la protection et la conservation des sites archéologiques, submergés par l’intensité et la vitesse des changements. Cependant, les instruments de gestion du patrimoine et du territoire ne fournissent pas d’espaces pour l’intégration du patrimoine archéologique dans les dynamiques territoriales actuelles. Le concept de paysage ouvre une opportunité d’aligner les visions sectorielles. Dans la région de Lambayeque, au nord du Pérou, l’élaboration d’un diagnostic territorial de son patrimoine archéologique par le ministère de la Culture, permettrait de tester une proposition de paysage opérationnelle pour la gestion de ce patrimoine.The understanding, protection and conservation of archaeological sites are overwhelmed by the strength and speed of territorial changes. However, heritage and territorial management tools do not integrate archaeological heritage into current territorial dynamics. The landscape concept is an opportunity to align both approaches. The Ministry of Culture of Peru has developed a territorial assessment of archaeological heritage in Lambayeque, North of Peru. It allows for a landscape operational approach to the heritage management.

This article debates the possibilities and advantages of using territorial impact assessment (TIA) policy evaluation methodologies to assess the implementation of spatial planning instruments. It builds on existing literature to define key analytical goals, dimensions, and respective components to monitor and evaluate the implementation of spatial plans, at all territorial levels, to be used as a TIA evaluation matrix. It concludes that, despite the inherent complexity associated with the process of evaluating spatial planning processes, there are manifest advantages to using TIA tools to evaluate them, mostly at the ex post phase.

The publication aims to study the implementation of the instruments for integrated territorial development in the EU in the context of the Cohesion policy. The research framework covers a literature review and a critical comment on the concept of the idea of introducing an integrated territorial approach to achieve convergence, emphasizing the applicable three territorial development approaches in the Member States: Community-Led Local Development, Sustainable Urban Development and Integrated territorial investments. Key conclusions are drawn, which are the result of an analysis of secondary data on the financial performance of the territorial development approaches for the 2014-2020 planning period. The authors focus on the specific challenges that the EU faces in measuring the effectiveness of the integrated territorial instruments in the new programming period. This study also puts an emphasis on the need for the development of a new generation of territorial impact assessment methods, instruments and indicators for measuring combined actions capable of evaluating the integration of EU. Based on an expert assessment of interrelationships, specific recommendations are made to over-come the challenges of implementing and monitoring of the instruments for integrated territorial development during the new programming period.

Albanian inhabited cities and centres have undergone chaotic developments in the years of transition, and this has come as a result of development not based on previous territorial and urban planning. Thus, construction, urban and territorial development in the transition years has not been the result of the implementation of previously approved territorial and urban planning instruments. This has come as a result of the lack of territorial and urban plans (local or national), which would precede construction and urban development with the aim of making this development smart, sustainable and comprehensive. In this context, we have made an observation in attempt to find the reasons for the lack of territorial and urban planning instruments in relation to governance. Our concern is focused on the question: has the scope of governance been so narrow that it has left out the task of drafting and approving territorial planning instruments; or was their absence for other reasons? As will be presented in this paper, transitional governments have not lacked: neither sectoral legislation that obliges the implementation of planning instruments; nor public institutions charged by law specified by duties in this field; nor public budget funding and foreign donors for their design. In contrast, it has been the characteristics of the left ‘big government’ and the public irresponsibility that characterize what have hindered the drafting and adoption of territorial and urban planning instruments.

Responsible Research and Innovation (RRI) is an inclusive approach to the research and innovation process. Regional and local authorities are encouraged to take advantages of RRI in order to address the complexity of the interplay between science and society, especially as it affects territorial development policies. However, adopting the RRI approach is not an immediate or linear process. Consciously or not, many territories have already adopted policies and planning instruments that incorporate RRI, generating effects on the spatial scales. The aim of this study is to provide a methodology to map the inclusion of RRI dimensions (i.e., public engagement, open access, gender, ethics, science education) into regional development policies and spatial planning instruments, in order to detect integrated strategies and elements that are sustainable, open, inclusive, anticipative and responsive. The mapping methodology has been applied to three territorial pilot cases. The results provide the territories with a baseline to improve the integration of the RRI approach in their commitments to develop self-sustaining research and innovation ecosystems. Through the lessons learnt from the pilot cases, recommendations are drawn for the integration of RRI in spatial and urban planning policies and tools.

Topicality. The article considers the main tools for ensuring territorial cohesion in Ukraine including those identified considering EU Cohesion Policy practical results and studies of European scientists regarding instuments of the territorial cohesion, as well as those, that are proposed by autor in view of the challenges of regional development instruments’ application in Ukraine derived from an analysis. The essence and method of harnessing for each of the territorial cohesion tools proposed by the author, in view of implementation of the Ukrainian State Strategy for Regional Development for the period 2021-2027, are also given. Aim and tasks. The aim of the article is to study instrumental provision of the state regional policy in Ukraine within the framework of ensuring cohesion for territories and communities in Ukraine, as well as, to propose recommendations for its improvement. The realization of aim is through the following tasks: to investigate the instrumental basis of the EU cohesion policy in the aspect of ensuring spatial development, to propose tools for ensuring territorial cohesion for the regions and territories of Ukraine, including adapted EU instruments and original ones with regard to the temporal and spatial context, and the institutional basis for ensuring cohesion in the regions and communities of Ukraine, as well as to analyze the tasks of the State Strategy for Regional Development for the period 2021-2027 to ensure cohesion in the state with regard to the use of these tools. Materials and methods. A methodological base of the research is based on results of comparative analysis and theoretical generalisation of modern scientific views and empirical observations regarding application of EU cohesion policy tools in the appropriate spatial and temporal aspect, which were highlighted in publications of both analytical and practical nature. A descriptive analysis was used in order to identify practical challenges of formation of institutional environment for stimulating development of economic growth points and ensuring conditions for their practical activity. Based on a synthesis, a hypothesis of the study was put forward i.e. the author's vision of instrumental provision of territorial cohesion for Ukraine, including tools of regional management, which are relevant in modern conditions in regions, districts and communities of Ukraine. Research results. The article considers the main tools for ensuring cohesion from the point of view of the European Union countries’ experience, which can be adapted to the modern realities of Ukraine, and also offers original tools that, in the opinion of the author, in view of the temporal and spatial context, correspond to the institutional base for ensuring cohesion in regions and communities of Ukraine. Within a framework of the current research, regional management tools have been identified, the use of which promotes territorial cohesion in the regions and communities of Ukraine, i.e.: (1) cooperation, (2) coordination between different sectors of the state regional policy and local policies, (3) incentives, in particular fiscal and financial, (4) improvement of an institutional environment for stimulation of economic growth points’ development and ensuring conditions of their practical activity, (5) effective management of common resources, (6) raising awareness of the essence and goals of cohesion within implementation of state regional policy and local development strategies, (7) information - creation and accumulation of an information base for assessing dynamics of territorial cohesion , (8) education - organisation of improvement of educational schemes for specialists in public administration, territorial development and spatial planning, (9) benchmarking of progress in better use of underused territorial potential and overcoming problems of a territory, (10) dialogue and consultations - formation of a platform for discussions / workshops for working groups of stakeholders of neighboring communities and consensus tools for finding consensus in controversial issues of territorial development, (11) building integrated development strategies and (12) digitalization. The essence and method of using each of the proposed tools for ensuring cohesion in the context of current legislation and practice that has developed in the context of the implementation of the State Strategy for Regional Development for the period 2021-2027 in recent years in the regions and communities of Ukraine is also given. The article also analyses the possibility of using the proposed tools in the aspect of ensuring cohesion in the state, as a task of the State Strategy for Regional Development for the period 2021-2027. Conclusion. The results of the study enable to identify obstacles, which impede maintenance of territorial cohesion in regions and communities of Ukraine by means of using regional management instruments. Based on the research results, it is concluded that in practice, the EU cohesion policy toolkit is not fully implemented in Ukraine. So, not enough attention is paid to the tools of stimulation and construction of integrated strategies. The tools of regional management must be implemented in a specific territorial context for the formation of effective and viable strategies for both regions and individual communities. In addition, encouragement through various types of funding (including grant projects for the development of the territories of individual communities and several adjacent communities) would serve as a necessary prerequisite for the active involvement of interested parties in the development and implementation of projects for the development of territories, forming an initiative from below, and not within the framework of funded projects through the State Regional Development Fund, which must correspond to the State Strategy for Regional Development.

The article presents the process of formation and development of the territorial policy of the European Union and its Member States. The author defines the goals and logic of territorial and political transformation of national territorial and political systems in the context of glocalisation – macro-regional integration of national entities in Europe, where regions are proclaimed the main beneficiary of reforms, and place is proclaimed the topos, the basis of the political process. Place-based politics, development of self-government systems, decentralisation reforms, promotion of local and regional autonomy and systemic asymmetry, where status is determined by the scope of functional responsibilities, are considered as processes of de(re)construction of a new model of polycentric governance and political interaction in the context of formation of an effective supranational political space of the EU. The author examines the peculiarities of the transformation of systemic relations in the EU member states, including the relations between metropolises and non-European remote territories (on the example of France and the Netherlands), and the relations between the supranational centre of the EU and these remote territories of the EU states, which have the specifics of asymmetric involvement in the territorial and political processes of the EU. The author notes that the development of the EU political space is ahead of the process of transformation of the territorial morphology, which is manifested in the expansion of political participation rights at the supranational level and the preservation of restrictions at the national level. The paper notes that the EU’s spatial development strategy is formed on the basis of an institutional compromise between different levels of political decision-making in a multi-level and polycentric system of territorial and political relations and is provided by a set of instruments. This complex is formed by: the policy of vertical and horizontal cooperation; multilevel and polycentric governance; practices of regional and autonomy; asymmetry of statuses and functional roles; 4D decentralisation instruments; standardisation and measurement (indexation) of standards; instruments of consociative democracy, which provide for “inclusion policy”, “effective citizenship”, “mobile political participation” in the context of deepening integration, increasing mobility, and changing the functional significance of the institution of citizenship.

Under the current conditions for the development of local finances, the issue of financial support for the development of territorial communities is especially relevant. According to domestic experience, not all hromadas are completely self-sufficient and able to fully ensure the implementation of socio-economic development tasks. In this case, it becomes necessary to search for additional sources of financial income and alternative instruments to solve issues of local importance. One of these instruments is the cooperation of territorial communities. The the article is aimed at examining the advantages and possible ways to improve the cooperation of territorial communities. Analyzing, systematizing and generalizing the legislative framework and domestic experience, the essence of the mechanism of cooperation between communities, as well as trends in its development in Ukraine, are considered. The relevance of the instrument of cooperation of territorial communities in the context of the introduction of administrative and territorial reform is characterized. The dynamics of the number of concluded agreements on cooperation between hromadas is analyzed. The main forms of implementation of cooperation between territorial communities, their signs and trends of application by local self-government bodies in practice are considered. The key areas in which interested communities cooperate most to solve common problems of socio-economic development are highlighted. The regional distribution of intermunicipal cooperation projects in Ukraine is analyzed. The main advantages of cooperation of territorial communities are characterized and ways to improve this mechanism in the conditions of modern development of local finances are proposed. Prospects for further research in this direction are the development of proposals for spreading the practice of such cooperation in all regions of Ukraine and the creation of stimuli for local self-government bodies to use this instrument to ensure the development of their communities and provide high-quality public services to local residents.

The article explores France's territorial disputes in Europe and beyond (in French overseas territories), as well as disputes settlement approaches adopted by Paris. The author outlines the historical background of the disputes and the motives of France to allocate significant funds in order to maintain high-cost overseas territories, some of them are disputed by regional countries. In Europe France relies on both bilateral mechanisms and EU instruments to settle disputes. The French territorial disagreements with other countries remain more acute overseas. Paris promotes a method of gradual settlement based on the idea that the joint development of disputed areas allows to mitigate contradictions and to create conditions for a long-term territorial settlement. The French overseas Department of Mayotte as a special territorial case is outlined. The Union of the Comoros claims are supported by the UN. The French rationale for retaining Mayotte as part of France despite the UN decision is based on the results of several referendums, when the island's residents voted for this idea.

<p>Desde la creación de la Eurorregión Alentejo-Centro-Extremadura (EUROACE) en 2009, la ordenación territorial de la Comunidad Autónoma extremeña debe considerar un nuevo marco espacial inmediato de relaciones socioeconómicas más amplio y a escala transnacional. Las políticas europeas de cooperación territorial, iniciadas en las postrimerías del siglo XX, han permitido la aparición de sinergias que, hasta entonces, las fronteras nacionales habían impedido. La Iniciativa INTERREG es, sin duda, el pilar fundamental de esta colaboración entre las regiones de los países comunitarios, que con los cinco periodos de programación existentes cumplirá tres décadas. En este nuevo contexto, la región extremeña aprobó la Ley 15/2001, de 14 de diciembre, del Suelo y Ordenación Territorial de Extremadura (LSOTEX), aunque su aplicación íntegra y efectiva no ha tenido lugar. La coherencia de un modelo teórico de planificación territorial prevalente sobre la ordenación urbanística no se ha traspuesto a la realidad. El problema radica no sólo en el exiguo ritmo de aprobación de los instrumentos de planeamiento, sino también en la aparición de éstos fuera de una secuencia espacial y temporal lógica. De esta forma, la ordenación del territorio extremeño comenzó por los Proyectos de Interés Regional (PIR), empleados de manera aislada, aunque muy prolífica, y con mayores implicaciones urbanísticas que territoriales. Posteriormente, la aprobación de Planes Territoriales (PT) ha resultado escasa y descoordinada por la ausencia del modelo territorial que las inéditas Directrices de Ordenación Territorial (DOT) deben proponer. Por lo tanto, Extremadura tiene que explorar caminos diferentes en este ámbito, que muy posiblemente signifiquen desandar lo recorrido y constituir un nuevo cuerpo legal que garantice la congruencia territorial a través de sus instrumentos de planeamiento y contemple su integración en un escenario de relaciones transfronterizas.</p><p>Since the establishment of the Alentejo-Centre-Estremadura Euroregion (EUROACE) in 2009, spatial planning of the Autonomous Community of Estremadura should consider a new immediate spatial framework of wider socio-economic relations and transnational scale. European territorial cooperation policies, begun in the late twentieth century, have allowed the emergence of synergies which, until then, had prevented by national borders. The INTERREG Initiative is, undoubtedly, the key element of this collaboration between the regions of the European Union countries, which will make three decades with the five existing programming periods. In this new context, Estremadura adopted the Law 15/2001, of December 14th, of Spatial Planning and Land of Estremadura (LSOTEX), although its full and effective implementation has not taken place. The consistency of a theoretical model of prevalent land use planning on the urban planning has not been transposed into reality. The problem lies not only in the meager pace of approval of planning instruments, but also in the appearance of these out of a spatial and temporal logical sequence. Thus, frontier territory management began by Regional Interest Projects (RIP), used in isolation, although in very prolific way, and with more urban implications than territorials. Subsequently, the approval of Territorial Plans (TP) has been scarce and uncoordinated by the absence of territorial model, that unpublished Regional Planning Guidelines (RPG) should be proposed. Therefore, Estremadura has to explore different paths in this area, quite possibly means retrace his route and establish a new body of law that guarantees the territorial congruity through their planning tools and considers their integration in a cross-border relations context.</p>

O presente texto discorre sobre a importância dos governos locais no planejamento e ordenamento do território e as conseqüências na conservação dos recursos hídricos. É atribuição dos municípios a elaboração e aprovação de instrumentos relacionados ao ordenamento territorial, tais como os planos diretores e as leis de zoneamento do uso e ocupação dos solos, bem como outras atividades relacionadas à preservação ambiental que em conjunto representam impacto direto nas águas. Por seu papel de instrumento básico de desenvolvimento urbano, o Plano Diretor condiciona a validade de outras leis. É dele a responsabilidade de traçar diretrizes para o ordenamento do uso do solo que deverão ser detalhadas, quando necessário, por leis específicas. Assim, o objetivo dessa comunicação é o de apresentar as formas de organização, em termos de diretrizes de ordenamento territoriais, dos municípios de Londrina, Arapongas, Rolândia e Cambé (norte do estado do Paraná-Brasil), e que possuem, na bacia hidrográfica do ribeirão Três Bocas, território comum. Desse modo, evidenciando a complementaridade e os avanços dos instrumentos de gestão do território urbano e a gestão dos recursos hídricos. The Laws of Use Zoning and Land Use: Instrument for Effective Management of Shared Water Resources ABSTRACT This text discusses the importance of local governments in planning and land use planning and the consequences of such management on the conservation of water resources. IT IS award of the cities the drafting and approval of instruments related to spatial planning, such as the master plans and the laws of zoning of the use and occupation of the soil, as well as other activities related to environmental preservation which together represent direct impact in the waters. For its role in basic tool for urban development, the Director Plan determines the validity of other laws. IT IS his responsibility to draw up guidelines for the planning of the use of the soil should be detailed, when necessary, by specific laws. Thus, the objective of this communication is to present the forms of organization, in terms of guidelines for territorial planning, from the municipalities of Londrina, Arapongas, Rolandia and Cambé (north of the state of Paraná-Brazil), and that they have, in the river basin of ribeirão Three Mouths, common territory. In this way, evidencing the complementarity and the advances of instruments for the management of the urban territory and the management of water resources. Aim. Post-communist planning in Ukraine was essentially transformed over the last years with new approaches, instruments and practices changing the very idea of planning at the local level. As a result, local planning is becoming a mix of multiple usual planning instruments, new optional tools, which have appeared with imported conceptions and widespread participatory practices. This article uses the context of Luhansk region to address the question how this variety of instruments transform the planning processes at the local level in post-transitional perspective. We examine how planning and participatory instruments are developed and combined in the territorial communities of Luhansk region, what are the outcomes and how the main actors evaluate the planning process. Methodology. In this article, we consider how territorial communities use the planning and participation instruments from the standpoints of spatial transformations and place-making, using the experience of the region with a severe planning crisis in recent decades. In order to analyze the state of use of planning and participation instruments at the local level, we focus on planning documents and participatory tools in 26 territorial communities of the government controlled areas in Luhansk region (as of the end of 2021). Additional data for contextualizing empirical information on the planning process, its outcomes and particular instruments were obtained from two focus groups, which involved 35 persons, including local officials, local activists and residents from different territorial communities of Luhansk region. Results. We argue that territorial communities rely on quite diverse planning documents and participatory practices with insufficient focus on planning instruments for balancing the spatial development. Active introduction of the new public participation tools that have become available in recent years had a paradoxical effect in the region, when implementing without reliance on planning instruments. At the same time, many territorial communities are adapting various instruments to specific local context, thus contributing significantly to developing the local institutional environment, creating local success stories and strengthening democratic decision-making. We show that planning instruments, their implementations and outcomes of planning activity in most cases are perceived and evaluated differently by the main actors, however many of them are becoming increasingly aware about planning process and interested in developing the planning culture. Novelty and practical significance. This paper contributes to the discussion on the evolution of local planning instruments, the role and effectiveness of certain instruments in the post-transitional perspective. Understanding the state of affairs with local planning and participatory instruments, their interplay and ability to provide expected outcomes contributes to strengthening of the local planning policy and making it more effective.

Scientific hypotheses are put forward and the provisions of the concept of state regulation of territorial communities spatial development are substantiated: development of united territorial communities is possible only on the basis of a systematic approach to spatial, socio-economic development, improvement of local self-government and modernization of administrative-territorial structure; spatial and socio-economic development of the united territorial communities is based on providing the territories with the fixed own resources and the corresponding powers and responsibilities; territorial boundaries of communities should be formed on the basis of reasonable criteria for possible self-development; instruments of state stimulation and support of united territorial communities vary depending on their type; tools for patrol development of territorial communities are based on geographic information systems. It is proved that the state regulation of spatial development consists in the state information and educational; organizational; methodological and financial support for the development of territorial communities and in the state stimulation of self-development of territories. Conclusions. The main statements of this article will contribute to the formation of a balanced state policy of regulating the spatial development of united territorial communities on the principles of self-sufficiency.

In a world as dynamic as the one we are experiencing now; it is necessary to investigate and reformulate the relationships between production systems and generate more equitable forms of distribution. Cluster networks or leagues have already proven their efficiency in reaching high levels of competitiveness and productivity in certain territorial systems, but given the characteristics of some developing regions, and in particular considering Chaco Austral Region in Argentina, it is important to generate a or model that catalyzes, through current resources, a transition towards change or improvement of the agro-industrial matrix from the point of view of bioeconomy, and therefore also towards a sustainable development of this territory, and necessarily that serves as model to apply in other territories with similar characteristics. For the study of the production units at the territorial, sectoral and business levels from the bioeconomic point of view, this work will consider, as a unit of analysis, a network of Productive Clusters preponderant at the regional level, with the territory as an operating framework. driving force in a center-periphery context, where development strategies are influenced by relations between different territories in an asymmetric hierarchy of power and flow of resources (typical of developing regions). Com a Constituição de 1988, obrigando as cidades com mais de vinte mil habitantes a elaborarem ou revisarem os seus planos diretores, e com a promulgação do Estatuto da Cidade (2001), regulamentando os instrumentos previstos constitucionalmente, vários trabalhos foram publicados em um contexto estimulante e polêmico que, sem dúvida, deverá continuar a alimentar o diálogo entre planejadores urbanos e especialistas em direito urbanístico: estimulante, por significar a retomada do planejamento municipal, e polêmico, porque os textos legais estão sujeitos a diferentes interpretações. É exatamente nesse ambiente que se insere a presente reflexão, trazendo à tona a importância do Plano Diretor como instrumento de planejamento municipal, discutindo se ele deve se conformar como um plano geral de desenvolvimento ou privilegiar o ordenamento territorial, propondo uma base conceitual para a sua elaboração e, finalmente, indicando os desafios da gestão do seu processo de elaboração e implementação.Palavras-chave: Estatuto da Cidade; planos diretores; planejamento urbano. Abstract: Along with Brazil’s 1988 Constitution came the obligation for cities with a population larger than 20.000 to elaborate or review their Master Urban Plans. Later the Estatuto da Cidade (2001), regulated a series of instruments that the constitution anticipated. Since then many papers have been published in this stimulating context. This new predicament will, undoubtedly, enrich the rapport between urban planners and specialists in urban law. This paper fits exactly in this new milieu, emphasizing the significance of Master Urban Plans as an instrument of local planning, and the discussion whether these plans should be general development instruments or should privilege territorial aspects. The problem of formulating the regional policy principles in Ukraine is considered in the context of current spatial development challenges, the use of territorially oriented and security approaches. The problem areas in the regulatory and legal mechanism of state regional policy have been identified, namely: the regulation of the regulatory aspects of state regional policy exclusively by law and the implementation of European instruments in the field of regional development; implementation of territorial communities’ territories into the national system of administrative and territorial organization; unification of typologies for the functional types of territories in current legal acts of the state; effective coordination and integration of various policies in the field of regional development. Proposals have been developed for a set of legislative changes in the context of forming an efficient interlinked planning system for the functional and spatial development of the state, regions, and territorial communities, which provide for: harmonizing the principles of state regional policy as a component of Ukraine's internal policy with the Guiding Principles for the Recovery Process in Ukraine (the Lugano Principles) and the Guiding Principles for Sustainable Spatial Development of the European Continent; implementation of national spatial development conception, regional spatial development conceptions, integrated development conception for territorial community’s territory as documents that determine the long-term, interdisciplinary, spatial and socio-economic priorities of the balanced development of corresponding territory and are the basis of the system of interlinked strategic planning documents and the implementation of state regional policy; implementation of an innovative smart specialization-based model of functional and spatial development of the territory; implementation of mechanism for creating spatial planning documentation via the geo-informational platform Spatial Development Planning as an integrated and site-oriented unique policy tool for functional and spatial development of the territory and transformation of the socio-economic environment taking into account the European Green Deal.

Economic zoning is an important instrument of regional policy; however, its impact upon solution of the territorial issues of macroregions that are built on other (noneconomic) grounds remains quite ambiguous. This research is dedicated to verification of the hypothesis on possibility of reducing the discrepancy between the parameters of territorial development as a result of their unification into a macroregion, which is formed primarily on the administrative principles. Research methodology leans on assessment of the parameter variations of interterritorial disparities in retrospect; methodological toolset includes the calculation of coefficients that characterize the degree of heterogeneity of cumulative data (coefficients of variation, asymmetry, and excess). The article uses the example of the Ural Federal District. The conducted analysis reveals that the scale of intraterritorial disparities typical for the district at the stage of its formation has not decreased over time; moreover, the difference between the parameters of the development of individual regions has increased. It is proven that the unification of territorial systems solely through administrative transformations does not mitigate the problems of excessive asymmetry of their development; and connectedness of the regions that proceeds from such transformations is often nominal. The acquired conclusions offer a critical insight into the instruments for managing socioeconomic processes in the territories of different levels, and can be taken into account in implementation of the regional policy.

The article deals with the topical problem of spatial development of territorial communities. The study aims at creating a methodical approach to identifying the problems in the functioning of territorial communities, the former being caused by unstable conditions, and the areas of spatial development of territories using a problem-oriented approach. The application of a problem-oriented approach to the spatial development of territorial communities is substantiated. The approach provides a set of actions in public administration and influences aimed at solving theoretical or practical problems of efficiently using local community resources by gaining new competitive advantages, creating favorable living conditions, ensuring population loyalty through actively solving the already existing and possible problems in community functioning. Within the problem-oriented framework, the spatial development of united territorial communities involves an approach based on the hypothesis that using the strategic capacity of a territorial community is not a problem-free process, and the arising problems require analysis and sound management decisions at the community level and within the powers of local authorities. A methodical approach to identifying problems with the functioning of territorial communities in an unstable environment is suggested. Namely, it involves analyzing the following issues: a) development level of united territorial communities through evaluating their resource provision and self-assessment of their development level, which helps to draw conclusions as for the effectiveness of using the community resources; b) legislative support for the spatial development of territorial communities; and c) the existing mechanisms, methods, and instruments of the state policy on the spatial development of Ukrainian territories. A cognitive map of interrelations between the existing problems of the spatial development of territorial communities has been drafted, in which four groups of problems are identified, in particular: 1) problems within the spatial development of territorial communities, and those connected with Ukraine’s territorial system; 2) problems of socio-economic development based on self-sufficiency; 3) problems in the local self-government system; 4) problems of rural development.

AbstractDespite the EU's lack of competence on spatial planning, mainly due to the Member States' reluctance to give up some of their sovereignty in this area given the strategic nature of territory, a pan-European approach providing solutions to all its problems has become urgent and necessary. Moreover, the accession of 10 new Member States has entailed an enlargement of the EU territory, requiring a deeper analysis of the new situation which has led to the emergence of 'sustainable territorial development' as the common element between the multilevel relationships set by the European Governance White Book of the European Commission and the provisions of the ESDP. In fact, with the preparation of this and other European soft law documents, the EU has found an effective type of instrument to deal with the territorial problems without requiring any competences in the area of spatial planning for its actions. In this way, a clearer means of achieving the emerging objective of sustainable territorial development has been developed.

The author deals with the issue, that has been widely considered in a number of scientific researches and has been regularly raised by Japan, — the problem of the so called “northern territories”. Having analyzed various international legal instruments, domestic and foreign scientists’ research papers, the author pays attention to some translation inaccuracies between the original text and the text in the Japanese language in the Simoda treaty, 1855, and the Saint-Petersburg treaty, 1875. Those mistakes have been used by Japan to prove the thesis that the term “the Kurils” doesn’t include Iturup, Kunashir, Shikotan and the Habomais. Besides, special attention is paid to the analysis of international legal instruments that were adopted during and after the World War II, for the purpose of ascertaining whether the Japan territorial claims are well-grounded. At the end of the article the author offers the way to overcome the long-standing “Kuril problem”.

Russia’s war against Ukraine has exacerbated challenges and risks to community development. Improving the ability to withstand the shocks of the external and internal environment, adapt to changes in the security environment, respond to threats, maintain sustainable functioning, and recover to the desired equilibrium will contribute to strengthening the resilience of communities. Budgetary instruments are crucial for ensuring the resilience of communities in such conditions. This study aims to identify the impact of budgetary instruments on ensuring the resilience of territorial communities amid the war in Ukraine (the case of Lviv oblast). The methods include a systemic and structural approach (building an information and analytical model of resilience research) and indicative and GAP analysis (identifying the impact of budgetary instruments on community resilience, in particular, local taxes, transfers, and personal income tax (PIT)). The data of 73 communities in Lviv oblast for 2021–2023 were collected. The study shows that the resilience of the territorial communities of Lviv oblast during the study period was at a moderate and above-moderate level; most were in the zones of resistance (resilience indicators ranging from 0.43-0.65) and decreasing resilience (0.42-0.20); the resilience of 8% was at a critically low level (2022–2023). The results estimate that the resilience of 90% communities in 2024 will not change significantly if military PIT is redirected from local to state budgets, except for those communities whose resilience is highly dependent on the amount of military PIT (the decrease in resilience will range from 12.5 to 4.2 percentage points).

Nos últimos anos as indicações geográficas (IG’s) têm sido consideradas como indutoras de desenvolvimento de uma região, com a valorização dos recursos territoriais e possibilitando o surgimento de novos nichos de mercados. Nesse contexto, o trabalho tem por objetivo compreender as políticas públicas como instrumentos indutores do desenvolvimento para os territórios que tenham o registro de indicações geográficas. A pesquisa se caracteriza como descritiva, bibliográfica e um estudo de caso. Decorrente da valorização dos recursos territoriais com a possibilidade do surgimento de novos nichos de mercados, nos últimos anos as IG têm sido consideradas como indutoras de desenvolvimento de uma região, principalmente a partir de políticas públicas. E este fato pode ser verificado na região delimitada pela Indicação de Procedência dos Vales da Uva Goethe. Neste sentido, as IGs podem ser pensadas como uma ferramenta de ocupação harmoniosa do espaço cultural produtivo, aliando a valorização de um produto típico e seus aspectos históricos e culturais, à conservação da biodiversidade e o desenvolvimento rural. In recent years, geographical indications (GIs) have been considered as inducing the development of a region, with the valorization of territorial resources and allowing the emergence of new market niches. In this context, the study aims to understand public policies as inducing instruments for the development of territories with geographical indications. The research is characterized as descriptive, bibliographical and a case study. Due to the valorization of the territorial resources with the possibility of the emergence of new market niches, in the last years the GIs have been considered as inducers of development of a region, mainly from public policies. And this fact can be verified in the region bounded by the Indication of Origin of Goethe Grape Vales. In this sense, GIs can be thought of as a tool for harmonious occupation of the productive cultural space, combining the valorization of a typical product and its historical and cultural aspects, biodiversity conservation and rural development.

The article analyses national projects as a key element of the Russian territorial administration system and reviews management tools of regional and municipal executive authorities. The object of research is a system of territorial management. The subject is the peculiarities of the program and municipal methods application in a territorial management system. The goal is to determine the nature of the territorial administration system transformations and the role of municipal instruments in it. The authors use methods of systematic historical and institutional analysis. After systemic transformations, national projects are adapting to new economic and political conditions. Municipal instruments are relevant measures that have not yet been applied at the federal level, or have been applied to a limited extent. Regional or municipal authorities independently develop measures to improve management processes, which can later be applied at the federal level. Often such initiatives are designed to promote government transparency, establish communication channels between the state and society, optimize the interdepartmental interaction, improve the state institutions' tools of information and data management, etc. The key disadvantage is differences in the results due to lack of a unified approach to their application.

Introduction. The article considers the scientific principles of solving the problem of intensifying of territorial communities cooperation in the field of economic development based on the use of mechanisms and tools of financial, budgetary, organizational, informational stimulation of communities cooperation, according to their specialization advantages, prerequisites for building and improving of horizontal links. Goal of the article is to identify scientifically substantiated measures to stimulate economic development and cooperation of communities in Ukraine using mechanisms and tools of financial, economic, tax, organizational, information support for joint participation in the inter-territorial division of labor. Research methods: for the solving of the problem methods of statistical, logical, systematic analysis are used to identify the causes of changes in the dynamics of cooperation agreements of communities, and the method of synthesis of mechanisms and tools to enhance cooperation of local communities in economic development are also used. Results. The assessment of institutional support, dynamics and structure of territorial communities cooperation in Ukraine is carried out and the tendency of increase and gradual decrease of activity of their cooperation is revealed. Referring to the international experience of community cooperation, it is established that with the help of inter-municipal cooperation it is possible to ensure the socio-economic development of territorial and economic systems on the basis of their joint implementation of investment, social-economic projects. It is also substantiated the necessity of creating of objective conditions for the increasing of interest of communities in the implementation of economic cooperation, the development of which in the territorial communities of Ukraine is still quite low, The mechanism of stimulating of economic development and cooperation of communities in Ukraine with the use of tools for financial cooperation, by improving the existing system of horizontal equalization of territorial communities capacity, using resources of national regional development funds, European support programs, as well as tax instruments to stimulate cooperation, including such local tax as land tax, the rates of which are to be differentiated depending on the passage of a particular project of inter-territorial economic cooperation payback stage. . Prospects for the study are seen in the further, deeper assessment of the effectiveness of the proposed mechanisms and tools of stimulation of economic cooperation of local communities from the standpoint of expanded interpretation of the concept of sustainable development, with economic, budgetary, social and environmental components.

Albania, for 30 years, has entered the phase of transition from a society organized into a one-party central governing regime to a democratic society of a free market economy. But the pace of moving in this direction and modernizing the country is not the expected one, because the centralized proclamations of the political elite and expertise have not allowed liberal approaches to enter Albanian legislation and governing practices. This has been the case in particular in the sector of territorial planning, where central governments have aimed and managed to not allow the actual decentralization of the governing function of drafting and adopting local territorial planning instruments. This has resulted in a shortage of local instruments, in general, but even when managed to ensure they are presented far beyond the needs, problems and objective local imbalances. This is because their distance mapping from the actual municipality for which they were designed failed to recognize the specifics and characteristics of each of them. The result has been evident; in both cases, planning has been inexistent to drive sustainable, smart and inclusive urban development processes. In this paper we aim to build another approach for future development in Albania, a country which aims at integration into the European Union. This path should be development based on previously adopted territorial planning instruments, drawn up in democratic and parliamentary processes as a local political activity. Central government must understand and accept the new and different role than the one it played 30 years ago in territorial development issues, and that the process of drafting and adopting local territorial planning instruments should be a function of local government itself.

According to core UN and Council of Europe human rights treaties each state party undertakes to respect and to ensure (or to secure) to all individuals within its territory and/or subject to its jurisdiction the rights (and freedoms) recognized in the treaties. Provisions of this kind suggest that the rights recognized in the treaties are rights of everyone everywhere. Nevertheless, there are certain well-known exceptions. The problem with these exceptions is a) that they are conceived as exceptions to ‘everyone’, although they are exceptions to “everywhere’, b) that they are not in fact exceptions but different kinds of rights and c) that many more, at least 16 rights are affected. In other words, this study shows that the rights recognized in the said instruments are divided into three groups: a) non-territorial rights (which everyone has everywhere in the world), b) territorial rights (which everyone has somewhere in the world) and c) territorially mixed rights (which everyone has partly everywhere and partly somewhere). This new classification is likely to contribute to a deeper and better understanding of human rights and human rights principles (in particular non-discrimination and equality) and to a more uncontroversial implementation of human rights treaties.

Observing the political processes taking place in the modern European Union, one can see the anchoring of the position of the cohesion policy as one of the most important policies of the organization, and within it its growing role of “territorial cohesion”. In legal terms this is reflected even in Treaty on European Union, and clearly confirms the same meaning given to the territorial dimension as economic and social dimensions were given in previous treaties. This fact, can have a significant impact on the shaping of the future of European territorial cooperation – its priorities, benchmarks, implementation forms and purposes. Increasing importance of territorial cooperation is strictly connected with the role of the European Grouping of Territorial Cooperation (EGTC), which is one of the most important new instruments for its implementation.

EVALUATION OF THE DEVELOPMENT AND TERRITORIAL PLAN OF THE RURAL PARISH MEMBRILLAL, JIPIJAPA, MANABÍRESUMENLos Planes de Desarrollo y Ordenamiento Territorial Parroquial (PDOT’s), son instrumentos de planificación, elaborados de forma participativa con la sociedad civil y actores territoriales. La parroquia Membrillal, está ubicada al noroeste del cantón Jipijapa, su clima es Tropical Seco, Sabana de Costa. La principal actividad económica es la agricultura, destacándose el cultivo de maíz (Zea mays L.) que lo producen en el periodo invernal aprovechando las lluvias. El objetivo de la investigación fue evaluar el sistema económico del PDOT’s en la parroquia Membrillal, Jipijapa, Manabí, Ecuador, enfatizando en aquellos que inciden en la seguridad alimentaria local. Se realizaron visitas periódicas y entrevistas a la población local. Se obtuvo que de 14 proyectos establecidos, solo el 35% obtuvo la meta establecida. Los proyectos ejecutados por el Gobierno Autónomo Descentralizado (GAD) han generado fuentes de trabajo para los miembros de la comunidad. Se consideró evaluar anualmente el PDOT para verificar los logros en función a la conservación del medio ambiente y los recursos naturales. Se recomienda socializar los resultados de la evaluación con la comunidad de tal forma que permitan delinear estrategias a favor del desarrollo local. The Membrillal parish, is located northwest of the canton Jipijapa, its climate is Tropical Dry, Sabana de Costa. The main economic activity is the agriculture, standing out the cultivation of corn (Zea mays L.) that produce it in the winter period taking advantage of the rains. The objective of the research was to evaluate the economic system of the PDOT's in the parishes of Membrillal, Jipijapa, Manabí, Ecuador, emphasizing those that affect local food security. Periodic visits and interviews were made to the local population. It was obtained that of 14 established projects, only 35% achieved the established goal. The projects executed by the Autonomous Decentralized Government (GAD) have generated sources of work for the members of the community. It was considered to evaluate the PDOT annually to verify the achievements in terms of the conservation of the environment and natural resources. It is recommended to socialize the results of the evaluation with the community in such a way that they allow delineating strategies in favor of local development.KEYWORDS: Local development; ordering plans; Membrillal; planning instruments.

Resumo:
The wider interpretation of the mountain policy notion is outlined. The entities and objects of domestic mountain policy, its forming principles, objectives and tasks are defined. Analysis of parameters of economic development level of mountain regions in Lviv oblast is performed and their negative dynamics is determined. Conclusions are made on low efficiency of mountain policy instruments applied in Ukraine and necessity of their improvement, including through implementation of the best European practices. The mechanisms of mountain territories’ development maintenance applied in European countries are studied. In particular, attention is paid to opportunities for Ukraine to use the instruments of territorial development that encompass not only the EU member states but the neighboring ones as well. In this context the peculiarities of application of new European instrument of countries’ and regions’ cooperation – macro-regional strategies – are shown. The initiative on development with Ukraine’s participation and adoption by the EU authorities of the Carpathian Macro-regional Strategy (MRS) is emphasized. Spatial limits of Carpathian MRS are presented and its priority spheres, most important objectives and tasks are revealed. The issues of introduction of special investment activity regime at Ukraine’s mountain territories are addressed as well. On this basis the attraction of investment into priority economic activity types compatible with ecological features of mountain territories, their natural and resources basis and economic traditions are promoted. Conclusions confirm the necessity to develop and implement modern policy of mountain territories’ development in Ukraine, based on economic support, increased competitiveness, prevention of depopulation, preserving the ecological function and ethno-cultural heritage of mountain regions.

There are various challenges in today's world, such as economic crises, global pandemics, and climate change, which have a major impact on the financial resilience and development of local communities. Today, the decentralization process has been completed, with territorial communities gaining more powers and responsibilities. Understanding the factors that contribute to the financial resilience and development of these communities is crucial to ensure their efficiency and viability, as well as opportunities for improved public governance, cost optimization, and more efficient use of resources. The article aims to examine the factors increasing the financial capacity and development of territorial communities in the context of modern challenges. Results. The article identifies internal and external factors for increasing the financial capacity of territorial communities. The advantages of the competitiveness of territorial communities are studied, and the main features for strengthening their financial stability are identified. The possibilities of local communities are considered in determining the attractiveness for investment in their territory, accounting for available resources and ways of their use, the use of labor, as well as the benefits that may arise during the relocation of enterprises due to active armed conflicts in a large territory of the country. Conclusion. Investment resources of territorial communities and the possibilities of their use are characterized. The investment attractiveness of territories is determined. The objects of investment activity may include any property, fixed assets, current assets in all sectors of the national economy, securities and targeted cash deposits, scientific and technical products, property rights, and resources. The instruments of investment attraction, their legal basis, and their effectiveness for the development of territorial communities are substantiated. Decision-makers, planners and administrators involved in different policy domains at different governance levels face the important challenge of fostering more balanced, sustainable and territorially integrated development. Well-designed, multi-level, multi-sector and multi-actor governance arrangements can play a key role in this process through orchestrating the interplay between different spheres, activities, actors and interests. In this paper, we examine the role of spatial planning in improving the relations between rural, peri-urban and urban areas. We analyse the strengths and limitations of spatial planning and explore the connections with territorial development. The methodology used for this analysis combines regional case studies in seven European locations—Ede, Frankfurt/Rhein-Main, Styria/Graz, Helsinki, Lisbon, Lucca and Mid Wales, with rapid appraisals, the analysis of published data, expert judgement and triangulation. We ask under which conditions spatial planning can induce more balanced, sustainable territorial relations, and look at the contribution planning can make to achieving sustainable development goals. The problem of ineffective (or toothless) plan implementation provides the entry point into the analysis and discussion. We illustrate why mutually beneficial relations between urban, peri-urban and rural communities (and territories) cannot simply be planned. Instead, these relationships need to be supported by strategies, policy instruments and governance arrangements that foster synergies between different actors and activities. The planning process itself needs to become more transparent and participatory. We conclude that the questions addressed in this article in an exploratory fashion merit further research especially as a more sustainable and territorially integrated development is becoming increasingly important in European policy making.

Abstract The year 2019 saw the arrival of the Hague Judgments Convention and Mainland China-Hong Kong SAR Judgments Arrangement, which is not a coincidence. Both instruments mark a historical culmination and constitute a milestone, at the global level and the at the level of territorial units within a country respectively. With novelties created to avoid the failures shadowing the past Hague Judgments Project, the 2019 Convention reflects the global trend and maximizes the common grounds countries could agree to, though it still falls short of some longstanding expectations. Similarly, the 2019 Arrangement advances judgment circulation between territorial units within China despite that room for further collaboration is still large. In significant respects, the 2019 Arrangement is heavily modelled on the 2019 Convention, while the Arrangement also addresses special concerns of the two regions. Undeniably, it may be another success for the Convention to be able to influence judgments recognition instruments targeting territorial units within a country and show its model effect. Recent years have witnessed Mainland China’s efforts to promote transboundary movement of judgments and its contribution to the arrival of both the 2019 Convention and Arrangement. As an important global player with increasing ambition of claiming more international presence, China will welcome both instruments and the instruments are expected to fare well as desired.

The progressive development of each country is the result of an effective management system at all levels of economic administration. Of particular importance is regional (territorial) development, due to the growing role of public regional management, the formation of local self-government, the influence of public organization of power on the socio-economic development of territories. In the context of activation of processes of decentralization of power, public management, transfer into the regions of certain powers to local authorities and increased responsibility for their activities significantly expands the socio-economic status of certain territories (regions, communities), the issues of development and stimulation, availability of effective mechanisms and instruments for socio-economic development of region (territories, communities, etc.) are becoming relevant. The existence of regional development problems in Ukraine with clear signs of increasing disparities of socio-economic indicators, increasing the number of problematic and backward territories, exacerbation of interregional socio-political tensions necessitates studying the world experience of functioning and development of territorial socio-economic systems and opportunities for the use of best practices for the formation of their own regional policy on the basis of effective management of territorial development in the conditions of decentralization of power. Changes in the legislation of Ukraine in terms of decentralization of power should concern the consolidation of the constitutional basis of local self-government, determination of its system and functioning with further detailed legislative regulation. This, on the one hand, will ensure the constitutional guarantee of local self-government, on the other hand – will provide a legal framework for its further development and improvement.

Topicality. Territorial communities as centers of self-organization and self-governance of the society must have significant economic potential to maintain their own ability and self-sufficiency for successful implementation of the economic, social and other functions, assigned to them. Particularly relevant is the issue of regulatory support for the economic development of territorial communities for the region of the Ukrainian Danube - a place of concentration of significant natural and economic resources, geopolitical prospects for development, as well as internal and transboundary challenges. Low indicators of the socio-economic development of the communities in the Danube region determine significance of tax regulation of economic activity, according to fast and systematic nature of the action of fiscal stimulants. The possibilities of modern process of power decentralization, of local self-government system reforming and budgetary system allow the use of tax instruments as levers of support for the development of united territorial communities and actualize the need to determine the scientific principles of tax regulation of territorial communities (on the example of the Ukrainian Danube).Aim and tasks. The purpose of the article is to identify the conceptual framework for the regulating of the economic development of territorial communities through tax instruments, for example, local taxes and fees, management of which is possible at the local level due to modern changes in budget legislation caused by the reform of local self-governance. Conceptual principles of tax regulation of economic development of territorial communities (on the example of the Ukrainian Danube) should be identified and disclosed in the aspect of the implementation of the European ideology of tax investment competition of territories that are promising for the implementation of certain projects as a lever for supporting of the development of economic growth. Measures of tax regulation of investment development of territorial communities are proposed to be developed and implemented taking into account the new institutional capacity that opens the process of decentralization and on the basis of world experience.Research results. The conceptual principles of tax support for the development of territorial communities with help of investment activity stimulation, promotion and implementation of investment projects, taking into account the influence of decentralization processes, are considered. The possibility of the using of local taxes as tools for business activity regulation of the territorial communities is substantiated by the newest institutional transformations that take place through the process of voluntary association of territorial communities in Ukraine and the Black Sea region, in particular, the general conceptual framework for tax regulation is defined. On the basis of the analysis of statistical data on investment and general economic development of Ukraine, Odesa region and the Danube region, it was established that the level of socio-economic development of regions and territorial communities is 4-5 times lower than of towns – regional centers. Despite numerous measures to intensify investment development, there is no significant progress in economic recovery stimulation. The experience of implementation of such measures to stimulate business activity as creation of special (free) economic zones, granting of tax privileges to economic entities by branch, territorial and other features is analyzed, and the level of effectiveness of such regulators is low. The classification of types of tax incentives for the development of territorial communities according to the degree of concentration and localization is proposed. Based on the study of the best world practices and given the results of logical analysis, it has been established that the most promising for the territorial communities are project-oriented levers of tax incentives for socio-economic development. A set of measures to promote the implementation of investment projects in the community on the basis of the use of local taxes, such as: land tax, transport tax, environmental taxes, excise taxes and non-local tax on personal incomes, is proposed.Conclusions. It has been established that taxes as fast and effective levers of regulation of economic activity should be used to stimulate the socio-economic development of territorial communities on a well-founded scientific basis and using the principles of systemicity, purposefulness and priority. The conceptual framework, the system of principles, mechanisms and instruments for tax incentives for socio-economic development of territorial communities constitute the subject and the prospects for further research in this direction.
